"summary_en": "The Constitutional Chamber (Sala Constitucional) denied the National Roadway Council’s (CONAVI) request for a four-month extension of the deadline set in an earlier ruling. That ruling required technical assessments and studies, and a definitive opinion on a tree within the right-of-way of a national road, within one month; it did not order pruning, felling, or removal of the tree. CONAVI argued that it needed time to formalize a contract, complete a forestry site assessment, and coordinate environmental authorizations with the National System of Conservation Areas (SINAC). The Chamber found that these arguments about carrying out a possible intervention did not justify extending the deadline for the order actually issued, which was limited to studying the tree and issuing an opinion. It therefore denied the extension request. The resolution does not decide whether the tree should be intervened and does not replace any required technical assessments or environmental procedures.",

\n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at nine hours and twenty minutes on 20 August 2026.\n\n \n\nPost-judgment application filed by Nombre01, IN HIS CAPACITY AS EXECUTIVE DIRECTOR OF THE NATIONAL ROAD COUNCIL (CONAVI), in case file no. 26-009841-0007-CO.\n\nBackground:\n\n \n\n1.- In a brief added to the case file on 17 August 2026, the respondent states: “II. ACTIONS TAKEN BY THIS ADMINISTRATION Far from remaining inactive, this Administration has taken the actions within the scope of its powers, as detailed below: 1. The application was forwarded to the Roads and Bridges Maintenance Management, specifically to Zone Engineering 1-1 of the Central Region, the department competent to handle this type of matter within the National Road Network. 2. The opinion of the competent forestry professional was requested and obtained, recommending that the tree at issue in the case file be felled, as its intervention is considered technically appropriate. The foregoing is documented in official letter CARTA-CONAVICA-DIE-GCSV-DRC-1341-2026 of 30 July 2026, signed by Eng. Allison Aymerich Pérez and Mr. Luis Antonio Alvarado Arce, Regional Director of the Central Region, both of the Roads and Bridges Maintenance Management, which is submitted as evidence in support of this application. 3. In parallel, the Roads and Bridges Maintenance Management is arranging the formalization of the new contract that will allow the felling and lopping of trees within the right-of-way of the National Road Network. It follows from the foregoing that there is no institutional refusal or administrative inertia. On the contrary, the matter has been addressed, and a technical forestry opinion is now available to guide this Administration’s actions. However, completion of the ordered process and implementation of the recommended intervention depend on three conditions that, as of this date, have not been met and cannot be resolved within the one-month period granted. III. MATERIAL IMPOSSIBILITY OF COMPLIANCE WITHIN THE PERIOD GRANTED a) No contract currently in force for carrying out felling and lopping work. According to the information provided by the Roads and Bridges Maintenance Management in official letter CARTACONAVI-CA-DIE-GCSV-DRC-1341-2026, that Management currently has no contract in force for carrying out the felling and lopping of trees within the right-of-way of the National Road Network, because Direct Contracting No. 2022CD000145-0006000001 has expired. This circumstance makes it materially impossible to schedule and carry out the work recommended by the technical opinion. Although it is preliminarily estimated that the new contract could take effect during the last quarter of 2026, that projection is subject to the progress of the corresponding administrative contracting procedure, which is governed by time limits and formalities that this Administration cannot shorten without violating the General Public Procurement Law. For that reason, as of this date, it is not possible to establish a definite start date for the work. b) Need for an on-site technical survey by the forestry engineer. In addition, as the Roads and Bridges Maintenance Management itself indicates, issuing the final opinion and potentially intervening on the specimen require an on-site technical survey by the competent forestry engineer. That survey is essential to determine, with technical rigor and in a verifiable manner, the tree’s phytosanitary and structural condition, its stability, the potential risk of falling, effects on existing infrastructure, and the specimen’s particular characteristics that must be recorded for any subsequent procedure. This is a specialized technical action that cannot be replaced by subjective assessments or general opinions, and its scheduling depends on the availability of the competent professional and the conditions of the site, located on a road with heavy pedestrian and vehicular traffic in downtown Guadalupe de Goicoechea. c) Coordination and authorizations with the National System of Conservation Areas (SINAC). Finally, carrying out the recommended felling does not depend solely on this Administration’s will. Because it entails removing a tree, the action must comply with the applicable environmental and forestry regulations, particularly Ley Forestal No. 7575 and its Regulations. This requires proper coordination with the National System of Conservation Areas (SINAC) of the Ministry of Environment and Energy, as the body competent in forestry matters, to process and obtain any authorizations