  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-013342-0007-CO \n\nRes. Nº 2026033777\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de setiembre de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita en expediente nro. 26-013342-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nResultando:\n\n1.- Por escrito recibido en la Secretaría de la Sala el 17 de abril de 2026, el recurrente interpone recurso de amparo contra la CCSS. Alega: “I. Que desde el año 2016 soy propietario de la filial 10 del Condominio el Cortijo y la vivienda se ha destinado a casa de habitación familiar. Como máximo han vivido 3 personas en la casa de manera simultánea, todos miembros de mi familia. n. El suministro de agua de dicha vivienda se identifica con el NIS [Valor 002] III. Durante mi estancia en este condominio tanto mi familia como yo ha mantenido una convivencia sana con los demás condóminos. En ningún momento se ha tenido conflicto o sanción alguna por nuestros comportamientos, siempre se ha manteniendo (sic) una relación cordial y amigable con los vecinos. IV. Como parte de las actividades comunes de una familia, la filial 10 siempre ha mantenido un consume de agua proporcional a la cantidad de personas presentes en la vivienda, en ningún momento se ha requerido realizar un consumo extraordinario o desproporcionado al volumen de personas presentes. V. Que desde el año 2025. por razones personales, mi hija y yo no vivimos más en la casa, y a día de hoy solo vive una persona cercana a la tercera edad, circunstancia que reduce todavía más el consume ordinario esperable. VI. A pesar de lo anterior, a partir del año 2025 el consumo facturado comenzó a incrementarse de manera sustancial y atípica, por montos superiores a los históricos normales de la vivienda. VII. En coordinación con la administración del condominio se llevó a cabo una investigación técnica, en cuyo curso se identificó una fuga ubicada en un área común del condominio, fuera de mi propiedad individual. VIII. Como solución a este inconveniente, se construyó una caja de registro independiente que facilita la locación de fugas. IX. A raíz de un análisis pericial se determinó que, desde años anteriores, se ban estado pagando montos de agua totalmente desproporcionados al consumo, generando una diferencia mensual atribuible a la fuga de ¢18,860.91 (dieciocho mil ochocientos sesenta colones con noventa y un céntimos) por mes entre los años 2022 a 2024. Generando así, en total, un monto pagado de más de ¢396,079.03 (trescientos noventa y seis mil setenta y nueve colones con tres céntimos). Esto puede verse constatado por medio del escrito con fecha 25 de junio del 2025 que se ofrece como Prueba 1. X. Mediante gestión escrita de fecha 25 de junio de 2025 solicite el reconocimiento y reintegro de los montos pagados en exceso por el consumo anómalo asociado a dicha fuga, acompañando análisis pericial consolidado. XL En respuesta posterior, la administración y la Junta Directiva admitieron que la fuga se encontraba en área común y que el condominio asumiría el costo de la reparación respectiva; no obstante, negaron el reintegro de los montos cobrados por el consumo reflejado en el medidor de la filial. (Prueba 2). XII. Que durante el mes de enero del 2026 la administración del condominio realizó la reparación que había sido reportada: “La fuga se encontraba en un área común, sobre la calle principal del condominio, por lo que el condominio procedió a realizar los trabajos necesarios para su reparación, los cuales incluyeron el cambio de la tubería y demás labores requeridas para solucionar el problema. Posteriormente, se le indico al propietario de la filial 10 que el condominio asuma la responsabilidad por la reparación de la fuga, dado que esta se encontraba en área común. No obstante, se le explico que el consumo de agua generado como consecuencia de dicha fuga corresponde al medidor de su filial, por lo que la gestión del cobro del recibo debe realizarla directamente el propietario ante el AYA, ya sea mediante un arreglo de pago, solicitud de revisión del cobro o cualquier otro procedimiento que dicha institución determine.” XIII. Sin embargo, aun después de dicha reparación, los cobros continuaron siendo extraordinarios y desproporcionados, incluyendo un recibo de Acueductos y Alcantarillados (AyA) con vencimiento al 4 de marzo de 2026 por la suma de Cl24.914,00 y otro con fecha de factura 17 de marzo de 2026 por la suma de C92.677,00. XIV. El 2 de marzo de 2026 dirigí nueva gestión a la administración y a la Junta Directiva solicitando, entre otros extremes, confirmación del alcance de la reparación, plan de verificación de nuevas fugas, atención de los recibos con sobrecargo y una solución urgente para evitar que el suministro de agua se viera afectado en la Casa 10 (Prueba 4 y 5). XV. Por medio de la sesión 0223, la administración del condominio acordó no asumir el pago de dicho recibo debido a que (Prueba 6): “(…) la política aplicada en situaciones similares ha sido que el condominio se responsabiliza por la reparación de la fuga cuando esta se encuentra en área común, pero no por el pago del consumo de agua reflejado en el medidor de la filial. Asimismo, se señala que en ocasiones anteriores otras filiales han atravesado situaciones similares, y en esos casos los propietarios han gestionado directamente con el AYA los arreglos o revisiones correspondientes.” XVI. Con fecha 9 de marzo de 2026 insistí! por escrito en la necesidad de una respuesta integral, solicité informe técnico detallado de la reparación, cronograma de revisión del estado general de cañerías y manifesté expresamente mi imposibilidad de asumir los montos extraordinarios derivados de estos excesos de consumo. En la misma gestión hice constar que la consulta realizada ante AyA arrojo como respuesta que las fugas dentro de la propiedad o red interna no eran cubiertas por esa vía, lo cual, lejos de resolver el problema, reforzo la necesidad de una solucion interna del condominio cuando el origen del consumo anómalo se encontraba en infraestructura común (Prueba 7). XVII. Como resultado de lo anterior y ante la imposibilidad de asumir tales montos, en la Orden de Servicio número 54156954, con fecha de edición 8 de abril de 2026, vinculada al NIS [Valor 002], el ICAA dispuso la desconexión del servicio por la factura del 17 de marzo de 2026 por ¢92.677,00 (noventa y dos mil seiscientos setenta y siete colones), más cargos de desconexión y reconexión por ¢5.272,00 (cinco mil doscientos setenta y dos colones), estableciendo un saldo total acumulado de ¢217.591,00 (doscientos diecisiete mil quinientos noventa y un colones) (Prueba 8). Cabe mencionar que, aunque el servicio figura registralmente a nombre de CONDOPROYECTOS ROCA DEL OESTE S.A., corresponde materialmente al abastecimiento de la filial 10 del Condominio El Cortijo, de mi propiedad, y soy directamente afectado por la suspensión. XVIII. A la fecha de este recurso el servicio de agua se encuentra cortado en la filial 10, lo que afecta de manera directa y grave la vida diaria de la persona cercana a la tercera edad que reside en dicha vivienda. XIX. La escritura constitutiva y reglamento del Condominio Residencial El Cortijo define como área común, entre otros extremes, “el terreno en que se asienta la edificación, los cimientos, las paredes maestras, techos, aceras, vía interna de acceso, instalaciones de electricidad, de agua, cloacas, tanques sépticos, tablero de medidores eléctricos, vías de acceso exterior tanto vehicular como peatonal y los muros”. Asimismo, establece que “en la zona de acceso vehicular y peatonal, en forma subterránea, están ubicadas las tuberías de abastecimiento de agua, las tuberías de salida de aguas negras y las aguas pluviales, todas con sus respectivas cajas de registro”. El mismo reglamento dispone además que cada propietario debe contribuir al pago de los gastos comunes mediante cuotas mensuales y que son gastos comunes, entre otros, los de “administración, mantenimiento, cuido, vigilancia y limpieza del edificio y los bienes comunes”, los servicios especiales del área común y “las reparaciones y mejoras que se realicen en el edificio o en los bienes comunes” (Prueba 9). XX. Inversiones Florem F.M.R. S.A., como administradora del condominio, es la encargada material de la gestión de dichas áreas comunes y reporta a la Junta Directiva del Condominio El Cortijo. XXL Se manifiesta y se acude a esta vía con el propósito de hallar reparo en este tema, los montos excesivos y el proceder de la administración ban obstaculizado el acceso a este recurso hasta el punto que se ha desconectado el servicio de agua en mi vivienda, en donde ahora solo vive una persona cercana a la tercera edad, afectando sustancialmente su calidad de vida y sus derechos fundamentales (Prueba 10). SOLICITUD DE MEDIDA CAUTELAR Con fundamento en la naturaleza urgente del amparo y en la existencia de una lesión actual al derecho fundamental al agua, solicito se dicte de inmediato medida cautelar para que: • El ICAA restablezca provisionalmente y sin dilación el servicio de agua potable en la filial 10, NIS [Valor 002], o, en su defecto, asegure una medida de abastecimiento temporal suficiente, continua y digna mientras se resuelve el presente recurso; • El ICAA se abstenga de ejecutar o mantener nuevas medidas de suspensión relacionadas con los montos controvertidos mientras no exista una revisión técnica y administrativa suficiente del caso; • La administradora recurrida y la Junta Directiva del Condominio El Cortijo realicen, coordinen y documenten de inmediato las gestiones técnicas y administrativas necesarias para cesar la lesión actual, incluyendo la entrega del informe técnico complete de la reparación ejecutada en enero de 2026 y la programación de una revisión integral de la red común vinculada al NIS [Valor 002]. La urgencia es manifiesta, pues actualmente el servicio está cortado y en la vivienda reside una persona adulta mayor cuya vida cotidiana, higiene y salud dependen de la continuidad del abastecimiento de agua potable. ALEGATOS PRIMERO: ACERCA DE LAS FUNCIONES DE LA ADMINISTRACION DEL CONDOMINIO Y SU RESPONSABILIDAD CON EL ACCESO AL AGUA Parte esencial de la interposición de un recurso de amparo contra un sujeto de derecho privado se encuentra en que la relación de los sujetos debe tener ciertas características básicas, el artículo 57 de la Ley de la Jurisdicción Constitucional dicta que: “Artículo 57. El recurso de amparo también se concederá contra las acciones u omisiones de sujetos de Derecho Privado, cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedies jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a), de esta ley. (...)” (resaltado no pertenece al original). Por lo tanto, para poder tener clara la procedencia del amparo, se considera necesario exponer como la relación entre el condominio y mi persona cumplen con los requisitos del articulo supra citado. En primer lugar, los condominios per se son una forma de propiedad inmobiliaria donde coexisten áreas de propiedad exclusiva y zonas comunes. Al estar presentes distintos titulares, estos son gestionados por un administrador que representa y regula las áreas comunes con el propósito de cumplir con el reglamento interne, aplicar las disposiciones legales, gestionar las áreas comunes y administrar los gastos. Teniendo en cuenta lo anterior, para asegurar el bienestar de todos los condóminos, la Ley Reguladora de los Condominios estableció una serie de condiciones funcionales y estructurales que deben cumplirse: “ARTICULO 35.- Todo condominio, según su tipo, deberá llenar al menos los siguientes requisitos: (...) b) Estar provisto de un conducto, a través de todos los pisos, que permita el paso de las instalaciones de agua potable, aguas servidas, aguas pluviales y aguas negras, electricidad y otras. Este conducto será parte de las áreas comunes. (...) d) Todas las edificaciones, ya sean de desarrollo horizontal o vertical, deberán construirse según las normas que exijan las leyes respectivas.” El punto anterior guarda extrema importancia para el caso en concreto, los conductos para abastecer el agua de cada filial, siempre y cuando se encuentre fuera de estas, se ven afectadas por el adecuado mantenimiento de las áreas comunes puesto a que el condómino no puede acceder a estas áreas a como le plazca, y menos hacer arreglos en estas tuberías. De lo anterior podría extraerse que, si existe una avería en uno de los conductos, el costo de su reparación corresponde al condominio y no al propietario de la filial; siendo fundamental hacer hincapié en que: “ARTICULO 19.