  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-023339-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026032418\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre02, abogado, con cédula de identidad CED01, en su condición de apoderado especial judicial de Nombre03; contra el MINISTERIO DE AMBIENTE Y ENERGÍA Y DE VECINOS COLINDANTES.\n\nResultando:\n\n 1.- Por escrito presentado en la Secretaría de la Sala el 29 de julio de 2026, el recurrente interpone recurso de amparo. Indica que su representado es propietario registral de la Finca del Partido de Alajuela matrícula nro. PRN01, ubicada en Florencia, San Carlos, Alajuela, adquirida el 24 de enero de 2018, libre de gravámenes, según la certificación literal del Registro Nacional adjunta. Nombre03 nunca ha sido parte del proceso agrario tramitado en el expediente nro. 15-000176-0298- AG, ante el Tribunal Agrario del Segundo Circuito Judicial de San José. No fue notificado, no fue emplazado ni fue oído en ninguna etapa de ese proceso. El Voto nro. 1087-F-16, dictado el 23 de noviembre de 2016 por ese Tribunal, no individualiza en ninguno de sus extremos la Finca PRN01, ni menciona a su representado como parte, testigo o tercero con interés en el proceso. La servidumbre de paso que eventualmente reconoció o reguló ese voto es, por su naturaleza jurídica predial, una carga constituida sobre fundos determinados. No puede extenderse a inmuebles no individualizados en el proceso constitutivo. La Finca PRN01 no fue identificada como predio sirviente en ese expediente: ningún efecto del fallo puede alcanzarla. Invocando de hecho ese voto —sin que les otorgue título alguno sobre la finca del amparado— , los vecinos colindantes recurridos abrieron una trocha de lastre dentro de la finca, alterando físicamente el inmueble e impidiendo el uso exclusivo de su propietario. Durante esa intervención, talaron árboles de especies protegidas y derribaron portones y mecanismos de cierre que el propietario había instalado para impedir el acceso no autorizado. El registro fotográfico del 21 de mayo de 2026 —siete fotografías con declaración jurada de autenticidad— documenta el estado actual de la trocha, la tala de árboles, la destrucción de portones y la afectación ecológica del inmueble. Señala que, el MINAE y el SINAC, pese a tener conocimiento potencial de la tala de especies protegidas en la zona —que activa sus deberes de tutela ambiental de manera oficiosa—, no han adoptado medida alguna de inspección, custodia o restauración del área afectada. A la fecha de este recurso, el tránsito por la trocha sigue siendo regular. El daño ambiental ya producido es parcialmente irreversible. Cada día que pasa agrava la afectación al derecho de propiedad del amparado y eleva el riesgo de nuevas intervenciones y de consolidación definitiva de la vía de hecho. Estima lesionados los siguientes derechos: A. Debido Proceso y Derecho de Defensa (artículo 39 de la Constitución Política). Ninguna carga real puede gravar una propiedad privada sin que su titular haya sido oído. El amparado nunca fue parte del expediente agrario que los vecinos invocan, y la finca que hoy soporta el paso físico nunca fue identificada como predio sirviente en ese proceso. Permitir que ese fallo opere de hecho sobre un tercero ausente niega de raíz la garantía de audiencia previa que el artículo 39 constitucional exige como presupuesto de validez de toda afectación a la esfera jurídica de una persona. B. Derecho de Propiedad (artículo 45 de la Constitución Política). La tutela del dominio no se limita a las privaciones formales: alcanza las actuaciones de hecho que vacían o menoscaban gravemente el contenido útil del derecho. Abrir una trocha, talar árboles y derribar portones dentro de una finca privada ajena, sin consentimiento del dueño y sin título que lo respalde, lesiona el núcleo esencial del artículo 45 constitucional y el artículo 21 de la Convención Americana sobre Derechos Humanos. La lesión se agrava a la luz de la naturaleza predial de la servidumbre de paso. La jurisprudencia uniforme de la Sala Primera, la Procuraduría General de la República y los tribunales agrarios es categórica: las servidumbres gravan fundos determinados, no personas; el fallo que reconoce una servidumbre solo puede desplegar efectos sobre los inmuebles que individualizó como predio dominante y predio sirviente. Extender esos efectos a la Finca PRN01 —que nunca apareció en el expediente— convierte una carga predial entre fundos determinados en una servidumbre personal generalizada a favor de vecinos, figura que el derecho costarricense no reconoce. C. Tutela Judicial Efectiva (artículo 41 de la Constitución Política). El acceso a la justicia exige vías capaces de prevenir y reparar el daño a tiempo. Ningún proceso ordinario puede devolver a Nombre03 la audiencia que no tuvo antes de la intervención, ni revertir la tala ya consumada. La tutela plena requiere una sentencia de esta Sala con órdenes de cesación, no repetición y restauración. Remitir al proceso ordinario vaciaría de contenido la garantía del artículo 41. D. Derecho a un Ambiente Sano y Ecológicamente Equilibrado (artículo 50 de la Constitución Política). La tala de especies protegidas dentro de la finca y el uso de la trocha comprometen el artículo 50 constitucional. Esta Sala ha reconocido la dimensión preventiva y precautoria del amparo ambiental, y ha admitido el recurso cuando existe riesgo de continuidad o agravamiento del daño ecológico, incluso antes de que el perjuicio alcance un grado irreparable. El tránsito continuado incrementa el riesgo de compactación del suelo, ampliación del área intervenida y nuevas talas. La omisión del MINAE/SINAC ante ese escenario convierte su pasividad en un incumplimiento constitucional autónomo frente a un bien jurídico de rango superior. Solicita declarar con lugar el recurso con medidas cautelares.