  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-028642-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026031766\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, cédula de identidad CED04, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS DE QUEPOS.\n\nResultando:\n\n 1.- Por escrito agregado al Sistema de Gestión de Despachos Judiciales de esta Sala a las 13:20 horas del 07 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS DE QUEPOS, y manifiesta que: “Hechos: En enero del 2025, ante la Oficina Cantonal del Instituto Costarricense de Acueductos y Alcantarillados en Puerto Quepos, Puntarenas, reclame (sic) con respecto a un cobro de agua de Diciembre del 2024, por un supuesto alto consumo de agua en el medidor con el NIS # PLA01, ubicado en Boca Vieja, Quepos, donde me indicaron que debía pagar 251.638, de un local vacío por bastante tiempo más de 8 meses, donde históricamente he pagado una tarifa básica de 2.260, según el registro en el AyA. Aducen en el AyA de Quepos que, al mandar al inspector, efectivamente no se reportan fugas. Solicité entonces un cambio de medidor, pero me han dicho que el medidor es verás y lo que marca es consumo y punto, que todavía no es tiempo de cambiarlo. Sin embargo, hablando con el inspector de esa Oficina de Quepos, me indicó que han estado cambiando los medidores de ese sector en razón de los reclamos de los usuarios. Posteriormente, en mayo del 2026, 2 años después, la situación vuelve a repetirse, con ese mismo servicio NIS # CED01 esta vez, el medidor registra otro consumo ficticio, exagerado de CED02 lo que me ofrecen del AyA de Quepos es un \"arreglo de pago\" y me obligan a pagar 16.783 mensual por 7 meses. Reclamé de nuevo y el 13 de mayo 2026 y lo hice por escrito, la inquietud ante la jefe Cantonal, Jaqueline Loria otra vez (ver documento adjunto) para que me cambiara el medidor que está dando dato incorrecto, pero de nuevo recibí otra negativa, aduciendo en esa oficina, que el medidor marca consumo y punto, porque no hay fugas. Debo aclarar que el local sigue vacío. El 26 de junio del 2026, trasladé la inquietud ante la Contraloría de Servicios del AyA (ver documento adjunto) y no he recibido respuesta. El asunto se está repitiendo con otro medidor con el # de NIS 5170902, el cual me está marcando una lectura o consumo erróneo, pero esta vez por más de CED03 están \"revisando\" para hacerme otro \"arreglo de pago\" de más de 30.000 aproximadamente por mes, por 7 u 8 meses, hasta completar el monto de 200 mil. Aduciendo que el medidor no falla, lo cual es muy subjetivo, pues de un momento otro, cualquier dispositivo puede fallar y es otro local desocupado. Por ese motivo presento este Recurso de Amparo y solicito a esta Noble Sala, se le indique a la jefe de la Cantonal del AyA en Quepos, señora Jacqueline Loría, para que se efectúe el cambio de esos dos medidores, con los # de NIS CED01 5170902. Y arreglar los ilegales cobros a que estoy siendo objeto. De lo contrario, en un cierto tiempo se volverá a repetir este error y con esos medidores de agua, en detrimento mío”. Solicita que se declare con lugar el recurso con las consecuencias de ley, que se suspenda el cobro arbitrario y que se le cobre lo justo.\n\n 2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n \n\n I.- OBJETO DEL RECURSO. El recurrente solicita la intervención de esta sede constitucional, para que se le ordene a la autoridad recurrida efectuar el cambio de los medidores señalados y brindar solución a los cobros realizados por el servicio de agua potable, los cuales estima desproporcionados.\n\nII.- CASO CONCRETO. Sobre la disconformidad con los cobros realizados, cabe indicar que, este Tribunal ha establecido que no es en esta sede donde se discute el monto de un recibo por la prestación del servicio de agua potable. Se trata de una cuestión de legalidad que debe plantearse en la misma sede administrativa y, eventualmente, jurisdiccional ordinaria. Entre otras, en la Sentencia N° 2018-017559 de las 10:10 horas del 23 de octubre de 2018, indicó lo siguiente:\n\n“…La recurrente reclama por lo elevados cobros que ha recibido en la factura del servicio de agua. Expresa que es mujer sola y de escasos recursos y ha observado que el monto a pagar expresado en el recibo del agua varía de forma exagerada, ya que el suministro sirve a pocas personas y no se justifica lo cobrado. Explica que el personal de la administración recurrida ya ha acudido a revisar, pero no le dan soluciones. Sin embargo, esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto a pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, este recurso es inadmisible y así se declara…”.