Nº 2026032030\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en el expediente nro. 26-024821-0007-CO, interpuesto por Nombre03, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).\n\nResultando:\n\n1.- Por escrito recibido en la Sala el 10 de julio de 2026, la persona accionante interpone un recurso de amparo. Manifiesta que es propietaria de una casa de habitación en Hatillo, en la cual residen tres personas. Comenta que el consumo normal y habitual de agua potable en su vivienda oscila entre 19.000 y un máximo de 27.000 colones mensuales. Sin embargo, alega que el Instituto Costarricense de Acueductos y Alcantarillados (ICAA) procedió a emitirle recibos de cobro por montos sumamente elevados de forma sucesiva en los últimos meses (327.072,00; 561.000.00; 216.000,00 colones). Arguye que el número de NIS afectado es el 3242798. Indica que, en virtud de lo anterior, se procedió a verificar la infraestructura de la vivienda y se constató que no existían fugas de agua, derrames ni ningún desperfecto que justificara un incremento tan desproporcionado en el consumo de un hogar en el que solo viven tres personas. Menciona que actualmente padece de cáncer de estómago y fue operada de cáncer de ovario; además, señala que se encuentra recibiendo quimioterapia. Arguye que, esa situación de cobros abusivos y la inminente amenaza de corte del servicio de agua, ital para su subsistencia e higiene médica, está agravando su estado de salud debido al estrés psicológico y la angustia que le genera. Manifiesta que interpuso un reclamo administrativo e intentó interponer ante el ICAA un recurso con apelación en subsidio; sin embargo, asegura que no quisieron recibirlo. Alega que, al día en que acude en amparo, la autoridad recurrida mantiene el cobro abusivo. Comenta que, de mantenerse ese cobro arbitrario, se encontraría en el inconveniente material de pagarlo, lo que provocaría el corte del servicio, lo cual sería catastrófico para su condición médica. Estima que la situación descrita lesiona sus derechos fundamentales. Solicita la intervención de la Sala en el presente asunto.\n\n2.- Por resolución de las 13:01 horas del 17 de julio de 2026 se dio curso al amparo.\n\n3.- Informa bajo juramento José Darío Guzmán Álvarez, en su condición de gerente general del ICAA, lo siguiente: “Vistos los alegatos de la recurrente, se procede a rendir este Informe de acuerdo con lo expuesto en los documentos: memorando No.UEN-SCC-GAM-2026-03017, de fecha 23 de julio de 2026, suscrito por Javier Jiménez Rivas, servidor de la UEN-Servicio al Cliente Comercial GAM, Informe de fecha 22 de julio de 2026, suscrito por Daniel Granados Miller, servidor de la UEN Servicio al Cliente Catastro GAM, adjunto al memorando No.UENSCCAT-GAM-2026-02716, de fecha 22 de julio de 2026, suscrito por el mismo servidor Daniel Granados Miller, y memorando No.UEN-SCMED-GAM-2026-01459, de fecha 23 de julio de 2026, suscrito por Nombre02, servidora de la UEN Servicio al Cliente Medición GAM. En tal sentido, se procede a informar lo siguiente: PRIMERO: Este asunto versa sobre la prestación del servicio de agua potable y alcantarillado sanitario registrado en el Sistema Comercial Integrado del AyA (SCI-OPEN), con el NIS 3242798 facturado a nombre de Nombre01, tarifa Metropolitana Residencial, código de localización PRN01, ubicado en San José, Hatillo, Ciudadela los Diamantes, y se encuentra activo en el campo (ver memorando No.UEN-SCC-GAM-2026-03017, de fecha 23 de julio de 2026). SEGUNDO: Es cierto que el NIS 3242798 registró altos consumos de agua potable en las facturas emitidas en los meses de diciembre de 2025, y enero, febrero, marzo, abril y junio del 2026. También, es cierto que los altos consumos facturados al servicio durante el año en curso han sido reclamados por el usuario del servicio (ver memorando No.UEN-SCCGAM-2026-03017, de fecha 23 de julio de 2026). Sin embargo, contrario a lo indicado por la recurrente, estos reclamos si fueron recibidos y resueltos por AyA por medio de inspecciones de campo registradas con las ordenes de servicio # 53578080 de fecha 30 de enero de 2026, # 53895894 de fecha 13 de marzo de 2026, # 54296457 de fecha 15 de mayo de 2026, y # 54533683 de fecha 05 de junio de 2026. En estas inspecciones se constató que al momento de cerrarse todas las llaves de las tuberías internas del inmueble el hidrómetro sigue registrando flujo de agua potable a lo interno de este, por lo que se presume la existencia de fugas en las instalaciones privadas del inmueble que se abastece del servicio (ver memorando No.UEN-SCC-GAM-2026- 03017, de fecha 23 de julio de 2026). También se constató el correcto funcionamiento de los sistemas de AyA (hidrómetro, caja de registro y red pública de agua potable) y de las lecturas registradas por el hidrómetro durante los meses facturados con altos consumos, siendo todo lo anterior realizado en presencia de la propia recurrente, a quien además se le emitieron recomendaciones técnicas que debe acoger por su cuenta para resolver la situación técnica detectada a lo interno del inmueble. En su efecto, se descarta que los altos consumos facturados al NIS 3242798 sean producidos por causas técnicas achacables a AyA (ver memorando No.UENSCC-GAM-2026-03017, de fecha 23 de julio de 2026). TERCERO: Al descartarse que los altos consumos facturados al NIS 3242798 sean producidos por causas técnicas achacables a AyA, no es procedente aplicar a ninguna de las facturas reclamadas la modificación que se habilita en el artículo 97 del Reglamento para la Prestación de los Servicios de AyA, publicado en Alcance 29 de La Gaceta Digital 27 del 09 de febrero de 2021 (en adelante RPSAyA) (ver memorando No.UEN-SCC-GAM2026-03017, de fecha 23 de julio de 2026). Al respecto, se informa que el artículo 97 del RPSAyA habilita la modificación de facturas que registran altos consumos cuando se comprueba cualquiera de las siguientes causales: i. Fuga en el hidrómetro y sus accesorios. ii. Lectura con consumo real acumulado por facturaciones consecutivas estimadas. iii. Prueba volumétrica cuyo resultado indique que el hidrómetro está fuera de la tolerancia permitida. iv. Afectación por la continuidad del servicio. v. Devolución de agua por ausencia o mal estado de válvula unidireccional (check). vi. Corrección de datos facturados. vii. Distribución de consumos. Lo anterior con apego a las políticas y procedimientos que se establezcan. Cuando se presenten reclamos por altos consumos y existan dudas sobre el funcionamiento del medidor, se podrá verificar la precisión a través de una prueba volumétrica. Para estos casos el registro acumulado del medidor a comprobar debe superar los 1000 M³. El pago de la tarifa de la prueba volumétrica deberá ser cancelada por el usuario, excepto que se compruebe el mal funcionamiento