  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-029217-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026031828\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre02, cédula de identidad CED01, a favor de Nombre01, cédula de identidad CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nResultando:\n\n 1.- Por escrito agregado al Sistema de Gestión de Despachos Judiciales de esta Sala a las 12:24 horas del 12 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, a favor de Nombre01 y manifiesta que: “Primero. La señora Nombre01 es usuaria del servicio de agua potable correspondiente al NIS 3342006, destinado exclusivamente a una vivienda de uso habitacional donde residen únicamente dos personas: su hijo y la persona que suscribe este recurso. Segundo. Desde abril de 2026 el AyA comenzó a emitir facturaciones con incrementos abruptos y desproporcionados que no guardan relación con el consumo histórico del inmueble. A pesar de los múltiples reclamos formulados, la institución sostuvo que las lecturas eran correctas sin realizar oportunamente una inspección técnica que verificara el estado del servicio. Tercero. La situación alcanzó su punto más grave con la facturación correspondiente a la lectura del 6 de julio de 2026, en la cual se registró un supuesto consumo de 185 metros cúbicos y un cobro de ₡107.997, cuando el consumo histórico de la vivienda es cercano a los 14 metros cúbicos mensuales. Posteriormente el AyA rectificó el consumo a 56 metros cúbicos; sin embargo, mantuvo prácticamente el mismo monto facturado, sin brindar explicación técnica suficiente que justificara esa decisión. Cuarto. Ante la falta de respuesta efectiva por parte del AyA, la señora Nombre01 contrató por su cuenta una inspección técnica particular, la cual descartó la existencia de fugas o desperfectos internos que pudieran explicar consumos extraordinarios. Quinto. El historial de facturación evidencia además la realización de varias estimaciones consecutivas, práctica que resulta contraria a la regulación aplicable cuando no concurren las circunstancias excepcionales previstas en la normativa. A pesar de ello, el AyA no ha explicado las razones técnicas que justifican esas estimaciones ni ha demostrado que el consumo extraordinario realmente ocurrió. Sexto. El día 14 de julio de 2026 presenté un reclamo telefónico ante el Instituto Costarricense de Acueductos y Alcantarillados, registrado bajo el caso No. 12470205. No fue sino hasta el 27 de julio de 2026 que la institución comunicó una supuesta rectificación del consumo, reduciéndolo de 185 m³ a 56 m³. Sin embargo, dicha rectificación no produjo una disminución real del monto facturado, pues el importe a cancelar permaneció prácticamente inalterado, sin que el AyA brindara una explicación técnica o jurídica que justificara esa situación. Ante esta respuesta insuficiente, solicité nuevamente que se realizara un análisis integral del historial de consumo del medidor y que la facturación se ajustara con base en el consumo promedio histórico del inmueble, por tratarse de una vivienda habitada únicamente por dos personas. Los consumos extraordinarios atribuidos por el AyA resultan manifiestamente incompatibles con las condiciones reales del servicio y evidencian una actuación carente de razonabilidad, sustentada en criterios técnicos insuficientemente motivados. Sétimo. La señora Nombre01 es una persona adulta mayor y convive con su hijo, quien presenta una condición de discapacidad. Los cobros desproporcionados e injustificados afectan gravemente su economía familiar y colocan a su hogar en una situación de vulnerabilidad, pues generan el riesgo permanente de suspensión o limitación del servicio de agua potable por imposibilidad material de cancelar montos manifiestamente irregulares. El acceso continuo al agua resulta indispensable para su salud, higiene y calidad de vida”. Considera violentados los derechos fundamentales de la tutelada. Solicita que se declare con lugar el recurso con las consecuencias de ley y que se le ordene al AyA realizar una revisión técnica integral, objetiva y debidamente motivada del historial de consumo correspondiente al NIS 3342006, y mientras se resuelve definitivamente la controversia administrativa, que el recurrido se abstenga de suspender, restringir o afectar el suministro de agua potable por motivo de las facturaciones impugnadas, que se ordene al A y A emitir una resolución técnicamente fundamentada que explique las razones de los consumos extraordinarios y, en caso de no demostrarse objetivamente su procedencia, proceda a corregir la facturación conforme al consumo real e histórico del inmueble.\n\n 2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n \n\n I.- OBJETO DEL RECURSO. La recurrente señala que la amparada es usuaria del servicio de agua potable correspondiente al NIS 3342006, destinado exclusivamente a una vivienda de uso habitacional donde residen únicamente dos personas: su hijo y la persona que suscribe este recurso. Menciona que, desde abril de 2026 el A y A comenzó a emitir facturaciones con incrementos abruptos y desproporcionados que no guardan relación con el consumo histórico del inmueble, y pese a las gestiones planteadas los cobros desproporcionados e injustificados afectan gravemente su economía familiar y colocan a su hogar en una situación de vulnerabilidad, pues generan el riesgo permanente de suspensión o limitación del servicio de agua potable por imposibilidad material de cancelar montos manifiestamente irregulares. Situación por la cual solicita la intervención de esta sede constitucional.