  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-024687-0007-CO \n\nRes. Nº 2026033015\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-024687-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE PÉREZ ZELEDÓN.\n\nResultando:\n\n1.- Por escrito recibido en la Secretaría de la Sala el 9 de julio de 2026, la recurrente interpone recurso de amparo. Manifiesta que, el 16 de abril de 2026, la municipalidad de Pérez Zeledón realizó trabajos con maquinaria pesada en un terreno municipal que colinda con la parte trasera de su casa. Asegura que, para ingresar al terreno, cortaron la malla del parque de juegos de niños. Comenta que, en esos trabajos se removieron tierras para nivelar el terreno. Acusa que las acciones de la municipalidad provocaron el debilitamiento y daño estructural de su tapia trasera. Sostiene que se descubrió la base de la tapia, dejando expuesta la estructura. Indica que el terreno quedó inestable, provocando desmoronamientos y se generó un acceso por debajo de la tapia que permitió la salida de sus perros. Alega que se talaron árboles que fueron arrojados a la quebrada, se sembraron llantas en zona de protección y se habilitó el acceso de niños hasta el fondo de la quebrada y el cañal, pese a que en época de lluvias el cuerpo de agua crece mucho y hay serpientes. Menciona que el 20 de abril de 2026 planteó una gestión por escrito ante la autoridad recurrida, según consta en el oficio OFI-020-26-CDS. Indica que no se había solucionado el problema. \n\n2.- Mediante resolución de la Presidencia de la Sala de 18:52 horas del 17 de julio de 2026, se le previno a la recurrente aclarar: “Si ha planteado de manera formal y por escrito la gestión correspondiente a efecto de denunciar ante la autoridad accionada la situación que expone en el memorial de interposición de este recurso; • De ser afirmativa su respuesta, deberá aportar copia completa, legible y con el respectivo comprobante de recibido o de remisión de correo electrónico de la denuncia que formuló; • De haber recibido alguna resolución, deberá indicar claramente cuál fue el resultado obtenido y aportar la documentación generada con ocasión de tales diligencias; • Si dicha denuncia se encuentran pendiente de resolución a la fecha de interposición de este recurso, también deberá indicarlo expresamente a esta Sala; • Igualmente si no ha planteado por escrito y de manera formal su denuncia, así deberá aclararlo”.\n\n3.- Por escrito recibido en la Secretaría de la Sala el 22 de julio de 2026, la recurrente expone que, posteriormente, ante la ausencia de respuesta, reiteró su solicitud mediante escrito dirigido al alcalde. Narra que, con posterioridad a la interposición de este amparo, la accionada emitió respuesta mediante dos oficios de 14 de julio de 2026. Apunta que, según el oficio OFI-117-26-SSM, se realizó inspección y a criterio de la administración no existe afectación a su propiedad ni problema con los linderos, y que los trabajos en la propiedad municipal fueron paralizados. Agrega que, mediante oficio OFI-020-26-CDS, suscrito por el contralor de servicios, se archivó su gestión con fundamento en el oficio OFI-117-26-SSM. Destaca que el resultado obtenido no se ajusta a la realidad material verificable en el sitio. Manifiesta que si bien la municipalidad afirma en el oficio OFI-117-26-SSM que no existe afectación a su propiedad, dicha conclusión resulta contradictoria con el estado físico actual de la tapia trasera, la cual se encuentra falseada y estructuralmente debilitada como consecuencia directa de los movimientos de tierra ejecutados en el terreno municipal colindante. Resalta que subsiste la exposición de los cimientos de la tapia, la inestabilidad del terreno con desprendimientos, el acceso abierto por debajo de la tapia hacia la quebrada, y la ausencia de cerramiento del área municipal, por lo que se mantiene vigente el riesgo para ella y para terceros, incluidos menores de edad. Acusa que la respuesta administrativa se limita a descartar formalmente la afectación, sin haber adoptado medida material alguna que repare el daño ni que elimine la situación de peligro.\n\n4.- Mediante resolución de la Presidencia de la Sala de las 17:25 horas del 10 de agosto de 2026 se dio curso al amparo.\n\n5.