  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-025207-0007-CO \n\nRes. Nº 2026032048\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita en expediente 26-025207-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA S.A.\n\nResultando:\n\n1.- Por escrito recibido en la Secretaría de la Sala el 14 de julio de 2026, el recurrente interpone recurso de amparo. Alega: “1. Soy legítimo propietario de un derecho en la finca inscrita en el Registro Nacional bajo el folio real número PRN01 ubicada en PROVINCIA HEREDIA, CANTON BARVA, DISTRITO SAN JOSE DE LA MONTAÑA, Dirección01 2. Desde hace 50 años vivo en dicha propiedad, la cual se ubica frente a la calle pública, he presentado ante la EMPRESA DE SERVICIOS PUBLICOS DE HEREDIA, solicitudes para la instalación de una paja de agua potable en mi propiedad, gestión esencial para garantizar la satisfacción de necesidades básicas y el goce de una vida digna, tanto para mi familia como para quienes habitan el inmueble. 3. Pese a haber cumplido en debida forma con los trámites, requisitos legales y administrativos, la EMPRESA DE SERVICIOS PUBLICOS DE HEREDIA, ha denegado de manera infundada la autorización e instalación de la paja de agua solicitada, sin aportar razonamiento técnico ni base jurídica que justifique tal negativa. 4. Debo indicar que las propiedades que están al otro lado de la calle de mi propiedad si cuentan con el servicio de agua potable. 5. He tenido que solventar mi necesidad de agua con mangueras que traigo agua desde la montaña hasta mi humilde casa 6. Dicha negativa vulnera gravemente mis derechos a la salud, a una vida digna y al acceso a servicios públicos indispensables, generando un perjuicio directo y poniendo en riesgo mi salud como adulto mayor que vivo solo desde que murió mi esposa, no tengo trabajo solo una pensión del seguro, mi casa es de madera muy humilde y repito tengo 50 años de vivir ahí. Derechos Fundamentales Lesionados Artículo 21 de la Constitución Política: Derecho a la vida. Artículo 50 de la Constitución Política: Derecho a un ambiente sano y ecológicamente equilibrado. Jurisprudencia reiterada de esa Sala Constitucional respecto del acceso al agua potable como derecho fundamental. Convenios internacionales sobre derechos humanos ratificados por Costa Rica. Petitorio Por lo expuesto, solicito muy respetuosamente a las señoras y señores Magistrados: 1. Declarar con lugar el presente recurso de amparo. 2. Ordenar a la EMPRESA DE SERVICIOS PUBLICOS DE HEREDIA que, en el plazo más breve posible, autorice y gestione la instalación de la paja de agua potable en mi propiedad, garantizando el acceso efectivo e inmediato al servicio. 3. Disponer cualquier otra medida que estime pertinente para restablecer de manera plena el goce de mis derechos fundamentales”. \n\n2.- Mediante resolución dictada a las 23:00 horas del 20 de julio de 2026, la Presidencia de la Sala dio curso al proceso y solicitó informe al gerente general de la Empresa de Servicios Públicos de Heredia. \n\n3.- Por escrito recibido en la Secretaría de la Sala el 27 de julio de 2026, contesta la audiencia Laura Castro Chaves en su condición de apoderada generalísima de la Empresa de Servicios Públicos de Heredia. Expone: “Respecto al hecho uno: Es cierto. Respecto al hecho dos: Es parcialmente cierto, se procede a explicar: No es cierto que el recurrente haya presentado diversas solicitudes para la instalación del servicio de agua potable. De la revisión de los registros de la Empresa de Servicios Públicos de Heredia S.A. consta una solicitud presentada por el señor Nombre01, correspondiente al año 2019, relacionada con la solicitud de disponibilidad de servicio de agua potable para la finca matrícula folio real PRN02. Esa solicitud fue debidamente atendida mediante el oficio SCM-SC-CP-1558-2019-C, de fecha 5 de septiembre de 2019, mediante el cual se informó al señor Nombre01 las razones que impedían el otorgamiento del servicio. (Véase prueba oficio APH-ON-lG-337- 2026) Respecto al hecho tres: No es cierto se procede a explicar: No es cierto que el recurrente cumpla con los requisitos legales para obtener el servicio de agua potable ni que la negativa de la ESPH S.A. haya sido infundada o sin base jurídica. En el oficio SCM-SC-CP-1558-2019-C de fecha 5 de septiembre de 2019, con el que se atendió la única solicitud registrada a nombre del recurrente, se le informó que la finca folio real PRN02 con plano catastrado H-0554377-1999 se encuentra dentro de la Zona de restricción absoluta, para el cual regula: Áreas de protección que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal, según artículo 33 de la Ley Forestal (NO 7575, 13 de febrero de 1996) y las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio, según artículo 31 de la Ley Agua. Estos lineamientos tomados por el acuerdo de Junta Directiva JD-021-2017 del 4 de febrero del 2017 sin periodo de vigencia. En esta zona la Empresa de Servicios Públicos de Heredia S. A., no otorgará servicios de energía eléctrica ni de agua potable, bajo ninguna circunstancia. \"La finca matrícula N.