  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-006587-0007-CO \n\nRes. Nº 2026031920\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n \n\nRecurso de amparo interpuesto por Nombre02, cédula de identidad CED02, contra el MINISTERIO DE AMBIENTE Y ENERGÍA.\n\nResultando:\n\n1.- Por escrito recibido en la Secretaría de la Sala el 24 de febrero de 2026, el recurrente interpone recurso de amparo contra el MINISTERIO DE AMBIENTE Y ENERGÍA y manifiesta que es adulto mayor y miembro activo de la comunidad afrodescendiente del Caribe costarricense, con legítimo y profundo interés histórico, cultural, social y espiritual en la protección y gestión sostenible de los territorios costeros y áreas protegidas de la vertiente atlántica, particularmente el Refugio Nacional de Vida Silvestre Barra del Colorado, espacio de alto valor ecológico y potencial relevancia cultural para las prácticas ancestrales de las comunidades afrodescendientes de la región. Señala que ha dirigido al Viceministerio de Ambiente y Energía varias solicitudes formales relacionadas con el Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado, solicitando específicamente información detallada, técnica y documentada sobre: “* El reconocimiento o no de posesiones históricas y ancestrales de comunidades afrodescendientes en el área del Refugio. * La existencia de prácticas culturales, sociales, económicas tradicionales, pesca artesanal, navegación local histórica y actividades culturales afrodescendientes dentro del Refugio. o Las medidas concretas adoptadas (o no) por el MINAE/SINAC para proteger y visibilizar tales derechos culturales en el régimen de gestión del Refugio. * Los estudios técnicos, antropológicos, históricos o de mapeo cultural realizados o en curso sobre el valor ancestral del territorio”. Refiere que el 25 de enero de 2026 presentó la nota MLV-0032-2026. El 9 de febrero de 2026 recibió respuesta mediante oficio DVA-017-2026, la cual resultó manifiestamente insuficiente, parcial y tangencial. El mismo 9 de febrero de 2026 replicó mediante nota MLV-0051-2026, refutando punto por punto las omisiones y solicitando información completa. El 23 de febrero de 2026 recibió el oficio DVA-022-2026, mediante el cual el recurrido establece lo siguiente: “* Califica sus solicitudes como \"reiterativas\" y \"abusivas del derecho de petición\", citando una resolución de la Sala Constitucional del año 2005 (2005-9680). * Afirma de manera categórica y sin sustento probatorio que \"en el área del Refugio Nacional de Vida Silvestre Barra del Colorado no se registra ni identifica a ningún actor que corresponda a un grupo tribal o indígena\" y que \"no se realiza ningún uso relacionado a posesiones históricas y ancestrales; prácticas culturales, sociales y económicas tradicionales, actividades de pesca artesanal y tradicional; actividades de cabotaje tradicional y navegación local histórica, actividades culturales afrodescendientes\". * Declara sus peticiones \"improcedentes y carentes de legitimación\". * Se limita a remitir al Plan de Manejo publicado en 2018 sin aportar ningún dato actualizado, estudio o evidencia que respalde sus afirmaciones”. El mismo 23 de febrero de 2026, la Presidencia de la Asamblea Legislativa, mediante oficio AL-PRES-RAS-198- 25/26 dirigido a él, reconoció expresamente que “no se cuenta con una identificación oficial de cuáles comunidades afrodescendientes deben ser consideradas sujetos colectivos para efectos de una eventual consulta obligatoria\" ni existe registro institucional que las represente, y que los estudios técnico-científicos de territorios ancestrales corresponden al Poder Ejecutivo (MINAE y entidades técnicas). Este documento oficial del Estado contradice frontalmente la posición del Viceministro y demuestra la omisión estructural del propio órgano recurrido”. Por lo anterior, solicita lo siguiente: “a) Admitir el presente recurso de amparo, tramitarlo con la celeridad que la materia exige y concederle el trámite de ley. b) Declarar con lugar el recurso y, en consecuencia: 1. Que el Ing. Jorge Mario Rodríguez Zúñiga y el Viceministerio de Ambiente han violado mis derechos fundamentales de acceso a la información pública, petición, identidad cultural y ambiente sano. 2. Ordenar, en el plazo máximo de 48 horas contadas a partir de la notificación, la entrega de respuesta completa, detallada, documentada y motivada a todas las preguntas formuladas en mis oficios, incluyendo todo estudio, mapa, informe técnico, acta o dato existente o que deba generarse sobre los valores culturales afrodescendientes en el Refugio Nacional de Vida Silvestre Barra del Colorado. 3. Ordenar que se abstengan de calificar mis peticiones como abusivas o improcedentes mientras subsista el legítimo interés público y personal. 4. Disponer las medidas cautelares que estime pertinentes para evitar que continúe la obstrucción informativa. c) Notificar al Ministerio Público, a la Procuraduría General de la República y al Despacho Ministerial del MINAE. d) Condenar en costas si a derecho corresponde”. \n\n2.- Mediante resolución de las 14:45 horas del 05 de marzo de 2026, este Tribunal dictó la resolución del curso del presente asunto.\n\n3.- Informa bajo juramento Jorge Mario Rodríguez Zúñiga, en su condición de viceministro de Ambiente y Energía (informe rendido el 10 de marzo de 2026), en los siguientes términos: “I. HECHOS Hechos alegados por la recurrente. “PRIMERO: Que es adulto mayor y miembro activo de la comunidad afrodescendiente del Caribe costarricense, con interés legítimo en la protección del Refugio Nacional de Vida Silvestre Barra del Colorado. SEGUNDO: Que mediante nota MLV-0032-2026 del 25 de enero de 2026, solicitó formalmente a este Viceministerio: a) la suspensión del Plan General de Manejo del Refugio; b) la activación del mecanismo de consulta previa, libre e informada conforme a los Convenios 107 y 169 de la OIT; c) que dicha consulta abarcara el Diagnóstico del año 2016; y d) que se respondiera una serie de preguntas concretas sobre el reconocimiento de derechos de comunidades afrodescendientes en la zona. TERCERO: Que mediante oficio DVA-017-2026 del 09 de febrero de 2026, este Despacho le brindó respuesta, indicando que el Plan de Manejo es un acto administrativo válido y firme, que no existe población tribal identificada en el Refugio según los mapeos oficiales del SINAC, y que el representante legal del Foro Tribal (ADIC) no ha realizado gestión alguna al respecto. CUARTO: Que mediante nota MLV-0051-2026 del 09 de febrero de 2026, el recurrente replicó y refutó la respuesta anterior, aportando argumentos basados en jurisprudencia de la Corte Interamericana de Derechos Humanos y reiterando sus solicitudes. QUINTO: Que mediante oficio DVA-022-2026 del 23 de febrero de 2026, este Despacho reiteró los argumentos expuestos en el oficio anterior, indicando que las gestiones del recurrente resultaban reiterativas y carentes de legitimación, citando jurisprudencia de esa Honorable Sala respecto al abuso del derecho de petición (Resolución N.°2005-9680). SEXTO: Que la recurrente adjunta a su amparo el oficio AL-PRES-RAS198-25/26 de la Asamblea Legislativa, del cual pretende desprender una contradicción en la posición del Estado. II. CONSIDERACIONES JURÍDICAS: PRIMERO: Sobre la naturaleza del Recurso de Amparo. El recurso de amparo es un proceso judicial que se tramita en la Sala Constitucional y que constituye la denominada jurisdicción constitucional de la libertad; su existencia garantiza la vigencia de los derechos fundamentales establecidos en la Constitución Política y en los tratados internacionales de derechos humanos vigentes en el país. La Ley de la Jurisdicción Constitucional establece en su numeral 29 que el recurso de amparo garantiza los derechos y libertades fundamentales a que se refiere esta ley, salvo los protegidos por el de hábeas corpus, establece además que procede contra toda disposición, acuerdo o resolución y en general, contra toda acción, omisión o simple actuación material no fundada en un acto administrativo eficaz, de los servidores y órganos públicos, que haya violado, viole o amenace violar cualquiera de aquellos derechos. No sólo procede contra los actos arbitrarios, sino también contra las actuaciones u omisiones fundadas en normas erróneamente interpretadas o indebidamente aplicadas. SEGUNDO: Sobre el marco constitucional aplicable. En el ordenamiento jurídico costarricense, el Recurso de Amparo se desprende de las normas constitucionales 10 y 48 de la Constitución Política, que establecen que toda persona tiene derecho al recurso de amparo para mantener o restablecer el goce de los derechos consagrados en la Constitución, así como de los de carácter fundamental, establecidos en los instrumentos internacionales sobre derechos humanos, aplicables en la República. Existe todo un título dentro de este cuerpo normativo donde se establecen una serie de derechos y garantías individuales, tales como el derecho a la vida en el artículo 21, el derecho a la intimidad, libertad y secreto de las comunicaciones del artículo 24, el derecho de igualdad que se consagra en el artículo 33, derecho que tienen los consumidores y usuarios a la protección del ambiente en el artículo 46, y dentro de los derechos y garantías sociales, el derecho a un ambiente sano y ecológicamente equilibrado y el correlativo deber estatal de tutelarlo en el artículo 50, así como el deber estatal de proteger las bellezas naturales. III En relación con lo ordenado por esta honorable Sala: “Rendir informe, dentro de los TRES DÍAS HÁBILES siguientes a la notificación de esta resolución, en cumplimiento de lo ordenado por esa Honorable Sala en la resolución de las 14:45 horas del 05 de marzo de 2026, procedo a rendir el presente informe bajo fe de juramento, en los siguientes términos: PRIMERO: Sobre la respuesta brindada mediante oficios DVA-017-2026 y DVA-022-2026. Este Despacho, en estricto apego al principio de legalidad que rige la función pública, ha dado respuesta oportuna y por escrito a cada una de las gestiones presentadas por el recurrente. En el oficio DVA-017-2026, se le indicaron con claridad los motivos por los cuales no resultaba procedente la solicitud de consulta, tomando en consideración la firmeza del acto administrativo, se le indico al recurrente que la suspensión no procede porque el Plan está vigente y no hay afectación a derechos de terceros, también por la inexistencia de población tribal identificada en la zona conforme a los mapeos oficiales del SINAC, el cual es un diagnóstico, un insumo técnico interno, no un acto administrativo autónomo, y que por tanto no es objeto de consulta y para finalizar no se ha presentado ante el SINAC gestión alguna por parte del representante legal del Foro Tribal (Asociación de Desarrollo Integral de Cahuita), con competencia en estos temas. Por tanto, se dio por parte de este viceministerio una respuesta congruente con lo solicitado, en la que se expusieron las razones que justifican la posición de la Administración. SEGUNDO: Sobre la calificación de las gestiones como \"reiterativas\". El oficio DVA-022-2026 fue emitido en respuesta a la nota MLV-0051- 2026, en dicha nota, el recurrente se limitó a reiterar los mismos argumentos expuestos en su gestión anterior, sin aportar elementos nuevos que hicieran variar el criterio de este Despacho, la cita de la resolución de esa Honorable Sala N.°2005-9680 no tuvo por objeto descalificar al recurrente, sino ilustrar el principio jurídico según el cual el derecho de petición se satisface mediante una respuesta congruente, no necesariamente favorable, y que su ejercicio abusivo o reiterativo no resulta amparable, lejos de constituir una violación a sus derechos, se le brindó una respuesta fundada, reiterando los argumentos ya expuestos. TERCERO: Sobre la inexistencia de población tribal en el Refugio Nacional de Vida Silvestre Barra del Colorado. Debe aclararse a esa Honorable Sala que la afirmación contenida en los oficios recurridos no es caprichosa ni carece de sustento. El Sistema Nacional de Áreas de Conservación (SINAC), como órgano técnico especializado, ha realizado procesos de mapeo integral de actores en el Área de Conservación Tortuguero desde el año 2000 hasta la fecha y no se han registrado ni identificado actor alguno que corresponda a un grupo tribal, no existe, por tanto, base fáctica alguna que permita tener por cierta la presencia de comunidades tribales en el área, ni mucho menos la realización de actividades ancestrales como las descritas por el recurrente. CUARTO: Sobre la naturaleza jurídica del Plan de Manejo y su proceso de aprobación. El Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado es un instrumento de planificación que fue aprobado siguiendo estrictamente los procedimientos legales establecidos en la Ley de Biodiversidad N.° 7788 y sus reglamentos. Su primera versión data del año 2009, y su actualización fue publicada en el Alcance N.° 144 a La Gaceta N.° 148 del 16 de agosto de 2018, pretender, como lo hace el recurrente, que un acto administrativo válido, firme y en ejecución desde hace más de 17 años sea sometido a un proceso de consulta con efecto retroactivo, no solo carece de sustento legal, sino que atenta contra el principio de seguridad jurídica y la estabilidad de los instrumentos de gestión ambiental del Estado. QUINTO: Sobre el oficio de la Asamblea Legislativa (AL-PRES-RAS-198- 25/26). En cuanto al oficio emitido por la Asamblea Legislativa, debe señalarse que dicho documento no constituye prueba de omisión alguna por parte de este viceministerio, por el contrario, dicho oficio se limita a reconocer una realidad fáctica que no existe un registro oficial de comunidades afrodescendientes como sujetos de consulta, ello no implica que este Despacho haya incurrido en contradicción alguna, sino que confirma que la carga de identificar y acreditar la existencia de tales comunidades y sus usos ancestrales no puede ser trasladada a la Administración de forma oficiosa, especialmente cuando el representante legal del Foro Tribal (ADIC) no ha realizado gestión alguna al respecto. SEXTO: Sobre la inexistencia de violación al derecho de petición. El derecho de petición consagrado en el artículo 27 de la Constitución Política no implica que la Administración deba acoger lo solicitado por el administrado, sino que debe otorgarle una respuesta oportuna, congruente y fundada. En el presente caso, al recurrente se le ha brindado respuesta en dos ocasiones oficios DVA-017-2026 y DVA-022-2026 mismos que el recurrente menciona, en las cuales se le han expuesto de manera clara y motivada las razones por las cuales su solicitud resulta improcedente. No existe, por tanto, violación alguna a su derecho fundamental de petición, sino una discrepancia de criterio respecto del fondo del asunto, lo cual escapa del ámbito de protección del amparo. SETIMO: En atención a los hechos expuestos se demuestra de manera fehaciente que este viceministerio ha dado respuesta en todo momento dentro del estricto marco de sus competencias legales y técnicas. PETITORIA De conformidad con lo estipulado se cumple con la presentación del informe solicitado por tanto SE SOLICITA se tome nota del cumplimiento del mandato ordenado por esta honorable Sala y se archive el expediente”. \n\n4.