\n\n2.- Por resolución de las 12:50 horas del 7 de julio de 2026, la Presidencia previno al recurrente indicar lo siguiente: “Si ha denunciado ante el Sistema Nacional de Áreas de Conservación (SINAC) el problema de tala de árboles que refiere en el escrito de interposición. De ser afirmativa la respuesta, aporte copia completa, legible y con el respectivo sello o comprobante de recibido, o bien, comprobante de remisión y recepción de correo electrónico de esa denuncia”.\n\n3.- Por escrito remitido el 9 de julio de 2026 a este expediente, el recurrente manifiesta que no se presentó denuncia previa ante SINAC ni ante ninguna otra autoridad ambiental antes de interponer este recurso. La razón no fue indiferencia ni negligencia. La señora Nombre04 — vecina del sector, quien tomó las fotografías del 21 de mayo de 2026 aportadas como prueba y quien presenció directamente la tala de árboles dentro de la finca — intentó alertar al señor Nombre03 cuando observó lo que estaba ocurriendo. No pudo hacerlo: el propietario reside en Canadá y ella no disponía de un medio de contacto directo con él. En cuanto a la denuncia ante SINAC, no la presentó porque desconocía el procedimiento, los documentos requeridos y la oficina competente. Así lo declara bajo juramento en la declaración notarial que se adjunta como prueba a este escrito. El amparo ambiental no exige agotamiento de la vía administrativa como presupuesto de admisibilidad. La Sala ha sido constante en este punto: cuando la lesión al artículo 50 constitucional es actual, directa y con riesgo de continuidad o agravamiento, el recurso de amparo procede sin necesidad de agotar previamente los mecanismos administrativos disponibles. Lo contrario vaciaría de contenido la función preventiva y precautoria que la propia Sala ha reconocido al amparo ambiental. En este caso, la tala de especies protegidas ya fue consumada parcialmente. El tránsito diario por la trocha de lastre abierta dentro de la finca continúa agravando el daño ecológico. Exigir que el recurrente — un propietario extranjero residente en Canadá, ajeno al proceso agrario que los vecinos invocan como cobertura — agotara primero la vía administrativa ante SINAC significaría dejar sin tutela real una situación que se deteriora con cada día que pasa. Ese no es el sentido del artículo 48 constitucional ni de la LJC. Adicionalmente, la persona que presenció los hechos y que habría estado en condiciones de hacer la denuncia — la señora Nombre04 — no tenía forma de contactar al propietario para obtener su autorización ni conocía el procedimiento administrativo aplicable. Ese contexto fáctico no equivale a renuncia ni a tolerancia de la lesión.\n\n4.- Por escrito remitido el 9 de julio de 2026 a este expediente, el recurrente solicita dejar sin efecto el escrito presentado anteriormente, 09/07/2026 12:05:44, toda vez que adolece de un error material, y se sirva admitir el presente documento en su reemplazo para los efectos legales correspondientes. Manifiesta que no se presentó denuncia previa ante SINAC ni ante ninguna otra autoridad ambiental antes de interponer este recurso. La razón no fue indiferencia ni negligencia. El señor Nombre01, vecina del sector, quien tomó las fotografías del 21 de mayo de 2026 aportadas como prueba y quien presenció directamente la tala de árboles dentro de la finca — intentó alertar al señor Nombre03 cuando observó lo que estaba ocurriendo. No pudo hacerlo: el propietario reside en Canadá y ella no disponía de un medio de contacto directo con él. Adicionalmente, la persona que presenció los hechos y que habría estado en condiciones de hacer la denuncia el señor Nombre01 no tenía forma de contactar al propietario para obtener su autorización ni conocía el procedimiento administrativo aplicable. Ese contexto fáctico no equivale a renuncia ni a tolerancia de la lesión.\n\n5.- Mediante escrito remitido el 31 de julio de 2026, el recurrente manifiesta que este recurso no gira únicamente en torno al dominio registral de una finca. Hay un elemento que lo distingue de un conflicto posesorio ordinario y que obliga a tratarlo con la urgencia que el artículo 50 constitucional exige: dentro de la Finca del Partido de Alajuela matrícula nro. PRN01 se talaron árboles de especies protegidas. Esa tala no es un daño patrimonial más. Es la destrucción de componentes del ecosistema que el Estado costarricense tiene el deber constitucional de garantizar, defender y preservar. La zona de Florencia, San Carlos, Alajuela, forma parte del corredor biológico que sustenta, entre otras especies, a la lapa verde (Ara ambigua) y al almendro amarillo (Dipteryx panamensis), dos de las especies en mayor riesgo de extinción en el país. La relación entre ambas no es anecdótica: es estructural. Sin almendros, las lapas no tienen hábitat viable. Y lo que se taló dentro de la finca del señor Nombre03 puede ser exactamente ese tipo de árbol. Esta Sala ya se pronunció sobre este vínculo ecológico en dos ocasiones que resultan directamente aplicables al caso. El voto nro. 2002-2486 del 8 de marzo de 2002 anuló un decreto ejecutivo que permitía la explotación del almendro amarillo. El fundamento no fue técnico ni secundario: la Sala reconoció expresamente que la sobrevivencia de la lapa verde depende de manera directa