  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-024130-0007-CO \n\nRes. Nº 2026032003\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-024130-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).\n\nRESULTANDO:\n\n1.- Por escrito presentado en la Secretaría de la Sala a las 17:59 horas del 5 de julio de 2026, la parte recurrente interpone recurso de amparo contra el ICAA. Manifiesta que: “PRIMERO. Soy propietario del inmueble identificado mediante plano catastrado número PRN01, ubicado en el distrito de Sardinal, cantón de Carrillo, provincia de Guanacaste. SEGUNDO. El día 06 de noviembre de 2025, funcionarios del Instituto Costarricense de Acueductos y Alcantarillados realizaron inspección técnica en el inmueble, la cual fue efectuada por el señor Allan Pizarro Arias, jefe Técnico de Coco-Sardinal. TERCERO. En dicha visita se determinó: a) Que actualmente no existe red de distribución frente a la propiedad. b) Que para brindar el servicio es necesaria una extensión aproximada de noventa y cuatro coma seis metros (94,6 metros) de tubería PVC de cien milímetros. c) Que existe una presión disponible de veinticinco PSI. d) Que las coordenadas del inmueble corresponden a CED01 -85.478541. CUARTO. El expediente administrativo fue remitido a criterio de ingeniería para su valoración técnica. QUINTO. A pesar del tiempo transcurrido, el AyA no ha emitido resolución definitiva, no ha comunicado una negativa fundada, no ha establecido un cronograma para la ejecución de la obra y mantiene una situación de incertidumbre indefinida. SEXTO. La propia valoración técnica efectuada por funcionarios del AyA demuestra que existe presión suficiente y que la obra requerida consiste únicamente en una extensión aproximada de noventa y cinco metros de tubería PVC de cien milímetros, por lo que no existe una imposibilidad material acreditada. SÉTIMO. La omisión administrativa prolongada y la ausencia de una respuesta debidamente motivada lesionan gravemente mi derecho fundamental al acceso al agua potable, recurso indispensable para la vida y para el disfrute de los demás derechos humanos”. (sic). Solicita que se declare con lugar el recurso con las consecuencias de ley. \n\n2.- Por resolución de Presidencia de las 22:03 horas del 24 de julio de 2026, se dio curso al presente proceso y se le dio traslado al gerente general del ICAA.\n\n3.- Por escrito incorporado al expediente digital a las 16:24 horas del 30 de julio de 2026, se apersona la parte recurrente con el fin de aclarar que la dirección correcta del inmueble objeto de este amparo es la siguiente: “Soy propietario del inmueble identificado mediante plano catastrado número PRN01, ubicado en el distrito de Cañas Dulces, cantón de Liberia, provincia de Guanacaste\". \n\n4.- Por escrito incorporado al expediente digital a las 23:13 horas del 31 de julio de 2026, informa bajo juramento María de los Ángeles Morera Calderón, en su condición de gerente general a.i. del ICAA, que: “(…) La solicitud de disponibilidad de servicios N.°2025-00100837-1, correspondiente a la propiedad inscrita bajo la matrícula de folio real N.° PRN02 y el plano catastrado N.° 5-49002-2024, ubicada en el distrito de Cañas Dulces, cantón de Liberia, provincia de Guanacaste, fue analizada por la Dirección de Ingeniería de la Región Chorotega, que emitió el criterio técnico N.° GSP-RCHO-2025-02672, con fecha del 7 de noviembre de 2025, y de acuerdo a los estudios técnicos se estableció que el inmueble de la recurrente se encuentra fuera del área de cobertura del acueducto y que no existe red de distribución frente a sus linderos. La infraestructura más cercana se localiza aproximadamente a 95 metros de distancia, sobre vía pública, y corresponde a una tubería de 100 mm con una presión de 25 PSI, por lo que, con base en esas condiciones, se determinó que no era posible otorgar la disponibilidad de agua potable, debido a la ausencia de infraestructura frente al inmueble. Ahora bien, en el criterio técnico también confirmó que el sistema de Cañas Dulces cuenta con capacidad hídrica para abastecer una vivienda unifamiliar con un caudal de 0,60 m³ por día. razón, por la cual junto con la resolución negativa se emitió una constancia de capacidad hídrica en la que se detallaron las obras que la recurrente debía realizar para habilitar el servicio, de agua entre ellas, la construcción de una extensión de ramal de aproximadamente 95 metros, así como los accesorios y demás componentes requeridos técnicamente. (Ver Criterio N.° GSP-RCHO-2025-02672). 