  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-025676-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026032073\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, y Nombre05, cédula de identidad CED02, contra la EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA S.A. y la MUNICIPALIDAD DE SAN RAFAEL DE HEREDIA.\n\nResultando:\n\n 1.- Por escrito incorporado al expediente digital de la Sala a las 12:39 horas del 17 de julio de 2026, la parte recurrente interpone recurso de amparo contra la Municipalidad de San Rafael de Heredia y la Empresa de Servicios Públicos de Heredia. Indica lo siguiente: “En primera instancia, desde el año 2022 mi padre Nombre04 ha solicitado los servicios de agua en varias ocasiones y hasta la fecha nos siguen negando el acceso. La entidad Empresa de Servicios Públicos de Heredia negó el servicio argumentando que la Dirección02, la cual es colindante a nuestro terrene, no es una calle publica, razón por la cual no puede abastecer dicho servicio. algo que es totalmente absurdo, ya que existe una tubería que viene desde la calle principal hasta el fondo de la calle, incluso existe un macromedidor y que suministra agua a un vecino. De igual manera hay una problemática entre la municipalidad y la Empresa de Servicios Públicos, en este caso. la municipalidad había aprobado la segmentación de varies terrenes y aprobación de previstas de agua para la venta en dicho lugar donde nosotros adquirimos nuestro lote para vivir: pero de un pronto a otro, en un consejo municipal y de manera negligente argumentaron que la calle era privada, como si fuera un impedimento para proporcionar los servicios y que son vitales para cualquier ser humano, consecuentemente la Empresa de Servicios Públicos ha utilizado la misma excusa de que la calle es privada, recalco de nuevo que hasta la fecha siguen manifestando lo mismo, sin embargo no hay ningún motive justo o argumento técnico para imposibilitar el paso del agua a nuestra propiedad ya que como se explicó anteriormente si hay una cañería con agua potable y que pasa por la calle, también es una calle de paso o de uso común. ya que hay varies vecinos y que tienen su terreno a la par De igual manera manifiesto que mis padres padecen de cáncer y evidentemente las condiciones en las cuales vivimos actualmente no son las mejores, sufrimos de vandalismo porque tiran basura en la calle y la municipalidad no hace el mínimo esfuerzo de recoger la basura, a pesar de que hemos seguido pagando impuestos, la última vez que recogieron basura fue hace un año aproximadamente, asimismo la calle se encuentra en mal estado porque la municipalidad la tiene en abandono y las fuertes lluvias a veces no nos permiten salir; es decir, no estamos en las mejores condiciones humanas, sin agua ni luz, durante estos años, incluso hemos tenido que pedirles agua a los vecinos que si la tienen para poder sobrevivir. Consideramos que son urgentes tales servicios por la condición de salud de mis papas, por mi parte soy docente y es evidente que por la naturaleza de mi trabajo la luz y el internet son mis herramientas de trabajo. pero ni siquiera puedo acceder a ello, lo cual está afectando directamente a mi trabajo y se están violando nuestros derechos al no tener una vida digna. no es justo que nos nieguen los servicios por pura negligencia cuando no es un secreto que en muchas propiedades hay varios medidores de agua y de luz y accesos de paso común, algo que es totalmente normal, perdón pero es una excusa y una irresponsabilidad de parte de la municipalidad y la Empresa de Servicios Públicos. (…) Petitoria Solicitamos respetuosamente los permisos de agua y de luz de parte de la Empresa de Servicios Públicos de Heredia y la recolección de la basura en la Dirección02”. \n\n2.- Por resolución de las 14:52 horas del 22 de julio de 2026, la Presidencia de la Sala previno al recurrente que aportara “Copia completa, legible y con el respectivo comprobante de recibido o de remisión de correo electrónico de las solicitudes de agua potable que aducen han presentado ante la Empresa de Servicios Públicos de Heredia, así como copia completa de las respuestas que han recibido. • Además, aclaren si han solicitado de manera formal y por escrito el servicio de electricidad, y de ser así, aporten copia íntegra, legible y con el respectivo comprobante de recibido o de remisión de correo electrónico de esa solicitud y, en caso de haber recibido alguna respuesta, deberán aportar copia completa de la misma. • Asimismo, señalen si han denunciado ante la Municipalidad de San Rafael de Heredia el problema de basura que refieren en el escrito de interposición. De ser afirmativa la respuesta, aporten copia completa, legible y con el respectivo comprobante de recibido de esa gestión. • De igual modo, deberá aportar cualquier prueba adicional en la cual fundamente su dicho. Lo anterior, por cuanto tal información resulta esencial para resolver lo que en derecho corresponda y bajo apercibimiento de rechazar de plano el recurso si no lo hiciere (artículos 38 y 42 de la Ley de la Jurisdicción Constitucional).”\n\n3.