- Por escrito recibido en la Secretaría de la Sala el 12 de marzo de 2026, el recurrente replica el informe y reitera sus alegatos. \n\n5.- Por escrito recibido en la Secretaría de la Sala el 12 de marzo de 2026, el recurrente replica el informe y reitera sus alegatos. \n\n6.- Por escrito recibido en la Secretaría de la Sala el 23 de marzo de 2026, el recurrente aporta prueba. \n\n7.- Por escrito recibido en la Secretaría de la Sala el 23 de marzo de 2026, el recurrente realiza ampliación de réplica. Así, añade lo siguiente: “(…) solicitó formalmente la suspensión del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado y la activación inmediata del mecanismo de consulta previa, libre e informada conforme a los Convenios 107 y 169 de la OIT. Las respuestas recibidas (oficios DVA-017-2026 y DVA-022-2026) no satisfacen el derecho de petición ni cumplen las obligaciones internacionales y constitucionales del Estado, generando una violación manifiesta a mis derechos fundamentales y a los del pueblo tribal afrocostarricense que habita y utiliza ancestralmente la zona (…) El Plan General de Manejo, aunque aprobado en 2018, es un instrumento de planificación cuya ejecución continua afecta directamente los derechos territoriales, culturales y de subsistencia del pueblo tribal (pesca tradicional, uso de recursos y gobernanza ambiental)”. \n\n8.- Por escrito recibido en la Secretaría de la Sala el 31 de marzo de 2026, el recurrente aporta prueba. \n\n9.- Mediante resolución de las 15:49 horas del 18 de mayo de 2026, este Tribunal le previno al recurrente lo siguiente: “De previo a resolver lo que proceda en el RECURSO DE AMPARO que se tramita en el expediente No. 26-006587-0007-CO, interpuesto por Nombre02, aporte la parte recurrente, dentro del plazo de TRES DÍAS, contado a partir de la notificación de este pronunciamiento lo siguiente: • Copias completas, legibles y con el respectivo comprobante de recibido o de remisión de correo electrónico de las gestiones o solicitudes que señala planteó ante la autoridad accionada y cuya falta de respuesta adecuada alega en el memorial de interposición de este proceso. De igual modo, deberá aportar cualquier prueba adicional en la cual fundamente su dicho. Lo anterior, por cuanto tal información resulta esencial para resolver lo que en derecho corresponda y bajo apercibimiento de rechazar de plano el recurso si no lo hiciere (artículos 38 y 42 de la Ley de la Jurisdicción Constitucional). Notifíquese”. \n\n10.- Por escrito recibido en la Secretaría de la Sala el 20 de mayo de 2026, el recurrente manifiesta lo siguiente: “me permito presentar dentro del plazo de tres días otorgado, la siguiente documentación: 1. Copia completa y legible del oficio MLV-0032-2026, con su respectivo comprobante de recibido o remisión. 2. Copia completa y legible del oficio MLV-0051-2026, con su respectivo comprobante de recibido o remisión. 3. Copia completa y legible del oficio DVA-0003-2026. 4. Copia completa y legible del oficio DVA-017-2026. 5. Copia completa y legible del oficio DVA-022-2026. Los documentos anteriores corresponden a las gestiones y solicitudes que planteé ante la autoridad recurrida y cuya falta de respuesta adecuada motivó la interposición del presente Recurso de Amparo. Quedo atento a cualquier requerimiento adicional que esa Sala estime necesario para resolver el fondo del asunto”. \n\n11.- Por escrito recibido en la Secretaría de la Sala el 26 de mayo de 2026, Ana Aburto Tenorio, Anastacio Cajina Días, Alejandro Cajina Luna, Nubia Mayrena Tucker, Sixta Hernández Jirón, Sergio Guzmán Casto, Carlos Sánchez Espinoza, Betsy Sánchez Guzmán, Ernesto López González, Lidia Ruiz Ramírez, Nombre08, Nombre06, Nombre01, Nombre07, Nombre04, Nombre03, Luis Alberto Castrillo Carillo, Nombre05, Victoria Carillo Carillo, Andrés Jiménez García, y Nombre09 presentan una coadyuvancia a favor del recurrente. \n\n12.- Por escrito recibido en la Secretaría de la Sala el 26 de mayo de 2026, el recurrente aporta prueba. \n\n13.- Por escrito recibido en la Secretaría de la Sala el 30 de mayo de 2026, el recurrente aporta prueba. \n\n14.- Por escrito recibido en la Secretaría de la Sala el 30 de junio de 2026, el recurrente aporta prueba. \n\n15.- Por escrito recibido en la Secretaría de la Sala el 13 de julio de 2026, el recurrente aporta prueba. \n\n16.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta el Magistrado Araya García; y,\n\nConsiderando:\n\nI.- Objeto del recurso. El recurrente, quien es una persona adulta mayor reclama violación a sus derechos fundamentales, pues señala que ha presentado las siguientes solicitudes de información relacionadas con el Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado: a) nota MLV-0032-2026 del 25 de enero de 2026, la cual fue contestada de forma insuficiente mediante oficio DVA-017-2026; b) nota MLV-0051-2026, en donde replica el oficio DVA-017-2026, gestión que también fue contestada de forma insuficiente mediante oficio DVA-022-2026. Asegura que la autoridad recurrida no ha contestado de forma adecuada esas solicitudes. \n\nII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:\n\na) Mediante oficio no. DVA-003-2026 del 26 de enero de 2026, el viceministro de Ambiente le respondió al recurrente lo siguiente: “En atención al oficio MLV-0011-2026, mediante el cual solicita información relacionada con la actualización del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado 2017-2027, me permito indicarle lo siguiente: Durante el proceso de actualización del Plan General de Manejo, se elaboró previamente el Diagnóstico para la Actualización del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado (2016), el cual incorporó mecanismos de participación comunal, conforme a la normativa ambiental y administrativa vigente al momento de su formulación. Conforme lo dispone el Decreto 43532-MP-MINAE-MCJ-MEP fue publicado en el año 2022, la organización del Foro del Pueblo Tribal Afrocostarricense actualmente se encuentra a cargo de la Asociación de Desarrollo Integral de Cahuita y es a quien le corresponde la representación. Note de importancia, que el artículo 4 dispone que de ser necesario el Poder Ejecutivo adoptará, en consulta y coordinación con el Pueblo Tribal Afrocostarricense, los asuntos que le resulten importantes para sus derechos humanos; sin que a la fecha se tenga ninguna solicitud expresa relacionada al Refugio Nacional de Vida Silvestre Barra del Colorado ni a sus instrumentos de planificación” (ver el informe rendido y la prueba aportada).\n\nb) Mediante oficio no. MLV-0032-2026 del 27 de enero de 2026, el recurrente presentó una gestión ante el viceministro de Ambiente, en donde solicitó lo siguiente: “Asunto: Ampliación del oficio DVA-003-2026, solicitud de aplicación inmediata del mecanismo de consulta previa, libre e informada, solicitud de inaplicación y suspensión de los efectos jurídicos del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado, y formulación de consultas de obligada contestación al MINAE y al SINAC Estimado señor Viceministro: I. ANTECEDENTES 1. Mediante oficio DVA-003-2026, de fecha 26 de enero de 2026, ese Viceministerio dio respuesta a la solicitud de información presentada por el suscrito mediante oficio MLV-0011-2026, relacionada con el proceso de actualización del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado 2017-2027 (…) V. SOLICITUD DE INAPLICACIÓN Y SUSPENSIÓN DE LOS EFECTOS JURÍDICOS DEL PLAN GENERAL DE MANEJO Con fundamento en lo expuesto, SOLICITO FORMALMENTE, en protección y beneficio de la población tribal afrodescendiente de Limón, que se inapliquen y suspendan los efectos jurídicos del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado, así como de cualquier proceso de modificación o actualización del mismo, exclusivamente en cuanto tales efectos incidan o puedan incidir sobre: • Los usos tradicionales del territorio; • Las posesiones históricas y ancestrales; • Las prácticas culturales, sociales y económicas tradicionales; • Las actividades de pesca artesanal y tradicional; • Las actividades de cabotaje tradicional y navegación local histórica; • Las actividades culturales afrodescendientes; y • Cualquier restricción, obligación, prohibición o sanción administrativa aplicada sin consulta previa. La presente solicitud no persigue la nulidad general del Plan, sino la inaplicación parcial y suspensión de efectos respecto de la población tribal afrodescendiente, hasta tanto se realice válidamente la consulta previa. VI. SOLICITUD DE APLICACIÓN INMEDIATA DEL MECANISMO DE CONSULTA PREVIA SOLICITO que el Ministerio de Ambiente y Energía active de inmediato el mecanismo de consulta previa, libre e informada, en el estado actual del Plan General de Manejo, y que se suspenda su aplicación respecto de la población afrodescendiente hasta la conclusión válida del proceso de consulta. VII. SOLICITUD EXPRESA DE CONSULTA DEL PLAN GENERAL DE MANEJO Y DEL DIAGNÓSTICO 2016 SOLICITO DE MANERA EXPRESA que el proceso de consulta previa abarque integralmente: 1. El Plan General de Manejo en su versión vigente y futuras actualizaciones; y 2. El Diagnóstico para su actualización elaborado en el año 2016, por constituir la base técnica y conceptual del Plan y producir efectos materiales determinantes. VIII. PRETENSIONES FINALES Y CONSULTAS DE OBLIGADA CONTESTACIÓN (MINAE – SINAC) Con fundamento en lo anterior, PLANTEO LAS SIGUIENTES PRETENSIONES Y CONSULTAS, las cuales requieren pronunciamiento expreso, claro y motivado: A. Pretensiones 1. Que se tenga por presentada la presente gestión como ampliación formal del oficio DVA-003-2026. 2. Que se mantenga suspendida la aplicación del Plan General de Manejo respecto de la población afrodescendiente hasta que concluya válidamente la consulta previa. 3. Que se ordene la activación inmediata del mecanismo de consulta previa respecto del Plan y del Diagnóstico 2016. B. Consultas de obligada contestación al MINAE 4. ¿Reconoce el MINAE que el Plan General de Manejo y el Diagnóstico 2016 son medidas administrativas susceptibles de afectar derechos colectivos de la población tribal afrodescendiente? 5. ¿Reconoce el MINAE que la consulta previa es un deber estatal oficioso, que no depende de solicitud previa? 6. ¿Qué acción concreta adoptará el MINAE para cumplir la consulta previa, indicando acto administrativo, dependencia responsable y plazo de inicio? 7. ¿Mantendrá el MINAE suspendida la aplicación del Plan mientras no se concluya válidamente la consulta? C. Consultas de obligada contestación al SINAC 8. ¿Reconoce el SINAC que le corresponde ejecutar materialmente el proceso de consulta previa como administrador del Refugio? 9. ¿Reconoce el SINAC que no se ha realizado consulta previa respecto del Plan ni del Diagnóstico 2016? 10. ¿Qué acciones concretas desarrollará el SINAC para convocar y ejecutar la consulta previa, indicando metodología y cronograma? 11. ¿Se compromete el SINAC a no aplicar restricciones ni sanciones derivadas del Plan respecto de la población afrodescendiente mientras no se realice la consulta?” (ver el informe rendido y la prueba aportada).\n\nc) Mediante oficio no. DVA-017-2026 del 09 de febrero de 2026, el viceministro de ambiente y energía le respondió al recurrente lo siguiente: “En atención a su nota MLV-0032-2026 del 25 de enero de 2026, mediante la cual usted solicita que se amplie la nota DVA-003-2026 y se suspenda la aplicación del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado con el fin de que se realicen los mecanismos de consulta con base en el Convenio 107 y 169, me permito sobre el particular indicar lo siguiente: Se ratifica lo mencionado en la nota DVA-003-2026 en cuanto a que la representación legal del Foro Tribal recae en la Asociación de Desarrollo Integral de Cahuita, quien no ha realizado ninguna gestión relacionada al Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado ni ha solicitado ninguna aplicación de mecanismos de consulta, toda vez que no hay ningún documento relacionado en desarrollo. Es de suma importancia, tener presente los antecedentes del área silvestre protegida y la regulación ambiental y gobernanza que operó para su puesta en vigencia, pues la pretensión del solicitante es aplicar una retroactividad a un acto administrativo firme y consolidado, basado en un argumento de supuesta obligatoriedad de consultar un acto administrativo relacionado a una población tribal no identificada. El área silvestre protegida llamada “Refugio Nacional de Vida Silvestre Barra del Colorado”, fue creado mediante Decreto Ejecutivo No. 16358-MAG publicado en La Gaceta No. 141 del 26 de julio de 1985; es decir, el área silvestre protegida se creó hace 41 años por medio de un acto administrativo válido emitido por el Poder Ejecutivo. El Plan de Manejo de las Áreas Silvestres Protegidas (ASP) es el instrumento orientador para una efectiva administración y manejo de los elementos naturales presentes en dichas áreas y de la dinámica socio ambiental ligada a éstos. Además, es la herramienta técnica por medio de la cual se establece las directrices de manejo para el uso y protección de estos elementos naturales. El Plan de Manejo es el instrumento de planificación que permite orientar la gestión de un área silvestre protegida hacia el cumplimiento de sus objetivos de conservación a largo plazo. Se fundamenta en líneas de acción estratégicas a mediano plazo y en objetivos de manejo para los elementos naturales y culturales incluidos dentro del área, así como en la relación de estos últimos con su entorno socio ambiental. Es la base para el desarrollo de otros instrumentos de planificación y reglamentación de las Áreas Silvestres Protegidas. (Reglamento a la Ley de Biodiversidad, Art.3, Inc. p) Debe notarse que el objetivo de la declaratoria y mantenimiento de esos espacios de protección encuentra fundamento en el cumplimiento de los compromisos dispuestos en algunos instrumentos internacionales como la Convención para la Protección de la Flora, Fauna y Bellezas Escénicas Naturales de los Países de América (ratificada mediante la Ley no. 3763 de 19 de octubre de 1966) y el Convenio sobre Diversidad Biológica y sus anexos (ratificado mediante la Ley no. 7416 de 30 de junio de 1994), que