San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n Gestión formulada dentro del recurso de amparo interpuesto por Nombre01, cédula de identidad número CED02, en su condición de apoderado especial judicial de Nombre02, de nacionalidad canadiense, documento de identidad número CED01, quien es apoderado generalísimo sin límite de suma de la empresa SALUMA DEL MAR S.A., cédula jurídica 3-101-120699; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA). \n\nResultando:\n\n 1.- Por sentencia número 2026029714 de las 09:25 horas del 04 de agosto de 2026, esta Sala rechazó de plano el presente recurso. Dicha sentencia fue notificada a la recurrente a las 17:28 horas del 05 de agosto de 2026, al medio señalado al efecto.\n\n2.- Por escrito incorporado al expediente digital a las 10:43 horas del 07 de agosto de 2026, la parte recurrente plantea una “GESTIÓN EXTRAORDINARIA POR TUTELA DEL DERECHO HUMANO AL AGUA POTABLE (MÍNIMO VITAL)” y manifiesta que: “I. ANTECEDENTES Y RELACIÓN CON LA RESOLUCIÓN N° 2026029714 Mediante la Resolución N° 2026029714 de las 09:25 horas del 4 de agosto de 2026, esta Sala declaró de plano la inadmisibilidad del recurso de amparo tramitado bajo el expediente 26-026715-0007-CO, al considerar que la discusión sobre la exigencia de un sistema de bombeo para la independización de 5 medidores constituye un asunto de legalidad ordinaria y reglamentación técnica ante el Instituto Costarricense de Acueductos y Alcantarillados (AyA). Si bien acatamos respetuosamente el criterio técnico-jurisprudencial sobre la independización múltiple de servicios urbanísticos, se hace imperativo someter a consideración de los Sres. Magistrados un aspecto de **carácter estrictamente humanitario y de tutela constitucional inmediata** que fue omitido en el análisis de fondo del pronunciamiento: la garantía del **Mínimo Vital de Agua Potable (una paja de agua / servicio básico)** para salvaguardar la vida y la salud de sujetos de especial protección constitucional. II. FUNDAMENTOS DE DERECHO Y TUTELA DEL MÍNIMO VITAL 1. Diferenciación Sustancial entre Proyecto Comercial y Mínimo Vital Sanitario: Existe una distinción clara entre la solicitud de cinco (5) servicios independizados para una obra y el **derecho fundamental a recibir una sola paja de agua (servicio básico provisional/definitivo)** para el consumo humano inmediato. Negar la totalidad del acceso al agua potable bajo el argumento de requerimientos de infraestructura compleja somete a los residentes a un estado de vulnerabilidad extrema e inhumana. 2. Protección Reforzada a Sujetos en Condición de Vulnerabilidad: En la propiedad habita la señora Nombre03, adulta mayor de 96 años de edad, así como personas menores de edad. Al tenor del artículo 21 de la Constitución Política, la *Convención Interamericana sobre la Protección de los Derechos Humanos de las Personas Mayores* y la *Convención sobre los Derechos del Niño*, el Estado costarricense tiene el deber ineludible de garantizar el suministro de agua para necesidades fisiológicas e higiénicas básicas. […] 3. Principio de Proporcionalidad y Solución Proporcional: Exigir la construcción previa de una estación de bombeo de alto costo financiero y técnico como condición *sine qua non* para otorgar al menos un servicio o acometida de agua potable (una paja de agua) resulta una medida desproporcionada que vulnera el contenido esencial del derecho a la salud y a la vida digna. III. PETITORIA / SOLICITUD CONCRETA Con fundamento en los artículos 21, 33 y 50 de la Constitución Política, solicito a la Sala Constitucional: ADICIONAR Y ACLARAR la Resolución N° 2026029714 en el sentido de precisar que, sin perjuicio de los trámites técnicos reglamentarios que corresponden ante el AyA para la independización de los 5 medidores, el **AyA no está facultado para negar el suministro del MÍNIMO VITAL de agua potable (al menos una paja de agua / acometida básica)** indispensable para la subsistencia de la adulta mayor de 96 años y los niños que residen en el inmueble. ORDENAR COMO MEDIDA CAUTELAR / PREVENTIVA DE EMERGENCIA al Instituto Costarricense de Acueductos y Alcantarillados (AyA) que, en el plazo perentorio de 48 horas, autorice e instale UNA PAJA DE AGUA PROVISIONAL O MEDIDOR BÁSICO DE CONSUMO HUMANO en la finca objeto de este expediente, garantizando el suministro hídrico elemental mientras se concluyen las obras de ingeniería exigidas para el resto de la edificación.” (SIC). \n\n Redacta el Magistrado Castillo Víquez; y,\n\n Considerando:\n\n I.- SOBRE LA GESTIÓN ADICIÓN Y ACLARACIÓN DE SENTENCIA. De conformidad con lo establecido en el artículo 12 de la Ley que rige esta Jurisdicción, la adición o aclaración de una sentencia, procede, únicamente, para complementarla en caso de que alguno de los puntos debatidos no hubiese sido fallado o para explicar los alcances de lo que pudo haber quedado confuso. Lo anterior, a petición de parte, si se solicita dentro de tercero día y de oficio en cualquier tiempo, incluso en la etapa de ejecución, en la medida en que sea necesario para dar cabal cumplimiento al contenido del fallo. \n\n II.