de esa especie arbórea, y que el Estado tiene la obligación de implementar todas las medidas necesarias para proteger a la lapa, lo que conlleva impedir su comercio y, por su relación con el almendro, impedir también la tala de esta especie en todo el territorio nacional, con énfasis particular en las zonas donde se concentra el hábitat óptimo para la sobrevivencia del ave. El Voto nro. 2008-13426 del 2 de setiembre de 2008 fue más lejos. Al anular una resolución administrativa que autorizaba el aprovechamiento del almendro, la Sala afirmó que la protección de especies en peligro de extinción tiene valor intrínseco: no depende de su utilidad para el ser humano. Una especie se protege porque existe y porque su extinción es irreversible. El tribunal declaró que la resolución impugnada careció de sustento fáctico y jurídico, y que contravenía simultáneamente la Constitución Política, resoluciones previas de la propia Sala, instrumentos de derecho internacional adoptados por Costa Rica y la legislación ambiental interna. Esos dos votos construyen un estándar claro: cuando existe riesgo de daño a especies en peligro de extinción o a los ecosistemas que las sostienen, la tutela constitucional es inmediata, preventiva y no está condicionada al agotamiento de la vía administrativa. La tala ocurrida dentro de la finca del amparado activa ese estándar. El núcleo de la violación constitucional en este expediente tiene tres capas que se superponen. La primera es de propiedad y debido proceso. Terceros intervinieron físicamente una finca ajena sin título legítimo, sin autorización del propietario y sin que este hubiera sido notificado, oído ni citado en procedimiento alguno. La intervención se ejecutó de hecho, sobre un inmueble que no les pertenece y respecto del cual carecen de derecho real que los habilite. El señor Nombre03 no consintió. Ningún proceso ordinario puede restituir esa audiencia que jamás se le concedió. La segunda es de tutela judicial efectiva. Un propietario extranjero residente en Canadá, enfrentado a vecinos que ejercen un control material y continuado sobre su finca, no tiene remedio ordinario que funcione a tiempo. El tránsito por la trocha continúa. Los portones siguen siendo derribados. Cada día que pasa sin intervención de esta Sala consolida una vía de hecho que el proceso ordinario, con años de duración, no puede detener. La tercera —y la que convierte este amparo en algo más que un conflicto interprivado— es ambiental. La tala de árboles de especies protegidas dentro del inmueble, en una zona geográficamente relevante para la biodiversidad de San Carlos, genera una afectación al artículo 50 constitucional que esta Sala ha tutelado repetidamente de manera directa, sin esperar pronunciamiento previo de las autoridades administrativas. Los Votos 2002-2486 y 2008-13426 son la prueba más reciente y específica de esa disposición. Las tres capas coinciden en el mismo punto: la vía ordinaria no es idónea, el daño es actual y parcialmente irreversible, y la omisión de las autoridades —incluyendo MINAE/SINAC— frente a la tala de especies protegidas convierte el silencio estatal en incumplimiento constitucional autónomo. Con fundamento en lo expuesto, en la jurisprudencia de los Votos 2002-2486 y 2008- 13426, en el artículo 50 de la Constitución Política y en la línea de tutela ambiental preventiva y restauradora que esta Sala ha desarrollado, se solicita: 1. Dar trámite al recurso de amparo en todos sus extremos, teniendo por cumplida la prevención dictada a las 12:50 horas del 7 de julio de 2026 mediante el escrito y la declaración jurada ya presentados. 2. Declarar con lugar el recurso de amparo y reconocer que los actos materiales denunciados — tala de árboles de especies protegidas, apertura de trocha de lastre y derribo de portones dentro de la Finca PRN01, ejecutados por particulares sin autorización del propietario, sin título real que los habilite y sin que el señor Nombre03 hubiera sido oído en procedimiento alguno — violan los artículos 39, 41, 45 y 50 de la Constitución Política y los artículos 8, 21 y 25 de la Convención Americana sobre Derechos Humanos. 3. Ordenar a las autoridades administrativas competentes —MINAE, SINAC y la Municipalidad de San Carlos— que procedan de inmediato a: (a) inspeccionar el área afectada dentro de la finca del amparado y determinar si los árboles talados corresponden a especies protegidas, incluyendo el almendro amarillo (Dipteryx panamensis); (b) levantar un acta técnica del daño ambiental constatado; (c) adoptar las medidas de custodia, señalización y protección del área necesarias para impedir nuevas talas o intervenciones; y (d) elaborar y ejecutar un plan de restauración ecológica con reforestación de especies nativas equivalentes, bajo los estándares que la legislación ambiental y la jurisprudencia constitucional exigen. 4. Ordenar la cesación definitiva de cualquier tránsito, uso o paso por la finca del amparado, y la restitución del inmueble a su estado anterior en todo lo materialmente posible, incluyendo la clausura de la trocha y la reinstalación de los cierres destruidos. 5. Condenar a los recurridos al pago de los daños y perjuicios causados, incluyendo el valor de restauración ecológica del área afectada, con liquidación reservada a la fase de ejecución de sentencia. 6. Disponer que MINAE/SINAC reporten a esta Sala, en el plazo que se les fije, sobre el resultado de la inspección y el plan de restauración adoptado, bajo apercibimiento de desobediencia conforme al artículo 71 de la Ley de la Jurisdicción Constitucional.\n\n 6.