plantean la necesidad de que los Estados constituyan y protejan espacios naturales protegidos. Esta posición del Estado ha sido ratificada por la Procuraduría General de la República, en su Dictamen No. 153 del 07 de agosto del 2023. Por otra parte, la validación de estos instrumentos tiene su propia gobernanza que le corresponde al Área de Conservación Tortuguero del SINAC, así como las instancias oficiales de participación social establecidas en ellas, sean estas los Consejos Regionales y Comités Locales, de conformidad con la Ley de Biodiversidad No. 7788. Para el caso específico de elaboración de un Plan de Manejo, el Consejo Nacional de Áreas de Conservación (CONAC), aprobó el procedimiento por medio del \"Manual de Procedimientos para la Publicación de los Planes de Manejo de las Áreas Silvestres Protegidas del Sistema Nacional de Áreas de Conservación\", mediante Acuerdo No. 17, tomado en Sesión Extraordinaria No. 06-2008 del 04 de agosto del 2008, y con base en ello el Área de Conservación Tortuguero inició el proceso de elaboración del primer Plan de Manejo en el año 2008, es decir hace 18 años. Para ello, el Comité Técnico del Área de Conservación Tortuguero aprueba el Plan de Manejo, según Acuerdo No. 2 de la minuta de reunión del 17 de junio del 2009, y posteriormente, pasa a aprobación del Consejo Regional del Área de Conservación Tortuguero (CORACTO), mediante Acuerdo No. 3 del 18 de junio del 2009, para luego pasar al CONAC , quien lo aprobó, mediante No. 16 de la Sesión Ordinaria No. 11-2009 del 23 de noviembre del 2009, lo que determina que este instrumento tenga 17 años de aprobación, bajo los mecanismos legales de gobernanza formalmente establecidos a nivel de Ley de Biodiversidad. Asimismo, mediante la Resolución No. R-SINAC-CONAC-024-2017, el Consejo Nacional de Áreas de Conservación, de conformidad con el Acuerdo No. 33 adoptado en la Sesión Ordinaria No. 09-2017, celebrada el 25 de setiembre de 2017, y en cumplimiento de lo dispuesto en el artículo 12, inciso d), del Reglamento a la Ley de Biodiversidad No. 7788, Decreto Ejecutivo No. 34433-MINAE, aprobó y emitió la “Actualización del Plan de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado”, la cual fue publicada en el Alcance No. 144 a La Gaceta No. 148, de fecha 16 de agosto de 2018. Por consiguiente, no es de recibo pretender que un acto administrativo valido, vigente y en ejecución como lo es un Plan de Manejo relacionado a recursos naturales, se retrotraiga en sus efectos jurídicos para realizar una “consulta” a una población tribal que no está oficialmente identificada por los mecanismos del Estado como tampoco se identifican actividades ancestrales como las que se mencionan en el escrito de solicitud. No existe una gestión por parte de la Asociación de Desarrollo Integral de Cahuita, como representante oficial del Foro Tribal que formule una petición en favor de algún grupo específico sobre un tema asociado a la Convención 169. Incluso, es de mérito aclarar que en el área que comprende el Refugio tampoco se identifican poblaciones indígenas que consultar, lo que hace presumir que se está partiendo de supuestos y no de hechos concretos. Cabe indicar que, para la elaboración de los planes de manejo de las Áreas Silvestres Protegidas, la metodología oficialmente establecida por SINAC contempla la realización de un mapeo integral de actores. En el marco de todos los procesos de mapeo efectuados desde el 2000 hasta la fecha, no se ha identificado, en ningún momento, la existencia de un grupo tribal dentro del Área de Conservación Tortuguero. En particular, el último mapeo de actores correspondiente al Refugio Nacional de Vida Silvestre Barra del Colorado, concluido en marzo de 2023, no registró ni identificó actor alguno que corresponda a un grupo tribal. Conforme lo dispone la Resolución No. 06 del 26 marzo del 2012 del Consejo Nacional de Áreas de Conservación, publicada en el Diario Oficial La Gaceta, el Plan de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado ha sido oficializado y tiene los siguientes objetivos, los cuales evidencia que no tienen ninguna relación con poblaciones tribales. “c) Objetivos de Conservación del Refugio Nacional de Vida Silvestre Barra del Colorado Objetivos Primarios • Conservar muestras de ecosistemas representativos del caribe norte costarricense. • Proteger hábitats de interés particular existentes en el área silvestre protegida, especialmente acuáticos. • especies de flora y fauna sobresalientes, endémicas y en peligro de extinción que habitan en el área protegida y alrededores. • Proteger los recursos paisajísticos. Objetivos Secundarios • Mantener procesos evolutivos y conservar recursos genéticos e hídricos. • Suministrar oportunidades para las actividades recreativas, turísticas, de educación ambiental y de investigación. • Favorecer el manejo sostenible de los recursos naturales que contribuyan al desarrollo socio - económico de la región caribe norte costarricense.” En el área de este Refugio no se identifican usos relacionados a “posesiones históricas y ancestrales; prácticas culturales, sociales y económicas tradicionales, actividades de pesca artesanal y tradicional; actividades de cabotaje tradicional y navegación local histórica, actividades culturales afrodescendientes” que son los argumentos alegados para tratar de justificar el tema de la consulta pública. De igual forma, no existe ninguna afectación a “derechos colectivos de la población tribal afrodescendiente”, ya que el objetivo del Plan de Manejo no esta dirigido a estos fines, sino a la conservación de los elementos naturales en un área geográfica en la cual no se identifican poblaciones tribales. El tema de la aplicabilidad del artículo 14 del Convenio 169 con relación a las áreas silvestres protegidas, ya fue consultado por el MINAE a la Procuraduría General de la República, en su Dictamen No. 153 del 07 de agosto del 2023 claramente ha expresado la posición legal del Estado en este tema, cuando indica: “III. POSIBILIDAD DE AUTORIZAR ACTIVIDADES TRADICIONALES INDÍGENAS EN ÁREAS SILVESTRES PROTEGIDAS. Retomando lo expuesto en el primer apartado, resulta claro que la segunda disposición del artículo 14.1 del Convenio 169 de la OIT no establece un mandato directo a los Estados signatarios a adoptar medidas específicas. Sino que, de esa disposición, se entiende que cada Estado debe valorar y determinar si existen casos o supuestos en los que se presente la necesidad de adoptar medidas tendientes a garantizar el derecho de los pueblos indígenas a utilizar otras tierras, además de las que ocupan tradicionalmente, para el desarrollo de actividades tradicionales y de subsistencia. Y, en caso de que se constate que, efectivamente, existen pueblos indígenas que, para el desarrollo de sus actividades utilizan otras tierras aparte de las que ocupan, deben adoptarse las medidas pertinentes para proteger su derecho a continuar utilizándolas. Según la apreciación de la Sala Constitucional, en nuestra legislación interna se ha reconocido el derecho de los pueblos indígenas a ocupar los terrenos que tradicionalmente han poseído, pues se reservaron importantes porciones de su territorio, tratando de evitar que se inscribieran como propiedad privada de otros y se les permitió explotar los recursos naturales dentro de sus territorios. Ahora bien, como se dijo, no existe un desarrollo normativo que haga suponer que el Estado ha determinado que existen casos apropiados en los que es necesario adoptar medidas para salvaguardar el derecho de los pueblos indígenas a utilizar otras tierras, aparte de las que ocupan tradicionalmente, para el desarrollo de sus actividades tradicionales o de subsistencia. Y, en consecuencia, tampoco existe un desarrollo normativo sobre cuáles pueden ser esas medidas ni la forma en la que deben adoptarse. De tal modo, si no existe una previsión general que determine que existen esos casos que hacen necesaria la adopción de otro tipo de medidas distintas a las existentes y que establezca el tipo de acciones que puede adoptar el Estado para salvaguardar el derecho de los pueblos indígenas a desarrollar sus actividades tradicionales y de subsistencia en otros terrenos, aparte de los que ocupan tradicionalmente, no podría concluirse que el Sistema Nacional de Áreas de Conservación debe adoptar medidas para permitir el desarrollo de ese tipo de actividades en las áreas silvestres protegidas. Como ya se abordó en el apartado precedente, las áreas silvestres protegidas forman parte del patrimonio natural del Estado, y, en esa condición, en ellas no pueden autorizarse otras actividades distintas a las señaladas en el artículo 18 de la Ley Forestal. De ahí que, en esos espacios no podrían autorizarse actividades tradicionales indígenas que sean distintas a las señaladas en esa disposición. La autorización de actividades indígenas tradicionales distintas a las permitidas por el régimen actual, requeriría la emisión de una disposición legal que así lo disponga y que, en atención a los principios de objetivación de la tutela ambiental, razonabilidad y proporcionalidad antes desarrollados, cuente con la justificación técnica adecuada que acredite la necesidad de adoptar ese tipo de medidas. Si bien es cierto, el artículo 58 de la Ley de Biodiversidad dispone que al constituirse un área silvestre protegida debe tomarse “muy en cuenta los derechos previamente adquiridos por las poblaciones indígenas o campesinas y otras personas físicas o jurídicas, subyacentes o adyacentes a ella”, eso no hace suponer que, una vez constituida, deban permitirse actividades indígenas contrarias a las permitidas por el régimen aplicable a las áreas silvestres protegidas antes expuesto. Esa disposición es acorde con la diferencia existente en la naturaleza jurídica de las reservas indígenas y de las áreas silvestres protegidas y, en general, del patrimonio natural del Estado. Jurídicamente, el régimen del patrimonio natural del Estado y el de los territorios indígenas es incompatible. El patrimonio natural del Estado es de dominio público, y, por tanto, contrapuesto al régimen de las reservas indígenas, que constituyen un régimen de propiedad privada colectiva, exclusivas para las comunidades indígenas que las habitan, inscritas en el Registro Público de la Propiedad Inmueble a nombre de la Asociación de Desarrollo Integral que las representan. (Véase el dictamen no. PGR-C-253-2021 de 6 de setiembre de 2021). Esa diferencia ha sido señalada por la Sala Constitucional, al indicar que: “El régimen jurídico de protección de la propiedad de las Áreas Silvestres Protegidas y las Reservas Indígenas son distintas (…) En consecuencia, jurídicamente no sería posible que un espacio territorial sea simultáneamente de dominio público estatal -patrimonio natural del Estado- y reserva indígena, y por ello, al ser regímenes contrapuestos, resulta necesario que, al crearse un área silvestre protegida no se lesione el derecho de los pueblos indígenas a ocupar los terrenos que han habitado tradicionalmente y que, por tanto, deba ser considerado como un territorio indígena. Y, en orden a la incompatibilidad de actividades tradicionales indígenas distintas a las permitidas por el régimen propio de las áreas silvestres protegidas, en ese último voto citado, la Sala Constitucional señaló: (…) El fundamento jurídico expresado por la Procuraduría General de la República y por la Sala Constitucional, indica con claridad el régimen jurídico que le aplica a las áreas silvestres protegidas, de ahí que resulte improcedente lo solicitud de realizar una consulta pública a una población tribal no identificada con base en los Convenios Nos. 107 y 169, sobre un Plan de Manejo que tiene como fin regular la gestión de los recursos naturales en un área específica, pretendiendo que con la petitoria extrapolar los efectos jurídicos a partir de una supuesta afectación de derechos a una población tribal y actividades culturales y artesanales que resultan ser inexistentes dentro de este territorio protegido, por lo que no existe una relación causal que justifique la solicitud. Desaplicar un instrumento de planificación legalmente válido retrotrayendo sus efectos sin ningún fundamento legal es legislar en contra del Principio de Legalidad que regula la administración pública. El Refugio Nacional de Vida Silvestre Barra del Colorado está legalmente constituido, su gobernanza es legítima y sus instrumentos de planificación son legalmente validados y eficaces, por lo que no existe ninguna razón para desaplicar el Plan de Manejo. Actuar sin dimensionar los alcances de tal decisión causaría un efecto negativo sobre la protección ambiental de la zona, violentando el artículo 50 constitucional. Es valido aclarar, que las disposiciones de la Sala Constitucional con relación a la consulta previa basada en el Convenio 169, tuvieron objetivos específicos en conexión con un interés directo, que no aplican al presente caso: a) consultar Plan Regulador Costero del Distrito de Cahuita del Cantón de Talamanca a los habitantes del Territorio Indígena de Keköldi por considerar que ese territorio indígena forma una unidad con la línea costera que se busca regular, pues se trata de zonas adyacentes continuas (Voto No. 2023-031756 de las 9:30 horas del 7 de diciembre de 2023) b) consultar el Plan Regulador Costero del Caribe a los pobladores de Cahuita, Puerto Viejo y Manzanillo ya que podrían resultar afectados por el cobro de cánones, desalojos y demolición de viviendas a esa población. (Voto No. 2025-029985 del 19 de septiembre de 2025)” (ver el informe rendido y la prueba aportada).\n\nd) Mediante oficio no. MLV-0051-2026 del 09 de febrero de 2026, el recurrente presentó una gestión ante el viceministro de Ambiente, en donde solicitó lo siguiente: “Asunto: Réplica y refutación al oficio DVA-017-2026 de fecha 9 de febrero de 2026, por violación a los Convenios 107 y 169 de la OIT y a la jurisprudencia vinculante de la Corte Interamericana de Derechos Humanos (…) me dirijo a usted de manera respetuosa pero firme para replicar y refutar el oficio DVA-017-2026 de fecha 9 de febrero de 2026, en el que se ratifica la omisión de consulta previa en relación con el Plan General de Manejo y demás instrumentos reguladores del Refugio Nacional de Vida Silvestre Barra del Colorado (RNVS-BC) (…) El oficio impugnado incurre en graves omisiones y errores interpretativos que invisibilizan la presencia histórica de poblaciones afrodescendientes en el Caribe norte costarricense, violando obligaciones internacionales de rango supraconstitucional conforme al artículo 7 de la Constitución Política (…) I. Antecedentes y Contexto En mi nota MLV-0032-2026 del 25 de enero de 2026, solicité la suspensión del Plan General de Manejo del RNVS-BC y la realización de consulta previa conforme a los Convenios 107 y 169 de la OIT, dada la presencia de comunidades afrodescendientes con prácticas ancestrales como la pesca artesanal, navegación tradicional y cabotaje. El oficio DVA-017-2026 responde negando la existencia de “población tribal identificada” en el área, basándose en mapeos de actores del SINAC que supuestamente no registraron tales grupos. Esta afirmación carece de fundamento técnico y jurídico, ignorando evidencias históricas y la jurisprudencia de la Corte IDH (…) V. Petitorio Solicito: 1. Anular el oficio DVA-017-2026 por inconvencionalidad. 