San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita bajo el número de expediente 26-028917-0007-CO, interpuesto por Nombre01, cédula de identidad CED01; contra el INSTITUTO NACIONAL DE VIVIENDA Y URBANISMO (INVU). \n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de la Sala el 10 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el INSTITUTO NACIONAL DE VIVIENDA Y URBANISMO (INVU). Manifiesta que el 17 de abril de 2026 presentó ante la institución accionada una solicitud de Alineamiento Fluvial, identificada con la Secuencia N.° 25330, trámite que considera necesario para continuar con el proceso de obtención de un bono de vivienda. Señala que, ante la falta de resolución, consultó el estado de la gestión y que, mediante correo electrónico del 26 de mayo de 2026, el Departamento de Urbanismo del INVU le informó que se encontraba en proceso de revisión y cálculo, indicando que, si bien el plazo ordinario para resolver era de quince días hábiles, debido a la cantidad de trámites y al personal disponible el plazo de respuesta superaba los treinta días hábiles. Refiere que el 3 de junio de 2026 realizó una nueva consulta y se le indicó que la solicitud continuaba pendiente debido a un atraso en los trámites, sin que se le comunicara una fecha estimada de resolución. Agrega que, a la fecha de interposición del recurso, habían transcurrido aproximadamente dos meses sin que el INVU resolviera el trámite, situación que le impide continuar con las gestiones necesarias para acceder al bono de vivienda y le genera perjuicios e incertidumbre. Solicita la intervención de la Sala.\n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. La parte recurrente reclama que el Instituto Nacional de Vivienda y Urbanismo no ha resuelto, dentro del plazo correspondiente, la solicitud de Alineamiento Fluvial, identificada con la Secuencia N.° 25330, presentada el 17 de abril de 2026, pese a que el propio INVU le informó que el plazo ordinario para atenderla era de quince días hábiles y que, a la fecha de interposición del recurso, habían transcurrido aproximadamente dos meses sin resolución; considera que dicha demora le impide continuar con el proceso de obtención de un bono de vivienda y le genera perjuicios e incertidumbre, por lo que pretende que se resuelva la gestión.\n\nII.- SOBRE LA ALEGADA MORA ADMINISTRATIVA. La gestión cuya falta de respuesta reclama la parte recurrente, no constituye una solicitud de información pura y simple protegida por el artículo 27 de la Constitución Política; sino que se trata de una solicitud de Alineamiento Fluvial, identificada con la Secuencia N.° 25330, presentada ante el Instituto Nacional de Vivienda y Urbanismo, a lo cual le es aplicable lo dispuesto en el artículo 41 de la Constitución Política, pues requiere un pronunciamiento por parte de la Administración. Ahora bien, a partir del voto número 2008-02545 de las 8:55 horas del 22 de febrero de 2008 y salvo algunas excepciones, esta Sala ha remitido este tipo de reclamos a la jurisdicción contencioso administrativa y, precisamente, el tema aquí planteado no es una de las excepciones que esta Sala ha admitido para conocer la alegada violación al derecho a obtener justicia administrativa pronta y cumplida. En efecto, la parte recurrente cuestiona que el Instituto Nacional de Vivienda y Urbanismo no haya emitido una resolución definitiva respecto de la solicitud de Alineamiento Fluvial presentada el 17 de abril de 2026, pese a que, según refiere, la propia Administración le informó que el plazo ordinario para atender dicha gestión era de quince días hábiles y que, debido a la cantidad de trámites y al personal disponible, el plazo de respuesta era superior a treinta días hábiles; asimismo, señala que el 26 de mayo de 2026 se le comunicó que la gestión se encontraba en proceso de revisión y cálculo y que, posteriormente, el 3 de junio de 2026 se le informó que continuaba pendiente debido a un atraso en las solicitudes. De esta suerte, lo que se pretende en este asunto es que se determine si la Administración ha incurrido en un retardo injustificado en la resolución de una gestión administrativa y, por ende, se trata de un extremo cuyo conocimiento corresponde a la jurisdicción contencioso-administrativa. En consecuencia, lo procedente es remitir a la parte recurrente a la vía contenciosa a acusar el retardo en cuestión, con fundamento en los siguientes considerandos.\n\nIII.- NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación. Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.\n\n IV.- VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS: CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para la parte recurrente. Consecuentemente, se impone el rechazo de plano e indicarle a la persona gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa. \n\nV.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\nVI.- VOTO SALVADO DEL MAGISTRADO CRUZ CASTRO. Si bien en el pasado he sostenido el criterio de mayoría del Tribunal, bajo una mejor ponderación de los derechos fundamentales que se reclaman, estimo que la mora administrativa constituye una lesión a una garantía procesal fundamental, razón por la que cambio el criterio que había expuesto, admitiendo la posible infracción al derecho a una justicia administrativa pronta y cumplida, separándome de la visión de la mayoría del Tribunal, en el sentido que –salvo contadas excepciones- este tipo de reproches deben resolverse en la jurisdicción contenciosa administrativa. Por el contrario, estimo que uno de los derechos que esta jurisdicción se encuentra llamada a tutelar es el de la justicia pronta y cumplida, expresamente consagrado en el artículo 41 constitucional. Ello conforme al ámbito de competencia asignado a este Tribunal en materia de protección a derechos fundamentales, en atención a lo dispuesto en los artículos 10 y 48 de la Constitución Política. Si bien, entiendo la importancia de las reformas de la jurisdicción contencioso administrativa a partir de la vigencia de la Ley 8508 del veinticuatro de abril de dos mil seis, lo cierto es que dicha situación no justifica la remisión a dicha instancia de los asuntos que versan sobre materia que es competencia de esta Sala, la cual ha demostrado a lo largo de los años que es un medio célere y efectivo para la tutela de los derechos fundamentales de los habitantes del país.