Nº 2026031287\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01 cédula de identidad CED01, contra LA EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA.\n\nRESULTANDO:\n\n1.- Por escrito recibido en esta Sala 3 de agosto de 2026, la parte recurrente interpone recurso de amparo contra la Empresa de Servicios Públicos de Heredia, y manifiesta que el 9 de setiembre de 2020 su madre presentó ante la Empresa de Servicios Públicos de Heredia (ESPH) una solicitud de disponibilidad de agua para la finca Folio Real No. 309000, ubicada en Concepción de San Rafael de Heredia. Indica que dicha solicitud tenía como finalidad obtener el visto bueno de esa oficina para los planos a fin de catastrar e individualizar los derechos de dos de sus hijos y una nieta. Señala que en esa oportunidad se denegó el otorgamiento la disponibilidad de agua, con el argumento, “la propiedad de localiza a más de 50 metros de distancia de la infraestructura de distribución más cercana”. Asegura que dicha situación ya está superada pues recientemente la Empresa de Servicios Públicos ya colocó una tubería que está ubicada en la calle pública frente de la finca. Menciona que el 6 de noviembre de 2026 formuló una nueva gestión para contar con las disponibilidades de agua solicitadas, pero se indicó que lo establecido en el testamento tendría vigencia al momento del fallecimiento de la persona. Indica que el 31 de mayo de 2026 su madre falleció por lo que nuevamente solicitaron la disponibilidad de agua a fin de hacer efectivo el testamento y disponer de manera individual del lote heredado por cada uno de sus hijos; sin embargo, el 15 de julio de 2026 mediante el oficio No. APH ON-IG-317-2026, la autoridad recurrida denegó formalmente la solicitud de disponibilidad de agua potable y el correspondiente visado de los planos a los lotes, alegando en forma reiterativa que la propiedad se encuentra ubicada en una zona declarada bajo “estrés hídrico”. Reclama que negativa de la ESPH, se constituye en una lesión al administrado, pues no toma en cuenta la preexistencia de un derecho de agua consolidado sobre la finca madre, trasladando de manera desproporcionada la crisis de la gestión hídrica de la institución hacia el derecho a la propiedad, impidiéndonos tramitar el visado de los planos para los lotes individuales. Por lo expuesto, solicita la intervención de esta Sala y que se declare con lugar el recurso. \n\n2.- El artículo 9, de la Ley de la Jurisdicción Constitucional, faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nCONSIDERANDO:\n\nI.- OBJETO DEL AMPARO. La parte recurrente reclama que se ha negado la disponibilidad de agua bajo el argumento que la propiedad se encuentra ubicada en una zona declarada bajo “estrés hídrico”. Considera violentados sus derechos fundamentales.\n\nII.- EL CASO CONCRETO. Este Tribunal, en otras ocasiones, ha señalado que el Instituto Costarricense de Acueductos y Alcantarillados, las asociaciones administradoras de acueductos y alcantarillados, las municipalidades y demás instituciones que prestan el servicio de suministro de agua potable, pueden rechazar válidamente las solicitudes de disponibilidad de agua potable que les sean formuladas, o condicionarlas si existen razones técnicas o legales que así lo justifiquen. De esta forma, en la Sentencia N° 2016-006027 de las 09:05 horas del 6 de mayo de 2016, esta Sala consideró:\n\n“(...) Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos el veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios (...)”. \n\n \n\nEste pronunciamiento puede complementarse con la resolución N° 2017-005245 de las 10:00 horas del 07 de abril de 2017, que en lo conducente dispuso:\n\n \n\n“(…) Del informe rendido por las autoridades de la municipalidad recurrida se indica que el reclamo de la recurrente, respecto de si el lugar donde tiene la propiedad la señora Nombre02 está fuera o no del abastecimiento de agua, le corresponderá al Instituto Costarricense de Acueductos y Alcantarillados referirse al respecto, ya que la Municipalidad no tiene competencia para ello. Y por su parte, el Instituto Costarricense de Acueductos y Alcantarillados menciona que han actuado conforme a la normativa que lo regula, ejerciendo su función rectora como corresponde, llevando a cabo en todo momento actuaciones debidamente fundamentadas y razonadas como se detalló, se evidencia así que el Instituto ha procedido conforme a derecho, ya que según el informe técnico emitido por la UEN Optimización de Sistemas Nuevos Desarrollos GAM, oficio UEN-OSND-GAM- 2017-00082, se indica claramente que para el inmueble que cita la señora Nombre03 en su recurso de amparo, no existe la disponibilidad de agua potable. Además agrega el informe, que en análisis de los antecedentes de este inmueble se tiene que pertenecía a la propiedad con catastro PRN01 y según consulta al Registro Nacional, ésta última fue fraccionada y de la misma resultaron cuatro propiedades sin mediar la gestión del trámite de disponibilidad para dicho fraccionamiento. Así las cosas, esta Sala no logra acreditar ninguna omisión o actuación arbitraria por parte de la autoridad recurrida, en consecuencia lo correspondiente es declarar sin lugar el amparo, y reiterar que según la prueba aportada, la falta de dotación del servicio de agua potable en el lote de la recurrente no es una actuación antojadiza, arbitraria o sin fundamento, sino que está justificada en la inexistencia de disponibilidad de agua potable en el sector. (Ver en similar sentido las sentencias números 2014-9134 de las 14:05 horas del 19 de junio de 2014 y 2016007240 de las 09:20 horas del 27 de mayo 2017, entre otras). Bajo esa inteligencia, no se está frente a la infracción de derechos fundamentales y, por ello, lo pertinente es desestimar el recurso de amparo”. (El resaltado y subrayado no es del original).