  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-018775-0007-CO \n\nRes. Nº 2026033788\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de setiembre de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita en expediente nro. 26-018775-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE LIBERIA Y EL MINISTERIO DE SALUD.\n\nResultando:\n\n \n\n \n\n1.- Por escritos incorporados al expediente el 26 y 27 de mayo de 2026, el accionante plantea recurso de amparo. Acusa la inercia multiorgánica institucional, la desobediencia crónica a sentencias firmes y la flagrante omisión de soluciones materiales que provocan una lesión grave y continuada a los intereses difusos y al interés público en el Barrio La Victoria de Liberia, manteniendo un foco infeccioso putrefacto frente a la escuela local y un riesgo vial inminente para la población infantil por ausencia de infraestructura peatonal adecuada. El propósito medular de este instrumento es acreditar ante este Tribunal la subsistencia de una omisión absoluta de solución técnica y material en el Barrio La Victoria de Liberia (específicamente en el cuadrante de la Escuela local, Calle 11 y Avenidas 6, 8 y 10). Las respuestas evasivas de la Municipalidad de Liberia, combinadas con la inacción fiscalizadora del Ministerio de Salud y de la Contraloría General de la República, configuran una flagrante violación a los principios constitucionales de legalidad, continuidad del servicio público, razonabilidad, proporcionalidad y tutela ambiental (principio pro natura), dejando en total desamparo a poblaciones de extrema vulnerabilidad como niños, adultos mayores y personas con discapacidad. Como antecedente inmediato, esta parte tramitó el reclamo de la comunidad bajo el expediente 26-012198-0007-CO. No obstante, a raíz de las anomalías internas denunciadas, el 26 de mayo de 2026 el elenco de Magistrados Titulares dictó una resolución de Inhibitoria en pleno. La justificación imperativa y urgentepara formular este nuevo recurso de amparo de forma totalmente autónoma e independiente radica en que, posterior a dicha inhibitoria, existe una omisión material absoluta en el nombramiento, integración y juramentación de un Tribunal de siete Magistrados Suplentes independientes. Al no haberse nombrado ni existir dicho órgano de reemplazo, la causa primigenia ha quedado atrapada en un limbo procesal absoluto y desprovista de Juez Natural, provocando una flagrante denegación de justicia (Artículo 41 CP). Ante esta quiebra del engranaje judicial, esta nueva acción autónoma se constituye en la única vía jurídica idónea y disponible para frenar el daño material irreversible que sufren diariamente los menores y vecinos del Barrio La Victoria, impidiendo que la inoperancia burocrática se traduzca en impunidad para las autoridades locales recurridas. El problema de infraestructura pluvial, colapso de desfogues y la ausencia absoluta de aceras seguras en las inmediaciones de la Escuela La Victoria es una deficiencia estructural crónica derivada de fallas de diseño topográfico e hidráulico ejecutadas por la Unidad Técnica de Gestión Vial (UTGV) de la Municipalidad de Liberia. El sistema pluvial recibe el caudal convergente de sectores comerciales de alto impacto (tales como la Farmacia Guanacasteca y el Súper Económico), pero debido a una pendiente negativa severa, el agua se represa directamente contra los linderos del centro educativo en lugar de seguir una línea recta natural de desfogue. Como consecuencia de dicho error de ingeniería, las esquinas de las Avenidas 8 y 10, y de la Calle 11, mantienen una acumulación permanente de escorrentías. Se encuentra plenamente acreditado que el agua estancada adquiere una coloración verde y emite olores fétidos avanzados (putrefacción orgánica) incluso en el punto máximo de la estación seca o verano. Esto confirma la existencia de un foco permanente de contaminación y un criadero idóneo para los vectores del dengue frente a la población escolar, localizado en las coordenadas satelitales exactas: Lat: 10.626663, Long: 85.430786. En el margen derecho de la Calle 11 (sentido sur), a lo largo de aproximadamente 100 metros contiguos al centro educativo, existe una omisión total de infraestructura peatonal (inexistencia absoluta de aceras, cordón y caño). En el margen izquierdo, la infraestructura se encuentra en estado de ruina evidente (fracturada, con huecos y obstrucciones físicas). Esta carencia estructural obliga diariamente a cientos de estudiantes de la escuela primaria, madres con coches de niños, adultos mayores y personas con movilidad reducida a bajarse de la acera y transitar directamente sobre la calzada vehicular activa, exponiéndose a un riesgo inminente de atropello. La desidia de las autoridades recurridas constituye un patrón sistemático de conducta omisiva. Ya en la sentencia firme del expediente N° 23-024765-0007CO, esta Sala Constitucional ordenó a la Municipalidad de Liberia intervenir la infraestructura en el costado sur del Estadio Edgardo Baltodano Briceño. No obstante, mediante una práctica lesiva de \"vías de hecho\" e inercia burocrática, la corporación municipal desobedeció dicho mandato al limitarse a realizar parches deficientes en la acera, omitting la continuidad de la obra hasta la Iglesia Evangélica (frente a la Panadería Sánchez) y eludiendo la colocación de la línea amarilla táctil para el tránsito de personas no videntes, en clara infracción a la Ley 7600. Este antecedente demuestra que el abandono actual en el Barrio La Victoria es la continuación de un cuadro crónico de desobediencia a la autoridad judicial. El desamparo de la comunidad se agrava por el incumplimiento de funciones de los órganos de control co-recurridos: • Ministerio de Salud (Área Rectora de Liberia): A pesar de las denuncias interpuestas, ha omitido ejecutar inspecciones periciales de campo oportunas ni ha emitido las Órdenes Sanitarias vinculantes que obliguen a la Municipalidad a intervenir de inmediato el cuadrante por razones de emergencia sanitaria y salud pública. • Contraloría General de la República. (CGR): Ante la denuncia formal del 14 de marzo de 2026 (Expediente CGRADIN2026002405) por el uso ineficiente y desvío de los fondos específicos de la Ley N° 8114, la CGR no ha concretado la auditoría externa sobre la UTGV de Liberia, permitiendo que la corporación local mantenga los recursos subejecutados. Agrega: \"1. TRASLADO SIN NOTIFICACIÓN: Denuncio que toda la documentación y pruebas del expediente 26-008745-0007-CO (Folios 1 al 93) fueron trasladados al expediente 25026749-0007-CO, el cual estaba cerrado y declarado sin lugar. Los señores de la Sala IV realizaron este movimiento sin dar ninguna explicación lógica y sin informarme absolutamente nada, dejándome en total estado de indefensión. 2. INACCIÓN COORDINADA (ALCALDÍA, CONCEJO Y UTGV): He agotado la vía administrativa mediante la réplica presentada el 09 de abril de 2026 (Folios 91 y 92), donde rechacé el acuerdo CM0292042026. La Alcaldía, el Concejo Municipal y la UTGV han mantenido una postura evasiva, trasladándose correspondencia entre ellos sin ejecutar las obras pluviales y peatonal necesarias en el sector de la Escuela La Victoria. 