- Informan Emmanuel Ceciliano Alfaro y Erick Ovidio Fallas Montero, cada uno en su condición de alcalde y contralor de Servicios, ambos de la Municipalidad de Pérez Zeledón. Exponen: “I. EXCEPCIÓN DE INCOMPETENCIA POR RAZÓN DE LA MATERIA (ASUNTO DE LEGALIDAD ORDINARIA Y RECLAMO PATRIMONIAL). Los reclamos de la recurrente giran en torno a supuestos 'daños a su propiedad' y una aparente disconformidad técnica. Al respecto, la línea jurisprudencial de la Sala, la cual ha determinado que la fijación, valoración y resarcimiento de daños materiales en propiedad privada es un asunto de legalidad ordinaria que carece de relevancia constitucional. La determinación de tales extremos requiere de una etapa probatoria amplia (peritajes, inspecciones oculares judiciales) que resulta ajena a la naturaleza sumarísima del recurso de amparo, debiendo acudir el administrado a la vía contencioso-administrativa o civil, según corresponda. Asimismo, las menciones al derecho a la vida y al medio ambiente sano resultan accesorias y carentes de sustento fáctico en el expediente, utilizándose únicamente con el fin de forzar la jurisdicción de este Tribunal Constitucional. II. SOBRE LOS ESCRITOS PRESENTADOS POR LA PARTE RECURRENTE Y LAS ACTUACIONES TÉCNICAS Y ADMINISTRATIVAS ACREDITADAS EN AUTOS Se procede a rechazar de forma categórica lo expuesto por la aquí recurrente en cuanto a que, por parte de esta Municipalidad se ha vulnerado el derecho de petición y omisión de respuesta, lo anterior en virtud que, la misma recurrente es quien aporta escritos copias y oficios de las gestiones presentadas ante esta Municipalidad debidamente diligenciadas. La señora Nombre01, el día 20 de abril de 2026, se presenta personalmente a la oficina de la Contraloría de Servicios, solicitando atención por un movimiento de tierra en un terreno municipal, gestión identificada con el No. SOL-0006-26-CDS, sin el permiso correspondiente, ubicado 1,5 km al sureste del Salón el Yugo en Peñas Blancas, del Distrito de General folio real N° 554056. Dicha gestión fue tramitada como una queja, siendo que por tratarse de un asunto que no corresponde a funciones y/o atribuciones propias de esta dependencia, se trasladó al Sub-Proceso de Servicios Municipal conforme lo establece el artículo 38, del decreto ejecutivo Nº 39096-PLAN, Reglamento a la ley Reguladora del Sistema Nacional de Contraloría de Servicios, mediante documento OFI-012-26-CDS en fecha 24 de abril de 2026. Posteriormente en fecha 14 de julio de 2026, como parte del seguimiento solicitado, se nos remitió copia por medio de correo electrónico del documento OFI-117-26-SSM, emitido por la coordinadora del Subproceso de Servicios Municipales dirigido a la señora Nombre01, donde se le informa los resultados del análisis de su solicitud. Una vez analizados los documentos referidos anteriormente, y por tratarse de un procedimiento competencia del Subproceso de Servicios Municipales, y una vez comunicado a la señora Nombre01 por parte de la oficina responsable, se procedió al cierre de la gestión ante esta Contraloría de Servicios mediante documento OFI-020-26-CDS, en fecha 14 de julio de 2026. Siguiendo en el mismo orden de ideas, nuevamente mediante oficio número OFI-117-26- SMS suscrito por la Coordinadora de Servicios Municipales, del 14 de julio de 2026 se le da respuesta a la señora Nombre01, en donde se indicó que, se realizaron las inspecciones técnicas realizadas por la Municipalidad, donde se determina que no existe afectación a su propiedad, no existen problemas con los linderos de su propiedad. En consecuencia, los escritos presentados por la recurrente no logran desvirtuar los informes técnicos oficiales ni las actuaciones administrativas acreditadas en autos, limitándose a expresar desacuerdos personales con los criterios emitidos por la Admini stración. Por lo tanto, de la prueba incorporada al expediente se desprende que la Municipalidad de Pérez Zeledón ha venido atendiendo la situación planteada mediante actuaciones concretas, progresivas, planificadas y técnicamente fundamentadas”.\n\n6.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta la Magistrada Hess Herrera; y,\n\nConsiderando:\n\n I.- CUESTIÓN PREVIA. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite se plantea un supuesto de excepción, pues se está ante la supuesta dilación en resolver una denuncia relativa a una obra realizada por la municipalidad acciona que podría poner en peligro la integridad de la recurrente. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.\n\nII.- OBJETO DEL RECURSO. La parte recurrente reclama que, el 16 de abril de 2026, la municipalidad de Pérez Zeledón realizó trabajos con maquinaria pesada en un terreno municipal que colinda con la parte trasera de su casa. Asegura que, para ingresar al terreno, cortaron la malla del parque de juegos de niños. Comenta que, en esos trabajos se removieron tierras para nivelar el terreno. Acusa que las acciones de la municipalidad provocaron el debilitamiento y daño estructural de su tapia trasera. Sostiene que se descubrió la base de la tapia, dejando expuesta la estructura. Indica que el terreno quedó inestable, provocando desmoronamientos y se generó un acceso por debajo de la tapia que permitió la salida de sus perros. Alega que se talaron árboles que fueron arrojados a la quebrada, se sembraron llantas en zona de protección y se habilitó el acceso de niños hasta el fondo de la quebrada y el cañal, pese a que en época de lluvias el cuerpo de agua crece mucho y hay serpientes. Menciona que el 20 de abril de 2026 planteó una gestión por escrito ante la autoridad recurrida, según consta en el oficio OFI-020-26-CDS. Explica que, posteriormente, ante la ausencia de respuesta, reiteró su solicitud mediante escrito dirigido al alcalde. Indica que no se había solucionado el problema.