- Son gastos comunes: (...) c) Los gastos por administración, mantenimiento, reparación y limpieza de las regularan los que se en el reglamento. d) El costo de las mejoras realizadas en las cosas comunes, debidamente autorizadas por la Asamblea de Condóminos. (...)” (resaltado no pertenece al original). Ahora, aterrizando en lo que nos concierne, el presente amparo se interpone debido a la reiterada e ineficiente conducta por parte de la administración con relación a la reparación de distintas fugas que se ban dado en mi propiedad (filial 10 del condominio El Cortijo). Mi familia y yo vivimos de manera conjunta en este condominio por más de diez años, somos una familia de tres, y siempre hemos mantenido un consumo de agua normal. Como prueba de ello, invito a esta respetable Sala a ver la Prueba 3.1, es una recopilación de varios comprobantes de pago realizados al AyA entre los años 2020 y 2026. Con base en los datos recopilados entre los años 2020 y 2024, se puede extraer que en esta casa habitacional se pagaba en promedio alrededor de C 28,075.41 (veintiocho mil setenta y cinco colones con cuarenta y un céntimos), esto si bien resulta algo elevado, lo llegamos a considerar como nuestro consumo normal y proporcional al ritmo de vida que llevábamos en ese entonces. Sin embargo, el asunto que hoy me trae ante esta Sala surge de las facturas correspondientes a los años 2025 y 2026 en donde se ha dado un incremento sustancial y volátil en las facturas pagadas. El costo por consumo de agua en la filial 10 empezó a aumentar injustificadamente a pesar de que ahora solo vivía una persona en la casa. Las facturas por consumo de agua llegaron a un promedio aproximado de C 53,787.67 (cincuenta y tres mil setecientos ochenta y siete colones con sesenta y siete céntimos). Como resultado de lo anterior, se procedió el día veinticinco de junio del dos mil veinticinco a manifestar que (Prueba 1): la “Durante varios meses, los consumes de agua en mi residencia se presentaron con cifras inusualmente elevadas, que, ante la imposibilidad de detectar fallas internas, me vi en la obligación de asumir de buena fe y siempre con la consideración de buen vecino, pensando que también el condominio estaba pasando por una difícil situación financiera -situación que ustedes vinieron a revertir muy exitosamente No obstante, cuando los montos facturados alcanzaron niveles absolutamente desproporcionados, procedí a realizar una investigación técnica más detallada, con la cual finalmente se identificó la fuga mencionada cuando la administración contrató a un detector de fugas que dio con ubicación. Como solución definitiva, se construyó una caja de registro independiente que beneficia la locación de fugas, medida que desde entonces ha permitido no solo un control más riguroso del consume individual, sino que también ha servido para beneficiar a otras viviendas del condominio que presentaban situaciones similares. A continuación los montos estimados de ese periodo por el consumo irregular: Análisis pericial Consolidado Final-Pagos Agua NIS [Valor 002] (2022-2024) Promedios Globales Promedio mensual en condiciones normales: ¢18,318.82 Promedio mensual en periodos con fuga o consumo anómalo: ¢37,179.72 Diferencia mensual atribuible a fuga: ¢l8,860.91 Impacto Económico Estimado Total pagado de más en ese periodo: ¢396,079.03 Pd. Si se requieren los recibos, me lo indica por favor. Si bien la detección de esta fuga se dio hace ya varies meses y en su momento no gestione el cobro de estos excesos, confiando en el espíritu de buena convivencia y considerando que la reparación ya representaba un avance, hoy me veo en la necesidad impostergable de presentar esta solicitud formal. Esto, entre otras cosas, se debe a que recientemente se presentó una nueva fuga, esta vez dentro de mi propiedad, pero que fue detectada desde el medidor siendo reportada por la administración, aun y cuando no es su entera responsabilidad, realizan inspecciones constantemente con lo cual se pudo realizar una actuación temprana, cosa que no sucedió la vez pasada. Por estas razones, y con el mayor respeto, apelando el sentido de responsabilidad y el hacer lo que es correcto, solicito a la administración el reconocimiento y reintegro total de los montos asociados al exceso de consumo provocado por la fuga original, debidamente documentados y que se resumen en el análisis adjunto. Considero que este pedido es legítimo y se basa en los principios de corresponsabilidad y equidad que deben regir en toda comunidad condominal.” Sobre esto es esencial reiterar el hecho de que ya desde años anteriores al 2025 se estaba pagando una diferencia mensual significativa atribuible a la fuga de ¢396,079.03 (trescientos noventa y seis mil setenta y nueve colones con tres céntimos), por lo que mi acceso al agua se ha estado viendo obstaculizado desde hace años. Ante esto la señora Rebeca Chaves Flores, en su condición de representante legal del condominio El Cortijo, se pronunció respecto al escrito anterior estableciendo, dentro de lo que nos interesa, lo siguiente: inusuales “Luego de una revisión detallada, nos permitimos aclarar y comunicar lo siguiente: 1. Responsabilidad de reporte oportuno: Es responsabilidad de cada propietario informar de inmediato a la administración sobre cualquier anómala o sospecha de fuga en su propiedad. La actual administración lleva un año en funciones y no recibió en ese tiempo notificación alguna de su parte relacionada con consumos sospechas o de fuga. 2. Cobertura de reparaciones: Conforme a las políticas internas y la práctica del condominio, cuando se identifica una fuga fuera del límite de una vivienda y en un área común, la administración asume el costo de la reparación correspondiente. Sin embargo, el consumo de agua facturado debe ser cubierto por cada propietario, tal como lo establece el contrato con la entidad prestadora del servicio (Acueductos y Alcantarillados). En caso de considerar que dicho consumo fue anómalo por una causa externa, el proceso correspondiente es directamente presentar el reclamo ante dicha entidad. 3. Tuberías en áreas comunes: Todas las tuberías del condominio, por diseño, transitan por áreas comunes. No obstante, ello no implica que toda fuga sea automáticamente responsabilidad del condominio, ya que el origen del daño debe ser determinado a tiempo y con claridad. El hecho de que una tubería pase por un área común no significa que el daño sea atribuible al condominio si no se reportó oportunamente o no se identificó con precisión su causa. 4. Mejoras en infraestructura: En el último año se han implementado mejoras, como la instalación de cajas de registro, precisamente para facilitar la detección de este tipo de problemas. Lamentablemente, cuando una fuga no es reportada a tiempo, es imposible determinar con certeza si el consume excesivo se debió exclusivamente a una fuga externa o si también influyeron factores internos o domestico en el uso del agua. 5. Limitaciones presupuestarias: De acuerdo con el Reglamento del Condominio y la Ley Reguladora de la Propiedad en Condominio, el presupuesto anual se aprueba en Asamblea y está destinado al mantenimiento y operación de áreas comunes. No contempla la posibilidad de asumir consumos individuales de agua o reembolsos por servicios públicos que corresponden a cada filial. Por todo lo anterior, lamentamos informarle que el condominio no puede asumir ni reembolsar el monto solicitado, ya que hacerlo constituiría un precedente que compromete la estabilidad financiera del fondo común y va en contra de las responsabilidades individuales que corresponden a cada propietario. Comprendemos su preocupación, sin embargo, la Junta Directiva tiene la obligación de actuar conforme a la normativa vigente y con equidad hacia todos los propietarios. En ese sentido, es importante señalar que varias filiales ban enfrentado situaciones similares con fugas de agua en los últimos anos, y cada una ha asumido la responsabilidad correspondiente por los consumos generados. Confiamos en su comprensión, recordando que el fondo común debe velar por el bienestar colectivo y no está destinado a cubrir gastos particulares de filiales. las Agradecemos su comprensión.” (resaltado no pertenece al original) El monto por consume de agua se mantuvo a la alza desde ese entonces, impidiendo cada vez más mi acceso a este recurso. Esto continue hasta que se volvió algo insostenible, como puede apreciarse en la Prueba 5, el costo por el consume de agua en mi casa llego a ser de ¢124,914.00 (ciento veinticuatro mil novecientos catorce colones); ya para este punto resultaba completamente improcedente, inadecuado e imposible mantenerse al día con un costo tan alto si se suponga que desde la última carta la administración había estado realizando arreglos, debido a esto, procedí a escribir el siguiente escrito (Prueba 4): “ Estimados Por medio de la presente, y con el fin de manejar el tema de forma ordenada y preventiva, les informo que se adjunta el recibo de AyA correspondiente a la Casa 10, el cual señores: vence el 4 de marzo de 2026. Dado que en meses anteriores ya se venían presentando sobrecargos y que se me indico que las reparaciones fueron realizadas, agradecería su apoyo con lo siguiente: 1. Confirmar por escrito el alcance de la reparación efectuada (que se reparó y en qué zona/tramo) y el plan de verificación para prevenir nuevas fugas o consumos atípicos. 2. Indicar el mecanismo que aplicara el condominio para atender los recibos anteriores infraestructura con sobrecargo (reintegro, acreditación o compensación, según corresponda). 3. Con respecto al recibo adjunto con vencimiento 4/03/2026, agradeceremos nos confirmen que medidas adoptaran para que el suministro de agua no se vea afectado en la Casa 10, considerando que el monto no corresponde a un consume normal atribuible a la vivienda, sino a consumos atípicos asociados a común. Para poder actuar a tiempo, les agradecería su respuesta a más tardar el 3 de marzo de 2026, indicando el responsable asignado y los pasos seguir. Quedo atento. Agradezco de antemano su colaboración. (...)” (resaltado no pertenece al original). a Contra este escrito la administración mantuvo su posición, estableciendo en la minuta de la sesión 0223 de la Junta Directiva (Prueba 6): “La Junta Directiva acuerda que el condominio no asumirá el pago de dicho recibo, ya que la política aplicada en situaciones similares ha sido que el condominio se responsabiliza por la reparación de la fuga cuando esta se encuentra en área común, pero no por el pago del consumo de agua reflejado en el medidor de la filial. Asimismo, se señala que en ocasiones anteriores otras filiales ban atravesado situaciones similares, y en esos casos los propietarios ban gestionado directamente con el AYA los arreglos o revisiones correspondientes. (...)” (resaltado no pertenece al original). Ante la negación de la administración, como ultimo escrito, presente la carta con fecha 09 de marzo de 2026 en donde manifiesto la imposibilidad que se me estaba generando para poder pagar este recurso: “(...) Adicionalmente, y con el mayor respeto, les recuerdo que no estoy en posibilidad de asumir ni asumiré los montos extraordinarios derivados de estos excesos de consumo. En consecuencia, si como resultado de la falta de gestión oportuna de este asunto llegara a presentarse una afectación o suspensión del suministro de agua en la Casa 10, agradeceré se tenga por entendido que dicha situación seria imputable a la Administración y Junta Directiva, en el marco de sus competencias y deberes de administración y mantenimiento de la infraestructura común. (...)” Tal y como se puede apreciar en la Prueba 8, el Ay A procedió a desconectar el servicio de agua en la filial 10, ahora también con otro importe excesivo correspondiente al mes de marzo por ¢92,677.00 (noventa y dos mil seiscientos setenta y siete colones). Desde entonces, en la casa 10 no ha habido servicio de agua, afectando sobre manera el derecho humano de acceso al agua. Este proceder de la Administración considero genero una evidente violación a mis derechos fundamentales, quebrantando así lo estipulado en el artículo 50 de nuestro Texto Fundamental: “(...) Toda persona tiene el derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El agua es un bien de la nación, indispensable para proteger tal derecho humano. Su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que establezca la ley que se creará para estos efectos y tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones.” (resaltado no pertenece al original). La administradora recurrida y la Junta Directiva del Condominio El Cortijo concentran el control material y jurídico sobre las áreas comunes, la red de tuberías que discurre por dichas áreas, los trabajos de mantenimiento, la contratación de reparaciones y las decisiones de gestión relativas a las fugas fuera de la propiedad individual. El condómino no puede, por sí mismo, excavar, sustituir tuberías, intervenir calles internas ni ordenar reparaciones en zonas comunes. Existe, por tanto, una posición de poder de hecho y de derecho respecto del problema que origina la lesión. Con base en esto es que se presenta el amparo. Considero que se cumplen con los requisitos necesarios para implementar esta figura. En primer lugar, me encuentro en una situación en donde las acciones de la administración del condominio deben ir acorde a lo que la misma Ley Reguladora de la Propiedad en Condominio otorga como potestades y deberes, cosa que no se está cumpliendo teniendo en cuenta la normativa supra citada. En segundo lugar, se está dando una clara violación a un derecho fundamental, se me está imposibilitando cada vez más acceder al agua, por lo que urge acudir a esta instancia para hallar una solucion pronta y cumplida, no por temas económicos, sino por el resguardo de mis derechos fundamentales. La vía ordinaria civil o condominal seria claramente tardía para evitar la lesión actual, pues el derecho vulnerado no es solo el patrimonio del recurrente, sino el acceso presente y continue al agua potable. La privación del servicio ya está ocurriendo hoy, por lo que la tutela debe ser inmediata. SEGUNDO: VIOLACION AL DERECHO FUNDAMENTAL DE ACCESO AL AGUA POR PARTE DE LOS RECURRIDOS PRIVADOS Con el propósito de dilucidar mejor el quebrantamiento generado en mi contra, es imperante establecer una relación causal entre las medidas aplicadas por el condominio y el impacto que estas ban tenido con relación a los montos de consumo excesivo cobrados por el AyA. En primera instancia, debe tenerse claro el concepto de área común. Tal y como se ha mencionado supra, al leer los artículos 35 inciso b) y 19 inciso c) de la Ley Reguladora de la Propiedad en Condominio los conductos destinados a dar paso a las instalaciones locales se encuentran en las áreas comunes y que, de hecho, el costo de reparación y mantenimiento son un gasto común que debe ser asumido por el condominio puesto a que el área debe de mantenerse en condiciones apropiadas. Sobre este punto es fundamental hacer hincapié en lo siguiente. Las tuberías de suministro de agua del condominio están por debajo del único y principal acceso con salidas a las calles norte y sur de la cuadra, siendo ambas salidas usadas con muy alta frecuencia. Como resultado de esto es que se han generado varias fugas en las tuberías. El condominio cuenta con un total de 34 filiales y la gran mayoría tienen como mínimo un vehículo, lógicamente, este acceso es usado con frecuencia. Por lo que constantemente ocurren esta clase de problemas con otros condóminos. Al condominio aceptar la reparación de la tubería y negar la retribución del dinero pagado de más como resultado de una fuga en área común genera un evidente nexo causal equivalente. La fuga generada en un área común a cargo de la administración causo, desde un inicio, un quebrantamiento de mi derecho fundamental el cual se fue agravando hasta el punto que a día de hoy se me imposibilita acceder al recurso. Lo anterior, además de encontrar sustento en los artículos supra citados, también tiene un sustento factico puesto a que la misma administración es la que asume la responsabilidad de la reparación de las tuberías cuando existen fugas (Pruebas 2 y 6). Por lo tanto, la falta del deber de cuidado por parte de la administración ha obstaculizado paulatinamente el acceso al agua hasta el punto en que, a día de hoy, se ha imposibilitado acceder a ella como consecuencia de los montos excesivos los cuales no representan el consumo real. A todas luces, el quebranto de este derecho fundamental es consecuencia directa de