  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-025929-0007-CO \n\nRes. Nº 2026031135\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto Nombre02, cédula de identidad CED02, a favor de Nombre03, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de esta Sala el 20 de julio de 2026, la parte recurrente, presenta recurso de amparo y manifiesta que el amparado tiene muchos años de vivir en su propiedad ubicada en Heredia y siempre ha tenido acceso al agua potable sin mayor inconveniente, incluso, tiene asignado el NIS 5349625. Indica que, recientemente, por necesidades de crecimiento familiar, requiere una nueva conexión de agua potable, pero, las autoridades recurridas, le exponen que en la actualidad no hay disponibilidad de agua en la zona y que la cantidad de agua es poca. Manifiesta que el amparado, el 05 de mayo de 2026, se apersonó a solicitar una constancia de servicios existentes para establecer que si hay capacidad hídrica en dicha zona. Narra que no ha obtenido respuesta a su solicitud. Incluso no se observa que el recurrido tuviera alguna clase de problema o inconveniente con la gestión pues enviaron al correo para notificaciones ...01, un mensaje que expresaba lo siguiente: “AYA le informa que la Constancia de Servicio existente de agua potable con caudal inventariado y/o de alcantarillado sanitario con caudal inventariado y/o de alcantarillado sanitario, NIS: 5349625, se encuentra en trámite”. Reclama que han transcurrido tiempo y plazos desproporcionados para que el amparado, que es un adulto mayor, pueda tener acceso al documento oportunamente gestionado ante la institución, violentando así sus derechos fundamentales.\n\n2.- Por resolución de las 15:39 horas del 27 de julio del 2026, se dio curso al presente amparo (ver registro electrónico).\n\n3.- Informa bajo juramento RAQUEL AGLIETTI DÍAZ, JEFA DE LA UEN SERVICIO AL CLIENTE DE LA GAM AYA que: “Con fundamento en los memorandos No. UEN-SCMED-GAM-2026-01511, elaborado por Carlos Quirós Mora, funcionario de la UEN Servicio al Cliente Medición GAM, con fecha 29 de julio del 2026, memorando No. UEN-SCCAT-GAM-2026-01890, elaborado por Pool Stuart Barquero Arce, funcionaria de la UEN Servicio al Cliente Catastro GAM, de fecha 28 de julio del 2026 y memorando No. UEN-SCCAT-GAM-2026-02840, elaborado por Nuria Chaves Villalobos, funcionaria de la UEN Servicio al Cliente Catastro GAM, de fecha 28 de julio del 2026 y los cuales se ofrecen como pruebas y forman parte integral del expediente administrativo, queda debidamente demostrado que: PRIMERO: Efectivamente, existe una gestión ingresada al Sistema Integrado para Gestión de Disponibilidades y Desarrollos (SIGDD), el día 08 de abril de 2026, bajo el número 2026-00008154-1 tramitada para la finca N.º PRN01 localizada en distrito San Pablo, cantón San Pablo, provincia Heredia, según Plano Catastro N° 4-0113704-1993, a nombre de Nombre03. Se refiere a una solicitud de disponibilidad de servicio resuelta de manera negativa, indicándole al solicitante que la infraestructura de producción y de distribución en el sector, es insuficiente para este tipo de desarrollo, mismo que está incluido dentro del sistema ME-A-15 San Pablo del Acueducto Metropolitano AyA; el cual corresponde a las áreas en los que, por su ubicación y por deficiencias en la capacidad hídrica y capacidad hidráulica de los sistemas de abastecimiento, no se tiene disponibilidad de agua para más de una unidad de consumo por inmueble. Por lo tanto, se determina que no existe factibilidad técnica para otorgar la disponibilidad para agua potable y en cuanto al sistema de alcantarillado sanitario, este no se encuentra disponible en la zona para nuevas conexiones. Se certifica que, a la fecha de emisión de este documento, sí posee servicios con AyA identificado con el Número de Identificación de Servicio (NIS) CED01 se concluye que NO EXISTE DISPONIBILIDAD DE AGUA POTABLE FRENTE A LA PROPIEDAD. NO HAY DISPONIBILIDAD SISTEMA DE ALCANTARILLADO PARA LA PROPIEDAD. Dicha gestión fue finalizada y materializada el 29 de abril de 2026, y remitida al correo ...01 informándole expresamente al gestionante sobre los recursos procedentes y el plazo legal establecido para su interposición. (Ver PRUEBA 1 memorando No. UEN-SCMED-GAM-2026-01511) SEGUNDO: Dentro del plazo conferido no se presentó recurso alguno contra la resolución emitida, no obstante, este es el momento oportuno para ampliar el fundamento de la denegatoria en la constancia. Se reitera que no existe factibilidad técnica para otorgar la disponibilidad positiva para abastecimiento de agua potable, debido a que la Infraestructura de producción y de distribución en el sector, es insuficiente para este tipo de desarrollo, el cual es parte del sistema ME-A-15 San Pablo del Acueducto Metropolitano AyA, cuyo estado es deficitario. Así las cosas, el objetivo de emitir actos administrativos que otorguen o denieguen servicios en una zona determinada, está basado en la realidad existente, en cuanto capacidad hídrica, capacidad de recolección y condiciones de orden ambiental que ofrecen o padecen los sistemas de AyA, en un punto determinado. Lo anterior, tomando como fundamento los “estudios básicos” e incluso, estudios de naturaleza más específica, dependiendo del proyecto, que son la base para dictar el acto. El sistema ME-A-15 San Pablo tenía una capacidad hídrica de 3.1 l/s, aproximadamente, según memorando UEN-OS-GAM-2025-00160, emitido por la UEN de Optimización