2. Importante resaltar a esta honorable Sala que las constancias de capacidad hídricas no equivalen al otorgamiento inmediato de la disponibilidad ni obliga al AyA a construir la extensión ramal el documento permite realizar los trámites, diseños y permisos necesarios para desarrollar las obras de infraestructura primaria, las cuales deberán ser construidas con el peculio del solicitante conforme a la normativa existente, bajo la aprobación, fiscalización y posterior recepción institucional. Asimismo, en dicho documento plasma toda la información en referencia a la construcción de la extensión de ramal y para el caso que nos ocupa la constancia de no disponibilidad de servicios N° SIGDD-2025-00100837-1-2-NCCH y la constancia de capacidad hídrica N° SIGDD-2025-00100837-1-3-CCH, así como el criterio técnico GSP-RCHO-2025-02672 fueron notificados a la recurrente en fecha de 17 de noviembre 2025 al correo ...01. Se evidencia en este informe que la omisión administrativa alegada por la recurrente no es cierta la solicitud fue analizada, resuelta y notificada, por otro lado con respecto al cronograma mencionado en el escrito, no corresponde al AyA, pues las obras requeridas deben ser promovidas y construidas por la persona interesada, por lo tanto nuestras actuaciones no han sido arbitrarias dado que este instituto reconoció la capacidad hídrica disponible y estableció una alternativa concreta para que la propiedad pueda contar con el servicio del suministro de agua una vez cumplidas las condiciones técnicas y administrativas las cuales fueron debidamente informadas.(Ver informe GSP-RCH-CL-2026- 00584. El Instituto, en su condición de prestador del servicio público de agua potable, se encuentra jurídicamente impedido para otorgar disponibilidades cuando no se cumplen las condiciones técnicas y legales requeridas y conforme los análisis técnicos se determinó que el inmueble se encuentra fuera del área de cobertura del acueducto de Cañas Dulces y no existe red de distribución frente a los linderos, razón por la cual no era posible otorgar la disponibilidad inmediata de agua potable y de acuerdo a la constancia de capacidad hídrica y notificada las obras deben ser construidas por la recurrente conforme lo indica el Reglamento de Prestación de Servicios de AyA”. Solicita a la Sala que declare sin lugar el recurso. \n\n5.- En los procedimientos seguidos se han observado las prescripciones legales. \n\n Redacta el Magistrado Salazar Alvarado; y,\n\nCONSIDERANDO: \n\nI.- OBJETO DEL RECURSO. La parte recurrente indica que el día 06 de noviembre de 2025, funcionarios del ICAA realizaron inspección técnica en un inmueble de su propiedad, a efectos de autorizar la disponibilidad de agua potable. En dicha visita se determinó: a) Que actualmente no existe red de distribución frente a la propiedad. b) Que para brindar el servicio es necesaria una extensión. C) Que el expediente administrativo fue remitido a criterio de ingeniería para su valoración técnica; empero, a pesar del tiempo transcurrido, no se ha emitido resolución definitiva.\n\nII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial: \n\na) El inmueble objeto del amparo es el identificado mediante plano catastrado número PRN01, ubicado en el distrito de Cañas Dulces, cantón de Liberia, provincia de Guanacaste (ver prueba aportada).\n\nb) La solicitud de disponibilidad de servicios N° 2025-00100837-1, correspondiente a la propiedad inscrita bajo la matrícula de folio real N° PRN02 y el plano catastrado N° PRN01, ubicada en el distrito de Cañas Dulces, cantón de Liberia, provincia de Guanacaste, fue analizada por la Dirección de Ingeniería de la Región Chorotega del ICAA (ver informe rendido bajo juramento y prueba aportada).\n\nc) El ICAA emitió el criterio técnico N° GSP-RCHO-2025-02672, con fecha del 7 de noviembre de 2025, en el cual se indicó que de acuerdo con los estudios técnicos se estableció que el inmueble en cuestión se encuentra fuera del área de cobertura del acueducto y que no existe red de distribución frente a sus linderos (ver informe rendido bajo juramento y prueba aportada).\n\nd) Con base en dichos estudios técnicos se determinó que no era posible otorgar la disponibilidad de agua potable, debido a la ausencia de infraestructura frente al inmueble (ver informe rendido bajo juramento y prueba aportada).\n\ne) La constancia de no disponibilidad de servicios N° SIGDD-2025-00100837-1-2-NCCH y la constancia de capacidad hídrica N° SIGDD-2025-00100837-1-3-CCH, así como el criterio técnico GSP-RCHO-2025-02672 fueron notificados a la recurrente en fecha de 17 de noviembre 2025 al correo ...01 (ver informe rendido bajo juramento y prueba aportada).