  "body_es_text": "\n\nEXPEDIENTE N° 26-028759-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026032280\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre03, cédula de identidad CED01, a favor de Nombre01, otro tipo de identificación CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARIILADOS.\n\nResultando:\n\n 1.- Por escrito incorporado al expediente digital de la Sala a las 9:19 horas del 10 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados. Indica lo siguiente: “PRIMERO: SOBRE EL APERSONAMIENTO A LA SUCURSAL. El día 31 de julio del 2026, el señor Nombre01, en su condición de propietario registral de la finca PRN01, ubicado en Dirección02, del distrito de San Josecito, cantón de Alajuelita, provincia de San José, se apersonó al Instituto Costarricense De Acueductos Y Alcantarillados, para solicitar la disponibilidad de agua potable. SEGUNDO: SOBRE LOS REQUISITOS. Por parte del Instituto Costarricense de Acueductos y Alcantarillados, se le informó al ofendido que no cumplía con los requisitos establecidos para solicitar la disponibilidad de agua potable, toda vez que, entre dichos requisitos, se exige ostentar la nacionalidad costarricense o contar con una cédula de residencia vigente. Lo anterior, aun cuando el ofendido ostentara la condición de propietario registral del inmueble. TERCERO: SOBRE LA CONDICIÓN MIGRATORIA DEL OFENDIDO. El día 16 de febrero de 2023, la Dirección General de Migración y Extranjería otorgó al ofendido un carné provisional de permiso laboral, condición migratoria reconocida y amparada por el ordenamiento jurídico costarricense. En virtud de dicho documento vigente, el ofendido se encuentra habilitado para permanecer y laborar legalmente dentro del territorio de Costa Rica. CUARTO: A la fecha, no se le ha permitido presentar la solicitud de disponibilidad de agua potable para el inmueble de su propiedad, bajo el argumento de que no cuenta con cédula de residencia, aun cuando el artículo 50 de la Constitución Política reconoce que TODA PERSONA TIENE EL DERECHO HUMANO, BÁSICO E IRRENUNCIABLE DE ACCESO AL AGUA POTABLE, sin establecer excepción alguna en razón de la condición migratoria. En consecuencia, la negativa de recibir y tramitar la solicitud, fundamentada únicamente en la falta de cédula de residencia, vulnera el derecho fundamental de acceso al agua potable, máxime cuando los vecinos de su propiedad matrícula PRN01 sí cuentan con dicho servicio. Esta situación afecta directamente al ofendido y a su núcleo familiar, compuesto por su esposa y una menor de edad, quienes a la fecha no cuentan con acceso al servicio de agua potable. (…) PRETENSIÓN De conformidad con los artículos citados supra, pido las siguientes pretensiones, las cuales quedan fundamentadas en las razones de hecho y derecho antes expuestas: Que se dé curso al recurso de amparo. Que se ordene al Instituto Costarricense De Acueductos y Alcantarillados a tramitar mi solicitud para acceso de agua potable en la propiedad del señor Nombre01. Se condene al Instituto Costarricense De Acueductos y Alcantarillados al pago de costas, daños y perjuicios.” \n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n \n\n I.- OBJETO DEL RECURSO. La parte recurrente manifiesta que el 31 de julio de 2026, el tutelado, en su condición de propietario registral, solicitó al recurrido la disponibilidad de agua potable para su propiedad, pero le fue rechazada con el argumento de no cumplir con los requisitos, entre ellos, contar con nacionalidad costarricense o una cédula de residencia vigente. Afirma que sí cuenta con carné provisional de permiso laboral, por lo que estima lesivo de sus derechos fundamentales la imposición de tales requisitos. \n\nII.- SOBRE EL CASO CONCRETO. Respecto a los agravios expuestos, es preciso indicar que este Tribunal ha señalado que las asociaciones administradoras de acueductos y alcantarillados, las municipalidades y demás instituciones que prestan el servicio de suministro de agua potable, pueden rechazar válidamente las solicitudes de servicio de agua potable que les sean formuladas o condicionarlas si existen razones técnicas o legales que así lo justifican. De esta forma, en sentencia No. 2016-006027 de las 09:05 horas del 6 de mayo de 2016, esta Sala consideró: \n\n“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”.\n\nEste pronunciamiento puede complementarse con la resolución No. 2017-005245 de las 10:00 horas del 7 de abril de 2017, que en lo conducente dispuso: \n\n“Del informe rendido por las autoridades de la municipalidad recurrida se indica que el reclamo de la recurrente, respecto de si el lugar donde tiene la propiedad la señora Nombre04 está fuera o no del abastecimiento de agua, le corresponderá al Instituto Costarricense de Acueductos y Alcantarrillados referirse al respecto, ya que la Municipalidad no tiene competencia para ello. Y por su parte, el Instituto Costarricense de Acueductos y Alcantarillados menciona que han actuado conforme a la normativa que lo regula, ejerciendo su función rectora como corresponde, llevando a cabo en todo momento actuaciones debidamente fundamentadas y razonadas como se detalló, se evidencia así que el Instituto ha procedido conforme a derecho, ya que según el informe técnico emitido por la UEN Optimización de Sistemas Nuevos Desarrollos GAM, oficio UEN-OSND-GAM- 2017-00082, se indica claramente