de Sistemas GAM, de fecha 06 de julio del 2025 pero dicha capacidad hídrica se actualizó, según oficio UEN-OS-GAM-2025-00592, de fecha 05 de diciembre del 2025, cambiando la condición del sistema a -1.4 l/s, categorizándolo a estado deficitario. Con base en la información anterior y de acuerdo con el Reglamento para la Prestación de los Servicios, particularmente artículos 7 y 10, se determinó que al ser zona deficitaria, el consumo no puede ser mayor al de una vivienda unifamiliar o comercio individual. Como se indicó en el apartado anterior, esta condición ya la tiene el inmueble, pues posee un servicio con AyA, identificado con el Número de Identificación de Servicio (NIS) 5349625. Consecuentemente, cuando se rechaza una solicitud de disponibilidad de agua, no se hace de forma arbitraria o antojadiza, sino que obedece a un fundamento técnico, donde se evidencia LA FALTA REAL Y ACTUAL de capacidad hídrica y/o hidráulica del acueducto. Por consiguiente, en la actualidad el sistema ME-A-15 San Pablo se encuentra deficiente en cuanto a su capacidad hídrica, siendo la denegatoria respaldada por los artículos 7 (inciso 12, 129), 8, 9, 10, 14 y 74 del Reglamento de Prestación de Servicios de AyA. Aunado a lo anterior, el Reglamento para la Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes. AR-PSAYA-2013 resolución N° 54-2014, del 18 de setiembre del 2014 mediante el Alcance N°50 y su modificación llamada “Prestación de los Servicios de Acueducto, Alcantarillado e hidrantes AR-PSAYA-2015 mediante resolución N° RJD-053-2016 por Alcance 55 por LA Gaceta N°69 el 12 de abril del 2016, establece en su numeral 9 que en ningún caso se autorizarán expansiones que comprometan el recurso hídrico existente o la capacidad del Sistema de Alcantarillado y su tratamiento, en perjuicio de la comunicad servida o de los habitantes de los eventuales nuevos desarrollos. Si bien es cierto, el suministro de agua potable es un servicio público, también es claro que se debe velar por el cumplimiento del principio de legalidad, que rige a toda la Administración Pública, y consiste en acatar su propia Reglamentación, sin hacer salvedad alguna, esto significa que el derecho al agua no exime del cumplimiento de los requisitos definidos en el Reglamento de Prestación de Servicios de AyA. Por último, es importante mencionar el artículo 11 de la Constitución Política de Costa Rica, el cual cita textualmente: “Los funcionarios públicos son simples depositarios de la autoridad. Están obligados a cumplir los deberes que la ley les impone y no pueden arrogarse facultades no concedidas en ella. Deben prestar juramento de observar y cumplir esta Constitución y las leyes (…)”. (Ver PRUEBA 1 memorando No. UEN-SCMED-GAM-2026-01511). - TERCERO: En cuanto a la CONSTANCIA DE SERVICIO EXISTENTE DE AGUA POTABLE CON CAUDAL INVENTARIADO Y/O DE ALCANTARILLADO SANITARIO CON CAUDAL DE DESCARGA AUTORIZADA, se generó el Consecutivo No. UEN-SCCAT-GAM-2026-01890, del 29 de mayo del 2026, que indica que a la fecha de emisión de este documento se encuentra registrado en la base de datos del Sistema Comercial Integrado (OPEN S.C.I.) la conexión de agua potable identificada con el Número de Identificación de Servicio (NIS) 5349625, a nombre Nombre03, código localización PRN02, el cual abastece la finca con matrícula de Folio real PRN03, según Plano Catastrado H-0113704-1993, Provincia Heredia, Cantón San Pablo, Distrito San Pablo. Se señala que el servicio con Tarifa Metropolitana Residencial, Sin Alcantarillado Sanitario, se encuentra al día con sus obligaciones de pago a la fecha de emisión de esta constancia. Se advierte además, que este documento se emite exclusivamente para indicar las condiciones de uso actual registrado en el Sistema Comercial, para que el propietario registral, poseedor o representante legal del inmueble, demuestre la existencia material y actual del servicio de agua potable y/o alcantarillado sanitario; ante otras personas, instituciones o empresas interesadas, que la solicitan como requisito para la gestión de trámites bancarios, permisos municipales, permisos de funcionamiento, aprobación de bonos de vivienda, trámites ante el APC; que no implique aumento en el caudal inventariado a favor del inmueble. Tampoco garantiza la existencia de servicios adicionales ni autoriza el cambio de uso autorizado para dicho servicio. Cualquier requerimiento adicional de servicios, debe tramitarse como una solicitud de disponibilidad de servicios nueva, de conformidad con la normativa y procedimientos vigentes. Esta constancia de servicio no tiene los efectos de una disponibilidad de agua para un uso distinto del expresamente indicado, así como tampoco posibilita el cambio de uso autorizado o la prestación de servicios básicos adicionales, para ello deberá presentar la solicitud formal conforme a lo dispuesto en el artículo 29 y 30 del Reglamento de Prestación de Servicios, Alcance N°29, Gaceta N°27 del martes 9 de febrero del 2021. El incumplimiento de las regulaciones y el uso no autorizado del servicio, entre otros, son causales para la suspensión del servicio registrado con NIS 5349625. La presente constancia se extendió a solicitud del interesado, con una vigencia de 12 meses a partir de la fecha de emisión, de conformidad con lo establecido en el artículo 30 del Reglamento de Prestación de Servicios del AyA, Alcance N°29, Gaceta N°27 del martes 9 de febrero del 2021. (Ver PRUEBA 2 memorando No. UEN-SCCAT-GAM-2026-01890) CUARTO: Ahora bien, es relevante indicarle a este alto Tribunal, que esta institución recibió de Don Nombre03, una solicitud de Constancia de Servicio Existente, que él presentó en la Agencia Comercial de San Pablo de Heredia, el día 5 de mayo del 2026. Ahí se hizo el ingreso de la solicitud en la herramienta oficial CRM, se trasladó al área de Levantamiento Catastral, para su debida gestión y se resolvió mediante el consecutivo No. UEN-SCCAT-GAM- 2026-01890, el 29 de mayo del 2026. Esta Constancia de Servicio Existente, descrita en el apartado anterior, fue notificada el 2 de junio del 2026, al correo señalado en el formulario que consta en la solicitud”.