° PRN02, inscrita bajo el plano catastrado H-0554377-1999, se encuentra parcialmente comprendida dentro del radio de protección de doscientos metros establecido en el artículo 31 de la Ley de Aguas, con respecto a la naciente denominada \"Iris Hernández\". El área de la propiedad ubicada dentro de dicho radio de protección comprende el frente colindante con la vía pública (Véase prueba uno-oficio APH-ON-IG337-2026). Dicha naciente cuenta con concesión de aprovechamiento de aguas tramitada bajo el expediente administrativo N. 0 3073-A, cuya gestión fue iniciada ante la Dirección de Agua del Ministerio de Ambiente y Energía (MINAE) desde el año 1984 (véase prueba documental-folio 06 y siguientes). Posteriormente, la concesión fue renovada mediante la Resolución N. O R-0808-2019-AGUAS-MlNAE, de fecha 23 de julio de 2019 (véase prueba documental folio 18 y siguientes). En razón de dicho radio de protección, la Junta Directiva de la ESPH S.A., mediante el Acuerdo JD-240-2022, dispuso mantener las Zonas de Prohibición Absoluta y las Zonas de Protección de Nacientes, estableciendo expresamente que dentro de dichas áreas no se otorgarán servicios de agua potable ni de energía eléctrica, salvo las excepciones previstas para fines institucionales o ambientales. El Reglamento Técnico para la Prestación del Suministro de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes (AR-RT-SUMAAH-2023) en el artículo 22 establece que el otorgamiento de nuevos servicios requiere el cumplimiento de las condiciones técnicas, legales y ambientales. El artículo 18 de este mismo reglamento establece como impedimento para brindar nuevos servicios de acueducto, el \"Incumplimiento a las leyes o regulaciones del servicio y los inmueble ubicado en un área declarada como zona con protección. Serán causas que impidan al prestador brindar nuevos servicios de acueducto y de alcantarillado sanitario, las siguientes: a. Incumplimiento a las leyes o regulaciones del servicio; b. Problemas en la red interna que pongan en peligro de contaminación el sistema público de acueducto; c. Peligro o emergencia debidamente identificada, que afecte a personas o propiedades privadas o públicas; d. Incapacidad o negativa para corregir cualquier deficiencia o defecto en el sistema interno que haya sido reportado por el prestador o autoridad competente; e. La solicitud corresponda a un inmueble ubicado en un área declarada como zona con protección según con lo que dispone la Ley No. 7788 Ley de Biodiversidad y su reglamento; f. El inmueble por servir se encuentre fuera del área de cobertura del prestador; g. Cuando no sea técnicamente factible brindar el servicio. Como se indicó, el inmueble del cual el señor Nombre01 es copropietario se encuentra ubicado en el radio de protección de los doscientos metros establecido en el artículo 31 de la Ley de Aguas. Artículo 31.- Se declaran como reserva de dominio a favor de la Nación: a) Las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio; b) La zona forestal que protege o debe proteger el conjunto de terrenos en que se produce la infiltración de aguas potables, así como el de los que dan asiento a cuencas hidrográficas y márgenes de depósito, fuentes surtidoras o curso permanente de las mismas aguas. La ESPH SA como prestadora de servicios de agua potable, de energía eléctrica y de agua residual debe cumplir las disposiciones del Estado dirigidas a la protección de los recursos naturales. Con fundamento en la Ley n. 0 7789, la ESPH SA administra de manera responsable y apegada a las normativas de derecho ambiental existentes las eventuales limitaciones de los servicios públicos que presta. Siendo esta misma ley en su artículo 6, inciso g), la que atribuye a la ESPHSA la responsabilidad de asumir la conservación, administración y explotación racional de los recursos energéticos e hídricos en la región de Heredia, y proteger las cuencas, los manantiales, los cauces y los lechos de los ríos, corrientes superficiales de agua y mantos acuíferos. Las actuaciones de mi representada están orientadas a la protección del recurso hídrico y del ambiente, de conformidad con nuestra Constitución Política artículo 50: \"Artículo 50. El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La naciente denominada Nombre03 es una toma surtidora de agua potable, por lo que el no otorgamiento del servicio corresponde a una decisión motivada en la protección del recurso hídrico con fundamento en la ley, disposiciones reglamentarias de ARESEP y de la propia empresa, razón por la cual resulta incorrecta la afirmación del recurrente de que se ha denegado el servicio de manera infundada y sin justificación. Respecto al hecho cuatro: Es parcialmente cierto, se procede a explicar: Cada solicitud debe analizarse conforme a las condiciones jurídicas, técnicas y ambientales propias del inmueble objeto de la gestión al momento de recibir la solicitud para servicio de agua potable. Cabe recalcar que, en el presente caso, la finca del recurrente se encuentra afectada por el radio de doscientos metros del artículo 31 de la Ley de Aguas. De conformidad con la información obtenida del Sistema de Información Geográfico del NAPH, del Sistema de Información del Registro Inmobiliario de Costa Rica y del Sistema de Gestión Comercial de la ESPH SA, el Negocio de Agua Potable e Hidrantes informa que, frente a la finca PRN02, se localizan las siguientes propiedades: Finca 4 61208-000, inscrita a nombre de Nombre02, la cual se abastece mediante el contrato N O 8765, con servicio de agua potable instalado desde el 31 de agosto de 1979 Finca PRN03, inscrita a nombre de Nombre04, la cual se abastece mediante el contrato N O 571255, con servicio de agua potable instalado desde el 31 de agosto de 1981 Al respecto, es importante precisar que los servicios de agua potable a los que se hace referencia fueron otorgados a finales de la década de 1970 e inicios de la década de 1980. No obstante, según consta en el expediente de la Dirección de Agua del Ministerio de Ambiente y Energía (MINAE), la fuente