que para el inmueble que cita la señora Nombre02 en su recurso de amparo, no existe la disponibilidad de agua potable. Además agrega el informe, que en análisis de los antecedentes de este inmueble se tiene que pertenecía a la propiedad con catastro PRN02 y según consulta al Registro Nacional, ésta última fue fraccionada y de la misma resultaron cuatro propiedades sin mediar la gestión del trámite de disponibilidad para dicho fraccionamiento. Así las cosas, esta Sala no logra acreditar ninguna omisión o actuación arbitraria por parte de la autoridad recurrida, en consecuencia lo correspondiente es declarar sin lugar el amparo, y reiterar que según la prueba aportada, la falta de dotación del servicio de agua potable en el lote de la recurrente no es una actuación antojadiza, arbitraria o sin fundamento, sino que está justificada en la inexistencia de disponibilidad de agua potable en el sector . (Ver en similar sentido las sentencias números 2014-9134 de las 14:05 horas del 19 de junio de 2014 y 2016007240 de las 09:20 horas del 27 de mayo 2017, entre otras). Bajo esa inteligencia, no se está frente a la infracción de derechos fundamentales y, por ello, lo pertinente es desestimar el recurso de amparo”. \n\nLuego de revisado el escrito de interposición, se observa que el instituto recurrido le indicó a la parte tutelada que rechazaba su solicitud de agua potable, toda vez que incumplía los requisitos legales.\n\nAsí las cosas, la procedencia o no del servicio solicitado no es un asunto que deba discutirse en esta jurisdicción, ya que es ajeno al ámbito de su competencia, y cabe agregar que, en reiteradas ocasiones, este Tribunal ha sostenido que resulta posible desestimar las gestiones presentadas para el otorgamiento del servicio de agua potable, cuando se presenten imposibilidades técnicas, incumplimiento de requisitos infraconstitucionales o existan criterios técnicos y/o legales que así lo justifiquen. Por otra parte, este Tribunal no debe fungir como mediador ante una determinada persona física o jurídica -ya sea esta última de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que ella pretende, tal y como así lo solicita la gestionante que se proceda en este caso. En consecuencia, la parte accionante deberá plantear, si a bien lo tiene, sus inconformidades o reclamos ante la propia autoridad recurrida o en la vía jurisdiccional ordinaria, sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. \n\nEn consecuencia, el recurso se declara inadmisible.\n\nIII.-VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL, CON REDACCIÓN DEL PRIMERO. Disentimos del criterio de mayoría. En el presente caso, se valida la negativa de la Administración de brindar un servicio esencial, con base en consideraciones técnicas relativas a la insuficiencia de la infraestructura hídrica; sin embargo, se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.\n\nEl artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.\n\nDesde esta perspectiva, la invocación de limitaciones técnicas no puede erigirse en una justificación absoluta para desatender una necesidad básica de subsistencia. La Administración no puede limitarse a constatar la insuficiencia del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.\n\nEl enfoque mayoritario normaliza una omisión estructural: acepta que la falta de infraestructura exonera al Estado de su obligación, cuando precisamente esa carencia evidencia un incumplimiento de su deber de previsión. No se trata de obligar a lo imposible, sino de exigir que la Administración adopte medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.\n\nEl agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la autoridad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.\n\nPor estas razones, estimamos que el recurso debió admitirse, al menos para ordenar a la Administración la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.\n\n IV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI . \n\nPor tanto:\n\n Se rechaza de plano el recurso. San José, at 9:20 a.m. on 20 August 2026.\n\nAmparo proceeding filed by Nombre03, identity card CED01, on behalf of Nombre01, other type of identification CED02, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERAGE.\n\nBackground:\n\n1.- By a document added to the Chamber’s digital case file at 9:19 a.m. on 10 August 2026, the applicant filed an amparo proceeding against the Costa Rican Institute of Aqueducts and Sewerage. The applicant states: “FIRST: APPEARANCE AT THE BRANCH OFFICE. On 31 July 2026, Mr. Nombre01, in his capacity as the registered owner of property PRN01, located at Dirección02, in the district of San Josecito, canton of Alajuelita, province of San José, appeared at the Costa Rican Institute of Aqueducts and Sewerage to request water-service availability. SECOND: REQUIREMENTS. The Costa Rican Institute of Aqueducts and Sewerage informed the aggrieved party that he did not meet the requirements for requesting water-service availability, since those requirements include holding Costa Rican nationality or having a valid residence card. This was so even though the aggrieved party was the registered owner of the property. THIRD: THE AGGRIEVED PARTY’S IMMIGRATION STATUS. On 16 February 2023, the General Directorate of Migration and Foreigners granted the aggrieved party a provisional work-permit card, an immigration