-En memorial incorporado al expediente digital de la Sala a las 14:47 horas del 27 de julio de 2026, la parte recurrente agrega lo siguiente: “Se adjuntan las evidencias pertinentes concerniente al reclamo de los servicios públicos, y también hago la salvedad, ya que se nos solicitaron documentos concernientes a la solicitud de la luz eléctrica y a la recolección de basura. Con respecto a la basura. se le ha preguntado a los peones y solo una única vez limpiaron la calle. pero hace tiempo no limpian ni ayudan con ese tema. Formalmente solo se hizo la petición del agua, ya que teniamos entendido que dicha empresa comienza con este servicio, de hecho ya existían las previstas de agua que se le brindaron a la finca que eventualmente se segrego en lotes para la venta, pero después \"frenaron\" los permisos de agua. Nosotros al solicitar nuevamente el servicio de agua. una vez comprado nuestro terreno. nos dijo la empresa que al no haber una resolución con la municipalidad sobre la calle, no se pueden establecer dichos servicios. En un consejo municipal se estableció que la calle no era \"pública\" y se le hizo el reclamo a la municipalidad hace unos años. le escribi al ingeniero de hecho recibi una carta de parte de la municipalidad el 25 de enero del 2022 argumentado que la calle aún estaba en análisis, hasta la fecha no han resuelto nada tampoco y nos afecta directamente. En este caso la Empresa de Servicios Públicos ha delegado la responsabilidad a la municiplalidad. Se le solicitó el servicio de agua el día de14 de julio del 2026, pero fue denegado. Nosotros lo solicitamos la respuesta por escrito (adjunto dicha respuesta).” \n\n4.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n \n\n I.- OBJETO DEL RECURSO. La parte recurrente manifiesta que solicitó los servicios de agua potable, pero se le denegó, con el argumento de que Dirección02, colindante con su terreno, no es pública, por lo que se no se puede abastecer del servicio. Reclama que existe una tubería que pasa desde la calle principal hasta el fondo de la calle, e incluso un macromedidor que suministra agua al vecino. Agrega que tampoco recibe el servicio de electricidad. Por otra parte, comenta que la municipalidad accionada no recoge la basura; la última vez fue hace un año, sumado a que la calle está en mal estado. Finalmente, menciona que aún está pendiente de resolución decidir si la calle es pública o no. Estima lesionados sus derechos fundamentales.\n\nII.- EN CUANTO AL SERVICIO DE AGUA POTABLE. Respecto a los agravios expuestos, es preciso indicar que este Tribunal ha señalado que las asociaciones administradoras de acueductos y alcantarillados, las municipalidades y demás instituciones que prestan el servicio de suministro de agua potable, pueden rechazar válidamente las solicitudes de servicio de agua potable que les sean formuladas o condicionarlas si existen razones técnicas o legales que así lo justifican. De esta forma, en sentencia No. 2016-006027 de las 09:05 horas del 6 de mayo de 2016, esta Sala consideró: \n\n“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”.\n\nEste pronunciamiento puede complementarse con la resolución No. 2017-005245 de las 10:00 horas del 7 de abril de 2017, que en lo conducente dispuso: \n\n“Del informe rendido por las autoridades de la municipalidad recurrida se indica que el reclamo de la recurrente, respecto de si el lugar donde tiene la propiedad la señora Nombre02 está fuera o no del abastecimiento de agua, le corresponderá al Instituto Costarricense de Acueductos y Alcantarrillados referirse al respecto, ya que la Municipalidad no tiene competencia para ello. Y por su parte, el Instituto Costarricense de Acueductos y Alcantarillados menciona que han actuado conforme a la normativa que lo regula, ejerciendo su función rectora como corresponde, llevando a cabo en todo momento actuaciones debidamente fundamentadas y razonadas como se detalló, se evidencia así que el Instituto ha procedido conforme a derecho, ya que según el informe técnico emitido por la UEN Optimización de Sistemas Nuevos Desarrollos GAM, oficio UEN-OSND-GAM- 2017-00082, se indica claramente que para el inmueble que cita la señora Nombre03 en su recurso de amparo, no existe la disponibilidad de agua potable. Además agrega el informe, que en análisis de los antecedentes de este inmueble se tiene que pertenecía a la propiedad con catastro PRN01 y según consulta al Registro Nacional, ésta última fue fraccionada y de la misma resultaron cuatro propiedades sin mediar la gestión del trámite de disponibilidad para dicho fraccionamiento. Así las cosas, esta Sala no logra acreditar ninguna omisión o actuación arbitraria por parte de la autoridad recurrida, en consecuencia lo correspondiente es declarar sin lugar el amparo, y reiterar que según la prueba aportada, la falta de dotación del servicio de agua potable en el lote de la recurrente no es una actuación antojadiza, arbitraria o sin fundamento, sino que está justificada en la inexistencia de disponibilidad de agua potable en el sector . (Ver en similar sentido las sentencias números 2014-9134 de las 14:05 horas del 19 de junio de 2014 y 2016007240 de las 09:20 horas del 27 de mayo 2017, entre otras). Bajo esa inteligencia, no se está frente a la infracción de derechos fundamentales y, por ello, lo pertinente es desestimar el recurso de amparo”. \n\nLuego de revisado el escrito de interposición, así como la prueba aportada, se constata que la empresa recurrida le indicó a la parte tutelada que rechazaba su solicitud de agua potable, toda vez que no existe “acceso público legalmente reconocido”, lo que impide la consolidación urbanística y la validez de eventuales permisos o autorizaciones municipales.