Nº 2026032379\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .\n\n \n\n Gestión posterior planteada por Nombre02, cédula de identidad CED02, en relación con la sentencia nro. 2026010905 de las 9:20 horas del 27 de marzo de 2026.\n\nResultando:\n\n1.- Por escrito incorporado al expediente digital el 5 de mayo de 2026, el recurrente plantea gestión posterior en relación con la sentencia nro. 2026010905 de las 9:20 horas del 27 de marzo de 2026. Alega: “I. OBJETO. Por este medio interpongo GESTIÓN DE INCUMPLIMIENTO DE SENTENCIA Y DESOBEDIENCIA, en relación con la sentencia dictada dentro del expediente N.° 26-002473-0007-CO, resolución N.° 2026010905, emitida por la Sala Constitucional. II. HECHOS PRIMERO: Mediante la resolución N.° 2026010905, esta Sala Constitucional declaró parcialmente con lugar el recurso de amparo interpuesto, ordenando a la Municipalidad de San José, al Instituto Nacional de Vivienda y Urbanismo (INVU) y al Instituto Costarricense de Acueductos y Alcantarillados (AyA) lo siguiente: 1. Conformar una comisión interinstitucional en el plazo de CINCO (5) DÍAS, contados a partir de la notificación de la sentencia. 2. Elaborar un plan de atención en el plazo de UN MES. SEGUNDO: Con base en la revisión del expediente digital judicial, se constata que: -El Instituto Nacional de Vivienda y Urbanismo (INVU) ha procedido a designar a sus representantes. -El Instituto Costarricense de Acueductos y Alcantarillados (AYA) igualmente ha cumplido con la designación correspondiente. -Sin embargo, la Municipalidad de San José NO ha acreditado en el expediente el cumplimiento de dicha orden, al no constar la designación de sus representantes dentro del plazo conferido. TERCERO: El plazo otorgado por esa Sala Constitucional para la conformación de la comisión ha vencido en exceso, sin que exista justificación visible ni actuación procesal por parte de la Municipalidad de San José que acredite cumplimiento. CUARTO: Adicionalmente, esta parte presentó formal gestión ante las instituciones involucradas solicitando la incorporación a las mesas de trabajo y participación en las visitas de campo, en calidad de representante comunitario, con el fin de coadyuvar en la correcta ejecución de lo ordenado por esta Sala. No obstante, a la fecha no se ha recibido respuesta alguna, lo cual evidencia una ejecución parcial, opaca e incompleta del mandato constitucional. III. FUNDAMENTO DE DERECHO Los hechos descritos configuran un incumplimiento de una orden expresa emitida por esa Sala Constitucional, lo cual resulta contrario a lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional, que establece sanciones para quienes incumplan o desobedezcan resoluciones dictadas en procesos de amparo. Asimismo, se vulneran los principios de: -Tutela judicial efectiva -Legalidad -Ejecución plena de las resoluciones constitucionales. IV. PETITORIA Por lo expuesto, respetuosamente solicito a esta Sala: 1. Se tenga por interpuesta la presente gestión de incumplimiento de sentencia. 2. Se declare el incumplimiento por parte de la Municipalidad de San José, en relación con la Orden de conformar la comisión interinstitucional dentro del plazo de cinco días establecido en la sentencia N.° 2026010905. 3. Se ordene el cumplimiento inmediato de lo dispuesto por esa Sala, bajo apercibimiento de las sanciones correspondientes. 4. Se valore la apertura de procedimiento por desobediencia, conforme al artículo 71 de la Ley de la Jurisdicción Constitucional. 5. Se tenga en consideración la falta de respuesta a la solicitud de incorporación presentada por esta parte, como elemento que evidencia una ejecución deficiente del fallo constitucional”.\n\n2.- Por resolución dictada a las 9:37 horas del 6 de mayo de 2026 se solicitó informe a Yariela Quirós Álvarez, Gabriela Madrigal Garro y Lourdes Sáurez Barboza, cada una en su condición de alcaldesa de la Municipalidad de San José, presidenta ejecutiva del Instituto Nacional de Vivienda y Urbanismo y presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en su lugar ocupen esos cargos, para que se refieran y aporten las pruebas correspondientes en relación con los hechos y omisiones que se les atribuyen. \n\n3.- Rinde informe Gabriela Madrigal Garro en su condición de presidenta ejecutiva del INVU. Expone: “A efectos de cumplir con lo anterior, y respecto al punto i) del por tanto arriba señalado, procede esta Presidencia Ejecutiva a informar la designación de los funcionarios, la Arq. Jessica Peralta Quesada, Encargada de la Unidad de Soluciones Habitacionales y el Ing. Robert Garita Hernández, como representantes de este Instituto para integrar la Comisión Interinstitucional que abordará el tema objeto del presente Recurso, relativo a Finca San Juan, y para trabajar en estrecha coordinación de acuerdo con las competencias que le son otorgadas al INVU, según su Ley Orgánica N°1788, del 24 de agosto de 1954. En su momento, se informará en el plazo otorgado y respecto al punto ii), los avances de coordinación y planificación de este Instituto con la Municipalidad de San José y el Instituto Costarricense de Acueductos y Alcantarillados para abordar el tema”. \n\n4.- Rinde informe Alejandro Morales Moya en su condición de abogado de la Dirección Jurídica del Instituto Costarricense de Acueductos y Alcantarillados. Expone: “Tal y como lo indica el recurrente en el escrito que consta en el expediente electrónico, en el que acusa desobediencia a lo ordenado por esta Sala en la sentencia 2026010905 de las 9:20 horas del 27 de marzo de 2026, mi Representada, en memorando de la Gerencia General del Instituto Costarricense de Acueductos y Alcantarillados No. GG-2026-01164 de fecha 08 de abril del 2026 designó los representantes institucionales ante la comisión interinstitucional para atender el tratamiento de las aguas residuales en ese sector, Ing. Alejandro González Bogantes y el Ing. Carlos Andrés Esquivel, con lo que se cumplió con lo ordenado por su Autoridad en el voto de marras”. \n\n5.- Rinde informe Gabriela Madrigal Garro en su condición de presidenta ejecutiva del INVU. Expone: “En lo medular, la resolución de cita señala que, el recurrente Nombre02, acusa desobediencia a lo ordenado por esta Sala en la sentencia número 2026010905 de las 9:20 horas del 27 de marzo de 2026. Respecto a lo indicado y en defensa de las actuaciones del INVU se procede a informar: HECHOS 1. Esta representación en fecha 09 de abril 2026, informó dentro del expediente y en el plazo señalado la designación de dos funcionarios de la Unidad de Proyectos Habitacionales del INVU, quienes formarán parte de las mesas de trabajo interinstitucionales. La evidencia puede observarse incorporada al expediente. 2. Asimismo, en fecha 06 de mayo 2026 el INVU comunicó dentro del plazo otorgado, sobre los avances de coordinación que ha venido gestionando con las demás entidades, a fin de conformar las mesas de trabajo correspondientes que permitan abordar la problemática que afecta a Finca San Juan. Lo anterior, con sustento al Informe DPH-UPH-083-2026 fecha 04 de mayo 2026, de la Unidad de Proyectos Habitacionales del INVU y sus evidencias, las cuales se encuentran incorporadas al expediente en la fecha indicada para conocimiento de las partes. 