las conductas omisivas de la administración. Cabe enfatizar que, si bien el condominio ha implementado “medidas al respecto” la realidad es que estos montos siguen llegando altos, la administración continúa asumiendo las “reparaciones” (evidenciando así su falta al deber de cuidado) y continúan negándose a reembolsar el daño económico generado el cual, conforme el pasar de los meses, se ha incrementado hasta el punto en que no puedo permitirme asumir esos sobrecostos y se me ha imposibilitado acceder al recurso. Conforme a los hechos narrados y a la prueba documental ofrecida, los consumes extraordinarios continuaron después de las reparaciones y desembocaron en la suspensión actual del servicio. Esa continuidad es decisiva: demuestra que la lesión al derecho fundamental no es histórica ni abstracta, sino presente, actual y agravada. No estamos hablando de solo una fuga, sino de reiteradas fugas que se mantienen en supuestas reparaciones. Ya se ha tardado más de un ano en resolver este problema, cada vez empeora más la situación y ya se llegó al punto en que se cortó el servicio, todo esto producto de las fugas ubicadas en áreas comunes del condominio. Lo anterior no solo demuestra una ineficiencia por parte de la administración a la hora de resolver este tema, sino que deja totalmente claro que no se le da un mantenimiento apropiado a las áreas comunes del condominio. La obligación del condominio de mantener áreas comunes no se satisface con ejecutar trabajos aislados si, pese a ello, persiste una situación que termina privando a una vivienda del acceso al agua potable. Cuando el régimen condominal concentra las decisiones técnicas y administrativas sobre la red común, también concentra la responsabilidad constitucional de no permitir que ese esquema termine anulando un derecho humano básico. TERCERO: RESPECTO A LA VIOLACION DEL DERECHO FUNDAMENTAL PRODUCTO DE LAS ACTUACIONES OMISIVAS DEL ICAA Considero que el quebrantamiento de este derecho fundamental lleva consigo responsabilidad del Instituto Costarricense de Acueductos y Alcantarillados al ser este el ente rector encargado de dirigir y vigilar todo lo concerniente para proveer a los habitantes de agua potable. Aun cuando pudiera existir una discusión administrativa sobre el origen del consume reflejado en el medidor, el AyA no podía desentenderse del componente constitucional del caso ni limitar su actuación a la sola emisión y cobro de facturas, para terminar con la suspensión del servicio, sin adoptar una revisión material suficiente y sin considerar que la vivienda afectada está ocupada por una persona adulta mayor (…) CUARTO: SOBRE LA NATURALEZA NO MERAMENTE PATRIMONIAL DEL CASO Este recurso no persigue, en esta sede, una condena patrimonial plena ni la liquidación definitiva de daños y perjuicios. Los montos pagados en exceso se exponen como contexto factico de un patrón de sobreconsumos anómalos y como antecedente explicativo de la lesión actual. El núcleo del amparo es la privación presente del acceso al agua potable y la necesidad urgente de una tutela efectiva. Sin perjuicio de lo anterior, me reservo expresamente el derecho de reclamar en la vía correspondiente cualquier reintegro, indemnización, compensación o responsabilidad patrimonial que corresponda respecto de los montos cobrados o pagados en exceso. ACLARACIONES SOBRE LAS PRUEBAS 3.1 Y 6 Sin perjuicio de lo anteriormente expuesto, y únicamente con el propósito de facilitar una valoración precisa de la prueba documental ofrecida, se deja expresamente aclarado lo siguiente: 1. La Prueba 3.1 se aporta con carácter ilustrativo y comparativo del patrón histórico de cobros asociados al NIS [Valor 002]. En caso de que, por error material, se hubiere incorporado algún comprobante ajeno a dicho servicio, se solicita tenerlo por no ofrecido únicamente a esos efectos, manteniéndose el resto de la prueba en todo lo que resulte pertinente. 2. La Prueba 6 se aporta en cuanto refleja materialmente el acuerdo adoptado sobre el tema de agua de la filial 10, coincidente con los hechos aquí expuestos. Cualquier discrepancia en el encabezado del documento corresponde al formato interno utilizado y no desvirtúa su pertinencia ni su contenido sustancial para el presente caso. PETITORIA Con base en los hechos y el derecho expuesto se solicita que: 1. Se admita para tramite el presente recurso de amparo. 2. Que, como medida cautelar, se ordene al ICAA restablecer de inmediato el servicio de agua potable en la filial 10 del Condominio El Cortijo, NIS [Valor 002], o, en su defecto, asegurar un abastecimiento temporal suficiente, continue y digno mientras se resuelve el presente recurso. 3. Que se declare con lugar el recurso por violación al derecho humano de acceso al agua potable del recurrente y de la persona residente en la filial 10. 4. Que se ordene a la administradora recurrida y a quien ostente la Presidencia de la Junta Directiva del Condominio El Cortijo adoptar de inmediato las gestiones técnicas y administrativas necesarias para cesar la lesión denunciada. 5. Que se ordene a los recurridos privados entregar un informe técnico complete de la reparación ejecutada en enero de 2026, con detalle del tramo intervenido, trabajo realizado, materiales sustituidos, fechas, responsable técnico y pruebas realizadas, así como un cronograma de revisión integral de la red común vinculada a la filial 10. 6. Que se deje a salvo el derecho del recurrente para reclamar en la vía correspondiente cualquier reintegro, compensación, indemnización o responsabilidad patrimonial que estime procedente”.\n\n 2.- Por escrito incorporado al expediente electrónico el 29 de mayo de 2026, el recurrente alega: “Como es de su conocimiento, este recurso se fundamenta en la imposibilidad de mi persona para pagar la factura del agua debido a una fuga que no me compete y que la administradora del condominio se ha rehusado a asumir, a día de hoy una persona cercana a la tercera edad se encuentra habitando en esa casa y esta limitación al derecho fundamental está perjudicando su calidad de vida. Esta situación ha generado una carga económica significativa y ha llevado a que, hasta la fecha, no se haya logrado efectuar el pago correspondiente de este recurso fundamental. Dado que ha transcurrido más de un mes desde la presentación del escrito de interposición, y versando este alrededor de la obstaculización que se ha generado para poder acceder a este recurso; solicitamos de manera respetuosa una actualización sobre el estado del recurso y que se tomen las medidas necesarias para resolver esta situación a la brevedad posible”.\n\n3.- Por escrito incorporado al expediente electrónico el 4 de junio de 2026, el recurrente alega: “I. HECHO SOBREVENIDO: PREVENCIÓN DE COBRO EMITIDA POR EL ICAA Con fecha 25 de mayo de 2026, el Instituto Costarricense de Acueductos y Alcantarillados emitió una Prevención de Cobro (Secuencia N, 0 709158) dirigida al NIS [Valor 002], correspondiente al suministro de agua de la filial 10 del Condominio El Cortijo, de mi propiedad. En dicho documento, la institución recurrida informa que el saldo adeudado asciende a la suma de ¢223,548.36 por concepto de prestación del servicio de agua potable y alcantarillado, monto que excluye potenciales multas adicionales que se facturarían al momento del pago. La Prevención de Cobro advierte expresamente que la cuenta se encuentra en condición de elegible para el proceso de Cobro Administrativo, otorgando un plazo máximo de cinco días hábiles para normalizar el estado de cuenta, ya sea mediante arreglo de pago o cancelación total. Asimismo, advierte que, de no atenderse dentro de dicho plazo, se procederá con la gestión de cobro administrativo y judicial conforme a los artículos 121 y 122 del Reglamento para la Prestación de los Servicios del AYA, incluyendo la posibilidad de interponer demanda hipotecaria o monitoria contra el inmueble. II. GRAVEDAD DE LA SITUACIÓN ECONÓMICA DEL RECURRENTE Esta nueva Prevención de Cobro agrava de manera significativa la situación que fue expuesta ante esta Honorable Sala en el recurso de amparo. El monto ahora exigido (¢223,548.36) representa el acumulado de facturas cuyo origen es, precisamente, la controversia que se somete al conocimiento de esta Sala: consumos extraordinarios y desproporcionados derivados de fugas en tuberías ubicadas en áreas comunes del condominio, cuya atención, reparación y mantenimiento corresponden a la administración condominal conforme a los artículos 19 y 35 de la Ley Reguladora de la Propiedad en Condominio. Para el suscrito, cancelar o incluso gestionar un arreglo de pago sobre dicha suma en las condiciones actuales representa un esfuerzo económico considerable e irrazonable, máxime cuando el propio fundamento del amparo es la imposibilidad de asumir montos que no reflejan el consumo real de la vivienda. El consumo histórico normal de la filial 10 no superaba los ¢28.075.41 mensuales. Las facturas que integran el saldo ahora reclamado (algunas superiores a y ¢124,000.00) son producto de anomalías en la infraestructura común, no del uso doméstico de sus habitantes. La exigencia de cancelar (o comprometerse a pagar) un monto que el propio proceso constitucional cuestiona como ilegítimo en su origen coloca al recurrente en una posición de manifiesta indefensión: o paga montos que no le corresponden, o enfrenta un proceso de cobro judicial que podría gravar su propiedad con una hipoteca forzosa. Ninguna de estas opciones es compatible con la tutela efectiva de un derecho fundamental que está siendo analizado por esta misma Sala. III. URGENCIA DEL PRONUNCIAMIENTO CONSTITUCIONAL La emisión de esta Prevención de Cobro, con un plazo de respuesta de apenas cinco días hábiles y la amenaza expresa de cobro judicial (incluyendo juicio hipotecario o monitorio sobre el inmueble), acredita que la lesión al derecho fundamental no solo persiste, sino que se agrava con el transcurso del tiempo. Cada día adicional sin una resolución constitucional incrementa la deuda, consolida el proceso de cobro en sede administrativa y aproxima la actuación judicial que podría comprometer el patrimonio del recurrente de forma irreversible. Es imperioso recordar que en la vivienda reside actualmente una persona cercana a la tercera edad, cuyo acceso al agua potable ya fue interrumpido como consecuencia de la misma controversia. El servicio permanece desconectado, y ahora además se amenaza con iniciar un proceso de cobro judicial sobre la vivienda que la alberga. La confluencia de estas circunstancias (corte del servicio, vulnerabilidad del habitante y amenaza patrimonial inminente) eleva la urgencia de este caso a niveles que demandan atención prioritaria por parte de esta Honorable Sala. El derecho humano al agua, reconocido en el artículo 50 de la Constitución Política y en la Observación General N. 0 15 del Comité de Derechos Económicos, Sociales y Culturales, exige que su accesibilidad económica sea real y efectiva. Una tutela que llega una vez ejecutado el cobro judicial y consolidada la lesión patrimonial no sería una tutela oportuna ni adecuada. La naturaleza del amparo es, precisamente, la de una garantía rápida y eficaz frente a lesiones actuales y concretas de derechos fundamentales. IV. SOLICITUD Con fundamento en lo expuesto, solicito respetuosamente a esta Honorable Sala: 1. Tener por comunicado el hecho sobrevenido consistente en la emisión de la Prevención de Cobro N.° 709158 por parte del ICAA, de fecha 25 de mayo de 2026, con saldo de ¢223,548.36, amenaza de cobro administrativo en cinco días hábiles y eventual proceso judicial hipotecario o monitorio sobre la filial 10 del Condominio El Cortijo. 2. Resolver con carácter urgente el presente recurso de amparo, o en su defecto, ampliar o reforzar la medida cautelar ya solicitada, a fin de que el ICAA se abstenga de continuar o iniciar acciones de cobro administrativo o judicial sobre los montos controvertidos mientras no exista pronunciamiento firme de esta Sala. 3. Que se ordene de manera inmediata el restablecimiento del servicio de agua potable en la filial 10, NIS [Valor 002], en tanto se resuelve el fondo del presente recurso, evitando así que la persona adulta mayor residente continúe privada de este recurso vital. La tutela de los derechos fundamentales pierde su razón de ser si no es oportuna. Confío en que esta Honorable Sala, en resguardo del derecho humano al agua y de los principios constitucionales de eficacia y celeridad de la justicia, atenderá el presente escrito con la prontitud que la situación exige”. \n\n4.- Por resolución dictada a las 21:15 horas del 19 de junio de 2026, la Presidencia de la Sala dio curso al amparo y solicitó informe al subgerente de gestión de sistemas GAM del Instituto Costarricense de Acueductos y Alcantarillados. \n\n5.