3. HECHOS NUEVOS (FOLIO 93): Las pruebas contenidas en el Folio 93 demuestran que el estancamiento de aguas persiste en estación seca, lo cual es un hecho superviniente que la Sala no valoró en 2025. Ignorar esta prueba bajo el pretexto de un traslado de expedientes violenta el principio de verdad real. 4. VULNERACIÓN A GRUPOS SENSIBLES: Esta desidia de la Municipalidad de Liberia afecta directamente los intereses superiores de niños, adultos mayores y personas con discapacidad (inválidos), quienes se ven obligados a transitar entrefocos de contaminación y aguas estancadas, poniendo en riesgo su vida y salud. ÚNICO: Sobre la inexistencia de Litispendencia y petitoria de conocimiento inmediato. Para asegurar la más absoluta transparencia procesal y evitar que se interprete de forma errónea la existencia de una identidad de causas, informo formalmente a este Tribunal que, con fecha de hoy, he presentado el desistimiento total y definitivo del expediente N° 26-012198-0007-CO. En virtud de lo anterior, no existe riesgo de duplicidad ni litispendencia, quedando este expediente (26-018775-0007-CO) como la única vía activa donde se solicita la tutela urgente de los derechos a la salud, la vida y la accesibilidad (Ley 7600) de la población escolar y vecinos de Barrio La Victoria en Liberia\". Agregaen todo caso, que \"ASUNTO: MANIFESTACIONES, FORMULA VALORACIÓN DE PRUEBA NUEVA INCORPORADA AL EXPEDIENTE (OFICIO MUNICIPAL CM-0453-05-2026 EN FOLIO 143 Y ACTUALIZACIÓN SATELITAL PLUVIAL EN FOLIO 144). Ejerciendo el derecho de defensa y con la firme intención de mantener debidamente instruido, actualizado y fundamentado este expediente judicial, comparezco ante este Tribunal con el debido respeto para exponer, manifestar y articular un análisis jurídico sobre los elementos probatorios de carácter documental y técnico-satelital incorporados a los autos bajo los folios de referencia, para que sean valorados de forma conjunta al momento de resolver el fondo de esta causa: PRIMERO: SOBRE LA INERCIA MUNICIPAL PLENAMENTE ACREDITADA EN EL FOLIO 1431. Consta incorporado en autos el FOLIO 143 del expediente, el cual contiene el oficio número CM-0453-05-2026 de fecha 27 de mayo de 2026, emitido por la Secretaría del Concejo Municipal de Liberia. En dicho documento se transcribe el acuerdo adoptado por el Concejo Municipal en el artículo tercero de la Sesión Ordinaria No. 127-2026, celebrada el 26 de mayo de 2026. (...) Ejerciendo el derecho de defensa y con la firme intención de mantener debidamente instruido, actualizado y fundamentado este expediente judicial, comparezco ante este Tribunal con el debido respeto para exponer, manifestar y articular un análisis jurídico sobre los elementos probatorios de carácter documental, técnico-satelital, inspección instrumental de campo e información epistolar sobrevenida incorporados a los autos, para que sean valorados de forma conjunta al momento de resolver el fondo de esta causa: (...) SEGUNDO: SOBRE LA INERCIA MUNICIPAL PLENAMENTE ACREDITADA EN EL FOLIO 143 Consta incorporado en autos el FOLIO 143 del expediente, el cual contiene el oficio número CM045305-2026 de fecha 27 de mayo de 2026, emitido por la Secretaría del Concejo Municipal de Liberia. En dicho documento se transcribe el acuerdo adoptado por el Concejo Municipal en el artículo tercero de la Sesión Ordinaria No. 127-2026, celebrada el 26 de mayo de 2026. Respetuosamente solicito a los Señores Magistrados constatar y valorar que ante la denuncia formal por desobediencia y la flagrancia de un foco infeccioso putrefacto frente a una escuela de niños, la máxima autoridad del cantón de Liberia decide calificar de forma displicente la situación comunitaria como un asunto puramente \"informativo\", decretando textualmente de forma literal: \"SE ACUERDA TOMAR NOTA POR SER UN ASUNTO INFORMATIVO, SE RENDIRA EL RESPETIVO INFORME CUANDO NOTIFIQUE LA SALA CONSTITUCIONAL.\" Esta postura de cómoda expectativa y deliberada inacción plasmada en el FOLIO 143, donde se supedita cualquier intervención material o solución técnica al momento en que este Tribunal Constitucional les ordene rendir cuentas, demuestra la total ausencia de un sentido de Buen Servicio Público y configura plenamente la lesión grave, continua e irreversible que sufren los menores de edad y vecinos del Barrio La Victoria. Ampliación sobre el Abandono de Competencias e Infracción a los Deberes de la Administración Activa: El acuerdo del Concejo Municipal documentado en el Folio 143 tipifica lo que la doctrina más autorizada del Derecho Administrativo denomina una abdicación voluntaria de las competencias legales de imperio y de policía sanitaria. Al calificar como un mero \"asunto informativo\" la existencia de un foco de contaminación orgánica y descomposición pluvial frente a un establecimiento de educación primaria, el cuerpo deliberativo municipal infringe de manera directo el bloque de legalidad establecido en el artículo 4 del Código Municipal. Las entidades corporativas locales poseen autonomía, pero esta no las faculta para el desabatecimiento de sus obligaciones inmediatas frente a la salud y la seguridad ambiental de sus habitantes. (...) CUARTO: SOBREVENIDA ADMISIÓN DE LA CRISIS SANITARIA POR EL ALCALDE MUNICIPAL (FOLIO 145) Con el fin de robustecer los autos, solicito se incorpore y valore de forma conjunta la manifestación oficial y pública emitida el domingo 31 de mayo de 2026, por el jerarca del órgano ejecutivo de la misma entidad accionada, el señor Alcalde de Liberia, José Javier Calvo Darcia. Dicha declaración pública constituye una confesión extrajudicial ineludible sobre los hechos denunciados, donde la máxima autoridad municipal textualmente señala: \"Quiero advertir respetuosamente a toda la ciudadanía que, a partir de mañana, he girado instrucciones a la Policía Municipal de Liberia y al Departamento de Inspectores Municipales para que realicen operativos de inspección y notificación en todo el cantón, con el fin de combatir una práctica inaceptable que afecta la salud pública, el ambiente y la imagen de nuestra ciudad. Me refiero al desfogue ilegal de aguas servidas, aguas negras y aguas residuales provenientes de viviendas y establecimientos hacia los caños, cunetas, alcantarillas y espacios públicos. No podemos seguir tolerando que algunos pocos continúen contaminando nuestros barrios, generando malos olores, focos de infección, proliferación de insectos y afectando la calidad de vida de los vecinos (...) De ser necesario, agotaremos todas las vías administrativas y legales disponibles hasta las últimas consecuencias para erradicar definitivamente esta asquerosa e irresponsable práctica. Liberia merece una ciudad limpia, ordenada, saludable y respetuosa del ambiente. La colaboración ciudadana será fundamental para alcanzar este objetivo. No habrá tolerancia para quienes atenten contra la salud y el bienestar de nuestra comunidad.\" A partir de este nuevo elemento probatorio, resulta indispensable resaltar ante este Tribunal Constitucional: • Confesión de las condiciones lesivas: El propio Alcalde de la Municipalidad de Liberia reconoce de forma pública y expresa la existencia fáctica de \"focos de infección\", \"proliferación de insectos\", \"malos olores\" y afectaciones directas a la \"salud pública\" y al \"ambiente\", tal y como este recurrente lo ha acreditado técnicamente para el Barrio La Victoria en el Folio 144. • Contradicción institucional interna: Mientras el Concejo Municipal adopta en el Folio 143 una postura omisiva de \"tomar nota\" y calificar la emergencia escolar como un mero \"asunto informativo\" a la espera de ser notificados por esta Sala, el Alcalde Municipal califica la situación en la realidad cantonal como una \"asquerosa e irresponsable práctica\" que amerita el despliegue inmediato de la fuerza pública e inspectores\". (...) El colapso del casco central, la inundación del Hospital Enrique Baltodano Briceño y de la sede local del Poder Judicial constituyen manifestaciones materiales irrefutables del agotamiento absoluto de la red pluvial urbana de Liberia\". Con base en las situaciones expuestas, estima que se han vulnerado derechos fundamentales. Pide se declare con lugar el recurso.\n\n2.- Por escritos incorporados al expediente el 27 y 31 de mayo, 1°, 2, 7 y 8 de junio, todos de 2026, el accionante aporta documentación.\n\n3.- Mediante resolución de las 12:11 horas de 12 de junio de 2026, la Presidencia de la Sala le dio curso al proceso y le solicitó informe al alcalde y al presidente del Concejo de la Municipalidad de Liberia; asimismo, al director del Área Rectora de Salud de Liberia del Ministerio de Salud. \n\n4.- Por escrito incorporado al expediente el 15 de junio de 2026, el accionante aporta manifestaciones. Solicita que también se tenga como recurrida a la Contraloría General de la República. \n\n5.- Por escrito incorporado al expediente el 22 de junio de 2026, José Javier Calvo Darcia, alcalde de la Municipalidad de Liberia, informa: “PRIMERO: La Municipalidad de Liberia es una institución que forma parte de la Administración Pública, cuyos objetivos se encuentran plasmados en su naturaleza de ente público al servicio del Municipio. Que la MUNICIPALIDAD DE LIBERIA dada la naturaleza jurídica y la función pública que desempeña la institución, se encuentra reguladas por el ordenamiento jurídico administrativo, lo que le obliga a sujetar su actuar a la satisfacción del interés público, sometida a1 principio de legalidad que se traduce en un actuar eficiente, responsable, en estricto apego a principios elementales de justicia, lógica y conveniencia ( Artículos 10, 11 y 16 inciso l. de la Ley General de la Administración Pública). Es de suma importancia aclarar en primer lugar a esta honorable Sala Constitucional, que la Municipalidad de Liberia, no ha violentado los derechos constitucionales del recurrente. La Municipalidad de Liberia administra aproximadamente de 600 kilómetros de red vial cantonal (entre calles urbanas y caminos distritales), los cuales deben ser atendidos bajo los principios de eficiencia, racionalidad en el uso de los recursos públicos y conforme a los lineamientos técnicos establecidos en: • Ley N.