\n\nAnte este panorama, se advierte que la procedencia o no del servicio solicitado no es un asunto que deba discutirse en esta jurisdicción. Cabe agregar que, en reiteradas ocasiones, este Tribunal ha sostenido que resulta posible desestimar las gestiones presentadas para el otorgamiento del servicio de agua potable, cuando se presenten imposibilidades técnicas, incumplimiento de requisitos infraconstitucionales o existan criterios técnicos y/o legales que así lo justifiquen. Además, a esta Sala no le corresponde valorar si lleva razón o no el recurrido respecto de la existencia de acceso público o las alternativas habidas para ofrecer el servicio, pese a la situación. Por otra parte, este Tribunal no debe fungir como mediador ante una determinada persona física o jurídica -ya sea esta última de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que ella pretende, tal y como así lo solicita la gestionante que se proceda en este caso. En consecuencia, la parte accionante deberá plantear, si a bien lo tiene, sus inconformidades o reclamos ante la propia autoridad recurrida o en la vía jurisdiccional ordinaria, sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. \n\nEn consecuencia, el recurso se declara inadmisible.\n\nIII.- ATINENTE AL SERVICIO DE ELECTRICIDAD Y DE RECOLECCIÓN DE BASURA. Vista la pretensión de la parte recurrente en cuanto a que se otorgue la disponibilidad del servicio de electricidad y se solucione el problema de la recolección de basura, la Presidencia de la Sala previno a los recurrentes que aclarara “si han solicitado de manera formal y por escrito el servicio de electricidad, y de ser así, aporten copia íntegra, legible y con el respectivo comprobante de recibido o de remisión de correo electrónico de esa solicitud y, en caso de haber recibido alguna respuesta, deberán aportar copia completa de la misma. Asimismo, señalen si han denunciado ante la Municipalidad de San Rafael de Heredia el problema de basura que refieren en el escrito de interposición. De ser afirmativa la respuesta, aporten copia completa, legible y con el respectivo comprobante de recibido de esa gestión”. Ante ello, los tutelados manifestaron que, formalmente, solo se ha planteado la solicitud del servicio de agua potable. Por ende, es necesario indicarle a la parte recurrente que la Sala Constitucional no debe suplantar a los despachos públicos en la resolución de los asuntos que, por su naturaleza y por mandato expreso de la ley, deban ser resueltos por ellos. En situaciones como esta es preciso que la parte interesada acuda ante las entidades respectivas a plantear la solicitud del servicio de electricidad aludido, así como la denuncia atinente a la recolección de basura, a fin de que aquellas tomen las medidas pertinentes para solucionar el problema denunciado o brindar el servicio, y, en su defecto, plantee su reclamo en la vía de legalidad ordinaria. Lo anterior no obsta para que el recurrente acuda a la vía constitucional, luego de que transcurriere un plazo irrazonable sin un actuar efectivo de la Administración y siempre que hubiere amenaza o lesión a un derecho fundamental. Ergo, se rechaza de plano el recurso. \n\nIV.-RESPECTO DE LA FALTA DE RESOLUCIÓN SOBRE LA NATURALEZA JURÍDICA DE Dirección02. Finalmente, la Sala considera que la acusada falta de resolución definitiva podría acarrear una lesión al artículo 41 de la Constitución Política, lo que también resulta inadmisible de ser conocido por este Tribunal, de conformidad con las siguientes consideraciones.\n\nV.- NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación. Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.\n\nVI.- VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS: CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para los recurrentes. Consecuentemente, se impone el rechazo de plano e indicarle a las partes gestionantes que si a bien lo tienen pueden acudir a la jurisdicción contencioso-administrativa.\n\nVII.- NOTA SEPARADA DEL MAGISTRADO CASTILLO VÍQUEZ. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\nVIII.- VOTO SALVADO DEL MAGISTRADO CRUZ CASTRO. Si bien en el pasado he sostenido el criterio de mayoría del Tribunal, bajo una mejor ponderación de los derechos fundamentales que se reclaman, estimo que la mora administrativa constituye una lesión a una garantía procesal fundamental, razón por la que cambio el criterio que había expuesto, admitiendo la posible infracción al derecho a una justicia administrativa pronta y cumplida, separándome de la visión de la mayoría del Tribunal, en el sentido que –salvo contadas excepciones- este tipo de reproches deben resolverse en la jurisdicción contenciosa administrativa. Por el contrario, estimo que uno de los derechos que esta jurisdicción se encuentra llamada a tutelar es el de la justicia pronta y cumplida, expresamente consagrado en el artículo 41 constitucional. Ello conforme al ámbito de competencia asignado a este Tribunal en materia de protección a derechos fundamentales, en atención a lo dispuesto en los artículos 10 y 48 de la Constitución Política. Si bien, entiendo la importancia de las reformas de la jurisdicción contencioso administrativa a partir de la vigencia de la Ley 8508 del veinticuatro de abril de dos mil seis, lo cierto es que dicha situación no justifica la remisión a dicha instancia de los asuntos que versan sobre materia que es competencia de esta Sala, la cual ha demostrado a lo largo de los años que es un medio célere y efectivo para la tutela de los derechos fundamentales de los habitantes del país.