2. Suspender inmediatamente la aplicación del Plan General de Manejo y demás instrumentos hasta realizar consulta previa, libre, informada y culturalmente adecuada con comunidades afrodescendientes, representadas por el Foro Tribal y la Asociación de Desarrollo Integral de Cahuita. 3. Oficializar mecanismos de consulta conforme al Convenio 169, cumpliendo votos de la Sala Constitucional como N.° 2023- CED01 N.° 2025-029985. 4. Iniciar investigación interna por omisiones y remitir al Ministerio Público. 5. Responder por escrito en un plazo de 10 días hábiles, adjuntando pruebas de mapeos y criterios étnicos” (ver el informe rendido y la prueba aportada).\n\ne) Mediante oficio no. DVA-022-2026 del 23 de febrero de 2026, el viceministro de Ambiente le respondió al recurrente lo siguiente: “En atención a su nota MLV-0051-2026 del 09 de febrero de 2026, mediante la cual replica y refuta el oficio DVA-017-2026 de fecha 9 de febrero de 2026, con relación al Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado, me permito indicarle lo siguiente: Los argumentos que usted expone en la presente nota son reiterativos de los contenidos en su anterior consulta MLV-0032-2026 del 25 de enero de 2026; y, por consiguiente, no se aporta nada adicional que amerite modificar la respuesta que ya se le ha brindado en la nota DVA-017-2026, en donde expresamente se le indicó que en el área del Refugio Nacional de Vida Silvestre Barra del Colorado no se registra ni identifica a ningún actor que corresponda a un grupo tribal o indígena. De igual forma, se le reitera que dentro de este Refugio no se realiza ningún uso relacionado a “posesiones históricas y ancestrales; prácticas culturales, sociales y económicas tradicionales, actividades de pesca artesanal y tradicional; actividades de cabotaje tradicional y navegación local histórica, actividades culturales afrodescendientes”. Nuevamente se le informa que la actualización del Plan de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado fue publicada en el Alcance No. 144 a La Gaceta No. 148, de fecha 16 de agosto de 2018; y que no se tiene ninguna solicitud relacionada al Plan de Manejo por parte de la Asociacion de Desarrollo Integral de Cahuita, como representante oficial de los pueblos tribales; por consiguiente, sus peticiones son improcedentes y carentes de legitimación. Unido a lo anterior, se le reitera lo indicado por la Sala Constitucional en la resolución No. 2005-9680, de las nueve horas con treinta minutos del veintidós de julio del año dos mil cinco, cuando expresa: “VI.- En este caso se está ante un típico abuso del derecho de petición, lo que se ha denominado un \"derecho de petición abusivo\", ello en razón de que al recurrente se le ha contestado lo que en el fondo es una misma petición, en multiplicidad de oportunidades. No resulta amparable el ejercicio abusivo de un derecho, vale decir aquel ejercicio que contraríe los fines que se tuvo en mira al reconocerlo, o que exceda los límites impuestos por la buena fe, la moral y las buenas costumbres. Es el criterio de esta Sala que la Defensoría de los Habitantes ha sido suficientemente diligente al contestarle de manera reiterada al recurrente lo solicitado. Recuérdese que el derecho de petición consagra el derecho a que se le conteste, lo que no significa que se conteste lo deseado, o que uno tenga que estar de acuerdo con lo contestado. De ahí que, no constatándose la violación al Derecho de Petición que menciona el reclamante, se impone desestimar el presente recurso” (ver el informe rendido y la prueba aportada).\n\nIII.- Aclaración. En el presente recurso de amparo, el recurrente reclama específicamente la falta de respuesta adecuada a su oficio no. MLV-0032-2026 del 27 de enero de 2026 y a su oficio no. MLV-0051-2026 del 09 de febrero de 2026, los cuales fueron contestados mediante oficio DVA-017-2026 y mediante oficio DVA-022-2026, respectivamente. Así, si bien es cierto las gestiones del recurrente iniciaron con el oficio no. MLV-0011-2026, el cual fue contestado mediante oficio no. DVA-003-2026 del 26 de enero de 2026, lo cierto es que el recurrente no reclama ningún punto referente a ese oficio y ni siquiera lo presentó como prueba, a pesar de que se le previno de que aportara las gestiones que considera no le han sido debidamente respondidas. Por ende, este Tribunal no se referirá sobre ese primer oficio (oficio no. MLV-0011-2026) ni la respuesta otorgada al recurrente, analizando únicamente las gestiones que la parte recurrente reclama, como serían su oficio no. MLV-0032-2026 del 27 de enero de 2026 y a su oficio no. MLV-0051-2026 del 09 de febrero de 2026 y las respuestas dadas a esas solicitudes. \n\nPor consiguiente, se pasará a analizar las consultas puntuales formuladas por la parte amparada y las respuestas brindadas por la parte recurrida, con el fin de determinar si cada una de estas fueron atendidas o no íntegramente, según lo requerido. \n\nReferente al oficio no. MLV-0032-2026 del 27 de enero de 2026:\n\nLo requerido\n\nResulta o no amparable lo requerido\n\nFue o no atendido lo solicitado \n\n“SOLICITO FORMALMENTE, en protección y beneficio de la población tribal afrodescendiente de Limón, que se inapliquen y suspendan los efectos jurídicos del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado, así como de cualquier proceso de modificación o actualización del mismo (…) La presente solicitud no persigue la nulidad general del Plan, sino la inaplicación parcial y suspensión de efectos respecto de la población tribal afrodescendiente, hasta tanto se realice válidamente la consulta previa”.\n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se inapliquen o se suspendan los los efectos jurídicos del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado.\n\n \n\nNo aplica. \n\n“SOLICITO que el Ministerio de Ambiente y Energía active de inmediato el mecanismo de consulta previa, libre e informada, en el estado actual del Plan General de Manejo, y que se suspenda su aplicación respecto de la población afrodescendiente hasta la conclusión válida del proceso de consulta”.\n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se aplique mecanismos de consulta sobre el estado actual de dicho Plan.\n\n \n\nNo aplica. \n\n“SOLICITO DE MANERA EXPRESA que el proceso de consulta previa abarque integralmente: 1. El Plan General de Manejo en su versión vigente y futuras actualizaciones; y 2. El Diagnóstico para su actualización elaborado en el año 2016, por constituir la base técnica y conceptual del Plan y producir efectos materiales determinantes”.\n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se aplique mecanismos de consulta (y sus temas) sobre el estado actual de dicho Plan.\n\n \n\nNo aplica. \n\n“PLANTEO LAS SIGUIENTES PRETENSIONES Y CONSULTAS, las cuales requieren pronunciamiento expreso, claro y motivado: (…) 2. Que se mantenga suspendida la aplicación del Plan General de Manejo respecto de la población afrodescendiente hasta que concluya válidamente la consulta previa”.\n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se inapliquen o se suspendan los los efectos jurídicos del Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado.\n\n \n\nNo aplica. \n\n“PLANTEO LAS SIGUIENTES PRETENSIONES Y CONSULTAS, las cuales requieren pronunciamiento expreso, claro y motivado: (…) 3. Que se ordene la activación inmediata del mecanismo de consulta previa respecto del Plan y del Diagnóstico 2016”.\n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se aplique mecanismos de consulta sobre el estado actual de dicho Plan.\n\n \n\nNo aplica. \n\n“4. ¿Reconoce el MINAE que el Plan General de Manejo y el Diagnóstico 2016 son medidas administrativas susceptibles de afectar derechos colectivos de la población tribal afrodescendiente?”.\n\nSí es amparable.\n\nSí, se le contestó mediante oficio no. DVA-017-2026 del 09 de febrero de 2026, notificado previo a la interposición del presente amparo. Así, se le indicó que “(…) no existe ninguna afectación a “derechos colectivos de la población tribal afrodescendiente”, ya que el objetivo del Plan de Manejo no está dirigido a estos fines, sino a la conservación de los elementos naturales en un área geográfica en la cual no se identifican poblaciones tribales”.\n\n“5. ¿Reconoce el MINAE que la consulta previa es un deber estatal oficioso, que no depende de solicitud previa?”.\n\nNo es amparable, pues no se trata propiamente de una solicitud de información, sino que es una gestión que requiere criterios institucionales sobre posibles actuaciones a futuro.\n\nNo aplica.\n\n“6. ¿Qué acción concreta adoptará el MINAE para cumplir la consulta previa, indicando acto administrativo, dependencia responsable y plazo de inicio?”.\n\nNo es amparable, pues no se trata propiamente de una solicitud de información, sino que es una gestión que requiere criterios institucionales sobre posibles actuaciones a futuro.\n\nNo aplica.\n\n“7. ¿Mantendrá el MINAE suspendida la aplicación del Plan mientras no se concluya válidamente la consulta?”.\n\nNo es amparable, pues no se trata propiamente de una solicitud de información, sino que es una gestión que requiere criterios institucionales sobre posibles actuaciones a futuro.\n\nNo aplica.\n\n“8. ¿Reconoce el SINAC que le corresponde ejecutar materialmente el proceso de consulta previa como administrador del Refugio?”.\n\nNo es amparable, pues no se trata propiamente de una solicitud de información, sino que es una gestión que requiere criterios institucionales sobre posibles actuaciones a futuro.\n\nNo aplica.\n\n“9. ¿Reconoce el SINAC que no se ha realizado consulta previa respecto del Plan ni del Diagnóstico 2016?”.\n\nNo es amparable, pues no se trata propiamente de una solicitud de información, sino que es una gestión que requiere criterios institucionales sobre posibles actuaciones a futuro.\n\nNo aplica.\n\n“10. ¿Qué acciones concretas desarrollará el SINAC para convocar y ejecutar la consulta previa, indicando metodología y cronograma?”.\n\nNo es amparable, pues no se trata propiamente de una solicitud de información, sino que es una gestión que requiere criterios institucionales sobre posibles actuaciones a futuro.\n\nNo aplica.\n\n“11. ¿Se compromete el SINAC a no aplicar restricciones ni sanciones derivadas del Plan respecto de la población afrodescendiente mientras no se realice la consulta?”.\n\nNo es amparable, pues no se trata propiamente de una solicitud de información, sino que es una gestión que requiere criterios institucionales sobre posibles actuaciones a futuro.\n\nNo aplica.\n\n \n\n \n\nReferente al oficio no. MLV-0051-2026 del 09 de febrero de 2026:\n\nLo requerido\n\nResulta o no amparable lo requerido\n\nFue o no atendido lo solicitado \n\n“(…) me dirijo a usted de manera respetuosa pero firme para replicar y refutar el oficio DVA-017-2026 de fecha 9 de febrero de 2026, en el que se ratifica la omisión de consulta previa en relación con el Plan General de Manejo y demás instrumentos reguladores del Refugio Nacional de Vida Silvestre Barra del Colorado (RNVS-BC).”\n\nNo es amparable, pues no se trata de una solicitud de información, sino de una disconformidad con la respuesta otorgada por medio del oficio DVA-017-2026.\n\nNo aplica. \n\n“Solicito: 1. Anular el oficio DVA-017-2026 por inconvencionalidad (…)”.\n\n \n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se anule el oficio DVA-017-2026.\n\n \n\nNo aplica. \n\n“2. Suspender inmediatamente la aplicación del Plan General de Manejo y demás instrumentos hasta realizar consulta previa, libre, informada y culturalmente adecuada con comunidades afrodescendientes, representadas por el Foro Tribal y la Asociación de Desarrollo Integral de Cahuita”.\n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se suspenda la aplicación del Plan General de Manejo.\n\n \n\nNo aplica. \n\n“3. Oficializar mecanismos de consulta conforme al Convenio 169, cumpliendo votos de la Sala Constitucional como N.° 2023- CED01 N.° 2025-029985”\n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se oficialice los mecanismos de consulta. Nótese que en el oficio anterior (oficio DVA-017-2026, oficio que en esta nota el recurrente replica), la autoridad recurrida le explicó al recurrente porque no procede la consulta solicitada. \n\n \n\nNo aplica. \n\n“4. Iniciar investigación interna por omisiones y remitir al Ministerio Público”\n\nNo es amparable, pues se trata de una excitativa para que se actúe de una determinada forma, en el sentido de que se realice una investigación interna.\n\nNo aplica. \n\n \n\n \n\nIV.- Sobre al oficio no. MLV-0032-2026 del 27 de enero de 2026. Después de analizar los elementos probatorios aportados, este Tribunal verifica que no ha existido violación a los derechos fundamentales del recurrente en cuanto a este punto. Lo anterior, porque, según lo indicado en el cuadro anterior, ha sido debidamente acreditado que la gran mayoría de consultas realizadas por el recurrente en el oficio no. MLV-0032-2026 del 27 de enero de 2026 corresponden a excitativas para que la administración actúe de cierta forma referente al Plan General de Manejo del Refugio Nacional de Vida Silvestre Barra del Colorado o gestiones que requieren criterios institucionales sobre posibles actuaciones a futuro. Por consiguiente, dichas gestiones no resultan tutelables vía amparo, dado que va más allá de la normativa aplicable y no se ajusta al contenido de una solicitud de información ni al derecho de petición propiamente.\n\nAhora bien, tal y como se explica en el cuadro anterior, sí existió un punto en la gestión que sí es amparable al solicitar información pública, siendo este el punto 4, pero se comprueba que ese apartado de la solicitud fue debidamente respondido. Así, el reclamo del recurrente es una disconformidad con esa respuesta. Por ende, si el recurrente está en desacuerdo con lo respondido, podrá -si a bien lo tiene- presentar sus reclamos en la vía ordinaria.\n\nPor consiguiente, respecto a las respuestas otorgadas a dicho oficio, se descarta lesión alguna a los derechos fundamentales del recurrente. \n\nV.