  "body_es_text": "\n\nEXPEDIENTE N° 26-028156-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026031317\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre02, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ELECTIRICIDAD (ICE) y la MUNICIPALIDAD DE LIMÓN.\n\nResultando:\n\n 1.- Por escrito incorporado al expediente digital de la Sala a las 15:25 horas del 4 de agosto de 2026, la parte recurrente interpone recurso de amparo contra la Municipalidad de Limón y el Instituto Costarricense de Electricidad. Indica lo siguiente: “PRIMERO: En la propiedad colindante con mi vivienda, perteneciente al señor Nombre01, existen varios árboles de gran altura que presentan un riesgo evidente para mi vivienda y para la integridad física de mi familia, debido a la posibilidad de que se desplomen, especialmente durante la época lluviosa. SEGUNDO: Ante la negativa del propietario de proceder con el derribo de dichos árboles, promoví el proceso especial de derribo de árboles, tramitado bajo el expediente judicial N.° 25-000274-0465-AG ante el Juzgado Agrario de Limón. TERCERO: Como resultado de dicho proceso, mediante la sentencia N.° 2025000674, el Juzgado Agrario ordenó el derribo de los árboles, disponiendo además que el Instituto Costarricense de Electricidad (ICE) y la Municipalidad de Limón, dentro del ámbito de sus competencias, realizaran las actuaciones necesarias para ejecutar dicha orden. Esta resolución fue comunicada a ambas instituciones desde el 25 de noviembre de 2025. CUARTO: No obstante lo anterior, han transcurrido aproximadamente siete meses desde que las instituciones recurridas fueron notificadas de la resolución judicial, sin que hayan ejecutado las acciones que les fueron ordenadas, incumpliendo de manera injustificada una sentencia firme y permitiendo que persistiera una situación de riesgo plenamente conocida. QUINTO: Como consecuencia directa de esa omisión, el día 2 de julio de 2026, producto de las fuertes lluvias que afectaron la zona, uno de los árboles cayó sobre mi vivienda, ocasionando daños materiales y poniendo en grave peligro mi vida y la de mi familia. Este hecho demuestra que el riesgo advertido era real, inminente y perfectamente previsible, por lo que pudo haberse evitado si las instituciones recurridas hubieran actuado con la diligencia que les imponía la sentencia judicial. SEXTO: A la fecha de presentación de este recurso, las instituciones recurridas continúan sin acatar la orden emitida por el Juzgado Agrario, manteniéndose el riesgo para mi vida, mi integridad física, mi vivienda y mi patrimonio, ya que aún existen árboles cuya condición representa un peligro inminente. (…) P or las razones expuestas, respetuosamente solicito a esta Honorable Sala Constitucional: Que se declare con lugar el presente recurso de amparo. Que se ordene a la Municipalidad de Limón y al Instituto Costarricense de Electricidad (ICE) cumplir de forma inmediata con la sentencia dictada dentro del expediente N.° 25-000274-0465-AG, adoptando todas las medidas necesarias para eliminar el riesgo existente. Que se ordene a las instituciones recurridas adoptar, de manera inmediata, las medidas preventivas necesarias para garantizar la protección de mi vida, la de mi familia y mi vivienda mientras se ejecuta en su totalidad la orden judicial. Que se aperciba a las autoridades recurridas sobre su deber de acatar las resoluciones judiciales y se les prevenga para que no vuelvan a incurrir en conductas omisivas que comprometan derechos fundamentales. Que se condene a las instituciones recurridas al pago de las costas, daños y perjuicios ocasionados, de conformidad con lo dispuesto en la Ley de la Jurisdicción Constitucional.” \n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n \n\n I.- OBJETO DEL RECURSO. El recurrente acusa que, luego de 7 meses, aún no se ha acatado la sentencia 2025000674 emitida por el Juzgado Agrario dentro del expediente 25-000274-0465-AG, atinente al derribo de árboles que ponen en peligro su vivienda. \n\nII.- SOBRE EL CASO CONCRETO. En la especie, se observa que lo pretendido en este amparo versa sobre la ejecución o el cumplimiento de los pronunciamientos jurisdiccionales de otros Tribunales de Justicia de la República, -artículo 153 de la Constitución Política-, lo cual no corresponde ser conocido por esta Sala, máxime si se considera que a cualquier órgano jurisdiccional le asiste la facultad de ejecutar sus pronunciamientos y hacer cumplir sus órdenes. Deberá, entonces, la parte recurrente, si a bien lo tiene, acudir ante el órgano jurisdiccional que dictó la resolución para que este, en ejercicio de las potestades que le asisten, disponga lo que en derecho corresponda para hacer cumplir lo resuelto. Así las cosas, este recurso deviene en inadmisible y así se declara.