\n\n4.- Por escrito recibido en la Secretaría de la Sala el 8 de agosto de 2026, el recurrente indica que “PRIMERO: Es menester indicar que el correo señalado es el correcto, incluso así se puede apreciar en la solicitud física expuesta y planteada por Don Nombre03 en la sede institucional generadora de la solicitud, ahora bien, que el correo sea el señalado no implica que la notificación se generara. SEGUNDO: En el documento aportado a la presente cámara constitucional se puede apreciar tanto el señalamiento del correo y un aparente envío, pero no se logra acreditar mediante medios digitales que el correo efectivamente se enviara o incluso que Don Nombre03 o su hija Nombre01 lo recibiera de forma efectiva. TERCERO: Lo anterior lo que deja claro es que no existe certeza real de la emisión de dicho correo electrónico incluso Nombre01 quien es la hija de Don Nombre03 y dueña del correo, quien es una Doctora muy respetada y maneja la tecnología a plenitud busco en todas las bandejas del correo para poder identificar si realmente dicha emisión se generó y no logro encontrar dicho correo. Por lo cual el documento solicitado Don Nombre03 lo acceso por primera vez cuando lo suben al sistema de gestión en línea del poder judicial”.\n\n5.- En los procedimientos seguidos se han observado las prescripciones legales. \n\n Redacta el Magistrado Cruz Castro; y,\n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. Señala la parte recurrente que el amparado siempre ha tenido acceso al agua potable sin mayor inconveniente, incluso, tiene asignado el NIS 5349625. Indica que, recientemente, por necesidades de crecimiento familiar, requiere una nueva conexión de agua potable, pero, las autoridades recurridas, le exponen que en la actualidad no hay disponibilidad de agua en la zona y que la cantidad de agua es poca. Manifiesta que el amparado, el 05 de mayo de 2026, se apersonó a solicitar una constancia de servicios existentes para establecer que si hay capacidad hídrica en dicha zona. Narra que no ha obtenido respuesta a su solicitud. Incluso no se observa que el recurrido tuviera alguna clase de problema o inconveniente con la gestión pues enviaron al correo para notificaciones ...01, un mensaje que expresaba lo siguiente: “AYA le informa que la Constancia de Servicio existente de agua potable con caudal inventariado y/o de alcantarillado sanitario con caudal inventariado y/o de alcantarillado sanitario, NIS: 5349625, se encuentra en trámite”. Reclama que han transcurrido tiempo y plazos desproporcionados para que el amparado, que es un adulto mayor, pueda tener acceso al documento oportunamente gestionado ante la institución, violentando así sus derechos fundamentales.\n\nII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:\n\n1. El amparado presentó una solicitud de disponibilidad de servicios ante el Instituto Costarricense de Acueductos y Alcantarillados (AyA), ingresada al Sistema Integrado para Gestión de Disponibilidades y Desarrollos (SIGDD) el día 08 de abril de 2026, bajo el número de gestión 2026-00008154-1, respecto de la finca matrícula N.° PRN01, ubicada en el distrito San Pablo, cantón San Pablo, provincia de Heredia, según plano catastrado N.° H-0113704-1993. (Ver registro electrónico). \n\n2. La solicitud de disponibilidad de servicio de agua potable fue resuelta de forma negativa por el AyA, al determinarse que la infraestructura de producción y distribución existente en el sector resulta insuficiente para atender un desarrollo adicional, al encontrarse la propiedad dentro del sistema ME-A-15 San Pablo del Acueducto Metropolitano AyA, identificado como un sistema con capacidad hídrica e hidráulica deficitaria. (Ver registro electrónico). \n\n3. El AyA informó que no existe factibilidad técnica para otorgar disponibilidad adicional de agua potable para la propiedad y que tampoco existe disponibilidad del sistema de alcantarillado sanitario para nuevas conexiones en la zona. (Ver registro electrónico). \n\n4. La gestión de disponibilidad de servicio fue finalizada el 29 de abril de 2026 y comunicada al gestionante mediante correo electrónico, indicándole la resolución adoptada, así como los recursos procedentes y el plazo legal para su interposición. (Ver registro electrónico). \n\n5. Dentro del plazo otorgado por la Administración, no se presentó recurso alguno contra la denegatoria de disponibilidad emitida por el AyA. (Ver registro electrónico). \n\n6. El AyA fundamentó la denegatoria en criterios técnicos relacionados con la capacidad actual del sistema de abastecimiento, indicando que el sistema ME-A-15 San Pablo pasó de contar con una capacidad aproximada de 3,1 litros por segundo a presentar una condición deficitaria de -1,4 litros por segundo, según la información técnica institucional. (Ver registro electrónico). \n\n7. El inmueble cuenta actualmente con un servicio de agua potable registrado ante el AyA bajo el Número de Identificación de Servicio (NIS) 5349625, a nombre de Nombre03, correspondiente a una tarifa residencial metropolitana, sin servicio de alcantarillado sanitario, encontrándose dicho servicio al día en sus obligaciones de pago. (Ver registro electrónico). \n\n8. El AyA emitió constancia de servicio existente mediante consecutivo UEN-SCCAT-GAM-2026-01890, de fecha 29 de mayo de 2026, en la cual se hizo constar la existencia del servicio de agua potable asociado al inmueble inscrito bajo la matrícula N.