\n\nConsideraciones que son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dichas sentencias, ni motivos que lo hagan valorar de manera distinta en la situación planteada. Del escrito de interposición del recurso, no se desprende una lesión al acceso a un servicio público, pues lo que se acusa es la discrepancia con el monto facturado por el servicio de agua potable, pero lo cierto es que los petentes mantienen el suministro de ese servicio en el inmueble a que hacen referencia. A partir de lo anterior, la disconformidad de los tutelados con los hechos que sustenta este asunto, es un aspecto que, como se indicó, es propio de alegarse en la vía común -administrativa o jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su disconformidad o reclamo ante la misma institución recurrida o en la jurisdicción ordinaria competente, vías en las que podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.\n\nIII.- En cuanto al disconformidad con el rechazo al cambio de los medidores solicitado, resulta importante indicar que este Tribunal no debe fungir como mediador ante una determinada persona física o jurídica -ya sea de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que ella pretende. De manera, no le corresponde valorar ni ordenar al instituto recurrido el cambio de los medidores requerido, ante la autoridad recurrida tal y como así lo solicita la parte amparada en este caso. Por ello, deberá el petente -si a bien lo tiene- plantear sus inconformidades o reclamos ante la autoridad recurrida, como indica haberlo realizado, o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En mérito de lo expuesto, el recurso es inadmisible.\n\n IV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\n \n\nPor tanto:\n\n Se rechaza de plano el recurso. \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.   "body_en_text": "Document Review\n\n\n\nCASE FILE No. 26-028642-0007-CO\n\nPROCEEDING: AMPARO APPLICATION\n\nRULING No. 2026031766\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 18 August 2026.\n\nAmparo application filed by Nombre01, identity card CED04, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS DE QUEPOS.\n\nBackground:\n\n1.- By a written submission added to this Chamber’s Judicial Offices Management System at 13:20 on 07 August 2026, the applicant files an amparo application against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS DE QUEPOS and states: “Facts: In January 2025, before the cantonal office of the Instituto Costarricense de Acueductos y Alcantarillados in Puerto Quepos, Puntarenas, I complained (sic) about a water charge for December 2024, for supposedly high water consumption on meter with NIS # PLA01, located in Boca Vieja, Quepos, where I was told I had to pay 251.638 for a premises that had been vacant for quite some time, more than 8 months, where historically I have paid a basic rate of 2.260, according to the AyA records. AyA in Quepos claims that, when they sent the inspector, no leaks were in fact reported. I then requested a meter change, but they have told me that the meter is accurate and what it registers is consumption, period, and that it is not yet time to change it. However, speaking with the inspector from that Quepos office, he told me they have been changing meters in that area because of user complaints. Later, in May 2026, 2 years later, the situation happens again, this time with that same service, NIS # CED01; the meter registers another fictitious, exaggerated consumption of CED02. What AyA in Quepos offers me is a ‘payment arrangement,’ and they force me to pay 16.783 per month for 7 months. I complained again, and on 13 May 2026 I did so in writing, raising the concern with the cantonal head, Jaqueline Loria, again (see attached document), asking her to change the meter that is giving an incorrect reading, but again I received another refusal, with that office claiming that the meter registers consumption, period, because there are no leaks. I must clarify that the premises remains vacant. On 26 June 2026, I brought the concern to AyA’s Service Inspectorate (see attached document) and have received no response. The issue is happening again with another meter, NIS # 5170902, which is showing an erroneous reading or consumption, but this time for more than CED03. They are ‘reviewing’ it to make me another ‘payment arrangement’ for approximately more than 30.000 per month, for 7 or 8 months, until the amount of 200 thousand is reached. They claim the meter does not fail, which is very subjective, since any device can fail from one moment to the next, and this is another unoccupied premises. For that reason I file this Amparo proceeding and ask this Honorable Chamber to instruct the head of AyA’s cantonal office in Quepos, Ms. Jacqueline Loría, to replace those two meters, with NIS numbers CED01 5170902, and to remedy the illegal charges to which I am being subjected. Otherwise, after some time this error will happen again with those water meters, to my detriment.” The applicant requests that the application be granted with the legal consequences thereof, that the arbitrary charge be suspended, and that a fair amount be charged.