\n\n II.- CASO CONCRETO. Según lo planteado por la recurrente, cabe indicar que, este Tribunal ha resuelto que no es en esta sede donde se discute sobre el monto de un recibo por la prestación del servicio de agua potable. Se trata de una cuestión de legalidad que debe plantearse en la misma sede administrativa y, eventualmente, jurisdiccional ordinaria. Entre otras, en la Sentencia N° 2018-017559 de las 10:10 horas del 23 de octubre de 2018, indicó lo siguiente:\n\n“…La recurrente reclama por lo elevados cobros que ha recibido en la factura del servicio de agua. Expresa que es mujer sola y de escasos recursos y ha observado que el monto a pagar expresado en el recibo del agua varía de forma exagerada, ya que el suministro sirve a pocas personas y no se justifica lo cobrado. Explica que el personal de la administración recurrida ya ha acudido a revisar, pero no le dan soluciones. Sin embargo, esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto a pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, este recurso es inadmisible y así se declara…”.\n\nConsideraciones que son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dichas sentencias, ni motivos que lo hagan valorar de manera distinta en la situación planteada. Del escrito de interposición del recurso, no se desprende una lesión al acceso a un servicio público, pues lo que se acusa es la discrepancia con el monto facturado por el servicio de agua potable, pero lo cierto es que la petente mantiene el suministro de ese servicio en el inmueble a que hace referencia. A partir de lo anterior, la disconformidad de la tutelada con los hechos que sustenta este asunto, es un aspecto que, como se indicó, es propio de alegarse en la vía común -administrativa o jurisdiccional-. \n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\n \n\nPor tanto:\n\n Se rechaza de plano el recurso. \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:30 a.m. on 18 August 2026.\n\nAmparo application filed by Nombre02, identity card CED01, on behalf of Nombre01, identity card CED02, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\nBackground:\n\n1.- In a submission added to this Chamber’s Judicial Offices Management System at 12:24 p.m. on 12 August 2026, the applicant files an amparo application against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS, on behalf of Nombre01, and states: “First. Ms. Nombre01 is a user of the drinking-water service associated with NIS 3342006, intended exclusively for a residential dwelling where only two people live: her son and the person signing this application. Second. Since April 2026, AyA began issuing bills with abrupt and disproportionate increases that bear no relation to the property’s historical consumption. Despite the multiple complaints filed, the institution maintained that the readings were correct without conducting a timely technical inspection to verify the condition of the service. Third. The situation reached its most serious point with the bill corresponding to the reading of 6 July 2026, which recorded an alleged consumption of 185 cubic meters and a charge of ₡107.997, when the dwelling’s historical consumption is close to 14 cubic meters per month. AyA subsequently corrected the consumption to 56 cubic meters; however, it maintained practically the same billed amount, without providing a sufficient technical explanation to justify that decision. Fourth. In the absence of an effective response from AyA, Ms. Nombre01 hired a private technical inspection at her own expense, which ruled out leaks or internal defects that could explain extraordinary consumption. Fifth. The billing history also shows several consecutive estimates, a practice contrary to the applicable regulations when the exceptional circumstances provided for in the rules do not apply. Despite this, AyA has not explained the technical reasons justifying those estimates or demonstrated that the extraordinary consumption actually occurred. Sixth. On 14 July 2026, I submitted a telephone complaint to the Costa Rican Institute of Aqueducts and Sewers, registered as case No. 12470205. It was not until 27 July 2026 that the institution communicated an alleged correction of the consumption, reducing it from 185 m³ to 56 m³. However, that correction did not result in an actual reduction in the billed amount, since the amount payable remained practically unchanged, without AyA providing a technical or legal explanation to justify that situation. In response to this insufficient answer, I again requested a comprehensive analysis of the meter’s consumption history and that the billing be adjusted based on the property’s historical average consumption, since it is a dwelling inhabited by only two people. The extraordinary consumption attributed by