° PRN03, según plano catastrado N.° H-0113704-1993. La constancia de servicio existente emitida por el AyA fue otorgada únicamente para acreditar las condiciones actuales del servicio registrado y no constituye una disponibilidad de agua potable adicional, ni autoriza aumentos de caudal, cambios de uso o la prestación de servicios adicionales para el inmueble. (Ver registro electrónico). \n\n10. El amparado presentó una solicitud de constancia de servicio existente ante la Agencia Comercial de San Pablo de Heredia el día 5 de mayo de 2026, la cual fue tramitada mediante la herramienta institucional CRM y trasladada al área de Levantamiento Catastral para su atención. (Ver registro electrónico). \n\n11. La constancia de servicio existente solicitada fue resuelta mediante consecutivo UEN-SCCAT-GAM-2026-01890 y notificada al gestionante el 2 de junio de 2026 al correo electrónico señalado en la solicitud. (Ver registro electrónico). \n\n12. El AyA indicó que la denegatoria de disponibilidad adicional de agua potable responde a criterios técnicos y normativos relacionados con la capacidad real del sistema de abastecimiento, de conformidad con el Reglamento para la Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes aplicable. (Ver registro electrónico).\n\nIII.- SOBRE EL CASO CONCRETO: En el presente asunto, la parte recurrente reclama la supuesta lesión a los derechos fundamentales del amparado, en particular, el derecho de petición y el acceso oportuno a la información administrativa, debido a que afirma que, pese a haber solicitado una constancia de servicio existente de agua potable ante el Instituto Costarricense de Acueductos y Alcantarillados (AyA), no habría recibido respuesta dentro de un plazo razonable. Asimismo, cuestiona que se le haya indicado la inexistencia de disponibilidad de agua potable en la zona, pese a que el inmueble cuenta actualmente con un servicio activo identificado con el NIS 5349625. En el caso concreto, de los elementos probatorios incorporados al expediente se desprende que el amparado presentó ante el AyA una solicitud de constancia de servicio existente el 5 de mayo de 2026, gestión que fue recibida, registrada y trasladada para su trámite correspondiente. Asimismo, consta que dicha solicitud fue atendida mediante el consecutivo UEN-SCCAT-GAM-2026-01890, de fecha 29 de mayo de 2026, y notificada al amparado el 2 de junio de 2026 al medio señalado para recibir comunicaciones. De esta forma, contrario a lo alegado por la parte recurrente, no se acredita una omisión absoluta por parte de la autoridad recurrida ni una negativa injustificada a brindar la información solicitada, toda vez que la institución emitió la constancia requerida y comunicó su resultado al interesado. En consecuencia, al haberse satisfecho la pretensión relacionada con la entrega del documento solicitado, no se observa una lesión actual al derecho fundamental invocado. Ahora bien, en cuanto al reclamo relacionado con la negativa de disponibilidad adicional de agua potable, debe indicarse que la Sala Constitucional ha reconocido que el acceso al agua potable constituye un derecho fundamental; sin embargo, ello no implica que las instituciones encargadas de la prestación del servicio deban autorizar conexiones adicionales sin considerar las condiciones técnicas y la capacidad real de los sistemas de abastecimiento. La Administración debe actuar conforme al principio de legalidad y garantizar la adecuada prestación del servicio a la población existente, evitando autorizar desarrollos que puedan comprometer la disponibilidad del recurso hídrico. En este caso, se encuentra acreditado que el AyA resolvió negativamente la solicitud de disponibilidad de servicio presentada por el amparado, debido a que la infraestructura de producción y distribución del sistema ME-A-15 San Pablo presenta una condición deficitaria, al no contar con capacidad hídrica e hidráulica suficiente para atender nuevas demandas. Según lo informado por la autoridad recurrida, dicha decisión se fundamentó en criterios técnicos y en la normativa aplicable al servicio público de acueducto. Asimismo, consta que el inmueble ya cuenta con un servicio activo de agua potable identificado con el NIS 5349625, correspondiente a una tarifa residencial metropolitana, sin servicio de alcantarillado sanitario. No obstante, la existencia de dicho servicio no implica que exista disponibilidad para una nueva conexión, aumento de caudal o modificación del uso autorizado, pues la constancia emitida por el AyA únicamente acredita las condiciones actuales del servicio registrado. En ese sentido, la decisión cuestionada no obedece a una actuación arbitraria o carente de fundamento, sino a una valoración técnica sobre la capacidad del sistema de abastecimiento, realizada dentro del ámbito de competencia de la institución recurrida. Además, consta que la resolución fue comunicada al amparado y que no se interpuso recurso alguno dentro del plazo conferido para cuestionar dicha decisión. En consecuencia, al haberse acreditado que el AyA atendió la gestión planteada por el amparado y que la denegatoria de disponibilidad adicional de agua potable encuentra sustento en criterios técnicos y normativos, no se observa vulneración alguna a los derechos fundamentales alegados. Por lo anterior, procede declarar sin lugar el recurso, como en efecto se dispone.