del medidor CUARTO: Ahora bien, ante los reclamos presentados por el recurrente en sede administrativa por los altos consumos facturados al NIS 3242798, AyA procedió aplicar a las facturas de febrero y marzo de 2026 el ajuste que habilita el artículo 95 del RPSAyA, y su modificación publicada en La Gaceta N° 121 Alcance N° 81, de fecha 2 de Julio del 2025, el cual a la letra indica: “(…) De los ajustes a la facturación por alto consumo. A solicitud del interesado, mediante generación de un reclamo por alto con-sumo o por alta facturación, el AyA podrá aplicar cada dieciocho (18) meses hasta dos (2) ajustes a las facturas leídas consecutivas, en aquellos servicios en categoría tarifaria residencial (uso domiciliar) conforme al cumplimiento de todas las condiciones siguientes: a) Que el consumo facturado sea igual o superior a los 40 metros cúbicos (40 M³)., b) Que el consumo supere en un 100% el consumo promedio normal de los últimos doce meses., y c) Que, el incremento en el consumo se haya originado por la ocurrencia de fuga. La aplicación del ajuste a la factura deberá respaldarse con el resultado de una inspección realizada por AyA al equipo de medición, denominada “Revisión a domicilio por medio del hidrómetro”. En caso de que el ajuste sea procedente, se realizará con base en el consumo promedio normal del abonado (…)” En este caso, quedó comprobada la responsabilidad del usuario por los altos consumos facturados al servicio producto del registro de fugas en las instalaciones privadas del inmueble mediante las ordenes de servicio # 53578080 de fecha 30 de enero de 2026, # 53895894 de fecha 13 de marzo de 2026, # 54296457 de fecha 15 de mayo de 2026, y # 54533683 de fecha 05 de junio de 2026 (ver memorando No.UEN-SCC-GAM-2026-03017, de fecha 23 de julio de 2026). Dicho ajuste generó una nota de crédito o rebaja para la factura de febrero de 2026 por un monto total de ¢183,720.85, quedando la misma por un importe de ¢32,493.15, la cual se encuentra cancelada. El ajuste aplicado a la facturación de marzo del 2026 generó una nota de crédito o rebaja por un monto total de ¢277,927.30, quedando la misma por un importe de ¢29,348.70, la cual se encuentra cancelada. Siendo que el mismo artículo 95 del RPSAyA limita la ejecución de ajustes cada dieciocho (18) meses hasta dos facturas leídas consecutivas, al comprobarse que al servicio se le aplicaron ajustes en las facturas de febrero y marzo de 2026, ya no es procedente aplicar más ajuste para las facturas de abril, mayo y junio del 2026, por lo que deben ser canceladas por el usuario mediante arreglo de pago o pago total de cada factura (ver memorando No.UEN-SCC-GAM-2026-03017, de fecha 23 de julio de 2026). QUINTO: Todo lo anterior quedó registrado en el sistema CRM de AyA (Customer Relationship Management), el cual registra las gestiones correspondientes a los reclamos, sus respectivas resoluciones, notificaciones y demás actuaciones efectuadas por el Instituto Costarricense de Acueductos y Alcantarillados (AyA) son administradas mediante o Gestión de Relaciones con el Cliente, plataforma institucional destinada al registro, control y seguimiento de las solicitudes presentadas por las personas usuarias (ver memorando No.UEN-SCC-GAM-2026-03017, de fecha 23 de julio de 2026). Para el caso concreto, se comprueba las siguientes interacciones: • Caso 12339821, creado el 09 de febrero del 2026, resolución de anomalía por Departamento de Facturación factura de febrero 2026, notificado el 09 de febrero del 2026(se adjunta notificación). • Caso 12358040, creado 02 de marzo del 2026, resolución de reclamo planteado por el usuario, aplicación de ajuste articulo 95 factura de febrero 2026 por analistas Nivel 2 Atención de Reclamos, notificado el 12 de marzo del 2026(se ad-junta notificación). • Caso 12377689, creado 24 de marzo del 2026, resolución de reclamo planteado por el usuario, aplicación de ajuste articulo 95 factura de marzo 2026 por analistas Nivel 2 Atención de Reclamos, notificado el 13 de abril del 2026(se adjunta notificación). • Caso 12405120, creado 27 de abril del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos factura abril 2026, notificado el 11 de mayo del 2026(se adjunta notificación). • Caso 12425087, creado 20 de mayo del 2026, usuario presenta carta de Estudios Técnicos, se brinda respuesta y notifica el 21 de julio del 2026(se adjunta notificación). • Caso 12431157, creado 27 de mayo del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos factura mayo 2026, notificado el 12 de junio del 2026(se adjunta notificación). • Caso 12458038, creado 29 de junio del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos, notificado el 30 de junio del 2026(se adjunta notificación. • Caso 12466156, creado 08 de julio del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos, notificado el 15 de julio del 2026(se adjunta notificación). SEXTO: Ante las facturas que se registran pendientes de pago en cualquier servicio en general, el Sistema Comercial Integrado OPEN (SCI-OPEN), procede a emitir “Prevenciones de Cobro”, tal y como ocurrió en este caso con la Prevención # 713860 emitida en fecha 03 de julio de 2026 y entregada en el inmueble que se abastece del NIS 3242798 en fecha 06 del mismo mes de julio, y que a la fecha registra la falta de pago de las facturas emitidas del 08/05/2026 al 15/07/2026 y que ascienden al monto de ¢942,392.00 (ver Informe de fecha 22 de julio de 2026 adjunto al memorando No.UENSCCAT-GAM-2026-02716). Es importante señalar que la prevención de cobro se trata de un documento que utiliza el AyA para informar a sus usuarios que en determinado servicio se encuentran facturas pendientes por cancelar, esta información es relevante para realizar los procesos de seguimiento, control y monitoreo de la morosidad. La prevención se realiza como mecanismo interno y alterno para prevenir e informar al cliente sobre la deuda y los riesgos a los que se podría ver expuesto en caso de que dicha deuda se mantenga (ver Informe de fecha 22 de julio de 2026 adjunto al memorando No.UEN-SCCAT-GAM-2026-02716). A pesar de la emisión de la “Prevención de Cobro” al servicio no se le ha generado expediente de cobro, y los usuarios del servicio tampoco ha presentado escritos, reclamos, recursos de revocatoria o similares producto de esta gestión (ver Informe de fecha 22 de julio de 2026 adjunto al memorando No.UEN-SCCAT-GAM-2026-02716). SETIMO: Si bien es cierto que los artículos 107 y 108 del RPSAyA, habilitan la desconexión de los servicios de agua potable, entre otras causas, por la falta de pago del servicio, posterior al cumplimiento de la fecha de cancelación de la factura, siempre y cuando en la facturación entregada o dispuesta al abonado en el lugar o medio señalado, se indique la fecha de vencimiento. Posterior