  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-026982-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026032477\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre04, cédula de identidad CED01, Nombre02, cédula de identidad CED02, contra el MINISTERIO DE SALUD.\n\nResultando:\n\n 1.- Por escrito recibido en la Secretaría de esta Sala a las 15:37 horas del 27 de julio de 2026, la parte recurrente interpone recurso de amparo contra el Ministerio de Salud. Manifiesta lo siguiente: \n\n“(…) I. HECHOS Y ANTECEDENTES \n\n1. Recepción de Denuncia Anónima e Inspección Inicial: El Ministerio de Salud (Área Rectora del Cantón La Unión, Distrito San Rafael) recibió una denuncia anónima que indicaba la supuesta salida de aguas negras en el cordón del caño ubicado en el límite entre dos propiedades. En respuesta, el funcionario técnico de la institución se apersonó a la vivienda e inició el protocolo correspondiente, procediendo a aplicar colorante fluoresceína en los inodoros con el objetivo de verificar el recorrido del agua hacia el tanque y el drenaje posterior. \n\n2. Indicaciones del Técnico y Notificación: Durante la visita inicial, el técnico indicó preliminarmente que el colorante aplicado podía tardar desde unos pocos días hasta un par de meses en manifestarse como un color verde neón altamente visible en el cordón del caño. Posteriormente, un mes después de realizada la prueba de campo, se visitaron las oficinas del Ministerio de Salud, oportunidad en la cual el funcionario solicito que se firmara la boleta de inspección. Se aclara que Nombre01 firmó dicho documento por mera solicitud del funcionario y por desconocimiento de las implicaciones legales, dejando expresamente constancia de que no estaba de acuerdo con su contenido. \n\n3. Ausencia Total de Coloración Visible a Luz del Día: Tras la marcha del técnico, transcurrió un mes completo durante el cual en ningún momento se observó la aparición de agua con color verde fluorescente destellante que fuera perceptible al ojo humano en la vía pública. \n\n4. Declaración Explícita del Técnico y Prueba en Cuarto Oscuro: Ante la ausencia de hallazgos visibles, los administrados don Nombre04 y Nombre01 acudieron presencialmente a las oficinas del Ministerio de Salud con el unico (sic) fin de ser informados del resultado de dicha prueba, ya que solo una oportunidad se converso (sic) durante la visita en nuestra casa y hasta la fecha despues (sic)de un mes nos apersonamos al Ministerio de Salud y se le pregunta sobre la prueba realizada en nuestra casa . En dicha reunión, todo esto se conversó de manera verbal, manifestando expresamente el propio funcionario técnico que no pudo observar visiblemente el agua verde en el cordón del caño ni en la acera. Por tal motivo, el técnico decidió de manera unilateral recolectar una muestra de agua del caño en un tubo de ensayo y llevarla a un cuarto oscuro dentro de las instalaciones del Ministerio, admitiendo abiertamente que le costó mucho detectar el color verde y que era muy poco lo que pudo observar. Se hace notar que ninguna de estas manifestaciones verbales y salvedades quedó plasmada por escrito en la boleta que firmó Nombre01, quien suscribió el documento por solicitud y desconocimiento. Pero por otro lado si bien es sierto (sic) que si se escribe y quedo plasmado en el Informe Tecnico (sic) ver anexo \" Informe Tecnico (sic)\"\n\nen relacion (sic) a la Situacion (sic) encontrada. Como resultado de las pruebas efectuadas con fluoresceina (sic), hechando (sic) ese liquido en los servicios sanitarios. El resultado positivo es confuso ya que no se sabe exactamente el lugar o punto senalado (sic) en dicha prueba y con el agrabantente (sic) de que nunca se nos evidenciaron de dichas allasgos (sic) como una prueba Tecnica (sic) objetiva y trasparente. En ese momento explica el tecnico (sic) verbalmente que se recoge al final donde termina el limite (sic) de nosotros, y comiensa (sic) el del veciono (sic) donde lleva mas (sic) de 6 meses desfogando aguas negras ver anexo de fotos y/o videos, ademas (sic) antes durante casi tres anos (sic) y medio no se presenta desfogues y estaba totalmente seco la acera y cordon (sic) del cano del vecino, pero como reitero luego del febrero del 2026 hasta el dia (sic) de hoy no para de salir aguas olorosas inpregnadas (sic) de espuma con olores fetidos (sic) y liquidos (sic) negros como obs.