identificada como Toma 3073-A, denominada \"Iris Hernández\" figura registrada a partir del año 1984, es decir, con posterioridad a la instalación de los servicios de agua potable que el señor Nombre01 indica en el presente recurso. Las condiciones existentes al momento de la aprobación e instalación de dichos servicios difieren de las que actualmente resultan aplicables a la finca PRN02, por lo que, tales antecedentes no constituyen una razón jurídica para desconocer la captación de la Toma Nombre03 y con esto el radio de protección que establece la Ley de aguas en el artículo 31 , las directrices institucionales orientadas a la protección del recurso hídrico. La existencia de otros inmuebles servidos en las cercanías no desvirtúa la aplicación de las regulaciones actuales. Respecto al hecho cinco: No es un hecho al que me pueda referir Respecto al hecho seis: Sin perjuicio de que este hecho constituye una valoración jurídica y no un hecho susceptible de aceptación o rechazo, resulta importante indicar que el derecho al agua potable no tiene carácter absoluto ni irrestricto, este derecho debe compatibilizarse con otros derechos como a un ambiente sano y ecológicamente equilibrado, para la protección y conservación del recurso hídrico. Esta honorable Sala Constitucional en el voto 2016-006027 del 06 de mayo de 2016, resolvió: \"(...) siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En el presente caso, la negativa para otorgar el servicio de agua potable no obedece a una actuación arbitraria o carente de motivación por parte de la ESPH S.A., sino a una imposibilidad jurídica derivada de la aplicación obligatoria de la Ley de Aguas, de la normativa técnica vigente y de las disposiciones institucionales dictadas para la protección de una fuente destinada al abastecimiento de agua potable, por lo que no existe vulneración de los derechos fundamentales invocados por el recurrente (…) PETITORIA Con fundamento en las razones expuestas, respetuosamente solicito se declare sin lugar el presente recurso de amparo al no existir una actuación arbitraria, u omisión atribuible a la Empresa de Servicios Públicos de Heredia S.A. que lesione los derechos fundamentales invocados por el recurrente. Solicito se exonere de toda responsabilidad a la Empresa de Servicios Públicos de Heredia S.A, sin condenatoria en costas, daños y perjuicios para mi representada y se ordene el archivo del presente expediente”. \n\n4.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\nConsiderando:\n\nI.- Sobre la admisibilidad de los recursos de amparo contra sujetos de derecho privado. Al tenor de lo dispuesto por el artículo 57 de la Ley de la Jurisdicción Constitucional, es admisible el recurso de amparo contra las acciones u omisiones de sujetos de derecho privado, cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a) de la misma Ley. En el presente asunto, la recurrida se trata de una prestataria por delegación de un servicio público, por lo que el recurso fue admitido.\n\nII.- Objeto del recurso. El recurrente alega que es propietario de un derecho de un inmueble ubicado en San José de la Montaña. Aduce que ha gestionado múltiples solicitudes para la instalación de una paja de agua potable en su propiedad. Narra que pese a haber cumplido en debida forma con los trámites, requisitos legales y administrativos, la recurrida ha denegado de manera infundada la autorización e instalación de la paja de agua solicitada, sin aportar razonamiento técnico ni base jurídica que justifique tal negativa. Agrega que debe indicar que las propiedades que están al otro lado de la calle de su propiedad sí cuentan con el servicio de agua potable. Estima lesionados sus derechos fundamentales. \n\nIII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: \n\na) En fecha indeterminada, el recurrente gestionó una solicitud de disponibilidad de servicio de agua potable para la finca matrícula folio real PRN02 (véase prueba aportada).\n\nb) Por oficio SCM-SC-CP-1558-2019-C del 5 de setiembre de 2019, se le contestó al recurrente: “Con relación a la consulta de disponibilidad de agua potable para la propiedad con plano catastro H-0554377-1999 situada en Distrito San José, Cantón Barva, Provincia 4° Heredia parte del folio real PRN05 con un área de 7474.12 m2, le comunicamos: Esta propiedad se encuentra dentro de la Zona de restricción absoluta, para el cual se indica: Zoma de restricción absoluta: Áreas de protección que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal, según artículo 33 de la Ley Forestal (N° 7575, 13 de febrero de 1996) y las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio, según artículo 31 de la Ley General de Agua Potable (N° 1634 de 18 de setiembre de 1953). Estos lineamientos tomados por el acuerdo de Junta Directiva JD-021-2017 del 4 de febrero del 2017 sin periodo de vigencia. En esta zona la Empresa de Servicios Públicos de Heredia S. A., no otorgará servicios de energía eléctrica ni de agua potable, bajo ninguna circunstancia (…)” (véase prueba aportada). \n\nc) Los inmuebles cercanos a la propiedad del tutelado, finca PRN04 cuenta con servicio de agua potable instalado desde el 31 de agosto de 1979 y la finca PRN03 desde el 31 de agosto de 1981 (véase prueba aportada).\n\nd) La fuente identificada como toma 3073-A denominada “Nombre03” fue registrada en 1984 (véase prueba aportada).\n\nIV.