  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-022187-0007-CO \n\nRes. Nº 2026032973\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .\n\nRecurso de amparo que se tramita en expediente número 26-022187-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra la MUNICIPALIDAD DE ASERRÍ.\n\nResultando:\n\n 1.- Por escrito presentado en la Secretaría de la Sala y, agregado al expediente a las 15:00 horas del 19 de junio de 2026, el recurrente interpone recurso de amparo contra la MUNICIPALIDAD DE ASERRÍ. Manifiesta, en resumen que, desde hace aproximadamente 28 años, ha recibido el servicio de\n\nagua potable en su propiedad mediante una conexión formal autorizada por el\n\nacueducto municipal. Señala que, en los últimos años, el suministro se brindaba de forma limitada, principalmente durante la noche y la madrugada, debido a condiciones operativas del sistema. Comenta que, pese a dichas limitaciones, lograba abastecer las necesidades básicas de su grupo familiar mediante el almacenamiento del agua. Agrega que, desde hace aproximadamente un mes y una semana, el servicio de agua potable se suspendió por completo, sin abastecimiento en ningún momento del día o de la noche. Añade que, ante esta situación, realizó gestiones ante la Municipalidad de Aserrí, la cual atribuyó el problema a una supuesta falla en la tubería interna de la propiedad. Señala que, dicha causa ha sido descartada, al verificarse mediante revisiones técnicas que no existen fugas ni obstrucciones en la instalación interna. Comenta que la tubería se encuentra en condiciones adecuadas para recibir el servicio, manteniéndose la ausencia total de agua. Agrega que, la municipalidad recurrida no ha aportado estudios técnicos concluyentes que acrediten que la interrupción sea atribuible al usuario. Acota que, la suspensión absoluta del suministro afecta gravemente la salud, la higiene, la alimentación y la calidad de vida del grupo familiar, incluyendo a una persona adulta mayor. Reclama que, dicha situación compromete derechos fundamentales como la vida, la salud, el acceso al agua potable y la dignidad humana. En virtud de lo expuesto, solicita se declare con lugar el presente recurso y se ordene a la Municipalidad recurrida adoptar de manera inmediata las medidas técnicas y administrativas necesarias para restablecer el suministro efectivo de agua potable a mi propiedad. Adiciona que, mientras se resuelve definitivamente la situación técnica, se ordene a la Municipalidad garantizar un suministro alternativo suficiente para cubrir las necesidades básicas del hogar, mediante cisternas, tanques u otros mecanismos idóneos.\n\n 2.- Por resolución de las 23:07 horas del 25 de junio de 2026, se dio curso al recurso y se solicitó informe al alcalde y al asistente de Servicios Municipales, ambos de la Municipalidad de Aserrí.\n\n 3.- Informa bajo juramento Patricia Porras Segura, en su condición de alcaldesa de la Municipalidad de Aserrí, que el recurrente es abonado del acueducto municipal por medio del hidrómetro número 82697. Explica que, han existido regulaciones horarias, las cuales obedecen a una afectación técnica generalizada y de fuerza mayor en el sector de Barrio Lourdes debido a la topografía extremadamente irregular y montañosa, sumada a la sequía extrema provocada por el Fenómeno de El Niño (con una reducción de caudales de las fuentes de hasta un 70%), por lo que el acueducto opera con un déficit de aproximadamente 70 litros de agua por segundo (demanda de CED01/s frente a una oferta de 30 l/s). Señala que, en virtud de lo anterior, se ejecutan cierres técnicos programados entre las 08:00 a.m. y las 12:30 p.m. para permitir el llenado de los tanques de almacenamiento y garantizar la distribución posterior. Acota que, es falso que la propiedad del recurrente haya permanecido sin agua durante más de un mes, según consta en el extracto oficial del Histórico de Lecturas de Medidor (Sistema IFAM Infinito) correspondiente al medidor N° 82697 del recurrente , la propiedad registró consumos efectivos y facturados de 12 m3 en mayo de 2026 (periodo 2026M05) y 10 m3 en junio de 2026 (periodo 2026 M06). Menciona que, el promedio de consumo en el trimestre crítico de sequía (mayo-julio 2026) ascendió a 13.66 m3 mensuales, cifra sumamente cercana y consistente con el consumo histórico del inmueble en el periodo de mayo a diciembre de 2025, el cual fue de 14.62 m3 mensuales. Expone que, lo anterior demuestra técnicamente que el agua sí ha estado ingresando y marcando en el medidor municipal de manera regular y continua. Afirma que, se ha brindado una atención oportuna, diligente y rigurosa al caso asignado bajo el reporte RAA-2026-02, siendo que funcionarios municipales, incluyendo al señor José Fuentes (encargado de captación), el señor Bryan Ramírez Chinchilla y el Coordinador de Servicios Municipales y Ambientales, Ing. Rolando Castro Steller, realizaron múltiples inspecciones de campo corroborando que: a) En la caja del medidor (ubicada a la entrada de la propiedad) existe un flujo activo y presión de agua adecuada y moderada, suficiente para abastecer una edificación de una planta a nivel de red pública. Y b) El problema real y determinante radica en la infraestructura y topografía interna del inmueble privado: la vivienda del recurrente se ubica a aproximadamente 100 metros de distancia desde la caja del medidor y presenta un desnivel vertical o diferencia de altura de aproximadamente 20 metro. Comenta que, debido a las regulaciones generales por la sequía, la presión hidráulica moderada que entrega la red en el medidor resulta insuficiente para vencer de forma natural la resistencia hidráulica provocada por una pendiente vertical de 20 metros a lo largo de 100 metros de tubería interna privada. Tan es así que el propio recurrente utiliza