\n\n IV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. San José, at nine hours and thirty minutes on 13 August 2026.\n\nAmparo proceeding filed by Nombre02, identity card CED02, on behalf of Nombre03, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\nBackground:\n\n1.- In a brief filed with the Secretariat of this Chamber on 20 July 2026, the petitioner files an amparo proceeding and states that the beneficiary has lived on his property in Heredia for many years and has always had access to drinking water without significant difficulty; he has even been assigned NIS 5349625. The petitioner indicates that recently, due to the needs of his growing family, the beneficiary requires a new drinking-water connection, but the respondent authorities told him that water is currently unavailable in the area and that the amount of water is low. The petitioner states that on 05 May 2026, the beneficiary appeared to request a certificate of existing services to establish whether there is water capacity in that area. The petitioner recounts that he has received no response to his request. Nor does it appear that the respondent had any problem or difficulty processing it, since a message was sent to the notification email address ...01 stating: “AYA informs you that the Certificate of Existing Drinking-Water Service with inventoried flow and/or sanitary sewer service with inventoried flow and/or sanitary sewer service, NIS: 5349625, is being processed.” The petitioner complains that disproportionate amounts of time have elapsed and deadlines have passed before the beneficiary, who is an older adult, could obtain the document duly requested from the institution, thereby violating his fundamental rights.\n\n2.- By order issued at 15:39 on 27 July 2026, this amparo proceeding was admitted for processing (see electronic record).\n\n3.- RAQUEL AGLIETTI DÍAZ, HEAD OF THE CUSTOMER SERVICE UEN OF THE GAM AYA, reports under oath that: “Based on memoranda No. UEN-SCMED-GAM-2026-01511, prepared by Carlos Quirós Mora, an employee of the Customer Service Measurement UEN GAM, dated 29 July 2026; memorandum No. UEN-SCCAT-GAM-2026-01890, prepared by Pool Stuart Barquero Arce, an employee of the Customer Service Cadastre UEN GAM, dated 28 July 2026; and memorandum No. UEN-SCCAT-GAM-2026-02840, prepared by Nuria Chaves Villalobos, an employee of the Customer Service Cadastre UEN GAM, dated 28 July 2026, which are offered as evidence and form an integral part of the administrative file, it is duly established that: FIRST: A request was indeed entered in the Integrated System for Managing Availability and Developments (SIGDD) on 08 April 2026, under number 2026-00008154-1, and processed for parcel No. PRN01, located in San Pablo district, San Pablo canton, Heredia province, according to Cadastral Plan No. 4-0113704-1993, in the name of Nombre03. It concerns a request for service availability that was denied, with the applicant being informed that the production and distribution infrastructure in the sector is insufficient for this type of development. The parcel is included in system ME-A-15 San Pablo of the AyA Metropolitan Aqueduct, which covers areas where, because of their location and deficiencies in the water and hydraulic capacity of the supply systems, water is unavailable for more than one consumption unit per property. Therefore, it was determined that there is no technical feasibility for granting drinking-water availability, and the sanitary sewer system is not available in the area for new connections. It is certified that, as of the date this document was issued, the property does have services with AyA identified by Service Identification Number (NIS) CED01. It is concluded that THERE IS NO DRINKING WATER AVAILABLE IN FRONT OF THE PROPERTY. THE SEWER SYSTEM IS NOT AVAILABLE FOR THE PROPERTY. This request was completed and finalized on 29 April 2026, and sent to email address ...01, expressly informing the applicant of the applicable remedies and the statutory period for filing them. (See EVIDENCE 1, memorandum No. UEN-SCMED-GAM-2026-01511.) SECOND: No remedy was filed within the period granted to challenge the decision issued; nevertheless, this is the appropriate time to expand on the grounds for denying the certificate. It is reiterated that there is no technical feasibility for granting a favorable determination of drinking-water availability because the production and distribution infrastructure in the sector is insufficient for this type of development, which forms part of system ME-A-15 San Pablo of the AyA Metropolitan Aqueduct, whose condition is deficient. Accordingly, the purpose of issuing administrative acts that grant or deny services in a given area is based on existing conditions regarding water capacity, collection capacity, and the environmental conditions that the AyA systems provide or face at a particular point. This is based on ‘basic studies’ and even more