  "body_es_text": "\n\nEXPEDIENTE: No. 26-026973-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN: No. 2026031582\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre02, cédula de identidad CED01, a favor de TEDDY THE WONDER DOG SRL, cédula jurídica 3102920548, contra el CONSEJO NACIONAL DE ÁREAS DE CONSERVACIÓN, el MINISTERIO DE AMBIENTE Y ENERGÍA y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.\n\nRESULTANDO:\n\n 1.- Por escrito agregado al Sistema de Gestión de Despachos Judiciales de esta Sala a las 15:02 horas de 27 de julio de 2026, la parte recurrente interpone recurso de amparo contra el CONSEJO NACIONAL DE ÁREAS DE CONSERVACIÓN, el MINISTERIO DE AMBIENTE Y ENERGÍA y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, a favor de TEDDY THE WONDER DOG SRL y manifiesta literalmente: \"PRIMERO: Mi representada desarrolla el proyecto \"Casa Principal\" en la finca PRN01, Bahía Ballena, Osa, amparado a la viabilidad ambiental otorgada por la Secretaría Técnica Nacional Ambiental (SETENA) mediante la Resolución N.° 2057-2025-SETENA (expediente D1-C-1031-2025), con los permisos municipales y de construcción correspondientes. SEGUNDO: Mediante la Orden Administrativa N.° SINAC-ACOSA-HNTS-006-2026, del 25 de marzo de 2026, la Dirección Regional de ACOSA ordenó la paralización de la totalidad de las obras, con motivo de la corta de tres árboles sin el permiso respectivo - daño que mi representada ha reconocido y se ha comprometido a resarcir -. La orden NO fija plazo ni término alguno de vigencia: es una paralización indefinida. TERCERO: Con posterioridad, la propia SETENA, mediante la Resolución N.° 0825-2026-SETENA, ordenó a mi representada la presentación de un estudio de estabilidad del talud (Por Tanto Segundo, cuyo plazo vence el 10 de agosto de 2026) y dispuso expresamente que ello es \"para que se efectúen las obras de contención\" (Por Tanto Segundo in fine), con aplicación inmediata (Por Tanto Tercero) y señalando en su Considerando 12° que debía actuarse \"cuanto antes\". Es decir: un órgano del Estado (SETENA) ordena ejecutar obras de estabilización con urgencia, mientras otro (SINAC-ACOSA) mantiene una paralización total e indefinida que las impide. El artículo 19 de la Ley Orgánica del Ambiente, N.° 7554, dispone que las resoluciones de la SETENA son de acatamiento obligatorio, también para los entes y organismos públicos. CUARTO: El riesgo no es hipotético: en el inmueble ya ocurrió un deslave, y tres informes técnicos coincidentes acreditan la urgencia de estabilizar el talud y canalizar las aguas pluviales: (i) informe estructural-geotécnico del Ing. Mena, del 29 de abril de 2026; (ii) informe de estabilidad de talud Navarro-Fallas, del 19 de mayo de 2026; y (iii) informe técnico forestal del Ing. Jeffry Alfaro Carvajal, del 6 de julio de 2026, que documenta el deslave y recomienda intervención inmediata. Nos encontramos en plena estación lluviosa en el Pacífico Sur. QUINTO: El 23 de junio de 2026 mi representada presentó ante la Dirección Regional de ACOSA, por escrito y con recibido de esa oficina (sello de las 13:28 horas, diez folios), gestión de levantamiento, modificación o aclaración de la Orden N.° 006-2026, a fin de que, al menos, se autorizaran las obras de estabilización. El plazo de ocho días del artículo 352 de la Ley General de la Administración Pública, N.° 6227, para resolver venció el 1° de julio de 2026, sin respuesta alguna. SEXTO: El 10 de julio de 2026, a las 14:43 horas, se reiteró la gestión por correo electrónico dirigido a ...01, con doce anexos, señalando expresamente medios para notificaciones. La funcionaria Karol Fonseca Carrillo acusó recibo el 13 de julio de 2026, a las 8:52 horas, con copia a las jefaturas Olger Méndez y Wendy Barrantes. El plazo de diez días hábiles del artículo 32 de la Ley de la Jurisdicción Constitucional venció el 24 de julio de 2026, sin que exista, a la fecha, respuesta de fondo alguna. SÉTIMO: El 13 de julio de 2026 se puso el asunto en conocimiento del Consejo Nacional de Áreas de Conservación (CONAC), jerarca del Sistema (artículos 22 y siguientes de la Ley de Biodiversidad, N.° 7788), mediante escrito firmado digitalmente y remitido por la vía electrónica. El 24 de julio de 2026 se presentó ante el propio CONAC escrito formal de reiteración y solicitud de resolución inmediata, con doce anexos. Ante el CONAC procede la apelación que agota la vía administrativa (artículo 13 del Decreto Ejecutivo N.