"summary_en": "The Constitutional Chamber (Sala Constitucional) decided a new application alleging noncompliance with judgment No. 2025031199, which had ordered the Municipality of Pococí to improve a road to prevent flooding in Barrio El Roble. The Municipality documented road improvement work and a stormwater drainage system in upstream areas and within the neighborhood’s area of influence. The Chamber found that these works showed diligent, progressive action, so neither omission nor deliberate disobedience had been established. However, photographs and a video submitted by the applicant, which the authorities did not contest, showed that flooding continued in part of the neighborhood. The Chamber therefore rejected the noncompliance application but urged municipal authorities to continue technical and administrative work, determine the causes of the remaining impacts, and carry out any additional improvements needed to address the flooding comprehensively.",

"excerpt_en": "In light of the foregoing, this Court finds that the respondent authorities have documented the completion of specific works intended to carry out what was ordered in judgment No. 2025031199. Accordingly, an omission or deliberate disobedience of this Chamber’s ruling cannot be established. However, the photographs and video submitted by the applicant, which the respondent authorities did not contest, show that flooding still affects part of Barrio El Roble despite the completed works. This demonstrates that the interventions, although real and verifiable progress, have not been sufficient to eliminate entirely the risk that gave rise to these proceedings.\n\nConsequently, noncompliance with judgment No. 2025031199 should not be declared, since the Municipality of Pococí has diligently and progressively carried out works. Nevertheless, because the applicant has shown that partial flooding impacts remain, the respondent authorities should be urged to continue the relevant technical and follow-up work, determine the causes of the remaining impacts, and carry out any additional improvements needed to achieve a comprehensive and definitive response to the flooding affecting residents of Barrio El Roble.",

San José, at nine hours and thirty minutes on 18 August 2026.\n\nMotion alleging noncompliance with the amparo proceeding processed under case file number 25-026131-0007-CO, filed by Nombre01, identity card CED01, on behalf of THE RESIDENTS OF BARRIO EL ROBLE, against the MUNICIPALITY OF POCOCÍ.\n\nBackground:\n\n1.- By a brief filed by the applicant on 3 August 2026, noncompliance is again alleged with the order issued in judgment N° 2025031199 at nine hours and twenty-five minutes on 26 September 2025. The applicant states that, despite the actions reported by the Municipality of Pococí, the Barrio El Roble community continues to suffer flooding, a situation that, according to the applicant, the municipal authorities seek to minimize. The applicant submits photographs and a video showing the impact and warns of the risk this poses to the life and physical integrity of residents in the area, including older adults and persons with disabilities.\n\n2.- By order issued at sixteen hours and fifty-five minutes on 5 August 2026, a three-day hearing was granted to YAMILETH HIDALGO ARIAS, acting Mayor, and JUAN MAURICIO MORA CRUZ, as President of the Council, both of the Municipality of Pococí, or whoever holds those positions, to respond to the alleged disobedience concerning the ruling in judgment N° 2025031199 at nine hours and twenty-five minutes on 26 September 2025. The foregoing was notified to the respondent authorities on 6 August 2026.\n\n3.- In a brief filed on 7 August 2026, by means of official letter OPM-0728-2026, OLGER GUTIÉRREZ MENDOZA, as Coordinator of the Municipal Public Works Process, reports that: “(…) The Municipal Public Works Process has carried out the technical and administrative actions within its remit to address what that Constitutional Chamber ordered (…) by official letter OPM-0298-2026, dated 13 April 2026, this Process submitted to the Constitutional Chamber the information concerning the actions taken (…) from the functional and technical perspective corresponding to the Municipal Public Works Process, it is evident that THERE HAS BEEN NO OMISSION WHATSOEVER by this municipality, nor any disobedience with respect to what the Constitutional Chamber ordered (…).”\n\n4.- In a brief filed on 10 August 2026, MANUEL HERNÁNDEZ RIVERA, as Mayor of Pococí, and JUAN MAURICIO MORA CRUZ, as President of the Municipal Council, report under oath, by means of the “Report of No Disobedience,” that: “(…) Through the road maintenance work in that community (Barrio Bethel), work was carried out to PREVENT flooding (…) The Municipality of Pococí conducted tender number 2025LE-000007-0032000702, a project described as: ‘Asphalt Treatments in Canton #2.’ Item 14 includes the Project: improvements to Dirección01 (…) As part of the works included in this process, this year a stormwater drainage system was built in areas upstream and within the area of influence of Barrio El Roble. It was designed according to technical criteria to optimize surface runoff and reduce the accumulation of water that has historically caused damage in the area (…) it is evident that THERE HAS BEEN NO OMISSION WHATSOEVER by this municipality (…).” On that basis, they requested that the Municipality of Pococí be found not to have disobeyed.\n\n5.- The legal requirements have been observed in the processing of this proceeding.\n\nDrafted by Justice Cruz Castro; and,\n\nReasons:\n\nI.- In this matter, the applicant again alleges that the respondent authorities have failed to comply with what was ordered in judgment N° 2025031199 at nine hours and twenty-five minutes on 26 September 2025, in which the Municipality of Pococí was ordered to take, within six months, the actions necessary to make appropriate improvements to the road at issue in that proceeding, in order to prevent the flooding affecting the residents of Barrio El Roble. The applicant states that, despite the works reported by the Municipality, flooding continues to affect an area of that neighborhood, and submits photographs and a video illustrating the situation.\n\nIn this regard, it should be noted that this Chamber has already heard and resolved a first motion alleging noncompliance concerning this same matter, by order N° 2026013257 at nine hours and twenty minutes on 21 April 2026. The motion was dismissed after it was deemed established that the respondent authorities had complied with what was ordered in relation to Dirección01, according to the report submitted on that occasion by the Coordinator of the Municipal Public Works Process.\n\nIn this new motion, the Coordinator of the Municipal Public Works Process reiterated, by official letter OPM-0728-2026, that the technical and administrative actions documented in official letter OPM-0298-2026 show that the Municipality addressed the requirement within the scope of its powers. For their part, the Municipal Mayor and the President of the Council, through the “Report of No Disobedience” dated 10 August 2026, established that, charged to the extraordinary budget 2-2025, tender N° 2025LE-000007-0032000702, “Asphalt Treatments in Canton #2,” was carried out. It included improvements to Dirección01, as well as a stormwater drainage system in areas upstream and within the area of influence of Barrio El Roble. Those works were carried out during the current year.\n\nIn view of the foregoing, this Court finds that the respondent authorities have established that specific works were carried out to address what was ordered in judgment N° 2025031199. Accordingly, conduct by omission or deliberate disobedience of this Chamber’s ruling cannot be found. However, the photographs and video submitted by the applicant, which the respondent authorities did not dispute, show that, despite the works carried out, flooding continues to affect an area of Barrio El Roble. This demonstrates that the interventions, although they constitute real and verifiable progress, have not been sufficient to eliminate entirely the risk that gave rise to this proceeding.\n\nAccordingly, there are no grounds to declare noncompliance with what was ordered in judgment N° 2025031199, since the record shows that the Municipality of Pococí has carried out works diligently and progressively. Nevertheless, because the applicant has established that some flooding impacts persist, the respondent authorities should be urged to continue the relevant technical work and follow-up, in order to determine the causes of the impacts that remain and carry out any necessary complementary improvements, until the flooding problem affecting the residents of Barrio El Roble has been addressed comprehensively and definitively.\n\nII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, telematic, or new-technology device, they must collect it from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all such material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session N° 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 on 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe motion filed is denied. YAMILETH HIDALGO ARIAS, as acting Mayor, and JUAN MAURICIO MORA CRUZ, as President of the Council, both of the Municipality of Pococí, or whoever holds those positions, are urged to continue the relevant technical and administrative work in order to determine and carry out any additional improvements necessary to address comprehensively the flooding impact that, according to the applicant, continues in an area of Barrio El Roble.