\n\nDe esta suerte, la Empresa de Servicios Públicos de Heredia, rechazó la petición de la parte recurrente, haciéndole saber cabalmente las razones de orden legal o técnico por las cuales no procedía atender su solicitud. Al respecto, la parte recurrente debe tener presente que la verificación del cumplimiento de requisitos legales o técnicos para obtener la disponibilidad solicitada, le corresponde a las autoridades administrativas respectivas, sin que esta Sala pueda incursionar en la materia, porque se trata de aspectos de legalidad ordinaria ajenos a su competencia. Nótese, que conforme a lo indicado en los precedentes de cita, este Tribunal ha considerado que, ante un impedimento jurídico -como la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva-, o frente a una imposibilidad técnica -como la carencia de una Red de Distribución de Aguas, entre otras-, resulta razonable condicionar la prestación del servicio solicitado. Así las cosas, lo propio es que la parte accionante acuda ante la vía de legalidad ordinaria, a fin de plantear allí las gestiones que estime pertinentes para que se resuelva lo que en derecho corresponda. Por lo expuesto, el recurso se declara inadmisible.\n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPOR TANTO:\n\n Se rechaza de plano el recurso.-\n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. Nº 2026031287\n\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty a.m. on the thirteenth of August, two thousand twenty-six.\n\nAmparo proceeding filed by Nombre01, identity card CED01, against the HEREDIA PUBLIC SERVICES COMPANY.\n\nBACKGROUND:\n\n1.- In a written submission received by this Chamber on 3 August 2026, the appellant files an amparo proceeding against the Heredia Public Services Company and states that, on 9 September 2020, her mother submitted to the Heredia Public Services Company (ESPH) an application for water availability for the property, Real Folio No. 309000, located in Concepción de San Rafael de Heredia. She indicates that the purpose of that application was to obtain that office’s approval of the plans so as to register in the cadastre and individualize the rights of two of her children and a granddaughter. She states that on that occasion the grant of water availability was denied on the grounds that “the property is located more than 50 meters from the nearest distribution infrastructure.” She asserts that this situation has since been resolved, as the Heredia Public Services Company recently laid a pipe located in the public road in front of the property. She mentions that on 6 November 2026 she filed a new request to obtain the requested water availability, but was told that the provisions of the will would take effect upon the person’s death. She indicates that her mother died on 31 May 2026, and that they therefore again requested water availability in order to give effect to the will and to dispose individually of the lot inherited by each of her children; however, on 15 July 2026, by official letter No. APH ON-IG-317-2026, the respondent authority formally denied the application for potable water availability and the corresponding approval of the plans for the lots, repeatedly asserting that the property is located in an area declared to be under “water stress.” She argues that ESPH’s denial constitutes an injury to the person subject to the administration, because it fails to take into account the prior existence of a consolidated water right over the parent property, disproportionately shifting the institution’s water-management crisis onto the right to property and preventing them from processing approval of the plans for the individual lots. For the foregoing reasons, she requests the intervention of this Chamber and that the amparo be declared well-founded.\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily reject, on procedural or substantive grounds, at any time, including upon filing, any application submitted to it that proves manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is simply a reiteration or reproduction of an earlier identical or similar application that was rejected.\n\nWritten by Justice Castillo Víquez; and,\n\nREASONS:\n\nI.- SUBJECT OF THE AMPARO. The appellant complains that water availability was denied on the grounds that the property is located in an area declared to be under “water stress.” She considers her fundamental rights to have been violated.\n\nII.