° 34433-MINAE). OCTAVO: El 27 de julio de 2026, a las 7:32 horas, la Secretaría de Correspondencia del CONAC respondió por escrito ADMITIENDO que el expediente de la Orden N.° 006-2026 \"no ha sido elevado por la Dirección Regional del Área de Conservación Osa (ACOSA) al Consejo Nacional de Áreas de Conservación (CONAC), para la atención respectiva\"; describió un procedimiento interno de nueve pasos y señaló que la Subcomisión de Agotamiento de Vía Administrativa y el propio CONAC sesionan UNA VEZ AL MES. Esa misma mañana, a las 8:21 horas, esta representación remitió el correo a ACOSA requiriéndole la remisión inmediata del expediente. La Administración confiesa así, por escrito, la omisión: a más de cuatro meses de dictada la orden y a más de un mes de la primera gestión, el órgano de origen no ha resuelto ni ha trasladado el expediente al jerarca, y el trámite interno anunciado - sesiones mensuales y nueve etapas - prolongará el silencio por meses adicionales. NOVENO: La vía administrativa es, además, la única disponible: en la causa penal N.° 26-000014-1111-PE, la Fiscalía indicó por escrito, el 9 de julio de 2026, que la Orden N.° 006-2026 es un acto autónomo del SINAC cuya modificación o levantamiento compete a la propia vía administrativa. Esa vía es precisamente la que los recurridos mantienen bloqueada con su silencio y su inercia. DÉCIMO: En síntesis, la problemática es la siguiente: (a) una orden de paralización total SIN PLAZO, dictada hace más de cuatro meses; (b) una orden de la SETENA que exige obras de contención urgentes, de acatamiento obligatorio para los entes públicos, cuyo plazo vence el 10 de agosto de 2026; (c) un deslave ya ocurrido y un riesgo cierto e inminente de nuevos derrumbes en estación lluviosa (daño ambiental efectivo y potencial, también para terceros y para el corredor biológico de la zona); (d) tres gestiones formales de la administrada (23 de junio, 10 de julio y 24 de julio de 2026) sin respuesta de fondo; y (e) la admisión escrita del propio jerarca de que el expediente ni siquiera le ha sido elevado. El administrado ha hecho todo lo que el ordenamiento le permite; la Administración, nada\".\n\n 2.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nCONSIDERANDO:\n\n I.- CASO CONCRETO. La parte recurrente alega que la amparada desarrolla un proyecto constructivo en Bahía Ballena de Osa, al amparo de la resolución No. 2057-2025-SETENA y con los permisos correspondientes, pero, la Dirección Regional del Área de Conservación Osa (ACOSA) mantiene vigente la Orden Administrativa No. SINAC-ACOSA-HNTS-006-2026, que dispuso la paralización total e indefinida de las obras, pese a que la resolución No. 0825-2026-SETENA ordenó la ejecución urgente de obras de estabilización del talud y, además, no ha resuelto las gestiones presentadas el 23 de junio y 10 de julio de 2026 para levantar, modificar o aclarar dicha orden ni ha remitido el expediente administrativo al Consejo Nacional de Áreas de Conservación (CONAC), el cual, tampoco ha podido conocer el asunto. Sin embargo, los agravios que plantea el actor fueron analizados recientemente por esta Sala en la sentencia No. 2026-030667 de las 09:25 horas de 11 de agosto de 2026, donde, en lo que interesa, se dispuso:\n\n\"II.- SOBRE LA REACTIVACIÓN DE LAS OBRAS. En el presente asunto, la parte recurrente pretende que esta Sala intervenga para dejar sin efecto, levantar o modificar los efectos de la Orden Administrativa N.° SINAC-ACOSA-HNTS-006-2026, disponga la remisión del expediente administrativo al Consejo Nacional de Áreas de Conservación (CONAC) y, además, como medida cautelar, autorice la ejecución inmediata de las obras de estabilización del talud previstas en la Resolución N.° 0825-2026-SETENA. Lo anterior no se encuentra dentro del ámbito de competencia de esta Jurisdicción, porque no le corresponde a la Sala interceder o mediar ante las autoridades administrativas para que se conceda lo pretendido. Además, este Tribunal no puede reemplazar a la Administración en el ejercicio de sus competencias para determinar, conforme a los hechos, los estudios técnicos y la normativa aplicable, si procede levantar, modificar o mantener la orden de paralización, autorizar la ejecución de las obras de estabilización o resolver las gestiones administrativas formuladas, por cuanto se trata de extremos de legalidad ordinaria y no de constitucionalidad, que deben ser dirimidos en la vía administrativa o jurisdiccional correspondiente. En consecuencia, deberá la parte recurrente gestionar lo correspondiente ante las autoridades recurridas o en la sede jurisdiccional ordinaria competente. Así las cosas, se declara inadmisible el recurso en cuanto a estos extremos. \n\nIII.