- SOBRE LA GESTIÓN FORMULADA. El recurrente solicita la adición y aclaración de la sentencia número 2026029714 de las 09:25 horas del 04 de agosto de 2026 que rechazó de plano el recurso, en el sentido de precisar que, sin perjuicio de los trámites técnicos reglamentarios que corresponden ante el AyA para la independización de los 5 medidores, el AyA no está facultado para negar el suministro del mínimo vital de agua potable (al menos una paja de agua / acometida básica) indispensable para la subsistencia de la adulta mayor de 96 años y los niños que residen en el inmueble, para lo cual reitera los argumentos esbozados en el escrito de interposición. Al respecto, se observa que la gestión es improcedente, no solo por cuanto carece de la debida expresión y fundamentación de los supuestos extremos oscuros o incompletos que contiene la sentencia, como para ser considerada una gestión de adición o aclaración en estricto sentido, ya que, no se refiere a la existencia de algún extremo alegado en el recurso que haya omitido resolverse, o bien, que se haya resuelto de manera oscura o confusa. Por el contrario, insiste en que la negativa total del acceso al agua potable bajo el argumento de requerimientos de infraestructura compleja somete a los residentes a un estado de vulnerabilidad extrema e inhumana, en especial a la persona adulta mayor de 96 años y los menores de edad que habitan el lugar. \n\n Así las cosas, se constata que en realidad, lo que el recurrente plantea es su inconformidad con lo resuelto en la sentencia y los argumentos que sustentaron el rechazo del recurso, lo cual resulta improcedente, pues de conformidad con lo dispuesto en el artículo 11 de la Ley de la Jurisdicción Constitucional, contra las sentencias de esta Sala no cabe recurso alguno. \n\n En todo caso, se constata que la sentencia número 2026029714 de las 09:25 horas del 04 de agosto de 2026 es clara en cuanto a las razones de hecho y de Derecho en las que se basó para rechazar el recurso, específicamente, en cuanto a que el acceso al agua no es irrestricto y no implica un derecho a eximirse del cumplimiento de requisitos legales para su dotación y, que en todo caso, tal como lo aseguró el propio recurrente la propiedad en la que habita la persona adulta mayor y los menores, sí cuenta con acceso al agua. \n\nEn virtud de lo anterior, se rechaza la gestión formulada. \n\n III.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\n No ha lugar a la gestión formulada. \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:30 a.m. on 13 August 2026.\n\nApplication filed within the amparo proceeding brought by Nombre01, identity card number CED02, in the capacity of special judicial attorney-in-fact for Nombre02, a Canadian national, identity document number CED01, who is the generalísimo attorney-in-fact without limit as to amount for SALUMA DEL MAR S.A., corporate ID number 3-101-120699; against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERAGE (AyA).\n\nBackground:\n\n1.- By judgment number 2026029714, issued at 09:25 on 04 August 2026, this Chamber summarily rejected the present application. That judgment was served on the applicant at 17:28 on 05 August 2026, through the channel designated for that purpose.\n\n2.- In a submission entered in the digital case file at 10:43 on 07 August 2026, the applicant seeks “EXTRAORDINARY RELIEF FOR THE PROTECTION OF THE HUMAN RIGHT TO DRINKING WATER (MINIMUM VITAL AMOUNT)” and states: “I. BACKGROUND AND RELATION TO DECISION N° 2026029714 By Decision N° 2026029714, issued at 09:25 on 4 August 2026, this Chamber summarily declared inadmissible the amparo application processed under case file 26-026715-0007-CO, on the ground that the dispute over the requirement for a pumping system to separate 5 meters constitutes an ordinary legality matter and a technical regulatory matter before the Costa Rican Institute of Aqueducts and Sewerage (AyA). While we respectfully abide by the technical-jurisprudential criterion on the multiple separation of urban-development services, it is imperative to submit for the justices’ consideration an aspect of **strictly humanitarian character and immediate constitutional protection** that was omitted from the decision’s substantive analysis: the guarantee of the **Minimum Vital Amount of Drinking Water (one water connection / basic service)** to safeguard the life and health of persons entitled to special constitutional protection. II. LEGAL GROUNDS AND PROTECTION OF THE MINIMUM VITAL AMOUNT 1. Substantive Distinction between a Commercial Project and a Sanitary Minimum Vital Amount: There is a clear distinction between the request for five (5) separate services for a project and the **fundamental right to receive a single water connection (provisional/final basic service)** for immediate human consumption. Denying all access to drinking water on the ground of complex infrastructure requirements subjects residents to a state of extreme and inhumane vulnerability. 