\n\nIII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: \n\na) El 20 de abril de 2026, la accionante planteó una gestión ante la Municipalidad de Pérez Zeledón, a la que se le asignó el nro. SOL-0006-26-CDS. En tal denuncia únicamente se indicó: “Movimiento de tierra en terreno Municipal por parte de un vecino, según indica el señor tiene los permisos requeridos”. (Ver prueba aportada).\n\nb) Por oficio OFI-117-26-SSM del 14 de julio de 2026, dirigido a la recurrente, la coordinadora de Servicios Municipales consignó: “Sírvase la presente para saludarle y a la vez brindar respuesta a su solicitud donde indica que existe un terreno municipal donde se están realizando movimientos de tierra y esto está afectando su propiedad. De lo anterior le indico que se realizó la inspección correspondiente y se determina que no hay afectación a su propiedad. Además, el ingeniero topógrafo indicó que no hay problemas con los linderos de su propiedad. Por otro lado, le indicamos que los trabajos realizados a la propiedad municipal fueron paralizados”. (Ver prueba aportada).\n\nc) Por oficio OFI-020-26-CDS del 14 de julio de 2026, dirigido a la tutelada, el contralor de Servicios de la municipalidad aclaró: “Reciba un cordial saludo, deseándole el mayor de los éxitos en sus labores diarias, a la vez aprovecho la oportunidad para hacer de su conocimiento que de acuerdo con su gestión presentada el día 20 de abril de 2026, sobre la afectación de su propiedad por los trabajos realizados en la propiedad municipal. De ello y con relación al informe emitido por la señora Lorena Núñez Blanco en su condición de coordinadora Servicios Municipales, mediante los documentos OFI-065-26-SSM y OFI-117-26- SSM, indica que no existe afectación a su propiedad, es por esto que se procede al archivo de su gestión. Agradecemos su gestión presentada, ya que con ello contribuye al mejoramiento continuo de la gestión de la institución”. (Ver prueba aportada).\n\nd) Por escrito recibido en la Municipalidad de Pérez Zeledón el 15 de julio de 2026, la accionante expuso: “En fecha 16 de abril de 2026, en el terreno municipal colindante a mi propiedad, se realizaron trabajos con maquinaria pesada, los cuales provocaron afectaciones directas a mi propiedad, específicamente el debilitamiento y daño estructural de la tapia trasera, así como la exposición de sus cimientos, inestabilidad del terreno y la generación de un acceso por debajo de la misma. Asimismo, dichas intervenciones incluyeron la remoción de la malla del área destinada a play, dejando el terreno completamente abierto, sin ningún tipo de cerramiento ni medidas de seguridad, a pesar de la presencia de una quebrada en el sitio. Como consecuencia directa, se generó un hueco por el cual se salieron mis animales (perros), los cuales son de carácter agresivo, lo que incrementa considerablemente el riesgo, ya que cualquier persona, especialmente menores de edad que ingresen al área, podría resultar gravemente afectada. Esto configura un peligro inminente, tanto por la exposición de la quebrada como por la falta de control de acceso, situación que debió ser prevenida por la Municipalidad. Adicionalmente, es importante señalar que dichas intervenciones se realizaron sin contar con viabilidad ambiental, autorización del MINAE, ni medidas de mitigación de daños a terceros, lo cual agrava la situación y evidencia una actuación irregular. Cabe resaltar que, en todo momento, el particular que Ingreso con maquinaria manifestó contar con permisos municipales para realizar dichas labores. Sin embargo, los resultados de estas intervenciones; daños a mi propiedad, eliminación de cerramientos y generación de riesgo, ponen en duda la legalidad, alcance y adecuada supervisión de dichos permisos, en caso de haber existido. Con base en estos hechos, procedí a presentar una gestión formal ante la Municipalidad, solicitando inspección, delimitación de linderos, reparación de daños y medidas de seguridad. No obstante, a la fecha no he recibido respuesta alguna, ni por parte de la Alcaldía, ni de la Contraloría de Servicios, ni de ninguna dependencia municipal, manteniéndose el problema sin solución y el riesgo vigente”. (Ver prueba aportada).\n\ne) El 17 de agosto de 2026, las autoridades recurridas fueron notificadas de la resolución de rectificación del curso. (Ver actas de notificación).\n\nIV.