- SOBRE LA ALEGADA MORA ADMINISTRATIVA. Por otra parte, la parte recurrente acusa el retardo de la Dirección Regional del Área de Conservación Osa (ACOSA) en resolver las gestiones presentadas los días 23 de junio y 10 de julio de 2026, así como la falta de remisión del expediente administrativo al Consejo Nacional de Áreas de Conservación (CONAC), lo cual le es aplicable lo dispuesto en el artículo 41 de la Constitución Política. Sin embargo, a partir del voto número 2008-02545 de las 8:55 horas del 22 de febrero de 2008 y salvo algunas excepciones, esta Sala ha remitido este tipo de reclamos a la jurisdicción contencioso administrativa y, precisamente, el tema planteado por la parte recurrente no es una de las excepciones que esta Sala ha admitido para conocer la alegada violación al derecho a obtener justicia administrativa pronta y cumplida. En consecuencia, lo procedente es remitirla a la vía contencioso administrativa a acusar el retardo en cuestión, con fundamento en los siguientes considerandos. \n\nIV.- NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad -y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o \"amparo de legalidad\", los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación. Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria. \n\nV.- VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS: CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material -esto es de comparecer sin patrocinio letrado- y de gratuidad para la parte recurrente. Consecuentemente, se impone el rechazo de plano e indicarle a la persona gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa. \n\nVI.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico. \n\nVII.- RAZONES DIFERENTES DEL MAGISTRADO RUEDA LEAL. Sostengo que este asunto se debe rechazar de plano, por cuanto la parte accionante plantea el recurso de amparo a favor de una persona jurídica. De importancia para el sub examine, en el voto salvado que consigné en la sentencia nro. 2019-2355 de las 9:30 horas de 12 de febrero de 2019 sostuve: \"en la Opinión Consultiva 22-16 del 26 de febrero de 2016, la Corte Interamericana de Derechos Humanos indicó que si bien algunos Estados reconocen el derecho de petición a personas jurídicas con condiciones especiales, como lo son los sindicatos, partidos políticos o representantes de pueblos indígenas, comunidades afrodescendientes o grupos específicos, lo cierto es que \"El artículo 1.2 de la Convención Americana sólo consagra derechos a favor de personas físicas, por lo que las personas jurídicas no son titulares de los derechos consagrados en dicho tratado\". Por otro lado, en la misma opinión consultiva, la Corte Interamericana dispuso que, en ciertos contextos particulares, las personas físicas pueden llegar a ejercer sus derechos a través de personas jurídicas (verbigracia, a través de un medio de comunicación, como acaeció en el caso Nombre01 y otros contra Venezuela); empero, a efectos de que ello sea tutelable ante el sistema interamericano, \"el ejercicio del derecho a través de una persona jurídica debe involucrar una relación esencial y directa entre la persona natural que requiere protección por parte del sistema interamericano y la persona jurídica a través de la cual se produjo la violación, por cuanto no es suficiente con un simple vínculo entre ambas personas para concluir que efectivamente se están protegiendo los derechos de personas físicas y no de las personas jurídicas. En efecto, se debe probar más allá de la simple participación de la persona natural en las actividades propias de la persona jurídica, de forma que dicha participación se relacione de manera sustancial con los derechos alegados como vulnerados.