  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-029440-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026032689\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE SALUD.\n\nResultando:\n\n 1.- Por escrito agregado al Sistema de Gestión de Despachos Judiciales de esta Sala a las 14:29 horas del 13 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el MINISTERIO DE SALUD, y manifiesta que: “ (…) Primero: Soy propietaria de un inmueble comercial mínimo en el cantón de La Cruz, que alberga únicamente 3 locales comerciales y una sala de juegos. En ese cantón no existe alcantarillado público por omisión estructural del Estado, obligando a toda la población histórica a disponer los residuos en tanques éticos. El sistema ha funcionado correctamente por más de 5 años y el desborde actual se debió única y exclusivamente a una ruptura imprevista, fortuita y temporal de un tubo interno que ya el fontanero se encontraba reparando de forma legítima. Segundo: De forma totalmente arbitraria, contradictoria y de mala fe, las autoridades de salud locales nos manifestaron expresamente que sería “muy, muy difícil” recibirnos o aprobarnos un croquis de reparación preparado de forma artesanal por nuestro fontanero. Posteriormente se cerraron por completo a cualquier solución lógica o de mantenimiento técnico, otorgándonos un plazo inviable e imposible de 20 días para presentar un plano firmado con exclusividad por un ingeniero civil, exigiéndonos de forma coactiva una planta de tratamiento industrial y que se reutilice el agua de la misma planta y la demolición de la mitad de nuestra propia casa de habitación para colocarla. Tercero: Esta exigencia desproporcionada constituye una persecución hacia mi persona, mientras las autoridades recurridas se hacen de la vista gorda con otros comercios del centro de este mismo cantón que vierten desechos putrefactos a la vía pública de forma intencional, amparándose bajo la excusa institucional de no tener denuncias formales escritas en su contra, violando flagrantemente el principio de igualdad ante la ley y obligando a mi núcleo familiar a tener que abandonar nuestro propio hogar. Cuarto: Esta orden arbitraria ignora por completo que los módulos traseros de la propiedad son únicamente bodegas de almacenamiento de uso mínimo y operativo. Con baños de uso meramente ocasional para personal de carga y nos condena a la total asfixia y quiebra financiera, ya que nuestro núcleo familiar actualmente costea activamente 2 educaciones universitarias y arrastra pesadas deudas y obligaciones con el Banco adquirido mediante financiamiento para poder levantar estos pequeños locales comerciales que hoy amenazan con clausurar”. Solicita que se declare con lo lugar el recurso con las consecuencias de ley, que se ordene la suspensión inmediata de los efectos del informe técnico N°MS-DRRSCH-DARSLC-IT-410-2026 y la Orden Sanitaria N° MS-DRRSCH-DARSLC-OS-0104-2026, prohibiendo expresamente al recurrido ejecutar cualquier tipo de clausura, multa, colocación de sellos de cierre o demolición de infraestructura en la propiedad mientras se tramita y resuelve este recurso.\n\n 2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n \n\n I.- OBJETO DEL RECURSO. La recurrente señala que es propietaria de un inmueble comercial en el cantón de La Cruz, que alberga únicamente 3 locales comerciales y una sala de juegos. Alega que la autoridad recurrida les otorgó un plazo inviable e imposible de 20 días para presentar un plano firmado con exclusividad por un ingeniero civil, exigiéndoles de forma coactiva una planta de tratamiento industrial y que se reutilice el agua de la misma planta y la demolición de la mitad de su casa de habitación para colocarla, disposición con la cual está disconforme y solicita la intervención de esta sede constitucional.\n\nII.- CASO CONCRETO. Según lo planteado, cabe indicar que, la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como un instrumento genérico para canalizar peticiones de otros tipos, con el afán de que este Tribunal intervenga o interponga sus buenos oficios ante la autoridad recurrida, ya que lo alegado, claramente, no se encuentra dentro del ámbito de competencia de esta Jurisdicción, porque no le corresponde a la Sala interceder o mediar a favor de la amparada, ante la autoridad recurrida, ni tampoco entrar a determinar, con base en los hechos y la normativa legal que regula la materia, si es procedente lo ordenado por dicha autoridad. Por lo tanto, la parte accionante deberá acudir, si a bien lo tiene, ante la vía de legalidad que corresponda, a fin de plantear allí las gestiones que estime pertinentes para que se resuelva lo que en derecho proceda. \n\n \n\n III.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "Document Review\n\n\n\nCASE FILE No. 26-029440-0007-CO \n\nPROCEEDING: AMPARO APPLICATION\n\nRULING No. 2026032689\n\n \n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 25 August 2026.