a ello, la suspensión se hará efectiva antes de la siguiente facturación, en caso de subsistir el incumplimiento de pago En el caso del NIS PRN02, el SCI-OPEN registró la orden de desconexión por falta de pago de la factura de fecha 18 de junio de 2026, la cual asciende al monto de ¢516.218,00, y que tenía fecha de vencimiento al 15 de julio de 2026. No obstante, esta fue anulada por la UEN de Servicio al Cliente GAM con el fin de resolver un reclamo por alto consumo planteado por el usuario del servicio, de forma tal que no se ejecutó la desconexión del servicio. Abonado a lo anterior, se debe considera que la norma reglamentaria de referencia solo permite la desconexión de los servicios de agua potable por la falta de pago de la última factura puesta a cobro y no por la totalidad de la deuda que pueda registrar un servicio, por lo que en este caso, no es posible para AyA proceder con la desconexión hasta tanto no se registren nuevas facturas pendientes de pago al momento de ejecutarse la eventual desconexión, salvo que estas registren nuevos reclamos administrativos que vuelvan a anular las eventuales ordenes de desconexión (memorando No.UEN-SCMEDGAM-2026-01459, de fecha 23 de julio de 2026) CONCLUSIONES Las actuaciones de AyA están supeditadas al principio de legalidad que se regula en el artículo 11 de la Constitución Política y Ley General de la Administración Pública, Ley N°6227. De igual forma están supeditadas a la ciencia y técnica que se impone en el artículo 16 de la misma LGAP, como vinculantes en las actuaciones de la Administración Pública. En este caso, se constata que el recurso sobre la prestación del servicio de agua potable y alcantarillado sanitario registrado en el Sistema Comercial Integrado del AyA (SCI-OPEN), con el NIS 3242798 facturado a nombre de Nombre01, tarifa Metropolitana Residencial, código de localización PRN01, ubicado en San José, Hatillo, Ciudadela los Diamantes, y registra una deuda pendiente de pago que asciende al monto de ¢942,392.00. La deuda pendiente de pago que registra el NIS 3242798, se sustenta en altos consumos facturados el registro de fugas de agua potable en las instalaciones privadas de la propiedad que se abastece de este servicio, siendo lo anterior constatado por AyA en presencia de los usuarios del servicio al momento de ejecutarse las ordenes de servicio servicio # 53578080 de fecha 30 de enero de 2026, # 53895894 de fecha 13 de marzo de 2026, # 54296457 de fecha 15 de mayo de 2026, y # 54533683 de fecha 05 de junio de 2026, a quienes incluso, se les emitieron las recomendaciones técnicas respectivas para resolver la situación técnica detectada a lo interno del inmueble. La ejecución de estas ordenes de servicio, permitieron constatar la existencia de fujo de agua a lo interno del inmueble, y el correcto funcionamiento de los sistemas de AyA (hidrómetro, caja de registro y red pública de agua potable), así como de las lecturas registradas por el hidrómetro durante los meses facturados con altos consumos, En su efecto, se descarta que los altos consumos facturados al NIS 3242798 sean producidos por causas técnicas achacables a AyA. Bajo esta premisa, es importante recordar que el adecuado mantenimiento de las instalaciones internas de la propiedad constituye una responsabilidad de la persona usuaria. En ese sentido, el artículo 104, inciso a), del Reglamento para la Prestación de los Servicios del AyA dispone que corresponde al usuario mantener en buenas condiciones de funcionamiento, los sistemas e instalaciones internas, siendo el AyA no responsable por su mal funcionamiento ni por los daños o perjuicios que de ello puedan derivarse. Al descartarse que los altos consumos facturados al NIS 3242798 sean producidos por causas técnicas achacables a AyA, no es procedente aplicar a ninguna de las facturas reclamadas la modificación que se habilita en el artículo 97 del RPSAYA, pues no se cumple con ninguna de las condiciones habilitadas por la norma para tal fin. Sin embargo, ante los reclamos presentados por el recurrente, se procedió aplicar a las facturas de febrero y marzo de 2026 el ajuste que habilita el artículo 95 del RPSAyA, pues quedó comprobada la responsabilidad del usuario por los altos consumos facturados al servicio producto del registro de fugas en las instalaciones privadas del inmueble. Siendo que el mismo artículo 95 del RPSAyA limita la ejecución de ajustes cada dieciocho (18) meses y hasta dos facturas leídas consecutivas, ya no es procedente aplicar más ajuste para las facturas de abril, mayo y junio del 2026, por lo que deben ser canceladas por el usuario mediante arreglo de pago o pago total de cada factura. Todas las actuaciones ejecutadas por AyA para resolver los reclamos planteados por los altos consumos facturados al NIS 3242798 están registradas en el sistema CRM de AyA, específicamente, por medio de los casos 12339821, del 09 de febrero del 2026, 12358040, del 02 de marzo del 2026, 12377689, del 24 de marzo del 2026, 12405120, del 27 de abril del 2026, 12425087, del 20 de mayo del 2026, 12431157, del 27 de mayo del 2026, 12458038, del 29 de junio del 2026, y 12466156, del 08 de julio del 2026, todos los cuales han sido debidamente resueltos y notificados al usuario. Si bien es cierto que el SCI-OPEN procedió a emitir la Prevención # 713860 de fecha 03 de julio de 2026, la cual fue entregada en el inmueble que se abastece del NIS 3242798 en fecha 06 del mismo mes de julio, al servicio no se le ha generado expediente de cobro, y los usuarios del servicio tampoco ha presentado escritos, reclamos, recursos de revocatoria o similares producto de esta gestión. Por último, se destaca el hecho, de que, a la fecha, el NIS 3242798 tampoco ha sido objeto de la desconexión por falta de pago en la última factura puesta a cobro que se habilita en os artículos 107 y 108 del RPSAyA. En este caso, la última factura puesta a cobro data del 18 de junio de 2026, con fecha de vencimiento al 15 de julio de 2026, sin embargo, no fue objeto de desconexión ya que esta fue anulada ante los reclamos por alto consumo planteado por el usuario del servicio, por lo que en este caso, ya no es posible para AyA proceder con la desconexión hasta tanto no se registren nuevas facturas pendientes de pago al momento de ejecutarse la eventual desconexión, salvo que estas registren nuevos reclamos administrativos. Por lo tanto, a la fecha de este Informe, el NIS 3242798 se encuentra activo en el campo, brindando la prestación del servicio a los usuarios conforme a los parámetros que demanda el artículo 9 del RPSAyA, concretamente, dentro de los parámetros de prestación óptima en cuanto a calidad, cantidad, continuidad, confiabilidad, igualdad, acceso universal, eficiencia, oportunidad, sostenibilidad y con un enfoque de derechos humanos, salvo en casos de fuerza mayor, caso fortuito o periodos de mantenimiento debidamente divulgados que afecten la zona de cobertura donde está localizada la propiedad”.