required before the intervention. Such interagency coordination entails time limits that are entirely outside the control of the National Road Council, since they depend on the procedure and decision of a separate environmental authority. Acting without those authorizations would expose this Administration to environmental and administrative liability and would violate the principle of legality enshrined in Articles 11 of the Political Constitution and 11 of the General Law of Public Administration. IV. BASIS FOR THIS APPLICATION The three conditions described constitute an objective material and legal impossibility, beyond this Administration’s control, that prevents completion within the ONE-MONTH period of the process ordered by this Honorable Chamber. This is not a failure to heed the constitutional order, but rather a need for a reasonable period that will allow the forestry technical survey, the steps with SINAC, and the formalization of the contract that will enable the work to be carried out to be completed sequentially and on a duly reasoned basis. Hasty compliance, without the corresponding technical survey and prior environmental authorizations, would not only lack technical and legal support, but would also run counter to the very purpose of the judgment, namely, to ensure that the decision concerning the tree is made on the basis of objective and verifiable criteria. This representative reiterates the commitment to comply with what was ordered and states that, once the relevant contract is in force and the applicable environmental authorizations have been obtained, the Roads and Bridges Maintenance Management will schedule the work in accordance with operational planning and contractual availability, and will inform this Honorable Chamber in due course. V. RELIEF SOUGHT On the basis of the foregoing, I respectfully request that this Honorable Chamber: Grant the National Road Council an additional four-month extension, counted from the expiration of the period originally granted in judgment No. 2026025653 issued at nine hours and twenty-five minutes on 10 July 2026, in order to complete the forestry technical survey, coordinate with and obtain the applicable authorizations from the National System of Conservation Areas (SINAC), formalize the required contract, and carry out the actions that are technically appropriate with respect to the tree at issue in this case file.”\n\n2.- The legal requirements have been observed in these proceedings.\n\n \n\nJustice Rueda Leal drafted this decision; and,\n\nReasons:\n\n \n\nI.- In judgment no. 2026025653 issued at 9:25 hours on 10 July 2026, the following was ordered:\n\n“ON THE SPECIFIC CASE. In this case, the applicant states that a tree posing a risk to people who live and travel in the area is located in front of the respondent municipality’s building. She argues that she has repeatedly asked the local government to remove the aforementioned tree; however, this has not happened. She also notes that a request was made for the matter to be taken up with other public institutions so they could address the issue and eliminate the risk; however, the relevant steps have not been taken.\n\nUpon review of the record, it is established that, at ordinary session no. 06-2025 of 10 February 2025, the respondent municipality considered the situation concerning the tree described by the protected party; however, it determined that the tree is located ‘in front of private property and within the right-of-way of Dirección02.’ On 14 March 2025, the respondent municipality sent an application to Conavi’s Roads and Bridges Maintenance Management, requesting its intervention to address the matter of the aforementioned tree. The Roads and Bridges Maintenance Management was notified of the order commencing these proceedings on 8 June 2026. In official letter no. CARTA-CONAVI-CA-DIE-GCSV-DRC-971-2026 of 10 June 2026, Conavi’s Roads and Bridges Maintenance Management stated: ‘The assessment of tree species located within or near the right-of-way is a specialized matter requiring the involvement of professionals competent in forestry, who must determine the tree’s condition, structural stability, potential risk of falling, effects on existing infrastructure, and the technical appropriateness of any pruning, felling, or removal work. Accordingly, any intervention on a tree must be based in advance on a field inspection and a specialized technical opinion, as well as compliance with applicable environmental regulations and the corresponding administrative procedures. In this case, after reviewing the available background, the need for a specialized technical assessment was determined, and the matter was therefore referred to the competent forestry professional to conduct the relevant inspection and issue the corresponding technical opinion. Consequently, any determination as to whether the tree at issue in the application should be intervened upon is subject to the outcome of that specialized technical assessment, which is essential to this Administration’s decision-making.’\n\nFirst, it should be noted that, in this particular case, it is not for this Court to determine whether the tree in question should be pruned or eventually felled, as the applicant seeks. This is because such a determination requires a broad, technical, and specialized analysis that exceeds the summary nature of this amparo proceeding and therefore must be determined through the corresponding ordinary procedure.