San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n \n\n Recurso de amparo que se tramita bajo el número de expediente 26-028972-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, a favor de Nombre02, cédula de identidad CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. \n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de la Sala el 11 de agosto de 2026, la parte recurrente interpone recurso de amparo a favor de Nombre02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. Manifiesta que el amparado (su padre), persona adulta mayor, reside en una bodega ubicada dentro de la finca indicada y que el Instituto Costarricense de Acueductos y Alcantarillados (AyA) le ha denegado la disponibilidad de los servicios de agua potable y alcantarillado, alegando limitaciones técnicas y reglamentarias; señala que, según le indicó el AyA, para el servicio de agua potable resultan aplicables el Reglamento Ilustrado de Fraccionamiento y Urbanizaciones del INVU y el artículo 16 del Reglamento de Prestación de los Servicios del AyA, así como el artículo 23 del Reglamento de Fraccionamientos y Urbanizaciones, conforme al cual, tratándose del fraccionamiento de lotes para vivienda unifamiliar cuyo acceso a calle pública sea mediante servidumbre de paso, se establece un máximo de seis lotes a fraccionar y una vivienda unifamiliar por inmueble; agrega que, según observa en la entrada de la servidumbre, existen únicamente tres pajas de agua. Considera que la negativa desconoce el derecho humano al agua potable, indispensable para la vida, la salud y la dignidad, y que afecta directamente a su padre, quien se encuentra en condición de vulnerabilidad, colocándolo en riesgo sanitario y social y afectando sus derechos a la salud y a una vivienda digna, así como el principio de igualdad, en contraposición con el artículo 51 de la Constitución Política, que establece la protección especial de las personas adultas mayores. Solicita que se declare con lugar el recurso y se ordene al AyA garantizar de inmediato el acceso al servicio de agua potable en la bodega donde habita su padre, así como girar las órdenes necesarias para que se respete el derecho humano al agua y se evite un perjuicio irreparable a su salud y dignidad. Solicita la intervención de la Sala.\n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. La parte recurrente reclama que el Instituto Costarricense de Acueductos y Alcantarillados (AyA) habría denegado a su padre, persona adulta mayor que reside en una bodega ubicada dentro de la finca indicada, la disponibilidad de los servicios de agua potable y alcantarillado, alegando limitaciones técnicas y reglamentarias relacionadas con el fraccionamiento de la propiedad y el acceso mediante servidumbre de paso; considera que dicha negativa vulnera el derecho humano al agua y, con ello, los derechos a la salud, a una vivienda digna. Pretende que se ordene al AyA garantizar de inmediato el acceso al servicio de agua potable en la bodega donde habita el amparado.\n\nII.- INADMISIBILIDAD DEL AMPARO. En reiteradas ocasiones, esta Sala ha sostenido que si bien se reconoce el derecho fundamental al agua y su acceso en igualdad de condiciones, por cuanto se trata de un servicio esencial para la vida y la salud, también ha indicado que este derecho no implica un acceso irrestricto al agua, toda vez que la Administración puede válidamente establecer condiciones y requisitos generales para acceder a este servicio. Asimismo, resulta válido que las entidades que administran el servicio puedan rechazar las solicitudes de agua, o bien, de la carta de disponibilidad de agua, cuando el interesado no cumple los requisitos o cuando existen razones técnicas o legales que lo justifiquen. Así, en sentencia número 2016-006027 de las 09:05 horas del 6 de mayo de 2016, esta Sala consideró lo siguiente:\n\n“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”.\n\nTales argumentos resultan aplicables al caso concreto, en el cual el recurrente refiere que el AyA denegó a su padre, persona adulta mayor que reside en una bodega ubicada dentro de la finca indicada, la disponibilidad de los servicios de agua potable y alcantarillado, alegando limitaciones técnicas y reglamentarias relacionadas con el fraccionamiento del inmueble y su acceso mediante servidumbre de paso, y señalando la aplicación del Reglamento Ilustrado de Fraccionamiento y Urbanizaciones del INVU, el artículo 16 del Reglamento de Prestación de los Servicios del AyA y el artículo 23 del Reglamento de Fraccionamientos y Urbanizaciones. En consecuencia, la negativa cuestionada aparece sustentada, según lo expuesto por el propio recurrente, en razones técnicas y legales, por lo que no se advierte, en los términos planteados, una actuación manifiestamente arbitraria susceptible de tutela mediante esta vía. \n\nAhora bien, cabe señalar que la procedencia o no de la disponibilidad de agua en el inmueble de interés, así como la pertinencia de las razones técnicas y