- Sobre al oficio no. MLV-0051-2026 del 09 de febrero de 2026. Respecto a este oficio, tampoco se denota una lesión a los derechos fundamentales del recurrente. Lo anterior, ya que, tal y como se explica en el cuadro anterior, las gestiones de dicho oficio corresponden a excitativas para que la administración actúe de cierta forma referente a su solicitud de consulta sobre el tema. Nótese que en el oficio anterior (oficio DVA-017-2026, oficio que en esta nota el recurrente replica), la autoridad recurrida le explicó al recurrente porque no procede la consulta solicitada, sin embargo, el recurrente continúa disconforme con esas respuestas. Por ende, se le reitera lo indicado en el considerando anterior, respecto a que, si el recurrente está en desacuerdo con lo respondido, podrá -si a bien lo tiene- presentar sus reclamos en la vía ordinaria.\n\nEn síntesis, respecto a este oficio, también se descarta lesión alguna a los derechos fundamentales del recurrente. \n\nVI.- Conclusión. En virtud de lo expuesto, lo que procede es declarar sin lugar el recurso en todos sus extremos. \n\nVII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "Review of the Document\n\n\n\nExp: 26-006587-0007-CO\n\nRes. Nº 2026031920\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 20 August 2026.\n\nAmparo proceeding filed by Nombre02, identity card CED02, against the MINISTRY OF ENVIRONMENT AND ENERGY.\n\nBackground:\n\n1.- In a brief received by the Chamber’s Secretariat on 24 February 2026, the applicant files an amparo proceeding against the MINISTRY OF ENVIRONMENT AND ENERGY and states that he is an older adult and an active member of the Afro-descendant community of the Costa Rican Caribbean, with a legitimate and profound historical, cultural, social, and spiritual interest in the protection and sustainable management of the coastal territories and protected areas on the Atlantic slope, particularly the Barra del Colorado National Wildlife Refuge, an area of high ecological value and potential cultural relevance to the ancestral practices of the region’s Afro-descendant communities. He states that he has sent the Vice Ministry of Environment and Energy several formal requests concerning the General Management Plan for the Barra del Colorado National Wildlife Refuge, specifically requesting detailed, technical, and documented information on: “* Whether the historical and ancestral occupations of Afro-descendant communities in the Refuge area are recognized. * The existence of traditional cultural, social, and economic practices, artisanal fishing, historical local navigation, and Afro-descendant cultural activities within the Refuge. o The specific measures adopted (or not adopted) by MINAE/SINAC to protect and make visible these cultural rights under the Refuge’s management regime. * Technical, anthropological, historical, or cultural-mapping studies conducted or underway concerning the ancestral value of the territory.” He reports that on 25 January 2026 he submitted letter MLV-0032-2026. On 9 February 2026 he received a response by means of official letter DVA-017-2026, which was manifestly insufficient, partial, and tangential. On that same 9 February 2026, he replied by means of letter MLV-0051-2026, rebutting the omissions point by point and requesting complete information. On 23 February 2026 he received official letter DVA-022-2026, by which the respondent states the following: “* It characterizes his requests as ‘repetitive’ and ‘an abuse of the right to petition,’ citing a 2005 Constitutional Chamber ruling (2005-9680). * It categorically and without evidentiary support asserts that ‘no actor corresponding to a tribal or Indigenous group is recorded or identified in the Barra del Colorado National Wildlife Refuge area’ and that ‘no use related to historical and ancestral occupations; traditional cultural, social, and economic practices; artisanal and traditional fishing activities; traditional coastal navigation and historical local navigation; or Afro-descendant cultural activities takes place.’ * It declares his petitions ‘inadmissible and lacking standing.’ * It merely refers him to the Management Plan published in 2018, without providing any updated data, study, or evidence to support its assertions.” On that same 23 February 2026, the Presidency of the Legislative Assembly, by means of official letter AL-PRES-RAS-198- 25/26 addressed to him, expressly acknowledged that “there is no official identification of which Afro-descendant communities should be considered collective subjects for purposes of a potential mandatory consultation,” and that there is no institutional registry representing them, and that technical-scientific studies of ancestral territories fall within the remit of the Executive Branch (MINAE and technical entities). “This official State document directly contradicts the Vice Minister’s position and demonstrates the structural omission of the respondent body itself.” For these reasons, he requests the following: “a) Admit this amparo proceeding, process it with the speed required by the matter, and grant it the procedure prescribed by law. b) Uphold the application and, consequently: 1. Declare that Ing. Jorge Mario Rodríguez Zúñiga and the Vice Ministry of Environment have violated my fundamental rights of access to public information, petition, cultural identity, and a healthy environment. 2. Order, within a maximum period of 48 hours from notification, the delivery of a complete, detailed, documented, and reasoned response to all questions posed in my official letters, including every existing study, map, technical report, record, or data—or any that must be generated—concerning Afro-descendant cultural values in the Barra del Colorado National Wildlife Refuge. 3. Order them to refrain from characterizing my petitions as abusive or inadmissible while the legitimate public and personal interest persists. 4. Order such interim measures as it deems appropriate to prevent the continued obstruction of information. c) Notify the Ministerio Público, the Procuraduría General de la República, and the Minister’s Office of MINAE. d) Order payment of costs, if warranted by law.”\n\n2.- By resolution issued at 14:45 on 05 March 2026, this Court issued the order initiating proceedings in this matter.\n\n3.- Jorge Mario Rodríguez Zúñiga, in his capacity as Vice Minister of Environment and Energy, submits a sworn report (report submitted on 10 March 2026) in the following terms: “I. FACTS Facts alleged by the applicant. ‘FIRST: That he is an older adult and an active member of the Afro-descendant community of the Costa Rican Caribbean, with a legitimate interest in protecting the Barra del Colorado National Wildlife Refuge. SECOND: That by letter MLV-0032-2026 dated 25 January 2026, he formally requested from this Vice Ministry: a) suspension of the Refuge’s General Management Plan; b) activation of the prior, free, and informed consultation mechanism pursuant to ILO Conventions 107 and 169; c) that said consultation include the 2016 Diagnosis; and d) responses to a series of specific questions concerning recognition of the rights of Afro-descendant communities in the area. THIRD: That by official letter DVA-017-2026 dated 09 February 2026, this Office responded, indicating that the Management Plan is a valid and final administrative act, that no tribal population has been identified in the Refuge according to SINAC’s official mapping, and that the legal representative of the Tribal Forum (ADIC) has taken no action in this regard. FOURTH: That by letter MLV-0051-2026 dated 09 February 2026, the applicant replied and rebutted the previous response, presenting arguments based on case law of the Inter-American Court of Human Rights and reiterating his requests. FIFTH: That by official letter DVA-022-2026 dated 23 February 2026, this Office reiterated the arguments set out in the previous official letter, indicating that the applicant’s submissions were repetitive and lacked standing, and citing case law of that Honorable Chamber concerning abuse of the right to petition (Resolution N.°2005-9680). SIXTH: That the applicant attaches to his amparo application official letter AL-PRES-RAS198-25/26 from the Legislative Assembly, from which he seeks to infer a contradiction in the State’s position. II. LEGAL CONSIDERATIONS: FIRST: On the nature of the Amparo Proceeding. The amparo proceeding is a judicial process conducted before the Constitutional Chamber and constitutes what is known as the constitutional jurisdiction of liberty; its existence guarantees the effectiveness of the fundamental rights established in the Political Constitution and in the international human rights treaties in force in the country. Article 29 of the Constitutional Jurisdiction Act provides that the amparo proceeding guarantees the fundamental rights and freedoms to which that Act refers, except those protected by habeas corpus. It further provides that it lies against any provision, agreement, or resolution and, generally, against any action, omission, or mere material conduct not founded on an effective administrative act, by public servants and bodies, that has violated, violates, or threatens to violate any of those rights. It lies not only against arbitrary acts, but also against conduct or omissions based on rules that have been erroneously interpreted or improperly applied. SECOND: On the applicable constitutional framework. In the Costa Rican legal system, the Amparo Proceeding derives from Articles 10 and 48 of the Political Constitution, which establish that every person has the right to amparo to maintain or restore the enjoyment of rights enshrined in the Constitution, as well as fundamental rights established in international human rights instruments applicable in the Republic. This body of law contains an entire title establishing a series of individual rights and guarantees, such as the right to life in Article 21, the right to privacy, liberty, and secrecy of communications in Article 24, the right to equality established in Article 33, the right of consumers and users to environmental protection in Article 46, and, among the social rights and guarantees, the right to a healthy and ecologically balanced environment and the corresponding State duty to protect it in Article 50, as well as the State duty to protect natural beauty. III In relation to what this Honorable Chamber ordered: ‘To submit a report within the THREE BUSINESS DAYS following notification of this resolution,’ in compliance with what this Honorable Chamber ordered in its resolution issued at 14:45 on 05 March 2026, I hereby submit this report under oath in the following terms: FIRST: On the response provided by official letters DVA-017-2026 and DVA-022-2026. This Office, in strict adherence to the principle of legality governing public service, has responded in a timely manner and in writing to each submission made by the applicant. In official letter DVA-017-2026, he was clearly informed of the reasons why the consultation request was inadmissible, taking into account that the administrative act is final. The applicant was informed that suspension is not appropriate because the Plan is in force and there is no harm to third-party rights; also, no tribal population has been identified in the area according to SINAC’s official mapping, which is a diagnosis, an internal technical input, and not an autonomous administrative act, and therefore is not subject to consultation. Finally, the legal representative of the Tribal Forum (Asociación de Desarrollo Integral de Cahuita), which has authority in these matters, has submitted no request to SINAC. Accordingly, this Vice Ministry provided a response consistent with what was requested, setting out the reasons supporting the Administration’s position. SECOND: On characterizing the submissions as ‘repetitive.’ Official letter DVA-022-2026 was issued in response to letter MLV-0051- 2026. In that letter, the applicant merely repeated the same arguments set out in his previous submission, without providing new elements that would change this Office’s view. The citation to Resolution N.°2005-9680 of that Honorable Chamber was not intended to discredit the applicant, but to illustrate the legal principle that the right to petition is satisfied by a consistent response, which need not necessarily be favorable, and that its abusive or repetitive exercise is not protected. Far from constituting a violation of his rights, he was given a reasoned response reiterating the arguments already set out. THIRD: On the absence of a tribal population in the Barra del Colorado National Wildlife Refuge. This Honorable Chamber should be advised that the assertion in the challenged official letters is neither arbitrary nor unsupported. SINAC, as a specialized technical body, has conducted comprehensive actor-mapping processes in the Tortuguero Conservation Area from 2000 to the present, and no actor corresponding to a tribal group has been recorded or identified. There is therefore no factual basis for finding the presence of tribal communities in the area, much less for finding that ancestral activities such as those described by the applicant take place. FOURTH: On the legal nature of the Management Plan and its approval process. The General Management Plan for the Barra del Colorado National Wildlife Refuge is a planning instrument approved in strict accordance with the legal procedures established in Biodiversity Act N.° 7788 and its regulations. Its first version dates from 2009, and its update was published in Alcance N.° 144 to La Gaceta N.° 148 of 16 August 2018. The applicant’s attempt to have a valid, final administrative act that has been in execution for more than 17 years subjected to a consultation process with retroactive effect not only lacks legal basis, but also undermines the principle of legal certainty and the stability of the State’s environmental management instruments. FIFTH: On the Legislative Assembly’s official letter (AL-PRES-RAS-198- 25/26). As to the official letter issued by the Legislative Assembly, it should be noted that this document does not constitute proof of any omission by this Vice Ministry. On the contrary, that official letter merely acknowledges the factual reality that there is no official registry of Afro-descendant communities as subjects of consultation. This does not mean that this Office has contradicted itself; rather, it confirms that the burden of identifying and establishing the existence of such communities and their ancestral uses cannot be shifted to the Administration on its own initiative, especially when the legal representative of the Tribal Forum (ADIC) has taken no action in this regard. SIXTH: On the absence of a violation of the right to petition. The right to petition enshrined in Article 27 of the Political Constitution does not require the Administration to grant what the person concerned requests; it requires a timely, consistent, and reasoned response. In this case, the applicant has been given responses on two occasions—official letters DVA-017-2026 and DVA-022-2026, which the applicant mentions—in which the reasons why his request is inadmissible were clearly and with reasons explained. There is therefore no violation of his fundamental right to petition, but rather a difference of opinion concerning the merits of the matter, which falls outside the scope of protection of amparo. SEVENTH: The facts set out demonstrate conclusively that this Vice Ministry has at all times responded within the strict limits of its legal and technical powers. REQUEST Accordingly, this report is hereby submitted as requested. It is therefore REQUESTED that the Court note compliance with the order issued by this Honorable Chamber and close the file.’”