- Por escrito incorporado al expediente electrónico el 3 de julio de 2026, informa bajo juramento Randall Campos Rojas en su condición de subgerente gestión de sistemas GAM del Instituto Costarricense de Acueductos y Alcantarillados. Expone: “Con fundamento en el informe técnico elaborado por Jorge Mauricio Matamoros Pérez, funcionario de la UEN Servicio al Cliente Zona III GAM No. UEN-SCZIII-GAM 2026-00442 de fecha 2 de julio del 2026, que es agregado como prueba y forma parte integral del expediente administrativo, queda demostrado que: PRIMERO. Según la base de datos del Sistema Comercial Integrado OPEN S.C.I., la propiedad registra el servicio NIS [Valor 002] facturado a nombre de 3-101-714681 Sociedad Anónima, Provincia de San José, Escazú, San Rafael, Dirección Condominio El Cortijo Apartamento N°10, tarifa de agua Residencial, 1 unidad habitacional. (Ver informe técnico No. UEN-SCZIII-GAM-2026-00442 de fecha 2 de julio del 2026). SEGUNDO: De la información incorporada al Sistema Comercial Integrado OPEN S.C.I, tenemos que el servicio identificado con el NIS [Valor 002], facturado a nombre de 3-101 714681 Sociedad Anónima no registra órdenes asociadas a fuga, ni reparación de fuga. (Ver informe técnico No. UEN-SCZIII-GAM-2026-00442 de fecha 2 de julio del 2026). TERCERO: De la información incorporada al Sistema Comercial Integrado OPEN S.C.I, tenemos que el servicio identificado con el NIS [Valor 002], facturado a nombre de 3-101 714681 Sociedad Anónima, entre los periodos del 17/10/2022 al 17/07/2023 registró altos consumos, atendidos oportunamente y con fundamento en el artículo 95 del Reglamento para la Prestación de los Servicios del AyA y en los resultados obtenidos en las ordenes de servicio generadas por Revisión de Hidrómetro y Conexión del servicio, por lo que según el Acuerdo de Junta Directiva de AyA No. 2021-154, del 24 de marzo de 2021, de la Sesión Extraordinaria 2021-21, aprobado mediante Acuerdo de Junta Directiva No. 442 del 8 de diciembre de 2020 y publicado en la Gaceta No. 27 del 9 de febrero del 2021 para regular la aplicación de ajustes a las facturaciones con consumos fuera de parámetros normales de cada servicio, se aplicó ajustes transitorios a los periodos afectados del 17/10/2022, 18/04/2023, 17/05/2023 y 16/06/2023. (Ver informe técnico No. UEN-SCZIII-GAM-2026-00442 de fecha 2 de julio del 2026). CUARTO. Posteriormente, con la orden de servicio No. 46608717 Prueba Volumétrica se determinó: Hidrómetro Fuera de la tolerancia Permitida, por lo que con fundamento en el artículo No. 97 inciso iii) del Reglamento de la Prestación de los Servicios del AyA se procedió a modificar el periodo del 17/08/2023. (Ver informe técnico No. UEN-SCZIII GAM-2026-00442 de fecha 2 de julio del 2026). QUINTO. Mediante las órdenes de servicio realizadas entre el 28/09/2023 y 04/12/2023, se determinó: Revisión de Hidrómetro y Conexión del servicio Hidrómetro no registra fugas ni flujo de agua, por lo que con fundamento en el artículo No. 95 del Reglamento de la Prestación de los Servicios del AyA se aplicó ajustes a los periodos del 16/11/2023, 18/09/2023 y 15/04/2025. Del monto generado, se suscribió un Arreglo de Pago por ¢143.136.00, más intereses de ¢5.142.00 para un total de ¢148.278.00 con una prima del 20% de ¢29.655.76 y 11 cuotas de ¢10.783.90 mismo que a la fecha se encuentra cancelado. (Ver informe técnico No. UEN-SCZIII-GAM-2026-00442 de fecha 2 de julio del 2026). SEXTO. De acuerdo con la información obtenida del Sistema Comercial, en el servicio identificado con el NIS [Valor 002] se realizaron ajustes y modificaciones de acuerdo con el Reglamento de la Prestación de los Servicios del AyA, y en lo que respecta a las fugas registradas dentro del inmueble, es responsabilidad exclusiva del usuario el buen mantenimiento de las redes de cañerías internas, por lo tanto, el AyA no asumirá responsabilidad alguna por los altos consumos que se facturen producto de la existencia de fugas dentro de una propiedad, tal como lo indican los artículos 8 y 104 inciso a) del Reglamento de Prestación de Servicios del AyA; Con relación al actuar de la Junta Directiva y de la administración del condominio, lo que resuelvan estos órganos no es competencia de AyA. (Ver informe técnico No. UEN SCZIII-GAM-2026-00442 de fecha 2 de julio del 2026). SETIMO. Indicar en este aparte que el Reglamento de la Prestación de los Servicios del AyA, en el artículo 108 dispone las causas para la suspensión del servicio de agua, entre estas la “…Falta de pago del servicio, posterior al cumplimiento de la fecha de cancelación de la factura, siempre y cuando en la facturación entregada o dispuesta al abonado en el lugar o medio señalado, se indique la fecha de vencimiento. Posterior a ello, la suspensión se hará efectiva antes de la siguiente facturación, en caso de subsistir el incumplimiento de pago;”, para el caso de marras, según el Sistema Comercial Integrado OPEN S.C.I el servicio identificado con el NIS [Valor 002] presenta al día de hoy por factura vencida un pendiente de ¢217.591.00, de ahí la suspensión del servicio. II. CONCLUSIONES En el presente caso queda demostrado que AyA ha ejecutado y realizado todas las acciones que corresponden al ámbito de su competencia y dentro del marco de legalidad que nos rige, realizando los ajustes y modificaciones a las facturaciones cuando las mismas cumplían con los lineamientos reglamentarios y en el caso de las fugas que se presentaron en el servicio NIS [Valor 002] al ser originadas al interior del Condominio, no existe causas imputables al AyA, ni están sujetas a modificaciones, ni rectificaciones, por lo que con fundamento en lo expuesto, se concluye que este Recurso carece de fundamento técnico, legal y reglamentario, ya que AyA ha cumplido con las obligaciones impuestas por imperio de ley en el marco constitucional y legal por el principio de legalidad, por ende, no se ha violentado ningún derecho constitucional a la recurrente (…) PETITORIA Con fundamento en la normativa citada y de la prueba que aporto en este acto, solicito respetuosamente a su Autoridad DECLARE SIN LUGAR el este Recurso de Amparo y se exima de toda responsabilidad y condenatoria en costas, daños y perjuicios al AyA”. \n\n6.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\nConsiderando:\n\nI.- Objeto del recurso. El recurrente alega que es propietario de la filial 10 del Condominio El Cortijo, en la que vive solo una persona. Menciona que el consumo de agua asociado al NIS [Valor 002] históricamente se mantuvo proporcional a la cantidad de habitantes; sin embargo, se ha registrado un consumo anómalo derivado de una fuga de agua, la cual se encontraba en un área común del condominio. Menciona que en enero de 2026, se ejecutó la reparación de una fuga en el área común; empero, persistieron los cobros elevados, a saber: un recibo con vencimiento el 4 de marzo de 2026 por ₡124.914,00 y otro del 17 de marzo de 2026 por ₡92.677,00. Al respecto, menciona que la administración y junta directiva del condominio rechazaron la devolución de los montos facturados por consumo reflejado en el medidor individual, situación con la que se encuentra disconforme. Además, aduce que el Instituto Costarricense de Acueductos y Alcantarillados emitió la orden de servicio nro. 54156954 el 8 de abril de 2026, en la que dispuso la desconexión del suministro por falta de pago, estableciendo un saldo acumulado de ₡217.591 más cargos por desconexión y reconexión. Menciona que, al día en que interpone el recurso, el servicio de agua se encuentra suspendido en la filial 10, situación que afecta directamente a la residente de la vivienda. Solicita la intervención de la Sala. \n\nII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:\n\na) El recurrente es propietario de la casa 10 del condominio El Cortijo, con NIS [Valor 002] (véase informe y prueba aportada).\n\nb) En orden de servicio 54156954 del 8 de abril de 2026, al recurrente se le indicó: “Le informamos que además del recibo por el cual se suspende el servicio, usted tiene una deuda pendiente de pago según detalle adjunto, por lo que lo instamos a que normalice su situación con AyA. En caso contrario se procederá con el trámite usual para interponer el COBRO JUDICIAL con las consecuencias legales y pecuniarias que este implica por la vía judicial se demandará a todos los que aparezcan como responsables de la correspondiente deuda, por medio de apremio patrimonial. Asimismo le recordamos que la deuda proveniente del servicio de cañería y alcantarillado impone HIPOTECA LEGAL sobre el bien o bienes en que recae la obligación de pagarlo, de conformidad con el artículo 12 de la Ley General de Agua Potable (No. 1634), pudiendo culminar el proceso con el REMATE JUDICIAL de los bienes del responsable. Respecto a la orden de corta número 64156954. Se detalla a continuación la lista de facturas pendientes y último mes puesto al cobro:\n\nServicio\n\nFactura de Facturación \n\nImporte ¢\n\nEstado\n\n5255608\n\n18/02/2026\n\n124.914.00\n\nProceso de corte detenido \n\n5255608\n\n17/03/2026\n\n92.677.00\n\nOrden de corta\n\n \n\nTotal recibos ¢\n\n217,591.00\n\n \n\nSr.(a) cliente, en este documento no se incluyen los cargos por desconexión y reconexión; para el trámite de la reconexión del servicio, además del monto arriba indicado, usted deberá cancelar, LOS CARGOS POR TARIFA DE DESCONECIÓN Y RECONEXIÓN POR UN MONTO DE: ¢5272.00” (véase prueba aportada).\n\nIII.- Hecho no probado. No logra acreditarse el siguiente hecho, de importancia para la resolución de este asunto:\n\nÚnico. Que tras la suspensión del servicio de agua potable, el Instituto Costarricense de Acueductos y Alcantarillados haya colocado una fuente pública a no más de 50 metros de la entrada del condominio en cuestión. \n\nIV.- Sobre el caso concreto. En el sub lite, el recurrente alega que es propietario de la filial 10 del Condominio El Cortijo, en la que vive solo una persona. Menciona que el consumo de agua asociado al NIS [Valor 002] históricamente se mantuvo proporcional a la cantidad de habitantes; sin embargo, se ha registrado un consumo anómalo derivado de una fuga de agua, la cual se encontraba en un área común del condominio. Menciona que en enero de 2026, se ejecutó la reparación de una fuga en el área común; empero, persistieron los cobros elevados, a saber: un recibo con vencimiento el 4 de marzo de 2026 por ₡124.914,00 y otro del 17 de marzo de 2026 por ₡92.677,00. Al respecto, menciona que la administración y junta directiva del condominio rechazaron la devolución de los montos facturados por consumo reflejado en el medidor individual, situación con la que se encuentra disconforme. Además, aduce que el Instituto Costarricense de Acueductos y Alcantarillados emitió la orden de servicio nro. 54156954 el 8 de abril de 2026, en la que dispuso la desconexión del suministro por falta de pago, estableciendo un saldo acumulado de ₡217.591 más cargos por desconexión y reconexión. Menciona que, al día en que interpone el recurso, el servicio de agua se encuentra suspendido en la filial 10, situación que afecta directamente a la residente de la vivienda. Solicita la intervención de la Sala.\n\nAl respecto, sobre la suspensión del suministro de agua potable por morosidad, esta Sala se ha pronunciado, en reiteradas oportunidades. Por ejemplo, en la sentencia nro. 2020003446 de las 9:30 horas del 21 de febrero del 2020, indicó lo siguiente:\n\n“La posición de este Tribunal Constitucional en cuanto a recursos de amparo en los que se cuestiona la suspensión del suministro de agua potable, ha sido reiterada en el sentido de admitir que las instituciones administradoras de los acueductos públicos pueden suspender el servicio a sus abonados, siempre y cuando los usuarios se encuentren en mora en el pago de las tarifas establecidas, pues los requisitos legales y reglamentarios que debe reunir el posible consumidor no pueden soslayarse si son razonables. A pesar de lo anterior, este Tribunal ha establecido la necesidad de que, si va a proceder a cortar el suministro regular, el A y A o la Asociación Administradora deje a disposición del interesado una fuente pública a corta distancia, donde pueda abastecerse del vital líquido, pues al estar de por medio el derecho a la salud, derivado del artículo 21 de la Constitución Política, el servicio de agua potable debe de estar al alcance de toda persona”.\n\nPor otra parte, también ha aclarado que la suspensión procede por la falta de pago del último importe mensual. En sentencia nro. 2016012075 de las 9:30 horas del 26 de agosto del 2016, lo indicó así en los siguientes términos:\n\n“ (…) Esta Sala también ha indicado, de forma reiterada, que la suspensión, únicamente, procede por la falta de pago oportuno del último importe mensual, por cuanto los meses anteriores que se adeuden deberán ser cobrados, separadamente, por la vía correspondiente. Así, por ejemplo, en sentencia número 2003-06565 de las 15:29 hrs. de 8 de julio de 2003, se indicó: “Este Tribunal se ha referido a otra condición para que la suspensión del servicio de agua sea constitucionalmente legítimo, indicando que no puede privarse al administrado de éste si se ha cancelado el último recibo vencido, toda vez que no procede por esa vía exigir la obligación total o parcial del monto adeudado” .\n\nAsí las cosas, en el sub lite se estima que la desconexión del servicio se hizo con base en las potestades que tiene la autoridad recurrida, como ente operador del servicio de agua potable, por morosidad. Es menester indicar que, si bien existe un derecho fundamental de acceso al agua potable, este no es gratuito, por lo que la autoridad recurrida cuenta con la potestad de suspender el servicio, en caso de que los administrados no cancelen los montos que se adeuden por este concepto. Nótese que el recurrente no aduce haber cancelado el último recibo vencido y se le denegara el restablecimiento del servicio. \n\nEn ese sentido, véase que de la orden de servicio 54156954 del 8 de abril de 2026, al recurrente se le indicó: “Le informamos que además del recibo por el cual se suspende el servicio, usted tiene una deuda pendiente de pago según detalle adjunto, por lo que lo instamos a que normalice su situación con AyA. En caso contrario se procederá con el trámite usual para interponer el COBRO JUDICIAL con las consecuencias legales y pecuniarias que este implica por la vía judicial se demandará a todos los que aparezcan como responsables de la correspondiente deuda, por medio de apremio patrimonial. Asimismo le recordamos que la deuda proveniente del servicio de cañería y alcantarillado impone HIPOTECA LEGAL sobre el bien o bienes en que recae la obligación de pagarlo, de conformidad con el artículo 12 de la Ley General de Agua Potable (No. 1634), pudiendo culminar el proceso con el REMATE JUDICIAL de los bienes del responsable. Respecto a la orden de corta número 64156954. Se detalla a continuación la lista de facturas pendientes y último mes puesto al cobro:\n\nServicio\n\nFactura de Facturación \n\nImporte ¢\n\nEstado\n\n5255608\n\n18/02/2026\n\n124.914.00\n\nProceso de corte detenido \n\n5255608\n\n17/03/2026\n\n92.677.00\n\nOrden de corta\n\n \n\nTotal recibos ¢\n\n217,591.00\n\n \n\n De tal documento se desprende que la suspensión del servicio obedece al último recibo y no a la deuda total, lo cual fue debidamente comunicado al tutelado.\n\n Ahora bien, si el recurrente se encuentra disconforme con el monto de los cobros por el servicio de agua potable, debe advertir que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto por pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En igual sentido, tampoco le corresponde a esta Sala revisar la decisión de la administración y junta directiva del condominio donde se encuentra el inmueble de no devolver los montos cobrados al recurrente por concepto de agua potable, por tratarse de una cuestión de mera legalidad. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones, si estas fueren procedentes. \n\nEn consecuencia, en cuanto a este extremo, no se observa alguna situación de raigambre constitucional que amerite la intervención de la Sala en este momento. \n\nV.