\n\nIII.- SOBRE LAS IMPOSIBILIDADES TÉCNICAS QUE OBSTACULIZAN EL ABASTECIMIENTO DE AGUA POTABLE. Esta Sala en Sentencia N° 2010-001516 de las 18:36 horas del 26 de enero de 2010, se refirió a lo relativo a las imposibilidades técnicas o legales para brindar el servicio de agua potable. En esa oportunidad estableció lo siguiente: \n\n“IV.- Sobre como la imposibilidad jurídica o formal para dotar del servicio de agua potable no es violatorio de derechos fundamentales.- Reiterada jurisprudencia de esta Sala ha indicado que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos –sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). En este sentido, resulta claro concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargado de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, a pesar de todo lo que se acaba de establecer, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. Por supuesto, el AyA como un ente estatal encargado mayormente de la prestación del servicio de agua potable, tiene la obligación de ir expandiendo su infraestructura para que tengan acceso a este preciado líquido cada vez más y más personas, pero mientras queden vacíos resulta indispensable la colaboración de los interesados (véase las resoluciones Nº 2006-014218 de las quince horas y cuatro minutos del veintiséis de septiembre del dos mil seis y Nº 2007-11190 de las catorce horas y treinta y seis minutos del siete de agosto del dos mil siete). En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales”.\n\n IV.- SOBRE EL CASO CONCRETO. En el sub examine, la parte recurrente aduce que el día 06 de noviembre de 2025, funcionarios del ICAA realizaron inspección técnica en un inmueble de su propiedad, a efectos de autorizar la disponibilidad de agua potable. En dicha visita se determinó: a) Que actualmente no existe red de distribución frente a la propiedad. b) Que para brindar el servicio es necesaria una extensión. C) Que el expediente administrativo fue remitido a criterio de ingeniería para su valoración técnica; empero, a pesar del tiempo transcurrido, no se ha emitido resolución definitiva. Al respecto, la Sala tiene por demostrado que el inmueble objeto del amparo es el identificado mediante plano catastrado número PRN01, ubicado en el distrito de Cañas Dulces, cantón de Liberia, provincia de Guanacaste. La solicitud de disponibilidad de servicios N.°2025-00100837-1, correspondiente a la propiedad inscrita bajo la matrícula de folio real N° PRN02 y el plano catastrado N° PRN01, ubicada en el distrito de Cañas Dulces, cantón de Liberia, provincia de Guanacaste, fue analizada por la Dirección de Ingeniería de la Región Chorotega del ICAA. El ICAA emitió el criterio técnico N° GSP-RCHO-2025-02672, con fecha del 7 de noviembre de 2025, en el cual se indicó que de acuerdo con los estudios técnicos se estableció que el inmueble en cuestión se encuentra fuera del área de cobertura del acueducto y que no existe red de distribución frente a sus linderos. Con base en dichos estudios técnicos se determinó que no era posible otorgar la disponibilidad de agua potable, debido a la ausencia de infraestructura frente al inmueble. La constancia de no disponibilidad de servicios N° SIGDD-2025-00100837-1-2-NCCH y la constancia de capacidad hídrica N° SIGDD-2025-00100837-1-3-CCH, así como el criterio técnico GSP-RCHO-2025-02672 fueron notificados a la recurrente en fecha de 17 de noviembre 2025 al correo ...01. Ante este panorama, estima la Sala que se debe declarar sin lugar el recurso. Como puede constatarse del elenco de hechos probados, a la amparada se le notificó que existe una imposibilidad real o material para poder autorizarle el suministro del servicio público de agua potable, toda vez que el inmueble en cuestión se encuentra fuera del área de cobertura del acueducto y que no existe red de distribución frente a sus linderos. Por ello, se requiere la cooperación de la persona interesada para lograr extender la infraestructura existente hasta el lugar donde se pretende instalar el nuevo servicio públicos. En razón de lo anterior, como en reiterada jurisprudencia constitucional lo ha señalado este Tribunal, no existe una lesión al derecho fundamental de acceso al agua en aquellos escenarios en los cuales existe una imposibilidad técnica o material para brindar el servicio, como en efecto ocurre en el sub lite. Ergo, por las razones expuestas, procede la desestimatoria del amparo.\n\nV.- VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL, CON REDACCIÓN DEL PRIMERO. Conforme a las consideraciones que indicamos a continuación estimamos que el presente recurso debe declararse con lugar. En el criterio de mayoría, la sentencia desestima el amparo porque, a su juicio, la negativa impugnada no obedece a una actuación arbitraria o discriminatoria, sino que encuentra fundamento en criterios técnicos, como lo es la insuficiencia de capacidad hidráulica del sistema de abastecimiento, específicamente por limitaciones en la línea de conducción existente y ante la insuficiente capacidad del sistema para atender la demanda actual sin comprometer la continuidad, calidad y cantidad del servicio de los usuarios existente; sin embargo se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana. El artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos. El proveedor del servicio público no puede limitarse a constatar insuficiencias del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano. No se trata de obligar a lo imposible, sino de exigir la adopción de medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas. El agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la entidad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas. Por estas razones, estimamos que el recurso debe declararse con lugar, al menos para ordenar la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.\n\nVI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. San José, at 9:20 a.m. on 20 August 2026.\n\nAmparo proceeding conducted in case file number 26-024130-0007-CO, filed by Nombre01, identity card CED02, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (ICAA).\n\nBACKGROUND:\n\n1.- By a written submission filed with the Chamber Secretariat at 17:59 on 5 July 2026, the appellant files an amparo application against the ICAA. The appellant states: “FIRST. I own the property identified by cadastral survey map number PRN01, located in the district of Sardinal, canton of Carrillo, province of Guanacaste. SECOND. On 06 November 2025, officials of the Costa Rican Institute of Aqueducts and Sewers conducted a technical inspection of the property, carried out by Mr. Allan Pizarro Arias, Technical Head of Coco-Sardinal. THIRD. During that visit, it was determined: a) There is currently no distribution network in front of the property. b) To provide the service, an extension of approximately ninety-four point six meters (94,6 meters) of 100-millimeter PVC pipe is necessary. c) Available pressure is twenty-five PSI. d) The property’s coordinates are CED01 -85.478541. FOURTH. The administrative file was referred for engineering review and technical assessment. FIFTH. Despite the time that has elapsed, AyA has not issued a final decision, has not communicated a reasoned denial, has not established a schedule for carrying out the work, and maintains an indefinite state of uncertainty. SIXTH. The technical assessment conducted by AyA officials itself shows that sufficient pressure is available and that the required work consists only of an approximately ninety-five-meter extension of 100-millimeter PVC pipe; therefore, no demonstrated material impossibility exists. SEVENTH. The prolonged administrative omission and the absence of a duly reasoned response seriously infringe my fundamental right of access to drinking water, a resource essential to life and to the enjoyment of other human rights.” (sic). The appellant asks that the application be granted, with the legal consequences that follow.\n\n2.- By order of the Presidency at 22:03 on 24 July 2026, these proceedings were initiated and the general manager of the ICAA was given notice.\n\n3.- By a written submission added to the digital file at 16:24 on 30 July 2026, the appellant appears to clarify that the correct address of the property at issue in this amparo is as follows: “I own the property identified by cadastral survey map number PRN01, located in the district of Cañas Dulces, canton of Liberia, province of Guanacaste.”\n\n4.