° 9329, “Ley de Transferencia de Competencias”. • Decreto Ejecutivo N.° 40137-MOPT. • Plan de Conservación Desarrollo y Seguridad Vial Cantonal (PCDSVC), Con base en esta normativa, la Municipalidad está obligada a priorizar las intervenciones viales según evaluaciones técnicas y sociales, y no únicamente según el orden de solicitudes ciudadanas. Que las funciones municipales para le gestión Vial, se establecen en el decreto N°40137-MOPT, Reglamento a la Primera Ley Especial para la Transferencia de Competencias: Atención Plena y Exclusiva de la Red Vial Cantonal, en su artículo 5 establece: Artículo 5.- Funciones municipales para la gestión vial J) Priorizar los proyectos viales a ejecutar dentro de las respectivas jurisdicciones, tomando en consideración los criterios técnicos. Tal priorización deberá sustentarse en la evaluación socioeconómica de las diferentes vías a intervenir que cuantifique los beneficios a sus usuarios. Dichas evaluaciones involucrarán parámetros como conectividad y concepto de red, tránsito promedio diario, acceso a servicios en las comunidades, densidad de población y volumen de producción. Complementariamente se podrá utilizar el Índice de Viabilidad Técnico-Social (IVTS), establecido por la Secretaría de Planificación Sectorial del MOPT. (El destacado es nuestro). La Gestión vial es el conjunto de actividades necesarias, para alcanzar una meta de conservación, mejoramiento, rehabilitación o construcción vial, el objetivo de la gestión vial es establecer planes de acción tomando en cuenta las condiciones de la infraestructura vial cantonal a las necesidades producto del crecimiento del volumen de tránsito, la población y la producción. Con respecto a esto, la Sala Constitucional de la Corte Suprema de Justicia señala en la resolución 2011-006514, de las diez horas y veintiuno minutos del veinte de mayo de dos mil once, indica con respecto a los criterios de priorización de la Municipalidad lo siguiente: “Más aún, en la sentencia No. 2010-16417 de las 09:45 hrs. de 1° de octubre de 2010, la Sala expresó: “La construcción de un nuevo alcantarillado pluvial en Ciudad Colón es una decisión municipal que responderá a criterios de oportunidad y conveniencia del gobierno local, de acuerdo con las prioridades políticas y presupuestarias, en el ejercicio de sus competencias autónomas”. - Tales consideraciones sin duda son aplicables en el caso concreto, en el cual la Sala Constitucional carece de elementos para determinar con qué prioridad se debe realizar el asfaltado requerido por los recurrentes, razón por la cual lo procedente es declarar sin lugar el recurso, como en efecto se dispone.” (El destacado es nuestro). De acuerdo a lo anterior, es importante indicar que no puede obviarse que la Municipalidad de Liberia cuenta con un Plan de Conservación Desarrollo y Seguridad Vial Cantonal, en el cual permite priorizar de manera eficiente la inversión de los recursos públicos, esta Municipalidad tiene como objetivo el cumplimiento de este plan de acuerdo a lo estipulado por las leyes vinculantes en materia de conservación vial, dentro de esta normativa se puede mencionar la Constitución Política, Ley General de Caminos, Código Municipal, Ley de simplificación y eficiencia Tributaria, Ley 8114, Ley Especial para la Transferencia de Competencias: Atención Plena y Exclusiva de la Red Vial Cantonal, Ley 9329, Decreto N°40137, Decreto N°40138 Decreto N°40139, entre otras, por lo tanto las obras solicitadas deben adecuarse a lo planteado dentro del plan quinquenal, para no causar en un perjuicio del resto de la población, siendo como se dijo en el párrafo segundo un asunto de mera legalidad que se traduce en un actuar eficiente, responsable, en estricto apego a principios elementales de justicia, lógica y conveniencia ( Artículos 10, 11 y 16 inciso l. de la Ley General de la Administración Pública). Cabe aclarar a esta respetable Sala que el ámbito de actuación de la Administración Pública concretamente con los Municipios, de acuerdo al Principio de Legalidad estipulado en la Constitución Política y la Ley General de la Administración Pública, en la materia propia del Derecho Público, y concretamente en el Derecho Administrativo, el principio de legalidad representa uno de los pilares fundamentales sobre los cuales se asienta el quehacer diario de la Administración Pública. Su nacimiento se encuentra concomitantemente con el nacimiento de las instituciones políticas modernas, y con el desarrollo y extensión del Derecho Administrativo, como aquel derecho tendiente a regular las actuaciones de la administración en el ejercicio de su función administrativa. De referencia positiva en nuestro ordenamiento jurídico, en el numeral 11 de la Constitución Política , y en los artículos 11, 12, 6 y 13 de la Ley General de la Administración Pública, su conceptualización se da, en el sentido de que todo acto o comportamiento de la Administración Pública debe estar regulado y permitido por el ordenamiento jurídico, aplicando el viejo aforismo de que la Administración puede hacer únicamente aquello que le está permitido, muy al contrario de la actuación del particular, que en su actividad privada rige el dogma de la autonomía de la voluntad, y el mismo podrá hacer actos o actividades que no se encuentren prohibidas. En relación al tema de los Municipios, en el artículo 169 de la Constitución Política se fijan las atribuciones municipales, al poner a cargo del Gobierno local, los intereses y servicios locales, concomitantemente con el Código Municipal que señala las atribuciones municipales que atiendan al fin de promover el desarrollo integral de los cantones y dentro de los cuales señala una lista muy extensa de las mismas. Se pueden contar dentro de ellas, los servicios públicos locales, la planificación urbanística, la administración de la zona marítimo terrestre etc. De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho porque la Municipalidad con los pocos recursos con los que cuenta da mantenimiento a las calles del Cantón, todo dentro de sus posibilidades y dentro de su plan quinquenal, que es la herramienta que contiene la planificación sobre la gestión vial, a cinco años plazo, de acuerdo con lo establecido en el artículo 2 de la Ley No. 9329. Al respecto la Procuraduría General de la República en el dictamen C-11-2019 16 de enero de 2019, ha indicado lo siguiente: “Asimismo, se concluye que para que las municipalidades puedan ejercer, de forma válida, sus competencias en materia de conservación y desarrollo de la Red Vial Cantonal, éstas deben haber aprobado un Plan Vial Quinquenal de Conservación y Desarrollo. El presupuesto y actuaciones de las Municipalidades, relativas a la atención de la Red Vial Cantonal, deben ajustarse al respectivo Plan Vial Quinquenal de Conservación y Desarrollo aprobado por el Concejo Municipal. Ergo, el hecho de que la Junta Vial Cantonal haya dejado de funcionar, no implica que la respectiva municipalidad pueda desatender lo dispuesto en el Plan Vial Quinquenal de Conservación y Desarrollo”. (El resaltado es nuestro). Sobre esto se menciona Nota de la Magistrada Hernández López, en la resolución N° 2019-020645, de las nueve horas treinta minutos del veintinueve de octubre de dos mil diecinueve: “… estimo que no es posible para una sociedad en desarrollo satisfacer el cien por ciento de la necesidad es de infraestructura (calles, puentes, escuelas, etc.) al mismo tiempo, de tal forma que se requiere de una programación y planificación cuya priorización obedece a criterios técnicos y a una planificación cuya competencia es exclusiva de las autoridades locales…” (El resaltado es nuestro). Por lo tanto, todas las obras que se ejecutan por la Municipalidad de Liberia se encuentran establecidas dentro de este plan quinquenal. Es de suma importancia aclarar en primer lugar a esta honorable Sala Constitucional, que la Municipalidad de Liberia, no ha violentado los derechos constitucionales al recurrente por lo tanto se les solicita se declare