- Sobre el caso concreto. En el sub lite, la recurrente alega que es propietario de un derecho de un inmueble ubicado en San José de la Montaña. Aduce que ha gestionado múltiples solicitudes para la instalación de una paja de agua potable en su propiedad. Narra que pese a haber cumplido en debida forma con los trámites, requisitos legales y administrativos, la recurrida ha denegado de manera infundada la autorización e instalación de la paja de agua solicitada, sin aportar razonamiento técnico ni base jurídica que justifique tal negativa. Agrega que debe indicar que las propiedades que están al otro lado de la calle de su propiedad sí cuentan con el servicio de agua potable. Estima lesionados sus derechos fundamentales.\n\nAl respecto, del estudio de los autos se desprende que el recurrente gestionó una solicitud de disponibilidad de servicio de agua potable para la finca matrícula folio real PRN02. Por oficio SCM-SC-CP-1558-2019-C del 5 de setiembre de 2019, se le contestó al recurrente: “Con relación a la consulta de disponibilidad de agua potable para la propiedad con plano catastro H-0554377-1999 situada en Distrito San José, Cantón Barva, Provincia 4° Heredia parte del folio real PRN05 con un área de 7474.12 m2, le comunicamos: Esta propiedad se encuentra dentro de la Zona de restricción absoluta, para el cual se indica: Zona de restricción absoluta: Áreas de protección que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal, según artículo 33 de la Ley Forestal (N° 7575, 13 de febrero de 1996) y las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio, según artículo 31 de la Ley General de Agua Potable (N° 1634 de 18 de setiembre de 1953). Estos lineamientos tomados por el acuerdo de Junta Directiva JD-021-2017 del 4 de febrero del 2017 sin periodo de vigencia. En esta zona la Empresa de Servicios Públicos de Heredia S. A., no otorgará servicios de energía eléctrica ni de agua potable, bajo ninguna circunstancia”. Los inmuebles cercanos a la propiedad del tutelado, finca 4 61208-000 cuenta con servicio de agua potable instalado desde el 31 de agosto de 1979 y la finca PRN03 desde el 31 de agosto de 1981. La fuente identificada como toma 3073-A denominada “Nombre03” fue registrada en 1984.\n\nEn este sentido, no se observa que tal denegatoria del servicio de agua resulte abiertamente arbitraria y desproporcionada, sino que obedece a imposibilidades técnicas y normativas, toda vez que el inmueble del tutelado se encuentra en un perímetro menor a doscientos metros de radio desde el sitio de captación o toma surtidora de agua potable. Acerca de esto, no corresponde a este Tribunal Constitucional efectuar la verificación de requisitos legales y técnicos para establecer la procedencia o no de la negativa en cuestión (ver la sentencia no. 2025008644 de las 9:30 horas del 21 de marzo de 2025). Por ende, si el recurrente persiste en su disconformidad, si a bien lo tiene, puede plantear el reclamo correspondiente ante la propia ESPH o en la vía jurisdiccional ordinaria.\n\nPor otra parte, en cuanto a la alegada lesión a su derecho a la igualdad en relación con la existencia de otros inmuebles cercanos a su propiedad que sí cuentan con acceso al agua potable, la autoridad recurrida afirma que a la finca PRN04 se le instaló el servicio el 31 de agosto de 1979 y a la finca PRN03 desde el 31 de agosto de 1981; es decir, que tales inmuebles cuentan con agua potable desde antes que la fuente identificada como toma 3073-A “Nombre03” fuera registrada como toma surtidora de agua potable, lo cual ocurrió en 1984. Así las cosas, no se observa que se haya dado un trato diferenciado a situaciones iguales. \n\nEn consecuencia, no se logra acreditar alguna situación de raigambre constitucional que amerite la intervención de la Sala en este momento, por lo que se declara sin lugar el recurso de amparo. \n\nV.- Voto salvado del magistrado Cruz Castro. Conforme a las consideraciones que indico a continuación estimo que el presente recurso debe declararse con lugar. En el criterio de mayoría, la sentencia desestima el amparo porque, a su juicio, la negativa impugnada no obedece a una actuación arbitraria o discriminatoria, sino que encuentra fundamento en criterios técnicos, como lo es la insuficiencia de capacidad hidráulica del sistema de abastecimiento, específicamente por limitaciones en la línea de conducción existente y ante la insuficiente capacidad del sistema para atender la demanda actual sin comprometer la continuidad, calidad y cantidad del servicio de los usuarios existente; sin embargo se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.\n\nEl artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.\n\nEl proveedor del servicio público no puede limitarse a constatar insuficiencias del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.\n\nNo se trata de obligar a lo imposible, sino de exigir la adopción de medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.\n\nEl agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la entidad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.\n\nPor estas razones, estimo que el recurso debe declararse con lugar, al menos para ordenar la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.\n\nVI.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia.   "body_en_text": "Review of the Document\n\n\n\nExp: 26-025207-0007-CO \n\nRes. Nº 2026032048\n\n \n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at twenty minutes past nine on 20 August 2026.\n\n \n\nAmparo proceeding in expediente 26-025207-0007-CO, filed by Nombre01, identity card CED01, against EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA S.A.\n\nBackground:\n\n1.