(sic) Petroleo (sic9 liquido (sic) y/o natilla Negra, ademas liquidos Tambien (sic) con diversidad de colores parecidos al arco iris. Y vale destacar que la denuncia de esta Orden Sanitaria se hizo el 19 de Marzo del 2026 y se hace la visita el 5 de mayo del 2026 en presencia de la inundacion (sic) reiteradamente en muchas ocaciones (sic) desde que se puso el Recurso de Amparo en el ano (sic) 2021 expediente 21-015740-0007-CO, y fue Ganado por nosotros. Y hasta la fecha las respectivas autoridades ninguna de las instituciones que a pesar que an (sic)\n\nvisto de lo que esta (sic) pasando, no han hecho nada sin envargo (sic) llegaron a nuestra casa segun (sic) por una denuncia anonima (sic) el cual creemos de donde probiene (sic). Nunca hemos tenido desfogues de aguas negras a no ser cuando nos inunda nuestra propiedad como lo hace en el presente. \n\nPor otro lado el dia (sic) 8 de Julio del 2026 en horas de la manana (sic) el Gerente encargado de las aguas Negra del G.A.M. Sr. Nombre03 nos encontramos a 100 metros de mi casa, procede el senor (sic) Nombre03 a reconocer unos de los problemas que se dedico (sic) a buscar en el Residencial Estancia Antigua, fue asi (sic) que el se ve soreprendido (sic) de la gran cantidad del agua que sale en ese momento en una de las casas. exactamente el tecinco (sic) del Ministerio de Salud, dice haber recogido las muestras para llevarlas al cuarto oscuro. \n\nFUNDAMENTOS TECNICO-CIENTÍFICOS Y EXISTENCIA DE FALSO POSITIVO\n\n1. Demostración Científica de Traza Microscópica: El hecho de que el técnico tuviera que recurrir a un cuarto oscuro y que aun así haya tenido extrema dificultad para detectar algún brillo, demuestra en el ambito cientifico (sic) que no existio (sic) un flujo real ni continuo de agua teñida procedente del inodoro, sino a lo sumo una traza microscópica o imperceptible en condiciones normales.\n\n2. Criterio Experto e Interferencia de Fluorescencia Natural: Con el fin de esclarecer técnicamente el hallazgo, se buscó capacitación y asesoría especializada con un Ingeniero en Química de una Universidad del Estado, contrastando los resultados con la normativa aplicable en La Gaceta. El especialista químico explico que la presencia de un rastro minimo (sic) de luminiscencia en un cuarto oscuro bajo luz ultravioleta (UV) no prueba la presencia de fluoresceína aplicada en el inodoro, ya que la muestra puede reaccionar de forma idéntica debido a múltiples factores ambientales, generando un Falso Positivo. Entre las causas técnicas de fluorescencia natural del entorno se destacan:\n\n \n\n• Materia orgánica y vegetal: Presencia de residuos vegetales o materia orgánica en descomposición acumulada en el caño.\n\n• Excretas y fluidos animales: Presencia de orina o excrementos de mamíferos, aves y roedores que transitan habitualmente por las vías públicas y canos (sic).\n\n• Microorganismos: Proliferación natural de bacterias y hongos en el drenaje público que emiten luminiscencia bajo luz UV.\n\n• Residuos químicos domésticos: Acumulación de jabones, detergentes y blanqueadores ópticos comunes en la tierra y agua del cano, los cuales reaccionan fuertemente ante la radiación ultravioleta dando colores fluorescentes verdes.\n\n3. Comportamiento Técnico Real de la Fluoresceína: En una prueba con resultado positivo por interconexión directa de un inodoro, la fluoresceína tiñe el agua del caño con un color Verde Neón tan denso e intenso que resulta conspicuo y visible a simple vista a metros de distancia durante el día. Dicho\n\nfenómeno jamás ocurrió en nuestra propiedad ni en la vía pública. Vale comentar que nosotros en ninguna prueba hemos visto la coloracion (sic) a simple vista sobre el cano o cordon (sic) del cano del Verde destellante Neon (sic)del que se dice que esta (sic) presente en esta Orden Sanitaria.