\n\nAmparo application filed by Nombre01, identity card CED01, against the MINISTRY OF HEALTH.\n\nBackground:\n\n1.- In a submission added to this Chamber’s Judicial Case Management System at 14:29 on 13 August 2026, the applicant files an amparo application against the MINISTRY OF HEALTH and states: “(…) First: I own a small commercial property in the canton of La Cruz, which houses only 3 commercial premises and a game room. There is no public sewer system in that canton because of the State’s structural omission, forcing the entire long-standing population to dispose of waste in septic tanks. The system has functioned correctly for more than 5 years, and the current overflow was due exclusively to an unforeseen, accidental, and temporary break in an internal pipe, which the plumber was already legitimately repairing. Second: In a completely arbitrary, contradictory, and bad-faith manner, local health authorities expressly told us that it would be ‘very, very difficult’ to receive or approve a repair sketch prepared by our plumber by hand. They later closed themselves off entirely to any logical solution or technical maintenance, giving us an unworkable and impossible 20-day deadline to submit plans signed exclusively by a civil engineer, coercively requiring us to install an industrial treatment plant, reuse the water from that same plant, and demolish half of our own home to put it in place. Third: This disproportionate demand constitutes persecution of me, while the respondent authorities turn a blind eye to other businesses in the center of this same canton that intentionally discharge putrid waste into the public roadway, relying on the institutional excuse that no formal written complaints have been filed against them. This blatantly violates the principle of equality before the law and forces my family to abandon our own home. Fourth: This arbitrary order completely ignores that the rear units on the property are only storage rooms for minimal operational use, with bathrooms used merely occasionally by loading staff. It condemns us to total suffocation and financial ruin, since our family is currently paying for 2 university educations and carrying heavy debts and obligations with the bank, incurred through financing to build these small commercial premises, which they now threaten to shut down.” The applicant asks that the application be granted with the consequences provided by law; that the effects of technical report No. MS-DRRSCH-DARSLC-IT-410-2026 and Health Order No. MS-DRRSCH-DARSLC-OS-0104-2026 be suspended immediately; and that the respondent be expressly prohibited from carrying out any type of closure, imposing a fine, placing closure seals, or demolishing infrastructure on the property while this application is being processed and decided.\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily reject or reject on the merits, at any time, including upon filing, any matter submitted for its consideration that is manifestly inadmissible, when it considers that there is sufficient evidence to reject it, or when it is merely a reiteration or reproduction of an identical or similar prior matter that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION. The applicant states that she owns a commercial property in the canton of La Cruz, which houses only 3 commercial premises and a game room. She alleges that the respondent authority gave them an unworkable and impossible 20-day deadline to submit plans signed exclusively by a civil engineer, coercively requiring them to install an industrial treatment plant, reuse the water from that same plant, and demolish half of her home to put it in place. She disagrees with this measure and requests the intervention of this constitutional forum.\n\nII.- SPECIFIC CASE. In light of the arguments presented, it should be noted that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as a general-purpose means of channeling other types of requests in the hope that this Court will intervene or use its good offices with the respondent authority. What is alleged clearly falls outside this jurisdiction’s competence, because the Chamber is not responsible for interceding or mediating on behalf of the applicant before the respondent authority, nor for determining, based on the facts and the legislation governing the matter, whether what that authority ordered is appropriate. Therefore, if the applicant so chooses, she must pursue the appropriate legal avenue to submit the requests she considers pertinent so that the matter may be resolved as the law provides.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, or objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment.