- SOBRE EL CASO CONCRETO. En el sub lite, la parte recurrente reclama que, el 16 de abril de 2026, la municipalidad de Pérez Zeledón realizó trabajos con maquinaria pesada en un terreno municipal que colinda con la parte trasera de su casa. Asegura que, para ingresar al terreno, cortaron la malla del parque de juegos de niños. Comenta que, en esos trabajos se removieron tierras para nivelar el terreno. Acusa que las acciones de la municipalidad provocaron el debilitamiento y daño estructural de su tapia trasera. Sostiene que se descubrió la base de la tapia, dejando expuesta la estructura. Indica que el terreno quedó inestable, provocando desmoronamientos y se generó un acceso por debajo de la tapia que permitió la salida de sus perros. Indica que no se había solucionado el problema.\n\nDe los autos se desprende que, el 20 de abril de 2026, la accionante planteó una gestión ante la Municipalidad de Pérez Zeledón, a la que se le asignó el nro. SOL-0006-26-CDS. En tal denuncia únicamente se indicó: “Movimiento de tierra en terreno Municipal por parte de un vecino, según indica el señor tiene los permisos requeridos”. \n\nAsí, por oficio OFI-117-26-SSM del 14 de julio de 2026, dirigido a la recurrente, la coordinadora de Servicios Municipales consignó: “Sírvase la presente para saludarle y a la vez brindar respuesta a su solicitud donde indica que existe un terreno municipal donde se están realizando movimientos de tierra y esto está afectando su propiedad. De lo anterior le indico que se realizó la inspección correspondiente y se determina que no hay afectación a su propiedad. Además, el ingeniero topógrafo indicó que no hay problemas con los linderos de su propiedad. Por otro lado, le indicamos que los trabajos realizados a la propiedad municipal fueron paralizados”. \n\nAdemás, por oficio OFI-020-26-CDS del 14 de julio de 2026, dirigido a la tutelada, el contralor de Servicios de la municipalidad aclaró: “Reciba un cordial saludo, deseándole el mayor de los éxitos en sus labores diarias, a la vez aprovecho la oportunidad para hacer de su conocimiento que de acuerdo con su gestión presentada el día 20 de abril de 2026, sobre la afectación de su propiedad por los trabajos realizados en la propiedad municipal. De ello y con relación al informe emitido por la señora Lorena Núñez Blanco en su condición de coordinadora Servicios Municipales, mediante los documentos OFI-065-26-SSM y OFI-117-26- SSM, indica que no existe afectación a su propiedad, es por esto que se procede al archivo de su gestión. Agradecemos su gestión presentada, ya que con ello contribuye al mejoramiento continuo de la gestión de la institución”. \n\nOtrora, se constata que, por escrito recibido en la Municipalidad de Pérez Zeledón el 15 de julio de 2026, la accionante expuso: “En fecha 16 de abril de 2026, en el terreno municipal colindante a mi propiedad, se realizaron trabajos con maquinaria pesada, los cuales provocaron afectaciones directas a mi propiedad, específicamente el debilitamiento y daño estructural de la tapia trasera, así como la exposición de sus cimientos, inestabilidad del terreno y la generación de un acceso por debajo de la misma. Asimismo, dichas intervenciones incluyeron la remoción de la malla del área destinada a play, dejando el terreno completamente abierto, sin ningún tipo de cerramiento ni medidas de seguridad, a pesar de la presencia de una quebrada en el sitio. Como consecuencia directa, se generó un hueco por el cual se salieron mis animales (perros), los cuales son de carácter agresivo, lo que incrementa considerablemente el riesgo, ya que cualquier persona, especialmente menores de edad que ingresen al área, podría resultar gravemente afectada. Esto configura un peligro inminente, tanto por la exposición de la quebrada como por la falta de control de acceso, situación que debió ser prevenida por la Municipalidad. Adicionalmente, es importante señalar que dichas intervenciones se realizaron sin contar con viabilidad ambiental, autorización del MINAE, ni medidas de mitigación de daños a terceros, lo cual agrava la situación y evidencia una actuación irregular. Cabe resaltar que, en todo momento, el particular que Ingreso con maquinaria manifestó contar con permisos municipales para realizar dichas labores. Sin embargo, los resultados de estas intervenciones; daños a mi propiedad, eliminación de cerramientos y generación de riesgo, ponen en duda la legalidad, alcance y adecuada supervisión de dichos permisos, en caso de haber existido. Con base en estos hechos, procedí a presentar una gestión formal ante la Municipalidad, solicitando inspección, delimitación de linderos, reparación de daños y medidas de seguridad. No obstante, a la fecha no he recibido respuesta alguna, ni por parte de la Alcaldía, ni de la Contraloría de Servicios, ni de ninguna dependencia municipal, manteniéndose el problema sin solución y el riesgo vigente”. \n\nFinalmente, se constata que, el 17 de agosto de 2026, las autoridades recurridas fueron notificadas de la resolución de rectificación del curso.\n\nAsí las cosas, lo correspondiente es declarar sin lugar el recurso. En este sentido, nótese que la gestión del 20 de abril de 2026 fue resuelta mediante los oficios OFI-117-26-SSM y OFI-020-26-CDS, ambos del 14 de julio de 2026, sea, con sobrada antelación a que los accionados fueran notificados de la resolución de curso de este amparo y, por ende, sin que mediara la intervención de la Sala.