legales que sustentaron la decisión del instituto recurrido, no son cuestiones que deban discutirse en esta Jurisdicción, por tratarse de aspectos de legalidad ordinaria ajenos al ámbito de competencia de esta Sala. Tampoco puede este Tribunal sustituir a la Administración en la determinación de si se cumplen los requisitos técnicos y reglamentarios necesarios para la prestación del servicio, por lo que la pretensión de que esta Sala ordene al AyA garantizar de inmediato el acceso al servicio de agua potable en la bodega donde habita el amparado resulta improcedente en los términos planteados. Lo anterior no desconoce la especial protección constitucional que merece la persona adulta mayor ni la relevancia fundamental del acceso al agua para la vida y la salud, sino que responde a que la determinación concreta sobre la factibilidad técnica y jurídica del servicio requiere el examen de aspectos propios de la Administración y, en su caso, de la jurisdicción competente. Por ello, deberá la parte recurrente, si a bien lo tiene, plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, donde podrá discutir ampliamente el fondo del asunto y hacer valer sus pretensiones. En consecuencia, el recurso es inadmisible y así se declara.\n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso. \n\n \n\n \n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:20 a.m. on 20 August 2026.\n\nAmparo proceeding filed under expediente number 26-028972-0007-CO by Nombre01, identity card CED01, on behalf of Nombre02, identity card CED02, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nBackground:\n\n1.- In a brief filed with the Chamber Secretariat on 11 August 2026, the applicant files an amparo proceeding on behalf of Nombre02 against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. The applicant states that the amparo beneficiary (the applicant’s father), an older adult, resides in a storage building located within the indicated property and that the Instituto Costarricense de Acueductos y Alcantarillados (AyA) has denied him availability of drinking water and sewer services, citing technical and regulatory limitations. The applicant indicates that, according to AyA, the INVU Illustrated Subdivision and Urbanization Regulations and Article 16 of the AyA Regulations on the Provision of Services apply to the drinking water service, as does Article 23 of the Subdivision and Urbanization Regulations, under which, in the case of subdivision of lots for single-family housing whose access to a public road is by way of a right-of-way easement, a maximum of six lots may be subdivided and one single-family dwelling is permitted per property. The applicant adds that, as observed at the entrance to the easement, there are only three water connections. The applicant considers that the denial disregards the human right to drinking water, which is essential to life, health, and dignity, and directly affects the applicant’s father, who is in a vulnerable situation, placing him at sanitary and social risk and affecting his rights to health and decent housing, as well as the principle of equality, contrary to Article 51 of the Political Constitution, which provides special protection for older adults. The applicant asks that the amparo proceeding be granted and that AyA be ordered to guarantee immediate access to drinking water service in the storage building where the applicant’s father lives, and to issue the necessary orders to ensure respect for the human right to water and prevent irreparable harm to his health and dignity. The applicant requests the Chamber’s intervention.\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to reject outright or on the merits, at any time, including upon filing, any matter submitted for its consideration that proves manifestly inadmissible, when it considers that there is sufficient evidence to reject it, or when it is a mere reiteration or reproduction of an earlier identical or similar matter that was rejected.\n\nJustice Castillo Víquez writes; and,\n\nReasons:\n\nI.- SUBJECT OF THE AMPARO. The applicant claims that the Instituto Costarricense de Acueductos y Alcantarillados (AyA) allegedly denied the applicant’s father, an older adult who resides in a storage building located within the indicated property, availability of drinking water and sewer services, citing technical and regulatory limitations related to subdivision of the property and access by way of a right-of-way easement. The applicant considers that this denial violates the human right to water and thereby the rights to health and decent housing. The applicant seeks an order requiring AyA to guarantee immediate access to drinking water service in the storage building where the amparo beneficiary lives.\n\nII.