un vehículo tipo pick-up para transportar agua en un recipiente desde la entrada de su propiedad (donde está el medidor) subiendo la pendiente hacia su vivienda. Destaca que, no solo ha garantizado el flujo y marcado continuo en el medidor, sino que de manera coordinada se atiende la vulnerabilidad por la presencia de un adulto mayor mediante el suministro alternativo de agua con camiones cisterna contratados debidamente en la plataforma SICOP (contratación con la empresa Trasagua S.A.) de lunes a domingo, además de la asistencia con vehículos tipo pick-up municipales para los sectores de difícil acceso vial. Estima que, se ha cumplido con su deber legal y constitucional de entregar agua potable con presión y caudal en la acometida medidor del abonado; no obstante, el problema surge de los factores físicos y topográficos de la propiedad del recurrente, correspondiéndole a este velar y adecuar la red de distribución privada dentro de su inmueble. Expone que, se ha comprobado pericial y técnicamente por el Ing. Rolando Castro Steller que el medidor registra presión positiva en la entrada; no obstante, vencer un gradiente de 20 metros de altura a 100 metros de distancia requiere de sistemas internos de bombeo o almacenamiento que son responsabilidad exclusiva del propietario. Advierte que, pretender que la red municipal compense desniveles privados desproporcionados en medio de la sequía más severa desde 2018, desnaturaliza el servicio público y afecta la equidad en la distribución para el resto de la comunidad. Refiere que, la alteración en los horarios de suministro responde a un evento hidrometeorológico extremo de alcance nacional. Señala que, la Comisión Nacional de Emergencias (CNE) declaró Alerta Verde para el cantón de Aserrí debido a la consolidación del Fenómeno de El Niño siendo que las fuentes superficiales de las que se abastece el acueducto municipal (en un 95%) sufrieron un estiaje severo con una caída de caudales de hasta un 70%., por lo que frente a esta fuerza mayor, la actuación municipal ha sido técnica, razonable y ajustada al principio de solidaridad social. Relata que, respecto a las medidas de mitigación se entrega de agua mediante camiones cisterna (de lunes a domingo en jornadas de 11:00 a.m. a 3:00 p.m. y de 3:00 p.m. a 8:00 p.m.). Puntualiza que, en la visita efectuada el 13 de agosto de 2026, el Coordinador Ing. Rolando Castro Steller acordó directamente con el co-recurrente Nombre02 la implementación de medidas técnicas complementarias: • Regulación mediante un bypass en el tanque de almacenamiento que abastece la propiedad para asegurar un suministro continuo de al menos 2 horas diarias directamente a la vivienda. • Instalación de una tubería de respaldo para optimizar la presión en la entrada de la propiedad. • Refuerzo del suministro de agua mediante camión cisterna mientras se completan dichas obras. Solicita se declare sin lugar el recurso. \n\n 4.- En los procedimientos seguidos se han observado las prescripciones de ley.\n\n5.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta el Magistrado Salazar Alvarado; y,\n\n Considerando:\n\n I.- Objeto del recurso. El recurrente reclama la vulneración de sus derechos fundamentales a la salud, a la vida digna y al acceso al agua potable, pues afirma que, a pesar de contar con una conexión formal al acueducto administrado por la Municipalidad de Aserrí, el líquido dejó de llegar hasta su casa de habitación. Acusa que la autoridad recurrida atribuyó el problema a la instalación interna sin contar, según su criterio, con prueba técnica suficiente. Solicita que se restablezca el servicio y se garantice un abastecimiento alternativo mientras se resuelve definitivamente la situación. \n\n II.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial: \n\na) El recurrente es abonado del Acueducto Municipal de Aserrí mediante el hidrómetro número 82697, instalado en la entrada de su propiedad, ubicada en Barrio Lourdes de Aserrí (véanse el informe rendido bajo juramento y la documentación aportada). \n\nb) Durante el 2026, el sector de Barrio Lourdes ha experimentado variaciones en los horarios y en la presión del suministro de agua potable, asociadas con la topografía irregular y montañosa del lugar y con la reducción de los caudales ocasionada por la temporada de sequía y el fenómeno de El Niño. (véanse el informe rendido y el oficio número DGAA-169-2026-int). \n\nc) Debido a la disminución de los caudales, la Municipalidad estableció cierres técnicos programados entre las 8:00 y las 12:30 horas, con el propósito de permitir el llenado de los tanques de almacenamiento y efectuar posteriormente la distribución del agua (véase informe rendido). \n\nd) Según el Histórico de Lecturas correspondiente al hidrómetro número 82697, la propiedad del tutelad registró consumos de doce metros cúbicos en mayo y diez metros cúbicos en junio de 2026. Durante el trimestre comprendido entre mayo y julio de 2026 se registró un consumo promedio mensual de 13,66 metros cúbicos (véanse el informe y el histórico de lecturas). \n\ne) Durante mayo y junio de 2026, el recurrente y su hijo comunicaron a la Municipalidad de Aserrí que el agua no estaba llegando hasta la casa de habitación (véanse las comunicaciones electrónicas aportadas). \n\nf) La gestión interpuesta por el recurrente debido a la falta de agua fue tramitada por la Municipalidad bajo el reporte número RAA-2026-02 (véanse el informe rendido y las comunicaciones electrónicas aportadas). \n\ng) Los funcionarios municipales José Fuentes, encargado de captación; Bryan Ramírez Chinchilla y Rolando Castro Steller, coordinador de Servicios Municipales y Ambientales, realizaron varias inspecciones en la propiedad del recurrente (véanse el informe rendido, el oficio número DGAA-169-2026-int y la documentación