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\nI.- OBJETO DEL RECURSO. El recurrente reclama que los derechos de su representado han sido vulnerados, pues otras personas -vecinos colindantes- amparados en una sentencia emitida por el Tribunal Agrario del Segundo Circuito Judicial de San José, en la cual el tutelado no fue parte, ingresaron a la finca nro. PRN01 de su representado, que no se menciona en esa sentencia, y abrieron una trocha de lastre dentro de la finca, talaron árboles de especies protegidas, derribaron portones y mecanismos de cierre que el propietario había instalado para impedir el acceso no autorizado, alterando físicamente el inmueble e impidiendo el uso exclusivo de su propietario. Reclama que, pese a ello el MINAE y el SINAC no se han apersonado a detener el daño ambiental.\n\nII.- INADMISIBILIDAD DEL AMPARO. En primer término, el recurrente acude en amparo contra sujetos de derecho privado que no llega a individualizar, solo menciona que son vecinos colindantes de la finca nro. PRN01 de su representado, sin que corresponda a este Tribunal su identificación. En todo caso, se trata de sujetos de derecho privado que no se encuentran en los supuestos establecidos en el artículo 57 de la Jurisdicción Constitucional, por lo que el amparo resulta inadmisible en cuanto a estos. En segundo lugar, si la actuación de estos deviene de lo resuelto o ejecutado por un Tribunal Agrario en la sentencia que menciona el recurrente y se trata de un error como este manifiesta, lo procedente es que el amparado acuda ante esa misma autoridad a manifestar lo que estime pertinente, a fin de que sea esa misma autoridad la que se pronuncie al respecto y rectifique eventualmente lo que ahí corresponda. Advierta el recurrente que, en realidad se trata de un conflicto entre sujetos de derecho privado que procede ser resuelto en la vía de legalidad, por las vías legales civiles y/o agrarias que ya existen para amparar la posesión y los derechos de propiedad, como los interdictos, y no a través de la vía de amparo invocando presuntos daños ambientales como se pretende hacer ver. Finalmente, tal como reconoce el recurrente, nadie, ni siquiera él como su apoderado legal, ha interpuesto denuncia alguna a favor del amparado ante el MINAE o el SINAC, para que se valore si con la ejecución de esa sentencia se ha lesionado alguna especie que deba ser protegida. En virtud de lo anterior, no puede pretenderse que, por la vía del amparo, la Sala Constitucional haga las veces de una mera instancia tramitadora de denuncias contra la administración, puesto que ello no solamente haría necesario efectuar probanzas complicadas, incompatibles con la naturaleza sumaria de esta sede, sino también sustituir directamente la voluntad administrativa y suplantar a los despachos públicos en la gestión de los asuntos de su competencia. En este sentido, debe mencionarse que las correspondientes denuncias deben ser presentadas por escrito, puesto que el derecho de petición, establecido en el artículo 27 de la Constitución Política, cuando es entendido en sentido amplio, hace referencia a la facultad que posee todo ciudadano para dirigirse por escrito a cualquier funcionario público o entidad oficial con el fin de exponer un asunto de su interés. Tómese en cuenta que esto último no significa que la Sala exija agotar la vía administrativa, como aduce el recurrente, sino la simple aceptación de que, como se dijo anteriormente, esta jurisdicción no puede sustituir directamente a la Administración activa. En el presente caso, la parte recurrente acepta que no ha realizado denuncia alguna ante las autoridades públicas cuya omisión reclama y tampoco se trata de un hecho público y notorio, sino dentro de una propiedad privada y por actuaciones de sujetos de derecho privado. Por lo tanto, lo procedente es indicar al recurrente que, si a bien lo tiene, deberá presentar sus denuncias, por escrito, directamente ante las instancias administrativas competentes, toda vez que este Tribunal no puede sustituirle en la gestión de sus propios intereses, sin perjuicio que, si las autoridades que reciban dichas denuncias, no se muestran efectivas en darle solución oportuna al problema —permitiendo así que la situación descrita se mantenga en el tiempo—, nada obsta para que la parte recurrente se apersone nuevamente ante esta sede para reclamar lo que estime pertinente en cuanto a las autoridades públicas recurridas se refiere. \n\nPor consiguiente, procede rechazar de plano el recurso. \n\n III.- VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL con redacción del segundo. La parte recurrente reclama que varias personas ingresaron en la finca del tutelado, abrieron una trocha y talaron árboles presuntamente pertenecientes a especies protegidas, sin que las autoridades ambientales hayan inspeccionado el lugar ni adoptado medidas dirigidas a evitar la continuación o el agravamiento del daño.\n\nEn el sub lite, de ser ciertos los hechos expuestos, no resulta evidente que la autoridad jurisdiccional que conoció del proceso agrario pueda brindar una tutela efectiva frente a la posible afectación ambiental, máxime cuando el amparado no formó parte de ese proceso. Además, la eventual existencia de vías ordinarias para discutir el derecho de propiedad o la servidumbre invocada no excluye el deber de examinar, en esta sede, si se lesionó el derecho a un ambiente sano y ecológicamente equilibrado, consagrado en el artículo 50 de la Constitución Política. En virtud de la naturaleza de los hechos expuestos y de los principios preventivo y precautorio que informan la tutela constitucional del ambiente, estimo necesario requerir los informes de las autoridades recurridas antes de rechazar de plano el recurso.