  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-027774-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026032529\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, adulto mayor, casado una vez, cédula de identidad nro. CED01, pensionado, vecino de San Juan Sur, Corralillo, Cartago, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nResultando:\n\n1.- Por escrito recibido en esta Sala el 31 de julio de 2026, el recurrente interpone recurso de amparo en el manifiesta: \n\n“1. Soy socio fundador de la Asada San Juan Sur, Corralillo, Cartago, desde el \n\n18 de mayo de 2003.\n\n2. El 14 de junio de 2015, en elección de la Asamblea General Ordinaria, de la Asada San Juan Sur, efectuada en la escuela Justo María Padilla Castro, fui elegido como presidente por un período de dos años. \n\n3. De la misma forma he sido reelegidos por un total de seis periodos consecutivos como presidente de esta Asociación y el último período, es hasta la segunda quincena del mes de mayo 2027.\n\n4. Como casi todas las Asadas de Costa Rica, nuestra Asada San Juan Sur, Corralillo, Cartago, cuenta con el convenio de Delegación con el INSTITUTO COSTARRICENSE ACUEDUCTOS Y ALCANTARILLADOS.\n\n5. Debemos de acatar los lineamientos que emita la ORAC CE de CARTAGO, en cuanto a la parte administrativa, operativa y financiera. \n\n6. El pasado 24 de mayo de 2026, se realizó la Asamblea General Ordinaria, que se denomina de información, ante el faltante de agua que hay en nuestra comunidad, hubo un grupo de personas que en su mayoría no eran asociados, hicieron un desorden en la Asamblea General Ordinaria, en donde según ellos iban a sustituir la Directiva actual, contraviniendo los estatutos y los dispuesto en la Ley 218, Ley de Asociaciones de Costa Rica.\n\n7. Ante esta situación, el día 18 de julio de 2026, hice mi carta de renuncia para la junta Directiva de la Asada San Juan Sur, primer órgano colegiado en donde debo entregar mi carta de renuncia y esta debe realizar una Asamblea General Extraordinaria, para dar a conocer mi renuncia y si se acepta o no. \n\n8. También, este mismo día jueves 18 de junio de 2026, se le envía al correo electrónico de la ORAC CE de Cartago, para que conociera la renuncia y que estuviera informada de lo que estaba por suceder en la Asada San Juan Sur, Corralillo, Cartago.\n\n9. Ante mi renuncia, un grupo de asociados de la Asada, me manifestaron su apoyo y me aconsejaron que revocara la renuncia, Ante lo cual yo les manifesté que todavía la Junta Directiva, no tenía en sus manos la carta de renuncia y que solamente la ORAC CE de Cartago, tenía mi carta de renuncia y que esta no tenía la potestad de aceptar o no mi renuncia. \n\n9. El día martes 23 de junio de 2026, se le envía a la ORAC CE de Cartago, mi revocatoria, la cual estaba sustentada en que, los asociados me dieron su apoyo a mantenerme en la presidencia de la Asada San Juan Sur.\n\n10. El día miércoles 1 de julio de 2026, la ORAC CE de Cartago, nuevamente visitaron la Asada San Juan Sur, en donde se me entregó el oficio N° GSD-UENGAR-2026-02989, fechada 1 de julio 2026, en donde se me manifiesta que, por haber renunciado, la Asesoría Legal de Sistemas Delegados del AyA, brinda su criterio Legal, en cual dice “En ese sentido, la resolución emitida en el expediente No DPJ-036-2023, por parte del Registro Personas Jurídicas. Curridabat, a las once horas del trece de septiembre de dos mil veinticuatro, la cual se encuentra firme según resolución N° 0291-2025 expedida por el Tribunal Registral Administrativo, establece:\n\n“Ineludiblemente es ante el soberano, o sea la asamblea general que debería haberse ventilado el asunto para un saneamiento adecuado. La consideración del Departamento Legal de Sistemas”. Lo extraño es que no aportan la totalidad de Resolución N° 0291-2025 expedida por el Tribunal Registral Administrativo, por lo que, no se sabe cuál fue su por tanto o a que se llegó en la Resolución y cuáles fueron sus consecuencias.\n\nEl Departamento Legal de Sistemas Comunales de Acueductos y Alcantarillados, fue atinada al recomendar dado que el tema central a tratar era la sustitución de los puestos (partiendo de la renuncia), que se sometiera a aprobación de asamblea una ampliación de agenda, donde los miembros que revocaron su renuncia, expusieran los motivos de renuncia y revocatoria de la misma a afectos de que la asamblea valorara si se mantenía en sus puestos o que hubiera sustitución. Así las cosas, la renuncia y su revocatoria hubiesen sido publicitadas ante todos los asociados de un modo transparente, abordando todos los motivos, justificaciones y consideraciones.”