  "body_es_text": "\n\nEXPEDIENTE: No. 26-030415-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN: No. 2026033436\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-030415-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DE VILLARREAL (ASADA VILLARREAL) Y EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA).\n\nRESULTANDO\n\n1.- Por escrito recibido en la Secretaría de la Sala, la parte recurrente interpone recurso de amparo contra La Asada de Villareal y el Instituto Costarricense de Acueductos y Alcantarillados y manifiesta lo siguiente: “(…) PRIMERO. Soy propietario de una propiedad ubicada en Villareal de Tamarindo, cantón de Santa Cruz, provincia de Guanacaste, identificada mediante el plano catastrado G-1141461-2007, con un área aproximada de 220 m². La propiedad se encuentra dentro del área de cobertura del acueducto administrado por la ASADA de Villareal. SEGUNDO. El día 15 de marzo de 2023, solicité a la ASADA de Villareal una constancia de disponibilidad de agua respecto de mi propiedad. Como resultado de la valoración realizada, la propia ASADA emitió la “CONSTANCIA DE DISPONIBILIDAD DE AGUA FRENTE A UNA PROPIEDAD SIN ALCANTARILLADO”, consecutivo N.° 126. En dicha constancia la ASADA determinó expresamente: “Sí tiene disponibilidad de agua frente a propiedad.” Asimismo, estableció una dotación aproximada de 0,20 litros por segundo (L/s) para una vivienda unifamiliar. TERCERO. Reconozco que la constancia de 2023 tenía una vigencia de doce meses y que el propio documento indicaba que se emitía exclusivamente para trámite municipal y que no constituía por sí misma autorización de interconexión ni aprobación definitiva de un nuevo servicio. No obstante, dicha constancia constituye un antecedente técnico y administrativo directo de enorme relevancia, pues fue la propia ASADA quien realizó la valoración y determinó que existía disponibilidad para mi propiedad, específicamente para una vivienda unifamiliar y por aproximadamente 0,20 L/s. CUARTO. Una vez vencida la constancia anterior, procedí a solicitar nuevamente a la misma ASADA de Villareal una constancia de disponibilidad para la misma propiedad y para el mismo uso: una vivienda unifamiliar. QUINTO. El día 3 de agosto de 2026, la ASADA de Villareal emitió la “Constancia de NO disponibilidad de servicio”, mediante la cual modificó sustancialmente el criterio anteriormente aplicado a mi propiedad. La nueva constancia establece: “NO HAY DISPONIBILIDAD DE CAPACIDAD HÍDRICA FRENTE A LA PROPIEDAD”. SEXTO. La ASADA fundamenta la negativa, entre otros elementos, en un informe técnico de AyA identificado como GSD-UEN-GAR-2021-04801, de fecha 8 de noviembre de 2021. Por tanto, la decisión administrativa adoptada el 3 de agosto de 2026 se apoya sustancialmente en un documento técnico elaborado aproximadamente cinco años antes. SÉTIMO. El oficio GSD-UEN-GAR-2021-04801 señala que en el año 2021 se recomendó no emitir más constancias de disponibilidad o capacidad hídrica debido a determinadas condiciones técnicas y legales del acueducto de Villareal. Sin embargo, el mismo oficio establece una serie de medidas destinadas a mejorar la capacidad del sistema, incluyendo la construcción y/o instalación de al menos 255 m³ de capacidad para los siguientes 20 años, además de estudios técnicos y planes de trabajo. OCTAVO. El documento de 2021 no constituye una valoración técnica específica de mi propiedad realizada en el año 2026. Tampoco demuestra, por sí solo, cuál es la capacidad actual del sistema cinco años después de su elaboración NOVENO. Existe además un documento denominado “Comunicado ASADAS CONIMBOCO y ORAC Chorotega – Comisión Técnica Interinstitucional para la Gestión del Agua Subterránea”, emitido en septiembre de 2021. Dicho documento fue entregado al suscrito por la misma ASADA de Villareal junto con los demás documentos relacionados con mi solicitud. En él se aclara expresamente que al CTI-Aguas Subterráneas no le corresponde regular ni disponer sobre el servicio público de suministro de agua, y que tampoco le corresponde definir ni pronunciarse sobre el otorgamiento de cartas de disponibilidad del servicio público. El comunicado señala que la emisión de cartas de disponibilidad corresponde al ente operador del acueducto, AyA o las ASADAS por delegación. DÉCIMO. El mismo comunicado señala que, cuando el sistema de acueducto lo permita y sin sobrepasar el caudal registrado y autorizado, el ente operador puede emitir cartas de disponibilidad bajo su responsabilidad. Por ello, el documento aportado por la propia ASADA no demuestra la existencia de una prohibición absoluta e indefinida de emitir cartas de disponibilidad para toda propiedad ubicada en Villareal. UNDÉCIMO. La ASADA tampoco identifica en la constancia del 3 de agosto de 2026 una resolución específica del CTI que prohíba emitir