\n\nPor ello, salvamos el voto y disponemos que se curse el amparo a fin de contar con más elementos de convicción que permitan corroborar o descartar la lesión reclamada.\n\n IV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "Document Review\n\n\n\nCASE FILE No. 26-023339-0007-CO\n\nPROCEEDING: AMPARO APPLICATION\n\nRULING No. 2026032418\n\nCONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 25 August 2026.\n\nAmparo application filed by Nombre02, attorney, holder of identity card CED01, in his capacity as special judicial attorney-in-fact for Nombre03, against the MINISTRY OF ENVIRONMENT AND ENERGY AND NEIGHBORING PROPERTY OWNERS.\n\nBackground:\n\n1.— By submission filed with the Chamber Secretariat on 29 July 2026, the applicant files an amparo application. He states that his client is the registered owner of the property in the Alajuela Province Land Registry, registration No. PRN01, located in Florencia, San Carlos, Alajuela, acquired on 24 January 2018, free of encumbrances, according to the attached certified literal extract from the National Registry. Nombre03 has never been a party to the agrarian proceeding conducted in case file No. 15-000176-0298-AG before the Agrarian Court of the Second Judicial Circuit of San José. He was not notified, summoned, or heard at any stage of that proceeding. Ruling No. 1087-F-16, issued on 23 November 2016 by that Court, does not identify the property PRN01 anywhere in its terms, nor does it mention his client as a party, witness, or interested third party in the proceeding. The right-of-way easement that ruling may have recognized or regulated is, by its legal nature as a property right, a burden imposed on specified parcels. It cannot be extended to properties that were not identified in the proceeding that created it. Property PRN01 was not identified as the servient property in that case file: the judgment cannot affect it in any way. In factually invoking that ruling—although it grants them no title to the amparo applicant’s property—the respondent neighboring property owners opened an unpaved road within the property, physically altering it and preventing its owner from using it exclusively. During that intervention, they cut down trees of protected species and brought down gates and closure mechanisms that the owner had installed to prevent unauthorized access. The photographic record dated 21 May 2026—seven photographs accompanied by a sworn declaration of authenticity—documents the current condition of the road, the tree felling, the destruction of gates, and the ecological impact on the property. He states that MINAE and SINAC, despite potentially knowing of the felling of protected species in the area—which activates their environmental protection duties on their own initiative—have taken no measure to inspect, secure, or restore the affected area. As of the date of this application, traffic along the road remains regular. The environmental damage already caused is partially irreversible. Each passing day worsens the impact on the amparo applicant’s property right and increases the risk of further interventions and the definitive entrenchment of this unlawful course of action. He considers the following rights to have been violated: A. Due Process and Right of Defense (Article 39 of the Political Constitution). No real burden may encumber private property without its owner having been heard. The amparo applicant was never a party to the agrarian case invoked by the neighbors, and the property now physically burdened by the passage was never identified as the servient property in that proceeding. Allowing that judgment to operate in fact against an absent third party wholly denies the prior-hearing guarantee that Article 39 of the Constitution requires as a condition for the validity of any interference with a person’s legal sphere. B. Right to Property (Article 45 of the Political Constitution). Protection of ownership is not limited to formal deprivations; it extends to acts in fact that empty the right of its useful content or seriously diminish it. Opening a road, cutting down trees, and bringing down gates on someone else’s private property, without the owner’s consent and without any supporting title, violates the essential core of Article 45 of the Constitution and Article 21 of the American Convention on Human Rights. The violation is aggravated in light of the property-based nature of a right-of-way easement. The consistent case law of the First Chamber, the Procuraduría General de la República, and the agrarian courts is categorical: easements burden specified parcels, not persons; a judgment recognizing an easement can have effect only on the properties it identified as the dominant property and the servient property. Extending those effects to property PRN01—which never appeared in the case file—turns a property burden between specified parcels into a general personal easement in favor of neighbors, a legal construct not recognized by Costa Rican law. C. Effective Judicial Protection (Article 41 of the Political Constitution). Access to justice requires procedures capable of preventing and repairing harm in time. No ordinary proceeding can give Nombre03 the hearing he was denied before the intervention, or undo the tree felling that has already taken place. Full protection requires a judgment from this Chamber ordering cessation, non-repetition, and restoration. Referring the matter to