San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .\n\n \n\n Recurso de amparo que se tramita bajo el número de expediente 26-029825-0007-CO, interpuesto por Nombre01, cédula de identidad CED01; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. \n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de la Sala el 17 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. Manifiesta que durante los últimos meses el consumo y facturación del servicio de agua de su vivienda se han mantenido habitualmente entre ¢34.000 y ¢40.000, por lo que la factura de julio de 2026, por aproximadamente ¢60.000, representa un incremento considerable y atípico. Agrega que, en un período inferior a algunos meses, el hidrómetro de su servicio ha sido sustituido aproximadamente tres veces, sin que se le hayan explicado las razones técnicas de dichos cambios. Señala que el 22 de julio de 2026 acudió a la sede del Instituto Costarricense de Acueductos y Alcantarillados (AyA) ubicada en la Municipalidad de Alajuelita, donde solicitó la revisión de la facturación, el hidrómetro y el consumo registrado; posteriormente, el 5 de agosto de 2026, se le comunicó que no se había detectado ninguna anomalía y que no procedería modificar la factura de julio. Refiere que el 13 de agosto de 2026 acudió a la oficina de AyA en Dirección01 para manifestar su disconformidad, donde se le indicó que debía cancelar el monto facturado. Considera que la respuesta recibida no brinda una explicación técnica suficiente sobre el incremento extraordinario de la facturación, pues su consumo habitual es de entre 13 y 18 metros cúbicos y, pese a las sustituciones del hidrómetro, se sostiene que este no presenta anomalías. Solicita que se cambie el hidrómetro y que, respecto de la factura por ¢60.000, se realice un ajuste objetivo, razonable y debidamente fundamentado, tomando como referencia el historial de consumo y las lecturas efectivamente verificadas. \n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. La parte recurrente reclama que el Instituto Costarricense de Acueductos y Alcantarillados (AyA) le facturó aproximadamente ¢60.000 por el servicio de agua en julio de 2026, monto que considera atípico respecto de su consumo y facturación habituales, y que, pese a haber solicitado la revisión de la facturación y del hidrómetro, la institución determinó que no existía anomalía y mantuvo el cobro, sin brindarle una explicación técnica suficiente sobre el incremento ni sobre las reiteradas sustituciones del hidrómetro; considera que dicha actuación lesiona su derecho fundamental a recibir una respuesta debidamente fundamentada y solicita que se cambie el hidrómetro y se ajuste la factura cuestionada de manera objetiva y razonable, tomando en cuenta su historial de consumo y las lecturas verificadas.\n\nII.- INADMISIBILIDAD DEL AMPARO. Vistos los alegatos de la parte recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de la Administración Pública, ni como una instancia adicional para dirimir controversias propias de la vía ordinaria. Por esta razón, la Sala no puede hacer las veces de alzada en la materia expuesta y revisar si el cobro o facturación efectuado por la institución accionada se ajusta al consumo real, a las condiciones del servicio o a la normativa aplicable, por cuanto constituye un diferendo de legalidad ordinaria que debe ser dirimido en la vía administrativa o judicial correspondiente. Tampoco corresponde a esta Sala sustituir las competencias legalmente asignadas a la recurrida o a las autoridades competentes en la materia, a efecto de determinar si procede o no un ajuste en la facturación, verificar el método de cálculo, establecer el consumo efectivo o disponer las revisiones técnicas necesarias para determinar la procedencia del cobro cuestionado, por cuanto ello constituye una labor propia de la Administración, cuyos diferendos son propios de conocerse en la vía de legalidad ordinaria y no de constitucionalidad. En ese sentido, tampoco puede pretenderse que, por la vía del amparo, la Sala Constitucional se convierta en una instancia tramitadora de reclamos relacionados con la facturación de servicios, pues ello implicaría realizar valoraciones y comprobaciones de naturaleza técnica que exceden el ámbito sumario de esta jurisdicción y sustituir a la Administración en el ejercicio de las competencias que legalmente le han sido conferidas.\n\nEn el caso concreto, la inconformidad de la parte recurrente se dirige, sustancialmente, contra el monto facturado por el servicio de agua y contra el resultado de la revisión efectuada por el Instituto Costarricense de Acueductos y Alcantarillados, pues cuestiona que el consumo registrado y cobrado corresponda a su consumo real, así como las sustituciones del hidrómetro y la conclusión administrativa de que dicho dispositivo no presenta anomalías. No obstante, de lo expuesto se desprende que la parte recurrente ya planteó su inconformidad ante la institución recurrida y que esta efectuó una revisión del hidrómetro, comunicándole que no se había detectado ninguna anomalía y que no procedería modificar la factura de julio de 2026. Así, determinar si dicha conclusión técnica es correcta, si el consumo registrado corresponde al efectivamente realizado y si procede modificar la facturación cuestionada requiere el análisis de circunstancias fácticas y técnicas propias de la relación de servicio y de la gestión administrativa correspondiente, sin que de lo expuesto se desprenda, por sí mismo, una lesión constitucional susceptible de ser tutelada en esta sede. Así las cosas, deberá la parte recurrente acudir ante la vía de legalidad ordinaria, administrativa o judicial, a fin de plantear allí los reclamos que estime pertinentes respecto de la facturación cuestionada, del funcionamiento y sustitución del hidrómetro y de la revisión efectuada, para que se determine lo que en derecho corresponda. En consecuencia, el recurso es inadmisible y así se declara.\n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso. \n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:25 a.m. on 25 August 2026.\n\nAmparo proceeding registered under expediente number 26-029825-0007-CO, filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\nBackground:\n\n1.