disponibilidad de agua para mi propiedad. Tampoco identifica una resolución administrativa vigente que declare que mi propiedad se encuentra excluida de cualquier posibilidad de disponibilidad. DUODÉCIMO. La normativa del AyA contempla expresamente el concepto de “zona de crecimiento máximo” dentro de una zona deficitaria y establece que, en dicha categoría, el prestador puede autorizar constancias de disponibilidad positivas para determinados casos, incluyendo expresamente: “Vivienda unifamiliar individual”. La misma normativa contempla que una zona deficitaria debe responder a condiciones técnicas determinadas y que las obras de inversión deben orientarse a resolver gradualmente la insuficiencia técnica y operativa Por ello, aun suponiendo que el acueducto de Villareal tenga una condición deficitaria, resulta necesario determinar técnicamente si mi solicitud, por tratarse de una vivienda unifamiliar individual, se encuentra dentro de los supuestos que la normativa permite atender. DECIMOTERCERO. La ASADA no indica en su negativa: 1. cuál es la capacidad hídrica actual del sistema; 2. cuál es el caudal actualmente autorizado; 3. cuál es el caudal actualmente utilizado; 4. cuál es el caudal actualmente comprometido; 5. cuál es el caudal efectivamente disponible; 6. cuál es el déficit actual, en caso de existir; 7. cuáles obras recomendadas por AyA en 2021 fueron ejecutadas; 8. cuáles obras permanecen pendientes; 9. cuál es el estudio técnico actualizado que determina la situación del sistema en 2026; 10. por qué los 0,20 L/s que la propia ASADA consideró disponibles para mi propiedad en 2023 ya no pueden ser atendidos; 11. cuál es la disposición normativa o resolución vigente que impide emitir la constancia solicitada; 12. ni cuál es exactamente el supuesto criterio del CTI que fundamenta la negativa. DECIMOCUARTO. Mi solicitud no corresponde a un proyecto inmobiliario, urbanización, condominio, comercio masivo ni desarrollo de múltiples lotes. Se trata de una sola propiedad y una vivienda unifamiliar, exactamente uno de los supuestos que la normativa del AyA contempla expresamente al regular las zonas de crecimiento máximo. DECIMO QUINTO. Existe, por tanto, una diferencia objetiva entre la situación documentada en 2023 y la que actualmente afirma la ASADA: 15 de marzo de 2023: La ASADA determinó que la propiedad sí tenía disponibilidad de agua, para una vivienda unifamiliar y aproximadamente 0,20 L/s. 3 de agosto de 2026: La ASADA determina que no existe capacidad hídrica frente a la propiedad. La ASADA no explica suficientemente qué circunstancia técnica concreta produjo ese cambio. DECIMOSEXTO. Todos los documentos principales en que se fundamenta esta controversia —incluyendo la constancia positiva de 2023, la constancia negativa de 2026, el oficio de AyA de 2021 y el comunicado del CTI— fueron entregados al suscrito por la propia ASADA de Villareal. Por tanto, la ASADA conoce plenamente el contenido de esos documentos y conoce también el antecedente de que en 2023 había determinado disponibilidad de agua para mi propiedad. DECIMOSÉTIMO. No pretendo que la Sala ordene comprometer caudales inexistentes ni que se desconozcan las restricciones destinadas a proteger los recursos hídricos. Mi pretensión es que se determine si mi propiedad puede recibir la constancia solicitada dentro del caudal legalmente autorizado y conforme a la normativa vigente, y que, de existir capacidad técnica para los 0,20 L/s requeridos, se ordene la emisión de la constancia. DECIMOCTAVO. La información necesaria para verificar la capacidad actual del sistema se encuentra principalmente en poder de la ASADA y del AyA. Por ello, solicito que dichos recurridos aporten a esta Sala el expediente técnico y administrativo completo que sustenta la negativa. (sic)”. Por lo anterior, solicita la intervención de la Sala, a fin de que se deje sin efecto la constancia de no disponibilidad del servicio de agua potable y se ordene a la Asada recurrida emitir una constancia de de disponibilidad para vivienda unifamiliar. Subsidiariamente, que se le ordene al Instituto Costarricense de Acueductos y Alcantarillados realizar una valoración técnica actual, objetiva, individualizada y documentada de su propiedad y del sistema de acueducto. \n\n2. El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n \n\n Redacta el Magistrado Castillo Víquez; y, \n\nCONSIDERANDO\n\nI.- OBJETO DEL RECURSO. La parte recurrente reclama la violación de sus derechos fundamentales, pues acusa que la Asada recurrida se niega a instalar una disponibilidad de agua potable en su casa de habitación, bajo el argumento que no hay disponibilidad de capacidad hídrica frente a la propiedad. Por lo anterior, solicita la intervención de la Sala, a fin de que se deje sin efecto la constancia de no disponibilidad del servicio de agua potable y se ordene a la Asada recurrida emitir una constancia de disponibilidad para vivienda unifamiliar. Subsidiariamente, que se le ordene al Instituto Costarricense de Acueductos y Alcantarillados realizar una valoración técnica actual, objetiva, individualizada y documentada de su propiedad y del sistema de acueducto.