- Por otra parte, esta Sala observa que una de las pretensiones del recurrente es que: “se ordene al ICAA restablecer de inmediato el servicio de agua potable en la filial 10 del Condominio El Cortijo, NIS [Valor 002], o, en su defecto, asegurar un abastecimiento temporal suficiente, continuo y digno mientras se resuelve el presente recurso”. \n\n Al respecto, como se indicó en la sentencia transcrita anteriormente, la jurisprudencia de esta Sala ha determinado que, si se da la suspensión del servicio de agua potable, las autoridades deben instalar una fuente pública a una distancia no mayor a 50 metros, en resguardo de los derechos fundamentales y de las necesidades básicas de los usuarios; sin embargo, en el sub examine no se acredita que esto haya ocurrido. \n\nEn consecuencia, se declara parcialmente con lugar el recurso solo en cuanto a este extremo.\n\nVI.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.\n\nPor tanto:\n\nSe declara parcialmente con lugar el recurso solo por la omisión de garantizar el acceso a una fuente pública de agua potable tras la suspensión del servicio. Se le ordena a Randall Campos Rojas en su condición de subgerente gestión de sistemas GAM del Instituto Costarricense de Acueductos y Alcantarillados, o a quien ocupe ese cargo, que gire las instrucciones necesarias, coordine lo pertinente y disponga lo correspondiente dentro del ámbito de sus competencias respectivas para asegurar que, en caso de que no se haya hecho, DE FORMA INMEDIATA se instale una fuente pública a una distancia máxima de 50 metros de la entrada del Condominio El Cortijo. Se advierte a la autoridad recurrida, que de acuerdo con el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia ante la jurisdicción contencioso-administrativa.   "body_en_text": "Document Review\n\n\n\nExp: 26-013342-0007-CO \n\nRes. Nº 2026033777\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 3 September 2026.\n\nAmparo proceeding filed under case no. 26-013342-0007-CO, brought by [Nombre 001], identity card [Valor 001], against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\nBackground:\n\n1.- In a written submission received by the Chamber’s Secretariat on 17 April 2026, the amparo applicant files an amparo proceeding against the CCSS. The applicant alleges: “I. Since 2016, I have owned unit 10 of Condominio el Cortijo, and the dwelling has been used as a family residence. At most, 3 people have lived in the house at the same time, all members of my family. n. The water supply for that dwelling is identified by NIS [Valor 002] III. During my stay in this condominium, both my family and I have maintained a healthy relationship with the other condominium owners. At no time have we had any conflict or been sanctioned for our behavior; we have always maintained a cordial and friendly relationship with our neighbors. IV. As part of a family’s ordinary activities, unit 10 has always maintained water consumption proportional to the number of people living in the dwelling; at no time has it been necessary to use an extraordinary or disproportionate volume of water relative to the number of people present. V. Since 2025, for personal reasons, my daughter and I have no longer lived in the house, and today only a person nearing old age lives there, which further reduces the ordinary consumption that could be expected. VI. Despite the foregoing, beginning in 2025 the billed consumption began to increase substantially and atypically, to amounts above the dwelling’s normal historical levels. VII. In coordination with the condominium administration, a technical investigation was carried out, during which a leak was identified in a common area of the condominium, outside my individual property. VIII. As a solution to this problem, an independent inspection box was built to facilitate locating leaks. IX. An expert analysis determined that, for years, water charges had been paid in amounts wholly disproportionate to consumption, resulting in a monthly difference attributable to the leak of ¢18,860.91 (eighteen thousand eight hundred sixty colones and ninety-one céntimos) per month between 2022 and 2024. This resulted in a total overpayment of ¢396,079.03 (three hundred ninety-six thousand seventy-nine colones and three céntimos). This can be confirmed by the written submission dated 25 June 2025, offered as Evidence 1. X. By written request dated 25 June 2025, I requested recognition and reimbursement of amounts overpaid for anomalous consumption associated with that leak, attaching a consolidated expert analysis. XL In a subsequent response, the administration and Board of Directors acknowledged that the leak was in a common area and that the condominium would bear the cost of the corresponding repair; however, they denied reimbursement of the amounts charged for the consumption recorded by the unit’s meter. (Evidence 2). XII. During January 2026, the condominium administration carried out the reported repair: ‘The leak was in a common area, on the condominium’s main road, so the condominium proceeded to carry out the work necessary to repair it, which included replacing the pipe and other work required to solve the problem. The owner of unit 10 was subsequently informed that the condominium would assume responsibility for repairing the leak, since it was in a common area. However, he was told that the water consumption resulting from that leak is recorded by his unit’s meter, so the owner must handle collection of the bill directly with AyA, whether through a payment arrangement, a request for review of the charge, or any other procedure that institution may determine.’ XIII. However, even after that repair, the charges continued to be extraordinary and disproportionate, including an Acueductos y Alcantarillados (AyA) bill due 4 March 2026 for Cl24.914,00 and another bill dated 17 March 2026 for C92.677,00. XIV. On 2 March 2026, I submitted a new request to the administration and Board of Directors seeking, among other things, confirmation of the scope of the repair, a plan to check for new leaks, attention to the surcharged bills, and an urgent solution to prevent the water supply to House 10 from being affected (Evidence 4 and 5). XV. At session 0223, the condominium administration agreed not to pay that bill because (Evidence 6): ‘(…) the policy applied in similar situations has been for the condominium to take responsibility for repairing a leak when it is in a common area, but not for paying the water consumption recorded by the unit’s meter. It is also noted that other units have faced similar situations on previous occasions, and in those cases the owners have dealt directly with AyA to arrange the corresponding payment plans or reviews.’ XVI. On 9 March 2026, I insisted in writing on the need for a comprehensive response, requested a detailed technical report on the repair and a schedule for reviewing the general condition of the pipes, and expressly stated that I could not pay the extraordinary amounts resulting from this excess consumption. In the same request, I recorded that an inquiry to AyA had been answered by saying that leaks within the property or internal network were not covered through that channel. This, far from solving the problem, reinforced the need for an internal condominium solution when the anomalous consumption originated in common infrastructure (Evidence 7). XVII. As a result of the foregoing and because I could not pay those amounts, in Service Order number 54156954, issued 8 April 2026 and associated with NIS [Valor 002], the ICAA ordered disconnection of the service for the bill dated 17 March 2026, in the amount of ¢92.677,00 (ninety-two thousand six hundred seventy-seven colones), plus disconnection and reconnection charges of ¢5.272,00 (five thousand two hundred seventy-two colones), establishing a total accumulated balance of ¢217.591,00 (two hundred seventeen thousand five hundred ninety-one colones) (Evidence 8). It should be noted that, although the service is registered in the name of CONDOPROYECTOS ROCA DEL OESTE S.A., it materially supplies unit 10 of Condominio El Cortijo, which I own, and I am directly affected by the suspension. XVIII. As of the date of this application, the water service to unit 10 is disconnected, directly and seriously affecting the daily life of the person nearing old age who lives in that dwelling. XIX. The constitutive deed and regulations of Condominio Residencial El Cortijo define common areas to include, among other things, ‘the land on which the building stands, foundations, load-bearing walls, roofs, sidewalks, internal access road, electricity, water and sewer installations, septic tanks, electrical meter board, exterior access roads for vehicles and pedestrians, and walls.’ They also provide that ‘the water supply pipes, wastewater outlet pipes, and stormwater pipes, all with their respective inspection boxes, are located underground in the vehicle and pedestrian access area.’ The same regulations further provide that each owner must contribute to common expenses through monthly assessments, and that common expenses include, among other things, ‘administration, maintenance, care, security, and cleaning of the building and common property,’ special services for the common area, and ‘repairs and improvements carried out in the building or on common property’ (Evidence 9). XX. Inversiones Florem F.M.R. S.A., as condominium administrator, is materially responsible for managing those common areas and reports to the Board of Directors of Condominio El Cortijo. XXL This application is made to obtain redress in this matter. The excessive amounts and the administration’s conduct have obstructed access to this remedy to the point that the water service to my dwelling has been disconnected. Only a person nearing old age now lives there, substantially affecting that person’s quality of life and fundamental rights (Evidence 10).\n\nREQUEST FOR PRECAUTIONARY MEASURE\n\nIn view of the urgent nature of the amparo and the existence of a current injury to the fundamental right to water, I request that a precautionary measure be issued immediately so that:\n\n• The ICAA provisionally and without delay restores the potable water service to unit 10, NIS [Valor 002], or, alternatively, ensures a sufficient, continuous, and dignified temporary supply while this amparo proceeding is resolved;\n\n• The ICAA refrains from carrying out or maintaining new suspension measures related to the disputed amounts until there has been a sufficient technical and administrative review of the case;\n\n• The respondent administrator and the Board of Directors of Condominio El Cortijo immediately undertake, coordinate, and document the technical and administrative steps necessary to end the current injury, including delivery of the complete technical report on the repair carried out in January 2026 and scheduling a comprehensive inspection of the common network associated with NIS [Valor 002].\n\nThe urgency is evident, since the service is currently disconnected and an older adult lives in the dwelling, whose daily life, hygiene, and health depend on continuity of the potable water supply.\n\nARGUMENTS\n\nFIRST: THE FUNCTIONS OF THE CONDOMINIUM ADMINISTRATION AND ITS RESPONSIBILITY FOR ACCESS TO WATER\n\nAn essential aspect of bringing an amparo proceeding against a private-law person is that the relationship between the parties must have certain basic characteristics. Article 57 of the Ley de la Jurisdicción Constitucional provides: ‘Article 57. An amparo proceeding shall also be granted against the actions or omissions of private-law persons when they act or are required to act in the exercise of public functions or powers, or when they are, in law or in fact, in a position of power against which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights or freedoms referred to in Article 2(a) of this law. (…)’ (emphasis not in the original). Therefore, to clarify whether the amparo is available, it is considered necessary to explain how the relationship between the condominium and me meets the requirements of the above-cited article.\n\nFirst, condominiums per se are a form of real property ownership in which areas of exclusive ownership and common areas coexist. Because there are different owners, these properties are managed by an administrator who represents and regulates the common areas for the purpose of complying with the internal regulations, applying legal provisions, managing common areas, and administering expenses. In view of the foregoing, to ensure the well-being of all condominium owners, the Ley Reguladora de los Condominios established a series of functional and structural requirements that must be met: ‘ARTICLE 35.- Every condominium, according to its type, shall meet at least the following requirements: (…) b) Be equipped with a conduit running through all floors that allows passage of potable water, wastewater, stormwater, and sewage installations, electricity, and others. This conduit shall be part of the common areas. (…) d) All buildings, whether horizontal or vertical developments, shall be built in accordance with the standards required by the applicable laws.’\n\nThe foregoing is extremely important to this case. The conduits supplying water to each unit, when located outside the units, are affected by the proper maintenance of common areas, since a condominium owner cannot access those areas at will, much less carry out repairs to those pipes. It could be inferred from the foregoing that, if a conduit is damaged, the cost of its repair falls to the condominium, not the unit owner. It is essential to emphasize that: ‘ARTICLE 19.- Common expenses are: (…) c) Expenses for administration, maintenance, repair, and cleaning shall be governed by the regulations. d) The cost of improvements made to common property, duly authorized by the Condominium Owners’ Assembly. (…)’ (emphasis not in the original).