\n\n 4.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\nConsiderando:\n\nI.- Objeto del recurso. La parte recurrente indica que es usuaria del ICAA. Señala que ha recibido cobros abusivos en los últimos meses. Acusa que llevó “…un reclamo con apelación en subsidio…”; sin embargo, no se lo recibieron. \n\nII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial: \n\na) El servicio de agua potable NIS 3242798, está a nombre de Nombre01. (Ver informe rendido).\n\nb) En inspecciones del 30 de enero de 2026, 13 de marzo de 2026, 15 de mayo de 2026 y 5 de junio de 2026, efectuadas ante reclamos de la recurrente, se determinó que, al momento de cerrarse todas las llaves de las tuberías internas del inmueble, el hidrómetro seguía registrando flujo de agua potable a lo interno de este, por lo que se presume la existencia de fugas en las instalaciones privadas del inmueble. También se constató el correcto funcionamiento de los sistemas de ICAA (hidrómetro, caja de registro y red pública de agua potable) y de las lecturas registradas por el hidrómetro durante los meses facturados con altos consumos. (Ver informe rendido).\n\nc) El ICAA registra las siguientes interacciones con la parte accionante: “• Caso 12339821, creado el 09 de febrero del 2026, resolución de anomalía por Departamento de Facturación factura de febrero 2026, notificado el 09 de febrero del 2026(se adjunta notificación). • Caso 12358040, creado 02 de marzo del 2026, resolución de reclamo planteado por el usuario, aplicación de ajuste articulo 95 factura de febrero 2026 por analistas Nivel 2 Atención de Reclamos, notificado el 12 de marzo del 2026(se ad-junta notificación). • Caso 12377689, creado 24 de marzo del 2026, resolución de reclamo planteado por el usuario, aplicación de ajuste articulo 95 factura de marzo 2026 por analistas Nivel 2 Atención de Reclamos, notificado el 13 de abril del 2026(se adjunta notificación). • Caso 12405120, creado 27 de abril del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos factura abril 2026, notificado el 11 de mayo del 2026(se adjunta notificación). • Caso 12425087, creado 20 de mayo del 2026, usuario presenta carta de Estudios Técnicos, se brinda respuesta y notifica el 21 de julio del 2026(se adjunta notificación). • Caso 12431157, creado 27 de mayo del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos factura mayo 2026, notificado el 12 de junio del 2026(se adjunta notificación). • Caso 12458038, creado 29 de junio del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos, notificado el 30 de junio del 2026(se adjunta notificación. • Caso 12466156, creado 08 de julio del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos, notificado el 15 de julio del 2026(se adjunta notificación)”. (Ver informe rendido).\n\nIII.- Sobre el caso concreto. En el sub examine, la parte recurrente indica que es usuaria del ICAA. Señala que ha recibido cobros abusivos en los últimos meses. Acusa que llevó “…un reclamo con apelación en subsidio…”; sin embargo, no se lo recibieron.\n\nAnalizados los autos, la Sala tuvo por probado que, el servicio de agua potable NIS 3242798, está a nombre de Nombre01. En inspecciones del 30 de enero de 2026, 13 de marzo de 2026, 15 de mayo de 2026 y 5 de junio de 2026, efectuadas ante reclamos de la recurrente, se determinó que, al momento de cerrarse todas las llaves de las tuberías internas del inmueble, el hidrómetro seguía registrando flujo de agua potable a lo interno de este, por lo que se presume la existencia de fugas en las instalaciones privadas del inmueble. También se constató el correcto funcionamiento de los sistemas de ICAA (hidrómetro, caja de registro y red pública de agua potable) y de las lecturas registradas por el hidrómetro durante los meses facturados con altos consumos. \n\nCon respecto a supuesto cobro abusivo, el reclamo debe desestimarse, toda vez que no corresponde a la Sala verificar que el monto del recibo de agua sea el correcto:\n\n“II.- INADMISIBILIDAD DEL RECURSO. En el sub iudice, la parte accionante indica que durante años ha sido víctima de cobros abusivos y lecturas erróneas por parte del ICAA. Señala que en mayo efectuó un reclamo por un cobro ridículo, pero como no se respondió rápido, ya se acumularon tres recibos. Sostiene que el propio ICAA ha reconocido que existen anomalías en las lecturas del medidor. Acusa que el ICAA contestó que todo está bien y que deben cancelar el monto abusivo. Solicita que se ordene al ICAA anular los últimos tres meses de cobro. \n\nAsí las cosas, de la lectura integral del memorial de interposición se colige que lo acusado por la parte recurrente es su disconformidad con el monto que el ICAA le cobró en relación con el recibo de agua potable. Sobre el particular, advierta la parte amparada que no le corresponde a este Tribunal Constitucional determinar, de acuerdo con la normativa infraconstitucional que rige la materia y las particularidades del caso bajo estudio, si el monto consignado en el mencionado recibo es o no correcto, tampoco establecer si se produjo o no una fuga o errores en el medidor, ni si el ICAA debería ajustar la tarifa para que se equipare a los montos de consumo históricos registrados para ese servicio. Ello por cuanto tales diferendos corresponden ser dilucidados ante la propia autoridad recurrida o en la vía jurisdiccional ordinaria”. (Sentencia nro. 2026025310 de las 9:25 horas del 7 de julio de 2026).\n\nAtinente a la supuesta negativa a recibir los reclamos y recursos de la justiciable, la Sala tuvo por probado que el ICAA ha recibido y tramitado numerosos reclamos de ella: “• Caso 12339821, creado el 09 de febrero del 2026, resolución de anomalía por Departamento de Facturación factura de febrero 2026, notificado el 09 de febrero del 2026(se adjunta notificación). • Caso 12358040, creado 02 de marzo del 2026, resolución de reclamo planteado por el usuario, aplicación de ajuste articulo 95 factura de febrero 2026 por analistas Nivel 2 Atención de Reclamos, notificado el 12 de marzo del 2026(se ad-junta notificación). • Caso 12377689, creado 24 de marzo del 2026, resolución de reclamo planteado por el usuario, aplicación de ajuste articulo 95 factura de marzo 2026 por analistas Nivel 2 Atención de Reclamos, notificado el 13 de abril del 2026(se adjunta notificación). • Caso 12405120, creado 27 de abril del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos factura abril 2026, notificado el 11 de mayo del 2026(se adjunta notificación). • Caso 12425087, creado 20 de mayo del 2026, usuario presenta carta de Estudios Técnicos, se brinda respuesta y notifica el 21 de julio del 2026(se adjunta notificación). • Caso 12431157, creado 27 de mayo del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos factura mayo 2026, notificado el 12 de junio del 2026(se adjunta notificación). • Caso 12458038, creado 29 de junio del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos, notificado el 30 de junio del 2026(se adjunta notificación. • Caso 12466156, creado 08 de julio del 2026, resolución de reclamo planteado por el usuario por analistas Nivel 2 Atención de Reclamos, notificado el 15 de julio del 2026(se adjunta notificación)”.