adjunta). \n\nh) Durante las supra indicadas inspecciones se constató la existencia de flujo activo y presión positiva o moderada en la caja del medidor ubicada en la entrada de la propiedad (véanse el informe rendido, el oficio número DGAA-169-2026-int y las fotografías aportadas). \n\ni) La casa de habitación del recurrente se encuentra aproximadamente a cien metros de distancia de la caja del medidor y presenta una diferencia de altura cercana a veinte metros respecto de ese punto (véanse el informe técnico y la documentación fotográfica aportada). \n\nj) La presión disponible en el medidor no resulta suficiente para conducir naturalmente el agua hasta la vivienda, debido a la resistencia hidráulica generada por el recorrido y el desnivel de la tubería interna de la propiedad (véase oficio número DGAA-169-2026-int). \n\nk) Mediante correo electrónico del 12 de junio de 2026, la Municipalidad informó al hijo del recurrente que, luego de varias revisiones, había comprobado la existencia de agua en el punto donde se encuentra el medidor y que, en principio, la propiedad estaba siendo abastecida. Asimismo, le indicó que verificaría si existía alguna pérdida de presión en la red pública o dentro de la propiedad y le recomendó revisar la instalación interna para descartar fugas u otras deficiencias (véase correo electrónico citado). \n\nl) En las inspecciones realizadas no fue necesario efectuar mediciones de presiones porque se evidenció que en el medidor del recurrente existe buena presión, por lo que cumple con la presión mínima reglamentaria de 10.22 (ver oficio GGAA-169-2026). \n\nm) En la vivienda reside una persona adulta mayor, circunstancia que fue comunicada a la Municipalidad durante la atención del reporte número RAA-2026-02 (véanse las comunicaciones electrónicas y el informe rendido). \n\nn) La Municipalidad contrató el suministro alternativo de agua mediante camiones cisterna y ese servicio se presta de lunes a domingo, en jornadas comprendidas entre las 11:00 y las 15:00 horas y entre las 15:00 y las 20:00 horas. Además, se utilizan vehículos municipales tipo pick-up para abastecer los sectores de difícil acceso vial (véanse el informe, la documentación contractual y las fotografías aportadas). \n\no) La Comisión Nacional de Prevención de Riesgos y Atención de Emergencias declaró alerta verde para el cantón de Aserrí con ocasión de las condiciones asociadas al fenómeno de El Niño (véase documentación aportada). \n\np) El 13 de agosto de 2026, el ingeniero Rolando Castro Steller realizó una visita a la propiedad y coordinó con Nombre02 las siguientes medidas complementarias: i) la regulación de un bypass en el tanque de almacenamiento que abastece la propiedad, con el propósito de facilitar el suministro de agua durante al menos dos horas diarias; ii) la instalación de una tubería de respaldo para optimizar la presión en la entrada del inmueble; y iii) el reforzamiento del suministro mediante camión cisterna mientras se ejecutaban esas medidas (véanse el informe rendido y el oficio número DGAA-169-2026-int).\n\nIII.- Sobre el servicio de agua potable. De la relación de los artículos 21 y 50, de la Constitución Política, se desprende el derecho de las personas a la vida, la salud y a un medio ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la constitución, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. \n\nAsí las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública. En ese sentido, la protección y conservación a la que se hace referencia, debe ser brindada por el Estado a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (Sentencia N° 2007-005482, de las 14:39 horas del 24 de abril del 2007, reiterada en múltiples ocasiones, entre ellas la N° 2007-005482, de las 09:20 horas del 31 de enero de 2025).\n\nIV.- Sobre el fondo. En el sub lite, es menester tener presente que el derecho humano al agua es el derecho de todos a disponer de agua suficiente, salubre, aceptable, accesible y asequible para el uso personal y doméstico. \n\nDel examen integral de los autos y del elenco de hechos probados se desprende, en primer término que la Municipalidad de Aserrí no ha suspendido de forma absoluta y arbitraria el suministro de agua potable en la propiedad del recurrente, ya que las inspecciones realizadas por los funcionarios municipales determinaron que, el agua llegaba hasta la caja del medidor, ubicada en la entrada del inmueble, lo cual también resulta compatible con el histórico del hidrómetro, que registró consumos efectivos durante mayo, junio y julio de 2026. Además, se observó que contaba con buena presión y si bien el agua no llegaba directamente la casa de habitación del tutelado, de los informes técnicos aportados se constata que, esa situación estaba vinculada con las características de la red interna, pues la vivienda se localiza aproximadamente a cien metros del medidor y veinte metros por encima de ese punto, de modo que, según dichos análisis, la presión disponible no lograba superar el desnivel y la resistencia hidráulica generada dentro de la propiedad. Si bien el recurrente afirma que, el servicio presenta baja presión, no consta en autos alguna medición contradictoria ni otro elemento técnico que permita concluir que este se presta por debajo del umbral establecido. Nótese que, la determinación de eventuales pérdidas, obstrucciones o deficiencias en las instalaciones internas ubicadas después del sistema de medición requiere de una actividad probatoria técnica más amplia, propia de la vía de legalidad, salvo que de los autos se desprendiera una lesión manifiesta de derechos fundamentales, circunstancia que no se verifica en este asunto. Por ende, no corresponde a esta jurisdicción sustituir el criterio técnico objetivamente acreditado por una apreciación que carece de respaldo probatorio verificable. Así las cosas, de las pruebas aportadas al expediente se desprende que, el problema denunciado por el amparado no obedece a un cierre individual, una desconexión, una avería no atendida o una actuación discriminatoria de la Municipalidad.