  "body_es_text": "\n\nExp: 26-028080-0007-CO \n\nRes. Nº 2026031298\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, cédula de identidad número CED01; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA).\n\nResultando:\n\n1.- Por escrito presentado a las 11:27 horas del 04 de agosto de 2026, la parte recurrente interpone recurso de amparo y manifiesta que: “PRIMERO Soy propietario de un inmueble ubicado en El Coyol de Alajuela, dentro del cual operan varios establecimientos comerciales. SEGUNDO El día lunes 27 de julio de 2026, antes de las 11:00 a.m., varios funcionarios del Instituto Costarricense de Acueductos y Alcantarillados ingresaron a mi propiedad. A esa hora los establecimientos permanecían cerrados al público, pues su horario habitual de apertura inicia a las 11:00 a.m. El único acceso abierto era el portón utilizado para el ingreso de vehículos al área de parqueo. TERCERO Los funcionarios solicitaron autorización para ingresar a una persona que se encontraba realizando labores dentro del inmueble. Dicha persona no era propietaria, representante legal, administradora ni apoderada del inmueble y carecía de facultades para autorizar el ingreso de terceros a la propiedad. Yo, en mi condición de propietario, nunca fui contactado previamente, nunca fui notificado de la inspección y nunca otorgué autorización para dicho ingreso. CUARTO Durante la inspección los funcionarios observaron que las llaves de paso correspondientes al servicio suministrado por AyA se encontraban cerradas. La persona que atendió a los funcionarios escuchó cuando éstos manifestaron que, pese a encontrarse cerradas las llaves, existía agua en la propiedad y que ello significaba que se estaba \"robando agua\". Dicha afirmación fue realizada delante de terceros presentes en el inmueble. QUINTO Los funcionarios no mostraron resolución administrativa, orden escrita, acta de inspección ni documento alguno que fundamentara las afirmaciones realizadas. Tampoco indicaron la existencia de un procedimiento administrativo abierto por presunto fraude ni comunicaron cuáles eran los hechos concretos que sustentaban semejante imputación. SEXTO Antes de retirarse manifestaron que regresarían al día siguiente porque deseaban hablar con el propietario del inmueble. SÉTIMO Ante la gravedad de lo ocurrido presenté una queja formal ante la Contraloría de Servicios del Instituto Costarricense de Acueductos y Alcantarillados. En respuesta recibí un correo electrónico oficial mediante el cual la Institución indicó, entre otras cosas, que: • inició una revisión de los hechos denunciados; • resultaba necesario profundizar la revisión técnica del caso; • debía recopilar información objetiva para esclarecer los hechos; • pretendía determinar el origen del abastecimiento de agua utilizado en la propiedad; • solicitaba posteriormente autorización para realizar una inspección detallada y tomar muestras de agua. OCTAVO La propia respuesta oficial del AyA evidencia que al momento en que los funcionarios afirmaron que en mi propiedad se estaba \"robando agua\", la Administración aún no había concluido ninguna investigación técnica. Por el contrario, expresamente reconoce que todavía debía recopilar información objetiva para determinar si existía alguna irregularidad. NOVENO La actuación descrita lesionó mi honor y mi buen nombre al atribuirme públicamente una conducta que constituye un hecho ilícito sin que existiera respaldo técnico o administrativo para efectuar tal imputación. DÉCIMO Los hechos fueron registrados por el sistema de videovigilancia instalado en la propiedad. Asimismo, existe una persona que presenció directamente las manifestaciones realizadas por los funcionarios y puede rendir declaración sobre lo ocurrido. III. DERECHOS FUNDAMENTALES LESIONADOS Considero vulnerados los siguientes derechos fundamentales: • Derecho a la inviolabilidad del domicilio y de los recintos privados. • Derecho al debido proceso. • Derecho de defensa. • Presunción de inocencia. • Derecho al honor, al buen nombre y a la dignidad. • Derecho a una actuación administrativa objetiva, razonable y respetuosa del principio de legalidad. IV. FUNDAMENTOS No cuestiono la competencia legal del Instituto Costarricense de Acueductos y Alcantarillados para ejercer labores de inspección o fiscalización relacionadas con la prestación del servicio público de agua potable. Lo que se impugna mediante este recurso es la forma en que dichas potestades fueron ejercidas. Los funcionarios ingresaron a una propiedad privada sin contar con autorización del propietario ni de una persona con facultades legales para otorgarla. Además, antes de concluir investigación alguna y sin contar con respaldo técnico, atribuyeron verbalmente la comisión de un supuesto \"robo de agua\", afirmación que fue realizada delante de terceros y que afectó mi honor y reputación. Resulta especialmente relevante que la propia respuesta institucional emitida posteriormente por el AyA reconoce expresamente que aún era necesario profundizar la revisión técnica y recopilar información objetiva para esclarecer los hechos. Ello demuestra que al momento en que se realizaron aquellas manifestaciones no existía una conclusión técnica que justificara imputar la comisión de un hecho ilícito. Las potestades de fiscalización de la Administración Pública deben ejercerse respetando los principios constitucionales de legalidad, razonabilidad, objetividad, proporcionalidad y debido proceso. La existencia de un consumo reducido de agua o la necesidad de realizar verificaciones técnicas no autoriza a funcionarios públicos a formular acusaciones de fraude sin haber concluido previamente la investigación correspondiente. La actuación descrita constituye una afectación a mi derecho al honor, a la dignidad, a la presunción de inocencia y al debido proceso. […] VI. PETITORIA Respetuosamente solicito a la Sala Constitucional: 1. Que admita para estudio el presente recurso. 