\n\nDe igual forma, se advierte a la accionante que cualquier disconformidad con la respuesta obtenida o la conclusión a la que llegó la municipalidad, es un extremo de mera legalidad, ajeno a la competencia de este Tribunal. Por ende, si a bien lo tiene, la accionante podrá plantear sus reclamos en la vía administrativa o jurisdiccional ordinaria que estime pertinente. \n\nPor último, esta Sala omite pronunciarse respecto a la gestión del 15 de julio de 2026, en primer lugar porque excede el objeto de este recurso y, en segundo lugar, porque fue planteada por la accionante ante la corporación con posterioridad a la interposición de este recurso (9 de julio de 2026).\n\nV.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008- 02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\nVI.- NOTA DEL MAGISTRADO SALAZAR ALVARADO. En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, donde se alega que el 16 de abril de 2026, la Municipalidad de Pérez Zeledón realizó trabajos con maquinaria pesada en un terreno municipal que colinda con la parte trasera de su casa, lo cuales generaron daños importantes tanto al parque de juegos de niños, como a su propiedad, poniendo en riesgo sus derechos así como los de las personas y menores de edad que acuden a dicho lugar.\n\nVII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012. \n\nPor tanto:\n\n \n\nSe declara sin lugar el recurso. San José, at 9:40 a.m. on 27 August 2026.\n\nAmparo proceeding filed under case number 26-024687-0007-CO, brought by Nombre01, identity card CED01, against the MUNICIPALITY OF PÉREZ ZELEDÓN.\n\nBackground:\n\n1.- In a brief received by the Chamber Secretariat on 9 July 2026, the applicant files an amparo application. She states that, on 16 April 2026, the Municipality of Pérez Zeledón carried out work with heavy machinery on municipal land adjoining the back of her house. She asserts that, to access the land, they cut the fence around the children’s playground. She comments that the work involved moving earth to level the land. She alleges that the Municipality’s actions weakened and structurally damaged the wall at the back of her property. She maintains that the base of the wall was exposed, leaving the structure uncovered. She indicates that the land was left unstable, causing collapses, and that an opening was created beneath the wall through which her dogs escaped. She alleges that trees were cut down and thrown into the ravine, tires were planted in a protection zone, and children were given access to the bottom of the ravine and the sugarcane field, despite the fact that the watercourse rises substantially during the rainy season and there are snakes. She mentions that on 20 April 2026 she submitted a written request to the respondent authority, as recorded in official letter OFI-020-26-CDS. She indicates that the problem had not been resolved.\n\n2.- By order of the Chamber President at 18:52 on 17 July 2026, the applicant was asked to clarify: “Whether she formally submitted the corresponding request in writing in order to report the situation described in the brief initiating this proceeding to the respondent authority; • If her answer is yes, she must provide a complete, legible copy of the report she filed, together with the corresponding proof of receipt or email transmission; • If she received any decision, she must clearly state the outcome and provide the documentation generated in connection with those proceedings; • If, as of the date this proceeding was filed, that report is still pending a decision, she must also expressly inform this Chamber; • Likewise, if she did not formally submit her report in writing, she must clarify that.”\n\n3.- In a brief received by the Chamber Secretariat on 22 July 2026, the applicant explains that, subsequently, in the absence of a response, she reiterated her request in a written submission addressed to the mayor. She recounts that, after this amparo was filed, the respondent issued a response in two official letters dated 14 July 2026. She notes that, according to official letter OFI-117-26-SSM, an inspection was carried out and, in the administration’s view, there was no impact on her property or boundary issue, and work on the municipal property had been halted. She adds that, by official letter OFI-020-26-CDS, signed by the services comptroller, her request was closed on the basis of official letter OFI-117-26-SSM. She emphasizes that the outcome does not match the verifiable physical reality at the site. She states that, although the Municipality asserts in official letter OFI-117-26-SSM that her property has not been affected, this conclusion contradicts the current physical condition of the wall at the back of her property, which has shifted and been structurally weakened as a direct consequence of the earthworks carried out on the adjoining municipal land. She highlights that the wall’s foundations remain exposed, the land remains unstable with material breaking away, an opening remains beneath the wall leading to the ravine, and the municipal area remains unfenced; therefore, the risk to her and to third parties, including minors, continues. She alleges that the administrative response merely formally dismisses the impact, without adopting any actual measure to repair the damage or eliminate the hazardous situation.