\n\n11. Bien, entonces esta ORAC CE de Cartago, quiere hacer valer su criterio a pesar de que los establecido en la Ley 218, Ley de Asociaciones, no establece que, cualquier órgano del Estado, en este caso una Institución Autónoma como es el INSTITUTO COSTARRICENSE ACUEDUCTOS Y ALCANTARILLADOS, quiere hacer una interpretación antojadiza de los que es una Asociación Administradora de Acueductos y Alcantarillados, que es privada y que administra fondos públicos, pero no es parte de ser una asociación pública. \n\n12. Por otro lado tenemos que si en la Asamblea General Ordinaria, los 29 asociados que asistieron, no pidieron que ninguno de los miembros de la Junta Directiva debía ser removido y más bien dieron su apoyo a la gestión realizada.\n\n13. Si debo hacer notar que, desde mucho tiempo atrás, la jefa de la ORAC CE de Cartago, empezó a manifestar que era necesario quitar al presidente de la Asada San Juan Sur y ante reuniones realizadas por esta funcionaria del AyA y la Fiscal de la Asada San Juan Sur, siempre le dijo, debe de realizar una Asamblea General Extraordinaria, para que se sustituya al presidente de la Asada San Juan Sur, pero solamente este puesto. \n\n14. En un momento dado, un grupo de personas que se auto denominaron ProMejoras, dentro de los cuales hay unos asociados y otro grupo mayoritario de no Asociados, mantuvieron reuniones con la jefa de la ORAC CE de Cartago, en donde, según sus manifestaciones, el presidente de la Asada San Juan Sur, no era bienvenido en las oficinas y que debía ser sustituido y esto lo manifestaron en la Asamblea General Ordinaria del día 24 de mayo de 2026. Por lo que pregunto, siendo ella una funcionaria pública y con el compromiso y deber de recibir a cualquier miembro de las Asadas que están bajo su Jurisdicción, porque habla mal y hace estas manifestaciones que en nada benefician la sana convivencia entre una Asada y la ORAC CE de Cartago.\n\n15. Ante la carta de renuncia y posterior revocatoria, lo más lógico es que la ORAC CE de Cartago, era mantenerse neutral, para analizar, que iba a resolver la Junta Directiva de la Asada San Juan Sur y en caso de que esta Directiva, aceptara su renuncia, en donde el siguiente paso sería convocar a una Asamblea General Extraordinaria, para someter a su conocimiento sobre la renuncia y la posterior revocatoria ante el Soberano, como la misma jefa de la ORAC CE de Cartago lo manifestó. Por lo tanto, por un lado, manifiesta que es el soberano, o sea la Asamblea General Extraordinaria, quien debía decidir, y no ella que no tiene competencia ni atribuciones sobre que ella tiene el poder de aceptar mi renuncia y posterior escrito para que yo no pueda seguir ejerciendo mi función, como presidente de la Asada San Juan Sur. Quiere decir que la señora jefa de la ORAC CE de Cartago se extralimitó en sus funciones. \n\n16. Por otro lado, en el Convenio de Delegación, en ninguno de sus artículos dice, que el AyA, la ORAC CE de Cartago, puede intervenir dentro de la organización de la Junta Directiva, no pueden intervenir su elección a menos que haya problemas de operación o por problemas financieros, lo cual no es este el caso. Porque solo quiere remover al presidente, por parte de esta señora jefa de la ORAC CE de Cartago.\n\n17. Esto está causando un perjuicio con algunos compromisos como convenios con la Cooperativa Coopesantos, para la compra de dos manzanas de terreno, con el fin de reforestar y cuidar el recurso hídrico, de una naciente, que tiene dos nacientes para el uso de agua de la Asada San Juan Sur. Esto se debe a que, mi persona tiene la Representación Legal de la Asada San Juan Sur y esto no lo tomó en cuenta la jefa de la ORAC CE de Cartago.\n\nPETITORIA\n\nSolicito de la manera más respetuosa, que se me reinstale nuevamente en el puesto de presidente, pero mediante oficio expedido por la ORAC CE de Cartago, ya que fueron ellos, mediante oficio firmado por la señora JOHANA SOLANO, esto por cuanto, los demás miembros de la directiva de la Asada San Juan Sur, quedaron con esta manifestación por medio del oficio N° GSD-UEN-GAR-2026-02989.\n\nTambién solicito que se me indemnice, si así lo considera la Sala Constitucional, por el daño moral y los perjuicios que se me ocasionaron por la decisión que se tomó de forma antojadiza y sin tomar en cuenta los reglamentos de Asadas y lo establecido en la Ley 218, Ley de Asociaciones de Costa Rica.\n\nFUNDAMENTO DE DERECHO\n\nFundamento la presente demanda con los siguientes artículos 50, 26, 27 de la CONSTITUCIÓN POLÍTICA DE LA REPÚBLICA DE COSTA RICA, Ley 218, Ley de Asociaciones de Costa Rica, Reglamento de Asadas y Reglamento de ARESEP.”