\" (énfasis agregado) (OC. 22/16)\". En mi criterio, la lectura de la Ley de la Jurisdicción Constitucional obliga a la misma ratio de la hermenéutica convencional supracitada respecto a todo derecho fundamental. Así, en un proceso de constitucionalidad formulado a favor de una persona jurídica, su admisión para estudio exige una relación esencial y directa entre la persona jurídica que aduce verse afectada por alguna vulneración al orden constitucional y la persona natural que por tal lesión viene a ver menoscabado, de forma refleja pero directa, algún derecho fundamental. Ahora, para tales efectos es insuficiente la mera referencia a una conexión o vínculo entre la persona jurídica y la natural para poder colegir que, precisamente, por medio del proceso de constitucionalidad se esté procurando el resguardo de los derechos fundamentales de la última, no meramente los de la primera. El requerimiento antedicho deviene entonces un presupuesto sine qua non para la procedencia del control de constitucionalidad por parte de esta jurisdicción. A partir de lo expuesto, colijo que esta debe ser la pauta con que se debe interpretar la Ley de la Jurisdicción Constitucional, de manera que en el sub iudice deviene improcedente la aplicación del control jurisdiccional de constitucionalidad, puesto que, con base en la prueba que consta en autos, no se ha demostrado el vínculo esencial entre la persona jurídica amparada y alguna natural, de modo específico, en relación con el presunto derecho agraviado. \n\nVIII.- VOTO SALVADO DEL MAGISTRADO CRUZ CASTRO. Si bien en el pasado he sostenido el criterio de mayoría del Tribunal, bajo una mejor ponderación de los derechos fundamentales que se reclaman, estimo que la mora administrativa constituye una lesión a una garantía procesal fundamental, razón por la que cambio el criterio que había expuesto, admitiendo la posible infracción al derecho a una justicia administrativa pronta y cumplida, separándome de la visión de la mayoría del Tribunal, en el sentido que -salvo contadas excepciones- este tipo de reproches deben resolverse en la jurisdicción contenciosa administrativa. Por el contrario, estimo que uno de los derechos que esta jurisdicción se encuentra llamada a tutelar es el de la justicia pronta y cumplida, expresamente consagrado en el artículo 41 constitucional. Ello conforme al ámbito de competencia asignado a este Tribunal en materia de protección a derechos fundamentales, en atención a lo dispuesto en los artículos 10 y 48 de la Constitución Política. Si bien, entiendo la importancia de las reformas de la jurisdicción contencioso administrativa a partir de la vigencia de la Ley 8508 del veinticuatro de abril de dos mil seis, lo cierto es que dicha situación no justifica la remisión a dicha instancia de los asuntos que versan sobre materia que es competencia de esta Sala, la cual ha demostrado a lo largo de los años que es un medio célere y efectivo para la tutela de los derechos fundamentales de los habitantes del país.\"\n\n A partir de lo anterior, se observa que la pretensión de la parte recurrente en este nuevo proceso está referida a los mismos hechos que ya fueron analizados y decididos por este Tribunal. En consecuencia, lo procedente es que el actor se esté a lo resuelto en ese pronunciamiento. \n\n II.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "\n\nCASE FILE: No. 26-026973-0007-CO\n\nPROCEEDING: AMPARO PROCEEDING\n\nRULING: No. 2026031582\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 18 August 2026.\n\nAmparo application filed by Nombre02, identity card CED01, on behalf of TEDDY THE WONDER DOG SRL, corporate identification number 3102920548, against the NATIONAL COUNCIL OF CONSERVATION AREAS, the MINISTRY OF ENVIRONMENT AND ENERGY, and the NATIONAL SYSTEM OF CONSERVATION AREAS.\n\nBACKGROUND:\n\n1.- By a brief entered into this Chamber’s Judicial Office Management System at 15:02 on 27 July 2026, the appellant files an amparo application against the NATIONAL COUNCIL OF CONSERVATION AREAS, the MINISTRY OF ENVIRONMENT AND ENERGY, and the NATIONAL SYSTEM OF CONSERVATION AREAS, on behalf of TEDDY THE WONDER DOG SRL, and states verbatim: “FIRST: My client is developing the ‘Casa Principal’ project on property PRN01, Bahía Ballena, Osa, under the environmental viability granted by the National Environmental Technical Secretariat (SETENA) through Resolution No. 2057-2025-SETENA (case file D1-C-1031-2025), with the corresponding municipal and construction permits. SECOND: By Administrative Order No. SINAC-ACOSA-HNTS-006-2026, dated 25 March 2026, the ACOSA Regional Directorate ordered all works halted on the grounds that three trees had been felled without the required permit—a harm my client has acknowledged and undertaken to remedy. The order sets NO period or term of validity: the halt is indefinite. THIRD: Subsequently, SETENA itself, by Resolution No. 0825-2026-SETENA, ordered my client to submit a slope-stability study (Ruling Second, whose deadline expires on 10 August 2026) and expressly provided that this was ‘so that containment works may be carried out’ (Ruling Second, in fine), with immediate effect (Ruling Third), and stated in Reasoning 12 that action was required ‘as soon as possible.’ In other words, one State body (SETENA) orders urgent stabilization works, while another (SINAC-ACOSA) maintains a total and indefinite halt that prevents them. Article 19 of the Organic Law of the Environment, No. 7554, provides that SETENA resolutions are binding, including on public entities and bodies. FOURTH: The risk is not hypothetical: a landslide has already occurred on the property, and three consistent technical reports establish the urgency of stabilizing the slope and channeling rainwater: (i) the structural-geotechnical report by Engineer Mena, dated 29 April 2026; (ii) the Navarro-Fallas slope-stability report, dated 19 May 2026; and (iii) the forestry technical report by Engineer Jeffry Alfaro Carvajal, dated 6 July 2026, which documents the landslide and recommends immediate intervention. We are in the middle of the rainy season in the South Pacific. FIFTH: On 23 June 2026, my client submitted a request in writing to the ACOSA Regional Directorate, which that office acknowledged as received (stamp at 13:28, ten pages), seeking the lifting, modification, or clarification of Order No. 006-2026, so that at least the stabilization works would be authorized. The eight-day period under Article 352 of the General Law of Public Administration, No. 6227, for issuing a decision expired on 1 July 2026, without any response. SIXTH: On 10 July 2026, at 14:43, the request was reiterated by email addressed to ...01, with twelve attachments, expressly identifying means for service of notices. Employee Karol Fonseca Carrillo acknowledged receipt on 13 July 2026, at 8:52, copying supervisors Olger Méndez and Wendy Barrantes. The ten-business-day period under Article 32 of the Law on Constitutional Jurisdiction expired on 24 July 2026, and, as of this date, there has been no response on the merits. SEVENTH: On 13 July 2026, the matter was brought to the attention of the National Council of Conservation Areas (CONAC), the superior body of the System (Articles 22 et seq. of the Biodiversity Law, No. 7788), by a digitally signed brief sent electronically. On 24 July 2026, a formal brief reiterating the request and seeking an immediate decision, with twelve attachments, was submitted to CONAC itself. An appeal that exhausts the administrative remedies lies before CONAC (Article 13 of Executive Decree No. 34433-MINAE). EIGHTH: On 27 July 2026, at 7:32, CONAC’s Correspondence Office replied in writing, ADMITTING that the file for Order No. 006-2026 ‘has not been forwarded by the Regional Directorate of the Osa Conservation Area (ACOSA) to the National Council of Conservation Areas (CONAC) for the corresponding action’; it described an internal nine-step procedure and stated that the Subcommission on Exhaustion of Administrative Remedies and CONAC itself meet ONCE A MONTH. That same morning, at 8:21, counsel for the applicant forwarded the email to ACOSA, requesting immediate transmittal of the file. The Administration thus admits in writing to the omission: more than four months after the order was issued and more than one month after the first request, the originating body has neither issued a decision nor transferred the file to the superior body, and the announced internal process—monthly meetings and nine stages—will prolong the silence for additional months. NINTH: The administrative route is also the only one available: in criminal case No. 26-000014-1111-PE, the Public Prosecutor’s Office stated in writing on 9 July 2026 that Order No. 006-2026 is an autonomous act of SINAC whose modification or lifting falls within the administrative route itself. That is precisely the route the respondents are keeping blocked through their silence and inaction. TENTH: In summary, the situation is as follows: (a) a total HALT ORDER WITH NO DEADLINE, issued more than four months ago; (b) an order by SETENA requiring urgent containment works, binding on public entities, with a deadline of 10 August 2026; (c) a landslide that has already occurred and a real and imminent risk of further landslides during the rainy season (actual and potential environmental harm, also affecting third parties and the area’s biological corridor); (d) three formal requests by the party concerned (23 June, 10 July, and 24 July 2026) without a response on the merits; and (e) the written admission by the superior body itself that the file has not even been forwarded to it. The party concerned has done everything the legal system permits; the Administration has done nothing.”