2. Que solicite informe al Instituto Costarricense de Acueductos y Alcantarillados. 3. Que declare con lugar el presente recurso de amparo. 4. Que declare que la actuación de los funcionarios recurridos lesionó mis derechos fundamentales al debido proceso, al honor, a la dignidad, a la presunción de inocencia y a una actuación administrativa objetiva y respetuosa del principio de legalidad. 5. Que ordene al Instituto Costarricense de Acueductos y Alcantarillados que, en futuras actuaciones relacionadas con mi propiedad, sus funcionarios se abstengan de formular imputaciones de fraude o de cualquier otra conducta ilícita sin que exista previamente una investigación técnica objetiva y un procedimiento administrativo ajustado al debido proceso. 6. Que se adopten las medidas administrativas necesarias para garantizar que las inspecciones realizadas por el AyA respeten los derechos fundamentales de los administrados. 7. Que se condene al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios ocasionados, los cuales deberán liquidarse en la vía correspondiente.” (sic). \n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. El recurrente es propietario de un inmueble en el Coyol de Alajuela, donde operan varios establecimientos comerciales. El 27 de julio de 2026 varios funcionarios del AyA ingresaron al área de parqueo de esa propiedad, cunado los comercios estaban cerrados, con la autorización de una persona que estaba realizando labores dentro del inmueble, pese a que no era el propietario. Afirma que nunca fue contactado, ni notificado de una inspección, ni otorgó autorización. Durante la inspección los funcionarios observaron que las llaves de paso correspondientes al servicio suministrado por AyA se encontraban cerradas. La persona que atendió a los funcionarios escuchó cuando éstos manifestaron que, pese a encontrarse cerradas las llaves, existía agua en la propiedad y que ello significaba que se estaba \"robando agua\". Dicha afirmación fue realizada delante de terceros presentes en el inmueble. Los funcionarios no mostraron resolución administrativa, orden escrita, acta de inspección ni documento alguno que fundamentara las afirmaciones realizadas. Tampoco indicaron la existencia de un procedimiento administrativo abierto por presunto fraude ni comunicaron cuáles eran los hechos concretos que sustentaban semejante imputación. Sostiene que interpuso una queja ante la Contraloría de Servicios del AyA, ante la cual le respondieron que: “se inició una revisión de los hechos denunciados; resultaba necesario profundizar la revisión técnica del caso; • debía recopilar información objetiva para esclarecer los hechos; • pretendía determinar el origen del abastecimiento de agua utilizado en la propiedad; • solicitaba posteriormente autorización para realizar una inspección detallada y tomar muestras de agua.” Acusa que lo anterior evidencia que el momento en que los funcionarios afirmaron que en su propiedad se estaba robando agua la Administración aún no había concluido ninguna investigación. Estima que la actuación de los funcionarios lesionó su honor, a l debido proceso, a la dignidad, a la presunción de inocencia y a una actuación administrativa objetiva. \n\nII.- INADMISIBILIDAD DEL AMPARO. Vistos los reclamos y pretensiones del recurrente, se le hace saber en primer término que, el solo hecho de que el AyA realice actos de revisión, control y fiscalización del servicio que prestan y su correcto funcionamiento, no constituye -per se- una violación a sus derechos fundamentales, toda vez que, las autoridades recurridas, se encuentran facultadas para ello, en el marco de sus competencias.\n\nEn segundo lugar, aun cuando el recurrente acusa la violación al debido proceso, lo cierto es que, de los hechos que expone no se desprende que a la fecha de interposición de este amparo, se haya emitido algún acto o sanción en su contra, que restrinja sus derechos fundamentales y que esta Sala deba tutelar. En todo caso, tal como lo indicó el propio recurrente, interpuso una queja formal ante la autoridad recurrida, la cual se encuentra en investigación, por lo que, a partir de ese momento que el recurrente podrá plantear los reclamos que estime necesario y ejercer su derecho de defensa. \n\nEn tercer lugar, si el amparado estima que los funcionarios del AyA se han excedido en el ejercicio de sus facultades, deberá plantear de manera formal y por escrito las denuncias que estime pertinentes, sea ante el propio instituto -como indica haberlo hecho- o en las instancias legales ordinarias, por cuanto esta Sala no puede actuar como una mera instancia tramitadora de denuncias contra funcionarios públicos, puesto que ello no solamente haría necesario efectuar investigaciones y probanzas complicadas, incompatibles con la naturaleza sumaria de esta sede, sino también sustituir directamente la voluntad administrativa y suplantar a los despachos públicos en la gestión de los asuntos de su competencia. Así las cosas, deberá el recurrente si a bien lo tiene, plantear los reclamos o denuncias pertinentes en la vía administrativa, a través de los mecanismos dispuestos al efecto, o bien en la vía judicial competente, para que se resuelva lo que en derecho corresponda. En consecuencia, el recurso es inadmisible y así se declara.