\n\nAdemás, en respuesta a la queja presentada por el tutelado por la falta de agua potable en su vivienda, mediante correo electrónico del 12 de junio de 2026, la autoridad recurrida informó al usuario sobre el resultado de las revisiones realizadas, le comunicó que existía agua en el punto de entrega y le explicó que, se verificaría si la pérdida de presión se originaba en la red municipal o en la instalación privada. Asimismo, le recomendó revisar las tuberías internas para descartar fugas, obstrucciones u otras deficiencias. Posteriormente, de las inspecciones realizadas, la recurrida estimó que no era necesario efectuar mediciones de presiones porque se evidenció que en el medidor del recurrente existe buena presión, por lo que cumple con la presión mínima reglamentaria. De manera que, en ese sentido, tampoco se observa que la Municipalidad hubiera permanecido inactiva o hubiera omitido atender las gestiones del interesado.\n\nEn relación con la prueba de presión que el hijo del recurrente afirma haber efectuado dentro de la propiedad no resulta suficiente para desvirtuar las conclusiones de los funcionarios municipales ni para demostrar, en esta vía sumaria, que la causa del problema se encuentra en la red pública. Resolver definitivamente esa discrepancia requeriría una pericia hidráulica y una valoración técnica de la instalación interna, lo cual excede la naturaleza del proceso de amparo y puede ser discutido ante las instancias administrativas, regulatorias o jurisdiccionales competentes.\n\nPor otra parte, las afectaciones en el suministro de agua potable y en la presión no se limitaron a la propiedad del recurrente. Al respecto, se acredita, que el déficit de agua que presenta la comunidad de Aserrí es producto de la disminución en el volumen de los tanques de agua derivado a la sequía producida por el Fenómeno de El Niño, a la topografía del cantón, y no relacionada con problemas en la infraestructura del acueducto. De manera, que las autoridades municipales se han visto obligadas a implementar medidas de regulación del consumo en múltiples sectores, con el fin de garantizar la continuidad del servicio. \n\nEn casos similares, la Sala ha estimado procedente adoptar determinadas medidas para distribuir lo obtenido, y así garantizar el suministro posible a los usuarios ya existentes, pues dicha situación no resulta imputable a la institución recurrida (ver en este sentido las Sentencias N° 2016-14465 de las 9:05 horas del 7 de octubre de 2016, N° 2014-9134 de las 14:05 horas del 19 de junio de 2014 y N° 2016-7240 de las 09:20 horas del 27 de mayo 2017, entre otras). \n\nAsí las cosas, la situación denunciada es provocada por inconvenientes de origen natural vinculados a la disponibilidad del recurso hídrico, y con la baja presión del caudal por la época seca, lo cual constituye circunstancias de fuerza mayor no atribuibles a la Corporación Municipal. Ante esta problemática, la Municipalidad recurrida ha tomado las acciones necesarias para minimizar la situación y garantizar el agua potable a todas las personas que habitan en la zona mediante de racionamiento o suspensiones del servicio, por algunas horas durante el día, y mediante el suministro de agua a través de camiones cisterna que hacen los recorridos por las zonas afectadas. En ese sentido, no se verifica que la vivienda del tutelado hubiera sido excluida arbitrariamente de ese mecanismo o que la Municipalidad se hubiera negado a suministrarle agua por medios alternativos.\n\nEn un caso similar al presente, en el que la recurrente alegó ser vecina de Aserrí, Barrio el Socorro, y que desde hacía varios días no le llegaba el servicio de agua potable a su casa, la Sala en la Sentencia N° 2026022360, de las 09:30 horas del 19 de junio de 2026, resolvió: \n\n “(…) De lo expuesto, se verifica que debido a los inconvenientes de origen natural, la Corporación Municipal ha tenido la obligación de aplicar racionamientos temporales del servicio de agua potable en la zona donde vive la usuaria siendo que la Sala ha avalado como medida, el racionamiento debido a la escasez del recurso hídrico, siempre que con ello, no se desatienda las necesidades básicas de la población, que sea de carácter temporal y por algunas horas, lo cual debe ser informado a los pobladores, y si es el caso, y enviar camiones cisternas. \n\nPor ende, no se constata lesión alguna a los derechos fundamentales del recurrente y lo procedente es declarar sin lugar el recurso”.\n\nV.- Conclusión. Corolario de lo expuesto, se desprende de los informes técnicos elaborados por la autoridad recurrida, que la dificultad para que el agua potable llegue desde el medidor del usuario hasta su vivienda se relaciona con la pérdida de presión provocada por el recorrido, el desnivel y las condiciones de la instalación situada dentro de la propiedad. Tales circunstancias no pueden imputarse, en los términos planteados, a una actuación arbitraria u omisiva de la Municipalidad recurrida. Todo lo anterior permite concluir que la autoridad accionada atendió las gestiones del usuario, mantuvo el suministro en el punto de conexión, explicó la causa técnica de la afectación y adoptó medidas alternativas para toda la comunidad ante la disminución extraordinaria de los caudales, por efectos naturales. \n\nPor consiguiente, no se acredita una vulneración de los derechos fundamentales invocados. Lo anterior es sin perjuicio del deber de la Municipalidad de continuar adoptando las medidas necesarias para mitigar las consecuencias de la sequía, brindar oportunamente el abastecimiento alternativo a las personas afectadas -en particular a los hogares donde residan personas adultas mayores- y ejecutar las medidas técnicas ofrecidas al recurrente, mientras persistan las condiciones extraordinarias que afectan el acueducto. Por las razones expuestas, procede declarar sin lugar el recurso.