\n\n4.- By order of the Chamber President at 17:25 on 10 August 2026, the amparo was admitted for processing.\n\n5.- Emmanuel Ceciliano Alfaro and Erick Ovidio Fallas Montero report, each in his capacity as mayor and Services Comptroller, respectively, both of the Municipality of Pérez Zeledón. They state: “I. OBJECTION OF LACK OF JURISDICTION BY SUBJECT MATTER (ORDINARY LEGALITY MATTER AND CLAIM FOR COMPENSATION). The applicant’s claims concern alleged ‘damage to her property’ and an apparent technical disagreement. In this regard, the Chamber’s line of case law has determined that the assessment and compensation of material damage to private property is a matter of ordinary legality that lacks constitutional relevance. Determining these matters requires extensive evidentiary proceedings (expert reports, judicial site inspections), which are incompatible with the summary nature of amparo proceedings; the party concerned must pursue the administrative-litigation or civil avenue, as applicable. Likewise, references to the right to life and to a healthy environment are incidental and unsupported by the facts in the case file, and are used solely to force this Constitutional Court’s jurisdiction. II. ON THE SUBMISSIONS FILED BY THE APPLICANT AND THE TECHNICAL AND ADMINISTRATIVE ACTIONS ESTABLISHED IN THE RECORD The applicant’s assertion that this Municipality violated the right of petition and failed to respond is categorically rejected, since the applicant herself provides copies of submissions and official letters concerning requests filed with this Municipality and duly processed. On 20 April 2026, Ms. Nombre01 personally appeared at the Services Comptroller’s office, requesting attention concerning earthworks on municipal land without the corresponding permit, located 1.5 km southeast of Salón el Yugo in Peñas Blancas, General District, folio real No. 554056. That request was processed as a complaint. Because the matter did not fall within this office’s functions and/or powers, it was transferred to the Municipal Services Subprocess pursuant to Article 38 of Decreto Ejecutivo Nº 39096-PLAN, Regulations to the Law Regulating the National System of Services Comptrollers, by document OFI-012-26-CDS dated 24 April 2026. Subsequently, on 14 July 2026, as part of the requested follow-up, we received by email a copy of document OFI-117-26-SSM, issued by the coordinator of the Municipal Services Subprocess and addressed to Ms. Nombre01, informing her of the results of the analysis of her request. After reviewing the documents referred to above, and because the matter fell within the competence of the Municipal Services Subprocess, and once the responsible office had notified Ms. Nombre01, her request before this Services Comptroller’s office was closed by document OFI-020-26-CDS dated 14 July 2026. Continuing in the same vein, by official letter number OFI-117-26-SMS, signed by the Municipal Services Coordinator and dated 14 July 2026, Ms. Nombre01 was again answered and informed that the technical inspections conducted by the Municipality determined that there was no impact on her property and no problem with its boundaries. Consequently, the submissions filed by the applicant do not refute the official technical reports or the administrative actions established in the record; they merely express personal disagreement with the criteria issued by the Administration. Therefore, the evidence added to the case file shows that the Municipality of Pérez Zeledón has addressed the situation raised through concrete, progressive, planned, and technically supported actions.”\n\n6.- The legal requirements have been observed in these proceedings.\n\nPrepared by Justice Hess Herrera; and,\n\nReasons:\n\nI.- PRELIMINARY MATTER. Before considering the merits of the matter, it must be clarified that, beginning with judgment no. 2008002545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred matters to the administrative-litigation jurisdiction—with some exceptions—in which the issue is whether the public administration has complied with the time limits set by the General Law on Public Administration (Articles 261 and 325) or sectoral laws governing special administrative proceedings, either to issue a final decision in an administrative proceeding—initiated ex officio or at a party’s request—or to hear the available administrative appeals. This case presents an exception, since it concerns an alleged delay in deciding a complaint regarding work carried out by the respondent Municipality that could endanger the applicant’s physical integrity. That clarified, the specific situation raised in this amparo will now be decided.