\n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso.\n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at nine thirty on 13 August 2026.\n\nAmparo application filed by Nombre01, identity card number CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA).\n\nBackground:\n\n1.- In a written submission filed at 11:27 on 04 August 2026, the claimant filed an amparo application and states: “FIRST. I own a property located in El Coyol, Alajuela, on which several commercial establishments operate. SECOND. On Monday, 27 July 2026, before 11:00 a.m., several officials of the Instituto Costarricense de Acueductos y Alcantarillados entered my property. At that time, the establishments were closed to the public, as their usual opening time is 11:00 a.m. The only open access was the gate used by vehicles entering the parking area. THIRD. The officials asked a person who was carrying out work on the property for authorization to enter. That person was not the owner, legal representative, manager, or attorney-in-fact for the property and had no authority to authorize third parties to enter the property. I, as the owner, was never contacted beforehand, was never notified of the inspection, and never authorized that entry. FOURTH. During the inspection, the officials observed that the shutoff valves for the service supplied by AyA were closed. The person who attended to the officials heard them state that, although the valves were closed, there was water on the property and that this meant water was being ‘stolen.’ That statement was made in front of third parties present on the property. FIFTH. The officials showed no administrative decision, written order, inspection report, or other document supporting their statements. Nor did they indicate that an administrative proceeding had been opened concerning alleged fraud or communicate the specific facts underlying such an accusation. SIXTH. Before leaving, they said they would return the following day because they wanted to speak with the property owner. SEVENTH. In view of the seriousness of what occurred, I filed a formal complaint with the Contraloría de Servicios of the Instituto Costarricense de Acueductos y Alcantarillados. In response, I received an official email in which the Institution stated, among other things, that it had: • begun a review of the reported events; • found it necessary to conduct a more in-depth technical review of the case; • needed to gather objective information to clarify the events; • intended to determine the source of the water supply used on the property; • subsequently requested authorization to conduct a detailed inspection and take water samples. EIGHTH. AyA’s own official response shows that, when the officials stated that water was being ‘stolen’ on my property, the Administration had not yet completed any technical investigation. On the contrary, it expressly acknowledged that it still needed to gather objective information to determine whether there was any irregularity. NINTH. The conduct described harmed my honor and good name by publicly attributing to me conduct constituting an unlawful act without any technical or administrative basis for making that accusation. TENTH. The events were recorded by the video surveillance system installed on the property. There is also a person who directly witnessed the statements made by the officials and can testify about what occurred. III. FUNDAMENTAL RIGHTS VIOLATED I consider the following fundamental rights to have been violated: • The right to the inviolability of the home and private premises. • The right to due process. • The right of defense. • The presumption of innocence. • The right to honor, good name, and dignity. • The right to objective and reasonable administrative action that respects the principle of legality. IV. GROUNDS I do not challenge the legal authority of the Instituto Costarricense de Acueductos y Alcantarillados to carry out inspection or oversight activities relating to the provision of the public drinking-water service. What is challenged by this amparo application is the manner in which those powers were exercised. The officials entered private property without authorization from the owner or from a person legally empowered to grant it. In addition, before completing any investigation and without technical support, they verbally attributed the commission of alleged ‘water theft,’ a statement made in front of third parties that affected my honor and reputation. It is especially relevant that AyA’s own subsequent institutional response expressly acknowledges that it was still necessary to conduct a more in-depth technical review and gather objective information to clarify the events. This shows that, when those statements were made, there was no technical conclusion justifying the accusation that an unlawful act had been committed. The oversight powers of the Public Administration must be exercised in accordance with the constitutional principles of legality, reasonableness, objectivity, proportionality, and due process. Low water consumption or the need to conduct technical checks does not authorize public officials to make accusations of fraud without first completing the corresponding investigation. The conduct described affects my rights to honor, dignity, the presumption of innocence, and due process. […] VI. RELIEF SOUGHT I respectfully request that the Constitutional Chamber: 1. Admit this application for consideration. 2. Request a report from the Instituto Costarricense de Acueductos y Alcantarillados. 3. Uphold this amparo application. 