- By written submission received by the Chamber’s Secretariat on 14 July 2026, the applicant files an amparo application. He alleges: “1. I am the rightful owner of an interest in the property registered in the National Registry under real property folio number PRN01, located in PROVINCIA HEREDIA, CANTON BARVA, DISTRITO SAN JOSE DE LA MONTAÑA, Dirección01. 2. I have lived on that property for 50 years. It is located in front of a public road. I have submitted requests to EMPRESA DE SERVICIOS PUBLICOS DE HEREDIA to have a potable water connection installed on my property, an essential measure to ensure that basic needs are met and that both my family and those who live on the property can enjoy a dignified life. 3. Although I duly complied with the procedures and legal and administrative requirements, EMPRESA DE SERVICIOS PUBLICOS DE HEREDIA has unjustifiably denied authorization and installation of the requested water connection, without providing technical reasoning or a legal basis for that refusal. 4. I must point out that the properties across the street from mine do have potable water service. 5. I have had to meet my water needs with hoses that bring water from the mountain to my humble home. 6. That refusal seriously violates my rights to health, a dignified life, and access to essential public services, causing me direct harm and putting my health at risk. I am an older adult living alone since my wife died; I have no job and only receive an insurance pension. My house is very modest and made of wood, and I repeat that I have lived there for 50 years. Fundamental Rights Violated Article 21 of the Political Constitution: Right to life. Article 50 of the Political Constitution: Right to a healthy and ecologically balanced environment. Reiterated case law of that Constitutional Chamber concerning access to potable water as a fundamental right. International human rights conventions ratified by Costa Rica. Relief Requested For the foregoing reasons, I respectfully request the justices: 1. Declare this amparo proceeding well-founded. 2. Order EMPRESA DE SERVICIOS PUBLICOS DE HEREDIA, within the shortest possible time, to authorize and arrange installation of the potable water connection on my property, ensuring effective and immediate access to the service. 3. Order any other measure it deems appropriate to fully restore the enjoyment of my fundamental rights.”\n\n2.- By resolution issued at 23:00 on 20 July 2026, the President of the Chamber admitted the proceeding and requested a report from the general manager of Empresa de Servicios Públicos de Heredia.\n\n3.- In a written submission received by the Chamber’s Secretariat on 27 July 2026, Laura Castro Chaves responded to the notice in her capacity as general power of attorney holder for Empresa de Servicios Públicos de Heredia. She states: “Regarding fact one: It is true. Regarding fact two: It is partially true; I will explain: It is not true that the applicant submitted several requests to have potable water service installed. A review of the records of Empresa de Servicios Públicos de Heredia S.A. shows one request submitted by Mr. Nombre01 in 2019, concerning the availability of potable water service for property folio PRN02. That request was duly addressed by official letter SCM-SC-CP-1558-2019-C, dated 5 September 2019, which informed Mr. Nombre01 of the reasons preventing the service from being granted. (See evidence, official letter APH-ON-lG-337-2026.) Regarding fact three: It is not true; I will explain: It is not true that the applicant meets the legal requirements for potable water service or that ESPH S.A.’s refusal was unjustified or lacked a legal basis. In official letter SCM-SC-CP-1558-2019-C, dated 5 September 2019, which addressed the only request recorded in the applicant’s name, he was informed that property folio PRN02, with cadastral plan H-0554377-1999, is located within the absolute restriction zone, which governs: protected areas bordering permanent springs, defined as a radius of one hundred meters measured horizontally, under Article 33 of the Ley Forestal (NO 7575, 13 February 1996), and lands surrounding potable water intake or supply points, within a radius of no less than two hundred meters, under Article 31 of the Water Law. These guidelines were adopted by the Board of Directors’ agreement JD-021-2017 of 4 February 2017, with no expiration period. In this zone, Empresa de Servicios Públicos de Heredia S. A. will not provide electricity or potable water service under any circumstances. ‘Property folio PRN02, registered under cadastral plan H-0554377-1999, is partially within the two-hundred-meter protection radius established in Article 31 of the Water Law with respect to the spring known as “Iris Hernández.” The portion of the property within that protection radius includes the frontage bordering the public road. (See evidence one, official letter APH-ON-IG337-2026.) That spring has a water-use concession processed under administrative expediente No. 3073-A, an application for which was initiated before the Water Directorate of the Ministry of Environment and Energy (MINAE) in 1984 (see documentary evidence, folio 06 et seq.). The concession was later renewed by Resolution No. R-0808-2019-AGUAS-MlNAE, dated 23 July 2019 (see documentary evidence, folio 18 et seq.). Because of that protection radius, the ESPH S.A. Board of Directors, by Agreement JD-240-2022, ordered that the Absolute Prohibition Zones and Spring Protection Zones be maintained, expressly providing that no potable water or electricity service would be granted within those areas, except for