\n\n4.- In a brief received by the Chamber’s Secretariat on 12 March 2026, the applicant replies to the report and reiterates his arguments.\n\n5.- In a brief received by the Chamber’s Secretariat on 12 March 2026, the applicant replies to the report and reiterates his arguments.\n\n6.- In a brief received by the Chamber’s Secretariat on 23 March 2026, the applicant submits evidence.\n\n7.- In a brief received by the Chamber’s Secretariat on 23 March 2026, the applicant expands his reply. He adds the following: “(…) he formally requested suspension of the General Management Plan for the Barra del Colorado National Wildlife Refuge and immediate activation of the prior, free, and informed consultation mechanism pursuant to ILO Conventions 107 and 169. The responses received (official letters DVA-017-2026 and DVA-022-2026) do not satisfy the right to petition or fulfill the State’s international and constitutional obligations, giving rise to a manifest violation of my fundamental rights and those of the Afro-Costa Rican tribal people who ancestrally inhabit and use the area (…) Although approved in 2018, the General Management Plan is a planning instrument whose continued implementation directly affects the territorial, cultural, and subsistence rights of the tribal people (traditional fishing, use of resources, and environmental governance).”\n\n8.- In a brief received by the Chamber’s Secretariat on 31 March 2026, the applicant submits evidence.\n\n9.- By resolution issued at 15:49 on 18 May 2026, this Court ordered the applicant as follows: “Before deciding what is appropriate in the AMPARO PROCEEDING being conducted in case file No. 26-006587-0007-CO, filed by Nombre02, the applicant shall, within THREE DAYS from notification of this ruling, submit the following: • Complete, legible copies, with the corresponding proof of receipt or email transmission, of the submissions or requests that he states he made to the challenged authority and whose inadequate response he alleges in the petition initiating this proceeding. Likewise, he shall submit any additional evidence supporting his statements. This information is essential to determine what is appropriate under the law. Failure to do so may result in summary rejection of the application (Articles 38 and 42 of the Constitutional Jurisdiction Act). Notify the parties.”\n\n10.- In a brief received by the Chamber’s Secretariat on 20 May 2026, the applicant states the following: “I hereby submit, within the three-day period granted, the following documentation: 1. A complete and legible copy of official letter MLV-0032-2026, with corresponding proof of receipt or transmission. 2. A complete and legible copy of official letter MLV-0051-2026, with corresponding proof of receipt or transmission. 3. A complete and legible copy of official letter DVA-0003-2026. 4. A complete and legible copy of official letter DVA-017-2026. 5. A complete and legible copy of official letter DVA-022-2026. The foregoing documents correspond to the submissions and requests I made to the challenged authority, whose inadequate response prompted the filing of this Amparo Proceeding. I remain available for any additional information this Chamber deems necessary to decide the merits of the matter.”\n\n11.- In a brief received by the Chamber’s Secretariat on 26 May 2026, Ana Aburto Tenorio, Anastacio Cajina Días, Alejandro Cajina Luna, Nubia Mayrena Tucker, Sixta Hernández Jirón, Sergio Guzmán Casto, Carlos Sánchez Espinoza, Betsy Sánchez Guzmán, Ernesto López González, Lidia Ruiz Ramírez, Nombre08, Nombre06, Nombre01, Nombre07, Nombre04, Nombre03, Luis Alberto Castrillo Carillo, Nombre05, Victoria Carillo Carillo, Andrés Jiménez García, and Nombre09 file a supporting intervention in favor of the applicant.\n\n12.- In a brief received by the Chamber’s Secretariat on 26 May 2026, the applicant submits evidence.\n\n13.- In a brief received by the Chamber’s Secretariat on 30 May 2026, the applicant submits evidence.\n\n14.- In a brief received by the Chamber’s Secretariat on 30 June 2026, the applicant submits evidence.\n\n15.- In a brief received by the Chamber’s Secretariat on 13 July 2026, the applicant submits evidence.\n\n16.- The legal requirements have been observed in the proceedings.\n\nJustice Araya García drafts the ruling; and,\n\nReasons:\n\nI.- Subject of the application. The applicant, an older adult, alleges violation of his fundamental rights, stating that he submitted the following requests for information concerning the General Management Plan for the Barra del Colorado National Wildlife Refuge: a) letter MLV-0032-2026 dated 25 January 2026, which was answered insufficiently by official letter DVA-017-2026; b) letter MLV-0051-2026, in which he replies to official letter DVA-017-2026, a submission that was also answered insufficiently by official letter DVA-022-2026. He maintains that the challenged authority has not adequately answered those requests.\n\nII.- Facts found. The following facts are considered duly established and relevant to deciding this matter, either because they have been established or because the respondent failed to address them as required by the initial order:\n\na) By official letter no. DVA-003-2026 dated 26 January 2026, the Vice Minister of Environment responded to the applicant as follows: “In response to official letter MLV-0011-2026, by which you request information concerning the update of the General Management Plan for the Barra del Colorado National Wildlife Refuge 2017-2027, I hereby advise you as follows: During the process of updating the General Management Plan, the Diagnosis for Updating the General Management Plan for the Barra del Colorado National Wildlife Refuge (2016) was prepared in advance. It incorporated community participation mechanisms in accordance with the environmental and administrative regulations in force at the time it was drafted. Pursuant to Decree 43532-MP-MINAE-MCJ-MEP, which was published in 2022, organization of the Afro-Costa Rican Tribal People Forum is currently the responsibility of the Asociación de Desarrollo Integral de Cahuita, which is the body responsible for its representation. It is important to note that Article 4 provides that, if necessary, the Executive Branch shall address matters important to the human rights of the Afro-Costa Rican Tribal People in consultation and coordination with them; to date, however, no express request concerning the Barra del Colorado National Wildlife Refuge or its planning instruments has been made.” (See the report submitted and the evidence provided.)\n\nb) By official letter no. MLV-0032-2026 dated 27 January 2026, the applicant submitted a request to the Vice Minister of Environment, in which he requested the following: “Subject: Supplement to official letter DVA-003-2026; request for immediate application of the prior, free, and informed consultation mechanism; request for non-application and suspension of the legal effects of the General Management Plan for the Barra del Colorado National Wildlife Refuge; and submission of questions that MINAE and SINAC are required to answer. Dear Mr. Vice Minister: I. BACKGROUND 1. By official letter DVA-003-2026 dated 26 January 2026, this Vice Ministry responded to the request for information that I submitted by official letter MLV-0011-2026 concerning the process of updating the General Management Plan for the Barra del Colorado National Wildlife Refuge 2017-2027 (…) V. REQUEST FOR NON-APPLICATION AND SUSPENSION OF THE LEGAL EFFECTS OF THE GENERAL MANAGEMENT PLAN On the basis of the foregoing, I FORMALLY REQUEST, for the protection and benefit of the Afro-descendant population of Limón, that the legal effects of the General Management Plan for the Barra del Colorado National Wildlife Refuge, as well as any process to modify or update it, be disapplied and suspended, exclusively to the extent that those effects affect or may affect: • Traditional uses of the territory; • Historical and ancestral occupations; • Traditional cultural, social, and economic practices; • Artisanal and traditional fishing activities; • Traditional coastal navigation and historical local navigation; • Afro-descendant cultural activities; and • Any administrative restriction, obligation, prohibition, or sanction imposed without prior consultation. This request does not seek general invalidation of the Plan, but rather its partial non-application and suspension of its effects with respect to the Afro-descendant tribal population until a valid prior consultation has been conducted. VI. REQUEST FOR IMMEDIATE APPLICATION OF THE PRIOR CONSULTATION MECHANISM I REQUEST that the Ministry of Environment and Energy immediately activate the prior, free, and informed consultation mechanism at the current stage of the General Management Plan, and that its application to the Afro-descendant population be suspended until the consultation process has been validly completed. VII. EXPRESS REQUEST FOR CONSULTATION ON THE GENERAL MANAGEMENT PLAN AND THE 2016 DIAGNOSIS I EXPRESSLY REQUEST that the prior consultation process comprehensively cover: 1. The General Management Plan in its current version and future updates; and 2. The Diagnosis for its update, prepared in 2016, as it constitutes the Plan’s technical and conceptual basis and produces determinative material effects. VIII. FINAL REQUESTS AND QUESTIONS THAT MINAE AND SINAC ARE REQUIRED TO ANSWER On the basis of the foregoing, I SUBMIT THE FOLLOWING REQUESTS AND QUESTIONS, which require an express, clear, and reasoned determination: A. Requests 1. That this submission be accepted as a formal supplement to official letter DVA-003-2026. 2. That application of the General Management Plan to the Afro-descendant population remain suspended until prior consultation has been validly completed. 3. That immediate activation of the prior consultation mechanism be ordered with respect to the Plan and the 2016 Diagnosis. B. Questions MINAE is required to answer 4. Does MINAE recognize that the General Management Plan and the 2016 Diagnosis are administrative measures capable of affecting the collective rights of the Afro-descendant tribal population? 5. Does MINAE recognize that prior consultation is a State duty that must be carried out on its own initiative and does not depend on a prior request? 6. What specific action will MINAE take to conduct prior consultation, identifying the administrative act, responsible department, and start date? 7. Will MINAE keep application of the Plan suspended until consultation has been validly completed? C. Questions SINAC is required to answer 8. Does SINAC recognize that it is responsible for carrying out the prior consultation process as administrator of the Refuge? 9. Does SINAC recognize that no prior consultation has been conducted concerning the Plan or the 2016 Diagnosis? 10. What specific actions will SINAC take to convene and conduct prior consultation, identifying the methodology and schedule? 11. Does SINAC undertake not to apply restrictions or sanctions arising from the Plan to the Afro-descendant population until consultation has been conducted?” (See the report submitted and the evidence provided.)\n\nc) By official letter no. DVA-017-2026 dated 09 February 2026, the Vice Minister of Environment and Energy replied to the applicant as follows: “In response to your letter MLV-0032-2026 of 25 January 2026, by which you request that letter DVA-003-2026 be expanded and that application of the General Management Plan for the Barra del Colorado National Wildlife Refuge be suspended so that consultation mechanisms may be carried out based on Conventions 107 and 169, I hereby state the following on the matter: What was stated in letter DVA-003-2026 is reaffirmed, namely, that the legal representation of the Foro Tribal rests with the Cahuita Integral Development Association, which has not taken any action related to the General Management Plan for the Barra del Colorado National Wildlife Refuge, nor requested the application of any consultation mechanisms, since there is no related document under development. It is extremely important to bear in mind the history of the protected wild area and the environmental regulation and governance that applied when it took effect, since the applicant’s aim is to apply retroactivity to a final and consolidated administrative act, based on the argument that consultation was supposedly mandatory for an administrative act related to an unidentified tribal population. The protected wild area known as the “Barra del Colorado National Wildlife Refuge” was created by Executive Decree No. 16358-MAG, published in La Gaceta No. 141 of 26 July 1985; that is, the protected wild area was created 41 years ago by means of a valid administrative act issued by the Executive Branch. The Management Plan for Protected Wild Areas (ASP) is the guiding instrument for the effective administration and management of the natural elements present in those areas and of the socio-environmental dynamics linked to them. It is also the technical tool through which management guidelines are established for the use and protection of these natural elements. The Management Plan is the planning instrument that makes it possible to guide the management of a protected wild area toward achieving its long-term conservation objectives. It is based on strategic medium-term courses of action and management objectives for the natural and cultural elements within the area, as well as on the relationship between the latter and their socio-environmental surroundings. It is the basis for developing other planning and regulatory instruments for Protected Wild Areas. (Regulation to the Biodiversity Law, Art.3, Inc. p) It should be noted that the purpose of