San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nResultando:\n\n1.- Mediante escrito incorporado al expediente el 24 de julio de 2026, la parte recurrente aduce que “habita en la Provincia de Alajuela, Cantón de Alajuela, Distrito de La Guácima, Poblado Rincón Herrera, dirección exacta, del Super Cali 150 metros al norte y 50 metros al este, en una calle sin salida. (...) Desde hace aproximadamente dos o tres meses, la calle donde se ubica mi vivienda ha presentado un deterioro progresivo. Con el paso del tiempo, dicho deterioro llegó a afectar la tubería principal de abastecimiento de agua potable, provocando una fuga/avería visible en la vía pública. (...) Según se tiene conocimiento que uno de los vecinos que se vio especialmente afectado por dicha situación realizó un reporte ante el Instituto Costarricense de Acueductos y Alcantarillados (AyA). No obstante, pese a que se le indicó que la institución se encontraba ocupada y que procuraría atender la situación a la mayor brevedad posible, cosa que hasta la fecha el problema no ha sido solucionado. (...) Posteriormente, aproximadamente hace un mes, comenzó a deteriorarse otro sector de la misma calle, específicamente frente a mi vivienda donde se encuentra afectada la tubería principal de abastecimiento de agua potable(...) El sábado 18 de julio de 2026, aproximadamente desde las 5:00 a.m., el servicio de agua potable dejó de llegar normalmente a mi vivienda, no había agua disponible en la cocina, ni para utilizar la lavadora, ni para atender las necesidades básicas del hogar(...) Ese mismo día, sábado 18 de julio de 2026, desde aproximadamente las 8:00 a.m., realicé gestiones para reportar la situación y solicitar la reparación correspondiente. Después de varias horas de gestión, aproximadamente a las 2:40 p.m. se me proporcionó la orden número 54958798 correspondiente a una reparación de fuga. (...) El martes 21 de julio de 2026, aproximadamente a las 11:00 a.m., la suscrita se presentó personalmente ante las oficinas correspondientes del Instituto Costarricense de Acueductos y Alcantarillados (AyA), con el fin de solicitar información y gestionar directamente la atención de la avería que afectaba el suministro de agua potable en su vivienda. En dicha ocasión, se expuso nuevamente la situación y se solicitó la intervención de la institución; sin embargo, se le indicó nuevamente que intentarían enviar una cuadrilla para atender el problema a la mayor brevedad posible, sin que, a la fecha de presentación del presente recurso, se haya solucionado la avería. (...) Al momento de realizar el reporte se indicó que los funcionarios o encargados correspondientes se presentarían a la mayor brevedad posible, sin embargo, al día 24 de julio del 2026 ha transcurrido casi una semana desde la emisión de la orden de reparación y la avería continúa sin ser reparada. (...) Como consecuencia de esta falta de atención oportuna, mi familia se ha visto obligada a subsistir con aproximadamente cuatro galones de agua y un balde que se tenía disponible en la vivienda, además de tener que trasladarse diariamente hasta La Guácima centro para recoger agua en la casa de un familiar. (...) La situación descrita ha afectado de manera directa el acceso normal al agua potable necesaria para satisfacer necesidades básicas, como beber, cocinar, realizar labores de higiene y limpieza, y utilizar los servicios esenciales del hogar. (...) La afectación no se limita a una interrupción momentánea o programada del servicio, sino que se relaciona con una avería visible en la infraestructura de abastecimiento y con una orden de reparación que, a pesar de haber sido reportada, no ha sido atendida dentro de un plazo razonable”.\n\n2.-Mediante resolución de las 18:01 horas del 4 de agosto de 2026, se previno a la parte recurrente para que “comparezca la parte recurrente Nombre01 ante la Secretaría de esta Sala para firmar el escrito de interposición, por haber omitido hacerlo, o bien, aporte memorial debidamente firmado en el que ratifique el recurso en todos sus extremos”. \n\n 3.-Según acta de notificación que consta en el expediente, la resolución de prevención fue notificada a la parte recurrente el 5 de agosto de 2026.\n\n4.- Según constancia del 12 de agosto de 2026, suscrita por la secretaria de la Sala y el técnico judicial encargado de tramitar este expediente, “no aparece que del cuatro de agosto de dos mil veintiséis al once de agosto de dos mil veintiséis, la parte recurrente haya(n) presentado escrito o documento alguno, para cumplir con lo prevenido en la resolución de las dieciocho horas uno minutos del cuatro de agosto de dos mil veintiséis, dictada en RECURSO DE AMPARO que se tramita en el expediente número 26-026617-0007-CO promovido por Nombre01. Únicamente aparece la presentación del escrito y documentación mediante los que interpone(n) el RECURSO DE AMPARO”.\n\n 5.- La Ley de la Jurisdicción Constitucional, en el artículo 42, faculta a la Sala para rechazar de plano aquel amparo en el que no se corrijan los defectos u omisiones en que se hubiere incurrido al tiempo de interponerlo.\n\n \n\n Redacta el Magistrado Castillo Víquez; y, Considerando: \n\nI.- Sobre la inadmisibilidad del recurso. Previo a la resolución de este recurso, la parte promovente debía cumplir la prevención realizada por este Tribunal -bajo apercibimiento de rechazo- mediante la resolución de las 18:01 horas del 4 de agosto de 2026, notificada de acuerdo con la Ley de Notificaciones Judiciales. Sin embargo, según constancia contenida en el expediente electrónico, la prevención no fue cumplida en el plazo señalado. \n\nEn virtud de lo expuesto, lo procedente es rechazar este recurso, sin perjuicio de que, si así lo considera pertinente y necesario, podrá la parte recurrente volver a acudir a esta jurisdicción a interponer un nuevo recurso.\n\nII.- Documentación aportada al expediente. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI. \n\nPor tanto:\n\nSe rechaza de plano el recurso. \n\n \n\n \n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at nine thirty a.m. on 18 August 2026.\n\nAmparo application filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\nBackground:\n\n1.- In a filing entered in the case file on 24 July 2026, the applicant alleges that “I live in the Province of Alajuela, Canton of Alajuela, District of La Guácima, settlement of Rincón Herrera, exact address: 150 meters north and 50 meters east of Super Cali, on a dead-end street. (...) For approximately two or three months, the street where my home is located has been progressively deteriorating. Over time, this deterioration came to affect the main drinking-water supply pipe, causing a visible leak/breakdown on the public road. (...) We understand that one of the neighbors particularly affected by this situation filed a report with the Costa Rican Institute of Aqueducts and Sewers (AyA). However, although that person was told the institution was busy and would try to address the situation as soon as possible, the problem has not been resolved to date. (...) Later, approximately one month ago, another section of the same street began to deteriorate, specifically in front of my home, where the main drinking-water supply pipe is affected (...) On Saturday, 18 July 2026, at approximately 5:00 a.m., drinking-water service stopped reaching my home normally. There was no water available in the kitchen, to use the washing machine, or to meet the household’s basic needs (...) That same day, Saturday, 18 July 2026, from approximately 8:00 a.m., I took steps to report the situation and request the corresponding repair. After several hours of follow-up, at approximately 2:40 p.m. I was given order number 54958798 for a leak repair. (...) On Tuesday, 21 July 2026, at approximately 11:00 a.m., I personally went to the relevant offices of the Costa Rican Institute of Aqueducts and Sewers (AyA) to request information and directly arrange for attention to the breakdown affecting the drinking-water supply to my home. On that occasion, I again explained the situation and requested the institution’s intervention; however, I was again told that they would try to send a crew to address the problem as soon as possible, and the breakdown had still not been repaired by the date this application was filed. (...) When I made the report, I was told that the relevant officials or personnel would appear as soon as possible. However, as of 24 July 2026, almost a week has passed since the repair order was issued, and the breakdown remains unrepaired. (...) As a result of this failure to respond promptly, my family has been forced to get by with approximately four gallons of water and a bucket that was available at home, and also to travel daily to downtown La Guácima to collect water at a family member’s house. (...) The situation described has directly affected normal access to the drinking water needed to meet basic needs, such as drinking, cooking, carrying out hygiene and cleaning tasks, and using the household’s essential services. (...) The impact is not limited to a momentary or scheduled interruption of service; it relates to a visible breakdown in the supply infrastructure and to a repair order that, despite having been reported, has not been acted upon within a reasonable time.”\n\n2.- By ruling issued at 18:01 on 4 August 2026, the applicant was directed to “appear before the Secretariat of this Chamber to sign the filing initiating the proceeding, having omitted to do so, or else submit a duly signed written submission ratifying the amparo in all its aspects.”\n\n3.- According to the service record in the case file, the direction to cure was served on the applicant on 5 August 2026.\n\n4.- According to a certification dated 12 August 2026, signed by the Chamber’s secretary and the judicial technician assigned to process this case file, “there is no record that, from 4 August 2026 through 11 August 2026, the applicant(s) submitted any filing or document to comply with the direction in the ruling issued at 18:01 on 4 August 2026, in the AMPARO PROCEEDING processed under case file number 26-026617-0007-CO, filed by Nombre01. The only item on record is the filing and documentation by which the applicant(s) initiated the AMPARO PROCEEDING.”\n\n5.- Article 42 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily dismiss an amparo in which defects or omissions made when it was filed are not corrected.\n\n \n\nDrafted by Justice Castillo Víquez; and, Reasons:\n\nI.- Inadmissibility of the application. Before this application could be decided, the applicant was required to comply with the direction issued by this Court—on pain of dismissal—by ruling issued at 18:01 on 4 August 2026, served in accordance with the Judicial Notifications Act. However, according to the certification in the electronic case file, the direction was not complied with within the specified period.\n\nIn light of the foregoing, the appropriate course is to dismiss this application, without prejudice to the applicant’s ability, if considered appropriate and necessary, to return to this jurisdiction to file a new application.\n\nII.- Documentation submitted in the case file. This Chamber must advise the applicant that, if any document was submitted, whether on paper, as objects or evidence stored on any additional device, or by electronic, computing, magnetic, optical, telematic, or new-technology media, it must be collected from the court office within 30 business days after receipt of notice of this judgment. Otherwise, all such materials will be destroyed in accordance with the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is summarily dismissed.\n\n \n\nFernando Castillo V.\n\nPresident\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.
