  "body_es_text": "\n\nEXPEDIENTE: No. 26-030218-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN: No. 2026033412\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-030218-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA).\n\nRESULTANDO:\n\n1.- Por escrito recibido en la Secretaría de la Sala el accionante interpone un recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados y manifiesta lo siguiente: “(…) Estoy consciente que uno tiene que pagar los servicios públicos, pero lo que es para vivir de mi salario, que es de 200 mil por quincena. Espero que me ayuden con este problema. No solo yo soy afectado, somos muchos los afectados por cobros excesivos. Este mes me llega el recibo de 99.973.00, agosto. Fui a pedir un arreglo en ese recibo de este mes. Me dijeron que por ese monto no hay posibilidad de un arreglo. Les dije que por qué no, que me están cobrando el doble mi dinero. Yo vivo en la Terminal de Buses de La Carpio, 25 años. Numero de casa 319, color pastel. El problema que tengo es el siguiente con el Acueducto y Alcantarillado A y A. La Carpio es un precario, es una casa de habitación. En noviembre del año 2025 me llego un recibo de 468.277,00, que fui a hacer un reclamo que duró como 2 meses, para que me dijeran que tengo que pagar No es justo que el A y A cobre recibos tan caros, que cobre lo que es y no. Que llegue a un arreglo de pago. No puedo pagar más de eso (sic)”. Por lo anterior, solicita ayuda a este Tribunal. \n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y, \n\nCONSIDERANDO:\n\nI.- OBJETO DEL RECURSO. El recurrente manifiesta su disconformidad con la facturación del mes de agosto por concepto de agua potable. Menciona que gestionó un arreglo de pago; empero, se le indicó que por ese monto no era posible. Por lo anterior, solicita la intervención de la Sala. \n\nII.- SOBRE EL CASO EN CONCRETO. Vistas las alegaciones de la parte recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de las distintas Administraciones Públicas. Por esta razón, la Sala no puede actuar como tribunal de alzada en la materia expuesta y revisar si el cobro o facturación por el servicio de agua que la parte amparada impugna se ajusta o no al consumo real y a la normativa legal vigente, puesto que ello es un diferendo de legalidad ordinaria que debe ser dirimido en la vía común. Asimismo, escapa al ámbito de competencia de esta Sala, investigar y revisar las causas del alto consumo, por cuanto excede la naturaleza sumaria del amparo. \n\nDe esta manera, no le corresponde a esta jurisdicción interceder a su favor ante la autoridad recurrida a fin de determinar, según la normativa infraconstitucional que rige la materia, la procedencia del cobro de la factura de marras. Por ello, la amparada podrá plantear, si a bien lo tiene, sus reparos en la propia vía administrativa o en la sede jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.\n\nErgo, el recurso es inadmisible como en efecto se declara.\n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. San José, at nine forty a.m. on 27 August 2026.\n\n Amparo proceeding conducted in case file number 26-030218-0007-CO, filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (AYA).\n\nBACKGROUND:\n\n1.- In a written submission received by the Chamber’s Secretariat, the applicant files an amparo application against the Costa Rican Institute of Aqueducts and Sewers and states as follows: “(…) I am aware that one has to pay for public services, but what I have to live on comes from my salary, which is 200 thousand per half-month. I hope you will help me with this problem. I am not the only one affected; many of us are affected by excessive charges. This month I received a bill for 99.973.00, August. I went to request a payment arrangement for this month’s bill. They told me that, for that amount, a payment arrangement was not possible. I asked them why not, since they are charging me double my money. I have lived at the La Carpio Bus Terminal for 25 years. House number 319, pastel color. The problem I have is the following with the Aqueduct and Sewer Authority A and A. La Carpio is an informal settlement; it is a dwelling. In November 2025 I received a bill for 468.277,00, and I filed a complaint that took about 2 months, only for them to tell me that I have to pay. It is not fair for A and A to charge such expensive bills; they should charge what is right and not. Let them agree to a payment arrangement. I cannot pay more than that (sic).” For these reasons, the applicant requests assistance from this Court.\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily dismiss or dismiss on the merits, at any time, including upon filing, any application submitted for its consideration that proves manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is merely a reiteration or reproduction of an earlier identical or similar application that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nREASONS:\n\nI.- SUBJECT OF THE APPLICATION. The applicant expresses disagreement with the August bill for potable water. The applicant states that they requested a payment arrangement; however, they were told that one was not possible for that amount. For these reasons, the applicant requests the Chamber’s intervention.\n\nII.- THE SPECIFIC CASE. In light of the applicant’s allegations, the applicant is advised that the purpose of an amparo application is to provide timely protection against violations or threats to fundamental rights and freedoms, and not to serve as an instrument for reviewing the legality of acts of the various Public Administrations. For this reason, the Chamber cannot act as an appellate tribunal in the matter presented and review whether the charge or billing for the water service challenged by the amparo applicant conforms to actual consumption and the legislation in force, since that is an ordinary question of legality that must be resolved through the ordinary process. Likewise, investigating and reviewing the causes of the high consumption falls outside this Chamber’s jurisdiction because it exceeds the summary nature of amparo.\n\nAccordingly, it is not for this jurisdiction to intervene on the applicant’s behalf before the respondent authority to determine, under the infra-constitutional rules governing the matter, whether the bill in question was properly charged. Therefore, the applicant may, if they so choose, raise their objections through the administrative process itself or before the competent court, where they may fully discuss the merits of the matter and assert their claims.\n\nTherefore, the application is inadmissible, as is hereby declared.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted must be collected within a maximum period of 30 business days, counted from notification of this judgment.