- THE SPECIFIC CASE. This Court has stated on other occasions that the Costa Rican Institute of Aqueducts and Sewers, the aqueduct and sewer administrative associations, municipalities, and other institutions that provide potable water service may validly deny applications for potable water availability submitted to them, or condition them if technical or legal reasons so justify. Accordingly, in Judgment No. 2016-006027, at 09:05 hours on 6 May 2016, this Chamber held:\n\n“(...) In Judgment 2014-9134, at 14:05 hours on 19 June 2014, which addressed an issue very similar to the one raised in the present amparo proceeding, this Constitutional Court held: ‘(...) This Chamber has stated in repeated judgments on this subject that, under Costa Rican law, the supply of potable water is considered a public service and, as such, every public service provider—whether a public or private entity—is obliged to provide the service continuously and efficiently, on equal terms, and in a manner that adapts to technological changes (see, in this regard, Judgment 2001-09676, at eleven twenty-five a.m. on twenty-six September two thousand one, and Judgment 2004-08161, at ten fifty-three a.m. on twenty-three July two thousand four). It is therefore clear that the Costa Rican Institute of Aqueducts and Sewers, as one of the state entities responsible for providing the public potable water service, is also obliged to provide that service continuously, adaptably, efficiently, and equally to all inhabitants. However, this Constitutional Court’s case law has also indicated that, when there is a legal impossibility (that is, failure to meet the requirements established in the applicable regulations) or a formal impossibility (that is, the absence of a Water Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear installation costs when no potable water distribution network exists and infrastructure must be built. In such cases, it is understood that this is not a denial of access to potable water service, but rather an inability to provide it or the interested party’s necessary participation in overcoming a technical impossibility, namely, the lack of infrastructure. In other words, where the failure to provide potable water service is not arbitrary, capricious, or without basis, but is justified by a legal or material impossibility, there is no violation of fundamental rights. In the specific case, the evidence submitted and the report made under oath confirm that AyA did not arbitrarily deny the appellant’s application, but did so because all the technical and legal requirements that the Regulation on the Provision of Services to Clients of the Costa Rican Institute of Aqueducts and Sewers requires for approval of new services had not been met (...)’.”\n\nThis ruling may be supplemented by Resolution No. 2017-005245, at 10:00 hours on 07 April 2017, which held, in relevant part:\n\n“(…) The report submitted by the authorities of the respondent municipality states that the appellant’s complaint as to whether the place where Ms. Nombre02 owns property is within the water-supply area is a matter for the Costa Rican Institute of Aqueducts and Sewers to address, since the Municipality has no jurisdiction over it. For its part, the Costa Rican Institute of Aqueducts and Sewers states that it acted in accordance with the regulations governing it, carrying out its supervisory function as required and taking duly reasoned and substantiated action throughout, as detailed. This shows that the Institute acted in accordance with the law, since the technical report issued by the New Systems Optimization Business Unit, GAM Developments, official letter UEN-OSND-GAM- 2017-00082, clearly states that potable water is not available for the property cited by Ms. Nombre03 in her amparo application. The report further adds that a review of the property’s history shows it belonged to the property recorded in the cadastre as PRN01 and, according to a search of the National Registry, that property was subdivided into four properties without an application for water availability having been submitted for that subdivision. Accordingly, this Chamber cannot establish any omission or arbitrary action by the respondent authority. The amparo must therefore be denied, and the Chamber reiterates that, according to the evidence submitted, the failure to provide potable water service to the appellant’s lot is not capricious, arbitrary, or without basis, but is justified by the absence of potable water availability in the area. On that basis, there has been no violation of fundamental rights, and the proper course is to dismiss the amparo.” (Emphasis and underlining not in the original.)\n\nAccordingly, the Heredia Public Services Company denied the appellant’s request, fully informing her of the legal or technical reasons why it could not grant her application. In this regard, the appellant must bear in mind that the relevant administrative authorities are responsible for verifying compliance with the legal or technical requirements for obtaining the requested availability, and this Chamber may not enter into that matter because it concerns ordinary questions of legality outside its jurisdiction. Note that, in accordance with the cited precedents, this Court has held that, where there is a legal impediment—such as failure to meet requirements established in the applicable regulations—or a technical impossibility—such as the lack of a Water Distribution Network, among other things—it is reasonable to condition the requested service. Accordingly, the proper course is for the appellant to pursue the ordinary legality forum and submit there any applications she considers appropriate so that the matter may be resolved as required by law. For the foregoing reasons, the amparo is declared inadmissible.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted, must be collected from the office within a maximum period of thirty business days from notification of this judgment.