3. Según se indicó en el escrito del 06 de mayo, mediante Oficio N°PE-197-2026, de fecha 28 de abril de 2026, la Presidencia Ejecutiva del INVU tomó la iniciativa de extender invitación a los jerarcas de las demás instituciones, solicitando formalmente un espacio de trabajo para la elaboración del Plan de Acción en conjunto. No obstante, nos encontramos a la espera de una respuesta formal, tomando en consideración que, así como es de conocimiento general, los nuevos jerarcas ingresan a las instituciones la próxima semana. De igual manera, el INVU sufre un cambio en el nombramiento respecto a la actual presidencia ejecutiva. Sin embargo, quien asume el puesto brindará seguimiento a las diligencias promovidas por el INVU. 4. Además, se incorpora como elemento probatorio junto a este escrito, el oficio DPHUPH-089-2026 de fecha 07 de mayo de 2026. Mediante dicho documento, la Unidad de Proyectos Habitacionales rinde informe sobre la solicitud de criterio legal gestionada ante la Asesoría Legal del INVU (oficio DPH-UPH-082-2026 del 04 de mayo), referente al Proyecto de Bono Colectivo Finca San Juan, III Etapa. PETITORIA De acuerdo con las evidencias aportadas por el INVU, el 09 de abril, 06 de mayo y el 07 de mayo 2026 y según pueden ser constatadas las diversas gestiones que ha venido realizando el INVU por medio de la Unidad de Proyecto Habitacionales, diligencias que constan en el expediente electrónico, afirma esta representación que no existe mérito alguno para presumir que el INVU ha hecho caso omiso a la ordenado mediante sentencia número 2026010905 de las 9:20 horas del 27 de marzo de 2026. En virtud de lo expuesto, debe descartarse cualquier condena por desobediencia en contra de mi representada. El recurrente no ha logrado acreditar la inercia institucional alegada; por el contrario, ha quedado demostrado que el INVU ha informado puntualmente, dentro de los plazos legales, sobre los avances, diligencias y labores ejecutadas —tanto a nivel interno como externo— para dar efectivo cumplimiento a las obligaciones impuestas por esta estimable Sala Constitucional”. \n\n6.- Rinde informe Diego Miranda Méndez en su condición de alcalde de San José. Expone: “(…) según certificación adjunta, en tiempo y forma procedemos a rendir según resolución de las nueve horas treinta y siete minutos del seis de mayo de dos mil veintiséis, informe adjunto, Oficio GGMDU-0348-2026, en el cual se puede apreciar las acciones que este Gobierno Local a realizado y coordinado a nivel interno así como también con actores e instituciones externas. Aunado a lo anterior, se recalca que la Municipalidad de San José, no ha incurrido en desobediencia o en incumplimiento sobre las acciones objeto del presente recurso. En consecuencia, rendimos el informe en cumplimiento de lo ordenado por esa Honorable Sala en mediante la resolución antes indicada. I. PRUEBA Para sustentar el cumplimiento de lo ordenado por esa Honorable Sala, ofrecemos como prueba documental: 1. Oficio GGMDU-0348-2026, de la Arq. Jessica Martínez Porras, Gerente de Gestión Municipal y Desarrollo Urbano 2 II. PETITORIA En mérito de lo expuesto, es determinable, según la documentación citada y adjunta al expediente y partiendo de que se han venido realizado las acciones respectivas de lo establecido en la Resolución N° 2026010905 de las 9:20 horas del 27 de marzo de 2026. Se rechace las manifestaciones realizadas por la accionante sobre la desobediencia realizada por esta Corporación Municipal en consecuencia, se proceda a realizar el descargo teniendo por cumplido lo correspondiente según el presente informe el cual se envía a la honorable Sala, mediante el Sistema de Gestión en Línea, Oficio GGMDU-0348-2026, de la Arq. Jessica Martínez Porras, Gerente de Gestión Municipal y Desarrollo Urbano, el cual se adjunta como prueba”. \n\n7.- Por escrito incorporado al expediente electrónico el 11 de junio de 2026, el recurrente indicó: “Por este medio, yo, Nombre02, portador de la cedula de identidad CED01, en mi condición de ciudadano y presidente de la Comisión Nacional de Gestión Social (CONAGES), solicito a esta sala valorar gestión de notificación y conocimiento de incumplimiento y posible desobediencia a lo ordenado por la Sala Constitucional. I. ANTECEDENTES PRIMERO: Mediante resolución n.° 2026010905 de fecha 27 de marzo de 2026, esta Sala ordeno la conformación de una Comisión Interinstitucional, otorgando un plazo de cinco días para su integración y un plazo de un mes para elaborar un Plan Reparador destinado a atender la problemática objeto del presente recurso. SEGUNDO: Con fecha 5 de mayo de 2026, nuestra organización presento una gestión poniendo en conocimiento de la Sala la aparente falta de nombramiento de representantes ante dicha Comisión Interinstitucional. TERCERO: Posteriormente, mediante resolución de fecha 06 de mayo de 2026, esta Sala previno a diversas autoridades para que rindieran los informes y descargos correspondientes. II. HECHOS NUEVOS De la revisión del expediente electrónico se desprende que existen elementos que evidencian un posible incumplimiento de lo ordenado por esta Sala. Particularmente, se observa que la Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (AyA) no habría rendido el informe requerido dentro del plazo conferido por esta Sala. Asimismo, de las actuaciones visibles en el expediente no se logra verificar de manera clara y fehaciente que todas las instituciones involucradas hayan cumplido con: a) El nombramiento oportuno de sus representantes ante la Comisión Interinstitucional. b) La participación efectiva dentro de dicha comisión. c) La elaboración y presentación del Plan Reforzador ordenado por esta Sala. d) La rendición completa y oportuna de los informes requeridos. III. SOBRE EL INCUMPLIMIENTO ! Las resoluciones emitidas por la Sala Constitucional son de acatamiento obligatorio para todos los funcionarios y autoridades públicas. En consecuencia, el incumplimiento total o parcial de una orden constitucional, así como la omisión de presentar informes requeridos por este Tribunal, constituye un asunto de especial gravedad que debe ser verificado por esta Sala a fin de garantizar la eficacia de sus resoluciones. Esta parte considera que los hechos descritos podrían configurar un incumplimiento de lo ordenado mediante la resolución N.° 2026010905 del 27 de marzo de 2026, razón por la cual resulta procedente su valoración por parte de este Tribunal. IV. PETITORIA Por lo expuesto, respetuosamente solicito: 1- Tener por presentado este escrito y por puestos en conocimiento los hechos aquí descritos. 2-Verificar el cumplimiento de la resolución N.° 2026010905 de fecha 27 de marzo de 2026. 