\n\nNótese que el último reclamo fue recibido tan solo dos días antes de la interposición del amparo. En ese tanto, no se verifica que alguna acción u omisión de la parte accionada en perjuicio de la tutelada. En virtud de lo expuesto, se declara sin lugar el recurso.\n\nIV.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. San José, at 9:20 a.m. on 20 August 2026.\n\nAmparo proceeding processed in case file no. 26-024821-0007-CO, filed by Nombre03, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (ICAA).\n\nBackground:\n\n1.- By submission received by the Chamber on 10 July 2026, the petitioner files an amparo proceeding. She states that she owns a residence in Hatillo, where three people live. She notes that normal and customary drinking-water consumption at her home ranges from 19.000 to a maximum of 27.000 colones per month. However, she alleges that the Costa Rican Institute of Aqueducts and Sewers (ICAA) successively issued her bills for extremely high amounts in recent months (327.072,00; 561.000.00; 216.000,00 colones). She argues that the affected NIS number is 3242798. She indicates that, as a result, the home's infrastructure was inspected and it was confirmed that there were no water leaks, overflows, or defects that would justify such a disproportionate increase in consumption in a household where only three people live. She mentions that she currently has stomach cancer and underwent surgery for ovarian cancer; she also states that she is receiving chemotherapy. She argues that this situation of abusive charges and the imminent threat of disconnection of the water service, which is vital to her subsistence and medical hygiene, is worsening her health due to the psychological stress and anguish it causes her. She states that she filed an administrative complaint and attempted to file with ICAA an appeal with a subsidiary appeal; however, she asserts that they refused to accept it. She alleges that, as of the date she seeks amparo, the respondent authority continues to impose the abusive charge. She notes that, if this arbitrary charge continues, she would be unable to pay it, which would result in disconnection of the service and would be catastrophic for her medical condition. She considers that the situation described violates her fundamental rights. She requests the Chamber's intervention in this matter.\n\n2.- By order issued at 13:01 on 17 July 2026, the amparo proceeding was admitted for processing.\n\n3.- José Darío Guzmán Álvarez, in his capacity as ICAA general manager, reports under oath as follows: “Having reviewed the petitioner's allegations, this report is submitted in accordance with the documents: memorandum No.UEN-SCC-GAM-2026-03017, dated 23 July 2026, signed by Javier Jiménez Rivas, employee of UEN-Servicio al Cliente Comercial GAM; report dated 22 July 2026, signed by Daniel Granados Miller, employee of UEN Servicio al Cliente Catastro GAM, attached to memorandum No.UENSCCAT-GAM-2026-02716, dated 22 July 2026, signed by the same employee Daniel Granados Miller; and memorandum No.UEN-SCMED-GAM-2026-01459, dated 23 July 2026, signed by Nombre02, employee of UEN Servicio al Cliente Medición GAM. Accordingly, the following is reported: FIRST: This matter concerns the provision of drinking-water and sanitary-sewer services recorded in AyA's Integrated Commercial System (SCI-OPEN), under NIS 3242798, billed in the name of Nombre01, at the Metropolitan Residential rate, location code PRN01, located in San José, Hatillo, Ciudadela los Diamantes, and is active in the field (see memorandum No.UEN-SCC-GAM-2026-03017, dated 23 July 2026). SECOND: It is true that NIS 3242798 recorded high drinking-water consumption on bills issued in December 2025 and January, February, March, April, and June 2026. It is also true that the user of the service has disputed the high consumption billed during the current year (see memorandum No.UEN-SCCGAM-2026-03017, dated 23 July 2026). However, contrary to what the petitioner stated, these complaints were received and resolved by AyA through field inspections recorded under service orders # 53578080 dated 30 January 2026, # 53895894 dated 13 March 2026, # 54296457 dated 15 May 2026, and # 54533683 dated 05 June 2026. During these inspections, it was established that when all the valves on the property's internal pipes were closed, the water meter continued to register drinking-water flow inside the property. The existence of leaks in the private installations of the property supplied by the service is therefore presumed (see memorandum No.UEN-SCC-GAM-2026-03017, dated 23 July 2026). The proper functioning of AyA's systems (water meter, meter box, and public drinking-water network) and of the meter readings recorded during the months billed for high consumption was also confirmed. All of this was done in the petitioner's presence, and she was also given technical recommendations to implement at her own expense to resolve the technical issue detected inside the property. Accordingly, it is ruled out that the high consumption billed to NIS 3242798 was caused by technical issues attributable to AyA (see memorandum No.UENSCC-GAM-2026-03017, dated 23 July 2026). THIRD: Since it has been ruled out that the high consumption billed to NIS 3242798 was caused by technical issues attributable to AyA, it is not appropriate to modify any of the disputed bills under Article 97 of the Regulations for the Provision of AyA Services, published in Supplement 29 to La Gaceta Digital 27 of 09 February 2021 (hereinafter, RPSAyA) (see memorandum No.UEN-SCC-GAM2026-03017, dated 23 July 2026). In this regard, it is reported that Article 97 of the RPSAyA authorizes modification of bills recording high consumption when any of the following grounds is established: i. A leak in the water meter and its accessories. ii. A reading reflecting actual consumption accumulated over consecutive estimated bills. iii. A volumetric test whose result indicates that the water meter is outside the permitted tolerance. iv. An effect caused by interruption in service continuity. v. Return flow due to the absence or poor condition of a one-way valve (check valve). vi. Correction of billed data. vii. Allocation of consumption. The foregoing