\n\n2.- The legal requirements have been observed in the proceedings.\n\nJustice Castillo Víquez writes; and,\n\nREASONS:\n\nI.- SPECIFIC CASE. The appellant alleges that the party represented is developing a construction project in Bahía Ballena, Osa, pursuant to Resolution No. 2057-2025-SETENA and with the corresponding permits, but that the Regional Directorate of the Osa Conservation Area (ACOSA) continues to maintain in force Administrative Order No. SINAC-ACOSA-HNTS-006-2026, which ordered a total and indefinite halt to the works, even though Resolution No. 0825-2026-SETENA ordered urgent slope-stabilization works and the Directorate has also failed to decide the requests submitted on 23 June and 10 July 2026 to lift, modify, or clarify that order, or to forward the administrative file to the National Council of Conservation Areas (CONAC), which has likewise been unable to consider the matter. However, the grievances raised by the applicant were recently analyzed by this Chamber in Judgment No. 2026-030667, issued at 09:25 on 11 August 2026, which provided, insofar as relevant:\n\n“II.- ON THE RESUMPTION OF WORKS. In this matter, the appellant seeks this Chamber’s intervention to set aside, lift, or modify the effects of Administrative Order No. SINAC-ACOSA-HNTS-006-2026, order the administrative file to be forwarded to the National Council of Conservation Areas (CONAC), and also, as an interim measure, authorize the immediate execution of the slope-stabilization works provided for in Resolution No. 0825-2026-SETENA. This does not fall within the jurisdiction of this Court, because it is not for the Chamber to intervene or mediate with the administrative authorities so that the relief sought may be granted. Furthermore, this Court cannot replace the Administration in exercising its powers to determine, in light of the facts, the technical studies, and the applicable law, whether the halt order should be lifted, modified, or maintained, whether the stabilization works should be authorized, or whether the administrative requests should be decided, since these are matters of ordinary legality, not constitutional matters, and must be resolved through the corresponding administrative or judicial avenue. Accordingly, the appellant must pursue the appropriate steps before the respondent authorities or in the competent ordinary court. Therefore, the amparo application is declared inadmissible as to these issues.\n\nIII.- ON THE ALLEGED ADMINISTRATIVE DELAY. The appellant also alleges delay by the Regional Directorate of the Osa Conservation Area (ACOSA) in deciding the requests submitted on 23 June and 10 July 2026, as well as failure to forward the administrative file to the National Council of Conservation Areas (CONAC), to which Article 41 of the Political Constitution applies. However, beginning with Judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008, and subject to certain exceptions, this Chamber has referred this type of claim to the administrative-litigation jurisdiction. The issue raised by the appellant is not one of the exceptions this Chamber has accepted for review of an alleged violation of the right to prompt and complete administrative justice. Accordingly, the proper course is to refer the appellant to the administrative-litigation jurisdiction to complain of the delay in question, based on the following considerations.\n\nIV.- THE NEW ADMINISTRATIVE JUSTICE: AN EXPEDITIOUS AND EFFECTIVE MECHANISM FOR PROTECTING THE SUBSTANTIVE LEGAL POSITIONS OF THE PARTIES CONCERNED. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in view of the absence of expeditious and swift procedural avenues for protecting substantive legal positions grounded in the legal system below the constitutional level, or in the standard of legality, which are indirectly connected to fundamental rights and Constitutional Law. In this regard, it must be kept in mind that the Constitution, by virtue of its supremacy, superlegality, and direct and immediate effect, provides indirect grounds for any conceivable substantive legal position of individuals. Nevertheless, upon better consideration, and following the enactment of the Administrative Litigation Procedural Code (Law No. 8508 of 24 April 2006) and its entry into force as of 1 January 2008, it has become clear that litigants now have access to a plenary and universal administrative-litigation jurisdiction, which