  "body_es_text": "\n\nEXPEDIENTE N° 26-029226-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026032335\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre03, cédula de identidad CED02, a favor de Nombre01, cédula de identidad CED03, y Nombre02, cédula de identidad CED04, contra la EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA.\n\nResultando:\n\n 1.- Por escrito recibido en la secretaría de la Sala a las 13:00 horas del 12 de agosto de 2026, la parte recurrente interpone recurso de amparo contra la EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA. Indica lo siguiente: “El día lunes 10 de agosto llego el empleado de Servicios Públicos a tomar la medida del medidor Servicio CED01 le dijo a Señora Nombre04 que habla una fuga enorme y que el recibo del agua le llegaría altísimo. Ayer se metió a la página de Servicios Públicos para ver si ya estaba el recibo y sorpresa por un monto astronómico de 01,046,250 y el cual ellos no tienen los recursos para pagar esa suma. Y tiene. Hay que pagarlo el 24 de agosto. Pero queda demostrado que en la foto y video después de abrir las Naves el medidor gira pero al final para. El día de ayer la señora Nombre01 se apersona a las oficinas de Servicios Públicos a pedir el consume del medidor de y los últimos 6 meses pero le indican que no pueden ya que el medidor no está a nombre de ella ni del hijo. Ellos son los dueños de la propiedad. Y que tienen que pagar el monto indicado. Y que ese monto es porque se le paso. De Residencial a Comercial, esto porque ellos tienen una pequeña ventana donde venden pizza y del cual ella la Mama saca a la familia adelante. Pero esto sin informar a las partes del cambio, lo mismo hicieron con el medidor de la luz realizarle el cambio sin informar a nadie. Y entonces no fue por la supuesta fuga. Y en los recibos de agua y luz tienen que venir el consume del mes anterior, actual y el consume que gasto en el mes y estos recibos de Servicios Públicos no reflejan el gasto o consume del mes. Se solicita que este recibo por más de millón sea eliminado y que cobren lo justo según la lectura y se revise o cambie el medidor y que si van a cambiar a Comercial que informen a partir de tal fecha”.\n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n \n\n I.- OBJETO DEL RECURSO. La parte recurrente aduce que se le está cobrando un monto muy alto por concepto de servicio de agua potable, por haberse variado la tarifa de residencia a comercial, sin notificación previa. Solicita la intervención a efectos de que se eliminen y cobren según la lectura del medidor, así como que se revise y cambie este. \n\nII.- SOBRE EL CASO CONCRETO. En el sub lite, se advierte que este Tribunal no es un contralor de legalidad ni una instancia más de la Administración, de modo que no le corresponde revisar, de acuerdo con el marco normativo, los supuestos fácticos y los criterios técnicos y económicos del caso, la procedencia o no del cambio de tarifa aludida, del monto cobrado por concepto del servicio de agua potable, ni si este se ajuste al consumo real. Ciertamente lo planteado no es más que un conflicto de legalidad ordinaria, que no involucra, al menos en forma directa, derecho fundamental alguno. Además, se destaca que este Tribunal no debe fungir como mediador ante una determinada persona física o jurídica -ya sea de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que ella pretende. Esos extremos deben ser resueltos por la Administración o, en su caso, la jurisdicción ordinaria. En consecuencia, el recurso se declara inadmisible.\n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\n Se rechaza de plano el recurso. \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:20 a.m. on 20 August 2026.\n\nAmparo application filed by Nombre03, identity card CED02, on behalf of Nombre01, identity card CED03, and Nombre02, identity card CED04, against the EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA.\n\nBackground:\n\n1.- In a written submission received by the Chamber’s Registry at 13:00 on 12 August 2026, the applicant files an amparo application against the EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA. The applicant states: “On Monday, 10 August, the employee of Servicios Públicos came to take the reading of the CED01 service meter. He told Señora Nombre04 that there was a huge leak and that the water bill would be extremely high. Yesterday she went to the Servicios Públicos website to see whether the bill was already there, and to her surprise it was for the astronomical amount of 01,046,250, which they do not have the resources to pay. And it is due on 24 August. But the photo and video after opening the Naves show that the meter turns but then stops. Yesterday Señora Nombre01 went to the Servicios Públicos offices to request the meter’s consumption and the last 6 months, but they told her they could not provide it because the meter is not in her name or her son’s. They are the owners of the property. They said they have to pay the stated amount. They said the amount is because they were moved from residential to commercial. This is because they have a small window where they sell pizza, from which she, the mother, supports the family. But they did this without informing the parties about the change. They did the same with the electricity meter, changing it without informing anyone. So it was not because of the alleged leak. The water and electricity bills should show the consumption for the previous month, the current month, and the consumption used during the month, but these Servicios Públicos bills do not show the month’s expenditure or consumption. They request that this bill for more than a million be canceled, that they be charged the fair amount according to the reading, and that the meter be inspected or changed, and that if they are going to change it to commercial, they inform them from what date.”\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily reject, or reject on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, when it considers that there is sufficient evidence to reject it, or when it is merely a reiteration or reproduction of an identical or similar prior application that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION. The applicant alleges that an excessively high amount is being charged for drinking water service because the rate was changed from residential to commercial without prior notice. The applicant requests intervention so that the charges are canceled and assessed according to the meter reading, and that the meter be inspected and replaced.\n\nII.- THE SPECIFIC CASE. In this case, the Court observes that it is not a legality-review body or another level of the Administration.