\n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\nRedacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\nI.-OBJETO DEL RECURSO. El recurrente alega que fue nombrado presidente de la ASADA San Juan Sur, Corralillo, Cartago, hasta la segunda quincena del mes de mayo 2027. Añade que el 18 de julio de 2026 suscribió una carta de renuncia a ese puesto, para presentarla ante la junta directiva de la ASADA. Ese mismo día, envió dicha carta “al correo electrónico de la ORAC CE de Cartago, para que conociera la renuncia y que estuviera informada de lo que estaba por suceder en la Asada San Juan Sur, Corralillo, Cartago”. Aduce que, ante su renuncia, un grupo de asociados de la ASADA le expresaron su apoyo y le aconsejaron que revocara la renuncia, por lo que les “manifesté que todavía la Junta Directiva, no tenía en sus manos la carta de renuncia y que solamente la ORAC CE de Cartago, tenía mi carta de renuncia y que esta no tenía la potestad de aceptar o no mi renuncia.” Por lo que, el 23 de junio de 2026, “le envía a la ORAC CE de Cartago, mi revocatoria, la cual estaba sustentada en que, los asociados me dieron su apoyo a mantenerme en la presidencia de la Asada San Juan Sur.” Finalmente, lo que motiva el recurso es la respuesta que obtuvo, mediante oficio GSD-UEN-GAR-2026-02989, suscrito por Johanna Solano Segura, de la UEN Gestión de Acueductos Rurales del Instituto Costarricense de Acueductos y Alcantarillados, en el siguiente sentido: \n\n“Mediante correo electrónico de fecha del 18 de junio del 2026, se recibe su carta de renuncia al puesto de presidente que ocupaba en la Asada San Juan Sur de Corralillo, del cual, conforme a nuestras competencias se acusa recibido para fines informativos; posteriormente el martes 23 de junio del mismo año, se remite carta donde se revoca la renuncia presentada.\n\nEn virtud de los documentos recibidos, por parte de la Asesoría Legal de Sistemas Delegados, mediante correo electrónico de fecha 30 de junio del 2026, se brinda a la ORAC Central Este el criterio legal, que expresa: \n\n\"En relación con el oficio remitido por parte del señor Nombre01 expresidente de la Asada San Juan Sur de Corralillo, relacionada con la revocatoria de la renuncia presentada a dicho cargo, me permito indicar que, el competente para conocer la revocatoria es la Asamblea General Extraordinaria, no basta, con el dicho señor haga la manifestación por escrito.\n\nEn ese sentido, la resolución emitida en el expediente N° DPJ-036-2023, por parte del Registro Personas Jurídicas. Curridabat, a las once horas del trece de septiembre de dos mil veinticuatro, la cual se encuentra firme según resolución N° 0291-2025 expedida por el Tribunal Registral Administrativo, establece:\n\n\"Ineludiblemente es ante el soberano, o sea la asamblea general que debería haberse ventilado el asunto para un saneamiento adecuado. La consideración del Departamento Legal de Sistemas Comunales de Acueductos y Alcantarillados, fue atinada al recomendar dado que el tema central a tratar era la sustitución de los puestos (partiendo de la renuncia), que se sometiera a aprobación de asamblea una ampliación de agenda, donde los miembros que revocaron su renuncia, expusieran los motivos de renuncia y revocatoria de la misma a afectos de que la asamblea valorara si se mantenía en sus puestos o que hubiera sustitución. Así las cosas, la renuncia y su revocatoria hubiesen sido publicitadas ante todos los asociados de un modo transparente, abordando todos los motivos, justificaciones y consideraciones.\"\n\nEn virtud de lo expuesto, es criterio de esta Asesoría Legal, que dicho señor no puede continuar en el ejercicio de su cargo, ya que, tal decisión es competencia de la Asamblea General, por tal motivo debe la ORAC remitir oficio al señor expresidente, así como, a los miembros de Junta Directiva que continúan en su cargo.\"\n\nEn virtud de lo expuesto, se indica que ni el AyA o la Junta Directiva de la Asada cuentan con competencias para conocer la revocatoria a la renuncia presentada, por lo tanto, hasta que dicha revocatoria no sea conocida por parte de la Asamblea General Extraordinaria usted no puede fungir en dicho puesto.” \n\nII.