\n\nVII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso. San José, at nine thirty in the morning on 18 August 2026.\n\n \n\nAmparo proceeding conducted under case file number 26-028917-0007-CO, filed by Nombre01, identity card CED01, against the NATIONAL INSTITUTE OF HOUSING AND URBAN PLANNING (INVU).\n\nBackground:\n\n1.- In a brief submitted to the Chamber Clerk’s Office on 10 August 2026, the petitioner files an amparo application against the NATIONAL INSTITUTE OF HOUSING AND URBAN PLANNING (INVU). The petitioner states that on 17 April 2026 they submitted to the respondent institution an application for river alignment (Alineamiento Fluvial), identified by Sequence No. 25330, a procedure the petitioner considers necessary to continue the process of obtaining a housing subsidy. The petitioner states that, after receiving no decision, they asked about the status of the application and that, by email dated 26 May 2026, INVU’s Department of Urban Planning informed them that it was under review and calculation, indicating that, although the ordinary period for deciding it was fifteen business days, the response period exceeded thirty business days because of the volume of applications and the available staff. The petitioner reports that on 3 June 2026 they made a further inquiry and were told that the application remained pending because of a backlog, without being given an estimated decision date. The petitioner adds that, as of the filing of the amparo application, approximately two months had passed without INVU deciding the application, a situation that prevents them from continuing the steps needed to obtain the housing subsidy and causes them harm and uncertainty. The petitioner requests the Chamber’s intervention.\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to dismiss summarily or on the merits, at any time, including upon filing, any matter brought before it that proves manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is merely a reiteration or reproduction of an earlier identical or similar matter that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- PURPOSE OF THE AMPARO APPLICATION. The petitioner complains that the National Institute of Housing and Urban Planning has not decided, within the applicable period, the application for river alignment, identified by Sequence No. 25330, submitted on 17 April 2026, even though INVU itself informed the petitioner that the ordinary period for handling it was fifteen business days and, as of the filing of the amparo application, approximately two months had passed without a decision. The petitioner considers that this delay prevents them from continuing the process of obtaining a housing subsidy and causes them harm and uncertainty, and therefore seeks a decision on the application.\n\nII.- REGARDING THE ALLEGED ADMINISTRATIVE DELAY. The matter for which the petitioner complains of a lack of response is not a simple request for information protected by Article 27 of the Political Constitution; rather, it is an application for river alignment, identified by Sequence No. 25330, submitted to the National Institute of Housing and Urban Planning, to which Article 41 of the Political Constitution applies, since it requires a decision by the Administration. Now, beginning with judgment number 2008-02545, issued at 8:55 a.m. on 22 February 2008, and subject to certain exceptions, this Chamber has referred this type of complaint to the administrative-litigation jurisdiction and, specifically, the issue raised here is not one of the exceptions this Chamber has accepted for hearing alleged violations of the right to obtain prompt and complete administrative justice. Indeed, the petitioner challenges the fact that the National Institute of Housing and Urban Planning has not issued a final decision on the application for river alignment submitted on 17 April 2026, even though, according to the petitioner, the Administration itself informed them that the ordinary period for handling the application was fifteen business days and that, because of the volume of applications and available staff, the response period exceeded thirty business days. The petitioner also states that on 26 May 2026 they were informed that the application was under review and calculation and that, later, on 3 June 2026, they were told it remained pending because of a backlog in applications. Accordingly, the relief sought in this matter is a determination of whether the Administration has incurred an unjustified delay in deciding an administrative matter and, therefore, this issue falls within the jurisdiction of the administrative-litigation courts. Consequently, the proper course is to refer the petitioner to the administrative-litigation avenue to complain of the delay in question, on the basis of the following reasons.\n\nIII.- THE NEW ADMINISTRATIVE JUSTICE SYSTEM: A PROMPT AND COMPLETE MECHANISM FOR PROTECTING THE SUBSTANTIVE LEGAL POSITIONS OF ADMINISTRATIVE SUBJECTS. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in view of the absence of expeditious and prompt procedural channels for protecting substantive legal positions grounded in the infra-constitutional legal order or legality standard, which have an indirect connection to fundamental rights and Constitutional Law. In this regard, it must be borne in mind that, by virtue of its supremacy, super-legality, and direct and immediate effect, the Constitution provides an indirect basis for any conceivable substantive legal position of individuals. Nevertheless, upon further consideration, and following the enactment of the Administrative Litigation Procedure Code (Law No. 8508 of 24 April 2006) and its entry into force on 1 January 2008, it has become clear that litigants now have access to a full and universal administrative-litigation jurisdiction, which is highly expeditious and prompt because of the various procedural mechanisms that this legislation incorporates into the legal order, such as shortened time limits for taking the various procedural steps; broad standing; interim measures; an open-ended range of claims that may be brought; oral proceedings—and their subsidiary principles of concentration, immediacy, and expedition; a single instance with a right of appeal in expressly specified situations; settlement during proceedings; a unified proceeding; the preferential-track proceeding or “amparo of legality”; proceedings involving only questions of law; new enforcement measures (coercive fines, substitute or commissarial enforcement, attachment of assets in the fiscal domain and certain assets in the public domain); the broad powers of the body of enforcement judges; the extension and adaptation of the effects of case law to third parties; and the flexibility of the cassation appeal. All these novel procedural institutions are expressly intended to achieve procedural economy, expedition, promptness, and effective or complete protection of the substantive legal positions of administrative subjects, while safeguarding fundamental rights such as due process, the right of defense, and the adversarial principle. In sum, the new administrative-litigation jurisdiction is an appropriate channel, given its new characteristics of simplicity, expedition, and promptness, for the effective protection of the substantive legal positions of administrative subjects where evidence must be gathered or ordinary legality issues determined.\n\nIV.- VERIFICATION OF STATUTORY TIME LIMITS FOR DECIDING ADMINISTRATIVE PROCEEDINGS: AN OBVIOUS QUESTION OF ORDINARY LEGALITY. It is evident that determining whether the public administration complies with the time limits established by the General Public Administration Act (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to issue a final act in an administrative proceeding—initiated on the administration’s own initiative or at a party’s request—or to hear the applicable administrative appeals, is plainly a question of ordinary legality that may henceforth be argued and decided before the administrative-litigation jurisdiction, applying the principles that inform constitutional jurisdiction, such as representative standing, the ability to present one’s own defense—that is, to appear without legal counsel—and the petitioner’s right to proceed without charge. Accordingly, the amparo application must be dismissed summarily, and the petitioner must be informed that they may, if they so wish, turn to the administrative-litigation jurisdiction.\n\nV.- NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND COMPLETE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and complete justice in the administrative forum, the legal dispute must be heard by the Administrative Litigation Courts, not by this Chamber. However, with the recent enactment of Law No. 9097, the Law Regulating the Right of Petition, it has been established that this right is subject to judicial protection through the amparo application established by Article 32 of the Constitutional Jurisdiction Act, in conjunction with Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of case law; under Article 7 of its Act, this Court alone is responsible for defining its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo procedure, the competent judges in all other cases, for the reasons given by this Court (judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008), are the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, Constitutional Law (its values, principles, and rules), and the applicable statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.\n\nVI.- DISSENTING OPINION OF JUSTICE CRUZ CASTRO. Although I previously held the Court’s majority view, upon further consideration of the fundamental rights at issue, I consider that administrative delay constitutes an injury to a fundamental procedural guarantee. For that reason, I change the position I had expressed and accept that there may be a violation of the right to prompt and complete administrative justice, departing from the Court’s majority view that, save for a few exceptions, this type of complaint must be resolved in the administrative-litigation jurisdiction. On the contrary, I consider that one of the rights this jurisdiction is called upon to protect is the right to prompt and complete justice, expressly enshrined in Article 41 of the Constitution. This follows from the scope of jurisdiction assigned to this Court in the protection of fundamental rights, pursuant to Articles 10 and 48 of the Political Constitution. Although I understand the importance of the reforms to the administrative-litigation jurisdiction following the entry into force of Law 8508 of 24 April 2006, that circumstance does not justify referring to that forum matters involving subject matter within this Chamber’s jurisdiction. Over the years, this Chamber has shown itself to be an expeditious and effective means of protecting the fundamental rights of the country’s inhabitants.\n\nVII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The petitioner is advised that any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted, must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the resolution approved by the Judicial Council at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is dismissed summarily.