\n\nIII. ARGUMENTOS JURÍDICOS Y MOTIVOS DE REVOCATORIA DE LA ORDEN SANITARIA\n\nCon base en los antecedentes de hecho y los fundamentos científicos señalados, sustentamos el presente recurso en los siguientes motivos de nulidad y revocatoria: \n\nNÚCLEO DEL ALEGATO JURÍDICO / MOTIVO PRINCIPAL DE REVOCATORIA:\n\n\"PRIMERO: Violación al Debido Proceso por Falta de Certeza Técnica. Consta en las declaraciones del propio técnico que el hallazgo fue sumamente difícil de detectar (\"costó mucho\"), lo que procesalmente se traduce en una duda razonable. Al no existir una coloración evidente a la luz del día, la administración está sancionando bajo meras conjeturas, violentando el principio de inocencia ... \"\n\n• Desarrollo del Principio de Certeza Técnica e Inocencia: El confesado grado de dificultad del funcionario para observar el supuesto brillo evidencia de forma incontrovertible la inexistencia de una prueba plena. En el Derecho Administrativo costarricense, una sanción, orden de hacer u orden sanitaria no puede fundamentarse en sospechas, hallazgos forzados o indicios débiles e inciertos. La imposición de una carga al administrado exige una prueba plena, contundente e indudable, en apego estricto al debido proceso y al principio de inocencia.\n\n• Ausencia de Dilución Concluyente y Falta de Nexo Causal: Si verdaderamente existiera una interconexión directa del inodoro hacia el exterior, el volumen de agua arrastrado por la descarga del tanque habria (sic) generado una mancha continua, evidente y densa a la luz del dia (sic). La necesidad de aislar una muestra en un tubo de ensayo y llevarla a un cuarto oscuro para detectar un rastro casi imperceptible solo con luz UV demuestra que no existe un nexo causal sólido entre el inodoro de la vivienda y el punto de inspección.\n\nPodemos agregar Tambien (sic) la inexistencia del Nexo Causal, por cuanto no se aplica luz UV en el cano y cordon (sic) del cano antes de vertir (sic) en el inodoro la sustancia de Fluoresceina (sic), que pueda evidenciar objetivamente ante testigos , el color verde al ser iluminadoel cano (sic) o cordon (sic) de cano (sic), con luz UV siendo producto de la materia organica (sic) en desconposicion bacterial (sic) o vegetal presente en el cano (sic) o cordon (sic) de cano (sic) antes de hechar fluoresceina (sic) en el inodoro. Y nunca fuimos testigos de dicha actividad por los tecnicos (sic) el dia (sic) de la visita o situacion (sic) encontrada.\n\n• Contaminación Luminica (sic) Preexistente e Imposibilidad de Determinación Física: Al ser el rastro de luz tan extremadamente débil, resulta fisicamente (sic) imposible determinar si la lámpara UV reaccionó a la fluoresceína o bien a la reactividad de blanqueadores ópticos presentes en detergentes de uso doméstico que discurren por la vía pública, o a la propia materia orgánica en descomposición. \n\nIV. PETITORIA\n\nPor todo lo expuesto, solicitamos muy respetuosamente a la autoridad competente:\n\nPRIMERO: Se declare CON LUGAR el presente recurso de revocatoria e impugnación contra la actuación y Orden Sanitaria emitida por el Área Rectora de Salud del Cantón La Unión por evidente violación al debido proceso y falta de certeza técnica.\n\nSEGUNDO: Se deje SIN EFECTO ni valor alguno la Orden Sanitaria referida, por existir una duda razonable y manifiesta falta de certeza técnica en las pruebas realizadas.\n\nTERCERO: Se ordene el ARCHIVO DEFINITIVO del expediente administrativo correspondiente a este caso. (…)”. \n\n2.- Por escrito recibido en la Secretaría de esta Sala a las 15:49 horas del 30 de julio de 2026, la parte recurrente aportó documentos y manifestó lo siguiente: “(…) Adjunto Acta de Inspección y sus hechos durante la visita de inspección y por último el trato de una técnica del Ministerio de Salud (…)”.\n\n3.- Por escrito recibido en la Secretaría de esta Sala el 07 de agosto de 2026, la parte recurrente aportó documentos. \n\n4.- Por resolución de las 16:00 horas del 10 de agosto de 2026, se le previno a la parte recurrente, lo siguiente: “(…) aclare la parte recurrente, dentro del plazo de TRES DÍAS, contado a partir de la notificación de este pronunciamiento lo siguiente: Si lo que pretende es interponer un nuevo recurso de amparo, o bien, si su intención es aportar el escrito como prueba dentro del recurso de amparo nro. 26-023702-0007-CO. (...)\".\n\n5.- Por escrito recibido en la Secretaría de esta Sala a las 16:16 horas del 12 de agosto de 2026, la parte recurrente manifestó lo siguiente: \n\n“(…) por medio de la presente declaramos nuestra intención de aportar nuestro escrito # 26-026982-0007 como prueba dentro del recurso de amparo nro. 26-023702-0007-CO. \n\nDeseamos aportar las siguientes pruebas:\n\n1- Por medio de fotos y/o videos en la Llave Maya.