3- Determinar cuáles instituciones cumplieron y cuales no cumplieron con: A- El nombramiento de representantes. B- La integración de la Comisión Interinstitucional. C- La elaboración y presentación del Plan Reforzador. F- La rendición de informes ordenados por esta Sala. G- Que, de comprobarse1 incumplimientos u omisiones, se adopten las medidas legales que correspondan para asegurar el pleno acatamiento de la resolución constitucional. H- Que este escrito sea incorporado al expediente para su valoración al momento de resolver sobre el cumplimiento de lo ordenado”. \n\n8.- Por resolución dictada a las 10:59 horas del 6 de julio de 2026, se previno al alcalde de San José, a la presidenta ejecutiva del Instituto Nacional de Vivienda y Urbanismo, y a la presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, a fin de que informen a esta Sala quiénes conforman la comisión interinstitucional encargada de abordar la problemática aquejada por el asentamiento finca San Juan respecto a la recolección y tratamiento de aguas servidas y sanitarias; asimismo, deberán remitir una copia del plan establecido por dicha comisión interinstitucional para atender la problemática en cuestión, a fin de cumplir lo ordenado por la Sala en la sentencia nro. 2026010905 de las 9:20 horas del 27 de marzo de 2026.\n\n9.- Rinde informe Diego Miranda Méndez en su condición de alcalde de San José. Expone: “(…) según demuestra en autos, se remite informe de prueba para mejor resolver, mediante Oficio GGMDU-0524-2026, en el cual se indica la conformación de la comisión interinstitucional encargada de abordar la problemática aquejada por el asentamiento finca San Juan respecto a la recolección y tratamiento de aguas servidas y sanitarias y el plan establecido por dicha comisión interinstitucional para atender la problemática en cuestión lo anterior según resolución de las diez horas cincuenta y nueve minutos del seis de julio de dos mil veintiséis, en los siguientes términos: En virtud del informe antedicho, así como de las manifestaciones, queda acreditado que la Municipalidad ha procurado en todo momento atender las gestiones presentadas y relacionadas con lo solicitado por el Recurrente, cabe señalar, conforme al informe rendido, que la Municipalidad en ningún momento ha eludido el trámite y tampoco ha asumido una conducta omisiva en cuanto a las peticiones del interesado”. \n\n10.- Rinde informe Johnny Leiva Badilla en su condición de presidente ejecutivo del Instituto Nacional de Vivienda y Urbanismo. Expone: “En dicha resolución, esa estimable Sala solicitó como prueba para mejor resolver informe al alcalde de San José, a la presidencia ejecutiva del Instituto Nacional de Vivienda y Urbanismo, y a la presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, donde se informe quiénes conforman la comisión interinstitucional encargada de abordar la problemática aquejada por el asentamiento finca San Juan respecto a la recolección y tratamiento de aguas servidas y sanitarias. Asimismo, solicitó remitir una copia del plan establecido por dicha comisión interinstitucional para atender la problemática en cuestión, a fin de cumplir lo ordenado mediante sentencia n° 2026010905 de las 9:20 horas del 27 de marzo de 2026. En virtud de lo anterior, el Instituto Nacional de Vivienda y Urbanismo , en atención a lo ordenado en la sentencia Res. Nº 2026010905 y de conformidad con el oficio DPH-UPH-119-2026, fecha 09 de julio de 2026, del Departamento de Programas Habitacionales, rinde el presente informe sobre las acciones desarrolladas por esta institución y el avance de la abor interinstitucional llevada a cabo hasta la fecha para solventar la problemática de recolección y tratamiento de aguas servidas en el asentamiento Finca San Juan (Etapas I, II y III): 1. Conformación y Actualización de la Comisión Interinstitucional • Designación oportuna: Cumpliendo con el primer extremo del, por tanto, el INVU designó formalmente a sus representantes técnicos el 09 de abril de 2026, mediante el oficio PE-150-2026. • Continuidad técnica: Ante la jubilación del Ing. Robert Garita Hernández, el INVU garantizó la continuidad del proceso realizando la suplencia inmediata por el Ing. Alexander Alpízar Segura, integrando la comisión actualmente junto a la Arq. Jessica Peralta Quesada 2. Trabajo Coordinado y Gestión Interinstitucional El INVU ha mantenido una participación proactiva en las mesas técnicas junto al Instituto Costarricense de Acueductos y Alcantarillados (AyA), el Ministerio de Vivienda y Asentamientos Humanos (MIVAH) y la Municipalidad de San José. • Evaluación de la Alternativa D: La comisión validó como la opción más adecuada el sistema de bombeo e impulsión hacia la planta de tratamiento Los Tajos. Esto no solo solucionará la situación de Finca San Juan, sino que beneficiará a comunidades aledañas, logrando un impacto ambiental positivo hacia las poblaciones. • Análisis de viabilidad financiera: Al determinarse que el costo técnico de la Alternativa D supera los ₡2.425.480.941,04, el INVU ha participado en sesiones virtuales (como la efectuada el 8 de julio de 2026) donde propuso otros escenarios alternativos (Alternativas 2, 3 y 4) para asegurar que el proyecto no se detenga por limitaciones presupuestarias. 3. Labores Exclusivas y Seguimiento de Campo por parte del INVU A nivel de competencias directas, esta institución ha desplegado importantes esfuerzos en el sitio: Insumos geográficos y de catastro: el INVU ha puesto a disposición al Ing. Topógrafo, con la finalidad de que, en conjunto con el AYA, se defina en sitio el punto de amarre o sector requerido para servidumbre de paso. Lo anterior vinculado con el abordaje que se debe realizar con las familias que se ubican informalmente en el terreno del INVU, trabajo que debe realizarse junto con el MIVAH. Ejecución del Censo Socioeconómico: El INVU programó y se encuentra ejecutando de manera activa las labores para el censo poblacional en los terrenos de reserva ocupados informalmente, esta tarea inició partir del mes de junio 2026. Para esto, solicitó el apoyo al MIVAH mediante el oficio PE-255-2026. Se tiene programado aplicar el censo tres veces por semana, lo cual es indispensable para trazar las estrategias de atención y eventual reubicación de las familias. Inspecciones de campo: El pasado 1 de julio de 2026, personal técnico del INVU participó directamente en visitas de campo conjuntas con el AyA en Finca San Juan para verificar las condiciones del terreno en sitio. Además, El 7 de julio del 2026, el INVU participó a la sesión convocada por la Municipalidad de San José. 4. Plan de Acción y Siguientes Pasos A modo de resumen, se ha estructurado un Plan de Acción formal que proyecta de forma ordenada las siguientes acciones: 1. Evaluar Técnicamente la problemática. 2. Generar Censo Social del asentamiento informal ubicado en el sector sur de la urbanización Finca San Juan de las 3 etapas. (actividad en procesos de ejecución) 3. Identificar y analizar las potenciales alternativas técnicas de abordaje a la problemática. (actividad en procesos de ejecución). 4. Valorar costos de las Alternativas Técnicas. 