the exceptions provided for institutional or environmental purposes. Article 22 of the Technical Regulation for the Provision of Water Supply, Sanitary Sewer, and Hydrant Services (AR-RT-SUMAAH-2023) provides that granting new services requires compliance with technical, legal, and environmental conditions. Article 18 of the same regulation identifies as a bar to providing new water-supply services: “Failure to comply with service laws or regulations, and a property located in a protected zone. The following are grounds preventing the provider from supplying new water-supply and sanitary sewer services: a. Failure to comply with service laws or regulations; b. Problems in the internal network that pose a risk of contaminating the public water-supply system; c. A duly identified danger or emergency affecting persons or private or public property; d. Inability or refusal to correct any deficiency or defect in the internal system reported by the provider or competent authority; e. The application concerns a property located in an area declared a protected zone under Ley No. 7788, Ley de Biodiversidad, and its regulations; f. The property to be served lies outside the provider’s coverage area; g. Where providing the service is not technically feasible.” As stated, the property of which Mr. Nombre01 is a co-owner is located within the two-hundred-meter protection radius established in Article 31 of the Water Law. Article 31.- The following are declared reserves of ownership in favor of the Nation: a) Lands surrounding potable water intake or supply points, within a radius of no less than two hundred meters; b) The forest zone that protects or must protect the group of lands where potable water infiltration occurs, as well as lands underlying watersheds and the banks of reservoirs, supply sources, or permanent courses of those same waters. As a provider of potable water, electricity, and wastewater services, ESPH SA must comply with State provisions aimed at protecting natural resources. Under Ley n. 0 7789, ESPH SA responsibly administers any limitations on the public services it provides, in accordance with existing environmental law regulations. Article 6, subsection g), of that same law assigns ESPHSA responsibility for the conservation, administration, and rational exploitation of energy and water resources in the Heredia region, and for protecting watersheds, springs, channels and beds of rivers, surface watercourses, and aquifers. My client’s actions are directed at protecting water resources and the environment in accordance with Article 50 of our Political Constitution: “Article 50. The State shall seek the greatest well-being of all inhabitants of the country by organizing and stimulating production and the most appropriate distribution of wealth. Everyone has the right to a healthy and ecologically balanced environment. Accordingly, everyone has standing to report acts that infringe that right and to seek reparation for the damage caused. The State shall guarantee, defend, and preserve that right.” The spring known as Nombre03 is a potable water supply point. Accordingly, withholding service is a decision grounded in the protection of water resources under the law, ARESEP regulatory provisions, and the company’s own rules. It is therefore incorrect for the applicant to assert that service was denied without grounds or justification. Regarding fact four: It is partially true; I will explain: Each application must be assessed according to the legal, technical, and environmental conditions specific to the property concerned at the time the water-service application is received. It should be emphasized that, in this case, the applicant’s property is affected by the two-hundred-meter radius under Article 31 of the Water Law. Based on information obtained from NAPH’s Geographic Information System, Costa Rica’s Real Property Registry Information System, and ESPH SA’s Commercial Management System, the Potable Water and Hydrants Business reports that the following properties are located across from property PRN02: Property 4 61208-000, registered in the name of Nombre02, supplied under contract No. 8765, with potable water service installed since 31 August 1979. Property PRN03, registered in the name of Nombre04, supplied under contract No. 571255, with potable water service installed since 31 August 1981. In this regard, it is important to clarify that the potable water services referenced were granted in the late 1970s and early 1980s. However, the Water Directorate’s expediente at the Ministry of Environment and Energy (MINAE) shows that the source identified as Intake 3073-A, called “Iris Hernández,” has been registered since 1984—that is, after the potable water services mentioned by Mr. Nombre01 were installed. The conditions existing when those services were approved and installed differ from those currently applicable to property PRN02. Therefore, those precedents do not provide a legal basis for disregarding the capture at Intake Nombre03 and, with it, the protection radius established by Article 31 of the Water Law and the institutional guidelines aimed at protecting water resources. The existence of other properties served nearby does not disprove the applicability of current regulations. Regarding fact five: This is not a fact to which I can respond. Regarding fact six: Without prejudice to the fact that this is a legal assessment and not a fact susceptible to acceptance or rejection, it is important to state that the right to potable water is neither absolute