- By a written submission added to the digital file at 23:13 on 31 July 2026, María de los Ángeles Morera Calderón, in her capacity as acting general manager of the ICAA, reports under oath that: “(…) The application for service availability No. 2025-00100837-1, corresponding to the property registered under real property folio matrícula No. PRN02 and cadastral survey map No. 5-49002-2024, located in the district of Cañas Dulces, canton of Liberia, province of Guanacaste, was analyzed by the Engineering Directorate of the Chorotega Region, which issued technical opinion No. GSP-RCHO-2025-02672, dated 7 November 2025. Based on the technical studies, it was established that the appellant’s property is outside the aqueduct coverage area and that there is no distribution network in front of its boundaries. The nearest infrastructure is located approximately 95 meters away, on a public road, and consists of a 100 mm pipe with a pressure of 25 PSI. Accordingly, based on those conditions, it was determined that drinking water availability could not be granted because there is no infrastructure in front of the property. However, the technical opinion also confirmed that the Cañas Dulces system has sufficient water capacity to supply a single-family home at a flow rate of 0,60 m³ per day. For this reason, together with the negative decision, a water-capacity certificate was issued detailing the works the appellant had to carry out to enable the water service, including construction of an approximately 95-meter branch-line extension, as well as the fittings and other technically required components. (See Opinion No. GSP-RCHO-2025-02672). 2. It is important to emphasize to this Honorable Chamber that water-capacity certificates are not equivalent to immediately granting service availability, nor do they obligate AyA to construct the branch-line extension. The document allows the necessary procedures, designs, and permits to be obtained to develop primary infrastructure works, which must be built at the applicant’s expense in accordance with existing regulations, subject to institutional approval, oversight, and subsequent acceptance. The document also sets out all information concerning construction of the branch-line extension. In the case before us, the certificate of non-availability of services No. SIGDD-2025-00100837-1-2-NCCH and the water-capacity certificate No. SIGDD-2025-00100837-1-3-CCH, as well as technical opinion GSP-RCHO-2025-02672, were notified to the appellant on 17 November 2025 at the email address ...01. This report shows that the administrative omission alleged by the appellant is not true: the application was analyzed, decided, and notified. As for the schedule mentioned in the submission, it is not AyA’s responsibility, since the required works must be initiated and built by the interested person. Therefore, our actions have not been arbitrary, since this Institute recognized the available water capacity and established a concrete alternative by which the property may receive water service once the technical and administrative conditions, which were duly communicated, have been met. (See report GSP-RCH-CL-2026-00584). The Institute, in its capacity as provider of the public drinking-water service, is legally barred from granting service availability when the required technical and legal conditions are not met. The technical analyses determined that the property is outside the Cañas Dulces aqueduct coverage area and that there is no distribution network in front of its boundaries. For that reason, it was not possible to grant immediate drinking-water availability. According to the water-capacity certificate, which was notified, the works must be built by the appellant as indicated in AyA’s Service Provision Regulations.” The respondent asks the Chamber to dismiss the application.\n\n5.- The legal requirements have been observed in these proceedings.\n\nJustice Salazar Alvarado writes; and,\n\nREASONS:\n\nI.- SUBJECT OF THE AMPARO. The appellant states that on 06 November 2025, ICAA officials conducted a technical inspection of a property owned by the appellant for the purpose of authorizing drinking-water availability. During the visit, it was determined: a) There is currently no distribution network in front of the property. b) An extension is necessary to provide the service. c) The administrative file was referred for engineering review and technical assessment; however, despite the time that has elapsed, no final decision has been issued.\n\nII.- FACTS FOUND. The following facts, relevant to deciding this matter, are considered duly established, either because they have been proven or because the respondent failed to address them, as required by the initial order:\n\na) The property at issue in the amparo is identified by cadastral survey map number PRN01 and is located in the district of Cañas Dulces, canton of Liberia, province of Guanacaste (see evidence submitted).\n\nb) The application for service availability No. 2025-00100837-1, corresponding to the property registered under real property folio matrícula No. PRN02 and cadastral survey map No. PRN01, located in the district of Cañas Dulces, canton of Liberia, province of Guanacaste, was analyzed by the ICAA Engineering Directorate of the Chorotega Region (see report submitted under oath and evidence submitted).