5. Análisis de disponibilidad presupuestaria y valoración de otras fuentes de recursos. 6. Definición de Alternativa seleccionada (Programada para octubre 2026) 7. Adquisición de terrenos (Expropiaciones), conformación de servidumbres y Estrategia de liberación de terrenos. 8. Incorporación de recursos adicionales. 9. Asignación de recursos. 10. Acuerdos Institucionales de los Jerarcas Institucionales 11. Diseño de procesos de contratación. 12. Procesos previos relacionados con la contratación: MIDEPLAN, Viabilidad Ambiental, Acuerdos Institucionales, Disponibilidades de Servicios públicos y de las Instituciones Estatales, Gestiones Administrativas vinculadas a procesos BANHVI y MIVAH. 13. Ejecución de diferentes Licitaciones necesarias a los distintos procesos de contratación de Estudios Técnicos, Diseño y Construcción de obras por fases o etapas. 14. Ejecución las licitaciones de los Estudios Técnicos, Diseño y Construcción de obras. Valga indicar que, en el Informe técnico DPH-UPH-119-2026 del Departamento de Proyectos Habitacionales puede verse de forma más amplia y detallada la información suministrada con el respaldo de sus adjuntos y evidencias. Finalmente, el INVU reitera a esta Sala su firme compromiso técnico y legal en continuar liderando los procesos institucionales asignados, manteniendo una comunicación constante y la emisión de los informes de avance periódicos que correspondan”. \n\n11.- Rinde informe Lourdes María Sáurez Barboza en su condición de presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados. Expone: “En escrito suscrito por el Licenciado Alejandro Morales Moya, en su condición de Apoderado Especial Judicial, incorporado a este expediente el 9 de abril de 2026, se informó que los funcionarios Alejandro González Bogantes y Carlos Andrés Esquivel fueron designados como representantes institucionales ante la comisión interinstitucional encargada de atender la problemática que afecta al asentamiento Finca San Juan en materia de recolección, conducción y tratamiento de aguas residuales y sanitarias, de conformidad con el memorando No. GG-2026-01164 de fecha 8 de abril de 2026, suscrito por el señor Nombre01, en su condición de Gerente General. Se hace constar que dichas designaciones se mantienen vigentes a la fecha. Asimismo, para efectos de dar cumplimiento a lo solicitado, se remite copia del plan institucional elaborado para la atención de la problemática, contenido en el Informe Técnico emitido por la UEN Programación y Control de la Subgerencia de Ambiente, Investigación y Desarrollo y la Subgerencia de Gestión de Sistemas GAM, documento que se adjunta al presente escrito”.\n\n12.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\n Considerando:\n\n I.- En la sentencia nro. 2026010905 de las 9:20 horas del 27 de marzo de 2026, se dispuso:\n\n“Se declara parcialmente con lugar el recurso, solo en cuanto al Instituto Nacional de Vivienda y Urbanismo, el Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de San José, debido a la demora en solventar la problemática aquejada por el asentamiento finca San Juan respecto a la recolección y tratamiento de aguas servidas y sanitarias. Se les ordena a Yariela Quirós Álvarez, Gabriela Madrigal Garro y Lourdes Sáurez Barboza, cada una en su condición de alcaldesa a.i. de la Municipalidad de San José, presidenta ejecutiva del Instituto Nacional de Vivienda y Urbanismo y presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en su lugar ocupen esos cargos, coordinar lo necesario, tomar las medidas adecuadas y girar las órdenes que correspondan dentro del ámbito de sus competencias respectivas, a fin de que: i) en el plazo de CINCO DÍAS, contado a partir de la notificación de este pronunciamiento, se cree una comisión interinstitucional que se encargue específicamente de abordar la problemática aquejada por el asentamiento finca San Juan respecto a la recolección y tratamiento de aguas servidas y sanitarias; y ii) en el plazo de UN MES, contado a partir de la creación de la comisión interinstitucional supramencionada, se diseñe un plan para atender el problema objeto de este recurso, el cual deberá ser puesto en conocimiento de esta Cámara. Tome nota el alcalde de San José de lo indicado in fine del considerando IV de este pronunciamiento. Lo anterior se dicta con el apercibimiento de que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Nacional de Vivienda y Urbanismo, al Instituto Costarricense de Acueductos y Alcantarillados y a la Municipalidad de San José al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El magistrado Salazar Alvarado pone nota. Notifíquese”. \n\nTal sentencia fue notificada a las autoridades recurridas el 31 de marzo de 2026.\n\nII.- SOBRE LA GESTIÓN DE INEJECUCIÓN PLANTEADA. En la especie, la parte recurrente plantea gestión posterior en relación con la sentencia nro. 2026010905 de las 9:20 horas del 27 de marzo de 2026. Alega que la Municipalidad de San José no ha acreditado la designación de sus representantes dentro del plazo conferido. Además, afirma que solicitó la incorporación a las mesas de trabajo y participación en las visitas de campo en condición de representante comunitario; sin embargo, no recibió respuesta. \n\nSobre el particular, nótese que en la sentencia nro. 2026010905 de las 9:20 horas del 27 de marzo de 2026, lo ordenado por esta Sala fue que: “: i) en el plazo de CINCO DÍAS, contado a partir de la notificación de este pronunciamiento, se cree una comisión interinstitucional que se encargue específicamente de abordar la problemática aquejada por el asentamiento finca San Juan respecto a la recolección y tratamiento de aguas servidas y sanitarias; y ii) en el plazo de UN MES, contado a partir de la creación de la comisión interinstitucional supramencionada, se diseñe un plan para atender el problema objeto de este recurso, el cual deberá ser puesto en conocimiento de esta Cámara”. \n\nAl respecto, de los informes y prueba aportada se desprende que se nombraron los siguientes representantes: Por la Municipalidad de San José: Jessica Martínez Porras, Roy Allan Jiménez Céspedes y Mauren Badilla Villalobos. Por el Instituto Costarricense de Acueductos y Alcantarillados: Alejandro González Bogantes y Carlos Esquivel Vindas. Por el Instituto Nacional de Vivienda y Urbanismo: Alexander Alpízar Segura y Jessica Peralta Quesada. Además, remitieron copia de los informes técnicos en los que constan los planes de acción a fin de atender el problema objeto de este recurso.\n\nPor consiguiente, en los términos en que fue planteada la gestión de desobediencia, en este momento procesal no se observa incumplimiento alguno que amerite la intervención de la Sala. \n\nIII.- Ahora bien, la parte recurrente también expone que: “Adicionalmente, esta parte presentó formal gestión ante las instituciones involucradas solicitando la incorporación a las mesas de trabajo y participación en las visitas de campo, en calidad de representante comunitario, con el fin de coadyuvar en la correcta ejecución de lo ordenado por esta Sala. No obstante, a la fecha no se ha recibido respuesta alguna”.