sin lugar el recurso presentado. SEGUNDO: Alega la parte recurrente que la inercia multiorgánica institucional, la desobediencia crónica a sentencias firmes y la flagrante omisión de soluciones materiales que provocan una lesión grave y continuada a los intereses difusos y al interés público en el Barrio La Victoria de Liberia, manteniendo un foco infeccioso putrefacto frente a la escuela local y un riesgo vial inminente para la población infantil por ausencia de infraestructura peatonal adecuada. El propósito medular de este instrumento es acreditar ante este Tribunal la subsistencia de una omisión absoluta de solución técnica y material en el Barrio La Victoria de Liberia (específicamente en el cuadrante de la Escuela local, Calle 11 y Avenidas 6, 8 y 10). Las respuestas evasivas de la Municipalidad de Liberia, combinadas con la inacción fiscalizadora del Ministerio de Salud y de la Contraloría General de la República, configuran una flagrante violación a los principios constitucionales de legalidad, continuidad del servicio público, razonabilidad, proporcionalidad y tutela ambiental (principio pro natura), dejando en total desamparo a poblaciones: De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06-2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente: “ I. ANTECEDENTES ADMINISTRATIVOS Y CONSTITUCIONALES La situación planteada por el señor [Nombre 001] no constituye un hecho nuevo ni desconocido para esta Administración. Por el contrario, las gestiones relacionadas con las condiciones de infraestructura peatonal y pluvial en las inmediaciones de la Escuela La Victoria, Calle 11 y sectores adyacentes, han sido objeto de atención administrativa y de análisis previo dentro del expediente constitucional N.° 25- 026749-0007-CO, respecto del cual esta Unidad Técnica rindió oportunamente el informe correspondiente. Dentro de dicho informe se hizo del conocimiento de la Sala Constitucional que la Municipalidad de Liberia había realizado diagnósticos técnicos del sector, identificando propiedades con eventuales incumplimientos asociados a infraestructura peatonal y definiendo las acciones administrativas que correspondían conforme al marco jurídico aplicable. Asimismo, en seguimiento a las gestiones planteadas por el recurrente y a las necesidades identificadas en el sector, durante el primer semestre del año 2026 la Municipalidad de Liberia ejecutó intervenciones directas en las inmediaciones de la Escuela La Victoria y sectores adyacentes, consistentes en la reparación de tramos de acera que presentaban deterioro, así como labores de limpieza y mantenimiento de caños y sistemas de evacuación superficial de aguas pluviales. Estas actuaciones formaron parte de las labores ordinarias de conservación y mejoramiento de la infraestructura vial y peatonal del cantón, evidenciando una atención continua por parte de la Administración respecto de las condiciones señaladas por el recurrente. De igual forma, se puso en conocimiento de la Sala Constitucional que la Municipalidad de Liberia venía desarrollando una estrategia integral en materia de movilidad peatonal, mediante el Plan de Movilidad Urbana Sostenible e Inclusiva y la programación establecida en el Plan Quinquenal institucional, dentro de la cual el sector de Barrios del Sur fue identificado como una de las áreas prioritarias de intervención. En dicho procedimiento constitucional quedó acreditado que la Municipalidad de Liberia había brindado atención a las diversas gestiones formuladas por el señor [Nombre 001]. Asimismo, con posterioridad a la interposición de dicho recurso, el recurrente continuó presentando nuevas solicitudes, observaciones, denuncias y requerimientos relacionados con el mismo sector, las cuales fueron debidamente conocidas, analizadas y atendidas por la Administración mediante las actuaciones, valoraciones técnicas y respuestas administrativas correspondientes. En consecuencia, las distintas gestiones promovidas por el recurrente han recibido atención institucional de manera continua, oportuna y conforme a las competencias legales de esta Municipalidad. Consecuentemente, no resulta correcto afirmar la existencia de una supuesta \"omisión absoluta\", \"inercia institucional\" o ausencia de pronunciamiento por parte de la Municipalidad de Liberia, toda vez que los hechos que motivan el presente recurso han sido conocidos, analizados y atendidos administrativamente en reiteradas oportunidades, existiendo actuaciones concretas tanto en el ámbito técnico como administrativo. Debe destacarse, además, que varias de las manifestaciones incorporadas en el expediente N.° 26- 018775-0007-CO constituyen una reiteración, ampliación o reformulación de planteamientos previamente formulados por el recurrente y que ya habían sido objeto de análisis y respuesta por I. SOBRE LAS MANIFESTACIONES DEL RECURRENTE Se rechazan en todos sus extremos aquellas afirmaciones que atribuyen a esta Unidad Técnica una supuesta \"omisión absoluta\", \"inercia institucional\", \"desobediencia crónica\", \"deficiencia estructural crónica\", \"fallas de diseño topográfico e hidráulico\" o cualquier otra expresión similar utilizada por el recurrente, por cuanto corresponden a apreciaciones subjetivas y conclusiones unilaterales que carecen de respaldo técnico, pericial incorporado al expediente. Debe destacarse que el recurrente formula conclusiones técnicas sobre presuntos errores de diseño hidráulico y topográfico atribuidos a la Municipalidad, sin aportar estudios hidráulicos, topográficos, geotécnicos, estructurales o periciales que permitan sustentar objetivamente tales afirmaciones.” (El resaltado es nuestro). Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales (…) De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06- 2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente: “ III. SOBRE LA INEXISTENCIA DE UNA OMISIÓN ABSOLUTA DE LA ADMINISTRACIÓN Resulta incorrecta la afirmación de que la Municipalidad de Liberia haya permanecido inactiva frente a las situaciones denunciadas. Con anterioridad a la presentación del presente recurso, esta Administración emitió diversos criterios técnicos y respuestas formales dirigidas al señor [Nombre 001], en las cuales se atendieron las gestiones relacionadas con el sector de Barrio La Victoria y las inmediaciones de la Escuela La Victoria. En dichas respuestas se informó expresamente que: • El sector sería incorporado dentro de los programas de mantenimiento y limpieza preventiva de la Municipalidad. • Se programaron labores de limpieza de cordón y caño, retiro de sedimentos y eliminación de obstrucciones que afectaran el escurrimiento de aguas pluviales. • Durante los meses de enero, febrero y mayo del año 2026 se ejecutaron labores de limpieza de aceras, eliminación de vegetación invasiva, corte de árboles y despeje de zonas que interferían con el tránsito peatonal y el escurrimiento superficial de las aguas. • Se contempló la realización de inspecciones técnicas adicionales para verificar las condiciones del drenaje y definir las medidas correspondientes. Lo anterior demuestra que la Administración no ha permanecido inactiva ni ha incurrido en la alegada omisión absoluta descrita por el recurrente. III. SOBRE LAS SUPUESTAS FALLAS DE DISEÑO HIDRÁULICO Y ESTRUCTURAL Se rechaza la afirmación de que la situación denunciada obedezca a supuestas fallas de diseño hidráulico o estructural atribuibles a la UTGV, por cuanto el recurrente no aporta ningún estudio técnico, peritaje o criterio profesional que respalde dicha conclusión. Las valoraciones realizadas por esta Unidad indican que las condiciones observadas en algunos puntos del sector están asociadas principalmente a factores externos, tales como la descarga indebida de aguas servidas al sistema pluvial y la acumulación de residuos sólidos y sedimentos que afectan su funcionamiento. Asimismo, debe indicarse que la Municipalidad de Liberia ha venido señalando al recurrente, mediante las respuestas emitidas a sus diferentes gestiones, sobre estas circunstancias y ha incorporado el sector dentro de sus programas ordinarios de mantenimiento y limpieza preventiva. Como parte de estas acciones, se han realizado labores periódicas de limpieza y desobstrucción del sistema pluvial, siendo la intervención más reciente durante el mes de mayo de 2026. Debe señalarse además que la afirmación relativa a la existencia de un supuesto \"foco infeccioso putrefacto frente a la Escuela La Victoria\" no