\n\nTurning to the matter at hand, this amparo is brought because of the administration’s repeated and inefficient conduct concerning repairs to various leaks that have occurred on my property (unit 10 of Condominio El Cortijo). My family and I lived together in this condominium for more than ten years. We are a family of three, and we have always maintained normal water consumption. As evidence of this, I invite this respected Chamber to review Evidence 3.1, a compilation of several payment receipts made to AyA between 2020 and 2026. Based on the data compiled between 2020 and 2024, it can be determined that the average amount paid for this dwelling was around C 28,075.41 (twenty-eight thousand seventy-five colones and forty-one céntimos). Although this was somewhat high, we came to consider it normal consumption, proportional to the way of life we had at that time. However, the matter bringing me before this Chamber today arises from the bills for 2025 and 2026, when a substantial and volatile increase occurred in the amounts paid. The cost of water consumption in unit 10 began to rise without justification, despite only one person now living in the house. Water consumption bills reached an approximate average of C 53,787.67 (fifty-three thousand seven hundred eighty-seven colones and sixty-seven céntimos). As a result, on the twenty-fifth of June of two thousand twenty-five, I stated the following (Evidence 1):\n\n‘For several months, water consumption at my residence appeared at unusually high levels. Unable to detect internal faults, I felt obliged to pay in good faith and always with the consideration of a good neighbor, thinking that the condominium was also going through a difficult financial situation—a situation you have since reversed very successfully. However, when the billed amounts reached wholly disproportionate levels, I carried out a more detailed technical investigation, which ultimately identified the aforementioned leak after the administration hired a leak detector who located it. As a definitive solution, an independent inspection box was built to facilitate locating leaks. Since then, this measure has not only allowed more rigorous monitoring of individual consumption, but has also benefited other dwellings in the condominium that had similar situations. Below are the estimated amounts for that period of irregular consumption:\n\nFinal Consolidated Expert Analysis—Water Payments NIS [Valor 002] (2022-2024)\n\nGlobal Averages\n\nAverage monthly amount under normal conditions: ¢18,318.82\n\nAverage monthly amount during periods with a leak or anomalous consumption: ¢37,179.72\n\nMonthly difference attributable to the leak: ¢l8,860.91\n\nEstimated Economic Impact\n\nTotal overpaid for that period: ¢396,079.03\n\nP.S. If you need the receipts, please let me know.\n\nAlthough this leak was detected several months ago and I did not seek collection of these overpayments at the time, trusting in the spirit of good relations and considering that the repair already represented progress, today I find myself with no choice but to submit this formal request. This is due, among other things, to a new leak that recently occurred, this time within my property, but was detected from the meter and reported by the administration. Although it is not entirely their responsibility, they carry out inspections constantly, which made it possible to act early—something that did not happen the previous time. For these reasons, and with the utmost respect, appealing to a sense of responsibility and doing what is right, I ask the administration to recognize and fully reimburse the amounts associated with the excess consumption caused by the original leak, duly documented and summarized in the attached analysis. I consider this request legitimate and based on the principles of shared responsibility and equity that should govern every condominium community.’\n\nOn this point, it is essential to reiterate that, even in years before 2025, a significant monthly difference attributable to the leak was being paid, totaling ¢396,079.03 (three hundred ninety-six thousand seventy-nine colones and three céntimos), and therefore my access to water had been obstructed for years. In response to the foregoing submission, Ms. Rebeca Chaves Flores, in her capacity as legal representative of Condominio El Cortijo, stated, among other things, as follows:\n\n‘After a detailed review, we wish to clarify and communicate the following: 1. Responsibility for timely reporting: Each owner is responsible for immediately informing the administration of any anomaly or suspected leak on their property. The current administration has been in office for one year and received no notification from you during that time concerning suspected consumption or a suspected leak. 2. Repair coverage: Under the condominium’s internal policies and practice, when a leak is identified outside a dwelling’s boundary and in a common area, the administration assumes the cost of the corresponding repair. However, each owner must cover the billed water consumption, as established by the contract with the service provider (Acueductos y Alcantarillados). If you believe that the consumption was anomalous due to an external cause, the appropriate process is to file a claim directly with that entity. 3. Pipes in common areas: By design, all condominium pipes run through common areas. However, that does not mean that every leak is automatically the condominium’s responsibility, since the cause of the damage must be determined promptly and clearly. The fact that a pipe runs through a common area does not mean that damage is attributable to the condominium if it was not reported promptly or its cause was not precisely identified. 4. Infrastructure improvements: Over the last year, improvements have been implemented, such as installing inspection boxes, precisely to facilitate detection of these types of problems. Unfortunately, when a leak is not reported on time, it is impossible to determine with certainty whether the excessive consumption was due exclusively to an external leak or whether internal or domestic factors in water use also played a role. 5. Budgetary limitations: Under the Condominium Regulations and the Ley Reguladora de la Propiedad en Condominio, the annual budget is approved by the Assembly and is intended for maintenance and operation of common areas. It does not provide for assuming individual water consumption or reimbursing public utility services attributable to each unit. For all of the foregoing reasons, we regret to inform you that the condominium cannot assume or reimburse the requested amount, since doing so would establish a precedent that compromises the financial stability of the common fund and runs counter to the individual responsibilities of each owner. We understand your concern; however, the Board of Directors is obligated to act in accordance with the regulations in force and equitably toward all owners. In that regard, it is important to note that several units have faced similar situations involving water leaks in recent years, and each has assumed responsibility for the resulting consumption. We trust you understand that the common fund must serve the collective well-being and is not intended to cover individual unit expenses. We thank you for your understanding.’ (emphasis not in the original)\n\nThe amount charged for water consumption continued to rise from then on, increasingly obstructing my access to this resource. This continued until it became unsustainable. As can be seen in Evidence 5, the cost of water consumption at my house reached ¢124,914.00 (one hundred twenty-four thousand nine hundred fourteen colones). By this point it was wholly improper, inadequate, and impossible to stay current with such a high cost, particularly if, as the administration had stated in its last letter, it had been carrying out repairs. For this reason, I submitted the following written request (Evidence 4):\n\n‘Dear Sirs:\n\nI am writing to handle this matter in an orderly and preventive manner and to inform you that the AyA bill for House 10, due 4 March 2026, is attached. Since surcharges had already appeared in previous months and I was told that repairs had been carried out, I would appreciate your assistance with the following:\n\n1. Confirm in writing the scope of the repair performed (what was repaired and in which area or section) and the verification plan to prevent new leaks or atypical consumption.\n\n2. Indicate the mechanism the condominium will apply to address the previous bills with surcharges associated with the common infrastructure (reimbursement, credit, or offset, as applicable).\n\n3. Regarding the attached bill due 4/03/2026, please confirm what measures you will adopt to prevent the water supply to House 10 from being affected, considering that the amount does not correspond to normal consumption attributable to the dwelling, but to atypical consumption associated with common infrastructure.\n\nSo that I can act in time, I would appreciate your response no later than 3 March 2026, indicating the person responsible and the steps to follow. I await your response. Thank you in advance for your cooperation. (…)’ (emphasis not in the original)\n\nIn response to this submission, the administration maintained its position, stating in the minutes of Board of Directors session 0223 (Evidence 6): ‘The Board of Directors agrees that the condominium will not pay that bill, since the policy applied in similar situations has been for the condominium to take responsibility for repairing a leak when it is in a common area, but not for paying the water consumption recorded by the unit’s meter. It is also noted that other units have faced similar situations on previous occasions, and in those cases the owners have dealt directly with AyA to arrange the corresponding payment plans or reviews. (…)’ (emphasis not in the original).\n\nAfter the administration’s denial, as my last written submission, I presented the letter dated 09 March 2026, in which I stated that I was being made unable to pay for this resource:\n\n‘(…) Additionally, and with the utmost respect, I remind you that I am unable to pay and will not pay the extraordinary amounts resulting from this excess consumption. Consequently, if the failure to handle this matter promptly results in the water supply to House 10 being affected or suspended, please understand that such a situation would be attributable to the Administration and Board of Directors, within the scope of their powers and duties to administer and maintain common infrastructure. (…)’\n\nAs can be seen in Evidence 8, AyA proceeded to disconnect the water service to unit 10, now also citing another excessive amount for March of ¢92,677.00 (ninety-two thousand six hundred seventy-seven colones). Since then, there has been no water service at House 10, greatly affecting the human right of access to water. I consider that this conduct by the Administration generated an evident violation of my fundamental rights, thereby breaching the provisions of Article 50 of our Fundamental Charter: ‘(…) Every person has the basic and inalienable human right of access to potable water, as an essential good for life. Water is a good of the nation, indispensable to protect that human right. Its use, protection, sustainability, conservation, and exploitation shall be governed by the law to be enacted for these purposes, and priority shall be given to the supply of potable water for consumption by people and populations.’ (emphasis not in the original).\n\nThe respondent administrator and the Board of Directors of Condominio El Cortijo exercise material and legal control over common areas, the network of pipes running through those areas, maintenance work, the hiring of repair services, and management decisions relating to leaks outside individual property. A condominium owner cannot personally excavate, replace pipes, intervene in internal roads, or order repairs in common areas. They therefore hold a position of power, in fact and in law, with respect to the problem causing the injury. This is the basis for bringing this amparo. I consider that the requirements for this remedy are met. First, I am in a situation in which the condominium administration’s actions must conform to the powers and duties granted to it by the Ley Reguladora de la Propiedad en Condominio, which is not happening in light of the regulations cited above. Second, there is a clear violation of a fundamental right: my access to water is being increasingly impeded. It is therefore urgent to turn to this forum for a prompt and complete solution, not for economic reasons, but to safeguard my fundamental rights. Ordinary civil or condominium proceedings would clearly be too late to prevent the current injury, since the right violated is not only the applicant’s property interest, but also present and continuous access to potable water. The service is already being withheld, so protection must be immediate.\n\nSECOND: VIOLATION OF THE FUNDAMENTAL RIGHT OF ACCESS TO WATER BY THE PRIVATE RESPONDENTS\n\nTo better elucidate the violation against me, it is essential to establish a causal relationship between the measures taken by the condominium and their impact in relation to the excessive consumption amounts charged by AyA. First, the meaning of common area must be clear. As mentioned above, Articles 35(b) and 19(c) of the Ley Reguladora de la Propiedad en Condominio provide that conduits intended to carry utility installations are located in common areas and that, in fact, repair and maintenance costs are common expenses to be borne by the condominium, since those areas must be kept in proper condition. On this point, it is essential to emphasize the following. The condominium’s water supply pipes are beneath the sole main access, which has exits onto the north and south streets of the block, both of which are used very frequently. This has resulted in several leaks in the pipes. The condominium has a total of 34 units, and the vast majority have at least one vehicle; logically, this access is used frequently. Therefore, these problems constantly occur with other condominium owners. When the condominium accepts responsibility for repairing the pipe but denies reimbursement of the money overpaid as a result of a leak in a common area, it creates an evident equivalent causal link. The leak in a common area under the administration’s responsibility initially violated my fundamental right, and that violation worsened until, today, I am unable to access this resource. In addition to being supported by the articles cited above, this is supported by the facts, since the administration itself assumes responsibility for repairing pipes when leaks occur (Evidence 2 and 6). Therefore, the administration’s failure to exercise its duty of care has gradually obstructed access to water to the point that, today, access has been made impossible as a result of excessive amounts that do not reflect actual consumption. Clearly, the violation of this fundamental right is a direct consequence of the administration’s omissions. It should be emphasized that, although the condominium has implemented ‘measures in this regard,’ the reality is that these amounts continue to be high, the administration continues to assume the ‘repairs’ (thus demonstrating its failure to exercise its duty of care), and it continues to refuse to reimburse the resulting economic loss. As the months have passed, that loss has increased to the point that I cannot afford these excess charges and have been prevented from accessing the resource. Under the facts described and the documentary evidence offered, extraordinary consumption continued after the repairs and led to the current suspension of the service. That continuity is decisive: it shows that the injury to the fundamental right is not historical or abstract, but present, current, and aggravated. This is not just one leak, but repeated leaks that persist despite supposed repairs. More than one year has passed without resolving this problem, the situation keeps getting worse, and the service has now been disconnected, all as a result of leaks located in the condominium’s common areas. This not only demonstrates the administration’s inefficiency in resolving this matter, but also makes clear that the condominium’s common areas are not being properly maintained. The condominium’s obligation to maintain common areas is not satisfied by carrying out isolated work if, despite that work, a situation persists that ultimately deprives a dwelling of access to potable water. When the condominium regime centralizes technical and administrative decisions over the common network, it also centralizes the constitutional responsibility not to allow that arrangement to extinguish a basic human right.