\n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "\n\nCASE FILE No. 26-028156-0007-CO\n\nPROCEEDING: AMPARO APPLICATION\n\nRULING No. 2026031317\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 13 August 2026.\n\nAmparo application filed by Nombre02, identity card CED01, against the INSTITUTO COSTARRICENSE DE ELECTIRICIDAD (ICE) and the MUNICIPALIDAD DE LIMÓN.\n\nBackground:\n\n1.- By a written submission incorporated into the Chamber’s digital case file at 15:25 on 4 August 2026, the applicant filed an amparo application against the Municipalidad de Limón and the Instituto Costarricense de Electricidad. The applicant states: “FIRST: On the property adjoining my home, which belongs to Nombre01, there are several very tall trees that pose an evident risk to my home and to my family’s physical integrity because they could fall, especially during the rainy season. SECOND: When the owner refused to have those trees felled, I initiated special proceedings for the felling of trees, heard under judicial case file No. 25-000274-0465-AG before the Agrarian Court of Limón. THIRD: As a result of those proceedings, in judgment No. 2025000674, the Agrarian Court ordered the trees to be felled and further directed the Instituto Costarricense de Electricidad (ICE) and the Municipalidad de Limón, within the scope of their respective powers, to take the actions necessary to carry out that order. This ruling was communicated to both institutions on 25 November 2025. FOURTH: Despite the foregoing, approximately seven months have elapsed since the respondent institutions were notified of the judicial ruling, and they have not carried out the actions they were ordered to take. They have unjustifiably failed to comply with a final judgment, allowing a known risk to persist. FIFTH: As a direct result of that omission, on 2 July 2026, one of the trees fell on my home because of the heavy rains that affected the area, causing property damage and seriously endangering my life and that of my family. This event shows that the identified risk was real, imminent, and entirely foreseeable, and could therefore have been avoided if the respondent institutions had acted with the diligence required of them by the judicial judgment. SIXTH: As of the date this application was filed, the respondent institutions continue to fail to comply with the order issued by the Agrarian Court. The risk to my life, my physical integrity, my home, and my property therefore persists, since there are still trees whose condition poses an imminent danger. (…) For the reasons stated, I respectfully ask this Honorable Constitutional Chamber: To declare this amparo application well-founded. To order the Municipalidad de Limón and the Instituto Costarricense de Electricidad (ICE) to comply immediately with the judgment issued in case file No. 25-000274-0465-AG, taking all necessary measures to eliminate the existing risk. To order the respondent institutions to immediately adopt the preventive measures necessary to protect my life, my family, and my home while the judicial order is being carried out in full. To warn the respondent authorities of their duty to comply with judicial rulings and admonish them not to engage again in omissions that compromise fundamental rights. To order the respondent institutions to pay the costs, damages, and losses caused, in accordance with the provisions of the Ley de la Jurisdicción Constitucional.”\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber, at any time, including upon filing, to summarily dismiss or reject on the merits any matter submitted to it that is manifestly inadmissible, when it considers that there is sufficient evidence to reject it, or when the matter is simply a reiteration or reproduction of an identical or similar earlier submission that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION. The applicant alleges that, after 7 months, judgment 2025000674 issued by the Agrarian Court in case file 25-000274-0465-AG has still not been complied with. That judgment concerns the felling of trees that endanger the applicant’s home.\n\nII.- THE SPECIFIC CASE. In this case, the relief sought in this amparo concerns the enforcement or compliance with judicial rulings issued by other Courts of Justice of the Republic—Article 153 of the Political Constitution—which is not a matter for this Chamber to hear, particularly since every judicial body has the authority to enforce its rulings and ensure compliance with its orders. The applicant must therefore, if they so wish, apply to the judicial body that issued the ruling so that it may, in exercise of its powers, order whatever is appropriate in law to enforce what was decided. Accordingly, this application is inadmissible, and that is hereby declared.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve those items from the office within a maximum period of 30 business days from notification of this judgment.