declaring and maintaining these protected spaces is grounded in fulfilling commitments set out in certain international instruments, such as the Convention on Nature Protection and Wildlife Preservation in the Western Hemisphere (ratified by Law no. 3763 of 19 October 1966) and the Convention on Biological Diversity and its annexes (ratified by Law no. 7416 of 30 June 1994), which establish the need for States to create and protect natural protected areas. This position of the State was reaffirmed by the Procuraduría General de la República in its Opinion No. 153 of 07 August 2023. Moreover, these instruments have their own governance structure, which falls under the Área de Conservación Tortuguero of SINAC, as well as the official social-participation bodies established therein, namely the Regional Councils and Local Committees, pursuant to the Biodiversity Law No. 7788. In the specific case of preparing a Management Plan, the National Council of Conservation Areas (CONAC) approved the procedure through the “Procedural Manual for Publishing Management Plans for Protected Wild Areas of the National System of Conservation Areas,” by Agreement No. 17, adopted at Extraordinary Session No. 06-2008 of 04 August 2008. On that basis, the Área de Conservación Tortuguero began preparing the first Management Plan in 2008, that is, 18 years ago. For that purpose, the Technical Committee of the Área de Conservación Tortuguero approved the Management Plan under Agreement No. 2 in the meeting minutes of 17 June 2009; it was then submitted for approval to the Regional Council of the Área de Conservación Tortuguero (CORACTO), by Agreement No. 3 of 18 June 2009, and subsequently to CONAC, which approved it under No. 16 of Ordinary Session No. 11-2009 of 23 November 2009. This means that this instrument has been approved for 17 years under the formal governance mechanisms established at the level of the Biodiversity Law. Likewise, by Resolution No. R-SINAC-CONAC-024-2017, the National Council of Conservation Areas, pursuant to Agreement No. 33 adopted at Ordinary Session No. 09-2017, held on 25 September 2017, and in compliance with Article 12, subsection d), of the Regulation to the Biodiversity Law No. 7788, Executive Decree No. 34433-MINAE, approved and issued the “Update of the Management Plan for the Barra del Colorado National Wildlife Refuge,” which was published in Alcance No. 144 to La Gaceta No. 148, dated 16 August 2018. Accordingly, it is not acceptable to seek to give retroactive effect to a valid, current administrative act that is being implemented, such as a Management Plan concerning natural resources, in order to conduct a “consultation” with a tribal population that has not been officially identified through the State’s mechanisms, and for which no ancestral activities of the kind mentioned in the request have been identified either. The Cahuita Integral Development Association, as the official representative of the Foro Tribal, has taken no action requesting anything on behalf of a specific group concerning a matter associated with Convention 169. It is also important to clarify that no Indigenous populations to consult have been identified in the area covered by the Refuge, which suggests that the request is based on assumptions rather than concrete facts. It should be noted that, for the preparation of management plans for Protected Wild Areas, the methodology officially established by SINAC calls for comprehensive stakeholder mapping. Across all mapping processes carried out from 2000 to date, no tribal group within the Área de Conservación Tortuguero has ever been identified. In particular, the latest stakeholder mapping for the Barra del Colorado National Wildlife Refuge, completed in March 2023, did not record or identify any stakeholder corresponding to a tribal group. Under Resolution No. 06 of 26 March 2012 of the National Council of Conservation Areas, published in the official journal La Gaceta, the Management Plan for the Barra del Colorado National Wildlife Refuge was made official and has the following objectives, which show that they have no connection with tribal populations. “c) Conservation Objectives of the Barra del Colorado National Wildlife Refuge\nPrimary Objectives\n• Conserve representative samples of ecosystems of the northern Costa Rican Caribbean.\n• Protect habitats of particular interest existing in the protected wild area, especially aquatic habitats.\n• Protect outstanding, endemic, and endangered flora and fauna species that inhabit the protected area and its surroundings.\n• Protect scenic resources.\nSecondary Objectives\n• Maintain evolutionary processes and conserve genetic and water resources.\n• Provide opportunities for recreational, tourism, environmental education, and research activities.\n• Promote the sustainable management of natural resources that contribute to the socioeconomic development of the northern Costa Rican Caribbean region.” No uses related to “historical and ancestral possession; traditional cultural, social, and economic practices, artisanal and traditional fishing activities; traditional cabotage activities and historic local navigation, Afro-descendant cultural activities” have been identified in the area of this Refuge, which are the arguments alleged to justify the public consultation issue. Similarly, there is no impact on the “collective rights of the Afro-descendant tribal population,” since the purpose of the Management Plan is not directed toward those ends, but rather toward conserving natural elements in a geographic area where no tribal populations have been identified. The issue of whether Article 14 of Convention 169 applies to protected wild areas was already referred by MINAE to the Procuraduría General de la República, which clearly stated the State’s legal position on this matter in its Opinion No. 153 of 07 August 2023, when it said: “III. POSSIBILITY OF AUTHORIZING TRADITIONAL INDIGENOUS ACTIVITIES IN PROTECTED WILD AREAS. Returning to what was explained in the first section, it is clear that the second provision of Article 14.1 of ILO Convention 169 does not directly require signatory States to adopt specific measures. Rather, that provision means that each State must assess and determine whether there are cases or circumstances in which it is necessary to adopt measures aimed at guaranteeing Indigenous peoples’ right to use other lands, in addition to those they traditionally occupy, for the development of traditional and subsistence activities. And if it is established that Indigenous peoples do in fact use other lands in addition to those they occupy for carrying out their activities, the appropriate measures must be adopted to protect their right to continue using them. In the view of the Constitutional Chamber, our domestic legislation has recognized Indigenous peoples’ right to occupy lands they have traditionally possessed, since significant portions of their territory were set aside in an effort to prevent them from being registered as the private property of others, and they were allowed to exploit natural resources within their territories. However, as stated, there is no regulatory framework suggesting that the State has determined that appropriate cases exist in which it is necessary to adopt measures to safeguard Indigenous peoples’ right to use other lands, apart from those they traditionally occupy, for their traditional or subsistence activities. Consequently, there is also no regulatory framework on what those measures might be or how they should be adopted. Thus, if there is no general provision determining that such cases exist, making it necessary to adopt other kinds of measures beyond those already in place, and establishing the types of actions the State may adopt to safeguard Indigenous peoples’ right to carry out their traditional and subsistence activities on other lands apart from those they traditionally occupy, it cannot be concluded that the National System of Conservation Areas must adopt measures to allow that kind of activity in protected wild areas. As discussed in the preceding section, protected wild areas form part of the State’s natural heritage, and, in that capacity, no activities other than those specified in Article 18 of the Ley Forestal may be authorized in them. Therefore, traditional Indigenous activities other than those specified in that provision may not be authorized in those spaces. Authorizing traditional Indigenous activities not permitted under the current regime would require the issuance of a legal provision to that effect, which, in keeping with the principles of objective environmental protection, reasonableness, and proportionality discussed above, must be supported by adequate technical justification establishing the need to adopt such measures. Although it is true that Article 58 of the Biodiversity Law provides that, when a protected wild area is established, ‘the rights previously acquired by Indigenous or peasant populations and other natural or legal persons, underlying or adjacent to it’ must be ‘taken very much into account,’ that does not suggest that, once the area is established, Indigenous activities contrary to those permitted under the regime applicable to protected wild areas described above must be allowed. That provision is consistent with the difference between the legal nature of Indigenous reserves and protected wild areas and, in general, the State’s natural heritage. In law, the regime governing the State’s natural heritage is incompatible with that governing Indigenous territories. The State’s natural heritage is in the public domain and is therefore at odds with the regime governing Indigenous reserves, which constitute a collective private-property regime, reserved exclusively for the Indigenous communities that inhabit them, and registered in the Public Registry of Real Property in the name of the Integral Development Association representing them. (See Opinion no. PGR-C-253-2021 of 6 September 2021). The Constitutional Chamber has pointed out this distinction, stating: ‘The legal regime protecting property in Protected Wild Areas and Indigenous Reserves is different (…) Accordingly, it would not be legally possible for a territorial space to be simultaneously in the State’s public domain—as part of the State’s natural heritage—and an Indigenous reserve. Because these regimes are at odds, when a protected wild area is created, care must be taken not to infringe Indigenous peoples’ right to occupy lands they have traditionally inhabited and which must therefore be considered Indigenous territory. And, regarding the incompatibility of traditional Indigenous activities other than those permitted under the regime governing protected wild areas, in that last cited vote, the Constitutional Chamber stated: (…)’ The legal reasoning expressed by the Procuraduría General de la República and the Constitutional Chamber clearly sets out the legal regime applicable to protected wild areas. Therefore, the request to conduct a public consultation with an unidentified tribal population under Conventions Nos. 107 and 169, concerning a Management Plan intended to regulate the management of natural resources in a specific area, is improper. The request seeks to extend the Plan’s legal effects based on an alleged impact on the rights of a tribal population and on cultural and artisanal activities that do not exist within this protected territory, and therefore there is no causal relationship justifying the request. Disapplying a legally valid planning instrument and giving it retroactive effect without any legal basis amounts to legislating in breach of the Principle of Legality governing public administration. The Barra del Colorado National Wildlife Refuge was legally established, its governance is legitimate, and its planning instruments are legally validated and effective; therefore, there is no reason to disapply the Management Plan. Acting without considering the scope of such a decision would negatively affect environmental protection in the area, in violation of constitutional Article 50. It is valid to clarify that the Constitutional Chamber’s rulings on prior consultation based on Convention 169 had specific objectives connected to a direct interest, which do not apply in this case: a) consultation on the Coastal Regulatory Plan for the Cahuita District of the Talamanca Canton with the inhabitants of the Keköldi Indigenous Territory, on the ground that this Indigenous territory forms a unit with the coastline to be regulated, since the areas are continuously adjacent (Voto No. 2023-031756 at 9:30 a.m. on 7 December 2023); b) consultation on the Caribbean Coastal Regulatory Plan with the residents of Cahuita, Puerto Viejo, and Manzanillo, since they could be affected by the charging of fees, evictions, and demolition of homes for that population. (Voto No. 2025-029985 of 19 September 2025)” (see the report submitted and the evidence provided).\n\nd) By official letter no. MLV-0051-2026 dated 09 February 2026, the applicant submitted a request to the Vice Minister of Environment, in which he requested the following: “Subject: Reply to and rebuttal of letter DVA-017-2026 dated 9 February 2026, for violation of ILO Conventions 107 and 169 and the binding case law of the Inter-American Court of Human Rights (…) I respectfully but firmly write to reply to and rebut letter DVA-017-2026 dated 9 February 2026, which reaffirms the omission of prior consultation regarding the General Management Plan and other regulatory instruments for the Barra del Colorado National Wildlife Refuge (RNVS-BC) (…) The challenged letter contains serious omissions and interpretive errors that render invisible the historical presence of Afro-descendant populations in the northern Costa Rican Caribbean, violating international obligations of supraconstitutional rank under Article 7 of the Political Constitution (…) I. Background and Context In my letter MLV-0032-2026 of 25 January 2026, I requested suspension of the General Management Plan for the RNVS-BC and prior consultation under ILO Conventions 107 and 169, given the presence of Afro-descendant communities with ancestral practices such as artisanal fishing, traditional navigation, and cabotage. Letter DVA-017-2026 replies by denying the existence of an ‘identified tribal population’ in the area, relying on SINAC stakeholder mappings that supposedly did not record such groups. This assertion lacks a technical and legal basis and disregards historical evidence and the case law of the IACtHR (…) V. Requests I request: 1. That letter DVA-017-2026 be annulled for being contrary to the Convention. 