San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita bajo el número de expediente 26-028454-0007-CO, interpuesto por Nombre01, cédula de identidad CED01; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS y la AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS. \n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de la Sala el 6 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS y la AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS. Manifiesta que a finales de 2025 el Instituto Costarricense de Acueductos y Alcantarillados (AyA) realizó un cambio de medidor en su vivienda, después de lo cual se incrementaron y comenzaron a variar considerablemente los montos de los recibos de agua potable, por lo que consultó ante dicha institución y se le indicó que posiblemente existía una fuga; señala que, ante ello, realizó por su cuenta arreglos en toda la tubería de su casa y mantuvo cerrada la llave de paso durante la noche y gran parte del día, sin que las tarifas dejaran de variar, pues recibió facturaciones de ¢50.000, ¢800.000 -posteriormente ajustadas a ¢402.000- y ¢61.000, entre otros montos. Refiere que acudió nuevamente al AyA en busca de una solución y se le indicó que debía realizar un segundo arreglo de pago por ¢318.000, mientras un funcionario revisaría el medidor y se analizaría su queja; agrega que funcionarios acudieron en tres ocasiones y manifestaron que todo estaba bien, y que además se le solicitó registrar durante siete días el consumo de agua de su hogar, sin que a la fecha haya recibido respuesta. Señala que posteriormente acudió a la Autoridad Reguladora de los Servicios Públicos (ARESEP), donde presentó su queja y aportó las pruebas correspondientes, pero se le informó que el trámite tendría una duración aproximada de seis meses, por lo que continúa sin respuesta. Manifiesta que actualmente debe pagar los recibos, cuyos montos continúan variando, además del arreglo de pago efectuado con el AyA, situación que le genera desesperación e impotencia ante la incertidumbre sobre los montos que deberá cancelar. Solicita que se revise adecuadamente el medidor para determinar y corregir el problema que origina las variaciones en el consumo y en las tarifas, que se analicen los cobros efectuados desde el cambio del medidor y se le reintegre el dinero que considera pagado de más, así como la anulación de los dos arreglos de pago realizados con el AyA. Solicita la intervención de la Sala.\n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. La parte recurrente reclama que el Instituto Costarricense de Acueductos y Alcantarillados, a partir del cambio de medidor realizado a finales de 2025, le ha efectuado cobros de agua potable cuyos montos considera excesivos y variables, pese a haber realizado reparaciones en la tubería de su vivienda y a las revisiones efectuadas por funcionarios de la institución; asimismo, acusa que el AyA no ha resuelto su queja ni ha corregido las variaciones en la facturación, mientras que la gestión presentada ante la Autoridad Reguladora de los Servicios Públicos continúa sin respuesta, lo que considera lesivo de sus derechos fundamentales; por lo que pretende que se revise el medidor, se determine y subsane la causa de las variaciones en el consumo y la facturación, se analicen los cobros efectuados desde su cambio, se le reintegre lo pagado de más y se anulen los dos arreglos de pago realizados con el AyA.\n\nII.- SOBRE LA FACTURACIÓN DEL SERVICIO DE AGUA. Vistos los alegatos de la recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de la Administración Pública, ni servir como un instrumento genérico para canalizar peticiones de otros tipos. Por esta razón, la Sala no puede hacer las veces de alzada en la materia expuesta y revisar si el cobro o facturación por el servicio de agua que realiza el AyA a la amparada, se ajusta o no a los hechos, al consumo real y a la normativa vigente, por cuanto constituye un diferendo de legalidad ordinaria que debe ser dirimido en la vía administrativa o judicial correspondiente. Tampoco corresponde a esta Sala sustituir las competencias legalmente asignadas al instituto recurrido o a las autoridades competentes en la materia, a efecto de iniciar investigaciones para determinar si técnica y jurídicamente procede o no el ajuste en la facturación, o verificar el método de cálculo, el consumo real y el estado del medidor o de las tuberías, por cuanto ello es una labor propia de la Administración, cuyos diferendos son propios de conocerse en la vía de legalidad ordinaria y no de constitucionalidad.\n\nAl respecto, cabe destacar que no puede pretenderse que, por la vía del amparo, la Sala Constitucional haga las veces de una mera instancia tramitadora de denuncias en materia de facturación de servicios, puesto que ello no solamente haría necesario efectuar probanzas complicadas, incompatibles con la naturaleza sumaria de esta sede, sino también sustituir directamente la voluntad administrativa y suplantar a los despachos públicos en la gestión de los asuntos de su competencia. Nótese que, en este caso, la recurrente plantea reclamos ante el AyA relacionados con las variaciones en la facturación y el funcionamiento del medidor, así como una gestión ante la Autoridad Reguladora de los Servicios Públicos, encontrándose inconforme con la situación expuesta, sin que resulte procedente discutir en esta sede la procedencia de los cobros, la existencia de sumas pagadas en exceso, la devolución de dichos montos o la anulación de los arreglos de pago, dado que esta Sala no es un contralor de legalidad de los actos de la Administración, ni una instancia más dentro de los procedimientos correspondientes.