2. Enhanced Protection for Persons in a Vulnerable Condition: Ms. Nombre03, a 96-year-old older adult, and minors live on the property. Under Article 21 of the Political Constitution, the *Inter-American Convention on Protecting the Human Rights of Older Persons* and the *Convention on the Rights of the Child*, the Costa Rican State has an unavoidable duty to ensure water supply for basic physiological and hygiene needs. […] 3. Principle of Proportionality and Proportionate Solution: Requiring the prior construction of a pumping station at high financial and technical cost as a *sine qua non* condition for granting at least one drinking-water service or connection (one water connection) is a disproportionate measure that violates the essential content of the right to health and to a dignified life. III. RELIEF SOUGHT / SPECIFIC REQUEST Based on Articles 21, 33 and 50 of the Political Constitution, I ask the Constitutional Chamber: TO SUPPLEMENT AND CLARIFY Decision N° 2026029714 to specify that, without prejudice to the technical regulatory procedures required before AyA to separate the 5 meters, AyA is not authorized to deny the supply of the MINIMUM VITAL AMOUNT of drinking water (at least one water connection / basic connection) indispensable to the subsistence of the 96-year-old older adult and the children residing on the property. TO ORDER, AS AN EMERGENCY PRECAUTIONARY / PREVENTIVE MEASURE, that the Costa Rican Institute of Aqueducts and Sewerage (AyA), within the mandatory period of 48 hours, authorize and install ONE PROVISIONAL WATER CONNECTION OR BASIC METER FOR HUMAN CONSUMPTION on the property that is the subject of this case file, ensuring the essential water supply while the engineering works required for the rest of the building are completed.” (SIC).\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- ON THE REQUEST TO SUPPLEMENT AND CLARIFY THE JUDGMENT. In accordance with Article 12 of the Law governing this Jurisdiction, a judgment may be supplemented or clarified solely to complete it if one of the disputed points was not decided, or to explain the scope of anything that may have been left unclear. The foregoing may be done at a party’s request, if requested within three days, or on the Court’s own initiative at any time, including at the enforcement stage, to the extent necessary to give full effect to the judgment.\n\nII.- ON THE REQUEST FILED. The applicant seeks to supplement and clarify judgment number 2026029714, issued at 09:25 on 04 August 2026, which summarily rejected the application, so as to specify that, without prejudice to the technical regulatory procedures required before AyA to separate the 5 meters, AyA is not authorized to deny the supply of the minimum vital amount of drinking water (at least one water connection / basic connection) indispensable to the subsistence of the 96-year-old older adult and the children residing on the property. In support, the applicant reiterates the arguments set out in the filing that initiated the proceeding. In this regard, the request is inadmissible, not only because it fails to state and substantiate the alleged unclear or incomplete aspects of the judgment, as required for it to qualify strictly as a request for supplementation or clarification, but also because it does not identify any point raised in the application that was omitted from the ruling or decided in an unclear or confusing manner. On the contrary, the applicant insists that denying all access to drinking water on the ground of complex infrastructure requirements subjects residents to a state of extreme and inhumane vulnerability, particularly the 96-year-old older adult and the minors who live there.\n\nAccordingly, it is apparent that what the applicant actually challenges is the outcome of the judgment and the arguments supporting the rejection of the application. This is inadmissible because, under Article 11 of the Constitutional Jurisdiction Act, no appeal lies against this Chamber’s judgments.\n\nIn any event, judgment number 2026029714, issued at 09:25 on 04 August 2026, clearly states the factual and legal grounds on which it relied to reject the application. Specifically, it explains that access to water is not unrestricted and does not confer a right to be exempt from complying with the legal requirements for its provision and that, in any event, as the applicant himself asserted, the property where the older adult and the minors live does have access to water.\n\nAccordingly, the request filed is rejected.\n\nIII.- DOCUMENTATION ADDED TO THE CASE FILE. The parties are notified that if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic or new-technology device, these must be collected from the Chamber’s office within a maximum of 30 business days from service of this judgment.