\n\nSobre el particular, esta Sala observa que este aspecto reclamado por la parte accionante es distinto a los conocidos en el recurso de marras, en tanto reclama que solicitó su incorporación como representante comunitario, sin que las autoridades recurridas le hayan brindado respuesta. \n\nAsí las cosas, lo procedente es desglosar el escrito incorporado al expediente digital el 5 de mayo de 2026, a fin de que, en lo que refiere a este extremo, sea tramitado como un asunto nuevo.\n\nIV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012. \n\nPor tanto:\n\nNo ha lugar a la gestión de desobediencia formulada. Nº 2026032379\n\n \n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 25 August 2026.\n\n \n\nPost-judgment motion filed by Nombre02, identity card CED02, in connection with judgment no. 2026010905, issued at 9:20 a.m. on 27 March 2026.\n\nBackground:\n\n1.- By filing entered in the digital case file on 5 May 2026, the amparo applicant filed a post-judgment motion in connection with judgment no. 2026010905, issued at 9:20 a.m. on 27 March 2026. The applicant alleges: “I. PURPOSE. By this means, I file a MOTION FOR FAILURE TO COMPLY WITH JUDGMENT AND DISOBEDIENCE, in connection with the judgment issued in case file No. 26-002473-0007-CO, ruling No. 2026010905, issued by the Constitutional Chamber (Sala Constitucional). II. FACTS FIRST: By ruling No. 2026010905, this Constitutional Chamber granted the amparo application in part, ordering the Municipality of San José, the National Institute of Housing and Urbanism (INVU), and the Costa Rican Institute of Aqueducts and Sewers (AyA) to do the following: 1. Establish an interinstitutional commission within FIVE (5) DAYS, counted from service of the judgment. 2. Prepare an action plan within ONE MONTH. SECOND: Based on a review of the digital judicial case file, it is established that: -The National Institute of Housing and Urbanism (INVU) has designated its representatives. -The Costa Rican Institute of Aqueducts and Sewers (AyA) has likewise made the corresponding designation. -However, the Municipality of San José has NOT established compliance with that order in the case file, as there is no record that it designated its representatives within the time granted. THIRD: The time granted by this Constitutional Chamber to establish the commission has long since expired, and there is no visible justification or procedural action by the Municipality of San José establishing compliance. FOURTH: Additionally, this party filed a formal request with the institutions involved seeking to be included in the working groups and to participate in field visits as a community representative, in order to assist in the proper implementation of what this Chamber ordered. However, to date no response has been received, which shows partial, opaque, and incomplete implementation of the constitutional mandate. III. LEGAL BASIS The facts described constitute failure to comply with an express order issued by this Constitutional Chamber, contrary to Article 71 of the Constitutional Jurisdiction Act, which establishes penalties for those who fail to comply with or disobey rulings issued in amparo proceedings. The following principles are also violated: -Effective judicial protection -Legality -Full implementation of constitutional rulings. IV. RELIEF REQUESTED For the reasons stated, I respectfully ask this Chamber to: 1. Accept this motion for failure to comply with judgment. 2. Declare that the Municipality of San José failed to comply with the order to establish the interinstitutional commission within the five-day period set in judgment No. 2026010905. 3. Order immediate compliance with what this Chamber directed, subject to the corresponding penalties. 4. Consider opening proceedings for disobedience pursuant to Article 71 of the Constitutional Jurisdiction Act. 5. Take into account the lack of response to this party’s request to be included as evidence of deficient implementation of the constitutional judgment.”\n\n2.- By ruling issued at 9:37 a.m. on 6 May 2026, Yariela Quirós Álvarez, Gabriela Madrigal Garro, and Lourdes Sáurez Barboza, each in her capacity as mayor of the Municipality of San José, executive president of the National Institute of Housing and Urbanism, and executive president of the Costa Rican Institute of Aqueducts and Sewers, respectively, or whoever holds those positions in their stead, were asked to submit a report and provide the corresponding evidence concerning the facts and omissions attributed to them.\n\n3.- Gabriela Madrigal Garro submits a report in her capacity as executive president of INVU. She states: “For purposes of complying with the foregoing, and regarding point i) of the operative part cited above, this Executive Presidency hereby reports the appointment of the officials Architect Jessica Peralta Quesada, Head of the Housing Solutions Unit, and Engineer Robert Garita Hernández as this Institute’s representatives on the Interinstitutional Commission that will address the matter at issue in this amparo proceeding, concerning Finca San Juan, and work in close coordination in accordance with the powers granted to INVU under its Organic Law No. 1788 of 24 August 1954. In due course, within the time granted and with respect to point ii), we will report on this Institute’s coordination and planning progress with the Municipality of San José and the Costa Rican Institute of Aqueducts and Sewers to address the matter.”\n\n4.- Alejandro Morales Moya submits a report in his capacity as attorney with the Legal Department of the Costa Rican Institute of Aqueducts and Sewers. He states: “As the amparo applicant indicates in the filing contained in the electronic case file, in which he alleges disobedience of what this Chamber ordered in judgment 2026010905, issued at 9:20 a.m. on 27 March 2026, my represented institution, in a memorandum from the General Management of the Costa Rican Institute of Aqueducts and Sewers, No. GG-2026-01164, dated 8 April 2026, designated the institutional representatives to the interinstitutional commission tasked with addressing wastewater treatment in that sector: Engineer Alejandro González Bogantes and Engineer Carlos Andrés Esquivel. This fulfilled what Your Authority ordered in the aforementioned ruling.”\n\n5.- Gabriela Madrigal Garro submits a report in her capacity as executive president of INVU. She states: “In substance, the cited ruling states that the amparo applicant, Nombre02, alleges disobedience of what this Chamber ordered in judgment number 2026010905, issued at 9:20 a.m. on 27 March 2026. Regarding this allegation, and in defense of INVU’s actions, we report as follows: FACTS 1. On 9 April 2026, this representative reported in the case file, within the time specified, the designation of two officials from INVU’s Housing Projects Unit, who will be members of the interinstitutional working groups. The evidence can be viewed in the case file. 2. Also, on 6 May 2026, INVU reported within the time granted on the coordination progress it had been making with the other entities in order to establish the relevant working groups to address the problems affecting Finca San Juan. This was supported by Report DPH-UPH-083-2026, dated 4 May 2026, from INVU’s Housing Projects Unit, and its supporting evidence, which were entered in the case file on the indicated date for the parties’ information. 