San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .\n\n  Recurso de amparo interpuesto por Nombre01, cédula de identidad número CED01; contra el INSTITUTO DE ACUEDUCTOS Y ALCANTARILLADOS (AYA) Y AUTORIDAD REGULADORA DE SERVICIOS PÚBLICOS (ARESEP).\n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de la Sala   a las  11:33  horas del  14 de agosto de 2026, la parte recurrente es una persona adulta mayor e interpone recurso de amparo y manifiesta que el AyA le aumentó la tarifa del agua de forma desproporcionada, desde marzo de 2025. Aduce que son cuatro miembros del núcleo familiar los que habitan la casa y siempre pagaban ¢16.000 colones mensuales. No obstante, ahora le cobran hasta ¢57.886 colones.  Debido a lo anterior, acudió ante el AYA solicitando explicaciones sobre el aumento del recibo, pero la respuesta fue siempre que su casa fue calificada como multifamiliar, por tener una escalera que da hacia el frente.  Afirma que, cuando se hicieron los cuartos de la parte de arriba de su casa, la municipalidad los obligó a construir la escalera. También envió correos al ARESEP donde les respondieron que eso era decisión del AyA y al mismo tiempo el AyA alega que es una directriz de ARESEP.  Solicita ayuda, pues considera injusto y desproporcional el cobro, ya que su casa no es multifamiliar ni un residencial de alto consumo.\n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n   I.- OBJETO DEL RECURSO.  La recurrente aduce que es  una persona adulta mayor y el AyA le aumentó la tarifa del agua de forma desproporcionada, desde marzo de 2025. Aduce que son cuatro miembros del núcleo familiar los que habitan la casa y siempre pagaban ¢16.000 colones mensuales. No obstante, ahora le cobran hasta ¢57.886 colones.  Debido a lo anterior, acudió ante el AYA solicitando explicaciones sobre el aumento del recibo, pero la respuesta fue siempre que su casa fue calificada como multifamiliar, por tener una escalera que da hacia el frente.  Afirma que, cuando se hicieron los cuartos de la parte de arriba de su casa, la municipalidad los obligó a construir la escalera. También envió correos al ARESEP donde les respondieron que eso era decisión del AyA y al mismo tiempo el AyA alega que es una directriz de ARESEP.  Solicita ayuda, pues considera injusto y desproporcional el cobro, ya que su casa no es multifamiliar ni un residencial de alto consumo.\n\nII.- SOBRE EL AUMENTO EN LA FACTURACIÓN DEL SERVICIO POR PARTE DEL AYA. Vistos los alegatos  de la   recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de la  Administración Pública, ni servir como un instrumento genérico para canalizar peticiones de otros tipos. Por esta razón, la Sala no puede hacer las veces de alzada en la materia expuesta y revisar si el cambio en la tarifa de cobro o facturación del servicio de agua en la propiedad de la amparada, se ajusta o no a los hechos, al consumo real  y a la normativa vigente, por cuanto constituye un diferendo de legalidad ordinaria que debe ser dirimido en la vía administrativa o judicial correspondiente. Tampoco corresponde a esta Sala sustituir las competencias legalmente asignadas a la autoridad recurrida o a las autoridades competentes en la materia, a efecto de iniciar investigaciones para determinar si técnica y jurídicamente procede o no el ajuste en la facturación, en la metodología de cálculo, en la reglamentación;  por cuanto ello es una labor propia de la administración, cuyos diferendos son propios de conocerse en la vía de legalidad ordinaria y no de constitucionalidad. Al respecto, cabe destacar que no puede pretenderse que, por la vía del amparo, la Sala Constitucional haga las veces de una mera instancia tramitadora de denuncias en materia de facturación de servicios, puesto que ello no solamente haría necesario efectuar probanzas complicadas, incompatibles con la naturaleza sumaria de esta sede, sino también sustituir directamente la voluntad administrativa y suplantar a los despachos públicos en la gestión de los asuntos de su competencia.  Así las cosas, deberá la parte recurrente acudir ante la vía de legalidad ordinaria, administrativa o judicial, a fin de plantear allí, por escrito, los reclamos que estime pertinentes, a fin de que se resuelva lo que en derecho corresponda. En consecuencia, el recurso es inadmisible en cuanto a este extremo y así se declara.\n\nIII.- SOBRE LO RESUELTO POR ARESEP. Por otra parte, la recurrente cuestiona la respuesta  emitida por el ARESEP. Al respecto, se le hace saber que esta  Sala  no es un contralor de la legalidad de las actuaciones o resoluciones que emita la ARESEP  en materia de  tarifas. Tampoco puede reemplazar a la Administración activa en la gestión de sus competencias, de modo que no le corresponde actuar como tribunal  de alzada en la materia y revisar si la decisión de denegar el reclamo planteado por la amparada  se ajusta a Derecho,    ni pronunciarse sobre el mérito de las razones en las que se fundó la autoridad recurrida para tomar esa decisión o   sustituir las competencias legalmente asignadas a la autoridad recurrida o a las autoridades competentes en la materia, a efecto de iniciar investigaciones para determinar si técnica y jurídicamente procede o no el ajuste en la facturación, en la metodología de cálculo, en la reglamentación, mucho menos, revisar los montos facturados y ordenar un reajuste;  por cuanto ello es una labor propia de la administración, cuyos diferendos son propios de conocerse en la vía de legalidad ordinaria y no de constitucionalidad.  En virtud de lo expuesto, deberá la parte recurrente plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, el recurso es inadmisible y así se declara.\n\nIV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. San José, at nine hours and forty minutes on 27 August 2026.