- INADMISIBILIDAD DEL AMPARO. La finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no la de servir como un instrumento genérico para garantizar el principio de legalidad o para ejercer un control de legalidad respecto de lo actuado por las distintas administraciones o autoridades públicas. Este Tribunal ha precisado –de forma reiterada– que: \n\n“De conformidad al artículo 48 de la Constitución Política, así como los artículos 1 y 2, con relación al 29 y siguientes de la Ley de la Jurisdicción Constitucional, el recurso de amparo ha sido instituido como un proceso sumario que tiene por propósito exclusivo garantizar o restablecer el goce de los derechos fundamentales consagrados por el Derecho de la Constitución -con excepción de los protegidos a través del hábeas corpus-, violados o amenazados, de forma directa, en perjuicio de su titular. Su objeto no es el de servir como un instrumento genérico para fiscalizar en abstracto la correcta aplicación del derecho o para ejercer un control de legalidad respecto de lo actuado por las administraciones o autoridades públicas. Control de legalidad que, de conformidad con nuestro ordenamiento jurídico, se encuentra en manos de las instancias administrativas correspondientes y, en último grado, de los jueces ordinarios, mediante los procedimientos previstos para tal propósito.” (véase, por todos, voto nro. 2007-012442 de las 9:05 horas del 31 de agosto del 2007)\n\nEsta Sala también ha aclarado, en diversas ocasiones, que el recurso de amparo tiene: \n\n“como finalidad exclusiva brindar tutela oportuna, con carácter restitutivo, contra infracciones o amenazas inminentes a los derechos y libertades fundamentales, su naturaleza es sumaria y su tramitación no es compatible con la realización de debates extensos y técnicamente complicados, la práctica de diligencias probatorias lentas y complejas, o la necesidad de entrar previamente a examinar, con carácter declarativo, si los derechos de rango infra constitucional que las partes citan como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso, existen en realidad.” (véase, por todas, el voto nro. 2022020000 de las 9:15 horas del 26 de agosto de 2022).\n\n En la especie, se plantea un conflicto ajeno al ámbito de competencia de esta Tribunal. No corresponde a esta Sala determinar la validez y eficacia de la renuncia remitida por el recurrente a las autoridades del Instituto Costarricense de Acueductos y Alcantarillados, así como de su posterior revocatoria, ni –en consecuencia– determinar si se le puede tener o no como presidente de la ASADA y para qué efectos, en atención a los antecedentes del caso y conforme la correcta interpretación y aplicación de la normativa infraconstitucional que rige la materia, pues, todo ello hace referencia a un diferendo de legalidad ordinaria, cuya resolución excede –además– el carácter sumario del amparo. La parte recurrente deberá plantear sus reproches en las sedes ordinarias, ya sea administrativas o judiciales. \n\nIII.- EN CONCLUSIÓN. Como corolario de lo anterior, procede rechazar de plano el presente amparo, como así se dispone.\n\n IV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "Review of the Document\n\n\n\nCASE FILE No. 26-027774-0007-CO\n\nPROCEEDING: AMPARO APPLICATION\n\nRULING No. 2026032529\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 25 August 2026.\n\nAmparo application filed by Nombre01, an older adult, married once, identity card no. CED01, pensioner, resident of San Juan Sur, Corralillo, Cartago, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nBackground:\n\n1.- In a pleading received by this Chamber on 31 July 2026, the applicant files an amparo application, stating:\n\n“1. I am a founding member of the Asada San Juan Sur, Corralillo, Cartago, since\n\n18 May 2003.\n\n2. On 14 June 2015, at the election held during the Ordinary General Assembly of the Asada San Juan Sur at the Justo María Padilla Castro school, I was elected president for a two-year term.\n\n3. I have likewise been reelected for a total of six consecutive terms as president of this Association, and my most recent term runs until the second half of May 2027.\n\n4. Like almost all Asadas in Costa Rica, our Asada San Juan Sur, Corralillo, Cartago, has a Delegation Agreement with the INSTITUTO COSTARRICENSE ACUEDUCTOS Y ALCANTARILLADOS.\n\n5. We must comply with the guidelines issued by ORAC CE de CARTAGO regarding administrative, operational, and financial matters.\n\n6. Last 24 May 2026, the Ordinary General Assembly, which is called an information assembly, was held in response to the water shortage in our community. A group of people, most of whom were not members, caused disorder at the Ordinary General Assembly, where, according to them, they were going to replace the current Board, in violation of the bylaws and the provisions of Law 218, Costa Rica’s Law on Associations.\n\n7. In response to this situation, on 18 July 2026, I wrote my letter of resignation to the Board of Directors of the Asada San Juan Sur, the first collegiate body to which I must submit my resignation letter. The Board must then hold an Extraordinary General Assembly to announce my resignation and determine whether it is accepted.