AyA is manifestly incompatible with the actual conditions of the service and demonstrates conduct lacking reasonableness, based on insufficiently reasoned technical criteria. Seventh. Ms. Nombre01 is an older adult and lives with her son, who has a disability. The disproportionate and unjustified charges seriously affect their household finances and place their home in a vulnerable situation, since they create an ongoing risk that the drinking-water service will be suspended or limited because it is materially impossible to pay manifestly irregular amounts. Continuous access to water is essential to their health, hygiene, and quality of life.” The applicant considers the fundamental rights of the protected person to have been violated. The applicant asks that the amparo application be granted, with the legal consequences thereof, and that AyA be ordered to conduct a comprehensive, objective, and duly reasoned technical review of the consumption history associated with NIS 3342006 and, while the administrative dispute is finally resolved, that the respondent refrain from suspending, restricting, or affecting the drinking-water supply on account of the contested bills; that AyA be ordered to issue a technically substantiated decision explaining the reasons for the extraordinary consumption and, if its basis is not objectively demonstrated, to correct the billing in accordance with the property’s actual and historical consumption.\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber to summarily dismiss, either at the outset or on the merits, at any time, including upon filing, any matter submitted to it that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is merely a reiteration or reproduction of an identical or similar earlier matter that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE AMPARO APPLICATION. The applicant states that the protected person is a user of the drinking-water service associated with NIS 3342006, intended exclusively for a residential dwelling where only two people live: her son and the person signing this application. The applicant notes that since April 2026 AyA began issuing bills with abrupt and disproportionate increases that bear no relation to the property’s historical consumption, and that despite the steps taken, the disproportionate and unjustified charges seriously affect their household finances and place their home in a vulnerable situation, since they create an ongoing risk that the drinking-water service will be suspended or limited because it is materially impossible to pay manifestly irregular amounts. For this reason, the applicant requests the intervention of this constitutional forum.\n\nII.- SPECIFIC CASE. In light of what the applicant has raised, it should be noted that this Court has held that a dispute over the amount of a bill for drinking-water service is not heard in this forum. This is a matter of legality that must be raised before the same administrative authority and, eventually, in the ordinary courts. Among others, in Judgment No. 2018-017559, issued at 10:10 a.m. on 23 October 2018, the Court stated:\n\n“…The applicant complains about the high charges on the water-service bill she has received. She states that she is a single woman with limited means and has observed that the amount payable shown on the water bill varies excessively, since the supply serves only a few people and the amount charged is unjustified. She explains that staff from the respondent administration have already come to inspect, but have offered no solutions. However, this Chamber is not a reviewer of the legality of the Administration’s actions or decisions. It is not within this Court’s jurisdiction to review, under the applicable law, whether or not there is a leak on the property, determine the origin of the charge, or establish the correct amount payable for the service received, since that is a matter for the ordinary administrative and judicial channels. Accordingly, if the applicant deems it appropriate, she may bring her disagreement or complaint before the same respondent authority or before the competent judicial forum, where she may fully discuss the merits of the matter and assert her claims. Therefore, this application is inadmissible, and it is so declared…”\n\nThose considerations apply to the case under review, since this Court finds no reason to depart from the criterion set out in those judgments, nor any grounds to assess the situation presented differently. The application does not disclose an infringement of access to a public service, because the complaint concerns disagreement with the amount billed for drinking-water service; the fact is that the petitioner continues to receive that service at the property in question. Accordingly, the protected person’s disagreement with the facts underlying this matter is, as indicated, an issue to be raised through the ordinary administrative or judicial channels.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are notified that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must collect them from the court office within a maximum period of 30 business days from notification of this judgment.