is highly expeditious and swift by virtue of the various procedural mechanisms that legislation incorporates into the legal system, such as shortening time limits for the various procedural acts, broad standing, interim measures, an open-ended range of claims that may be brought, oral proceedings—and their subsidiary principles of concentration, immediacy, and speed—single-instance proceedings with a right of appeal in expressly specified situations, in-proceeding conciliation, a unified proceeding, a preferential-track proceeding or ‘amparo of legality,’ proceedings on the merits, new enforcement measures (coercive fines, substitute or commissarial enforcement, attachment of fiscal-domain assets and certain public-domain assets), the broad powers of the enforcement judiciary, the extension and adaptation of case-law effects to third parties, and the flexibility of the cassation appeal. All these novel procedural institutions are manifestly intended to achieve procedural economy, speed, promptness, and effective or complete protection of the substantive legal positions of the parties concerned, all with safeguards for basic fundamental rights such as due process, the right of defense, and the right to a hearing. In sum, the new administrative-litigation jurisdiction is a suitable avenue, given its new features of simplicity, speed, and promptness, for amparo and effective protection of the substantive legal positions of parties concerned where evidence must be gathered or certain issues of ordinary legality determined.\n\nV.- VERIFICATION OF STATUTORY DEADLINES FOR DECIDING ADMINISTRATIVE PROCEEDINGS: AN EVIDENT MATTER OF ORDINARY LEGALITY. It is evident that determining whether the public administration complies with the deadlines established by the General Law of Public Administration (Articles 261 and 325) or by sectoral laws governing special administrative proceedings, in order to issue a final decision in an administrative proceeding—initiated on its own motion or at a party’s request—or to consider the available administrative appeals, is plainly a matter of ordinary legality. Going forward, it may be disputed and resolved before the administrative-litigation jurisdiction, applying the principles that inform constitutional jurisdiction, such as derivative standing, the possibility of self-representation—that is, appearing without counsel—and the appellant’s exemption from costs. Consequently, summary dismissal is required, and the person making the request must be informed that, if they so wish, they may resort to the administrative-litigation jurisdiction.\n\nVI.- NOTE BY JUSTICE CASTILLO VÍQUEZ ON PROMPT AND COMPLETE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and complete justice in the administrative forum, the legal dispute must be heard by the Administrative Litigation Courts and not by this Chamber. However, with the recent enactment of Law No. 9097, the Law Regulating the Right of Petition, it has been established that this right may be judicially protected through the amparo application established by Article 32 of the Law on Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, its administrative acts, or its response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of precedent; under Article 7 of its Law, this Chamber has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo proceeding, the competent courts in all other cases, for the reasons this Court has given (Judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008), are the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, Constitutional Law (its values, principles, and rules), and the applicable statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.\n\nVII.- DIFFERING REASONS OF JUSTICE RUEDA LEAL. I maintain that this matter must be summarily dismissed because the applicant filed the amparo application on behalf of a legal entity. Relevant to the matter under review, in the dissenting opinion I set out in Judgment No. 2019-2355, issued at 9:30 a.m. on 12 February 2019, I maintained: ‘In Advisory Opinion 22-16 of 26 February 2016, the Inter-American Court of Human Rights indicated that although some States recognize the right of petition for legal entities subject to special conditions, such as trade unions, political parties, or representatives of Indigenous peoples, Afro-descendant communities, or specific groups, the fact remains that “Article 1.2 of the American Convention only establishes rights in favor of natural persons, so