specific studies, depending on the project, which form the basis for issuing the act. System ME-A-15 San Pablo had water capacity of approximately 3.1 l/s, according to memorandum UEN-OS-GAM-2025-00160, issued by the Systems Optimization UEN GAM on 06 July 2025, but that water capacity was updated according to official letter UEN-OS-GAM-2025-00592 dated 05 December 2025, changing the system’s status to -1.4 l/s and categorizing it as deficient. Based on the foregoing information and in accordance with the Regulation on the Provision of Services, particularly Articles 7 and 10, it was determined that, because this is a deficit area, consumption may not exceed that of a single-family dwelling or individual business. As indicated in the preceding section, the property already has this condition, since it has a service with AyA identified by Service Identification Number (NIS) 5349625. Consequently, when a request for water availability is denied, this is not done arbitrarily or capriciously, but on technical grounds demonstrating the REAL AND CURRENT LACK of water and/or hydraulic capacity in the aqueduct. Therefore, system ME-A-15 San Pablo currently has deficient water capacity, and the denial is supported by Articles 7 (paragraphs 12 and 129), 8, 9, 10, 14, and 74 of the AyA Regulation on the Provision of Services. In addition, the Regulation on the Provision of Aqueduct, Sanitary Sewer, and Hydrant Services, AR-PSAYA-2013, resolution No. 54-2014 of 18 September 2014, through Supplement No. 50, and its amendment entitled ‘Provision of Aqueduct, Sewer, and Hydrant Services AR-PSAYA-2015,’ by resolution No. RJD-053-2016 through Supplement 55 to LA Gaceta No. 69 of 12 April 2016, establishes in section 9 that under no circumstances may expansions be authorized that compromise the existing water resource or the capacity of the Sewer System and its treatment, to the detriment of the population served or the inhabitants of potential new developments. While it is true that drinking-water supply is a public service, it is also clear that compliance with the principle of legality, which governs the entire Public Administration, must be ensured. This means complying with its own regulations without exception; the right to water does not exempt a person from meeting the requirements set out in the AyA Regulation on the Provision of Services. Finally, it is important to mention Article 11 of the Political Constitution of Costa Rica, which reads verbatim: ‘Public officials are merely custodians of authority. They are required to perform the duties imposed on them by law and may not arrogate powers not granted to them therein. They shall swear to observe and uphold this Constitution and the laws (…).’ (See EVIDENCE 1, memorandum No. UEN-SCMED-GAM-2026-01511.) - THIRD: As for the CERTIFICATE OF EXISTING DRINKING-WATER SERVICE WITH INVENTORIED FLOW AND/OR SANITARY SEWER SERVICE WITH AUTHORIZED DISCHARGE FLOW, consecutive No. UEN-SCCAT-GAM-2026-01890 was generated on 29 May 2026. It states that, as of the date this document was issued, the Integrated Commercial System database (OPEN S.C.I.) records the drinking-water connection identified by Service Identification Number (NIS) 5349625 in the name of Nombre03, location code PRN02, which supplies parcel with real property folio registration PRN03, according to Cadastral Plan H-0113704-1993, Heredia Province, San Pablo Canton, San Pablo District. It states that the service, under the Metropolitan Residential Rate, Without Sanitary Sewer, is current on its payment obligations as of the date this certificate was issued. It further cautions that this document is issued exclusively to indicate the conditions of use currently recorded in the Commercial System, so that the registered owner, possessor, or legal representative of the property may demonstrate to other interested persons, institutions, or companies that request it as a requirement for banking procedures, municipal permits, operating permits, approval of housing subsidies, or procedures before APC, the actual and current existence of drinking-water and/or sanitary sewer service, provided that this does not entail an increase in the inventoried flow allocated to the property. It also does not guarantee the existence of additional services or authorize a change in the authorized use of that service. Any additional service requirement must be processed as a new request for service availability, in accordance with the regulations and procedures in force. This service certificate does not have the effect of granting water availability for a use other than that expressly indicated, nor does it make possible a change in the authorized use or the provision of additional basic services. To that end, a formal request must be submitted pursuant to Articles 29 and 30 of the Regulation on the Provision of Services, Supplement No. 29, Gaceta No. 27 of Tuesday, 9 February 2021. Breach of the regulations and unauthorized use of the service, among other things, are grounds for suspending the service registered under NIS 5349625. This certificate was issued at the interested party’s request and is valid for 12 months from its date of issue, in accordance with Article 30 of the AyA Regulation on the Provision of Services, Supplement No. 29, Gaceta No. 27 of Tuesday, 9 February 2021. (See EVIDENCE 2, memorandum No. UEN-SCCAT-GAM-2026-01890.) FOURTH: It is now relevant to inform this high Court that this institution received from Don Nombre03 a request for a Certificate of Existing Service, which he submitted at the San Pablo de Heredia Commercial Agency on 5 May 2026. The request was entered into the official CRM tool, transferred to the Cadastral Survey area for processing, and resolved under consecutive No. UEN-SCCAT-GAM-2026-01890 on 29 May 2026. This Certificate of Existing Service, described in the preceding section, was notified on 2 June 2026 to the email address indicated on the form included with the request.”