ordinary proceedings would empty the guarantee in Article 41 of its content. D. Right to a Healthy and Ecologically Balanced Environment (Article 50 of the Political Constitution). Felling protected species within the property and using the road implicate Article 50 of the Constitution. This Chamber has recognized the preventive and precautionary dimension of environmental amparo and has admitted applications where there is a risk that ecological harm will continue or worsen, even before the harm reaches an irreparable degree. Continued traffic increases the risk of soil compaction, expansion of the disturbed area, and further tree felling. MINAE/SINAC’s failure to act in that situation makes its passivity an independent constitutional breach affecting a legal interest of superior rank. He requests that the application be granted and that interim measures be ordered.\n\n2.— By ruling issued at 12:50 p.m. on 7 July 2026, the Presidency directed the applicant to state the following: “Whether he has reported the tree-felling problem described in the application to the National System of Conservation Areas (SINAC). If so, provide a complete, legible copy bearing the corresponding receipt stamp or acknowledgment, or proof of the email complaint’s transmission and receipt.”\n\n3.— In a submission sent to this case file on 9 July 2026, the applicant states that no prior complaint was filed with SINAC or any other environmental authority before this application was filed. The reason was neither indifference nor negligence. Mrs. Nombre04—a neighbor in the area, who took the photographs dated 21 May 2026 submitted as evidence and directly witnessed the felling of trees within the property—tried to alert Mr. Nombre03 when she saw what was happening. She could not do so: the owner resides in Canada, and she had no direct means of contacting him. As for filing a complaint with SINAC, she did not do so because she was unaware of the procedure, the required documents, and the competent office. She so declares under oath in the notarized declaration attached as evidence to this submission. Environmental amparo does not require exhaustion of the administrative remedies as a condition of admissibility. The Chamber has consistently held this point: when the violation of Article 50 of the Constitution is current and direct, with a risk of continuation or worsening, an amparo application may proceed without first exhausting the available administrative mechanisms. The contrary would empty of content the preventive and precautionary function that the Chamber itself has recognized for environmental amparo. In this case, the felling of protected species has already partially occurred. Daily traffic along the unpaved road opened within the property continues to worsen the ecological harm. That factual context does not amount to waiver or tolerance of the violation.\n\n4.— In a submission sent to this case file on 9 July 2026, the applicant requests that the prior submission, dated 09/07/2026 12:05:44, be set aside because it contains a clerical error, and that this document be admitted in its place for the corresponding legal purposes. He states that no prior complaint was filed with SINAC or any other environmental authority before this application was filed. The reason was neither indifference nor negligence. Mr. Nombre01, a neighbor in the area, who took the photographs dated 21 May 2026 submitted as evidence and directly witnessed the felling of trees within the property—tried to alert Mr. Nombre03 when he saw what was happening. He could not do so: the owner resides in Canada, and he had no direct means of contacting him. That factual context does not amount to waiver or tolerance of the violation.\n\n5.— By submission sent on 31 July 2026, the applicant states that this application does not concern only registered ownership of a property. There is an element that distinguishes it from an ordinary possessory dispute and requires it to be addressed with the urgency demanded by Article 50 of the Constitution: trees of protected species were felled within the property in the Alajuela Province Land Registry, registration No. PRN01. That felling is not merely another economic loss. It is the destruction of components of the ecosystem that the Costa Rican State has a constitutional duty to guarantee, defend, and preserve. The area of Florencia, San Carlos, Alajuela, forms part of the biological corridor that supports, among other species, the great green macaw (Ara ambigua) and the yellow almond tree (Dipteryx panamensis), two of the species at greatest risk of extinction in the country. Their relationship is not incidental; it is structural. Without almond trees, the macaws have no viable habitat. And what was felled within Mr. Nombre03’s property may be exactly that kind of tree. This Chamber has ruled on this ecological link on two occasions that apply directly to this case. Ruling No. 2002-2486 of 8 March 2002 annulled an executive decree that permitted the exploitation of the yellow almond tree. The basis was neither technical nor secondary: the Chamber expressly recognized that the survival of the great green macaw directly depends on that tree species, and that the State is obliged to implement all necessary measures to protect the macaw, which entails preventing its trade and, given its relationship with the almond tree, also preventing the felling of that species throughout the national territory, with particular emphasis on areas where the bird’s optimal survival habitat is concentrated. Ruling No. 2008-13426 of 2 