\n\nII. INADMISIBILIDAD DEL RECURSO. Se le aclara a la parte accionante que desde larga data la Sala ha considerado que, si bien existe un derecho fundamental al agua potable, su ejercicio no es indiscriminado, ya que no hay una obligación de los entes que prestan ese servicio de brindarlo en cualesquiera condiciones y oportunidad. Así, por ejemplo, esta Sala en la sentencia n.º 2018-12838 de las 09:30 horas del 10 de agosto de 2018 se estableció lo siguiente:\n\n“ IV.- Sobre el caso concreto. En el sub lite, la recurrente estima lesionado su derecho fundamental de acceso al agua potable. Indica que es propietaria, junto con su esposo, del inmueble matrícula folio real N° 672411 del Partido de San José, plano catastrado N° SJ-1843630-2015. Señala que mediante gestión realizada por su esposo ante el Instituto Costarricense de Acueductos y Alcantarillados, se solicitó la disponibilidad de agua para el terreno citado; empero, por medio del oficio N° UNDGAM-0583-2018-1803 del 21 de febrero de 2018, el instituto recurrido denegó la petición, bajo el argumento que no existe disponibilidad (…) En el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. La producción de agua potable que existe actualmente y abastece la infraestructura que se ubica frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. La población en la zona ha ido aumentando y ello ha generado mucha demanda que ha provocado que, en la actualidad, el sistema que abastece el sector sea insuficiente. La situación se ve agravada por la elevación topográfica de la zona, las limitadas fuentes de captación en el sector y la falta de control catastral en la zona por parte de la municipalidad competente. Así las cosas, lo correspondiente es declarar sin lugar el recurso de amparo. Este Tribunal Constitucional ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase Sentencia N° 2001-09676 y N° 2004-08161). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una red de distribución de aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En la especie, la autoridad recurrida es clara en indicar que la recurrente debe cumplir con lo estipulado en la Ley de Planificación Urbana y Plan Regulador. Además, a la amparada se le explicó que no existe disponibilidad asociada para el fraccionamiento de la propiedad madre de la que se generó la propiedad en análisis ni tampoco existe capacidad de abastecimiento en el sector. Por último, el recurrido señala que en el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. De manera tal, que existe una imposibilidad tanto jurídica como formal o técnica, ya que el fraccionamiento del terreno se realizó sin que previamente se haya obtenido la disponibilidad y, además, porque en el sector donde se encuentra la propiedad no existe capacidad suficiente para brindar el servicio públicos. Corolario de lo expuesto, la Sala considera que se debe desestimar el recurso de amparo, ya que de conformidad con la línea jurisprudencial esgrimida por este Tribunal en casos similares, es posible denegar el suministro de agua potable cuando se determina la existente de una imposibilidad jurídica y/o formal técnica, como ocurre en la especie, de modo que no se estarían infringiendo los derechos fundamentales de la parte promovente. Si la recurrente lo que se encuentra es disconforme con la negatoria en sí, y con los motivos que la sustentan, ello corresponde a un extremo de legalidad que no puede ser ventilado en esta vía . Además, la Sala constata que a la amparada sí se le indicaron expresamente los motivos por los cuales no procedía la autorización del servicio, de ahí que tampoco en ese aspecto se hayan conculcado sus derechos fundamentales” (resaltado no es del original) .\n\n \n\nEn virtud de lo expuesto, se ha reconocido que las entidades prestatarias pueden denegar la prestación del servicio de agua potable si existen razones técnicas que así lo justifiquen. De tal manera, considera la Sala que la razón por la que la ASADA recurrida negó el servicio -en tesis de principio- no es arbitraria, sino que se debe a que no existe disponibilidad de capacidad hídrica frente a la propiedad de interés. \n\nPor ende, si los motivos de la denegatoria no son ciertos o no conformes con los criterios técnicos y/o legales, ello es un diferendo que debe ser dirimido en las vías infra constitucionales. \n\nAsí las cosas, y de conformidad con los reiterados precedentes de esta Sala, lo correspondiente es rechazar el amparo, sin demérito que la parte interesada presente sus reclamos en la vía ordinaria.