\n\nc) The ICAA issued technical opinion No. GSP-RCHO-2025-02672, dated 7 November 2025, which stated that the technical studies established that the property in question is outside the aqueduct coverage area and that there is no distribution network in front of its boundaries (see report submitted under oath and evidence submitted).\n\nd) Based on those technical studies, it was determined that drinking-water availability could not be granted because there is no infrastructure in front of the property (see report submitted under oath and evidence submitted).\n\ne) The certificate of non-availability of services No. SIGDD-2025-00100837-1-2-NCCH and the water-capacity certificate No. SIGDD-2025-00100837-1-3-CCH, as well as technical opinion GSP-RCHO-2025-02672, were notified to the appellant on 17 November 2025 at the email address ...01 (see report submitted under oath and evidence submitted).\n\nIII.- TECHNICAL IMPOSSIBILITIES THAT PREVENT THE SUPPLY OF DRINKING WATER. In Judgment No. 2010-001516 of 18:36 on 26 January 2010, this Chamber addressed technical or legal impossibilities to providing drinking-water service. On that occasion, it established the following:\n\n“IV.- On how the legal or formal impossibility of providing drinking-water service does not violate fundamental rights.—This Chamber’s settled case law has held that the supply of drinking water is considered under Costa Rican law to be a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously and efficiently, under equal conditions, and to adapt to technological changes (see Judgment 2001-09676, at 11:25 on 26 September 2001, and Judgment 2004-08161, at 10:53 on 23 July 2004). In this regard, it is clear that the Costa Rican Institute of Aqueducts and Sewers, as one of the state entities responsible for providing the public drinking-water service, is likewise required to provide that service continuously, adaptably, and efficiently, and equally to all inhabitants. However, despite all that has just been established, this Constitutional Court’s case law has also held that, in the face of legal impossibility (that is, failure to meet requirements set out in the applicable regulations) or formal impossibility (that is, the absence of a Water Distribution Network), it is reasonable not to grant service applications or to ask the interested party to bear installation costs when there is no drinking-water distribution network and infrastructure must be built. Thus, in these cases, it is clear that this is not a denial of access to drinking-water service, but rather an impossibility of providing it or the necessary participation of the interested party in overcoming a technical impossibility, namely, the lack of infrastructure. Of course, AyA, as a state entity principally responsible for providing drinking-water service, is obligated to expand its infrastructure so that more and more people can access this precious liquid; however, while gaps remain, the cooperation of interested parties is essential (see Decisions No. 2006-014218, at 15:04 on 26 September 2006, and No. 2007-11190, at 14:36 on 7 August 2007). In other words, when failure to provide drinking-water service is not capricious, arbitrary, or without basis, but is justified by legal or material impossibility, there is no violation of fundamental rights.”\n\nIV.- THE CASE BEFORE THE COURT. In the case under review, the appellant alleges that on 06 November 2025, ICAA officials conducted a technical inspection of a property owned by the appellant for the purpose of authorizing drinking-water availability. During the visit, it was determined: a) There is currently no distribution network in front of the property. b) An extension is necessary to provide the service. c) The administrative file was referred for engineering review and technical assessment; however, despite the time that has elapsed, no final decision has been issued. In this regard, the Chamber finds it established that the property at issue in the amparo is identified by cadastral survey map number PRN01 and is located in the district of Cañas Dulces, canton of Liberia, province of Guanacaste. The application for service availability No. 2025-00100837-1, corresponding to the property registered under real property folio matrícula No. PRN02 and cadastral survey map No. PRN01, located in the district of Cañas Dulces, canton of