\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily reject, or reject on the merits, at any time, including upon filing, any application submitted for its consideration that proves manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is merely a reiteration or reproduction of an identical or similar prior application that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION. The applicant seeks the intervention of this constitutional forum so that the challenged authority may be ordered to replace the meters identified and provide a solution regarding the charges for potable water service, which the applicant considers disproportionate.\n\nII.- THE CASE. Regarding the disagreement with the charges imposed, it should be noted that this Court has established that the amount of a bill for potable water service is not disputed in this forum. This is a matter of legality that must be raised in the same administrative forum and, eventually, in the ordinary judicial forum. Among others, Judgment No. 2018-017559, issued at 10:10 on 23 October 2018, stated the following:\n\n“...The applicant complains about the high charges received on the water service bill. She states that she is a woman living alone with limited means and has observed that the amount payable shown on the water bill varies excessively, since the supply serves few people and the amount charged is unjustified. She explains that personnel from the challenged administration have already visited to inspect, but have not provided solutions. However, this Chamber is not a body that reviews the legality of the Administration’s actions or decisions. It is not within this Court’s jurisdiction to review, in accordance with the applicable law, whether or not there is a leak on the property or to determine the origin of the charge, nor to establish the correct amount to be paid for the service received, since this is a matter for the ordinary administrative and judicial forums. Accordingly, if the applicant considers it appropriate, she may raise her disagreement or complaint with the same challenged authority or in the competent judicial forum, where she may fully discuss the merits of the matter and assert her claims. Accordingly, this application is inadmissible, and so it is declared...”\n\nThese considerations apply to the case under review, since this Court finds no reason to depart from the position expressed in those judgments, nor grounds to assess the situation presented differently. The application does not show an injury to access to a public service, since the complaint concerns disagreement with the amount billed for potable water service, but the applicants continue to receive that service at the property to which they refer. In light of the foregoing, the protected parties’ disagreement with the facts underlying this matter is, as indicated, an issue to be raised in the ordinary administrative or judicial forum. Accordingly, if the applicant considers it appropriate, they may raise their disagreement or complaint with the same challenged institution or in the competent ordinary jurisdiction, where they may fully discuss the merits of the matter and assert their claims.\n\nIII.- As to the disagreement with the refusal to replace the requested meters, it is important to state that this Court should not act as a mediator with a particular natural or legal person—whether governed by public or private law—to intercede on behalf of a third party so that the third party may obtain what they seek. Accordingly, it is not for this Court to assess or order the challenged institute to replace the requested meters before the challenged authority, as the protected party requests in this case. Therefore, the applicant may, if they so wish, raise their disagreements or complaints with the challenged authority, as they indicate they have done, or in the competent judicial forum, where they may fully discuss the merits of the matter and assert their claims. In view of the foregoing, the application is inadmissible.\n\nIV.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they have submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum of 30 business days from notification of this judgment.