3. As stated in the filing of 6 May, by Official Letter No. PE-197-2026, dated 28 April 2026, INVU’s Executive Presidency took the initiative to invite the heads of the other institutions, formally requesting a working session to prepare the Action Plan jointly. However, we are awaiting a formal response, bearing in mind that, as is generally known, the new heads will take office at the institutions next week. INVU is also undergoing a change in appointment to its current executive presidency. Nevertheless, the person taking office will follow up on the steps promoted by INVU. 4. In addition, Official Letter DPHUPH-089-2026, dated 7 May 2026, is submitted as evidence together with this filing. In that document, the Housing Projects Unit reports on the request for a legal opinion submitted to INVU’s Legal Counsel (Official Letter DPH-UPH-082-2026 of 4 May), concerning the Finca San Juan Collective Bonus Project, Phase III. RELIEF REQUESTED Based on the evidence submitted by INVU on 9 April, 6 May, and 7 May 2026, and as can be verified from the various steps INVU has taken through the Housing Projects Unit, which are documented in the electronic case file, this representative maintains that there is no basis to presume that INVU disregarded the order issued in judgment number 2026010905, issued at 9:20 a.m. on 27 March 2026. In light of the foregoing, any finding of disobedience against my represented institution should be dismissed. The amparo applicant has not established the alleged institutional inaction; on the contrary, it has been shown that INVU has duly reported, within the statutory time limits, on the progress, steps, and work carried out—both internally and externally—to effectively comply with the obligations imposed by this esteemed Constitutional Chamber.”\n\n6.- Diego Miranda Méndez submits a report in his capacity as mayor of San José. He states: “(…) as shown by the attached certification, we hereby submit, in due time and form pursuant to the ruling issued at 9:37 a.m. on 6 May 2026, the attached report, Official Letter GGMDU-0348-2026, which shows the actions this Local Government has taken and coordinated internally, as well as with external stakeholders and institutions. In addition, we emphasize that the Municipality of San José has not disobeyed or failed to comply with the actions at issue in this proceeding. Accordingly, we submit this report in compliance with what that Honorable Chamber ordered by the aforementioned ruling. I. EVIDENCE To support compliance with what that Honorable Chamber ordered, we offer the following documentary evidence: 1. Official Letter GGMDU-0348-2026 from Architect Jessica Martínez Porras, Manager of Municipal Management and Urban Development 2 II. RELIEF REQUESTED In light of the foregoing, based on the cited documentation attached to the case file and on the fact that the relevant actions under Ruling No. 2026010905, issued at 9:20 a.m. on 27 March 2026, have been carried out, it is appropriate to reject the amparo applicant’s allegations that this Municipal Corporation disobeyed the order and, accordingly, to accept this response as establishing compliance with the relevant requirements, as set out in this report submitted to the Honorable Chamber through the Online Case Management System, Official Letter GGMDU-0348-2026 from Architect Jessica Martínez Porras, Manager of Municipal Management and Urban Development, attached as evidence.”\n\n7.- By filing entered in the electronic case file on 11 June 2026, the amparo applicant stated: “By this means, I, Nombre02, holder of identity card CED01, in my capacity as a citizen and president of the National Commission for Social Management (CONAGES), ask this Chamber to consider a request for notice and review of noncompliance and possible disobedience of what the Constitutional Chamber ordered. I. BACKGROUND FIRST: By ruling No. 2026010905 dated 27 March 2026, this Chamber ordered the establishment of an Interinstitutional Commission, allowing five days for its formation and one month to prepare a Remedial Plan to address the problem at issue in this proceeding. SECOND: On 5 May 2026, our organization filed a motion informing the Chamber of the apparent failure to appoint representatives to that Interinstitutional Commission. THIRD: Subsequently, by ruling dated 6 May 2026, this Chamber directed various authorities to submit the corresponding reports and responses. II. NEW FACTS A review of the electronic case file reveals evidence of possible failure to comply with what this Chamber ordered. Specifically, it appears that the Executive Presidency of the Costa Rican Institute of Aqueducts and Sewers (AyA) may not have submitted the requested report within the time granted by this Chamber. Moreover, the proceedings visible in the case file do not clearly and conclusively establish that all the institutions involved have complied with: a) Timely appointment of their representatives to the Interinstitutional Commission. b) Effective participation in that commission. c) Preparation and submission of the Reinforcement Plan ordered by this Chamber. d) Complete and timely submission of the requested reports. III. NONCOMPLIANCE! Rulings issued by the Constitutional Chamber are binding on all public officials and authorities. Consequently, total or partial failure to comply with a constitutional order, as well as failure to submit reports requested by this Court, is a matter of particular gravity that this Chamber must verify to ensure the effectiveness of its rulings. This party considers that the facts described could constitute failure to comply with what was ordered by Ruling No. 2026010905 of 27 March 2026, and therefore warrant review by this Court. IV. RELIEF REQUESTED For the foregoing reasons, I respectfully request: 1- That this filing be accepted and the facts described herein be brought to the Chamber’s attention. 2- That compliance with Ruling No. 2026010905 dated 27 March 2026 be verified. 3- That it be determined which institutions complied and which did not comply with: A- Appointment of representatives. B- Formation of the Interinstitutional Commission. C- Preparation and submission of the Reinforcement Plan. F- Submission of reports ordered by this Chamber. G- If1 failures to comply or omissions are established, that the corresponding legal measures be adopted to ensure full compliance with the constitutional ruling. H- That this filing be added to the case file for consideration when ruling on compliance with what was ordered.”