Liberia, province of Guanacaste, was analyzed by the ICAA Engineering Directorate of the Chorotega Region. The ICAA issued technical opinion No. GSP-RCHO-2025-02672, dated 7 November 2025, which stated that the technical studies established that the property in question is outside the aqueduct coverage area and that there is no distribution network in front of its boundaries. Based on those technical studies, it was determined that drinking-water availability could not be granted because there is no infrastructure in front of the property. The certificate of non-availability of services No. SIGDD-2025-00100837-1-2-NCCH and the water-capacity certificate No. SIGDD-2025-00100837-1-3-CCH, as well as technical opinion GSP-RCHO-2025-02672, were notified to the appellant on 17 November 2025 at the email address ...01. In light of this, the Chamber considers that the application must be dismissed. As can be seen from the established facts, the amparo applicant was notified that an actual or material impossibility prevents authorization of the public drinking-water service, since the property in question is outside the aqueduct coverage area and there is no distribution network in front of its boundaries. The cooperation of the interested person is therefore required to extend the existing infrastructure to the place where the new public service is intended to be installed. For the foregoing reasons, as this Court has held in its settled constitutional case law, there is no violation of the fundamental right of access to water in situations where a technical or material impossibility prevents provision of the service, as is the case here. Accordingly, for the reasons stated, the amparo must be dismissed.\n\nV.- DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, WITH THE FORMER WRITING. For the reasons set out below, we consider that this application should be granted. In the majority’s view, the judgment dismisses the amparo because, in its opinion, the challenged denial was not arbitrary or discriminatory but was based on technical criteria, such as insufficient hydraulic capacity in the supply system, specifically because of limitations in the existing transmission line and the system’s insufficient capacity to meet current demand without compromising the continuity, quality, and quantity of service for existing users. However, it fails to weigh adequately that access to drinking water is a fundamental right, indispensable to life, health, and human dignity. Article 21 of the Political Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Article 50 of the Constitution also imposes on the State a duty to ensure the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to take positive measures for its full realization. The State has a heightened obligation in a social and democratic state governed by the rule of law; for this reason, the supply of water is a priority obligation of the public authorities. A public-service provider cannot limit itself to confirming system deficiencies; it has a legal duty to plan, anticipate, and carry out the actions needed to progressively guarantee access to water service, especially for human consumption. This does not mean requiring the impossible, but rather requiring the adoption of reasonable, alternative, or progressive measures so as not to leave people without protection. Water is not just any service; it is an essential human right. For this reason, the respondent entity cannot disregard its duty to guarantee it by sheltering behind technical limitations without offering effective solutions. For these reasons, we consider that the application should be granted, at least to order the adoption of concrete, progressive measures to guarantee the amparo applicant effective access to drinking water within a reasonable time. Water is an asset and a fundamental right whose effective enjoyment must be ensured; this is an inescapable duty.\n\nVI.- DOCUMENTATION SUBMITTED TO THE FILE. The Chamber must advise the parties that any paper documents they submitted, as well as any objects or evidence stored on an additional device or in electronic, computer, magnetic, optical, telematic, or new-technology format, must be collected from the Court within thirty business days after receipt of notice of this judgment. Otherwise, all such material will be destroyed in accordance with the “Regulations on the Electronic Case File before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12, held on 03 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe application is dismissed.