\n\nTHIRD: VIOLATION OF THE FUNDAMENTAL RIGHT RESULTING FROM THE ICAA’S OMISSIONS\n\nI consider that the violation of this fundamental right also entails responsibility on the part of the Costa Rican Institute of Aqueducts and Sewers, as the governing body responsible for directing and overseeing all matters concerning the provision of potable water to residents. Even if there could be an administrative dispute about the origin of the consumption recorded by the meter, AyA could not disregard the constitutional component of the case or limit its actions to merely issuing and collecting bills, ultimately suspending the service without conducting a sufficient substantive review and without considering that the affected dwelling is occupied by an older adult (…)\n\nFOURTH: THE CASE IS NOT MERELY PATRIMONIAL IN NATURE\n\nThis amparo does not seek, in this forum, a full patrimonial judgment or a final assessment of damages. The amounts overpaid are presented as factual context for a pattern of anomalous excess consumption and as background explaining the current injury. The core of the amparo is the present deprivation of access to potable water and the urgent need for effective protection. Without prejudice to the foregoing, I expressly reserve the right to seek, through the appropriate procedure, any reimbursement, compensation, or patrimonial liability that may apply to amounts charged or paid in excess.\n\nCLARIFICATIONS REGARDING EVIDENCE 3.1 AND 6\n\nWithout prejudice to the foregoing, and solely to facilitate an accurate assessment of the documentary evidence offered, the following is expressly clarified:\n\n1. Evidence 3.1 is submitted for illustrative and comparative purposes regarding the historical pattern of charges associated with NIS [Valor 002]. If, due to a clerical error, any receipt unrelated to that service was included, it is requested that it be deemed not offered solely for those purposes, with the rest of the evidence remaining in place insofar as relevant.\n\n2. Evidence 6 is submitted insofar as it materially reflects the agreement adopted regarding the water issue for unit 10, consistent with the facts set out here. Any discrepancy in the document’s heading is due to the internal format used and does not undermine its relevance or substantive content for this case.\n\nREQUEST FOR RELIEF\n\nBased on the facts and law set out, the following is requested:\n\n1. That this amparo proceeding be admitted for processing.\n\n2. That, as a precautionary measure, the ICAA be ordered to immediately restore the potable water service to unit 10 of Condominio El Cortijo, NIS [Valor 002], or, alternatively, to ensure a sufficient, continuous, and dignified temporary supply while this amparo proceeding is resolved.\n\n3. That the amparo be declared with merit due to violation of the applicant’s and the resident of unit 10’s human right of access to potable water.\n\n4. That the respondent administrator and whoever holds the Presidency of the Board of Directors of Condominio El Cortijo be ordered to immediately undertake the technical and administrative steps necessary to end the reported injury.\n\n5. That the private respondents be ordered to deliver a complete technical report on the repair carried out in January 2026, detailing the section worked on, the work performed, materials replaced, dates, technical lead, and tests performed, as well as a schedule for a comprehensive inspection of the common network connected to unit 10.\n\n6. That the applicant’s right to seek, through the appropriate procedure, any reimbursement, compensation, indemnity, or patrimonial liability deemed appropriate be reserved.’\n\n2.- In a written submission added to the electronic case file on 29 May 2026, the applicant alleges: ‘As you know, this amparo is based on my inability to pay the water bill because of a leak for which I am not responsible and which the condominium administrator has refused to assume. Today, a person nearing old age is living in that house, and this limitation on the fundamental right is harming that person’s quality of life. This situation has created a significant financial burden and has meant that, to date, payment for this fundamental resource has not been made. Since more than a month has passed since the filing of the initial submission, which concerns the obstruction that has arisen in accessing this resource, we respectfully request an update on the status of the amparo and that the necessary measures be taken to resolve this situation as soon as possible.’\n\n3.- In a written submission entered into the electronic case file on 4 June 2026, the amparo applicant alleges:\n\n“I. NEW DEVELOPMENT: COLLECTION NOTICE ISSUED BY ICAA\n\nOn 25 May 2026, the Instituto Costarricense de Acueductos y Alcantarillados (Costa Rican Institute of Aqueducts and Sewers) issued a Collection Notice (Sequence N, 0 709158) addressed to NIS [Valor 002], corresponding to the water supply for unit 10 of Condominio El Cortijo, which I own. In that document, the respondent institution reports that the outstanding balance is ¢223,548.36 for the provision of drinking water and sewer service, an amount that excludes potential additional charges that would be billed at the time of payment. The Collection Notice expressly warns that the account is eligible for the administrative collection process and grants a maximum of five business days to bring the account current, either by entering into a payment arrangement or paying the full amount. It also warns that, if the matter is not addressed within that period, administrative and judicial collection proceedings will be pursued under Articles 121 and 122 of the Regulations for the Provision of AyA Services, including the possibility of filing a mortgage-enforcement or payment-order claim against the property.\n\nII. SEVERITY OF THE APPLICANT’S FINANCIAL SITUATION\n\nThis new Collection Notice significantly worsens the situation presented to this Honorable Chamber in the amparo proceeding. The amount now demanded (¢223,548.36) is the accumulated total of bills whose origin is precisely the dispute submitted for this Chamber’s consideration: extraordinary and disproportionate consumption resulting from leaks in pipes located in the condominium’s common areas, whose care, repair, and maintenance are the responsibility of the condominium administration under Articles 19 and 35 of the Condominium Property Regulatory Law. For me, paying or even arranging payment of that amount under the current circumstances would be a considerable and unreasonable financial burden, particularly since the very basis of the amparo application is the impossibility of assuming amounts that do not reflect the home’s actual consumption. The normal historical consumption for unit 10 did not exceed ¢28.075.41 per month. The bills making up the balance now claimed (some exceeding ¢124,000.00) result from problems in the common infrastructure, not from the residents’ domestic use. The demand that I pay—or undertake to pay—an amount whose origin this constitutional proceeding itself challenges as illegitimate places the amparo applicant in a position of manifest defenselessness: either I pay amounts that I do not owe, or I face judicial collection proceedings that could encumber my property with a forced mortgage. Neither option is compatible with effective protection of a fundamental right currently under review by this same Chamber.\n\nIII. URGENCY OF A CONSTITUTIONAL RULING\n\nThe issuance of this Collection Notice, with a response period of only five business days and an express threat of judicial collection (including mortgage-enforcement or payment-order proceedings against the property), demonstrates that the violation of the fundamental right not only persists but worsens over time. Each additional day without a constitutional ruling increases the debt, advances the administrative collection process, and brings closer judicial action that could irreversibly compromise the amparo applicant’s assets. It is imperative to recall that a person approaching older age currently resides in the home, and that person’s access to drinking water has already been interrupted as a result of this same dispute. The service remains disconnected, and there is now also a threat to initiate judicial collection proceedings against the home where that person lives. The convergence of these circumstances (service disconnection, the resident’s vulnerability, and an imminent threat to property) raises the urgency of this case to a level requiring priority attention from this Honorable Chamber. The human right to water, recognized in Article 50 of the Political Constitution and in General Comment No. 15 of the Committee on Economic, Social and Cultural Rights, requires that its economic accessibility be real and effective. Protection that comes after judicial collection has been carried out and the violation of property rights has been finalized would not be timely or adequate protection. The nature of amparo is precisely that of a prompt and effective guarantee against current and concrete violations of fundamental rights.\n\nIV. REQUEST\n\nOn the basis of the foregoing, I respectfully ask this Honorable Chamber to:\n\n1. Take notice of the new development, namely the issuance by ICAA of Collection Notice No. 709158, dated 25 May 2026, with a balance of ¢223,548.36, a threat of administrative collection within five business days, and the possibility of mortgage-enforcement or payment-order judicial proceedings against unit 10 of Condominio El Cortijo.\n\n2. Issue an urgent ruling on this amparo application or, alternatively, expand or strengthen the provisional measure already requested, so that ICAA refrains from continuing or initiating administrative or judicial collection actions for the disputed amounts until this Chamber issues a final ruling.\n\n3. Order the immediate restoration of drinking water service to unit 10, NIS [Valor 002], while the merits of this application are resolved, thereby preventing the older adult residing there from continuing to be deprived of this vital resource.\n\nProtection of fundamental rights loses its purpose if it is not timely. I trust that this Honorable Chamber, safeguarding the human right to water and the constitutional principles of effective and expeditious justice, will address this submission promptly, as the situation requires.”\n\n4.- By order issued at 21:15 on 19 June 2026, the Presidency of the Constitutional Chamber (Sala Constitucional) admitted the amparo application and requested a report from the GAM systems management deputy manager of the Instituto Costarricense de Acueductos y Alcantarillados.\n\n5.- In a written submission entered into the electronic case file on 3 July 2026, Randall Campos Rojas, in his capacity as GAM systems management deputy manager of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath. He states:\n\n“On the basis of the technical report prepared by Jorge Mauricio Matamoros Pérez, an employee of UEN Servicio al Cliente Zona III GAM, No. UEN-SCZIII-GAM 2026-00442, dated 2 July 2026, which is submitted as evidence and forms an integral part of the administrative case file, it is established that:\n\nFIRST. According to the database of the OPEN S.C.I. Integrated Commercial System, the property has service NIS [Valor 002], billed in the name of 3-101-714681 Sociedad Anónima, Province of San José, Escazú, San Rafael, address: Condominio El Cortijo, Apartment No. 10, Residential water rate, 1 housing unit. (See technical report No. UEN-SCZIII-GAM-2026-00442, dated 2 July 2026.)\n\nSECOND. The information entered in the OPEN S.C.I. Integrated Commercial System shows that the service identified by NIS [Valor 002], billed in the name of 3-101 714681 Sociedad Anónima, has no orders associated with a leak or leak repair. (See technical report No. UEN-SCZIII-GAM-2026-00442, dated 2 July 2026.)\n\nTHIRD. The information entered in the OPEN S.C.I. Integrated Commercial System shows that the service identified by NIS [Valor 002], billed in the name of 3-101 714681 Sociedad Anónima, registered high consumption between the periods from 17/10/2022 to 17/07/2023. These instances were addressed in a timely manner under Article 95 of the Regulations for the Provision of AyA Services and based on the results of the service orders generated for meter inspection and service connection. Accordingly, under AyA Board of Directors Agreement No. 2021-154 of 24 March 2021, from Extraordinary Session 2021-21, approved by Board of Directors Agreement No. 442 of 8 December 2020 and published in La Gaceta No. 27 of 9 February 2021 to regulate adjustments to bills for consumption outside the normal parameters of each service, temporary adjustments were applied to the affected periods of 17/10/2022, 18/04/2023, 17/05/2023, and 16/06/2023. (See technical report No. UEN-SCZIII-GAM-2026-00442, dated 2 July 2026.)\n\nFOURTH. Subsequently, service order No. 46608717, Volumetric Test, determined: ‘Meter outside the permitted tolerance.’ Accordingly, under Article No. 97(iii) of the Regulations for the Provision of AyA Services, the period of 17/08/2023 was modified. (See technical report No. UEN-SCZIII GAM-2026-00442, dated 2 July 2026.)