\n\n VI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. San José, at nine hours and forty minutes on 27 August 2026.\n\nAmparo proceeding filed under case number 26-022187-0007-CO by Nombre01, identity card CED02, against the MUNICIPALITY OF ASERRÍ.\n\nBackground:\n\n1.- In a written submission filed with the Chamber’s Registry and added to the case file at 15:00 on 19 June 2026, the applicant files an amparo application against the MUNICIPALITY OF ASERRÍ. In summary, the applicant states that for approximately 28 years, the applicant has received drinking-water service at the property through a formal connection authorized by the municipal water utility. The applicant notes that in recent years the supply was limited, mainly to nighttime and early morning, due to operating conditions in the system. Despite those limitations, the applicant says the basic needs of the household were met by storing water. The applicant adds that approximately one month and one week ago, drinking-water service was suspended completely, with no supply at any time, day or night. The applicant further states that, in response, the applicant contacted the Municipality of Aserrí, which attributed the problem to an alleged fault in the property’s internal piping. The applicant says that cause has been ruled out, as technical inspections found no leaks or blockages in the internal installation. The piping is in suitable condition to receive service, yet water remains entirely unavailable. The applicant adds that the respondent municipality has not provided conclusive technical studies establishing that the interruption is attributable to the user. The applicant notes that the complete suspension of supply seriously affects the health, hygiene, nutrition, and quality of life of the household, which includes an older adult. The applicant claims that this situation jeopardizes fundamental rights, including the rights to life, health, access to drinking water, and human dignity. On these grounds, the applicant asks that this amparo application be granted and that the respondent Municipality be ordered to take the technical and administrative measures necessary to immediately restore effective drinking-water service to the applicant’s property. The applicant further requests that, until the technical situation is finally resolved, the Municipality be ordered to ensure an alternative supply sufficient to meet the household’s basic needs, through water tankers, tanks, or other suitable means.\n\n2.- By decision issued at 23:07 on 25 June 2026, the amparo application was admitted for processing, and a report was requested from the mayor and the Municipal Services assistant, both of the Municipality of Aserrí.\n\n3.- Patricia Porras Segura, in her capacity as mayor of the Municipality of Aserrí, reports under oath that the applicant is a customer of the municipal water utility through water meter number 82697. She explains that time-based restrictions have been imposed because of a widespread technical impact and force majeure in the Barrio Lourdes sector, owing to its extremely irregular, mountainous topography and the extreme drought caused by the El Niño phenomenon, which reduced source flows by up to 70%. As a result, the water utility operates with a deficit of approximately 70 liters of water per second (demand of CED01/s compared with a supply of 30 l/s). She notes that, for this reason, scheduled technical shutoffs are carried out between 08:00 a.m. and 12:30 p.m. to allow storage tanks to fill and ensure subsequent distribution. She states that it is false that the applicant’s property has been without water for more than a month: according to the official Historical Meter Readings extract (IFAM Infinito System) for the applicant’s meter No. 82697, the property recorded actual billed consumption of 12 m3 in May 2026 (period 2026M05) and 10 m3 in June 2026 (period 2026 M06). She notes that average consumption during the critical drought quarter (May–July 2026) was 13.66 m3 per month, very close to and consistent with the property’s historical consumption from May to December 2025, which was 14.62 m3 per month. She explains that this technically demonstrates that water has been entering the property and registering regularly and continuously on the municipal meter. She states that the Municipality provided timely, diligent, and thorough attention to the matter recorded under report RAA-2026-02. Municipal employees, including José Fuentes, the person in charge of water intake; Bryan Ramírez Chinchilla; and the Coordinator of Municipal and Environmental Services, Engineer Rolando Castro Steller, conducted multiple field inspections and confirmed that: a) there is active flow and adequate, moderate water pressure in the meter box, located at the property entrance, sufficient to supply a one-story building at the public network level; and b) the actual and decisive problem lies in the infrastructure and topography within the private property: the applicant’s home is approximately 100 meters from the meter box and has a vertical elevation difference of approximately 20 meters. She comments that, because of the general restrictions imposed during the drought, the moderate hydraulic pressure delivered by the network at the meter is not enough to overcome the hydraulic resistance caused by a 20-meter vertical slope along 100 meters of private internal piping. Indeed, the applicant uses a pickup