\n\n4.- In a brief received by the Secretariat of the Chamber on 8 August 2026, the petitioner states that “FIRST: It must be stated that the email address indicated is correct, as can even be seen in the physical request submitted by Don Nombre03 at the institutional office that generated the request. However, the fact that this is the email address indicated does not mean that notification was sent. SECOND: The document submitted to this Constitutional Chamber shows both the email address and an apparent sending, but it does not establish by digital means that the email was actually sent or even that Don Nombre03 or his daughter Nombre01 actually received it. THIRD: The foregoing makes clear that there is no real certainty that the email was sent. Nombre01, who is Don Nombre03’s daughter and the owner of the email account, is a highly respected doctor who is fully proficient with technology. She searched every folder in the email account to determine whether the email had actually been sent, but could not find it. Accordingly, Don Nombre03 first accessed the requested document when it was uploaded to the Judiciary’s online case-management system.”\n\n5.- The legal requirements have been observed in the proceedings conducted.\n\nJustice Cruz Castro drafted the decision; and,\n\nReasons:\n\nI.- SUBJECT OF THE AMPARO. The petitioner states that the beneficiary has always had access to drinking water without significant difficulty and has even been assigned NIS 5349625. The petitioner indicates that recently, due to the needs of his growing family, the beneficiary requires a new drinking-water connection, but the respondent authorities told him that water is currently unavailable in the area and that the amount of water is low. The petitioner states that on 05 May 2026, the beneficiary appeared to request a certificate of existing services to establish whether there is water capacity in that area. The petitioner recounts that he has received no response to his request. Nor does it appear that the respondent had any problem or difficulty processing it, since a message was sent to the notification email address ...01 stating: “AYA informs you that the Certificate of Existing Drinking-Water Service with inventoried flow and/or sanitary sewer service with inventoried flow and/or sanitary sewer service, NIS: 5349625, is being processed.” The petitioner complains that disproportionate amounts of time have elapsed and deadlines have passed before the beneficiary, who is an older adult, could obtain the document duly requested from the institution, thereby violating his fundamental rights.\n\nII.- FACTS FOUND. The following facts, relevant to deciding this matter, are considered duly established, either because they have been proven or because the respondent authority failed to address them, as provided in the initial order:\n\n1. The beneficiary submitted a request for service availability to the Costa Rican Institute of Aqueducts and Sewers (AyA), entered into the Integrated System for Managing Availability and Developments (SIGDD) on 08 April 2026 under request number 2026-00008154-1, concerning property folio registration No. PRN01, located in San Pablo district, San Pablo canton, Heredia province, according to cadastral plan No. H-0113704-1993. (See electronic record).\n\n2. AyA denied the request for drinking-water service availability, having determined that the existing production and distribution infrastructure in the sector is insufficient to serve additional development, since the property is within system ME-A-15 San Pablo of the AyA Metropolitan Aqueduct, identified as a system with deficient water and hydraulic capacity. (See electronic record).\n\n3. AyA reported that there is no technical feasibility for granting additional drinking-water availability to the property and that the sanitary sewer system is also unavailable for new connections in the area. (See electronic record).\n\n4. The service-availability request was completed on 29 April 2026 and communicated to the applicant by email, informing him of the decision, the applicable remedies, and the statutory period for filing them. (See electronic record).\n\n5. No remedy was filed within the period granted by the Administration to challenge AyA’s denial of availability. (See electronic record).\n\n6. AyA based its denial on technical criteria concerning the current capacity of the supply system, stating that system ME-A-15 San Pablo went from having an approximate capacity of 3.1 liters per second to a deficient status of -1.4 liters per second, according to the institution’s technical information. (See electronic record).\n\n7. The property currently has drinking-water service registered with AyA under Service Identification Number (NIS) 5349625 in the name of Nombre03, corresponding to a metropolitan residential rate, without sanitary sewer service, and the account is current on its payment obligations. (See electronic record).