September 2008 went further. In annulling an administrative resolution authorizing the harvesting of almond trees, the Chamber stated that protecting endangered species has intrinsic value: it does not depend on their usefulness to humans. A species is protected because it exists and because its extinction is irreversible. The Court declared that the challenged resolution lacked factual and legal support and contravened, at the same time, the Political Constitution, prior rulings of the Chamber itself, instruments of international law adopted by Costa Rica, and domestic environmental legislation. Those two rulings establish a clear standard: when there is a risk of harm to endangered species or the ecosystems that sustain them, constitutional protection is immediate and preventive and is not conditional on exhaustion of the administrative remedies. The felling that occurred within the amparo applicant’s property triggers that standard. The core of the constitutional violation in this case has three overlapping layers. The first concerns property and due process. Third parties physically intervened in someone else’s property without legitimate title, without the owner’s authorization, and without his having been notified, heard, or summoned in any proceeding. The intervention was carried out in fact on property that does not belong to them and over which they have no real right authorizing them to act. Mr. Nombre03 did not consent. No ordinary proceeding can restore the hearing that was never granted to him. The second concerns effective judicial protection. A foreign property owner residing in Canada, facing neighbors who exercise continued physical control over his property, has no ordinary remedy that will work in time. Traffic along the road continues. The gates continue to be brought down. Each day that passes without intervention by this Chamber entrenches an unlawful course of action that ordinary proceedings, which take years, cannot stop. The third—and the layer that makes this amparo more than a dispute between private parties—is environmental. The felling of trees of protected species within the property, in a geographically significant area for San Carlos biodiversity, creates an impact on Article 50 of the Constitution that this Chamber has repeatedly addressed directly, without waiting for a prior ruling by the administrative authorities. Rulings 2002-2486 and 2008-13426 are the most recent and specific evidence of that approach. All three layers converge on the same point: ordinary proceedings are inadequate, the harm is current and partially irreversible, and the authorities’ failure to act—including MINAE/SINAC’s failure to act regarding the felling of protected species—makes the State’s silence an independent constitutional breach. Based on the foregoing, the case law in Rulings 2002-2486 and 2008-13426, Article 50 of the Political Constitution, and the line of preventive and restorative environmental protection developed by this Chamber, the applicant requests: 1. That the amparo application be processed in all respects and that the direction issued at 12:50 p.m. on 7 July 2026 be deemed satisfied by the submission and sworn declaration already filed. 2. That the amparo application be granted and it be recognized that the material acts complained of—felling trees of protected species, opening an unpaved road, and bringing down gates within property PRN01, carried out by private parties without the owner’s authorization, without a real right entitling them to do so, and without Mr. Nombre03 having been heard in any proceeding—violate Articles 39, 41, 45, and 50 of the Political Constitution and Articles 8, 21, and 25 of the American Convention on Human Rights. 3. That the competent administrative authorities—MINAE, SINAC, and the Municipality of San Carlos—be ordered immediately to: (a) inspect the affected area within the amparo applicant’s property and determine whether the felled trees belong to protected species, including the yellow almond tree (Dipteryx panamensis); (b) prepare a technical report of the established environmental damage; (c) adopt the measures needed to secure, mark, and protect the area to prevent further felling or interventions; and (d) prepare and implement an ecological restoration plan that includes reforestation with equivalent native species, in accordance with the standards required by environmental legislation and constitutional case law. 4. That all traffic, use, or passage through the amparo applicant’s property definitively cease, and that the property be restored to its prior condition insofar as materially possible, including closure of the road and reinstallation of the destroyed barriers. 5. That the respondents be ordered to pay for the damages caused, including the cost of ecological restoration of the affected area, with the amount to be determined in the judgment-enforcement phase. 6. That MINAE/SINAC be directed to report to this Chamber, within the period set for them, on the inspection results and the restoration plan adopted, under warning of disobedience pursuant to Article 71 of the Law on Constitutional Jurisdiction.\n\n6.— Article 9 of the Law on Constitutional Jurisdiction authorizes the Chamber to dismiss summarily or on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is merely a reiteration or reproduction of an earlier identical or similar application that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.