\n\nIn that regard, it is clear that, in this case, it is for Conavi’s Roads and Bridges Maintenance Management to conduct the relevant technical study to define the tree’s condition, as well as any actions that should be taken in response to risk situations that may be confirmed, as that department itself acknowledges in official letter no. CARTA-CONAVI-CA-DIE-GCSV-DRC-971-2026 of 10 June 2026. However, it has not been established that the authority ultimately took those steps, even though the matter was referred to it in March 2025—that is, more than 1 year ago.\n\nAccordingly, this Chamber’s intervention is necessary precisely because of the delay by Conavi authorities in addressing this matter and conducting the relevant technical studies, especially since it must be determined whether the risk to the community alleged by the applicant exists.\n\nTherefore, the amparo application is granted on this point, on the terms set out in the operative part of this decision.\n\nAs for the Municipality of Goicoechea, the application is denied because, since February 2025, it had been determined that Conavi was responsible for addressing the matter (because the tree in question is within the right-of-way of a national route), and the matter was referred to that department in March of that same year, as stated above. In that regard, no action or omission by the respondent municipality that infringed fundamental rights can be discerned.\n\nFinally, although the applicant refers in a subsequent brief to circumstances concerning another tree in the community (located in front of Centeno Güell school), it should be noted that these proceedings were initiated specifically concerning the tree in front of the municipal building, as set out in the specific terms of the initiating brief. Thus, the matters raised in that subsequent brief concern circumstances beyond the specific subject matter of this case, and the Court therefore cannot rule on that new issue in these proceedings (…)”\n\nTherefore:\n\n \n\nThe amparo application is partially granted, solely with respect to the National Road Council. The person serving as manager of the National Road Council’s Roads and Bridges Maintenance Management is ordered to issue the necessary instructions, coordinate as appropriate, and carry out all actions within the scope of their powers so that, within a maximum period of ONE MONTH from notification of this judgment, the relevant assessments and technical studies are conducted and a final opinion is issued concerning the condition of the tree at issue in this application. The respondent authority is advised that, pursuant to Article 71 of the Constitutional Jurisdiction Act, anyone who receives an order to be carried out or enforced, issued in an amparo proceeding, and fails to carry it out or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The National Road Council is ordered to pay the costs, damages, and losses caused by the acts underlying this declaration, to be assessed in enforcement of judgment through the administrative-litigation jurisdiction. In all other respects, the amparo application is denied. Notify the parties.”\n\n \n\nII.- ON THE APPLICATION FILED. In this case, the respondent party requests an extension of the period granted in the principal judgment in this matter. To justify this request, it explains that the relevant forestry opinion has already been issued, but a contract specifically for carrying out the felling and lopping of the tree is being formalized, which requires additional time.\n\nHowever, it should be noted that in the aforementioned judgment this Chamber did not order the felling or lopping of the tree in question, as it specifically reasoned as follows:\n\n“First, it should be noted that, in this particular case, it is not for this Court to determine whether the tree in question should be pruned or eventually felled, as the applicant seeks. However, it has not been established that the authority ultimately took those steps, even though the matter was referred to it in March 2025—that is, more than 1 year ago.\n\nAccordingly, this Chamber’s intervention is necessary precisely because of the delay by Conavi authorities in addressing this matter and conducting the relevant technical studies, especially since it must be determined whether the risk to the community alleged by the applicant exists (…)”\n\n \n\nIn that regard, the operative part of the judgment ordered only that “within a maximum period of ONE MONTH from notification of this judgment, the relevant assessments and technical studies be conducted and a final opinion be issued concerning the condition of the tree at issue in this application.”\n\n Thus, the additional period requested by the respondent authority specifically to carry out pruning and lopping of the tree is inconsistent with what this Court ordered in this case, since, as reiterated, no intervention of that kind was ordered at any time.\n\n Consequently, the application filed is denied.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve these from the Court office within a maximum period of 30 business days from notification of this judgment. Any material not retrieved within this period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011, published in Judicial Bulletin no. 19 of 26 January 2012, as well as the Superior Council of the Judiciary’s resolution approved in Article LXXXI of session no. 43-12 held on 3 May 2012.\n\n \n\nTherefore:\n\n \n\nThe application filed is denied.\n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresident\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.