\n\n8.- By ruling issued at 10:59 a.m. on 6 July 2026, the mayor of San José, the executive president of the National Institute of Housing and Urbanism, and the executive president of the Costa Rican Institute of Aqueducts and Sewers, or whoever holds those positions, were directed to inform this Chamber who is on the interinstitutional commission tasked with addressing the problems affecting the Finca San Juan settlement concerning the collection and treatment of wastewater and sewage. They were also directed to submit a copy of the plan established by that interinstitutional commission to address the problem in question, in order to comply with what the Chamber ordered in judgment no. 2026010905, issued at 9:20 a.m. on 27 March 2026.\n\n9.- Diego Miranda Méndez submits a report in his capacity as mayor of San José. He states: “(…) as shown in the record, a report and evidence for purposes of further adjudication are submitted by Official Letter GGMDU-0524-2026. It identifies the members of the interinstitutional commission tasked with addressing the problems affecting the Finca San Juan settlement concerning the collection and treatment of wastewater and sewage, and the plan established by that interinstitutional commission to address the problem in question, pursuant to the ruling issued at 10:59 a.m. on 6 July 2026, as follows: In light of the aforementioned report and the statements made, it is established that the Municipality has at all times sought to address the motions filed in connection with what the amparo applicant requested. It should be noted, according to the report submitted, that the Municipality has at no time evaded the process or acted by omission with respect to the interested party’s requests.”\n\n10.- Johnny Leiva Badilla submits a report in his capacity as executive president of the National Institute of Housing and Urbanism. He states: “In that ruling, this esteemed Chamber requested, as evidence for purposes of further adjudication, a report from the mayor of San José, the Executive Presidency of the National Institute of Housing and Urbanism, and the executive president of the Costa Rican Institute of Aqueducts and Sewers, identifying the members of the interinstitutional commission tasked with addressing the problems affecting the Finca San Juan settlement concerning the collection and treatment of wastewater and sewage. It also requested a copy of the plan established by that interinstitutional commission to address the problem in question, in order to comply with what was ordered in judgment No. 2026010905, issued at 9:20 a.m. on 27 March 2026. Accordingly, the National Institute of Housing and Urbanism, in compliance with what was ordered in judgment Res. Nº 2026010905 and pursuant to letter DPH-UPH-119-2026, dated 9 July 2026, from the Department of Housing Programs, submits this report on the actions taken by this institution and the progress of the interinstitutional work carried out to date to resolve the problem of wastewater collection and treatment in the Finca San Juan settlement (Phases I, II, and III): 1. Formation and Update of the Interinstitutional Commission • Timely designation: In compliance with the first part of the operative section, INVU formally designated its technical representatives on 9 April 2026, by letter PE-150-2026. • Technical continuity: Following the retirement of Engineer Robert Garita Hernández, INVU ensured continuity in the process by immediately appointing Engineer Alexander Alpízar Segura as his substitute, so that he currently serves on the commission together with Architect Jessica Peralta Quesada. 2. Coordinated Work and Interinstitutional Management INVU has actively participated in technical working groups with the Costa Rican Institute of Aqueducts and Sewers (AyA), the Ministry of Housing and Human Settlements (MIVAH), and the Municipality of San José. • Assessment of Alternative D: The commission validated the pumping and conveyance system to the Los Tajos treatment plant as the most suitable option. This will not only resolve the situation at Finca San Juan but also benefit nearby communities, producing a positive environmental impact for the populations. • Financial feasibility analysis: After determining that the technical cost of Alternative D exceeds ₡2,425,480,941.04, INVU has participated in virtual sessions, such as the one held on 8 July 2026, where it proposed other alternative scenarios (Alternatives 2, 3, and 4) to ensure the project does not stall due to budget limitations. 3. INVU’s Exclusive Work and Field Follow-Up Within the scope of its direct responsibilities, this institution has made significant efforts on site: Geographic and cadastral data: INVU has made a surveyor available so that, together with AyA, the connection point or area needed for a right of way can be identified on site. This is connected to the work required with families informally occupying INVU land, which must be carried out together with MIVAH. Conducting the socioeconomic census: INVU scheduled and is actively carrying out a population census on the informally occupied reserve land. This work began in June 2026. To that end, it requested MIVAH’s assistance by letter PE-255-2026. The census is scheduled to be conducted three times a week, which is essential to developing strategies to assist and potentially relocate the families. Field inspections: On 1 July 2026, INVU technical staff took part in joint field visits with AyA at Finca San Juan to verify site conditions. In addition, on 7 July 2026, INVU participated in the session convened by the Municipality of San José. 4. Action Plan and Next Steps In summary, a formal Action Plan has been prepared, setting out the following steps in an orderly manner: 1. Technically assess the problem. 2. Conduct a social census of the informal settlement located in the southern sector of the Finca San Juan urban development, covering all three phases. (activity in progress) 3. Identify and analyze potential technical approaches to address the problem. (activity in progress) 4. Assess the costs of the technical alternatives. 5. Analyze budget availability and assess other sources of funding. 6. Select the chosen alternative (scheduled for October 2026). 7. Acquire land (expropriations), establish rights of way, and develop a land clearance strategy. 8. Incorporate additional resources. 9. Allocate resources. 10. Obtain institutional agreements from the heads of the institutions. 11. Design procurement processes. 12. Complete preliminary processes related to procurement: MIDEPLAN, environmental viability, institutional agreements, availability of services from public utilities and State institutions, and administrative steps related to BANHVI and MIVAH processes. 13. Carry out the various tenders needed for the different procurement processes for technical studies, design, and construction work in phases or stages. 