\n\nAsí las cosas, deberá la parte recurrente acudir ante la vía de legalidad ordinaria, administrativa o judicial, a fin de plantear allí, por escrito, los reclamos que estime pertinentes, a fin de que se resuelva lo que en derecho corresponda. En consecuencia, en cuanto a este extremo, el recurso es inadmisible y así se declara.\n\nIII.- SOBRE LA ALEGADA MORA ADMINISTRATIVA. Por otra parte, la recurrente aduce que ha presentado reclamos ante el AyA y la ARESEP relacionados con las variaciones en la facturación y el funcionamiento del medidor y no le han resuelto. Sin embargo, dichas gestiones no constituyen solicitudes de información puras y simples protegidas por el artículo 27 de la Constitución Política, en cuyo caso, el plazo de respuesta sería de 10 días hábiles conforme al artículo 32 de la Ley de la Jurisdicción Constitucional; sino que se trata de reclamos administrativos relacionados con la facturación del servicio de agua, a lo cual le es aplicable lo dispuesto en el artículo 41 de la Constitución Política. Ahora bien, a partir del voto número 2008-02545 de las 8:55 horas del 22 de febrero de 2008 y salvo algunas excepciones, esta Sala ha remitido este tipo de reclamos a la jurisdicción contencioso administrativa y, precisamente, el tema aquí planteado no es una de las excepciones que esta Sala ha admitido para conocer la alegada violación al derecho a obtener justicia administrativa pronta y cumplida. En consecuencia, lo procedente es remitir a la parte recurrente a la vía contenciosa a acusar el retardo en cuestión, con fundamento en los siguientes considerandos.\n\nIV.- NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación. Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.\n\n V.- VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS: CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para la parte recurrente. Consecuentemente, se impone el rechazo de plano e indicarle a la persona gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa. \n\nVI.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\nVII.- VOTO SALVADO DEL MAGISTRADO CRUZ CASTRO, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. Si bien en el pasado he sostenido el criterio de mayoría del Tribunal, bajo una mejor ponderación de los derechos fundamentales que se reclaman, estimo que la mora administrativa constituye una lesión a una garantía procesal fundamental, razón por la que cambio el criterio que había expuesto, admitiendo la posible infracción al derecho a una justicia administrativa pronta y cumplida, separándome de la visión de la mayoría del Tribunal, en el sentido que –salvo contadas excepciones- este tipo de reproches deben resolverse en la jurisdicción contenciosa administrativa. Por el contrario, estimo que uno de los derechos que esta jurisdicción se encuentra llamada a tutelar es el de la justicia pronta y cumplida, expresamente consagrado en el artículo 41 constitucional. Ello conforme al ámbito de competencia asignado a este Tribunal en materia de protección a derechos fundamentales, en atención a lo dispuesto en los artículos 10 y 48 de la Constitución Política. Si bien, entiendo la importancia de las reformas de la jurisdicción contencioso administrativa a partir de la vigencia de la Ley 8508 del veinticuatro de abril de dos mil seis, lo cierto es que dicha situación no justifica la remisión a dicha instancia de los asuntos que versan sobre materia que es competencia de esta Sala, la cual ha demostrado a lo largo de los años que es un medio célere y efectivo para la tutela de los derechos fundamentales de los habitantes del país.\n\nVIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso. San José, at nine thirty a.m. on 13 August 2026.\n\nAmparo proceeding registered under expediente number 26-028454-0007-CO, filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS and the PUBLIC SERVICES REGULATORY AUTHORITY.\n\nBackground:\n\n1.- By a brief filed with the Chamber’s Secretariat on 6 August 2026, the petitioner files an amparo proceeding against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS and the PUBLIC SERVICES REGULATORY AUTHORITY. The petitioner states that, at the end of 2025, the Costa Rican Institute of Aqueducts and Sewers (AyA) replaced the water meter at the petitioner’s home, after which the amounts on drinking-water bills increased and began to fluctuate considerably. The petitioner therefore consulted that institution and was told that there might be a leak. The petitioner states that, in response, repairs were made to all the pipes in the home at the petitioner’s own expense, and the shutoff valve was kept closed overnight and for much of the day, but the bills continued to vary: amounts included ¢50.000, ¢800.000—later adjusted to ¢402.000—and ¢61.000, among others. The petitioner says that they again went to AyA seeking a solution and were told to enter into a second payment arrangement for ¢318.000, while an employee would inspect the meter and the complaint would be reviewed. The petitioner adds that employees visited on three occasions and said everything was in order, and that the petitioner was also asked to record household water use for seven days, but has received no response to date. The petitioner says that they later went to the Public Services Regulatory Authority (ARESEP), where they filed a complaint and submitted the relevant evidence, but were told that processing would take approximately six months, and they still have no response. The petitioner states that they must currently pay the bills, whose amounts continue to vary, as well as the payment arrangement made with AyA, a situation that causes desperation and helplessness in the face of uncertainty about the amounts they will have to pay. The petitioner asks that the meter be properly inspected to determine and correct the problem causing the variations in consumption and charges, that the charges made since the meter was replaced be reviewed and the money the petitioner considers overpaid be refunded, and that the two payment arrangements made with AyA be annulled. The petitioner requests the Chamber’s intervention.