- By a brief submitted to the Chamber’s Secretariat on 17 August 2026, the petitioner files an amparo proceeding against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS. The petitioner states that in recent months, the water consumption and billing for the petitioner’s residence have usually remained between ¢34,000 and ¢40,000; therefore, the July 2026 bill, for approximately ¢60,000, represents a considerable and atypical increase. The petitioner adds that, within a period of less than a few months, the water meter for the service has been replaced approximately three times, without any technical reasons for those changes having been explained. The petitioner states that on 22 July 2026, the petitioner went to the office of the Costa Rican Institute of Aqueducts and Sewers (AyA) located at the Municipality of Alajuelita, where the petitioner requested a review of the billing, the water meter, and the recorded consumption. Subsequently, on 5 August 2026, the petitioner was informed that no anomaly had been detected and that the July bill would not be adjusted. The petitioner reports that on 13 August 2026, the petitioner went to the AyA office in Dirección01 to express disagreement and was told that the billed amount had to be paid. The petitioner considers that the response received does not provide a sufficient technical explanation for the extraordinary increase in the bill, since the petitioner’s usual consumption is between 13 and 18 cubic meters and, despite the water meter replacements, it is maintained that the meter has no anomalies. The petitioner requests that the water meter be changed and that the ¢60,000 bill be adjusted objectively, reasonably, and with proper grounds, using the consumption history and readings actually verified as references.\n\n2.- Article 9 of the Constitutional Jurisdiction Act empowers the Chamber to dismiss summarily or on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is merely the reiteration or reproduction of an identical or similar earlier application that was dismissed.\n\nPrepared by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION. The petitioner complains that the Costa Rican Institute of Aqueducts and Sewers (AyA) billed approximately ¢60,000 for water service in July 2026, an amount the petitioner considers atypical in light of the usual consumption and bills, and that, despite having requested a review of the billing and the water meter, the institution found no anomaly and maintained the charge without providing a sufficient technical explanation for the increase or the repeated water meter replacements. The petitioner considers that this conduct violates the fundamental right to receive a properly reasoned response and requests that the water meter be changed and the disputed bill adjusted objectively and reasonably, taking into account the consumption history and verified readings.\n\nII.- INADMISSIBILITY OF THE AMPARO. Having considered the petitioner’s arguments, the petitioner is advised that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms. It is not an instrument for reviewing the legality of acts of the Public Administration or an additional forum for resolving disputes that belong in the ordinary legal process. For this reason, the Chamber cannot act as an appellate body on the matter presented and review whether the charge or billing by the respondent institution accords with actual consumption, the service conditions, or the applicable regulations, since this is an ordinary-legality dispute that must be resolved through the corresponding administrative or judicial process. Nor is it for this Chamber to replace the powers legally assigned to the respondent institution or to the competent authorities in the matter, in order to determine whether a billing adjustment is warranted, verify the calculation method, establish actual consumption, or order the technical reviews needed to determine whether the disputed charge is warranted. Those are functions of the Administration, and disputes of that kind are to be heard through the ordinary-legality process, not the constitutional process. In that regard, it also cannot be sought through amparo to turn the Constitutional Chamber (Sala Constitucional) into a forum for processing complaints related to service billing, since that would entail technical assessments and verifications beyond the summary scope of this jurisdiction and would replace the Administration in exercising powers legally conferred on it.\n\nIn this case, the petitioner’s disagreement is directed, in substance, against the amount billed for water service and the result of the review conducted by the Costa Rican Institute of Aqueducts and Sewers, since the petitioner disputes whether the recorded and billed consumption corresponds to actual consumption, as well as the water meter replacements and the administrative conclusion that the device has no anomalies. However, it follows from the petitioner’s account that the petitioner already raised the disagreement with the respondent institution, which reviewed the water meter and informed the petitioner that no anomaly had been detected and that the July 2026 bill would not be adjusted. Thus, determining whether that technical conclusion is correct, whether the recorded consumption corresponds to the consumption actually incurred, and whether the disputed billing should be modified requires analysis of factual and technical circumstances specific to the service relationship and the corresponding administrative process. The account presented does not, by itself, disclose a constitutional violation that may be remedied in this forum. Accordingly, the petitioner must pursue the ordinary-legality process, administrative or judicial, to raise any claims considered appropriate concerning the disputed billing, the operation and replacement of the water meter, and the review conducted, so that the matter may be determined as the law requires. Consequently, the application is inadmissible, and so it is declared.\n\nIII.- DOCUMENTATION SUBMITTED TO THE EXPEDIENTE. The petitioner is advised that if any paper document, or any object or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, was submitted, it must be collected from the office within a maximum period of 30 business days from notification of this judgment.