\n\na- Desfogue de aguas Negras en horas Nocturnas y/o madrugada en la acera de la casa C7 (Debemos resaltar estas horas ya que nuestro sistema de drenaje se presenta aguas lenticas y/o totalmente estáticas, a esas horas ya que todos estamos durmiendo para luego se activa en horas del dia (sic), normalmente sin ningun (sic) inconveniente dentro del proceso acostumbrado desde que esta casa se construyó). \n\nb- Enfrente de la Dirección02 otra casa presenta infraestructura instalada, se observa un ducto que se encuentra enterado y con zacate dificultando su observación, posiblemente utilizado para el desfogue de Aguas Negras, dirigidas a la cuneta de dicha carretera. \n\n2- En el Área Rectora de Salud Goicoechea y Santa Ana me explican que al identificar u observar el vertido de la fluoresceina (sic) sódica, visible a simple vista a la luz del dia (sic) color verde destellante Neón sobre la via (sic) Pública y cordón del caño, dicho hallazgo debe exponerse a los causantes de dicho problema como prueba Técnica a Derecho y solo así se procede con Orden Sanitaria, de lo contrario se cierra dicho proceso de investigación según protocolo en ausencia del color verde destellante de la fluoresceina (sic) en el cordón del caño.\n\nEn nuestro caso transcurrido un mes después de la visita nunca se presentó el señor Kevin Sandoval Quiros (sic) para que nos demostrara el hallazgo en particular, nunca se demostró la presencia de la Fluoresceina (sic) y segun (sic) el tecnico (sic) Kevin Sandoval Quiros (sic), le explico a Nombre01 en donde nos apersonamos al (A.R.S.) La Unión, que no se observa color verde y recoge una muestra y la lleva al cuarto oscuro con luz ultravioleta, observando el mínimo que además le costo (sic) mucho. Prueba de lo anterior es que hay una costumbre contrario (sic) a otras Areas (sic) Rectoras con un ejemplo de otro técnico de apellido Castañaza (sic) y funcionario del (A.R.S.) La Unión y en otro momento, identificado el mismo en cuarto oscuro obs. (sic) foto relacionada.\n\nPero en ambos técnicos se presenta ausencia del estudio o técnica complementaria conocida con el nombre de \"Espectrofotometro\", que mide las ondas de longitud de cada comúnmente partícula, su tamaño detectando cuales partículas se presentan en dicha muestra, de lo contrario adolece de una prueba Científica a Derecho.\n\nEstos acontecimientos nunca se plasmaron y no se consideró durante el protocolo, y mucho menos lo consideran en el documento \" Informe Tecnico (sic)\" De igual manera si la denuncia es en el cordón del caño y caño, antes de aplicar la fluoresceína en los inodoros, se debe iluminar con luz ultravioleta u observar el verde destellante el caño para vincular el hecho con la presencia de bacterias, tejidos vegetales en descomposición, y /o materia orgánica descompuesta y orines de aves y ratas, perros etc., y jabones utilizados comúnmente. Lo anterior se ejecuta antes de echar fluoresceína a los inodoros. De lo contrario estaríamos en un Falso Positivo por los factores discutidos anteriormente. En la prueba que presento dice lo siguiente\n\nImagen 1. Croquis de datos recopilados en inspección técnica\n\nSe observa un flujo de agua en un tubo ubicado al costado oeste de la vivienda a pesar de no estar lloviendo y que segun (sic) indica el denunciado es una salida de aguas pluviales.\n\n2) Se toma muestra para observación bajo luz negra y se verifica que hay presencia de fluoresceina (sic) lo que indica que esta agua proviene del sistema de aguas negras de la vivienda.\"\n\nEsta prueba fue hecha por el técnico Castañaza (sic), en la vivienda vecinal.\n\nLo anterior es prueba de un posible error que presentan los técnicos del (A.R.S.) La Unión y algunos otros posiblemente. Lamentablemente se confecciona Ordenes Sanitarias totalmente injustas, teniendo por fin las pruebas como \"Falsos Positivos\". (…)”\n\n 6.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n I.- SOBRE LAS RAZONES DEL DESGLOSE. En el sub lite, se concluye que este caso no constituye un recurso nuevo, sino que lo pretendido -tal como lo señala la parte recurrente- se relaciona directamente con lo que se está conociendo dentro del recurso de amparo número 26-023702-0007-CO. En tal sentido, como los hechos referidos en este recurso de amparo, están relacionados con en el recurso de amparo supra citado, resulta improcedente admitir un nuevo proceso para discutir los mismos hechos que en esencia, se analizarán y resolverán en aquel expediente. En consecuencia, se ordena desglosar todos los escritos que constan agregados a este expediente, para que sean asociados al recurso de amparo número 26-023702-0007-CO, a fin de que allí se resuelva lo que en derecho corresponda. Archívese este expediente.