\n\nIX.-VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL, CON REDACCIÓN DEL PRIMERO. Disentimos del criterio de mayoría. En el presente caso, se valida la negativa de la Administración de brindar un servicio esencial, con base en consideraciones técnicas relativas a la insuficiencia de la infraestructura hídrica; sin embargo, se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.\n\nEl artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.\n\nDesde esta perspectiva, la invocación de limitaciones técnicas no puede erigirse en una justificación absoluta para desatender una necesidad básica de subsistencia. La Administración no puede limitarse a constatar la insuficiencia del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.\n\nEl enfoque mayoritario normaliza una omisión estructural: acepta que la falta de infraestructura exonera al Estado de su obligación, cuando precisamente esa carencia evidencia un incumplimiento de su deber de previsión. No se trata de obligar a lo imposible, sino de exigir que la Administración adopte medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.\n\nEl agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la autoridad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.\n\nPor estas razones, estimamos que el recurso debió admitirse, al menos para ordenar a la Administración la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.\n\n X.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI . \n\nPor tanto:\n\nSe rechaza de plano el recurso.   "body_en_text": "Document Review\n\n\n\nCASE FILE No. 26-025676-0007-CO \n\nPROCEEDING: AMPARO APPLICATION\n\nRULING No. 2026032073\n\n \n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 20 August 2026.\n\nAmparo application filed by Nombre01, holder of identity card CED01, and Nombre05, holder of identity card CED02, against EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA S.A. and the MUNICIPALITY OF SAN RAFAEL DE HEREDIA.\n\nBackground:\n\n1.- In a brief entered in the Chamber’s digital case file at 12:39 p.m. on 17 July 2026, the applicants file an amparo application against the Municipality of San Rafael de Heredia and Empresa de Servicios Públicos de Heredia. They state: “First, since 2022 my father, Nombre04, has requested water service on several occasions, and to date they continue to deny us access. The entity Empresa de Servicios Públicos de Heredia denied the service, arguing that Dirección02, which borders our property, is not a public street, and therefore cannot provide that service. This is completely absurd, since there is a pipe that runs from the main street to the end of the street; there is even a master meter that supplies water to a neighbor. There is also a dispute between the municipality and Empresa de Servicios Públicos in this case. The municipality had approved the division of several properties and approval of water service connections for sale at the site where we acquired our lot to live; but suddenly, at a municipal council meeting and negligently, they argued that the street was private, as if that were an impediment to providing services that are vital to every human being. Consequently, Empresa de Servicios Públicos has used the same excuse that the street is private. I emphasize again that to date they continue to say the same thing, but there is no fair reason or technical argument to prevent water from reaching our property, since, as explained above, there is a potable-water pipe that passes along the street, which is also a through street or for common use, as there are several neighbors whose properties are alongside it. I also state that my parents have cancer, and clearly the conditions in which we currently live are not the best. We suffer vandalism because people throw garbage in the street, and the municipality makes no effort at all to collect it, even though we have continued paying taxes. The last time they collected garbage was about a year ago. Likewise, the street is in poor condition because the municipality has abandoned it, and the heavy rains sometimes prevent us from leaving. In other words, we are not living in humane conditions, without water or electricity all these years; we have even had to ask neighbors who do have water to give us some so we can survive. We consider these services urgent because of my parents’ health condition. As for me, I am a teacher, and it is clear that, given the nature of my work, electricity and internet are my work tools. But I cannot even access them, which is directly affecting my work, and our rights to a dignified life are being violated. It is not fair to deny us services out of sheer negligence when it is no secret that many properties have several water and electricity meters and shared access routes, which is completely normal. I am sorry, but this is an excuse and irresponsibility on the part of the municipality and Empresa de Servicios Públicos. (…) Request: We respectfully request water and electricity permits from Empresa de Servicios Públicos de Heredia and garbage collection at Dirección02.”