2. That application of the General Management Plan and other instruments be suspended immediately until prior, free, informed, and culturally appropriate consultation is carried out with Afro-descendant communities represented by the Foro Tribal and the Cahuita Integral Development Association. 3. That consultation mechanisms be made official in accordance with Convention 169, in compliance with Constitutional Chamber votes such as N.° 2023- CED01 N.° 2025-029985. 4. That an internal investigation into the omissions be initiated and the matter referred to the Ministerio Público. 5. That a written response be provided within 10 business days, attaching evidence of mappings and ethnic criteria” (see the report submitted and the evidence provided).\n\ne) By official letter no. DVA-022-2026 dated 23 February 2026, the Vice Minister of Environment replied to the applicant as follows: “In response to your letter MLV-0051-2026 of 09 February 2026, in which you reply to and rebut letter DVA-017-2026 dated 9 February 2026, concerning the General Management Plan for the Barra del Colorado National Wildlife Refuge, I hereby state the following: The arguments you set out in this letter repeat those contained in your previous inquiry MLV-0032-2026 of 25 January 2026; consequently, you provide nothing additional that would warrant modifying the response already given to you in letter DVA-017-2026, in which you were expressly informed that no stakeholder corresponding to a tribal or Indigenous group is recorded or identified in the area of the Barra del Colorado National Wildlife Refuge. Likewise, you are again informed that no uses related to ‘historical and ancestral possession; traditional cultural, social, and economic practices, artisanal and traditional fishing activities; traditional cabotage activities and historic local navigation, Afro-descendant cultural activities’ take place within this Refuge. You are again informed that the update of the Management Plan for the Barra del Colorado National Wildlife Refuge was published in Alcance No. 144 to La Gaceta No. 148, dated 16 August 2018; and that no request related to the Management Plan has been submitted by the Cahuita Integral Development Association, as official representative of the tribal peoples. Consequently, your requests are improper and lack standing. In addition, you are reminded of what the Constitutional Chamber stated in resolution No. 2005-9680, at nine hours and thirty minutes on the twenty-second day of July of the year two thousand five, when it said: ‘VI.- This case involves a typical abuse of the right of petition, what has been called an “abusive right of petition,” because the applicant has been answered on what is essentially the same request on multiple occasions. The abusive exercise of a right cannot be protected, meaning an exercise that runs counter to the purposes contemplated when the right was recognized, or that exceeds the limits imposed by good faith, morals, and good customs. It is the view of this Chamber that the Defensoría de los Habitantes has been sufficiently diligent in repeatedly responding to the applicant’s request. It should be remembered that the right of petition establishes the right to receive a response; it does not mean that the response must be the one desired, or that one must agree with the response. Accordingly, since no violation of the Right of Petition alleged by the complainant has been established, the present application must be dismissed’ (see the report submitted and the evidence provided).\n\nIII.- Clarification. In this amparo proceeding, the applicant specifically complains of the lack of an adequate response to his official letter no. MLV-0032-2026 of 27 January 2026 and his official letter no. MLV-0051-2026 of 09 February 2026, which were answered by official letters DVA-017-2026 and DVA-022-2026, respectively. Thus, although it is true that the applicant’s requests began with official letter no. MLV-0011-2026, which was answered by official letter no. DVA-003-2026 of 26 January 2026, the fact is that the applicant makes no claim regarding that letter and did not even submit it as evidence, despite having been instructed to provide the requests that he considers not to have been duly answered. Accordingly, this Court will not address that first letter (official letter no. MLV-0011-2026) or the response given to the applicant, and will analyze only the requests challenged by the applicant, namely, his official letter no. MLV-0032-2026 of 27 January 2026 and his official letter no. MLV-0051-2026 of 09 February 2026, and the responses given to those requests.\n\nAccordingly, the specific inquiries submitted by the amparo applicant and the responses provided by the respondent will be analyzed to determine whether each was fully addressed as requested.\n\nRegarding official letter no. MLV-0032-2026 of 27 January 2026:\n\nWhat was requested\n\nWhether the request is eligible for amparo relief\n\nWhether the request was answered\n\n“I HEREBY FORMALLY REQUEST, for the protection and benefit of the Afro-descendant tribal population of Limón, that the legal effects of the General Management Plan for the Barra del Colorado National Wildlife Refuge, as well as of any process to amend or update it, be disapplied and suspended (…) This request does not seek the general annulment of the Plan, but rather its partial disapplication and suspension of its effects with respect to the Afro-descendant tribal population until valid prior consultation is carried out.”\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by disapplying or suspending the legal effects of the General Management Plan for the Barra del Colorado National Wildlife Refuge.\n\nNot applicable.\n\n“I REQUEST that the Ministry of Environment and Energy immediately activate the mechanism for prior, free, and informed consultation in relation to the current status of the General Management Plan, and that its application with respect to the Afro-descendant population be suspended until the consultation process is validly completed.”\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by applying consultation mechanisms to the current status of that Plan.\n\nNot applicable.\n\n“I EXPRESSLY REQUEST that the prior consultation process comprehensively cover: 1. The General Management Plan in its current version and future updates; and 2. The Diagnosis for its update prepared in 2016, as it constitutes the Plan’s technical and conceptual basis and produces determinative material effects.”\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by applying consultation mechanisms (and their subject matter) to the current status of that Plan.\n\nNot applicable.\n\n“I SET OUT THE FOLLOWING CLAIMS AND QUESTIONS, which require an express, clear, and reasoned determination: (…) 2. That application of the General Management Plan with respect to the Afro-descendant population remain suspended until prior consultation is validly completed.”\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by disapplying or suspending the legal effects of the General Management Plan for the Barra del Colorado National Wildlife Refuge.\n\nNot applicable.\n\n“I SET OUT THE FOLLOWING CLAIMS AND QUESTIONS, which require an express, clear, and reasoned determination: (…) 3. That immediate activation of the prior consultation mechanism be ordered with respect to the Plan and the 2016 Diagnosis.”\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by applying consultation mechanisms to the current status of that Plan.\n\nNot applicable.\n\n“4. Does MINAE acknowledge that the General Management Plan and the 2016 Diagnosis are administrative measures capable of affecting the collective rights of the Afro-descendant tribal population?”\n\nYes, the request is eligible for amparo relief.\n\nYes, it was answered by official letter no. DVA-017-2026 of 09 February 2026, notified before this amparo application was filed. The applicant was informed that “(…) there is no impact on the ‘collective rights of the Afro-descendant tribal population,’ since the purpose of the Management Plan is not directed toward those ends, but rather toward conserving natural elements in a geographic area where no tribal populations have been identified.”\n\n“5. Does MINAE acknowledge that prior consultation is an ex officio duty of the State, which does not depend on a prior request?”\n\nThe request is not eligible for amparo relief because it is not properly a request for information, but rather a request for institutional views on possible future actions.\n\nNot applicable.\n\n“6. Does SINAC acknowledge that it is responsible for materially carrying out the prior consultation process as administrator of the Refuge?”\n\nThe request is not eligible for amparo relief because it is not properly a request for information, but rather a request for institutional views on possible future actions.\n\nNot applicable.\n\n“9. Does SINAC acknowledge that no prior consultation has been carried out regarding the Plan or the 2016 Diagnosis?”\n\nThe request is not eligible for amparo relief because it is not properly a request for information, but rather a request for institutional views on possible future actions.\n\nNot applicable.\n\n“10. What specific actions will SINAC develop to convene and carry out the prior consultation, specifying the methodology and schedule?”\n\nThe request is not eligible for amparo relief because it is not properly a request for information, but rather a request for institutional views on possible future actions.\n\nNot applicable.\n\n“11. Does SINAC undertake not to apply restrictions or sanctions arising from the Plan to the Afro-descendant population until consultation has been carried out?”\n\nThe request is not eligible for amparo relief because it is not properly a request for information, but rather a request for institutional views on possible future actions.\n\nNot applicable.\n\nRegarding official letter no. MLV-0051-2026 of 09 February 2026:\n\nWhat was requested\n\nWhether the request is eligible for amparo relief\n\nWhether the request was answered\n\n“(…) I respectfully but firmly write to reply to and rebut letter DVA-017-2026 dated 9 February 2026, which reaffirms the omission of prior consultation regarding the General Management Plan and other regulatory instruments for the Barra del Colorado National Wildlife Refuge (RNVS-BC).”\n\nThe request is not eligible for amparo relief because it is not a request for information, but rather an expression of disagreement with the response given in official letter DVA-017-2026.\n\nNot applicable.\n\n“I request: 1. That letter DVA-017-2026 be annulled for being contrary to the Convention (…)”.\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by annulling letter DVA-017-2026.\n\nNot applicable.\n\n“2. That application of the General Management Plan and other instruments be suspended immediately until prior, free, informed, and culturally appropriate consultation is carried out with Afro-descendant communities represented by the Foro Tribal and the Cahuita Integral Development Association.”\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by suspending application of the General Management Plan.\n\nNot applicable.\n\n“3. That consultation mechanisms be made official in accordance with Convention 169, in compliance with Constitutional Chamber votes such as N.° 2023- CED01 N.° 2025-029985”\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by making consultation mechanisms official. Note that in the preceding letter (letter DVA-017-2026, which the applicant replies to in this letter), the respondent authority explained to the applicant why the requested consultation is not appropriate.\n\nNot applicable.\n\n“4. Initiate an internal investigation into the omissions and refer the matter to the Ministerio Público”\n\nThe request is not eligible for amparo relief because it is an exhortation that the administration act in a particular manner, in this case by conducting an internal investigation.\n\nNot applicable.\n\nIV.- Regarding official letter no. MLV-0032-2026 of 27 January 2026. After analyzing the evidence submitted, this Court finds that there has been no violation of the applicant’s fundamental rights on this point. The reason is that, as indicated in the preceding table, it has been duly established that the vast majority of the inquiries made by the applicant in official letter no. MLV-0032-2026 of 27 January 2026 are exhortations that the administration act in a certain way concerning the General Management Plan for the Barra del Colorado National Wildlife Refuge, or requests that require institutional views on possible future actions. Consequently, such requests are not subject to protection by way of amparo, since they go beyond the applicable regulations and do not conform to the content of a request for information or to the right of petition itself.\n\nHowever, as explained in the preceding table, one item in the request is eligible for amparo relief because it seeks public information, namely item 4; but it is established that this part of the request was duly answered. Thus, the applicant’s complaint is a disagreement with that response. Therefore, if the applicant disagrees with the response, he may—if he so wishes—present his claims through the ordinary channel.\n\nAccordingly, no violation of the applicant’s fundamental rights is found with respect to the responses given to that letter.\n\nV.- Regarding official letter no. MLV-0051-2026 of 09 February 2026. No violation of the applicant’s fundamental rights is apparent with respect to this letter either. As explained in the preceding table, the requests in that letter are exhortations that the administration act in a certain way concerning his request for consultation on the subject. Note that in the preceding letter (letter DVA-017-2026, which the applicant replies to in this letter), the respondent authority explained to the applicant why the requested consultation is not appropriate. However, the applicant continues to disagree with those responses. Therefore, as stated in the preceding consideration, if the applicant disagrees with the response, he may—if he so wishes—present his claims through the ordinary channel.\n\nIn summary, no violation of the applicant’s fundamental rights is found with respect to this letter either.\n\nVI.- Conclusion. In view of the foregoing, the amparo application must be dismissed in its entirety.\n\nVII.- DOCUMENTS SUBMITTED INTO THE CASE FILE. The parties are advised that any paper document submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, must be retrieved from the court office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe application is dismissed.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