\n\n II.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "Document Review\n\n\n\nCASE FILE No. 26-026982-0007-CO \n\nPROCEEDING: AMPARO PROCEEDING\n\nRULING No. 2026032477\n\n \n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 25 August 2026.\n\nAmparo proceeding filed by Nombre04, identity card CED01, and Nombre02, identity card CED02, against the MINISTRY OF HEALTH.\n\nBackground:\n\n1.- In a submission received by the Secretariat of this Chamber at 15:37 on 27 July 2026, the applicants filed an amparo proceeding against the Ministry of Health. They state the following:\n\n“(…) I. FACTS AND BACKGROUND\n\n1. Receipt of Anonymous Complaint and Initial Inspection: The Ministry of Health (Health Oversight Area for the Canton of La Unión, San Rafael District) received an anonymous complaint alleging the discharge of sewage onto the gutter at the boundary between two properties. In response, a technical officer of the institution went to the residence and began the applicable protocol, applying fluorescein dye in the toilets in order to verify the route of the water to the tank and the subsequent drainage.\n\n2. Technician’s Instructions and Notification: During the initial visit, the technician preliminarily indicated that the dye could take from a few days to a couple of months to appear as a highly visible neon green color on the gutter. Subsequently, one month after the field test had been conducted, the applicants visited the Ministry of Health offices, where the officer asked that the inspection form be signed. It is clarified that Nombre01 signed that document solely at the officer’s request and because of a lack of knowledge of the legal implications, expressly recording that they did not agree with its contents.\n\n3. Complete Absence of Visible Coloration in Daylight: After the technician left, a full month passed during which no water with a bright fluorescent green color perceptible to the human eye was ever seen in the public right-of-way.\n\n4. Technician’s Explicit Statement and Test in a Dark Room: In the absence of visible findings, the residents, Mr. Nombre04 and Nombre01, went in person to the Ministry of Health offices for the sole purpose of being informed of the test result, since there had been only one conversation during the visit to our home and, to date, after one month, we went to the Ministry of Health and asked about the test performed at our home. At that meeting, all of this was discussed verbally, and the technical officer expressly stated that he could not visibly see green water on the gutter or sidewalk. For that reason, the technician unilaterally decided to collect a water sample from the gutter in a test tube and take it to a dark room inside the Ministry’s facilities, openly admitting that he had great difficulty detecting the green color and that he could see very little. It is noted that none of these verbal statements or reservations was recorded in writing on the form signed by Nombre01, who signed the document at the officer’s request and out of lack of knowledge. On the other hand, however, it is true that it is written and recorded in the Technical Report, see annex “Technical Report,”\n\nin relation to the situation found. As a result of the tests carried out with fluorescein, pouring that liquid into the toilets. The positive result is unclear because the exact location or point indicated in that test is not known, and, aggravatingly, we were never shown those findings as objective and transparent technical evidence. At that time, the technician verbally explained that the sample was collected at the end, where our boundary ends and the neighbor’s begins, where for more than 6 months sewage has been discharging, see annex of photos and/or videos. Furthermore, for almost three and a half years before that, there were no discharges, and the neighbor’s sidewalk and gutter were completely dry. But, as I reiterate, since February 2026 until today, foul-smelling water has