resulta consistente con las condiciones observadas en el sitio. El frente principal de dicho centro educativo se ubica sobre la intersección de la Avenida 10 y Calle 15, sector que cuenta con infraestructura peatonal y que no presenta las condiciones descritas por el recurrente. Conforme a las inspecciones realizadas y a los registros fotográficos disponibles, el frente principal de la Escuela La Victoria, ubicado sobre la Avenida 10 y Calle 15, no presenta acumulaciones permanentes de agua ni las condiciones descritas por el recurrente. Las situaciones señaladas corresponden a puntos específicos del sector y no al entorno inmediato del centro educativo. En consecuencia, no resulta técnicamente procedente atribuir al frente de la escuela un supuesto problema sanitario o de drenaje ni concluir la existencia de fallas de diseño hidráulico o estructural del sistema pluvial. Todo lo anterior evidencia que la Municipalidad de Liberia no ha permanecido inactiva frente a las situaciones señaladas por el recurrente, sino que ha venido ejecutando labores de mantenimiento, limpieza, seguimiento técnico y atención periódica dentro del marco de sus competencias y de los programas regulares de conservación de la infraestructura vial y pluvial del cantón. IV. SOBRE EL PROYECTO INTEGRAL PARA EL MANEJO DE AGUAS PLUVIALES Debe indicarse que la problemática pluvial existente en los Barrios del Sur de Liberia no corresponde a una circunstancia aislada ni exclusiva del punto señalado por el recurrente, sino a una condición que ha sido objeto de análisis integral por parte de esta Municipalidad. Como parte de dicho proceso, desde el año 2024 se contrató el estudio denominado \"Contratación de estudios de factibilidad, diseños y elaboración de planos finales del sistema pluvial del sector Barrios del Sur, distrito Liberia\", mediante el cual se desarrolló un diagnóstico técnico de la red existente, los diseños del sistema propuesto, las etapas de ejecución y la estimación presupuestaria correspondiente. El estudio determinó una inversión estimada superior a los cinco millones de dólares estadounidenses, razón por la cual su ejecución fue concebida por etapas, conforme a criterios de priorización técnica, disponibilidad presupuestaria, capacidad operativa y programación institucional. Dada la magnitud de la inversión requerida y la complejidad técnica del sistema propuesto, la intervención debe desarrollarse de manera gradual, garantizando la funcionalidad e integración de cada una de las etapas constructivas. Como parte de dicha estrategia, durante el año 2025-2026 la Municipalidad de Liberia inició la ejecución de la primera etapa del proyecto integral de saneamiento pluvial de los Barrios del Sur, mediante una inversión cercana a los ₡100 millones. Si bien estas obras no se desarrollan directamente en el sector específico señalado por el recurrente, forman parte del mismo sistema de drenaje pluvial diseñado para la cuenca correspondiente. Desde el punto de vista técnico, la ejecución del proyecto responde a una secuencia constructiva lógica, iniciando en los sectores ubicados aguas abajo con el fin de garantizar la capacidad de conducción y desfogue del sistema antes de incorporar nuevos aportes provenientes de las zonas superiores de la cuenca. En ese sentido, el sector de Barrio La Victoria se localiza en la parte alta de dicha cuenca, por lo que las intervenciones deben ejecutarse de forma ordenada y conforme a la secuencia establecida en el diseño integral. Lo anterior evidencia que la Municipalidad ha venido desarrollando acciones concretas y sostenidas para atender de manera estructural la problemática de drenaje pluvial del sector sur del cantón, descartándose la existencia de una inacción o abandono institucional respecto de esta materia I. SOBRE LA INFRAESTRUCTURA PEATONAL Respecto de las manifestaciones relacionadas con la inexistencia o deterioro de aceras, debe señalarse que la legislación vigente establece obligaciones específicas para los propietarios de inmuebles frente a sus respectivas propiedades, correspondiendo a la Municipalidad ejercer labores de fiscalización y, de resultar procedente, ejecutar las acciones administrativas previstas por el ordenamiento jurídico. Adicionalmente, esta Municipalidad ha venido desarrollando labores de mantenimiento y limpieza en la zona y mantiene la valoración de nuevas intervenciones conforme a la planificación institucional y disponibilidad presupuestaria correspondiente. II. SOBRE LAS MANIFESTACIONES RELATIVAS A LA INFRAESTRUCTURA PEATONAL EN LA ESCUELA LA VICTORIA Debe aclararse además que las manifestaciones del recurrente no describen con precisión las condiciones reales del sitio. Particularmente, se afirma una supuesta ausencia de infraestructura peatonal frente a la Escuela La Victoria, cuando en realidad el frente principal de dicho centro educativo se ubica sobre la intersección de la Avenida 10 y Calle 15, sector que cuenta con infraestructura peatonal destinada al tránsito de estudiantes, personal docente y usuarios en general. Asimismo, si bien existen algunos tramos de acera en sectores aledaños que presentan distintos niveles de deterioro y que requieren intervenciones de mantenimiento, rehabilitación o reconstrucción, ello no significa que exista una ausencia total de infraestructura peatonal ni una omisión absoluta por parte de la Municipalidad, como pretende hacer ver el recurrente. Debe tomarse en consideración que la Municipalidad de Liberia administra las necesidades de infraestructura peatonal del cantón mediante procesos de planificación, programación y priorización técnica, los cuales permiten definir el orden de atención de las distintas intervenciones con base en criterios objetivos tales como el nivel de riesgo, el estado de deterioro, la cantidad de usuarios beneficiados, la conectividad peatonal, la disponibilidad presupuestaria y las metas establecidas en los instrumentos de planificación institucional. En ese sentido, resulta importante señalar que durante el primer semestre del año 2026 la Municipalidad ejecutó obras de mejoramiento de infraestructura peatonal en diversos puntos identificados como críticos dentro del sector originalmente señalado por el propio recurrente, incluyendo intervenciones sobre la Avenida 10, que forma parte del objeto inicial de sus denuncias. Estas actuaciones evidencian que la Administración ha venido atendiendo progresivamente las necesidades identificadas en el sector conforme a los criterios técnicos establecidos y dentro de las posibilidades presupuestarias institucionales. En consecuencia, la existencia de sectores que requieren mejoras adicionales no implica que dichas intervenciones deban ejecutarse de forma inmediata o exclusiva en atención a una solicitud individual, pues la Administración tiene el deber de garantizar una distribución racional, equitativa y eficiente de los recursos públicos disponibles, procurando atender de manera balanceada las múltiples necesidades de infraestructura peatonal existentes en todo el cantón. Por ello, las obras e intervenciones municipales responden a procesos de planificación, programación y priorización técnica previamente definidos, garantizando el uso eficiente de los recursos públicos y el mayor beneficio para la colectividad. En consecuencia, las afirmaciones del recurrente sobre una supuesta inexistencia de aceras frente a la Escuela La Victoria no reflejan las condiciones reales del sitio, toda vez que el centro educativo cuenta con infraestructura peatonal en su frente principal. Asimismo, omiten considerar las intervenciones ejecutadas por la Municipalidad, incluyendo las obras realizadas durante el primer semestre de 2026 en puntos críticos del sector originalmente denunciado, así como los procesos de planificación mediante los cuales se atienden progresivamente las necesidades de movilidad peatonal del cantón.” (El resaltado es nuestro). Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales. CUARTO: También reclama que la desidia de las autoridades recurridas constituye un patrón sistemático de conducta omisiva. Ya en la sentencia firme del expediente N° 23-024765-0007CO, esta Sala Constitucional ordenó a la Municipalidad de Liberia intervenir la infraestructura en el costado sur del Estadio Edgardo Baltodano Briceño. No obstante, mediante una práctica lesiva de \"vías de hecho\" e inercia burocrática, la corporación municipal desobedeció dicho mandato al limitarse a realizar parches deficientes en la acera, omitting la continuidad de la obra hasta la Iglesia Evangélica (frente a la Panadería Sánchez) y eludiendo la colocación de la línea amarilla táctil para el tránsito de personas no videntes, en clara infracción a la Ley 7600. Este antecedente demuestra que el abandono actual en el Barrio La Victoria es la continuación de un cuadro crónico de desobediencia a la autoridad judicial: De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06- 2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente (…) I. SOBRE LAS MANIFESTACIONES RELACIONADAS CON EL EXPEDIENTE N.° 23-024765-0007-CO En relación con la afirmación del recurrente según la cual la Municipalidad de Liberia habría desobedecido lo ordenado por la Sala Constitucional dentro del expediente N.° 23-024765-0007- CO al no extender las obras de infraestructura peatonal hasta el sector de la Iglesia Evangélica frente a la Panadería Sánchez, se rechazan dichos señalamientos por carecer de sustento fáctico y técnico. Debe indicarse que esta Administración ya se había pronunciado expresamente sobre estos mismos hechos en respuesta a las gestiones formuladas por el señor [Nombre 001], informándole que la Municipalidad de Liberia ejecutó las obras de infraestructura peatonal ordenadas por la Sala Constitucional dentro del expediente N.° 23-024765-0007-CO, en el plazo establecido y conforme al alcance definido en la resolución respectiva. Las obras ejecutadas comprendieron la construcción y mejoramiento de infraestructura peatonal en el costado sur del Estadio Edgardo Baltodano Briceño y sectores incluidos dentro del alcance técnico del proyecto desarrollado por la Municipalidad, por lo que no se configura incumplimiento alguno de lo ordenado por la autoridad jurisdiccional competente. Asimismo, se aclaró al recurrente que la existencia de tramos nuevos intercalados con infraestructura preexistente no obedece a una ejecución defectuosa ni a la realización de \"parches\", como afirma en el presente recurso, sino a la aplicación de criterios técnicos de intervención basados en el estado real de cada segmento de acera. Producto de las inspecciones realizadas se determinó que algunos sectores presentaban condiciones funcionales adecuadas y no requerían reconstrucción, mientras que otros sí presentaban deterioros significativos que justificaban su intervención. Consecuentemente, la ejecución de obras se realizó atendiendo criterios de necesidad, funcionalidad y uso eficiente de los recursos públicos, priorizando aquellos sectores con mayor nivel de deterioro o riesgo para los peatones. Igualmente, se informó al recurrente que la continuidad de la infraestructura peatonal constituye un objetivo de planificación institucional que se desarrolla de forma progresiva, conforme a la priorización técnica de proyectos y a la disponibilidad presupuestaria municipal. Por tal motivo, la inexistencia de una intervención integral en la totalidad del corredor mencionado por el recurrente no constituye incumplimiento de la resolución constitucional ni puede interpretarse como una desobediencia a la autoridad judicial. En consecuencia, la referencia que realiza el recurrente al expediente N.° 23-024765-0007-CO corresponde a una valoración subjetiva de su parte sobre el alcance deseable de las obras ejecutadas y no a un incumplimiento acreditado de lo ordenado por la Sala Constitucional, pues la Municipalidad ejecutó las obras correspondientes dentro del alcance definido y comunicó oportunamente dichas actuaciones al propio recurrente.” (El resaltado es nuestro). Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales. QUINTO: Alega que el desamparo de la comunidad se agrava por el incumplimiento de funciones de los órganos de control co-recurridos: • Ministerio de Salud (Área Rectora de Liberia), a pesar de las denuncias interpuestas, ha omitido ejecutar inspecciones periciales de campo oportunas ni ha emitido las Órdenes Sanitarias vinculantes que obliguen a la Municipalidad a intervenir de inmediato el cuadrante por razones de emergencia sanitaria y salud pública: Cabe aclarar a esta respetable Sala, que en acatamiento al Código Municipal artículo 4 siguientes y concordantes, establece que la municipalidad posee la autonomía política, administrativa y financiera que le confiere la Constitución Política, dentro de sus atribuciones. Por lo que en acatamiento a dicha normativa no es posible para este municipio intervenir en un asunto que no se enmarca en las atribuciones otorgadas por el Código Municipal y por la misma Constitución Política, por ser un asunto que compete a otras instituciones estatales sean estas el Ministerio de Salud y no a esta Municipalidad. Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, por lo que el recurso presentado debe declararse sin lugar. SEXTO: Que Contraloría General de la República.(CGR): Ante la denuncia formal del 14 de marzo de 2026 (Expediente CGRADIN2026002405) por el uso ineficiente y desvío de los fondos específicos de la Ley N° 8114, la CGR no ha concretado la auditoría externa sobre la UTGV de Liberia, permitiendo que la corporación local mantenga los recursos subejecutados: Cabe aclarar a esta respetable Sala, que en acatamiento al Código Municipal artículo 4 siguientes y concordantes, establece que la municipalidad posee la autonomía política, administrativa y financiera que le confiere la Constitución Política, dentro de sus atribuciones. Por lo que en acatamiento a dicha normativa no es posible para este municipio intervenir en un asunto que no se enmarca en las atribuciones otorgadas por el Código Municipal y por la misma Constitución Política, por ser un asunto que compete a otras instituciones estatales sean estas la Contraloría General de la República. De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06- 2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente: “ I. SOBRE LAS MANIFESTACIONES RELACIONADAS CON LA EJECUCIÓN DE RECURSOS DE LA LEY N.° 8114 En relación con las aseveraciones formuladas por el recurrente respecto de un supuesto uso ineficiente, desvío de recursos o subejecución de fondos provenientes de la Ley N.° 8114, se rechazan tales manifestaciones por carecer de sustento técnico, financiero o documental dentro del presente expediente. Debe señalarse que el recurrente se limita a formular afirmaciones generales sobre una presunta subejecución presupuestaria y sobre el supuesto mantenimiento de recursos sin ejecutar, sin aportar información objetiva que permita identificar el período presupuestario al que hace referencia, el monto presuntamente subejecutado, los proyectos afectados o algún elemento probatorio que respalde sus conclusiones. Asimismo, resulta importante indicar que la Municipalidad de Liberia administra los recursos provenientes de la Ley N.° 8114 de conformidad con el marco normativo aplicable, los lineamientos técnicos vigentes y los instrumentos de planificación institucional correspondientes. La programación y ejecución de dichos recursos responde a los proyectos, metas y prioridades establecidos en el Plan Quinquenal de Conservación, Desarrollo y Seguridad Vial Cantonal, así como a los presupuestos ordinarios y extraordinarios debidamente aprobados. De igual forma, la Municipalidad cumple de manera periódica con la elaboración y presentación de los informes presupuestarios, financieros y de ejecución que exige el ordenamiento jurídico, los cuales son sometidos a los mecanismos ordinarios de control, fiscalización y rendición de cuentas establecidos por la normativa nacional. En consecuencia, las afirmaciones realizadas por el recurrente en esta materia constituyen apreciaciones unilaterales que no se encuentran respaldadas por prueba alguna incorporada al expediente. Por ello, no existe elemento objetivo que permita concluir la existencia de desvío de recursos, uso irregular de fondos o una supuesta subejecución presupuestaria atribuible a esta Municipalidad. De manera que las denuncias planteadas corresponden a manifestaciones del recurrente que carecen de respaldo documental o técnico dentro de la presente acción constitucional y que no desvirtúan el cumplimiento de los procedimientos de planificación, presupuestación, ejecución y control que la Municipalidad de Liberia desarrolla conforme a la legislación vigente. (El resaltado es nuestro). Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, por lo que el recurso presentado debe declararse sin lugar (…) OCTAVO: 2. INACCIÓN COORDINADA (ALCALDÍA, CONCEJO Y UTGV): He agotado la vía administrativa mediante la réplica presentada el 09 de abril de 2026 (Folios 91 y 92), donde rechacé el acuerdo CM- 0292042026. La Alcaldía, el Concejo Municipal y la UTGV han mantenido una postura evasiva, trasladándose correspondencia entre ellos sin ejecutar las obras pluviales y peatonal necesarias en el sector de la Escuela La Victoria: De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06- 2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente: IX. SOBRE LA SUPUESTA “INACCIÓN COORDINADA” DE LA ALCALDÍA, EL CONCEJO MUNICIPAL Y LA UNIDAD TÉCNICA DE GESTIÓN VIAL Se rechaza la afirmación del recurrente relativa a una supuesta “inacción coordinada” por parte de la Alcaldía Municipal, el Concejo Municipal y la Unidad Técnica de Gestión Vial, por cuanto dicha manifestación constituye una apreciación subjetiva que no se ajusta a las actuaciones efectivamente desarrolladas por la Municipalidad de Liberia. Tal y como se ha expuesto en los antecedentes del presente informe, las distintas gestiones formuladas por el señor [Nombre 001] han sido conocidas, analizadas y atendidas por las dependencias municipales competentes, mediante la emisión de respuestas formales, valoraciones técnicas, inspecciones de campo, labores de mantenimiento e intervenciones ejecutadas en el sector, así como mediante la incorporación de las necesidades identificadas dentro de los procesos de planificación y programación institucional. Asimismo, debe señalarse que el hecho de que el recurrente no comparta los criterios técnicos, los alcances de las intervenciones realizadas, las prioridades institucionales o los plazos de ejecución comunicados por la Administración, no implica la inexistencia de atención administrativa ni permite concluir la existencia de una omisión o inactividad por parte de la Municipalidad. Por el contrario, la existencia de múltiples oficios, pronunciamientos técnicos y actuaciones administrativas emitidas en atención a las diversas solicitudes del recurrente evidencia que la Administración ha mantenido una gestión continua y permanente sobre los asuntos planteados, dentro del marco de sus competencias legales, posibilidades presupuestarias y planificación institucional. En consecuencia, no resulta procedente afirmar que exista una “inacción coordinada” entre las dependencias municipales recurridas, toda vez que las actuaciones desarrolladas demuestran una atención constante de las gestiones promovidas por el recurrente, así como la adopción de medidas técnicas y administrativas dirigidas a la atención progresiva de las condiciones de infraestructura peatonal y drenaje pluvial del sector objeto de consulta.” (El resaltado es nuestro). Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales. NOVENO: 3. HECHOS NUEVOS (FOLIO 93): Las pruebas contenidas en el Folio 93 demuestran que el estancamiento de aguas persiste en estación seca, lo cual es un hecho superviniente que la Sala no valoró en 2025. Ignorar esta prueba bajo el pretexto de un traslado de expedientes violenta el principio de verdad real: De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06- 2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente: “ II. SOBRE LA INEXISTENCIA DE UNA OMISIÓN ABSOLUTA DE LA ADMINISTRACIÓN Resulta incorrecta la afirmación de que la Municipalidad de Liberia haya permanecido inactiva frente a las situaciones denunciadas. Con anterioridad a la presentación del presente recurso, esta Administración emitió diversos criterios técnicos y respuestas formales dirigidas al señor [Nombre 001], en las cuales se atendieron las gestiones relacionadas con el sector de Barrio La Victoria y las inmediaciones de la Escuela La Victoria. En dichas respuestas se informó expresamente que: • El sector sería incorporado dentro de los programas de mantenimiento y limpieza preventiva de la Municipalidad. • Se programaron labores de limpieza de cordón y caño, retiro de sedimentos y eliminación de obstrucciones que afectaran el escurrimiento de aguas pluviales. • Durante los meses de enero, febrero y mayo del año 2026 se ejecutaron labores de limpieza de aceras, eliminación de vegetación invasiva, corte de árboles y despeje de zonas que interferían con el tránsito peatonal y el escurrimiento superficial de las aguas. • Se contempló la realización de inspecciones técnicas adicionales para verificar las condiciones del drenaje y definir las medidas correspondientes. Lo anterior demuestra que la Administración no ha permanecido inactiva ni ha incurrido en la alegada omisión absoluta descrita por el recurrente. (El resaltado es nuestro). Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales. DECIMO: 4. VULNERACIÓN A GRUPOS SENSIBLES: Esta desidia de la Municipalidad de Liberia afecta directamente los intereses superiores de niños, adultos mayores y personas con discapacidad (inválidos), quienes se ven obligados a transitar entre focos de contaminación y aguas estancadas, poniendo en riesgo su vida y salud: De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06-2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente: “ III. SOBRE LA INEXISTENCIA DE UNA OMISIÓN ABSOLUTA DE LA ADMINISTRACIÓN Resulta incorrecta la afirmación de que la Municipalidad de Liberia haya permanecido inactiva frente a las situaciones denunciadas. Con anterioridad a la presentación del presente recurso, esta Administración emitió diversos criterios técnicos y respuestas formales dirigidas al señor [Nombre 001], en las cuales se atendieron las gestiones relacionadas con el sector de Barrio La Victoria y las inmediaciones de la Escuela La Victoria. En dichas respuestas se informó expresamente que: • El sector sería incorporado dentro de los programas de mantenimiento y limpieza preventiva de la Municipalidad. • Se programaron labores de limpieza de cordón y caño, retiro de sedimentos y eliminación de obstrucciones que afectaran el escurrimiento de aguas pluviales. • Durante los meses de enero, febrero y mayo del año 2026 se ejecutaron labores de limpieza de aceras, eliminación de vegetación invasiva, corte de árboles y despeje de zonas que interferían con el tránsito peatonal y el escurrimiento superficial de las aguas. • Se contempló la realización de inspecciones técnicas adicionales para verificar las condiciones del drenaje y definir las medidas correspondientes. Lo anterior demuestra que la Administración no ha permanecido inactiva ni ha incurrido en la alegada omisión absoluta descrita por el recurrente. (El resaltado es nuestro). Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales. DECIMO PRIMERO: Sobre la inexistencia de Litispendencia y petitoria deconocimiento inmediato. Para asegurar la más absoluta transparencia procesal y evitar que se interprete de forma errónea la existencia de una identidad de causas, informo formalmente a este Tribunal que, con fecha de hoy, he presentado el desistimiento total y definitivo del expediente N° 26-012198-0007- CO. En virtud de lo anterior, no existe riesgo de duplicidad ni litispendencia, quedando este expediente (26-018775-0007-CO) como la única vía activa donde se solicita la tutela urgente de los derechos a la salud, la vida y la accesibilidad (Ley 7600) de la población escolar y vecinos de Barrio La Victoria en Liberia\". Agregaen todo caso, que \"ASUNTO: MANIFESTACIONES, FORMULA VALORACIÓN DE PRUEBA NUEVA INCORPORADA AL EXPEDIENTE (OFICIO MUNICIPAL CM-0453-05-2026 EN FOLIO 143 Y ACTUALIZACIÓN SATELITAL PLUVIAL EN FOLIO 144). Ejerciendo el derecho de defensa y con la firme intención de mantener debidamente instruido, actualizado y fundamentado este expediente judicial, comparezco ante este Tribunal con el debido respeto para exponer, manifestar y articular un análisis jurídico sobre los elementos probatorios de carácter documental y técnico-satelital incorporados a los autos bajo los folios de referencia, para que sean valorados de forma conjunta al momento de resolver el fondo de esta causa: De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06-2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente: “ I. SOBRE LA ATENCIÓN REITERADA DE LAS GESTIONES FORMULADAS POR EL RECURRENTE Debe señalarse que la Municipalidad de Liberia ha mantenido una atención permanente respecto de las diversas solicitudes, denuncias, observaciones y requerimientos formulados por el señor [Nombre 001] relacionados con las condiciones de infraestructura peatonal y pluvial