truck to carry water in a container from the entrance of the property, where the meter is located, up the slope to the home. She emphasizes that the Municipality has not only ensured continuous flow and meter readings, but has also coordinated an alternative water supply for the older adult in the household using water tankers duly contracted through the SICOP platform (contract with Trasagua S.A.) from Monday to Sunday, as well as municipal pickup trucks to serve areas with difficult road access. She considers that the Municipality has fulfilled its legal and constitutional duty to deliver drinking water at pressure and flow at the customer’s meter connection. However, the problem stems from the physical and topographic features of the applicant’s property, and it is the applicant’s responsibility to maintain and adapt the private distribution network within the property. She explains that Engineer Rolando Castro Steller has established through technical expert assessment that the meter registers positive pressure at the inlet. However, overcoming a 20-meter elevation gradient over a distance of 100 meters requires internal pumping or storage systems, which are the owner’s sole responsibility. She warns that requiring the municipal network to compensate for disproportionate elevation differences on private property during the most severe drought since 2018 would distort the public service and undermine equitable distribution to the rest of the community. She reports that the change in supply schedules is in response to an extreme hydrometeorological event affecting the country as a whole. She notes that the National Emergency Commission (CNE) declared a Green Alert for the canton of Aserrí due to the onset of the El Niño phenomenon, and that the surface sources supplying 95% of the municipal water utility’s water experienced severe low-water conditions, with flows falling by up to 70%. In response to this force majeure, the Municipality’s actions have been technical, reasonable, and consistent with the principle of social solidarity. She reports that mitigation measures include water deliveries by tanker trucks from Monday to Sunday, in shifts from 11:00 a.m. to 3:00 p.m. and from 3:00 p.m. to 8:00 p.m. She specifies that, during a visit on 13 August 2026, Coordinator Engineer Rolando Castro Steller agreed directly with co-applicant Nombre02 to implement additional technical measures: • Regulating a bypass in the storage tank supplying the property to ensure a continuous supply of at least 2 hours per day directly to the home. • Installing a backup pipe to improve pressure at the property entrance. • Reinforcing the water supply with a tanker truck while this work is completed. She asks that the amparo application be denied.\n\n4.- The legal requirements have been observed in these proceedings.\n\n5.- The legal requirements have been observed in these proceedings.\n\nJustice Salazar Alvarado drafts the decision; and,\n\nReasons:\n\nI.- Subject of the amparo application. The applicant claims that the fundamental rights to health, a dignified life, and access to drinking water have been violated, because, despite having a formal connection to the water utility administered by the Municipality of Aserrí, water has stopped reaching the applicant’s home. The applicant alleges that the respondent authority attributed the problem to the internal installation without, in the applicant’s view, sufficient technical evidence. The applicant asks that service be restored and that an alternative supply be ensured until the situation is finally resolved.\n\nII.- Facts found. The following facts, which are relevant to deciding this matter, are considered duly established, either because they have been proven or because the respondent did not address them as required by the initial order:\n\na) The applicant is a customer of the Aserrí Municipal Water Utility through water meter number 82697, installed at the entrance to the applicant’s property in Barrio Lourdes, Aserrí (see the report submitted under oath and the accompanying documents).\n\nb) During 2026, the Barrio Lourdes sector experienced variations in the hours and pressure of the drinking-water supply, associated with the area’s irregular, mountainous topography and the reduction in water flows caused by the drought season and the El Niño phenomenon (see the report submitted and official letter number DGAA-169-2026-int).\n\nc) Due to the reduction in water flows, the Municipality scheduled technical shutoffs between 8:00 and 12:30 to allow the storage tanks to fill and then distribute the water (see the report submitted).\n\nd) According to the Historical Readings for water meter number 82697, the property of the protected party recorded consumption of twelve cubic meters in May and ten cubic meters in June 2026. During the quarter from May to July 2026, average monthly consumption was 13,66 cubic meters (see the report and the historical readings).\n\ne) In May and June 2026, the applicant and the applicant’s son informed the Municipality of Aserrí that water was not reaching the home (see the electronic communications submitted).\n\nf) The Municipality processed the applicant’s complaint about the lack of water under report number RAA-2026-02 (see the report submitted and the electronic communications submitted).\n\ng) Municipal employees José Fuentes, person in charge of water intake; Bryan Ramírez Chinchilla; and Rolando Castro Steller, Coordinator of Municipal and Environmental Services, conducted several inspections at the applicant’s property (see the report submitted, official letter number DGAA-169-2026-int, and the attached documents).