continuously flowed out, impregnated with foam and fetid odors, and black liquids resembling, as observed, liquid oil (sic9) and/or black custard, as well as liquids of various colors resembling a rainbow. It is also worth emphasizing that the complaint underlying this Health Order was made on 19 March 2026 and the visit took place on 5 May 2026, during repeated flooding on many occasions since the amparo proceeding was filed in 2021, case file 21-015740-0007-CO, which we won. To date, none of the respective authorities or institutions has done anything, despite having seen what is happening. However, they came to our house supposedly because of an anonymous complaint, which we believe we know where it came from. We have never discharged sewage, except when our property floods, as it is doing at present.\n\nOn the other hand, on the morning of 8 July 2026, we met Mr. Nombre03, the manager responsible for sewage at G.A.M., 100 meters from my house. Mr. Nombre03 proceeded to acknowledge one of the problems he had set out to look for in Residencial Estancia Antigua; he was surprised by the large quantity of water flowing at that moment from one of the houses. Exactly, the Ministry of Health technician says that he collected the samples to take them to the dark room.\n\nTECHNICAL-SCIENTIFIC GROUNDS AND EXISTENCE OF A FALSE POSITIVE\n\n1. Scientific Demonstration of a Microscopic Trace: The fact that the technician had to resort to a dark room and still had extreme difficulty detecting any glow demonstrates, in the scientific field, that there was no actual or continuous flow of dyed water from the toilet, but at most a microscopic or imperceptible trace under normal conditions.\n\n2. Expert Opinion and Interference from Natural Fluorescence: To technically clarify the finding, specialized training and advice were sought from a Chemical Engineer at a State University, and the results were compared with the regulations applicable in La Gaceta. The chemistry specialist explained that the presence of a minimal trace of luminescence in a dark room under ultraviolet (UV) light does not prove the presence of fluorescein applied in the toilet, since the sample can react in exactly the same way because of multiple environmental factors, producing a False Positive. Technical causes of natural fluorescence in the environment include:\n\n• Organic and plant matter: Presence of plant residues or decomposing organic matter accumulated in the gutter.\n\n• Animal excrement and fluids: Presence of urine or excrement from mammals, birds, and rodents that regularly travel along public roads and gutters.\n\n• Microorganisms: Natural proliferation of bacteria and fungi in the public drainage system that emit luminescence under UV light.\n\n• Household chemical residues: Accumulation in the soil and water in the gutter of soaps, detergents, and optical brighteners commonly used in household products, which react strongly to ultraviolet radiation, producing green fluorescent colors.\n\n3. Actual Technical Behavior of Fluorescein: In a test with a positive result due to a direct connection from a toilet, the fluorescein dyes the water in the gutter a dense, intense neon green that is conspicuous and visible to the naked eye from meters away during the day. That phenomenon never occurred on our property or in the public right-of-way. It is worth mentioning that in none of our tests have we seen the bright neon green coloration said to be present in this Health Order with the naked eye on the gutter or gutter edge.\n\nIII. LEGAL ARGUMENTS AND GROUNDS FOR REVOCATION OF THE HEALTH ORDER\n\nBased on the factual background and scientific grounds set out above, we base this application on the following grounds for nullity and revocation:\n\nCORE OF THE LEGAL ARGUMENT / MAIN GROUND FOR REVOCATION:\n\n“FIRST: Violation of Due Process for Lack of Technical Certainty. The technician’s own statements show that the finding was extremely difficult to detect (‘it took a lot of effort’), which procedurally amounts to reasonable doubt. In the absence of an evident coloration in daylight, the administration is imposing a sanction based on mere conjecture, violating the presumption of innocence ...”