— SUBJECT OF THE APPLICATION. The applicant claims that his client’s rights have been violated because other people—neighboring property owners—relying on a judgment issued by the Agrarian Court of the Second Judicial Circuit of San José, in which the person under protection was not a party, entered his client’s property No. PRN01, which is not mentioned in that judgment, and opened an unpaved road within it, felled trees of protected species, and brought down gates and closure mechanisms installed by the owner to prevent unauthorized access, physically altering the property and preventing its owner from using it exclusively. He complains that MINAE and SINAC have not appeared to stop the environmental damage.\n\nII.— INADMISSIBILITY OF THE AMPARO. First, the applicant brings an amparo application against private-law subjects whom he does not identify individually; he only states that they are neighboring property owners of his client’s property No. PRN01, and it is not for this Court to identify them. In any event, these are private-law subjects who do not fall within the circumstances set out in Article 57 of the Law on Constitutional Jurisdiction, so the amparo is inadmissible as to them. Second, if their conduct stems from what was decided or carried out by an Agrarian Court in the judgment mentioned by the applicant, and if there was an error as he claims, the amparo applicant should bring the matter before that same authority and state what he considers appropriate so that the authority itself may rule on the matter and, where appropriate, correct what needs correcting. The applicant should note that this is in fact a dispute between private-law subjects that should be resolved through the legality jurisdiction, by the civil and/or agrarian legal procedures already available to protect possession and property rights, such as possessory interdicts, and not through amparo by invoking alleged environmental damage, as he seeks to portray it. Finally, as the applicant acknowledges, no one, not even he as his client’s legal representative, has filed any complaint on the amparo applicant’s behalf with MINAE or SINAC so that they may assess whether carrying out that judgment harmed a species that should be protected. In light of the foregoing, the Constitutional Chamber cannot be asked, through amparo, to act as a mere channel for processing complaints against the administration, because this would not only require complicated evidentiary proceedings incompatible with the summary nature of this forum, but would also directly substitute its judgment for that of the administration and supplant public offices in managing matters within their competence. In this regard, it should be mentioned that the corresponding complaints must be submitted in writing, since the right of petition, established in Article 27 of the Political Constitution, when understood broadly, refers to every citizen’s ability to address any public official or official body in writing to raise a matter of interest to them. This last point does not mean that the Chamber requires exhaustion of the administrative remedies, as the applicant argues, but simply acknowledges that, as stated above, this jurisdiction cannot directly substitute itself for the active administration. In this case, the applicant acknowledges that no complaint has been made to the public authorities whose omission is challenged, and this is not a public and notorious fact either, but rather an event within private property involving the actions of private-law subjects. Therefore, the applicant should be advised that, if he so wishes, he must submit his complaints in writing directly to the competent administrative bodies, since this Court cannot act in his place in managing his own interests, without prejudice to the applicant appearing again before this forum to complain about the respondent public authorities if the authorities receiving those complaints fail to provide an effective and timely solution to the problem, thereby allowing the described situation to continue over time.\n\nAccordingly, the application must be dismissed summarily.\n\nIII.— DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, drafted by the latter. The applicant claims that several people entered the protected party’s property, opened a road, and felled trees allegedly belonging to protected species, without the environmental authorities inspecting the site or adopting measures to prevent the harm from continuing or worsening.\n\nIn the case at hand, if the facts presented are true, it is not evident that the judicial authority that heard the agrarian proceeding can provide effective protection against the possible environmental impact, especially since the amparo applicant was not a party to that proceeding. Furthermore, the possible existence of ordinary procedures for disputing the property right or the easement invoked does not exclude the duty to examine in this forum whether the right to a healthy and ecologically balanced environment, enshrined in Article 50 of the Political Constitution, was violated. In view of the nature of the facts presented and the preventive and precautionary principles that inform constitutional protection of the environment, I consider it necessary to require reports from the respondent authorities before summarily dismissing the application.\n\nFor these reasons, we dissent and direct that the amparo proceed so that further evidence may be obtained to confirm or rule out the alleged violation.\n\nIV.— DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted, must be collected from the office within a maximum period of 30 business days from notification of this judgment.