is subject to the policies and procedures established. When complaints are made about high consumption and there is doubt about the meter's operation, its accuracy may be checked by means of a volumetric test. In such cases, the meter's accumulated reading must exceed 1000 M³. The user must pay the fee for the volumetric test unless improper meter operation is confirmed. FOURTH: However, in response to the complaints made by the petitioner in the administrative forum about the high consumption billed to NIS 3242798, AyA applied to the February and March 2026 bills the adjustment authorized by Article 95 of the RPSAyA, as amended and published in La Gaceta N° 121, Supplement N° 81, dated 2 July 2025, which provides as follows: “(…) Adjustments to bills for high consumption. At the interested party's request, by filing a complaint concerning high consumption or a high bill, AyA may apply up to two (2) adjustments to consecutively metered bills every eighteen (18) months for services in the residential rate category (household use), provided all of the following conditions are met: a) The billed consumption is equal to or greater than 40 cubic meters (40 M³); b) Consumption exceeds the normal average consumption of the previous twelve months by 100%; and c) The increase in consumption resulted from a leak. The bill adjustment must be supported by the result of an inspection of the metering equipment conducted by AyA, called an ‘In-home inspection by means of the water meter.’ If the adjustment is appropriate, it will be based on the subscriber's normal average consumption (…)” In this case, the user's responsibility for the high consumption billed to the service, resulting from leaks recorded in the property's private installations, was established through service orders # 53578080 dated 30 January 2026, # 53895894 dated 13 March 2026, # 54296457 dated 15 May 2026, and # 54533683 dated 05 June 2026 (see memorandum No.UEN-SCC-GAM-2026-03017, dated 23 July 2026). That adjustment generated a credit note or reduction of ¢183,720.85 on the February 2026 bill, leaving an amount of ¢32,493.15, which has been paid. The adjustment applied to the March 2026 bill generated a credit note or reduction of ¢277,927.30, leaving an amount of ¢29,348.70, which has been paid. Since Article 95 of the RPSAyA limits adjustments to up to two consecutively metered bills every eighteen (18) months, and adjustments were applied to the February and March 2026 bills for this service, no further adjustment may be applied to the April, May, and June 2026 bills. The user must therefore pay them through a payment arrangement or by paying each bill in full (see memorandum No.UEN-SCC-GAM-2026-03017, dated 23 July 2026). FIFTH: All of the foregoing was recorded in AyA's CRM (Customer Relationship Management) system, which logs actions corresponding to complaints, their respective resolutions and notifications, and other actions carried out by the Costa Rican Institute of Aqueducts and Sewers (AyA), administered through Customer Relationship Management, an institutional platform intended to record, control, and track requests submitted by users (see memorandum No.UEN-SCC-GAM-2026-03017, dated 23 July 2026). In this specific case, the following interactions are confirmed: • Case 12339821, created on 09 February 2026, billing anomaly resolved by the Billing Department for the February 2026 bill, notification sent on 09 February 2026 (notification attached). • Case 12358040, created 02 March 2026, resolution of complaint filed by the user, Article 95 adjustment applied to the February 2026 bill by Level 2 Complaint Handling analysts, notification sent on 12 March 2026 (notification attached). • Case 12377689, created 24 March 2026, resolution of complaint filed by the user, Article 95 adjustment applied to the March 2026 bill by Level 2 Complaint Handling analysts, notification sent on 13 April 2026 (notification attached). • Case 12405120, created 27 April 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts concerning the April 2026 bill, notification sent on 11 May 2026 (notification attached). • Case 12425087, created 20 May 2026, user submits a letter from Estudios Técnicos; a response is provided and notification sent on 21 July 2026 (notification attached). • Case 12431157, created 27 May 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts concerning the May 2026 bill, notification sent on 12 June 2026 (notification attached). • Case 12458038, created 29 June 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts, notification sent on 30 June 2026 (notification attached). • Case 12466156, created 08 July 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts, notification sent on 15 July 2026 (notification attached). SIXTH: For bills that remain unpaid for any service generally, the Integrated Commercial System OPEN (SCI-OPEN) issues “Payment Notices,” as occurred in this case with Notice # 713860, issued on 03 July 2026 and delivered to the property supplied under NIS 3242798 on 06 July of the same month. As of today, the record shows bills issued from 08/05/2026 through 15/07/2026 remain unpaid, totaling ¢942,392.00 (see report dated 22 July 2026 attached to memorandum No.UENSCCAT-GAM-2026-02716). It is important to note that a payment notice is a document AyA uses to inform its users that bills for a given service remain unpaid. This information is relevant to follow-up, control, and monitoring of delinquency. The notice is an internal and alternative mechanism to warn and inform the customer about the debt and the risks to which they might be exposed if the debt remains unpaid (see report dated 22 July 2026 attached to memorandum No.UEN-SCCAT-GAM-2026-02716). Despite issuance of the “Payment Notice,” no collection case file has been opened for the service, and the service users have not submitted any written filings, complaints, requests for reconsideration, or similar documents as a result of this action (see report dated 22 July 2026 attached to memorandum No.UEN-SCCAT-GAM-2026-02716). SEVENTH: Although Articles 107 and 108 of the RPSAyA authorize disconnection of drinking-water services, among other grounds, for nonpayment after the bill's payment date, provided the bill delivered or made available to the subscriber at the indicated place or by the indicated means states the due date, suspension will take effect before the next billing if the failure to pay continues. In the case of NIS PRN02, SCI-OPEN recorded a disconnection order for nonpayment of the bill dated 18 June 2026, in the amount of ¢516.218,00, which was due on 15 July 2026. However, the Customer Service UEN GAM cancelled it in order to resolve a complaint about high consumption filed by the service user, and therefore the service was