\n\nIII.- VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL, CON REDACCIÓN DEL SEGUNDO. En el sub lite, la mayoría de la Sala rechaza el amparo con el argumento de que las instituciones que prestan el servicio de suministro de agua potable pueden rechazar válidamente las solicitudes de servicio de agua potable o condicionarlas, si existen razones técnicas o legales que así lo justifican; sin embargo, salvamos el voto con base en las siguientes consideraciones: \n\nEl artículo 50 de la Carta Magna establece que toda persona es titular del derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. Añade que el agua es un bien de la nación, indispensable para proteger tal derecho humano. También impone que su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que establezca la ley que se creará para estos efectos, así como que tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones.\n\nA partir de lo anterior, está claro que el carácter prioritario que constitucionalmente se le da al abastecimiento de agua potable obliga a las entidades competentes a adoptar las medidas adecuadas para prever que tal servicio público se brinde de manera igual, continúa y eficiente, lo que exige, a la vez, la adaptación o mutabilidad pertinente, de manera tal que, dentro de una marco de razonabilidad, la infraestructura y las tecnologías se adecuen a los nuevos requerimientos de la sociedad y a los cambios de la naturaleza.\n\nAsí las cosas, estimamos que se requiere de más elementos de conocimiento para acreditar o descartar que en el sub examine se haya dado una afectación de raigambre constitucional que amerite la intervención de la Sala.\n\nIV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE.   "body_en_text": "\n\nCASE FILE: No. 26-030415-0007-CO\n\nPROCEEDING: AMPARO PROCEEDING\n\nDECISION: No. 2026033436\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine forty a.m. on 27 August 2026.\n\nAmparo proceeding filed in case file No. 26-030415-0007-CO by Nombre01, identity card CED01, against THE VILLARREAL RURAL AQUEDUCT ADMINISTRATIVE ASSOCIATION (ASADA VILLARREAL) AND THE COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (AYA).\n\nBACKGROUND\n\n1.- In a written submission received by the Chamber’s Secretariat, the applicant files an amparo proceeding against the Asada de Villareal and the Costa Rican Institute of Aqueducts and Sewers and states as follows: “(…) FIRST. I own a property located in Villareal de Tamarindo, canton of Santa Cruz, province of Guanacaste, identified by cadastral plan G-1141461-2007, with an area of approximately 220 m². The property is within the service area of the aqueduct administered by ASADA de Villareal. SECOND. On 15 March 2023, I requested from ASADA de Villareal a certificate of water availability for my property. Following its assessment, ASADA itself issued the ‘CERTIFICATE OF WATER AVAILABILITY IN FRONT OF A PROPERTY WITHOUT A SEWER CONNECTION,’ consecutive No. 126. In that certificate, ASADA expressly determined: ‘Water is available in front of the property.’ It also established an approximate allocation of 0.20 liters per second (L/s) for a single-family dwelling. THIRD. I acknowledge that the 2023 certificate was valid for twelve months and that the document itself stated it was issued exclusively for municipal procedures and did not, by itself, constitute authorization to connect to the system or final approval for a new service. Nevertheless, that certificate is a directly relevant technical and administrative precedent of great importance, because ASADA itself conducted the assessment and determined that water was available for my property, specifically for a single-family dwelling and at approximately 0.20 L/s. FOURTH. Once the previous certificate expired, I again requested from the same ASADA de Villareal a certificate of availability for the same property and the same use: a single-family dwelling. FIFTH. On 3 August 2026, ASADA de Villareal issued the ‘Certificate of NO service availability,’ thereby substantially changing the criterion previously applied to my property. The new certificate states: ‘THERE IS NO WATER CAPACITY AVAILABLE IN FRONT OF THE PROPERTY.’ SIXTH. Among other things, ASADA bases its refusal on a technical report by AyA identified as GSD-UEN-GAR-2021-04801, dated 8 November 2021. Therefore, the administrative decision adopted on 3 August 2026 relies substantially on a technical document prepared approximately five years earlier. SEVENTH. Letter GSD-UEN-GAR-2021-04801 states that in 2021 it was recommended that no further certificates of water availability or capacity be issued due to certain technical and legal conditions of the Villareal aqueduct. However, that same letter sets out a series of measures intended to improve the system’s capacity, including the construction and/or installation of at least 255 m³ of capacity for the next 20 years, as well as technical studies and work plans. EIGHTH. The 2021 document is not a technical assessment of my specific property conducted in 2026. Nor does it, by itself, establish the system’s current capacity five years after it was prepared. NINTH. There is also a document entitled ‘Notice from ASADAS CONIMBOCO and ORAC Chorotega – Interinstitutional Technical Commission for Groundwater Management,’ issued in September 2021. ASADA de Villareal itself provided that document to me along with the other documents related to my request. It expressly clarifies that the CTI-Groundwater is not responsible for regulating or deciding on the public water supply service, nor is it responsible for defining or issuing opinions on the granting of public service availability letters. The notice states that availability letters are issued by the aqueduct operator, AyA or the ASADAS acting under delegated authority. TENTH. The same notice states that, when the aqueduct system allows and without exceeding the registered and authorized flow, the operator may issue availability letters under its own responsibility. Therefore, the document provided by ASADA itself does not establish an absolute and indefinite prohibition on issuing availability letters for every property located in Villareal. ELEVENTH. The certificate of 3 August 2026 also does not identify any specific CTI decision prohibiting water availability for my property. Nor does it identify any current administrative decision declaring that my property is excluded from any possibility of availability. TWELFTH. AyA’s regulations expressly provide for the concept of a ‘maximum growth zone’ within a deficit zone, and establish that, in that category, the service provider may authorize positive availability certificates in certain cases, expressly including: ‘Individual single-family dwelling.’ The same regulations provide that a deficit zone must be based on specified technical conditions and that investment works must be aimed at gradually resolving technical and operational insufficiency. Therefore, even assuming that the Villareal aqueduct is in deficit, it is necessary to determine technically whether my request, which concerns an individual single-family dwelling, falls within the cases that the regulations allow to be served. THIRTEENTH. In its refusal, ASADA does not state: 1. the system’s current water capacity; 2. the flow currently authorized; 3. the flow currently used; 4. the flow currently committed; 5. the flow actually available; 6. the current deficit, if any; 7. which works recommended by AyA in 2021 have been completed; 8. which works remain pending; 9. which updated technical study determines the system’s condition in 2026; 10. why the 0.20 L/s that ASADA itself considered available for my property in 2023 can no longer be supplied; 11. which current regulatory provision or decision prevents issuance of the requested certificate; or 12. what the alleged CTI criterion underlying the refusal actually is. FOURTEENTH. My request does not concern a real estate project, urban development, condominium, large-scale commercial activity, or development involving multiple lots. It concerns a single property and a single-family dwelling, exactly one of the cases expressly covered by AyA’s regulations on maximum growth zones. FIFTEENTH. There is therefore an objective difference between the situation documented in 2023 and the one ASADA now asserts: 15 March 2023: ASADA determined that water was available for the property, for a single-family dwelling and at approximately 0.20 L/s. 3 August 2026: ASADA determines that no water capacity is available in front of the property. ASADA does not adequately explain what specific technical circumstance caused this change. SIXTEENTH. All the principal documents underlying this dispute—including the positive certificate from 2023, the negative certificate from 2026, AyA’s 2021 letter, and the CTI notice—were provided to me by ASADA de Villareal itself. ASADA therefore has full knowledge of the contents of those documents and also knows that it had previously determined in 2023 that water was available for my property. SEVENTEENTH. I do not seek an order from the Chamber requiring the commitment of nonexistent flows or disregarding restrictions intended to protect water resources. I seek a determination as to whether my property may receive the requested certificate within the legally authorized flow and in accordance with the current regulations, and, if there is technical capacity for the required 0.20 L/s, an order that the certificate be issued. EIGHTEENTH. The information needed to verify the system’s current capacity is primarily held by ASADA and AyA. I therefore request that the respondents provide the Chamber with the complete technical and administrative file supporting the refusal. (sic).” For these reasons, the applicant requests the Chamber’s intervention so that the certificate of no availability of drinking water service be set aside and the respondent Asada be ordered to issue a certificate of availability for a single-family dwelling. In the alternative, the applicant requests an order directing the Costa Rican Institute of Aqueducts and Sewers to conduct a current, objective, individualized, and documented assessment of the property and aqueduct system.