\n\n8. Also, on this same day, Thursday 18 June 2026, it was sent to the email address of ORAC CE de Cartago so that it would know of my resignation and be informed of what was about to happen at the Asada San Juan Sur, Corralillo, Cartago.\n\n9. After my resignation, a group of Asada members expressed their support and advised me to revoke it. I told them that the Board of Directors did not yet have my resignation letter in its possession, and that only ORAC CE de Cartago had my letter of resignation and had no authority to accept or reject it.\n\n9. On Tuesday 23 June 2026, I sent my revocation to ORAC CE de Cartago, which was based on the members’ support for my remaining president of the Asada San Juan Sur.\n\n10. On Wednesday 1 July 2026, ORAC CE de Cartago again visited the Asada San Juan Sur, where I was given letter No. GSD-UENGAR-2026-02989, dated 1 July 2026, informing me that, because I had resigned, the AyA Delegated Systems Legal Advisory Office was providing its legal opinion, which states: ‘In this regard, the ruling issued in case file No. DPJ-036-2023 by the Registry of Legal Entities, in Curridabat, at eleven o’clock on 13 September 2024, which became final according to ruling No. 0291-2025 issued by the Administrative Registry Tribunal, establishes:\n\n“Without question, the matter should have been brought before the sovereign body, that is, the general assembly, for proper remediation. The assessment by the Legal Department of Community Aqueduct and Sewer Systems.” What is strange is that they do not provide the full text of ruling No. 0291-2025 issued by the Administrative Registry Tribunal, so it is not known what its operative part said, what conclusion the ruling reached, or what its consequences were.\n\nThe Legal Department of Community Aqueduct and Sewer Systems was right to recommend that, since the central issue to be addressed was the replacement of positions (following the resignation), an expansion of the agenda be submitted for assembly approval, so that the members who revoked their resignations could explain their reasons for resigning and revoking their resignations, for the assembly to assess whether they would remain in their positions or be replaced. In that way, the resignation and its revocation would have been disclosed transparently to all members, addressing all the reasons, justifications, and considerations.’\n\n11. Well, ORAC CE de Cartago now wants to enforce its opinion, even though Law 218, the Law on Associations, does not provide that any State body—in this case, an autonomous institution such as the INSTITUTO COSTARRICENSE ACUEDUCTOS Y ALCANTARILLADOS—may make an arbitrary interpretation of what an Aqueduct and Sewer Administration Association is. It is a private entity that administers public funds, but that does not make it a public association.\n\n12. On the other hand, at the Ordinary General Assembly, the 29 members who attended did not ask for any member of the Board of Directors to be removed; rather, they supported the work carried out.\n\n13. I should point out that, some time ago, the head of ORAC CE de Cartago began saying that it was necessary to remove the president of the Asada San Juan Sur. At meetings held by this AyA official with the auditor of the Asada San Juan Sur, she always said that an Extraordinary General Assembly had to be held to replace the president of the Asada San Juan Sur, and only that position.\n\n14. At one point, a group of people calling themselves ProMejoras, including some members and a larger group of nonmembers, met with the head of ORAC CE de Cartago. According to their statements, the president of the Asada San Juan Sur was not welcome in the offices and had to be replaced. They said this at the Ordinary General Assembly on 24 May 2026. I therefore ask: since she is a public official with the commitment and duty to receive any member of the Asadas under her jurisdiction, why does she speak ill of me and make these statements, which do nothing to promote harmonious relations between an Asada and ORAC CE de Cartago?\n\n15. In response to the resignation letter and subsequent revocation, the most logical course for ORAC CE de Cartago was to remain neutral and consider what the Board of Directors of the Asada San Juan Sur would decide. If that Board accepted my resignation, the next step would be to call an Extraordinary General Assembly to submit the resignation and subsequent revocation for consideration by the sovereign body, as the head of ORAC CE de Cartago herself stated. Therefore, on the one hand, she says that the sovereign body—that is, the Extraordinary General Assembly—must decide; on the other, she acts as though she has the authority to accept my resignation and the subsequent written notice so that I cannot continue performing my duties as president of the Asada San Juan Sur, even though she has no competence or authority to do so. This means that the head of ORAC CE de Cartago exceeded her powers.