\n\n  Amparo proceeding filed by Nombre01, identity card number CED01, against the INSTITUTO DE ACUEDUCTOS Y ALCANTARILLADOS (AYA) AND THE PUBLIC SERVICES REGULATORY AUTHORITY (ARESEP).\n\nBackground:\n\n1.- In a brief filed with the Chamber Secretariat at 11:33 on 14 August 2026, the appellant, an older adult, files an amparo proceeding and states that AyA has increased the water tariff disproportionately since March 2025. The appellant asserts that four members of the family household live in the house and that they always paid ¢16.000 colones per month. However, they are now charged up to ¢57.886 colones.  For this reason, the appellant went to AYA seeking explanations for the increase in the bill, but the response was always that the house had been classified as multifamily because it has a staircase leading to the front.  The appellant states that, when the rooms on the upper floor of the house were built, the municipality required the staircase to be built. The appellant also sent emails to ARESEP, which responded that this was AyA’s decision, while AyA maintains that it is an ARESEP directive.  The appellant seeks assistance, as the charge is considered unfair and disproportionate because the house is neither multifamily nor a high-consumption residence.\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional (Constitutional Jurisdiction Act) authorizes the Chamber to dismiss summarily or on the merits, at any time, including upon filing, any matter brought before it that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is simply a reiteration or reproduction of an identical or similar prior matter that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION.  The appellant asserts that she is an older adult and that AyA has increased the water tariff disproportionately since March 2025. She asserts that four members of the family household live in the house and that they always paid ¢16.000 colones per month. However, they are now charged up to ¢57.886 colones.  For this reason, she went to AYA seeking explanations for the increase in the bill, but the response was always that her house had been classified as multifamily because it has a staircase leading to the front.  She states that, when the rooms on the upper floor of her house were built, the municipality required the staircase to be built. Having considered the appellant’s arguments, she is advised that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms. It is not an instrument for reviewing the legality of acts of the Public Administration, nor a general means of channeling other types of requests. For this reason, the Chamber cannot act as an appellate body in the matter presented and review whether the change in the tariff charged or the billing for water service at the appellant’s property conforms to the facts, actual consumption, and applicable regulations, since this is an ordinary legality dispute that must be resolved through the corresponding administrative or judicial procedure. Nor is it for this Chamber to replace the powers legally assigned to the respondent authority or the competent authorities in the field by initiating investigations to determine whether, technically and legally, an adjustment to billing, the calculation methodology, or the regulations is warranted. That is a function of the administration, and disputes of this kind are to be heard through ordinary legality procedures, not constitutional proceedings. In this regard, it should be emphasized that the Chamber cannot be expected, through amparo, to act as a mere forum for processing complaints about service billing, since this would not only require complex evidentiary proceedings, which are incompatible with the summary nature of this forum, but would also directly replace administrative decision-making and usurp the public offices responsible for managing matters within their competence.  Accordingly, the appellant must resort to the ordinary legality route, whether administrative or judicial, and submit in writing any claims she deems appropriate so that the matter may be resolved as the law requires. Consequently, the amparo application is inadmissible as to this issue, and it is so declared.\n\nIII.- REGARDING THE DECISION BY ARESEP. On the other hand, the appellant challenges the response issued by ARESEP. In this regard, she is advised that this Chamber does not review the legality of ARESEP’s actions or decisions concerning tariffs. Nor can it replace the active Administration in the exercise of its powers. Thus, it is not for the Chamber to act as an appellate body in this matter and review whether the decision to deny the appellant’s claim is in accordance with law, or to rule on the merits of the reasons on which the respondent authority based its decision, or to replace the powers legally assigned to that authority or to the competent authorities in the field by initiating investigations to determine whether, technically and legally, an adjustment to billing, the calculation methodology, or the regulations is warranted, much less to review the amounts billed and order an adjustment. That is a function of the administration, and disputes of this kind are to be heard through ordinary legality procedures, not constitutional proceedings.  In light of the foregoing, the appellant must submit her objections or claims to the respondent authorities or through the competent judicial procedure, where she may fully argue the merits of the matter and assert her claims. Consequently, the amparo application is inadmissible, and it is so declared.\n\nIV.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The appellant is advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that she may have submitted, must be retrieved from the office within a maximum period of 30 business days from notification of this judgment.