\n\nII.- SUBJECT OF THE APPLICATION. The applicant claims that, on 16 April 2026, the Municipality of Pérez Zeledón carried out work with heavy machinery on municipal land adjoining the back of her house. She asserts that, to access the land, they cut the fence around the children’s playground. She comments that the work involved moving earth to level the land. She alleges that the Municipality’s actions weakened and structurally damaged the wall at the back of her property. The following facts are considered duly established and relevant to deciding this matter:\n\na) On 20 April 2026, the applicant submitted a request to the Municipality of Pérez Zeledón, which was assigned no. SOL-0006-26-CDS. The complaint stated only: “Earthworks on municipal land by a neighbor, who says, according to the neighbor, that he has the required permits.” (See evidence submitted).\n\nb) In official letter OFI-117-26-SSM dated 14 July 2026, addressed to the applicant, the Municipal Services coordinator stated: “Please accept this letter as a greeting and as a response to your request, in which you indicate that earthworks are being carried out on municipal land and are affecting your property. In this regard, I inform you that the corresponding inspection was conducted and it was determined that there is no impact on your property. In addition, the surveyor indicated that there are no problems with your property boundaries. We also inform you that the work carried out on the municipal property has been halted.” (See evidence submitted).\n\nc) In official letter OFI-020-26-CDS dated 14 July 2026, addressed to the person seeking protection, the Municipality’s Services Comptroller clarified: “Please accept my cordial greetings and best wishes for success in your daily work. I also take this opportunity to inform you that, regarding your request submitted on 20 April 2026 concerning the impact on your property caused by work on municipal property, and in relation to the report issued by Ms. Lorena Núñez Blanco in her capacity as Municipal Services coordinator through documents OFI-065-26-SSM and OFI-117-26-SSM, which states that there is no impact on your property, your request is therefore being closed. We appreciate the request you submitted, as it contributes to the institution’s continuous improvement.” (See evidence submitted).\n\nd) In a written submission received by the Municipality of Pérez Zeledón on 15 July 2026, the applicant stated: “On 16 April 2026, heavy machinery carried out work on the municipal land adjoining my property, directly affecting my property—specifically, weakening and structurally damaging the wall at the back, exposing its foundations, destabilizing the land, and creating an opening underneath it. Those interventions also involved removing the fence from the area designated as a playground, leaving the land completely open, without any fencing or safety measures, despite the presence of a ravine at the site. As a direct consequence, a hole was created through which my animals (dogs) escaped. They are aggressive, which considerably increases the risk, since anyone entering the area, especially minors, could be seriously harmed. This creates an imminent danger both because of the exposed ravine and the lack of access control, a situation the Municipality should have prevented. In addition, it is important to note that those interventions were carried out without environmental viability, MINAE authorization, or measures to mitigate harm to third parties, aggravating the situation and showing that the actions were irregular. It should be noted that the individual who entered with machinery consistently stated that he had municipal permits to carry out this work. However, the results of these interventions—damage to my property, removal of fencing, and creation of risk—call into question the legality, scope, and proper oversight of those permits, if they existed. Based on these facts, I submitted a formal request to the Municipality seeking an inspection, demarcation of property boundaries, repair of the damage, and safety measures. Nevertheless, to date I have received no response from the Mayor’s Office, the Services Comptroller, or any municipal department, and the problem remains unresolved and the risk continues.” (See evidence submitted).\n\ne) On 17 August 2026, the respondent authorities were notified of the order correcting the order admitting the case for processing. (See notices of service).\n\nIV.