nor unrestricted. That right must be reconciled with other rights, such as the right to a healthy and ecologically balanced environment, in order to protect and conserve water resources. In vote 2016-006027 of 6 May 2016, this honorable Constitutional Chamber ruled: ‘(...) provided that the failure to supply potable water service is not capricious, arbitrary, or without grounds, but is justified by legal or material impossibility, there is no violation of fundamental rights. In this case, the refusal to grant potable water service is not an arbitrary or unmotivated act by ESPH S.A., but results from a legal impossibility arising from the mandatory application of the Water Law, the technical regulations in force, and the institutional provisions issued to protect a source intended to supply potable water. Accordingly, there is no violation of the fundamental rights invoked by the applicant (…) RELIEF REQUESTED On the basis of the foregoing, I respectfully request that this amparo proceeding be declared unfounded, since there is no arbitrary act or omission attributable to Empresa de Servicios Públicos de Heredia S.A. that violates the fundamental rights invoked by the applicant. I request that Empresa de Servicios Públicos de Heredia S.A. be exempted from all liability, with no award of costs, damages, or losses against my client, and that this expediente be archived.’”\n\n4.- The legal requirements have been observed in these proceedings.\n\nJustice Rueda Leal drafts the opinion; and,\n\nReasons:\n\nI.- Admissibility of amparo proceedings against private-law entities. Under Article 57 of the Ley de la Jurisdicción Constitucional, an amparo proceeding against actions or omissions of private-law entities is admissible when they act or are required to act in the exercise of public functions or powers, or when they are, in law or in fact, in a position of power against which ordinary judicial remedies are clearly insufficient or too slow to guarantee the fundamental rights or freedoms referred to in Article 2, subsection a), of that same Law. In this matter, the respondent is a delegated provider of a public service, and the amparo proceeding was therefore admitted.\n\nII.- Subject of the proceeding. The applicant alleges that he owns an interest in property located in San José de la Montaña. He states that he has submitted multiple requests to have a potable water connection installed on his property. He says that, despite duly complying with the procedures and legal and administrative requirements, the respondent unjustifiably denied authorization and installation of the requested water connection, without providing technical reasoning or a legal basis for that refusal. He also points out that properties across the street from his do have potable water service. He considers his fundamental rights to have been violated.\n\nIII.- Facts found. The following facts are considered duly established and relevant to deciding this matter:\n\na) On an undetermined date, the applicant submitted an application for potable water service availability for property folio PRN02 (see evidence submitted).\n\nb) By official letter SCM-SC-CP-1558-2019-C of 5 September 2019, the applicant was told: “Regarding the inquiry about potable water availability for the property with cadastral plan H-0554377-1999, located in Distrito San José, Cantón Barva, Provincia 4° Heredia, part of real property folio PRN05 and measuring 7474.12 m2, we inform you: This property is located within the Absolute Restriction Zone, which is defined as follows: Absolute Restriction Zone: protected areas bordering permanent springs, defined as a radius of one hundred meters measured horizontally, under Article 33 of the Ley Forestal (N° 7575, 13 February 1996), and lands surrounding potable water intake or supply points, within a radius of no less than two hundred meters, under Article 31 of the General Potable Water Law (N° 1634 of 18 September 1953). These guidelines were adopted by the Board of Directors’ agreement JD-021-2017 of 4 February 2017, with no expiration period. In this zone, Empresa de Servicios Públicos de Heredia S. A. will not provide electricity or potable water service under any circumstances (…)” (see evidence submitted).\n\nc) The properties near the protected party’s property, property PRN04, have had potable water service installed since 31 August 1979, and property PRN03 since 31 August 1981 (see evidence submitted).\n\nd) The source identified as Intake 3073-A, called “Nombre03,” was registered in 1984 (see evidence submitted).\n\nIV.- The specific case. In the case at hand, the applicant alleges that he owns an interest in property located in San José de la Montaña. He states that he has submitted multiple requests to have a potable water connection installed on his property. He says that, despite duly complying with the procedures and legal and administrative requirements, the respondent unjustifiably denied authorization and installation of the requested water connection, without providing technical reasoning or a legal basis for that refusal. He also points out that properties across the street from his do have potable water service. He considers his fundamental rights to have been violated.