\n\nFIFTH. Service orders carried out between 28/09/2023 and 04/12/2023 determined: ‘Meter inspection and service connection: meter shows no leaks or water flow.’ Accordingly, under Article No. 95 of the Regulations for the Provision of AyA Services, adjustments were applied to the periods of 16/11/2023, 18/09/2023, and 15/04/2025. Of the amount generated, a Payment Arrangement was entered into for ¢143.136.00, plus interest of ¢5.142.00, for a total of ¢148.278.00, with a 20% down payment of ¢29.655.76 and 11 installments of ¢10.783.90, which has been paid in full as of this date. (See technical report No. UEN-SCZIII-GAM-2026-00442, dated 2 July 2026.)\n\nSIXTH. According to information obtained from the Commercial System, adjustments and modifications were made to the service identified by NIS [Valor 002] under the Regulations for the Provision of AyA Services. As to leaks recorded inside the property, the user alone is responsible for properly maintaining the internal pipe networks. AyA therefore assumes no responsibility for high consumption billed as a result of leaks within a property, as indicated in Articles 8 and 104(a) of the Regulations for the Provision of AyA Services. As for the actions of the Board of Directors and the condominium administration, decisions made by those bodies are outside AyA’s jurisdiction. (See technical report No. UEN SCZIII-GAM-2026-00442, dated 2 July 2026.)\n\nSEVENTH. It should be noted here that Article 108 of the Regulations for the Provision of AyA Services sets out the grounds for suspending water service, including ‘nonpayment for the service after the invoice payment deadline has passed, provided that the due date is stated on the invoice delivered or made available to the subscriber at the location or by the means indicated. After that, the suspension will take effect before the next billing cycle if the failure to pay continues.’ In this case, according to the OPEN S.C.I. Integrated Commercial System, the service identified by NIS [Valor 002] has an outstanding amount of ¢217.591.00 for overdue invoices as of today; hence the service suspension.\n\nII. CONCLUSIONS\n\nIn this case, it is established that AyA has carried out all actions within its jurisdiction and in accordance with the applicable law, making adjustments and modifications to bills when they met the regulatory criteria. As to the leaks in service NIS [Valor 002], since they originated inside the condominium, no cause is attributable to AyA, and they are not subject to modification or correction. On the basis of the foregoing, it is concluded that this application lacks a technical, legal, and regulatory basis, since AyA has fulfilled the obligations imposed by law under the constitutional and legal framework and the principle of legality; therefore, no constitutional right of the amparo applicant has been violated (…)\n\nREQUEST\n\nOn the basis of the cited rules and the evidence I submit here, I respectfully ask the Court to DENY this amparo application and exempt AyA from any liability or award of costs, damages, and losses.”\n\n6.- The legal requirements have been observed in these proceedings.\n\nJustice Rueda Leal drafted this opinion; and,\n\nReasons:\n\nI.- Subject of the application. The amparo applicant alleges that he owns unit 10 of Condominio El Cortijo, where only one person lives. He states that water consumption associated with NIS [Valor 002] historically remained proportionate to the number of residents; however, anomalous consumption has been recorded as a result of a water leak located in a common area of the condominium. He states that a leak in the common area was repaired in January 2026; however, the high charges continued, namely: a bill due on 4 March 2026 for ₡124.914,00 and another dated 17 March 2026 for ₡92.677,00. In this regard, he states that the condominium administration and board of directors rejected reimbursement of the amounts billed for consumption recorded by the individual meter, a decision with which he disagrees. He further alleges that the Instituto Costarricense de Acueductos y Alcantarillados issued service order No. 54156954 on 8 April 2026, directing disconnection of the supply for nonpayment and establishing an accumulated balance of ₡217.591 plus disconnection and reconnection charges. He states that, on the date he filed the application, water service to unit 10 was suspended, directly affecting the resident of the home. He requests the Chamber’s intervention.\n\nII.- Facts found. The following facts of importance to the decision in this matter are deemed duly established:\n\na) The amparo applicant owns house 10 in Condominio El Cortijo, with NIS [Valor 002] (see report and evidence submitted).\n\nb) In service order 54156954 of 8 April 2026, the amparo applicant was told: “We inform you that, in addition to the bill for which service is being suspended, you have an outstanding debt according to the attached details, and we urge you to bring your account up to date with AyA. Otherwise, the usual procedure will be followed to file JUDICIAL COLLECTION proceedings, with the legal and financial consequences this entails; through the courts, all persons shown as liable for the corresponding debt will be sued by means of enforcement against their assets. We also remind you that a debt arising from pipe and sewer service creates a LEGAL MORTGAGE over the property or properties subject to the obligation to pay it, under Article 12 of the General Drinking Water Law (No. 1634), and the process may culminate in a JUDICIAL SALE of the liable party’s property. Regarding cutoff order number 64156954. The following fact of importance to the resolution of this matter could not be established:\n\nSole fact. That, after water service was suspended, the Instituto Costarricense de Acueductos y Alcantarillados placed a public water source no more than 50 meters from the entrance to the condominium in question.\n\nIV.- The case at hand. In the case at hand, the amparo applicant alleges that he owns unit 10 of Condominio El Cortijo, where only one person lives. He states that water consumption associated with NIS [Valor 002] historically remained proportionate to the number of residents; however, anomalous consumption has been recorded as a result of a water leak located in a common area of the condominium. He states that a leak in the common area was repaired in January 2026; however, the high charges continued, namely: a bill due on 4 March 2026 for ₡124.914,00 and another dated 17 March 2026 for ₡92.677,00. In this regard, he states that the condominium administration and board of directors rejected reimbursement of the amounts billed for consumption recorded by the individual meter, a decision with which he disagrees. He further alleges that the Instituto Costarricense de Acueductos y Alcantarillados issued service order No. 54156954 on 8 April 2026, directing disconnection of the supply for nonpayment and establishing an accumulated balance of ₡217.591 plus disconnection and reconnection charges. He states that, on the date he filed the application, water service to unit 10 was suspended, directly affecting the resident of the home. He requests the Chamber’s intervention.\n\nRegarding suspension of drinking water supply for nonpayment, this Chamber has ruled on the matter on numerous occasions. For example, in judgment No. 2020003446, issued at 9:30 on 21 February 2020, it stated:\n\n“The position of this Constitutional Court on amparo applications challenging suspension of drinking water supply has consistently been that institutions operating public water systems may suspend service to their subscribers if the users are in arrears on the established tariffs, since the legal and regulatory requirements that a prospective consumer must meet cannot be disregarded when they are reasonable. Nevertheless, this Court has established that, if the regular supply is to be cut off, AyA or the Administrative Association must make a public water source available nearby, where the person concerned can obtain this vital liquid; since the right to health under Article 21 of the Political Constitution is at stake, drinking water service must be accessible to everyone.”\n\nThe Chamber has also clarified that suspension is permitted for nonpayment of the latest monthly charge. In judgment No. 2016012075, issued at 9:30 on 26 August 2016, it stated the following:\n\n“ (…) This Chamber has also repeatedly held that suspension is permitted only for failure to pay the latest monthly charge on time, since earlier unpaid months must be collected separately through the applicable procedure. Thus, for example, in judgment No. 2003-06565 of 15:29 on 8 July 2003, it was stated: ‘This Court has referred to another condition for suspension of water service to be constitutionally legitimate, holding that a person may not be deprived of it if the latest bill due has been paid, since that procedure cannot be used to demand payment of all or part of the total amount owed.’”\n\nAccordingly, in the case at hand, the service disconnection is deemed to have been carried out pursuant to the powers of the respondent authority, as the operator of the drinking water service, on account of nonpayment. It must be noted that, although there is a fundamental right of access to drinking water, it is not free of charge; therefore, the respondent authority has the power to suspend service if users fail to pay the amounts owed for it. The amparo applicant does not allege that he paid the latest bill due and was denied restoration of service.\n\nIn this regard, note that service order 54156954 of 8 April 2026 informed the amparo applicant: “We inform you that, in addition to the bill for which service is being suspended, you have an outstanding debt according to the attached details, and we urge you to bring your account up to date with AyA. Otherwise, the usual procedure will be followed to file JUDICIAL COLLECTION proceedings, with the legal and financial consequences this entails; through the courts, all persons shown as liable for the corresponding debt will be sued by means of enforcement against their assets. We also remind you that a debt arising from pipe and sewer service creates a LEGAL MORTGAGE over the property or properties subject to the obligation to pay it, under Article 12 of the General Drinking Water Law (No. 1634), and the process may culminate in a JUDICIAL SALE of the liable party’s property. Regarding cutoff order number 64156954. The list of outstanding invoices and the latest month billed is set out below:\n\n| Service | Billing Invoice Date | Amount ¢ | Status |\n| --- | --- | --- | --- |\n| 5255608 | 18/02/2026 | 124.914.00 | Cutoff process halted |\n| 5255608 | 17/03/2026 | 92.677.00 | Cutoff order |\n| Total invoices ¢ |  | 217,591.00 |  |\n\nIt follows from this document that the service was suspended because of the latest bill, and not the total debt, which was duly communicated to the person whose rights are protected.\n\nNow, if the amparo applicant disagrees with the amounts charged for drinking water service, he should be aware that this Chamber does not review the legality of the Administration’s actions or decisions. It is not within this Court’s jurisdiction to determine, under the applicable law, whether a leak exists on the property or to establish the origin of the charge, nor to determine the correct amount payable for the service received, since those matters belong to the ordinary administrative and judicial channels. Likewise, it is not for this Chamber to review the decision of the administration and board of directors of the condominium where the property is located not to reimburse the amounts charged to the amparo applicant for drinking water, since that is a matter of ordinary legality. Consequently, if the amparo applicant considers it appropriate, he may submit his objection or claim to the respondent authority itself or to the competent judicial forum, where he may fully litigate the merits and assert his claims, if they are well-founded.\n\nAccordingly, as to this issue, no matter of constitutional significance warranting the Chamber’s intervention at this time is apparent.\n\nV.- In addition, this Chamber observes that one of the amparo applicant’s requests is that: “ICAA be ordered to immediately restore drinking water service to unit 10 of Condominio El Cortijo, NIS [Valor 002], or, alternatively, ensure a sufficient, continuous, and dignified temporary water supply while this application is resolved.”\n\nIn this regard, as stated in the judgment quoted above, this Chamber’s case law has determined that, if drinking water service is suspended, the authorities must install a public water source no more than 50 meters away, to safeguard users’ fundamental rights and basic needs. However, in the case under review, it has not been established that this occurred.\n\nAccordingly, the amparo application is granted in part solely as to this issue.\n\nVI.- Documents submitted to the case file. The parties are advised that any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device they have submitted must be retrieved within a maximum period of 30 business days from notification of this judgment. Any material not collected within that period will be destroyed, under the “Regulations on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of Session No. 27-11 of 22 August 2011 and published in Judicial Bulletin No. 19 of 26 January 2012) and Article LXXXI of Session No. 43-12 of the Superior Council of the Judiciary of 3 May 2012.\n\nTherefore:\n\nThe amparo application is granted in part solely on the ground that access to a public drinking water source was not ensured after service was suspended. Randall Campos Rojas, in his capacity as GAM systems management deputy manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that position, is ordered to issue the necessary instructions, coordinate as appropriate, and take the corresponding measures within the scope of their respective powers to ensure that, if this has not already been done, a public water source is installed IMMEDIATELY no more than 50 meters from the entrance to Condominio El Cortijo. The respondent authority is advised that, under Article 71 of the Constitutional Jurisdiction Law, anyone who receives an order to be carried out or enforced, issued in an amparo proceeding, and fails to carry it out or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, which shall be quantified in enforcement of judgment before the administrative-litigation jurisdiction.