\n\n• Development of the Principle of Technical Certainty and Innocence: The officer’s admitted difficulty in observing the alleged glow incontrovertibly demonstrates the absence of full proof. In Costa Rican Administrative Law, a sanction, order to act, or Health Order cannot be based on suspicions, forced findings, or weak and uncertain indications. Imposing a burden on the resident requires full, compelling, and unequivocal proof, in strict observance of due process and the presumption of innocence.\n\n• Absence of Conclusive Dilution and Lack of Causal Link: If there truly were a direct connection from the toilet to the exterior, the volume of water carried by the tank discharge would have produced a continuous, evident, dense stain in daylight. The need to isolate a sample in a test tube and take it to a dark room to detect an almost imperceptible trace only under UV light demonstrates that there is no sound causal link between the residence’s toilet and the inspection point.\n\nWe can also add the absence of a causal link, because UV light was not applied to the gutter and gutter edge before pouring the fluorescein substance into the toilet, which could have objectively shown witnesses the green color when the gutter or gutter edge was illuminated with UV light, as a product of organic matter from bacterial or plant decomposition present in the gutter or gutter edge before fluorescein was poured into the toilet. We were never witnesses to the technicians carrying out that activity on the day of the visit or the situation found.\n\n• Preexisting Light Contamination and Impossibility of Physical Determination: Since the light trace was so extremely weak, it is physically impossible to determine whether the UV lamp reacted to the fluorescein or to the reactivity of optical brighteners in household detergents that flow along the public right-of-way, or to decomposing organic matter itself.\n\nIV. REQUEST FOR RELIEF\n\nFor all the foregoing reasons, we respectfully request that the competent authority:\n\nFIRST: Declare this application for revocation and challenge against the action and Health Order issued by the Health Oversight Area for the Canton of La Unión WELL-FOUNDED, for the evident violation of due process and lack of technical certainty.\n\nSECOND: SET ASIDE the aforementioned Health Order and give it no effect or value, because of reasonable doubt and the manifest lack of technical certainty in the tests conducted.\n\nTHIRD: Order the DEFINITIVE CLOSURE of the administrative case file corresponding to this matter. (…)”\n\n2.- In a submission received by the Secretariat of this Chamber at 15:49 on 30 July 2026, the applicants submitted documents and stated the following: “(…) I attach the Inspection Record and the events during the inspection visit, and finally the treatment by a technician of the Ministry of Health (…)”.\n\n3.- In a submission received by the Secretariat of this Chamber on 7 August 2026, the applicants submitted documents.\n\n4.- By ruling of 16:00 on 10 August 2026, the applicants were instructed as follows: “(…) within THREE DAYS from notification of this ruling, the applicants are to clarify the following: Whether they intend to file a new amparo proceeding, or whether they intend to submit the document as evidence in amparo proceeding no. 26-023702-0007-CO. (...)”\n\n5.- In a submission received by the Secretariat of this Chamber at 16:16 on 12 August 2026, the applicants stated the following:\n\n“(…) We hereby state our intention to submit our document no. 26-026982-0007 as evidence in amparo proceeding no. 26-023702-0007-CO.\n\nWe wish to submit the following evidence:\n\n1- By means of photos and/or videos on the Llave Maya [USB drive].\n\na- Discharge of sewage during nighttime and/or early morning onto the sidewalk at house C7 (We must emphasize these hours because our drainage system has slow-moving and/or completely static water at those hours, since everyone is asleep, and then it becomes active during the day, normally without any problem in the usual process since this house was built).\n\nb- Across from Dirección02, another house has installed infrastructure; a duct can be seen, buried and covered with grass, making it difficult to see, possibly used to discharge sewage into the roadside ditch.