\n\n2. Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily dismiss, either at the outset or on the merits and at any time, including upon filing, any application brought before it that is manifestly inadmissible, when it considers that there is sufficient evidence to dismiss it, or when the application is merely a reiteration or reproduction of an earlier identical or similar application that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nREASONS\n\nI.- SUBJECT OF THE APPLICATION. The applicant alleges a violation of fundamental rights, claiming that the respondent Asada refuses to install a drinking water availability connection at the applicant’s home on the ground that no water capacity is available in front of the property. For these reasons, the applicant requests the Chamber’s intervention so that the certificate of no availability of drinking water service be set aside and the respondent Asada be ordered to issue a certificate of availability for a single-family dwelling. In the alternative, the applicant requests an order directing the Costa Rican Institute of Aqueducts and Sewers to conduct a current, objective, individualized, and documented assessment of the property and aqueduct system.\n\nII. INADMISSIBILITY OF THE APPLICATION. The applicant is advised that, for a long time, the Chamber has held that although there is a fundamental right to drinking water, its exercise is not unrestricted, since entities that provide that service are not obligated to provide it under all conditions and at all times. For example, this Chamber stated the following in judgment No. 2018-12838, at 09:30 on 10 August 2018:\n\n“IV.- The specific case. In the present case, the applicant considers her fundamental right of access to drinking water to have been violated. She states that she and her husband own the property registered under folio real No. 672411 in the San José Property Registry, cadastral plan No. SJ-1843630-2015. She states that, in response to a request made by her husband to the Costa Rican Institute of Aqueducts and Sewers, water availability was requested for the aforementioned land; however, by letter No. UNDGAM-0583-2018-1803 of 21 February 2018, the respondent Institute denied the request on the ground that there was no availability (…) In the sector identified by the applicant, the existing drinking water infrastructure in front of the property does not have sufficient capacity to supply it. The drinking water production currently available to supply the infrastructure located in front of the property does not have sufficient capacity to supply it. The population in the area has grown, generating substantial demand and causing the system serving the sector to become insufficient. The situation is aggravated by the area’s elevation, the limited water sources in the sector, and the lack of cadastral control in the area by the competent municipality. Accordingly, the amparo application must be denied. This Constitutional Court has repeatedly held that under Costa Rican law, the supply of drinking water is considered a public service and, as such, every public service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and in a manner that adapts to technological change (see Judgment No. 2001-09676 and No. 2004-08161). It is therefore clear that the Costa Rican Institute of Aqueducts and Sewers, as one of the state entities responsible for providing the public drinking water service, is also required to provide this service continuously, adaptably, and efficiently, and equally to all inhabitants. However, this Court’s case law has also held that, in the face of legal impossibility (that is, failure to meet requirements established in the applicable regulations) or formal impossibility (that is, the absence of a water distribution network), it is reasonable to deny service requests or to require the interested party to bear installation costs when no drinking water distribution network exists and infrastructure must be built. In such cases, the matter is not a denial of access to the drinking water service, but rather an inability to provide it or the interested party’s necessary participation in overcoming a technical impossibility, namely, the lack of infrastructure. In other words, when the failure