\n\nh) During the above inspections, active flow and positive or moderate pressure were confirmed in the meter box at the property entrance (see the report submitted, official letter number DGAA-169-2026-int, and the photographs submitted).\n\ni) The applicant’s home is approximately one hundred meters from the meter box and sits at an elevation approximately twenty meters above that point (see the technical report and the photographic documents submitted).\n\nj) The pressure available at the meter is not sufficient to carry water naturally to the home because of the hydraulic resistance created by the route and elevation difference of the internal piping on the property (see official letter number DGAA-169-2026-int).\n\nk) By email dated 12 June 2026, the Municipality informed the applicant’s son that, after several inspections, it had confirmed that water was present at the meter and that, in principle, the property was being supplied. It also told him it would check whether there was any loss of pressure in the public network or within the property, and recommended that he inspect the internal installation to rule out leaks or other deficiencies (see the cited email).\n\nl) During the inspections, pressure measurements were not necessary because good pressure was evident at the applicant’s meter, meeting the regulatory minimum pressure of 10.22 (see official letter GGAA-169-2026).\n\nm) An older adult resides in the home, a circumstance communicated to the Municipality while it handled report number RAA-2026-02 (see the electronic communications and the report submitted).\n\nn) The Municipality contracted for an alternative water supply using tanker trucks, and that service operates Monday to Sunday in shifts from 11:00 to 15:00 and from 15:00 to 20:00. Municipal pickup trucks are also used to supply areas with difficult road access (see the report, contract documents, and photographs submitted).\n\no) The National Commission for Risk Prevention and Emergency Response declared a Green Alert for the canton of Aserrí due to conditions associated with the El Niño phenomenon (see the documents submitted).\n\np) On 13 August 2026, Engineer Rolando Castro Steller visited the property and coordinated with Nombre02 the following additional measures: i) regulating a bypass in the storage tank supplying the property to facilitate water supply for at least two hours per day; ii) installing a backup pipe to improve pressure at the property entrance; and iii) reinforcing the supply by tanker truck while those measures were carried out (see the report submitted and official letter number DGAA-169-2026-int).\n\nIII.- Drinking-water service. Articles 21 and 50 of the Political Constitution establish people’s rights to life, health, and a healthy and ecologically balanced environment. These rights are closely linked, since life, as the Constitution’s supreme value, warrants special protection: without life, protecting the other fundamental rights would have little value.\n\nAccordingly, life must be protected in all its dimensions: physical, mental, and environmental. This is precisely why protecting the environment and natural resources is important, in order to promote people’s well-being. Among other things, that well-being is achieved by protecting and conserving the quality and quantity of water resources so that the water is suitable for human consumption and people’s health is protected. Because water is necessary for hygiene, food preparation, and drinking, its contamination can cause serious harm to public health. The State must provide the protection and conservation referred to here through the bodies it designates for that purpose. Those bodies must adopt the measures necessary to guarantee everyone access to this resource and oversee compliance with those measures. In this vein, the right to water arises, and this Constitutional Court may protect it through an amparo proceeding (Judgment No. 2007-005482, issued at 14:39 on 24 April 2007, reiterated on multiple occasions, including No. 2007-005482, issued at 09:20 on 31 January 2025).\n\nIV.- Merits. In this case, it must be borne in mind that the human right to water is everyone’s right to have sufficient, safe, acceptable, accessible, and affordable water for personal and domestic use.\n\nA comprehensive review of the case file and the established facts shows, first, that the Municipality of Aserrí did not arbitrarily suspend drinking-water supply to the applicant’s property in its entirety. Municipal employees’ inspections found that water reached the meter box at the property entrance, which is also consistent with the water meter’s historical readings, showing actual consumption in May, June, and July 2026. The water was also found to have good pressure. Although it did not reach the protected party’s home directly, the technical reports submitted confirm that the situation was connected to the features of the internal network: the home is approximately one hundred meters from the meter and twenty meters above it. According to those analyses, the available pressure could not overcome the elevation difference and hydraulic resistance within the property. Although the applicant says that the service has low pressure, the case file contains no conflicting measurement or other technical evidence that would support a finding that service is being provided below the applicable threshold. Determining whether there are leaks, blockages, or deficiencies in internal installations downstream of the metering system requires broader technical evidence, which belongs in the ordinary legality process, unless the case file shows a manifest violation of fundamental rights. No such violation is present here. Accordingly, this jurisdiction should not replace an objectively substantiated technical assessment with an opinion unsupported by verifiable evidence. The evidence in the case file therefore shows that the problem reported by the amparo applicant is not due to an individual shutoff, disconnection, unaddressed breakdown, or discriminatory action by the Municipality.