\n\n2.- By ruling issued at 2:52 p.m. on 22 July 2026, the Presidency of the Chamber directed the applicant to provide “a complete, legible copy, together with proof of receipt or email transmission, of the potable-water applications that you claim to have submitted to Empresa de Servicios Públicos de Heredia, as well as a complete copy of the responses received. • In addition, clarify whether you formally requested electricity service in writing, and, if so, provide a complete, legible copy of that request, together with proof of receipt or email transmission, and, if you received any response, provide a complete copy of it. • Also state whether you reported the garbage problem described in the filing to the Municipality of San Rafael de Heredia. If so, provide a complete, legible copy of that report, together with proof of receipt. • Likewise, provide any additional evidence supporting your statements. The foregoing information is essential to decide what is appropriate under law, and you are warned that the application will be summarily dismissed if you fail to do so (Articles 38 and 42 of the Ley de la Jurisdicción Constitucional).”\n\n3.- In a brief entered in the Chamber’s digital case file at 2:47 p.m. on 27 July 2026, the applicants add: “The relevant evidence concerning the claim for public services is attached. I also wish to clarify that we were asked for documents concerning the request for electricity and garbage collection. Regarding the garbage, we have asked the workers, and they cleaned the street only once. But they have not cleaned or helped with that issue in a long time. Formally, we only made the request for water, since we understood that this company begins with that service. In fact, water service connections had already been provided to the property that was eventually subdivided into lots for sale, but then they ‘put a stop’ to the water permits. When we again requested water service after buying our lot, the company told us that, without a municipal decision about the street, those services could not be established. At a municipal council meeting it was determined that the street was not ‘public,’ and we complained to the municipality about it a few years ago. I wrote to the engineer; in fact, I received a letter from the municipality on 25 January 2022 stating that the street was still under review. To date, they have not resolved anything, and this directly affects us. In this case, Empresa de Servicios Públicos has delegated responsibility to the municipality. Water service was requested on 14 July 2026, but it was denied. We asked for the response in writing (that response is attached).”\n\n4.- Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily dismiss or dismiss on the merits, at any time, including upon filing, any matter brought before it that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is merely a reiteration or reproduction of an identical or similar prior matter that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- OBJECT OF THE APPLICATION. The applicants state that they requested potable-water service, but it was denied on the grounds that Dirección02, which borders their property, is not public, and therefore the service cannot be provided. They claim there is a pipe running from the main street to the end of the street, and even a master meter supplying water to a neighbor. They add that they also do not receive electricity service. They further state that the respondent municipality does not collect garbage; the last collection was a year ago, and the street is in poor condition. Finally, they mention that a decision remains pending on whether the street is public. They consider their fundamental rights to have been violated.\n\nII.- REGARDING POTABLE-WATER SERVICE. With respect to the grievances raised, it should be noted that this Court has held that associations administering aqueducts and sewer systems, municipalities, and other institutions providing potable-water service may validly reject applications for water service or condition them if technical or legal grounds justify doing so. Thus, in ruling No. 2016-006027, issued at 9:05 a.m. on 6 May 2016, this Chamber held:\n\n“This Constitutional Court, in ruling 2014-9134, issued at 2:05 p.m. on 19 June 2014, which addressed an issue very similar to the one raised in the present application, held: ‘(...) In repeated rulings on this subject, this Chamber has stated that potable-water supply is considered a public service under Costa Rican law and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and in a manner that adapts to technological change (see ruling 2001-09676, issued at 11:25 a.m. on 26 September 2001, and ruling 2004-08161, issued at 10:53 a.m. on 23 July 2004). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing public potable-water service, is also required to provide that service continuously, adaptably, and efficiently, and equally to all inhabitants. However, this Constitutional Court’s case law has also held that, where there is legal impossibility (that is, noncompliance with requirements established in the applicable regulations) or formal impossibility (that is, the absence of a Water Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear installation costs when there is no potable-water distribution network and infrastructure must be built. In such cases, it has been understood that this is not a denial of access to potable-water service, but rather an inability to provide it or the interested party’s necessary involvement in remedying a technical impossibility, namely, the lack of infrastructure. In other words, as long as the failure to provide potable-water service is not arbitrary, capricious, or without grounds, but is instead justified by legal or material impossibility, there is no violation of fundamental rights. In this case, the evidence submitted and the report made under oath confirm that AyA did not arbitrarily reject the applicant’s request, but did so because all the technical and legal requirements established in the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for approving new services had not been met.’”\n\nThis ruling may be supplemented by ruling No. 2017-005245, issued at 10:00 a.m. on 7 April 2017, which held in relevant part:\n\n“According to the report submitted by the authorities of the respondent municipality, the applicant’s complaint concerning whether the place where Ms. Nombre02 owns property lies outside the water-supply area is a matter for the Instituto Costarricense de Acueductos y Alcantarrillados to address, since the Municipality has no jurisdiction over it. For its part, the Instituto Costarricense de Acueductos y Alcantarillados states that it acted in accordance with its governing regulations, exercising its regulatory function as appropriate and at all times taking duly reasoned and substantiated actions. It is thus evident that the Institute acted in accordance with law, since the technical report issued by UEN Optimización de Sistemas Nuevos Desarrollos GAM, memorandum UEN-OSND-GAM- 2017-00082, clearly states that potable water is not available for the property cited by Ms. Nombre03 in her amparo application. The report further adds that a review of the property’s history shows that it belonged to property with cadastral plan PRN01 and, according to an inquiry with the National Registry, the latter was subdivided into four properties without processing an application for service availability for that subdivision. Accordingly, this Chamber can establish no omission or arbitrary conduct on the part of the respondent authority. Consequently, the amparo must be dismissed, and it is reiterated that, based on the evidence submitted, the failure to provide potable-water service to the applicant’s lot is not arbitrary, capricious, or without grounds, but is justified by the absence of potable-water availability in the area. (See, to similar effect, rulings 2014-9134, issued at 2:05 p.m. on 19 June 2014, and 2016007240, issued at 9:20 a.m. on 27 May 2017, among others.) On that basis, there is no violation of fundamental rights, and the amparo application should therefore be dismissed.”\n\nUpon reviewing the filing and the evidence submitted, it is established that the respondent company informed the protected parties that it was rejecting their potable-water application because there is no “legally recognized public access,” which prevents urban consolidation and the validity of any eventual municipal permits or authorizations.\n\nIn these circumstances, whether the requested service should be provided is not a matter to be litigated in this jurisdiction. It should be added that this Court has repeatedly held that applications for potable-water service may be dismissed when there are technical impossibilities, noncompliance with requirements under subconstitutional law, or technical and/or legal criteria justifying the decision. Furthermore, this Chamber is not responsible for determining whether the respondent is correct regarding the existence of public access or the alternatives available for providing the service in the circumstances. Nor should this Court act as a mediator with a particular natural or legal person—the latter whether governed by public or private law—to intercede on behalf of a third party so that the third party may obtain what they seek, as the applicant requests here. Consequently, the applicants may, if they so choose, raise their objections or claims with the respondent authority itself or in the ordinary judicial forum, where they may fully litigate the merits and assert their claims.\n\nAccordingly, the application is declared inadmissible.\n\nIII.