to provide drinking water is not arbitrary, capricious, or without grounds, but is justified by legal or material impossibility, there is no violation of fundamental rights. In this case, the respondent authority clearly states that the applicant must comply with the provisions of the Urban Planning Act and the Regulatory Plan. In addition, the amparo beneficiary was informed that no associated availability exists for subdividing the parent property from which the property under review originated, and that the sector also lacks sufficient supply capacity. Lastly, the respondent states that the drinking water infrastructure in front of the property in the sector identified by the applicant does not have sufficient capacity to supply it. Thus, there is both legal and formal or technical impossibility, because the land was subdivided without first obtaining availability and because the sector where the property is located lacks sufficient capacity to provide the public service. In light of the foregoing, the Chamber considers that the amparo application must be dismissed because, consistent with this Court’s case law in similar cases, drinking water supply may be denied when legal and/or formal technical impossibility is established, as it is here; accordingly, the applicant’s fundamental rights have not been infringed. If the applicant is dissatisfied with the denial itself and the reasons supporting it, that concerns an issue of legality that cannot be addressed through this proceeding. Moreover, the Chamber confirms that the amparo beneficiary was expressly informed of the reasons why service authorization was not granted; therefore, her rights were not violated in that respect either” (emphasis in the original).\n\nIn light of the foregoing, it has been recognized that service providers may deny drinking water service when technical reasons justify doing so. The Chamber considers that the reason the respondent ASADA denied the service—in principle—is not arbitrary, but rather that no water capacity is available in front of the property in question.\n\nTherefore, if the reasons for the denial are untrue or inconsistent with technical and/or legal criteria, that is a dispute that must be resolved through the ordinary judicial channels.\n\nAccordingly, and consistent with this Chamber’s repeated precedents, the amparo application must be dismissed, without prejudice to the interested party bringing claims through the ordinary channels.\n\nIII.- DISSENTING VOTE OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, DRAFTED BY THE LATTER. In the present case, the Chamber majority dismisses the amparo application on the ground that institutions providing drinking water supply may validly reject or condition service requests if technical or legal reasons justify doing so. We dissent for the following reasons:\n\nArticle 50 of the Constitution provides that every person holds the basic, inalienable human right of access to drinking water, as an essential good for life. It adds that water is a national asset, indispensable to protect that human right. It also provides that water use, protection, sustainability, conservation, and exploitation are governed by the law to be enacted for these purposes, and that the supply of drinking water for the consumption of individuals and communities has priority.\n\nBased on the foregoing, it is clear that the constitutionally established priority given to the supply of drinking water requires the competent entities to adopt appropriate measures to ensure that this public service is provided equally, continuously, and efficiently. This also requires the relevant adaptation or ability to change, so that, within a framework of reasonableness, infrastructure and technology may be adjusted to society’s new requirements and to changes in nature.\n\nAccordingly, we consider that more information is needed to establish or rule out whether a constitutionally significant infringement occurred in this case that would warrant the Chamber’s intervention.\n\nIV. DOCUMENTATION SUBMITTED TO THE CASE FILE. The Chamber must notify the parties that if they submitted any paper documents, objects, or evidence stored on any additional device or in electronic, computer, magnetic, optical, telematic, or new technology format, these must be collected from the court office within 30 business days after receipt of notice of this judgment. Otherwise, all such materials will be destroyed in accordance with the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the agreement approved by the Judiciary’s Superior Council at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe amparo application is summarily dismissed. Justices Cruz Castro and Rueda Leal dissent and order that the amparo proceeding be heard.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