14. Carry out tenders for technical studies, design, and construction work. The information provided, together with its attachments and supporting evidence, can be seen in greater breadth and detail in the technical report DPH-UPH-119-2026 of the Department of Housing Projects. Finally, INVU reiterates to this Chamber its firm technical and legal commitment to continue leading the assigned institutional processes, maintaining ongoing communication and submitting the relevant periodic progress reports.”\n\n11.- Lourdes María Sáurez Barboza submits a report in her capacity as executive president of the Costa Rican Institute of Aqueducts and Sewers. She states: “In a filing signed by Attorney Alejandro Morales Moya in his capacity as Special Litigation Agent and entered in this case file on 9 April 2026, it was reported that officials Alejandro González Bogantes and Carlos Andrés Esquivel were designated as institutional representatives to the interinstitutional commission tasked with addressing the problems affecting the Finca San Juan settlement concerning the collection, conveyance, and treatment of wastewater and sewage, pursuant to memorandum No. GG-2026-01164 dated 8 April 2026, signed by Mr. Nombre01 in his capacity as General Manager. It is noted that these designations remain in force as of today. Also, to comply with the request, a copy of the institutional plan prepared to address the problem is submitted. It is contained in the Technical Report issued by the UEN Programming and Control of the Submanagement of Environment, Research and Development and the Submanagement of GAM Systems Management, attached to this filing.”\n\n12.- The legal requirements have been observed in the proceedings.\n\nJustice Rueda Leal drafts the ruling; and,\n\nReasons:\n\nI.- In judgment no. 2026010905, issued at 9:20 a.m. on 27 March 2026, the following was ordered:\n\n“The amparo application is granted in part, solely with respect to the National Institute of Housing and Urbanism, the Costa Rican Institute of Aqueducts and Sewers, and the Municipality of San José, due to the delay in resolving the problems affecting the Finca San Juan settlement concerning the collection and treatment of wastewater and sewage. Yariela Quirós Álvarez, Gabriela Madrigal Garro, and Lourdes Sáurez Barboza, each in her capacity as acting mayor of the Municipality of San José, executive president of the National Institute of Housing and Urbanism, and executive president of the Costa Rican Institute of Aqueducts and Sewers, respectively, or whoever holds those positions in their stead, are ordered to coordinate as necessary, take appropriate measures, and issue the corresponding orders within the scope of their respective powers, so that: i) within FIVE DAYS, counted from service of this ruling, an interinstitutional commission is established specifically to address the problems affecting the Finca San Juan settlement concerning the collection and treatment of wastewater and sewage; and ii) within ONE MONTH, counted from the establishment of the aforementioned interinstitutional commission, a plan is designed to address the problem at issue in this application, and that plan is brought to the attention of this Chamber. The mayor of San José shall take note of what is indicated at the end of consideration IV of this ruling. This is ordered with notice that, pursuant to Article 71 of the Constitutional Jurisdiction Act, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The National Institute of Housing and Urbanism, the Costa Rican Institute of Aqueducts and Sewers, and the Municipality of San José are ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be assessed in enforcement proceedings before the administrative-litigation jurisdiction. In all other respects, the amparo application is denied. Justice Salazar Alvarado files a separate opinion. Notify the parties.”\n\nThat judgment was served on the respondent authorities on 31 March 2026.\n\nII.- REGARDING THE MOTION ALLEGING NONCOMPLIANCE. In this case, the amparo applicant filed a post-judgment motion concerning judgment no. 2026010905, issued at 9:20 a.m. on 27 March 2026. The applicant alleges that the Municipality of San José has not established that it designated its representatives within the time granted. The applicant also states that a request was made to be included in the working groups and to participate in field visits as a community representative; however, no response was received.\n\nIn this regard, note that in judgment no. 2026010905, issued at 9:20 a.m. on 27 March 2026, this Chamber ordered that “i) within FIVE DAYS, counted from service of this ruling, an interinstitutional commission be established specifically to address the problems affecting the Finca San Juan settlement concerning the collection and treatment of wastewater and sewage; and ii) within ONE MONTH, counted from establishment of the aforementioned interinstitutional commission, a plan be designed to address the problem at issue in this application, and that plan be brought to the attention of this Chamber.”\n\nThe reports and evidence submitted show that the following representatives were appointed: For the Municipality of San José: Jessica Martínez Porras, Roy Allan Jiménez Céspedes, and Mauren Badilla Villalobos. For the Costa Rican Institute of Aqueducts and Sewers: Alejandro González Bogantes and Carlos Esquivel Vindas. For the National Institute of Housing and Urbanism: Alexander Alpízar Segura and Jessica Peralta Quesada. Copies of the technical reports containing the action plans to address the problem at issue in this application were also submitted.\n\nConsequently, on the terms in which the motion alleging disobedience was filed, no failure to comply warranting the Chamber’s intervention is apparent at this procedural stage.\n\nIII.- The amparo applicant also states: “Additionally, this party filed a formal request with the institutions involved seeking to be included in the working groups and to participate in field visits as a community representative, in order to assist in the proper implementation of what this Chamber ordered. However, to date no response has been received.”\n\nIn this regard, this Chamber observes that this matter raised by the amparo applicant is distinct from those considered in the aforementioned proceeding, since the applicant claims to have requested inclusion as a community representative and received no response from the respondent authorities.\n\nAccordingly, the filing entered in the digital case file on 5 May 2026 shall be severed so that, with respect to this issue, it may be processed as a new matter.\n\nIV.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device they submitted must be retrieved within a maximum period of 30 business days, counted from service of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files in the Judiciary” (approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary of 3 May 2012.\n\nTherefore:\n\nThe motion alleging disobedience is denied.