status recognized and protected by Costa Rican law. By virtue of this valid document, the aggrieved party is authorized to reside and work legally in Costa Rica. FOURTH: To date, he has not been allowed to submit an application for water-service availability for the property he owns, on the grounds that he does not have a residence card, even though Article 50 of the Constitution recognizes that EVERY PERSON HAS THE BASIC AND INALIENABLE HUMAN RIGHT OF ACCESS TO DRINKING WATER, without making any exception based on immigration status. Consequently, the refusal to receive and process the application, based solely on the lack of a residence card, violates the fundamental right of access to drinking water, especially since the neighbors of his property, registration number PRN01, do have that service. This situation directly affects the aggrieved party and his family unit, consisting of his wife and a minor, who to date have no access to drinking-water service. (…) RELIEF SOUGHT In accordance with the articles cited above, I request the following relief, supported by the factual and legal grounds set out above: That the amparo proceeding be admitted. That the Costa Rican Institute of Aqueducts and Sewerage be ordered to process my application for access to drinking water at Mr. Nombre01’s property. That the Costa Rican Institute of Aqueducts and Sewerage be ordered to pay costs, damages, and losses.”\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily reject or dismiss on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is merely a reiteration or reproduction of an identical or similar prior application that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE AMPARO. The applicant states that on 31 July 2026, the protected party, in his capacity as registered owner, requested that the respondent provide water-service availability for his property, but the request was rejected on the grounds that he did not meet the requirements, including holding Costa Rican nationality or having a valid residence card. He asserts that he does have a provisional work-permit card and therefore considers the imposition of these requirements harmful to his fundamental rights.\n\nII.- THE SPECIFIC CASE. Regarding the grievances raised, it should be stated that this Court has held that associations administering aqueduct and sewerage systems, municipalities, and other institutions providing drinking-water service may validly reject requests for water service or condition them where technical or legal grounds justify doing so. Thus, in ruling No. 2016-006027 of 9:05 a.m. on 6 May 2016, this Chamber held:\n\n“This Constitutional Court, in ruling 2014-9134 of 2:05 p.m. on 19 June 2014, which addressed an issue very similar to the one raised in the present amparo proceeding, held: ‘(...) This Chamber has stated in repeated rulings on this subject that the supply of drinking water is considered a public service under Costa Rican law, and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and in a manner that adapts to technological changes (see, in this regard, ruling 2001-09676 of 11:25 a.m. on 26 September 2001 and ruling 2004-08161 of 10:53 a.m. on 23 July 2004). It is therefore clear that the Costa Rican Institute of Aqueducts and Sewerage, as one of the state entities responsible for providing the public drinking-water service, is also required to provide this service continuously, adaptably, and efficiently, and equally to all inhabitants. At the same time, this Constitutional Court’s case law has indicated that, in the face of legal impossibility (that is, failure to meet the requirements established in the applicable regulations) or formal impossibility (that is, the absence of a Water Distribution Network), it is reasonable not to grant service requests or to require the interested party to assume installation costs when no drinking-water distribution network exists and infrastructure must be built. In these cases, it is clear that the issue is not a denial of access to drinking-water service, but rather the impossibility of providing it, or the interested party’s necessary participation in overcoming a technical impossibility, namely, the lack of infrastructure. In other words, provided that failure to supply drinking water is not capricious, arbitrary, or without grounds, but is justified by legal or material impossibility, there is no violation of fundamental rights. In the specific case, the evidence submitted and the report made under oath confirm that AyA did not arbitrarily reject the applicant’s request, but did so because all the technical and legal requirements set out in the Regulation for the Provision of Services to Clients of the Costa Rican Institute of Aqueducts and Sewerage for approving new services had not been met.’