- INADMISSIBILITY OF THE AMPARO. On numerous occasions, this Chamber has held that although the fundamental right to water and equal access to it are recognized, because it is an essential service for life and health, this right does not entail unrestricted access to water, since the Administration may validly establish general conditions and requirements for access to this service. It is also valid for the entities that administer the service to reject requests for water, or for a water availability letter, when the interested party does not meet the requirements or when technical or legal reasons justify the rejection. Thus, in judgment number 2016-006027, at 9:05 a.m. on 6 May 2016, this Chamber held as follows:\n\n“This Constitutional Court, in judgment 2014-9134, at 2:05 p.m. on 19 June 2014, which addressed an issue very similar to that raised in this amparo proceeding, held: ‘(...) This Chamber has stated in numerous judgments on the subject that, under Costa Rican law, the supply of drinking water is considered a public service and, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and to adapt to technological changes (see, in this regard, judgment 2001-09676, at 11:25 a.m. on 26 September 2001, and judgment 2004-08161, at 10:53 a.m. on 23 July 2004). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the State entities responsible for providing the public drinking water service, is likewise required to provide this service continuously, adaptably, efficiently, and equally to all inhabitants. However, this Constitutional Court’s case law has also held that, in the face of legal impossibility (that is, failure to meet requirements established in the applicable regulations) or formal impossibility (that is, the absence of a water distribution network), it is reasonable not to grant service requests, or to require the interested party to bear installation costs when there is no drinking water distribution network and infrastructure must be built. In such cases, it is clear that this is not a denial of access to drinking water service, but rather an inability to provide it or the interested party’s necessary participation in overcoming a technical obstacle, namely, the lack of infrastructure. In other words, where the failure to provide drinking water service is not arbitrary, capricious, or without grounds, but is instead justified by legal or material impossibility, there is no violation of fundamental rights. In the specific case, the evidence submitted and the report made under oath confirm that AyA did not arbitrarily reject the request submitted by the applicant, but did so because not all of the technical and legal requirements under the Regulations on the Provision of Services to Customers of the Instituto Costarricense de Acueductos y Alcantarillados for approval of new services had been met.’”\n\nThose arguments apply to this case, in which the applicant states that AyA denied the applicant’s father, an older adult who resides in a storage building located within the indicated property, availability of drinking water and sewer services, citing technical and regulatory limitations related to subdivision of the property and access by way of a right-of-way easement, and referring to the INVU Illustrated Subdivision and Urbanization Regulations, Article 16 of the AyA Regulations on the Provision of Services, and Article 23 of the Subdivision and Urbanization Regulations. Accordingly, as described by the applicant, the challenged denial appears to be based on technical and legal reasons, and therefore the conduct, as presented, does not appear manifestly arbitrary in a way that would warrant protection through this proceeding.\n\nIt should be noted, however, that whether water availability should be granted for the property in question, as well as the appropriateness of the technical and legal reasons underlying the respondent institute’s decision, are not matters to be litigated in this jurisdiction, because they concern ordinary questions of legality outside this Chamber’s jurisdiction. Nor may this Court substitute its judgment for that of the Administration in determining whether the technical and regulatory requirements necessary to provide the service have been met. Therefore, the request that this Chamber order AyA to guarantee immediate access to drinking water service in the storage building where the amparo beneficiary lives is inadmissible as presented. This does not disregard the special constitutional protection owed to older adults or the fundamental importance of access to water for life and health; rather, it reflects that determining the specific technical and legal feasibility of the service requires examination of matters within the Administration’s purview and, where appropriate, that of the competent jurisdiction. Accordingly, if the applicant so wishes, the applicant must submit any objections or claims to the respondent authorities or through the competent judicial process, where the merits of the matter may be fully argued and the applicant’s claims asserted. Consequently, the amparo proceeding is inadmissible, as is hereby declared.\n\nIII.- DOCUMENTATION SUBMITTED TO THE EXPEDIENTE.