\n\nIn addition, in response to the protected party’s complaint about the lack of drinking water at the home, the respondent authority informed the user by email dated 12 June 2026 of the outcome of its inspections. It told the user there was water at the delivery point and explained that it would check whether the pressure loss originated in the municipal network or the private installation. It also recommended inspecting the internal pipes to rule out leaks, blockages, or other deficiencies. After the inspections, the respondent determined that pressure measurements were unnecessary because good pressure was evident at the applicant’s meter, meeting the regulatory minimum pressure. Accordingly, the Municipality cannot be said to have remained inactive or failed to address the interested party’s requests.\n\nThe pressure test that the applicant’s son says he performed within the property is not sufficient to rebut the municipal employees’ conclusions or to show in this summary proceeding that the problem originated in the public network. Resolving that dispute definitively would require a hydraulic expert assessment and a technical evaluation of the internal installation, which exceed the scope of an amparo proceeding and may be raised before the competent administrative, regulatory, or judicial bodies.\n\nMoreover, the effects on water supply and pressure were not limited to the applicant’s property. The evidence shows that the community of Aserrí’s water deficit results from reduced water levels in the tanks due to the drought caused by the El Niño phenomenon and the canton’s topography, and is not related to problems with the water utility’s infrastructure. The municipal authorities have therefore had to introduce consumption restrictions in multiple sectors to ensure continuity of service.\n\nIn similar cases, the Chamber has considered it appropriate to adopt specific measures to distribute the available water and thus ensure the supply that can be provided to existing users, since the situation is not attributable to the respondent institution (see, in this regard, Judgments No. 2016-14465, issued at 9:05 on 7 October 2016; No. 2014-9134, issued at 14:05 on 19 June 2014; and No. 2016-7240, issued at 09:20 on 27 May 2017, among others).\n\nAccordingly, the reported situation is caused by naturally occurring problems related to the availability of water resources and the low pressure of the flow during the dry season. These are force majeure circumstances not attributable to the Municipal Corporation. In response, the respondent Municipality has taken the necessary steps to minimize the problem and ensure drinking water for all those living in the area by rationing or suspending service for a few hours during the day and supplying water by tanker trucks that travel through affected areas. In this regard, there is no evidence that the protected party’s home was arbitrarily excluded from that arrangement or that the Municipality refused to supply water by alternative means.\n\nIn a case similar to this one, in which the applicant alleged that she lived in Aserrí, Barrio el Socorro, and that drinking-water service had not reached her home for several days, the Chamber ruled as follows in Judgment No. 2026022360, issued at 09:30 on 19 June 2026:\n\n“(…) From the foregoing, it is clear that, due to naturally occurring problems, the Municipal Corporation was required to impose temporary rationing of drinking-water service in the area where the user lives. The Chamber has approved rationing as a measure in response to shortages of water resources, provided that basic needs of the population are met, the rationing is temporary and lasts only a few hours, the residents are informed, and, where appropriate, tanker trucks are sent.\n\nAccordingly, no violation of the applicant’s fundamental rights has been established, and the amparo application should be denied.”\n\nV.- Conclusion. In light of the foregoing, the technical reports prepared by the respondent authority show that the difficulty in getting drinking water from the user’s meter to the home is related to the loss of pressure caused by the route, the elevation difference, and the conditions of the installation within the property. As presented, those circumstances cannot be attributed to arbitrary action or omission by the respondent Municipality. All of the foregoing supports the conclusion that the respondent authority addressed the user’s requests, maintained the supply at the connection point, explained the technical cause of the problem, and adopted alternative measures for the entire community in response to the extraordinary decline in water flows caused by natural conditions.\n\nConsequently, no violation of the fundamental rights invoked has been established. This does not affect the Municipality’s duty to continue taking the measures necessary to mitigate the effects of the drought, provide timely alternative supply to affected people—particularly households where older adults reside—and carry out the technical measures offered to the applicant while the extraordinary conditions affecting the water utility persist. For the reasons stated, the amparo application should be denied.\n\nVI.- DOCUMENTS SUBMITTED TO THE CASE FILE. The parties are advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, must be collected from the office within a maximum of thirty working days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at Session No. 43-12, held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is denied.-\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