legal entities are not holders of the rights enshrined in that treaty.” On the other hand, in the same advisory opinion, the Inter-American Court held that, in certain particular contexts, natural persons may exercise their rights through legal entities (for example, through a communications medium, as occurred in the case of Nombre01 et al. v. Venezuela). However, for this to be subject to protection under the inter-American system, “the exercise of the right through a legal entity must involve an essential and direct relationship between the natural person requiring protection from the inter-American system and the legal entity through which the violation occurred, since a simple connection between the two persons is not enough to conclude that the rights of natural persons, rather than those of legal entities, are in fact being protected. Indeed, it must be proven beyond the natural person’s mere participation in the legal entity’s activities that such participation is substantially related to the rights alleged to have been violated.” (emphasis added) (Advisory Opinion 22/16).’ In my view, reading the Law on Constitutional Jurisdiction requires applying the same ratio of the aforementioned conventional interpretation to all fundamental rights. Thus, in a constitutional proceeding brought on behalf of a legal entity, admission for review requires an essential and direct relationship between the legal entity alleging that it has been affected by a violation of the constitutional order and the natural person who, because of that injury, comes to suffer a direct, albeit indirect, impairment of a fundamental right. For these purposes, a mere reference to a connection or relationship between the legal entity and the natural person is insufficient to conclude that the constitutional proceeding is in fact seeking to safeguard the latter’s fundamental rights, rather than merely those of the former. This requirement is therefore a sine qua non condition for constitutional review by this jurisdiction. Based on the foregoing, I conclude that this must be the standard for interpreting the Law on Constitutional Jurisdiction, such that in the case under review constitutional judicial review is improper because, based on the evidence in the record, the essential link between the legal entity protected by the amparo and any natural person has not been demonstrated, specifically in relation to the right allegedly infringed.\n\nVIII.- DISSENTING VOTE OF JUSTICE CRUZ CASTRO. Although I previously supported the Court’s majority position, upon better consideration of the fundamental rights being claimed, I find that administrative delay constitutes an infringement of a fundamental procedural guarantee. For that reason, I change the position I previously expressed and accept the possible violation of the right to prompt and complete administrative justice, departing from the majority’s view that—except in a few cases—this type of complaint must be resolved in the administrative-litigation jurisdiction. On the contrary, I consider that one of the rights this jurisdiction is called upon to protect is the right to prompt and complete justice, expressly enshrined in Article 41 of the Constitution. This follows from the jurisdiction assigned to this Court in the protection of fundamental rights, in accordance with Articles 10 and 48 of the Political Constitution. Although I understand the importance of the reforms to the administrative-litigation jurisdiction following the entry into force of Law 8508 of 24 April 2006, that circumstance does not justify referring to that forum matters concerning a subject within this Chamber’s jurisdiction, which has shown over the years that it is an expeditious and effective means of protecting the country’s inhabitants’ fundamental rights.”\n\nIn light of the foregoing, the claim in this new proceeding concerns the same facts already analyzed and decided by this Court. Accordingly, the applicant must abide by what was decided in that ruling.\n\nII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the Court within a maximum period of 30 business days counted from service of this judgment. Otherwise, all such material not retrieved within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court in session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe appellant shall abide by what this Chamber decided in Judgment No. 2026-030667, issued at 09:25 on 11 August 2026.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