\n\n8. AyA issued a certificate of existing service under consecutive UEN-SCCAT-GAM-2026-01890, dated 29 May 2026, certifying the existence of drinking-water service associated with the property registered under folio registration No. PRN03, according to cadastral plan No. H-0113704-1993. (See electronic record).\n\n9. The certificate of existing service issued by AyA was granted solely to certify the current conditions of the registered service. It does not constitute additional drinking-water availability, authorize flow increases or changes in use, or provide additional services to the property. (See electronic record).\n\n10. The beneficiary submitted a request for a certificate of existing service at the San Pablo de Heredia Commercial Agency on 5 May 2026. It was processed using the institutional CRM tool and transferred to the Cadastral Survey area for handling. (See electronic record).\n\n11. The requested certificate of existing service was resolved under consecutive UEN-SCCAT-GAM-2026-01890 and notified to the applicant on 2 June 2026 at the email address indicated in the request. (See electronic record).\n\n12. AyA stated that the denial of additional drinking-water availability is based on technical and regulatory criteria concerning the supply system’s actual capacity, in accordance with the applicable Regulation on the Provision of Aqueduct, Sanitary Sewer, and Hydrant Services. (See electronic record).\n\nIII.- THE SPECIFIC CASE: In this matter, the petitioner alleges a violation of the beneficiary’s fundamental rights, particularly the right to petition and timely access to administrative information, because he claims that, despite having requested a certificate of existing drinking-water service from the Costa Rican Institute of Aqueducts and Sewers (AyA), he did not receive a response within a reasonable period. He also challenges the statement that drinking water is unavailable in the area, despite the property currently having an active service identified by NIS 5349625. In this specific case, the evidence incorporated into the file shows that the beneficiary submitted a request for a certificate of existing service to AyA on 5 May 2026, and that the request was received, registered, and transferred for the corresponding processing. The record also shows that the request was handled under consecutive UEN-SCCAT-GAM-2026-01890, dated 29 May 2026, and notified to the beneficiary on 2 June 2026 through the channel indicated for receiving communications. Thus, contrary to the petitioner’s allegations, there is no evidence of an absolute omission by the respondent authority or an unjustified refusal to provide the requested information, since the institution issued the requested certificate and communicated its result to the interested party. Consequently, because the request for delivery of the document has been satisfied, there is no current violation of the fundamental right invoked.\n\nAs for the claim concerning the denial of additional drinking-water availability, the Constitutional Chamber has recognized that access to drinking water is a fundamental right. However, this does not mean that institutions responsible for providing the service must authorize additional connections without considering the technical conditions and actual capacity of the supply systems. The Administration must act in accordance with the principle of legality and ensure adequate service for the existing population, avoiding authorization of developments that could compromise the availability of the water resource. In this case, it has been established that AyA denied the beneficiary’s request for service availability because the production and distribution infrastructure of system ME-A-15 San Pablo is deficient and lacks sufficient water and hydraulic capacity to meet new demand. According to the respondent authority, that decision was based on technical criteria and regulations applicable to the public aqueduct service. The record also shows that the property already has active drinking-water service identified by NIS 5349625, corresponding to a metropolitan residential rate, without sanitary sewer service. However, the existence of that service does not mean that availability exists for a new connection, increased flow, or modification of the authorized use, since the certificate issued by AyA only certifies the current conditions of the registered service. In that regard, the challenged decision was not arbitrary or without grounds, but resulted from a technical assessment of the supply system’s capacity, carried out within the respondent institution’s sphere of competence. The record also shows that the decision was communicated to the beneficiary and that no remedy was filed within the period granted to challenge it. Consequently, given that AyA handled the beneficiary’s request and that the denial of additional drinking-water availability is supported by technical and regulatory criteria, no violation of the alleged fundamental rights is evident. Accordingly, the amparo proceeding must be dismissed, as is hereby ordered.\n\nIV.- DOCUMENTATION SUBMITTED TO THE FILE. The petitioner is advised that, if any paper document or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device were submitted, they must be collected from the office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo proceeding is dismissed.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