not disconnected. In addition, it must be considered that the referenced regulation allows drinking-water services to be disconnected only for nonpayment of the most recent bill issued for collection, and not for the entire debt a service may have recorded. Therefore, in this case AyA cannot proceed with disconnection until new unpaid bills are recorded when the potential disconnection is carried out, unless new administrative complaints are filed concerning those bills and again result in potential disconnection orders being cancelled (memorandum No.UEN-SCMEDGAM-2026-01459, dated 23 July 2026). CONCLUSIONS AyA's actions are subject to the principle of legality set out in Article 11 of the Political Constitution and the General Law of Public Administration, Law N°6227. They are likewise subject to the science and technology requirement imposed by Article 16 of the same LGAP, which is binding on Public Administration actions. In this case, it is confirmed that the complaint concerning the provision of drinking-water and sanitary-sewer services recorded in AyA's Integrated Commercial System (SCI-OPEN), under NIS 3242798, billed in the name of Nombre01, at the Metropolitan Residential rate, location code PRN01, located in San José, Hatillo, Ciudadela los Diamantes, has an outstanding balance of ¢942,392.00. The outstanding debt recorded for NIS 3242798 is based on high consumption billed due to recorded drinking-water leaks in the private installations of the property supplied by this service. AyA confirmed this in the presence of the service users when carrying out service orders # 53578080 dated 30 January 2026, # 53895894 dated 13 March 2026, # 54296457 dated 15 May 2026, and # 54533683 dated 05 June 2026, and even issued them the relevant technical recommendations for resolving the technical issue detected inside the property. Carrying out these service orders made it possible to confirm water flow inside the property and the proper functioning of AyA's systems (water meter, meter box, and public drinking-water network), as well as the meter readings recorded during the months billed for high consumption. Accordingly, it is ruled out that the high consumption billed to NIS 3242798 was caused by technical issues attributable to AyA. On this basis, it is important to recall that proper maintenance of a property's internal installations is the user's responsibility. In that regard, Article 104(a) of the Regulations for the Provision of AyA Services provides that the user is responsible for maintaining the internal systems and installations in good working order, and that AyA is not responsible for their improper operation or any damage or harm that may result from it. Since it has been ruled out that the high consumption billed to NIS 3242798 was caused by technical issues attributable to AyA, it is not appropriate to modify any of the disputed bills under Article 97 of the RPSAYA, because none of the conditions authorized by the regulation for that purpose has been met. However, in response to the petitioner's complaints, the adjustment authorized by Article 95 of the RPSAyA was applied to the February and March 2026 bills, because the user's responsibility for the high consumption billed to the service, resulting from leaks recorded in the property's private installations, was established. Since Article 95 of the RPSAyA limits adjustments to up to two consecutively metered bills every eighteen (18) months, no further adjustment may be applied to the April, May, and June 2026 bills. The user must therefore pay them through a payment arrangement or by paying each bill in full. All actions taken by AyA to resolve the complaints concerning the high consumption billed to NIS 3242798 are recorded in AyA's CRM system, specifically through cases 12339821, dated 09 February 2026; 12358040, dated 02 March 2026; 12377689, dated 24 March 2026; 12405120, dated 27 April 2026; 12425087, dated 20 May 2026; 12431157, dated 27 May 2026; 12458038, dated 29 June 2026; and 12466156, dated 08 July 2026. All of these were duly resolved and notified to the user. Although SCI-OPEN issued Payment Notice # 713860 dated 03 July 2026, which was delivered to the property supplied under NIS 3242798 on 06 July of the same month, no collection case file has been opened for the service, and the service users have not submitted any written filings, complaints, requests for reconsideration, or similar documents as a result of this action. Finally, it is noted that, as of today, NIS 3242798 has not been disconnected for nonpayment of the most recent bill issued for collection, as authorized by Articles 107 and 108 of the RPSAyA. In this case, the most recent bill issued for collection is dated 18 June 2026 and was due on 15 July 2026. However, it was not subject to disconnection because the order was cancelled in response to the user's complaint about high consumption. Therefore, in this case AyA can no longer proceed with disconnection until new unpaid bills are recorded when a potential disconnection is carried out, unless new administrative complaints are filed concerning them. Accordingly, as of the date of this report, NIS 3242798 is active in the field, providing service to users in accordance with the parameters required by Article 9 of the RPSAyA, specifically, within the standards for optimal service in terms of quality, quantity, continuity, reliability, equality, universal access, efficiency, timeliness, sustainability, and a human-rights approach, except in cases of force majeure, unforeseeable events, or duly publicized maintenance periods affecting the coverage area where the property is located.”\n\n4.- The legal requirements have been observed in the proceedings.\n\nJustice Rueda Leal drafts the decision; and,\n\nReasons:\n\nI.- Subject of the amparo. The petitioner states that she is an ICAA user. She indicates that she has received abusive charges in recent months. She alleges that she filed “…a complaint with an appeal in the alternative…”; however, it was not accepted.\n\nII.- Facts found. The following facts are considered duly established and relevant to deciding this matter, either because they were so proven or because the respondent failed to address them, as provided in the initial order:\n\na) Drinking-water service NIS 3242798 is in the name of Nombre01. (See report submitted).\n\nb) Inspections on 30 January 2026, 13 March 2026, 15 May 2026, and 5 June 2026, conducted in response to the petitioner's complaints, determined that when all the valves on the property's internal pipes were closed, the water meter continued to register drinking-water flow inside the property, and the existence of leaks in the property's private installations was therefore presumed. The proper functioning of ICAA's systems (water meter, meter box, and public drinking-water network) and the meter readings recorded during the months billed for high consumption were also confirmed. (See report submitted).