\n\n16. On the other hand, none of the articles of the Delegation Agreement states that AyA or ORAC CE de Cartago may intervene in the organization of the Board of Directors. They may not interfere in its election unless there are operational or financial problems, which is not the case here. This woman, the head of ORAC CE de Cartago, simply wants to remove the president.\n\n17. This is causing harm with respect to certain commitments, such as agreements with the Coopesantos Cooperative to purchase two manzanas of land, in order to reforest and protect the water resource of a spring with two outlets used by the Asada San Juan Sur. This is because I am the legal representative of the Asada San Juan Sur, a fact the head of ORAC CE de Cartago did not take into account.\n\nRELIEF REQUESTED\n\nI respectfully request that I be reinstated as president by means of an official letter issued by ORAC CE de Cartago, since it was that office, through a letter signed by Ms. JOHANA SOLANO, that made the decision, and the other members of the Board of Directors of the Asada San Juan Sur were left with this representation through letter No. GSD-UEN-GAR-2026-02989.\n\nI also request compensation, if the Constitutional Chamber so considers, for the moral damage and losses caused to me by the arbitrary decision that was made without taking into account the regulations governing Asadas and the provisions of Law 218, Costa Rica’s Law on Associations.\n\nLEGAL BASIS\n\nI base this application on the following articles: 50, 26, and 27 of the POLITICAL CONSTITUTION OF THE REPUBLIC OF COSTA RICA; Law 218, Costa Rica’s Law on Associations; the Asada Regulations; and the ARESEP Regulations.”\n\n2.- Article 9 of the Constitutional Jurisdiction Act empowers the Chamber to summarily dismiss or reject on the merits, at any time, including upon filing, any matter submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is merely a reiteration or reproduction of an identical or similar prior matter that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION. The applicant alleges that he was appointed president of the ASADA San Juan Sur, Corralillo, Cartago, through the second half of May 2027. He adds that on 18 July 2026 he signed a resignation letter for that position, to submit it to the ASADA’s Board of Directors. That same day, he sent the letter “to the email address of ORAC CE de Cartago so that it would know of my resignation and be informed of what was about to happen at the Asada San Juan Sur, Corralillo, Cartago.” He alleges that, following his resignation, a group of ASADA members expressed their support and advised him to revoke it, and that he “told them that the Board of Directors did not yet have my resignation letter in its possession, and that only ORAC CE de Cartago had my resignation letter and had no authority to accept or reject my resignation.” Accordingly, on 23 June 2026, he “sent my revocation to ORAC CE de Cartago, which was based on the members’ support for my remaining president of the Asada San Juan Sur.” Finally, the event giving rise to the application is the response he received in letter GSD-UEN-GAR-2026-02989, signed by Johanna Solano Segura of the Rural Aqueduct Management Unit of the Instituto Costarricense de Acueductos y Alcantarillados, as follows:\n\n“By email dated 18 June 2026, we received your letter of resignation from the position of president you held at the Asada San Juan Sur de Corralillo. In accordance with our authority, we acknowledge receipt for informational purposes. Later, on Tuesday 23 June of the same year, a letter was sent revoking the resignation submitted.\n\nIn view of the documents received, the Delegated Systems Legal Advisory Office provided ORAC Central East with its legal opinion by email dated 30 June 2026, which states:\n\n‘Regarding the letter sent by Mr. Nombre01, former president of the Asada San Juan Sur de Corralillo, concerning the revocation of his resignation from that position, I wish to state that the body competent to consider the revocation is the Extraordinary General Assembly; it is not enough for the gentleman simply to state it in writing.