\n\nThe case file shows that the applicant submitted an application for potable water service availability for property folio PRN02. By official letter SCM-SC-CP-1558-2019-C of 5 September 2019, the applicant was told: “Regarding the inquiry about potable water availability for the property with cadastral plan H-0554377-1999, located in Distrito San José, Cantón Barva, Provincia 4° Heredia, part of real property folio PRN05 and measuring 7474.12 m2, we inform you: This property is located within the Absolute Restriction Zone, which is defined as follows: Absolute Restriction Zone: protected areas bordering permanent springs, defined as a radius of one hundred meters measured horizontally, under Article 33 of the Ley Forestal (N° 7575, 13 February 1996), and lands surrounding potable water intake or supply points, within a radius of no less than two hundred meters, under Article 31 of the General Potable Water Law (N° 1634 of 18 September 1953). These guidelines were adopted by the Board of Directors’ agreement JD-021-2017 of 4 February 2017, with no expiration period. In this zone, Empresa de Servicios Públicos de Heredia S. A. will not provide electricity or potable water service under any circumstances.” The properties near the protected party’s property, property 4 61208-000, have had potable water service installed since 31 August 1979, and property PRN03 since 31 August 1981. The source identified as Intake 3073-A, called “Nombre03,” was registered in 1984.\n\nIn this regard, the denial of water service does not appear manifestly arbitrary or disproportionate, but rather stems from technical and regulatory impossibilities, since the protected party’s property lies within a radius of less than two hundred meters from the potable water intake or supply point. This Constitutional Court is not responsible for verifying the legal and technical requirements to determine whether the refusal in question is warranted (see judgment no. 2025008644 of 9:30 on 21 March 2025). Therefore, should the applicant remain dissatisfied, he may, if he so wishes, bring the corresponding claim before ESPH itself or in the ordinary judicial forum.\n\nAs for the alleged violation of his right to equality in light of the existence of other nearby properties with access to potable water, the respondent authority states that service was installed at property PRN04 on 31 August 1979 and at property PRN03 from 31 August 1981; that is, those properties have had potable water since before the source identified as Intake 3073-A, “Nombre03,” was registered as a potable water supply point in 1984. Accordingly, there is no indication that equal situations were treated differently.\n\nConsequently, no issue of constitutional significance warranting the Chamber’s intervention at this time has been established, and the amparo proceeding is declared unfounded.\n\nV.- Dissenting vote of Justice Cruz Castro. For the reasons set out below, I consider that this amparo proceeding should be declared well-founded. The majority opinion dismisses the amparo on the ground that, in its view, the challenged refusal was neither arbitrary nor discriminatory, but instead rested on technical criteria, such as insufficient hydraulic capacity in the supply system, specifically because of limitations in the existing transmission line and the system’s insufficient capacity to meet current demand without compromising the continuity, quality, and quantity of service to existing users. However, it fails to give adequate weight to the fact that access to potable water is a fundamental right, indispensable to life, health, and human dignity.\n\nArticle 21 of the Political Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Article 50 of the Constitution also imposes on the State the duty to ensure the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to potable water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to take positive measures to fully realize it. A heightened obligation is imposed on the State in a social and democratic state governed by the rule of law. For this reason, supplying water is a priority obligation of the public authorities.\n\nA public-service provider cannot merely identify shortcomings in the system; it has a legal duty to plan, anticipate, and carry out the actions necessary to progressively guarantee access to water service, especially for human consumption.\n\nThis does not mean requiring the impossible, but rather requiring the adoption of reasonable, alternative, or progressive measures so that people are not left without protection.\n\nWater is not just any service; it is an essential human right. Therefore, the respondent entity cannot shirk its duty to guarantee it by sheltering behind technical limitations without offering effective solutions.\n\nFor these reasons, I consider that the amparo proceeding should be declared well-founded, at least to order the adoption of concrete and progressive measures that guarantee the protected party effective access to potable water within a reasonable period. Water is a good and a fundamental right whose effective exercise must be ensured; this is an unavoidable duty.\n\nVI.- Documents submitted to the case file. The parties are advised that if they submitted any paper document, objects, or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them within a maximum period of 30 business days, counted from notification of this judgment. Any material not retrieved within that period will be destroyed, pursuant to the “Regulation on the Electronic Case File before the Judiciary” (approved by the Full Court under Article XXVI of session no. 27-11 of 22 August 2011 and published in Boletín Judicial no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Judiciary’s Superior Council of 3 May 2012.\n\nTherefore:\n\nThe amparo proceeding is declared unfounded.