\n\n2- At the Goicoechea and Santa Ana Health Oversight Area, they explained to me that when identifying or observing the discharge of sodium fluorescein, visible to the naked eye in daylight as a bright neon green color on the public road and gutter edge, that finding must be shown to those responsible for the problem as technical evidence admissible in law, and only then is a Health Order issued. Otherwise, the investigation is closed under the protocol in the absence of the fluorescein’s bright green color on the gutter edge.\n\nIn our case, one month after the visit, Mr. Kevin Sandoval Quiros (sic) never came to show us the particular finding; the presence of fluorescein was never demonstrated and, according to technician Kevin Sandoval Quiros (sic), he explained to Nombre01 at the Health Oversight Area (A.R.S.) La Unión, where we went in person, that no green color could be seen and that he collected a sample and took it to the dark room under ultraviolet light, where he observed the slightest trace, which also took him a lot of effort. Evidence of the foregoing is a practice contrary to that of other Health Oversight Areas, with the example of another technician, surnamed Castañaza (sic), an employee of the Health Oversight Area (A.R.S.) La Unión, and at another time, the same was identified in a dark room, see related photo.\n\nHowever, both technicians failed to conduct the complementary study or technique known as a ‘spectrophotometer,’ which measures the wavelength of each commonly occurring particle and its size, detecting which particles are present in the sample; otherwise, the evidence lacks scientific proof admissible in law.\n\nThese events were never recorded and were not considered during the protocol, much less in the document ‘Technical Report.’ Similarly, if the complaint concerns the gutter edge and gutter, before applying fluorescein in the toilets, the gutter must be illuminated with ultraviolet light or observed for bright green color, in order to link the fact to the presence of bacteria, decomposing plant tissue, and/or decomposed organic matter, and urine from birds, rats, dogs, etc., and commonly used soaps. The foregoing is done before pouring fluorescein into the toilets. Otherwise, we would have a False Positive because of the factors discussed above. The evidence I submit states the following:\n\nImage 1. Sketch of data collected during technical inspection\n\nA flow of water is observed in a pipe located on the west side of the residence, despite there being no rain and, according to the respondent, it is an outlet for stormwater.\n\n2) A sample is taken for observation under black light and the presence of fluorescein is verified, indicating that this water comes from the residence’s sewage system.”\n\nThis evidence was prepared by technician Castañaza (sic), at the neighboring residence.\n\nThe foregoing is evidence of a possible error by technicians from the Health Oversight Area (A.R.S.) La Unión and possibly some others. Unfortunately, completely unjust Health Orders are prepared, treating the evidence as “False Positives.” (…)”\n\n6.- The legal requirements have been observed in these proceedings.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- GROUNDS FOR SEVERANCE. In this case, it is concluded that this is not a new proceeding; rather, as the applicants indicate, what they seek is directly related to the matter being considered in amparo proceeding number 26-023702-0007-CO. Accordingly, since the facts referred to in this amparo proceeding are related to the aforementioned amparo proceeding, it is inadmissible to accept a new proceeding to discuss the same facts that, in essence, will be analyzed and resolved in that case file. Consequently, all submissions included in this case file are ordered severed so that they may be associated with amparo proceeding number 26-023702-0007-CO, where the matter will be resolved as required by law. Let this case file be archived.\n\nII.- DOCUMENTS SUBMITTED TO THE CASE FILE. The parties are instructed that if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum of 30 business days from notification of this judgment. Otherwise, any such material not collected within this period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nAll submissions included in this case file are ordered severed so that they may be associated with amparo proceeding number 26-023702-0007-CO, where the matter will be resolved as required by law.