4. Declare that the conduct of the respondent officials violated my fundamental rights to due process, honor, dignity, the presumption of innocence, and objective administrative action that respects the principle of legality. 5. Order the Instituto Costarricense de Acueductos y Alcantarillados, in future actions relating to my property, to ensure that its officials refrain from making accusations of fraud or any other unlawful conduct unless an objective technical investigation and an administrative proceeding in accordance with due process have first taken place. 6. Adopt the administrative measures necessary to ensure that inspections conducted by AyA respect the fundamental rights of those subject to the Administration. 7. Order the Instituto Costarricense de Acueductos y Alcantarillados to pay the costs, damages, and losses caused, which must be quantified through the corresponding procedure.” (sic).\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to dismiss summarily or on the merits, at any time, including upon filing, any application submitted for its consideration that proves manifestly inadmissible, or where it considers that there is sufficient evidence to dismiss it, or that it is simply a reiteration or reproduction of an identical or similar prior application that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE AMPARO APPLICATION. The claimant owns a property in El Coyol, Alajuela, where several commercial establishments operate. On 27 July 2026, several AyA officials entered the parking area of that property, when the businesses were closed, with the authorization of a person who was carrying out work on the property, even though that person was not the owner. The claimant states that he was never contacted or notified of an inspection and never gave authorization. During the inspection, the officials observed that the shutoff valves for the service supplied by AyA were closed. The person who attended to the officials heard them state that, although the valves were closed, there was water on the property and that this meant water was being “stolen.” That statement was made in front of third parties present on the property. The officials showed no administrative decision, written order, inspection report, or other document supporting their statements. Nor did they indicate that an administrative proceeding had been opened concerning alleged fraud or communicate the specific facts underlying such an accusation. The claimant says he filed a complaint with AyA’s Contraloría de Servicios, which responded that “a review of the reported events had begun; it was necessary to conduct a more in-depth technical review of the case; • objective information needed to be gathered to clarify the events; • it intended to determine the source of the water supply used on the property; • it would subsequently request authorization to conduct a detailed inspection and take water samples.” He alleges that this shows that, when the officials stated that water was being stolen on his property, the Administration had not yet completed any investigation. He considers that the officials’ conduct violated his rights to honor, due process, dignity, the presumption of innocence, and objective administrative action.\n\nII.- INADMISSIBILITY OF THE AMPARO. Having considered the claimant’s allegations and requests, he is first informed that the mere fact that AyA carries out review, control, and oversight activities concerning the service it provides and its proper functioning does not, per se, violate his fundamental rights, since the respondent authorities are empowered to do so within the scope of their powers.\n\nSecond, although the claimant alleges a violation of due process, the facts he describes do not show that, as of the date this amparo application was filed, any act or sanction had been issued against him that restricted his fundamental rights and required protection by this Chamber. In any event, as the claimant himself indicated, he filed a formal complaint with the respondent authority, which is under investigation. From that point onward, the claimant may raise any claims he considers necessary and exercise his right of defense.\n\nThird, if the amparo claimant considers that AyA officials exceeded their powers, he must formally submit in writing any complaints he considers appropriate, either to the institute itself—as he says he has done—or to the ordinary legal forums. This Chamber cannot act merely as a body that processes complaints against public officials, since doing so would not only require complex investigations and evidentiary proceedings incompatible with the summary nature of this forum, but would also directly substitute its will for that of the Administration and supplant public offices in handling matters within their competence. Accordingly, if the claimant so wishes, he must submit the relevant claims or complaints through the administrative route, using the mechanisms provided for that purpose, or through the competent judicial route, so that the matter may be resolved according to law. Consequently, the application is inadmissible, and so it is declared.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The claimant is advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that may have been submitted must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session No. 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 on 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe application is summarily dismissed.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