\n\nThis ruling may be supplemented by ruling No. 2017-005245 of 10:00 a.m. on 7 April 2017, which held, insofar as relevant:\n\n“According to the report submitted by the authorities of the respondent municipality, the applicant’s complaint as to whether the place where Ms. Nombre04 owns property lies within the water-supply area is a matter for the Costa Rican Institute of Aqueducts and Sewerage to address, since the Municipality has no authority over it. For its part, the Costa Rican Institute of Aqueducts and Sewerage states that it acted in accordance with the applicable regulations, properly exercising its governing function and at all times taking duly reasoned and substantiated actions, as detailed. It is thus evident that the Institute acted in accordance with law, since the technical report issued by the UEN Optimization of New Systems and Developments GAM, official letter UEN-OSND-GAM- 2017-00082, clearly states that drinking-water service is unavailable for the property cited by Ms. Nombre02 in her amparo proceeding. The report further adds that an analysis of the property’s history shows that it belonged to property recorded in the cadastral registry as PRN02 and, according to an inquiry to the National Registry, that property was subdivided into four properties without an application for service availability having been processed for that subdivision. Accordingly, this Chamber cannot establish any omission or arbitrary action by the respondent authority. The appropriate course is therefore to declare the amparo without merit and reiterate that, according to the evidence submitted, the failure to supply drinking-water service to the applicant’s lot is not capricious, arbitrary, or without grounds, but is justified by the absence of drinking-water availability in the area. (See, to similar effect, rulings Nos. 2014-9134 of 2:05 p.m. on 19 June 2014 and 2016007240 of 9:20 a.m. on 27 May 2017, among others.) Under that reasoning, there is no violation of fundamental rights and the amparo should therefore be dismissed.”\n\nUpon reviewing the filing, it is apparent that the respondent Institute informed the protected party that it was rejecting his drinking-water request because he did not meet the legal requirements.\n\nAccordingly, whether or not the requested service should be provided is not a matter to be resolved in this jurisdiction, as it falls outside its competence. It should also be added that this Court has repeatedly held that applications for drinking-water service may be dismissed when technical impossibilities arise, requirements established in subconstitutional law are not met, or technical and/or legal grounds justify doing so. Moreover, this Court should not act as a mediator with a particular natural or legal person—the latter whether governed by public or private law—to intercede on behalf of a third party so that the third party may obtain what they seek, as the applicant requests here. Consequently, the applicant may, if they so wish, bring their objections or claims before the respondent authority itself or in the ordinary judicial forum, where they may fully litigate the merits and assert their claims.\n\nAccordingly, the amparo is declared inadmissible.\n\nIII.- DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, DRAFTED BY THE FORMER. We dissent from the majority’s position. In this case, the Administration’s refusal to provide an essential service is upheld on technical grounds concerning insufficient water infrastructure; however, the decision fails to weigh adequately that access to drinking water is a fundamental right indispensable to life, health, and human dignity.\n\nArticle 21 of the Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution imposes on the State a duty to ensure the welfare of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—interpreted by the CESCR in its General Comment No. 15—recognize the human right to water and require States to take positive measures to realize it fully. A heightened obligation is imposed on the State in a social and democratic state governed by the rule of law; for this reason, the supply of water is a priority obligation of public authorities.\n\nFrom this perspective, invoking technical limitations cannot serve as an absolute justification for disregarding a basic need for survival. The Administration cannot simply establish that the system is insufficient; it has a legal duty to plan, anticipate, and carry out the actions necessary to progressively ensure access to water service, especially for human consumption.\n\nThe majority’s approach normalizes a structural omission: it accepts that a lack of infrastructure releases the State from its obligation, when that very deficiency demonstrates a failure to discharge its duty of foresight. This does not mean requiring the impossible, but rather requiring the Administration to adopt reasonable, alternative, or progressive measures so as not to leave people unprotected.\n\nWater is not an ordinary service; it is an essential human right. The respondent authority therefore cannot disregard its duty to ensure that right by invoking technical limitations without offering effective solutions.\n\nFor these reasons, we consider that the amparo should have been admitted, at least to order the Administration to adopt concrete, progressive measures to ensure the protected party effective access to drinking water within a reasonable time. Water is a good and a fundamental right whose effective enjoyment must be ensured; that duty is inescapable.\n\nIV.- DOCUMENTS SUBMITTED TO THE CASE FILE. The parties are notified that, if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must be collected from the office within a maximum period of 30 business days from notification of this ruling. Otherwise, all material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo proceeding is summarily rejected.