\n\nIn this regard, the ruling issued in case file No. DPJ-036-2023 by the Registry of Legal Entities, in Curridabat, at eleven o’clock on 13 September 2024, which became final according to ruling No. 0291-2025 issued by the Administrative Registry Tribunal, establishes:\n\n“Without question, the matter should have been brought before the sovereign body, that is, the general assembly, for proper remediation. The Legal Department of Community Aqueduct and Sewer Systems was right to recommend that, since the central issue to be addressed was the replacement of positions (following the resignation), an expansion of the agenda be submitted for assembly approval, so that the members who revoked their resignations could explain their reasons for resigning and revoking their resignations, for the assembly to assess whether they would remain in their positions or be replaced. In that way, the resignation and its revocation would have been disclosed transparently to all members, addressing all the reasons, justifications, and considerations.”\n\nIn view of the foregoing, it is the opinion of this Legal Advisory Office that said gentleman may not continue in the exercise of his position, since that decision falls within the competence of the General Assembly. For that reason, ORAC must send an official letter to the gentleman, the former president, and to the Board members who remain in office.’\n\nIn view of the foregoing, it is stated that neither AyA nor the Asada’s Board of Directors is competent to consider the revocation of the resignation submitted. Therefore, until the Extraordinary General Assembly has considered that revocation, you may not serve in that position.”\n\nII.- INADMISSIBILITY OF THE AMPARO. The purpose of an amparo application is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as a generic instrument for guaranteeing the principle of legality or exercising legality review over the actions of the various public administrations or authorities. This Court has repeatedly made clear that:\n\n“Under Article 48 of the Political Constitution, as well as Articles 1 and 2, in connection with Article 29 et seq. of the Constitutional Jurisdiction Act, the amparo application was established as a summary proceeding whose sole purpose is to guarantee or restore the enjoyment of the fundamental rights enshrined in the Law of the Constitution—with the exception of those protected through habeas corpus—that have been directly violated or threatened to the detriment of their holder. Its purpose is not to serve as a generic instrument for abstractly reviewing the correct application of the law or for exercising legality review over the actions of public administrations or authorities. Under our legal system, legality review lies with the corresponding administrative bodies and, ultimately, with the ordinary courts, through the procedures established for that purpose.” (see, among others, ruling no. 2007-012442, issued at 9:05 a.m. on 31 August 2007)\n\nThis Chamber has also clarified on various occasions that the amparo application has:\n\n“the exclusive purpose of providing timely, restorative protection against violations or imminent threats to fundamental rights and freedoms. It is summary in nature, and its processing is incompatible with extensive and technically complex debates, slow and complex evidentiary proceedings, or the need first to examine declaratively whether the rights below constitutional rank that the parties cite as part of the factual account in the amparo application or the statutory report, as the case may be, actually exist.” (see, among others, ruling no. 2022020000, issued at 9:15 a.m. on 26 August 2022).\n\nIn this case, the dispute falls outside the jurisdiction of this Court. It is not for this Chamber to determine the validity and effectiveness of the resignation the applicant sent to the authorities of the Instituto Costarricense de Acueductos y Alcantarillados, or of its subsequent revocation, nor—consequently—to determine whether he may be regarded as president of the ASADA and for what purposes, in light of the case history and the proper interpretation and application of the nonconstitutional regulations governing the matter. All of this concerns a dispute over ordinary legality, whose resolution also exceeds the summary nature of amparo. The applicant must raise his objections before the ordinary administrative or judicial forums.\n\nIII.- CONCLUSION. In light of the foregoing, the present amparo should be summarily dismissed, as ordered.\n\nIV.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they have submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is summarily dismissed.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