\n\nc) ICAA records the following interactions with the petitioner: “• Case 12339821, created on 09 February 2026, billing anomaly resolved by the Billing Department for the February 2026 bill, notification sent on 09 February 2026 (notification attached). • Case 12358040, created 02 March 2026, resolution of complaint filed by the user, Article 95 adjustment applied to the February 2026 bill by Level 2 Complaint Handling analysts, notification sent on 12 March 2026 (notification attached). • Case 12377689, created 24 March 2026, resolution of complaint filed by the user, Article 95 adjustment applied to the March 2026 bill by Level 2 Complaint Handling analysts, notification sent on 13 April 2026 (notification attached). • Case 12405120, created 27 April 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts concerning the April 2026 bill, notification sent on 11 May 2026 (notification attached). • Case 12425087, created 20 May 2026, user submits a letter from Estudios Técnicos; a response is provided and notification sent on 21 July 2026 (notification attached). • Case 12431157, created 27 May 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts concerning the May 2026 bill, notification sent on 12 June 2026 (notification attached). • Case 12458038, created 29 June 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts, notification sent on 30 June 2026 (notification attached). • Case 12466156, created 08 July 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts, notification sent on 15 July 2026 (notification attached)”. (See report submitted).\n\nIII.- The specific case. In the present case, the petitioner states that she is an ICAA user. She indicates that she has received abusive charges in recent months. She alleges that she filed “…a complaint with an appeal in the alternative…”; however, it was not accepted.\n\nUpon review of the case file, the Chamber found that drinking-water service NIS 3242798 is in the name of Nombre01. Inspections on 30 January 2026, 13 March 2026, 15 May 2026, and 5 June 2026, conducted in response to the petitioner's complaints, determined that when all the valves on the property's internal pipes were closed, the water meter continued to register drinking-water flow inside the property, and the existence of leaks in the property's private installations was therefore presumed. The proper functioning of ICAA's systems (water meter, meter box, and public drinking-water network) and the meter readings recorded during the months billed for high consumption were also confirmed.\n\nRegarding the alleged abusive charge, the complaint must be dismissed, since it is not for the Chamber to verify whether the water bill amount is correct:\n\n“II.- INADMISSIBILITY OF THE AMPARO APPLICATION. In the case under review, the petitioner states that for years she has been a victim of abusive charges and erroneous readings by ICAA. She indicates that in May she filed a complaint about a ridiculous charge, but because there was no prompt response, three bills have now accumulated. She maintains that ICAA itself has acknowledged irregularities in meter readings. She alleges that ICAA responded that everything was in order and that the abusive amount must be paid. She asks that ICAA be ordered to cancel the charges for the last three months.\n\nThus, a comprehensive reading of the amparo application shows that the petitioner is challenging her disagreement with the amount ICAA charged her for drinking-water service. In this regard, the amparo petitioner is advised that it is not for this Constitutional Court to determine, under the subconstitutional rules governing the matter and the particular circumstances of the case under review, whether the amount shown on that bill is correct, or to establish whether a leak or meter errors occurred, or whether ICAA should adjust the rate to match historical consumption amounts recorded for that service. Such disputes must be resolved before the respondent authority itself or through the ordinary judicial process.” (Judgment no. 2026025310, at 9:25 a.m. on 7 July 2026).\n\nRegarding the alleged refusal to accept the petitioner's complaints and appeals, the Chamber found that ICAA had received and processed numerous complaints from her: “• Case 12339821, created on 09 February 2026, billing anomaly resolved by the Billing Department for the February 2026 bill, notification sent on 09 February 2026 (notification attached). • Case 12358040, created 02 March 2026, resolution of complaint filed by the user, Article 95 adjustment applied to the February 2026 bill by Level 2 Complaint Handling analysts, notification sent on 12 March 2026 (notification attached). • Case 12377689, created 24 March 2026, resolution of complaint filed by the user, Article 95 adjustment applied to the March 2026 bill by Level 2 Complaint Handling analysts, notification sent on 13 April 2026 (notification attached). • Case 12405120, created 27 April 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts concerning the April 2026 bill, notification sent on 11 May 2026 (notification attached). • Case 12425087, created 20 May 2026, user submits a letter from Estudios Técnicos; a response is provided and notification sent on 21 July 2026 (notification attached). • Case 12431157, created 27 May 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts concerning the May 2026 bill, notification sent on 12 June 2026 (notification attached). • Case 12458038, created 29 June 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts, notification sent on 30 June 2026 (notification attached). • Case 12466156, created 08 July 2026, resolution of complaint filed by the user by Level 2 Complaint Handling analysts, notification sent on 15 July 2026 (notification attached)”.\n\nIt should be noted that the most recent complaint was received just two days before the amparo application was filed. Accordingly, no action or omission by the respondent party to the detriment of the protected party has been established. In light of the foregoing, the amparo application is dismissed.\n\nIV.- Documents submitted to the case file. The parties are advised that, if they submitted any paper document, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must be collected within a maximum period of 30 business days from notification of this judgment. They are warned that any material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary, dated 3 May 2012.\n\nTherefore:\n\nThe amparo application is dismissed.\n\n \n\nFernando Castillo V.\n\nPresident\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.