\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to dismiss outright or on the merits, at any time, including upon filing, any application brought before it that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is simply a reiteration or reproduction of an identical or similar prior application that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- PURPOSE OF THE APPLICATION. The petitioner complains that, following the water-meter replacement carried out at the end of 2025, the Costa Rican Institute of Aqueducts and Sewers has charged amounts for drinking water that the petitioner considers excessive and variable, despite repairs to the pipes in the petitioner’s home and inspections by the institution’s employees. The petitioner also alleges that AyA has not resolved the complaint or corrected the variations in billing, while the application submitted to the Public Services Regulatory Authority remains unanswered, which the petitioner considers injurious to their fundamental rights. The petitioner therefore seeks inspection of the meter, determination and correction of the cause of the variations in consumption and billing, review of the charges made since its replacement, reimbursement of the amount overpaid, and annulment of the two payment arrangements made with AyA.\n\nII.- WATER SERVICE BILLING. In light of the petitioner’s arguments, the petitioner is advised that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms; it is not an instrument for reviewing the legality of acts of the Public Administration or a general means of channeling other types of requests. For this reason, the Chamber cannot act as an appellate body in the matter raised and review whether the charge or billing for water service by AyA to the amparo petitioner is consistent with the facts, actual consumption, and regulations in force, since this is an ordinary legality dispute that must be resolved through the appropriate administrative or judicial procedure. Nor is it for this Chamber to assume the powers legally assigned to the respondent institute or the competent authorities in the matter, in order to initiate investigations into whether a billing adjustment is technically and legally warranted, or to verify the calculation method, actual consumption, or the condition of the meter or pipes. That is a task for the Administration, and disputes of this kind are to be heard through ordinary legality proceedings, not constitutional proceedings.\n\nIn this regard, it should be emphasized that a party cannot seek to have the Constitutional Chamber act, through an amparo proceeding, as a mere forum for processing complaints about service billing. Doing so would not only require complex evidentiary proceedings incompatible with the summary nature of this forum, but would also directly substitute the administrative authority’s judgment and usurp the public offices’ handling of matters within their competence. In this case, the petitioner raises complaints with AyA concerning billing variations and the meter’s operation, as well as an application before the Public Services Regulatory Authority, and is dissatisfied with the situation described. It is not appropriate to debate in this forum whether the charges are warranted, whether sums were overpaid, whether those amounts should be refunded, or whether the payment arrangements should be annulled, since this Chamber is not a legality-review body for acts of the Administration or another instance within the relevant proceedings.\n\nAccordingly, the petitioner must turn to the ordinary legality process, administrative or judicial, and submit in writing the complaints they consider appropriate, so that the matter may be resolved as the law requires. Consequently, the application is inadmissible as to this issue, and so it is declared.\n\nIII.- ALLEGED ADMINISTRATIVE DELAY. The petitioner also alleges that complaints were submitted to AyA and ARESEP concerning billing variations and the meter’s operation, and have not been resolved. However, those applications are not simple requests for information protected by Article 27 of the Political Constitution, in which case the response period would be 10 business days under Article 32 of the Constitutional Jurisdiction Act. Rather, they are administrative complaints concerning water-service billing, to which Article 41 of the Political Constitution applies. Since judgment number 2008-02545, issued at 8:55 a.m. on 22 February 2008, and subject to certain exceptions, this Chamber has referred this type of complaint to the administrative-litigation jurisdiction. The issue raised here is not one of the exceptions this Chamber has accepted for hearing an alleged violation of the right to obtain prompt and effective administrative justice. Accordingly, the petitioner must be referred to the administrative-litigation process to allege the delay in question, on the grounds set out below.\n\nIV.- THE NEW ADMINISTRATIVE JUSTICE SYSTEM: AN EXPEDITIOUS AND EFFECTIVE MECHANISM FOR PROTECTING THE SUBSTANTIVE LEGAL POSITIONS OF ADMINISTERED PERSONS. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in view of the absence of expeditious and swift procedural channels for protecting substantive legal positions grounded in the infra-constitutional legal order or legality standard, which have an indirect connection with fundamental rights and Constitutional Law. In this regard, it must be kept in mind that, by virtue of its supremacy, super-legality, and direct and immediate effect, the Constitution indirectly grounds any conceivable substantive legal position of individuals. Nevertheless, upon further consideration and following the enactment of the Administrative Litigation Procedure Code (Law No. 8508 of 24 April 2006), which entered into force on 1 January 2008, it has become clear that litigants now have access to a plenary and universal administrative-litigation jurisdiction that is highly expeditious and swift due to the various procedural mechanisms that legislation introduces into the legal order. These include shorter periods for carrying out the various procedural acts; broad standing; interim measures; an open-ended range of claims that may be brought; oral proceedings—and their subsidiary principles of concentration, immediacy, and expedition; a single instance with a right of appeal in expressly specified situations; in-proceeding conciliation; unified proceedings; expedited proceedings or “amparo de legalidad”; proceedings on the merits; new enforcement measures (coercive fines, substitute or commissarial enforcement, attachment of assets in the fiscal domain and some assets in the public domain); the broad powers of the enforcement judiciary; the extension and adaptation of the effects of precedent to third parties; and flexibility in cassation appeals. The express purpose of all these novel procedural institutions is to achieve procedural economy, expedition, promptness, and effective protection of the substantive legal positions of administered persons, while safeguarding basic fundamental rights such as due process, the right of defense, and adversarial process. In sum, the new administrative-litigation jurisdiction, with its new features of simplicity, expedition, and promptness, is a suitable channel for the effective protection of administered persons’ substantive legal positions where evidence must be gathered or ordinary legality issues resolved.\n\nV.- VERIFICATION OF THE STATUTORY TIME LIMITS FOR RESOLVING ADMINISTRATIVE PROCEEDINGS: AN OBVIOUS QUESTION OF ORDINARY LEGALITY. It is evident that determining whether the Public Administration complies with the periods established by the General Public Administration Act (Articles 261 and 325) or by sectoral laws for special administrative proceedings, to issue a final decision in an administrative proceeding—initiated ex officio or at a party’s request—or to hear the applicable administrative appeals, is a question of ordinary legality. Going forward, it may be debated and resolved before the administrative-litigation jurisdiction, applying the principles that inform constitutional jurisdiction, such as vicariant standing, the ability to appear without legal counsel, and the absence of costs for the petitioner. Consequently, the application must be dismissed outright, and the petitioner advised that, if they so wish, they may turn to the administrative-litigation jurisdiction.\n\nVI.- NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the Administrative Litigation Courts and not by this Chamber. However, with the recent enactment of Law No. 9097, the Law Regulating the Right of Petition, that right has been established as subject to judicial protection through the amparo proceeding provided for in Article 32 of the Constitutional Jurisdiction Act, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s actions, its administrative acts, or its response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court should change its line of precedent; under Article 7 of its Act, this Court alone is responsible for defining its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo proceeding, in all other cases the competent judges are those of the administrative-litigation jurisdiction, for the reasons this Court gave in judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008. All of this is consistent with Article 25 of the American Convention on Human Rights, Constitutional Law (its values, principles, and rules), and the applicable legal provisions, based on a logical, systematic, and teleological interpretation of the legal order.\n\nVII.- DISSENTING OPINION OF JUSTICE CRUZ CASTRO REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. Although in the past I have upheld the Court’s majority position, upon further consideration of the fundamental rights being asserted, I consider administrative delay to be a violation of a fundamental procedural guarantee. For that reason, I am changing the position I previously expressed and accepting that there may have been a violation of the right to prompt and effective administrative justice, departing from the Court majority’s view that—except in a few cases—this type of complaint must be resolved in the administrative-litigation jurisdiction. On the contrary, I consider that one of the rights this jurisdiction is called upon to protect is the right to prompt and effective justice, expressly enshrined in Article 41 of the Constitution. This follows from the scope of jurisdiction assigned to this Court in matters concerning the protection of fundamental rights, pursuant to Articles 10 and 48 of the Political Constitution. Although I understand the importance of the reforms to the administrative-litigation jurisdiction following the entry into force of Law 8508 of 24 April 2006, that fact does not justify referring to that forum matters concerning a subject within this Chamber’s jurisdiction, which has demonstrated over the years that it provides an expeditious and effective means of protecting the fundamental rights of the country’s inhabitants.\n\nVIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The petitioner is advised that any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that may have been submitted must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe application is dismissed outright.