- REGARDING ELECTRICITY SERVICE AND GARBAGE COLLECTION. In view of the applicants’ request that electricity service be made available and the garbage-collection problem be resolved, the Presidency of the Chamber directed the applicants to clarify “whether they formally requested electricity service in writing, and, if so, provide a complete, legible copy of that request, together with proof of receipt or email transmission, and, if they received any response, provide a complete copy of it. They were also to state whether they had reported the garbage problem described in the filing to the Municipality of San Rafael de Heredia. If so, they were to provide a complete, legible copy of that report, together with proof of receipt.” In response, the protected parties stated that, formally, they had only submitted an application for potable-water service. Accordingly, the applicants must be informed that the Constitutional Chamber should not take the place of public offices in resolving matters that, by their nature and by express statutory mandate, they must resolve. In situations such as this, the interested party must approach the relevant entities to submit the request for the electricity service in question and the report concerning garbage collection, so that those entities can take appropriate measures to resolve the reported problem or provide the service; failing that, the party may pursue a claim through the ordinary legality jurisdiction. The foregoing does not prevent the applicants from seeking constitutional relief after an unreasonable period has passed without effective action by the Administration, provided there is a threat to or violation of a fundamental right. Ergo, the application is summarily dismissed.\n\nIV.- REGARDING THE FAILURE TO DECIDE THE LEGAL STATUS OF Dirección02. Finally, the Chamber considers that the alleged failure to issue a final decision could result in a violation of Article 41 of the Constitution, which is also inadmissible for this Court to hear, for the following reasons.\n\nV.- THE NEW ADMINISTRATIVE-LITIGATION JURISDICTION: AN EXPEDITIOUS AND EFFECTIVE MECHANISM FOR PROTECTING THE SUBSTANTIVE LEGAL POSITIONS OF PERSONS SUBJECT TO THE ADMINISTRATION. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in light of the absence of expeditious and prompt procedural avenues for protecting substantive legal positions grounded in the subconstitutional legal system or legality framework, which are indirectly connected to fundamental rights and the Law of the Constitution. In this regard, it should not be overlooked that, by virtue of its supremacy, superior legality, and direct and immediate effect, the Constitution provides an indirect basis for any conceivable substantive legal position of individuals. Nevertheless, upon further balancing, and following the enactment of the Código Procesal Contencioso-Administrativo (Law No. 8508 of 24 April 2006) and its entry into force on 1 January 2008, it has become clear that litigants now have access to a plenary and universal administrative-litigation jurisdiction that is highly expeditious and prompt, owing to the various procedural mechanisms that legislation incorporates into the legal system, such as shorter time limits for carrying out the various procedural acts; broad standing; interim measures; an open-ended list of claims that may be brought; oral proceedings—and their subsidiary principles of concentration, immediacy, and expedition; a single instance with a right of appeal in expressly specified situations; in-proceedings conciliation; unified proceedings; preferential proceedings or the “amparo de legalidad”; proceedings on points of law alone; new enforcement measures (coercive fines, substitute or commissioner enforcement, attachment of assets in the fiscal domain and certain assets in the public domain); broad powers for the body of enforcement judges; extension and adaptation of the effects of case law to third parties; and flexibility in the cassation appeal. All these novel procedural institutions are expressly intended to achieve procedural economy, expedition, promptness, and effective or complete protection of the substantive legal positions of persons subject to the Administration, while guaranteeing basic fundamental rights such as due process, the right of defense, and adversarial proceedings. In short, the new administrative-litigation jurisdiction, with its new characteristics of simplicity, expedition, and promptness, is a suitable avenue for the effective protection of the substantive legal positions of persons subject to the Administration where evidence must be gathered or ordinary legality issues must be resolved.\n\nVI.- VERIFICATION OF THE STATUTORY TIME LIMITS FOR RESOLVING ADMINISTRATIVE PROCEEDINGS: AN OBVIOUS MATTER OF ORDINARY LEGALITY. It is evident that determining whether the public administration complies with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws for special administrative proceedings, either to issue a final decision in an administrative proceeding—initiated on its own motion or at a party’s request—or to hear the applicable administrative appeals, is clearly a matter of ordinary legality that may henceforth be litigated and resolved in the administrative-litigation jurisdiction, applying the principles that inform the constitutional jurisdiction, such as derivative standing, the ability to present one’s own defense—that is, to appear without counsel—and the absence of fees for applicants. Consequently, summary dismissal is required, and the applicants are to be informed that they may, if they so choose, go to the administrative-litigation jurisdiction.\n\nVII.- SEPARATE NOTE BY JUSTICE CASTILLO VÍQUEZ. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the dispute must be heard by the Administrative-Litigation Courts, not this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, that right has been made subject to judicial protection through the amparo application established by Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material conduct, its administrative acts, or its response is affecting the petitioner’s fundamental rights. In my view, the newly enacted legislation does not require this Court to change its line of case law; under numeral 7 of its Law, this Court alone is responsible for defining its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo process, in all other cases, for the reasons this Court has given (ruling No. 2008-02545, issued at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with numeral 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable legal provisions, based on a logical, systemic, and teleological interpretation of the legal system.\n\nVIII.- DISSENTING OPINION OF JUSTICE CRUZ CASTRO. Although in the past I have upheld the Court majority’s position, upon further consideration of the fundamental rights asserted, I consider that administrative delay constitutes a violation of a fundamental procedural guarantee. For that reason, I am changing the position I previously expressed and accept that there may be a violation of the right to prompt and effective administrative justice, departing from the Court majority’s view that—with few exceptions—this type of complaint must be resolved in the administrative-litigation jurisdiction. On the contrary, I consider that one of the rights this jurisdiction is called upon to protect is the right to prompt and effective justice, expressly enshrined in Article 41 of the Constitution. This is consistent with the jurisdiction assigned to this Court to protect fundamental rights, in accordance with Articles 10 and 48 of the Political Constitution. Although I understand the importance of the reforms to the administrative-litigation jurisdiction following the entry into force of Law 8508 of 24 April 2006, that fact does not justify referring matters within this Chamber’s jurisdiction to that forum. Over the years, this Chamber has shown that it is an expeditious and effective means of protecting the fundamental rights of the country’s inhabitants.\n\nIX.- DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, DRAFTED BY THE FORMER. We disagree with the majority’s position. In this case, the Administration’s refusal to provide an essential service is upheld on the basis of technical considerations concerning insufficient water infrastructure; however, the decision fails to give due weight to the fact that access to potable water is a fundamental right, indispensable to life, health, and human dignity.\n\nArticle 21 of the Political Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution imposes on the State the duty to ensure the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to potable water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—as interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to take positive measures for its full realization. The State bears a heightened obligation in a social and democratic state governed by the rule of law; for this reason, the supply of water is a priority obligation of public authorities.\n\nFrom this perspective, invoking technical limitations cannot serve as an absolute justification for disregarding a basic need for survival. The Administration cannot merely note that the system is insufficient; it has a legal duty to plan, anticipate, and carry out the actions necessary to progressively ensure access to water service, especially for human consumption.\n\nThe majority’s approach normalizes a structural omission: it accepts that a lack of infrastructure releases the State from its obligation, when that very deficiency shows a failure to fulfill its duty to plan ahead. This does not mean requiring the impossible, but rather requiring the Administration to adopt reasonable, alternative, or progressive measures so that people are not left unprotected.\n\nWater is not just any service; it is an essential human right. The respondent authority therefore cannot shirk its duty to guarantee it by hiding behind technical limitations without offering effective solutions.\n\nFor these reasons, we consider that the application should have been admitted, at least to order the Administration to adopt concrete and progressive measures to ensure that the protected parties have effective access to potable water within a reasonable period. Water is an asset and a fundamental right whose exercise must be effectively guaranteed; this is an inescapable duty.\n\nX.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that any documents submitted on paper, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, must be collected from the office within a maximum period of 30 business days from notification of this ruling. Otherwise, any such materials not collected within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Plenary Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe application is summarily dismissed. Justice Castillo Víquez files a separate note only regarding the ruling on Article 41 of the Constitution. Justice Cruz Castro dissents only regarding Article 41 of the Constitution.