- THE SPECIFIC CASE. In this case, the applicant claims that, on 16 April 2026, the Municipality of Pérez Zeledón carried out work with heavy machinery on municipal land adjoining the back of her house. She asserts that, to access the land, they cut the fence around the children’s playground. She comments that the work involved moving earth to level the land. I also take this opportunity to inform you that, regarding your request submitted on 20 April 2026 concerning the impact on your property caused by work on municipal property, and in relation to the report issued by Ms. Lorena Núñez Blanco in her capacity as Municipal Services coordinator through documents OFI-065-26-SSM and OFI-117-26-SSM, which states that there is no impact on your property, your request is therefore being closed. We appreciate the request you submitted, as it contributes to the institution’s continuous improvement.”\n\nEarlier, it is established that, in a written submission received by the Municipality of Pérez Zeledón on 15 July 2026, the applicant stated: “On 16 April 2026, heavy machinery carried out work on the municipal land adjoining my property, directly affecting my property—specifically, weakening and structurally damaging the wall at the back, exposing its foundations, destabilizing the land, and creating an opening underneath it. In this regard, note that the request of 20 April 2026 was decided by official letters OFI-117-26-SSM and OFI-020-26-CDS, both dated 14 July 2026—that is, well before the respondents were notified of the order admitting this amparo for processing and, therefore, without intervention by the Chamber.\n\nLikewise, the applicant is advised that any disagreement with the response received or the conclusion reached by the Municipality is a matter of ordinary legality, outside this Court’s jurisdiction. Accordingly, if she so wishes, the applicant may pursue her claims through the administrative or ordinary judicial avenue she deems appropriate.\n\nLastly, this Chamber refrains from ruling on the request of 15 July 2026, first because it exceeds the scope of this proceeding and, second, because the applicant submitted it to the municipal corporation after this proceeding was filed (9 July 2026).\n\nV.- NOTE BY JUSTICE CASTILLO VÍQUEZ CONCERNING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in the administrative forum, the administrative-litigation courts, rather than this Chamber, must hear the legal dispute. However, with the recent enactment of Law No. 9097, Law Regulating the Right of Petition, it has been established that this right may be protected judicially through the amparo proceeding provided for in Article 32 of the Constitutional Jurisdiction Act, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not mean that this Court must change its line of case law; under Article 7 of its Law, this Court alone defines its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo remedy, in all other cases the competent judges are those of the administrative-litigation jurisdiction, for the reasons this Court has given (judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008). All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable legal provisions, based on a logical, systemic, and teleological interpretation of the legal system.\n\nVI.- NOTE BY JUSTICE SALAZAR ALVARADO. As a general principle, I consider that cases related to the activity or inactivity of the Public Administration in the repair, construction, modification, or demolition of any infrastructure work should be dismissed, because such an omission is a matter of legality whose discussion belongs in the ordinary jurisdiction, where the interested person can address their disagreements more fully. However, when that administrative conduct, whether by action or omission, gives rise to a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do consider the merits of the matter, since this situation is an exception to my position in this area. That is the case here, where it is alleged that on 16 April 2026 the Municipality of Pérez Zeledón carried out work with heavy machinery on municipal land adjoining the back of the applicant’s house, causing significant damage both to the children’s playground and to her property, and placing her rights, as well as those of the people and minors who visit the site, at risk.\n\nVII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that any paper documents, as well as objects or evidence contained on electronic, computer, magnetic, optical, telematic, or new technology devices, must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Any such material not collected within this period will be destroyed, as provided in the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011, published in Judicial Bulletin no. 19 of 26 January 2012, as well as in the resolution of the Judicial Branch’s Superior Council, approved in Article LXXXI of session no. 43-12 held on 3 May 2012.\n\nTherefore:\n\nThe amparo is dismissed.
