"summary_en": "The Constitutional Chamber (Sala Constitucional) summarily rejected the amparo proceeding against the Costa Rican Institute of Aqueducts and Sewers. The applicant challenged sewerage charges despite alleging that the home uses a septic tank and is not connected to the network, and complained of increases in the bill. The Chamber stated that it is not for it to determine the origin or correct amount of a drinking-water service bill or to review the legality of such charges. It considered that the dispute must be raised through administrative channels and, eventually, in the ordinary courts. It found no injury to access to the public service because water supply to the property continued. The resolution orders summary rejection; it does not decide whether the charges were correct or order repayment.",

\n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:25 a.m. on 25 August 2026.\n\nAmparo application filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\nBackground:\n\n1.- In a written submission added to this Chamber’s Judicial Offices Management System at 09:53 on 17 August 2026, the petitioner files an amparo application against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS and states: “The fact is that in 2010 I moved to live in Residencial Bruno Martínez, located in Ipís de Guadalupe, across from Dirección01; from that date until today I have been charged for sewerage (wastewater), which is completely illegal since the house has a septic tank and has never been connected to the A y A sewer system. In addition, the bill has been increasing disproportionately even though consumption has remained relatively the same over the years, and according to the latest bills it rose by almost 100%, to 70,000 colones, which is disproportionate. I contact them constantly and they do not give me a logical or reasonable explanation; what they do is make a small reduction, but the following month the bill comes in the same. I ask the justices to require A y A to refund me, with interest, all the money they have improperly charged me for wastewater, since my home is not connected to the A y A sewer system and my house has its own septic tank, which I pay to have cleaned periodically from 2010 to the date of this request” (sic).\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily reject, or reject on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is simply a reiteration or reproduction of an identical or similar earlier application that was rejected.\n\nJustice Castillo Víquez writes the opinion; and,\n\nReasons:\n\nI.- OBJECT OF THE AMPARO APPLICATION. The petitioner states that since 2010 he has lived in Residencial Bruno Martínez, located in Ipís de Guadalupe, and since that date he has been charged for sewerage (wastewater), which he considers illegal because he says the house has a septic tank and has never been connected to the A y A sewer system. He further alleges that the bill has increased disproportionately despite consumption remaining the same, and according to the latest bills it rose by almost 100%, to 70,000 colones, which he considers disproportionate. He says he contacts them constantly and they do not give him a logical or reasonable explanation; they only make a small reduction, but the following month the bill is the same.\n\nII.- SPECIFIC CASE. In light of the petitioner’s arguments, it should be noted that this Court has held that disputes over the amount charged on a bill for drinking water service are not heard in this forum. This is a matter of legality that must be raised before the same administrative authority and, potentially, in the ordinary courts. Among others, in Judgment N° 2018-017559, issued at 10:10 a.m. on 23 October 2018, the Court stated the following:\n\n“…The petitioner complains about the high charges on her water service bill. She says she is a single woman with limited means and has observed that the amount due on the water bill varies excessively, since the supply serves few people and the amount charged is unjustified. She explains that staff of the respondent administration have already come to inspect, but they have offered no solutions. However, this Chamber is not a legality-review body for the Administration’s actions or decisions. It is not within this Court’s jurisdiction to review, under the applicable law, whether there is a leak on the property or to determine the origin of the charge, or to establish the correct amount payable for the service received, since that is a matter for the ordinary administrative and judicial avenues. Accordingly, if the petitioner considers it appropriate, she may raise her objection or claim before the same respondent authority or before the competent judicial forum, where she may fully dispute the merits of the matter and assert her claims. Therefore, this application is inadmissible, and so it is declared…”\n\nThese considerations apply to the case under review, since this Court finds no reason to depart from the position set out in those judgments, nor any grounds to assess the situation presented differently. The application does not disclose an infringement of access to a public service, since the complaint concerns disagreement with the amount billed for drinking water service; in fact, the petitioner continues to receive that service at the property to which she refers. Accordingly, the protected party’s disagreement with the facts underlying this matter is an issue that, as stated, must be raised through the ordinary administrative or judicial avenues.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, or objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not retrieved within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session N° 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is summarily rejected.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