del sector objeto de discusión. De la revisión de los antecedentes administrativos se desprende que el recurrente ha presentado múltiples escritos relacionados con los mismos hechos o con aspectos estrechamente vinculados entre sí, los cuales han sido oportunamente conocidos y atendidos por la Administración mediante respuestas formales, valoraciones técnicas, inspecciones y actuaciones administrativas acordes con las competencias municipales. Asimismo, muchas de las manifestaciones contenidas en las gestiones más recientes constituyen reiteraciones, ampliaciones o reformulaciones de planteamientos que ya habían sido previamente analizados y respondidos por la Municipalidad. No obstante, aun tratándose de asuntos sobre los cuales existían pronunciamientos previos, la Administración continuó brindando respuesta a los nuevos escritos presentados por el recurrente, manteniendo en todo momento el deber de atención y comunicación con el administrado. En consecuencia, no es cierto, como lo manifiesta el recurrente, que exista una negativa de atención, falta de respuesta o desinterés institucional respecto de las solicitudes formuladas por el recurrente, toda vez que la Municipalidad ha mantenido una actuación continua y documentada sobre los asuntos planteados, tanto en sede administrativa como en los distintos procesos constitucionales promovidos por este.” (El resaltado es nuestro). Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales. DECIMO SEGUNDO: 4. PRIMERO: SOBRE LA INERCIA MUNICIPAL PLENAMENTE ACREDITADA EN EL FOLIO 1431. Consta incorporado en autos el FOLIO 143 del expediente, el cual contiene el oficio número CM-0453-05-2026 de fecha 27 de mayo de 2026, emitido por la Secretaría del Concejo Municipal de Liberia. En dicho documento se transcribe el acuerdo adoptado por el Concejo Municipal en el artículo tercero de la Sesión Ordinaria No. 127-2026, celebrada el 26 de mayo de 2026. (...) Ejerciendo el derecho de defensa y con la firme intención de mantener debidamente instruido, actualizado y fundamentado este expediente judicial, comparezco ante este Tribunal con el debido respeto para exponer, manifestar y articular un análisis jurídico sobre los elementos probatorios de carácter documental, técnico-satelital, inspección instrumental de campo e información epistolar sobrevenida incorporados a los autos, para que sean valorados de forma conjunta al momento de resolver el fondo de esta causa: Con respecto a este punto se aclara a su respetable autoridad que son hechos que corresponde atender el Concejo Municipal como órgano colegiado y deliberativo de conformidad con el Código Municipal artículo 13 en donde se indican las atribuciones y funciones que debe de ejercer este cuerpo colegiado. Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales. DECIMO TERCERO: 5. SEGUNDO: SOBRE LA INERCIA MUNICIPAL PLENAMENTE ACREDITADA EN EL FOLIO 143 Consta incorporado en autos el FOLIO 143 del expediente, el cual contiene el oficio número CM045305-2026 de fecha 27 de mayo de 2026, emitido por la Secretaría del Concejo Municipal de Liberia. En dicho documento se transcribe el acuerdo adoptado por el Concejo Municipal en el artículo tercero de la Sesión Ordinaria No. 127-2026, celebrada el 26 de mayo de 2026. Respetuosamente solicito a los Señores Magistrados constatar y valorar que ante la denuncia formal por desobediencia y la flagrancia de un foco infeccioso putrefacto frente a una escuela de niños, la máxima autoridad del cantón de Liberia decide calificar de forma displicente la situación comunitaria como un asunto puramente \"informativo\", decretando textualmente de forma literal: \"SE ACUERDA TOMAR NOTA POR SER UN ASUNTO INFORMATIVO, SE RENDIRA EL RESPETIVO INFORME CUANDO NOTIFIQUE LA SALA CONSTITUCIONAL.\" Esta postura de cómoda expectativa y deliberada inacción plasmada en el FOLIO 143, donde se supedita cualquier intervención material o solución técnica al momento en que este Tribunal Constitucional les ordene rendir cuentas, demuestra la total ausencia de un sentido de Buen Servicio Público y configura plenamente la lesión grave, continua e irreversible que sufren los menores de edad y vecinos del Barrio La Victoria. Ampliación sobre el Abandono de Competencias e Infracción a los Deberes de la Administración Activa: El acuerdo del Concejo Municipal documentado en el Folio 143 tipifica lo que la doctrina más autorizada del Derecho Administrativo denomina una abdicación voluntaria de las competencias legales de imperio y de policía sanitaria. Al calificar como un mero \"asunto informativo\" la existencia de un foco de contaminación orgánica y descomposición pluvial frente a un establecimiento de educación primaria, el cuerpo deliberativo municipal infringe de manera directo el bloque de legalidad establecido en el artículo 4 del Código Municipal. Las entidades corporativas locales poseen autonomía, pero esta no las faculta para el desabatecimiento de sus obligaciones inmediatas frente a la salud y la seguridad ambiental de sus habitantes. (...) Con respecto a este punto se aclara a su respetable autoridad que son hechos que corresponde atender el Concejo Municipal como órgano colegiado y deliberativo de conformidad con el Código Municipal artículo 13 en donde se indican las atribuciones y funciones que debe de ejercer este cuerpo colegiado. Considerando este municipio que no se le vulneran los derechos fundamentales alegados por el recurrente, ya que toda actuación de este municipio debe de ajustarse a su plan quinquenal cumpliendo con el principio de legalidad que es el pilar de toda la actuación de la administración pública, por lo que el recurso presentado debe declararse sin lugar, ya que no se le han vulnerado los derechos fundamentales. DECIMO CUARTO: 6, CUARTO: SOBREVENIDA ADMISIÓN DE LA CRISIS SANITARIA POR EL ALCALDE MUNICIPAL (FOLIO 145) Con el fin de robustecer los autos, solicito se incorpore y valore de forma conjunta la manifestación oficial y pública emitida el domingo 31 de mayo de 2026, por el jerarca del órgano ejecutivo de la misma entidad accionada, el señor Alcalde de Liberia, José Javier Calvo Darcia. Dicha declaración pública constituye una confesión extrajudicial ineludible sobre los hechos denunciados, donde la máxima autoridad municipal textualmente señala: \"Quiero advertir respetuosamente a toda la ciudadanía que, a partir de mañana, he girado instrucciones a la Policía Municipal de Liberia y al Departamento de Inspectores Municipales para que realicen operativos de inspección y notificación en todo el cantón, con el fin de combatir una práctica inaceptable que afecta la salud pública, el ambiente y la imagen de nuestra ciudad. Me refiero al desfogue ilegal de aguas servidas, aguas negras y aguas residuales provenientes de viviendas y establecimientos hacia los caños, cunetas, alcantarillas y espacios públicos. No podemos seguir tolerando que algunos pocos continúen contaminando nuestros barrios, generando malos olores, focos de infección, proliferación de insectos y afectando la calidad de vida de los vecinos (...) De ser necesario, agotaremos todas las vías administrativas y legales disponibles hasta las últimas consecuencias para erradicar definitivamente esta asquerosa e irresponsable práctica. Liberia merece una ciudad limpia, ordenada, saludable y respetuosa del ambiente. La colaboración ciudadana será fundamental para alcanzar este objetivo. No habrá tolerancia para quienes atenten contra la salud y el bienestar de nuestra comunidad.\" A partir de este nuevo elemento probatorio, resulta indispensable resaltar ante este Tribunal Constitucional: • Confesión de las condiciones lesivas: El propio Alcalde de la Municipalidad de Liberia reconoce de forma pública y expresa la existencia fáctica de \"focos de infección\", \"proliferación de insectos\", \"malos olores\" y afectaciones directas a la \"salud pública\" y al \"ambiente\", tal y como este recurrente lo ha acreditado técnicamente para el Barrio La Victoria en el Folio 144. • Contradicción institucional interna: Mientras el Concejo Municipal adopta en el Folio 143 una postura omisiva de \"tomar nota\" y calificar la emergencia escolar como un mero \"asunto informativo\" a la espera de ser notificados por esta Sala, el Alcalde Municipal califica la situación en la realidad cantonal como una \"asquerosa e irresponsable práctica\" que amerita el despliegue inmediato de la fuerza pública e inspectores\". (...) El colapso del casco central, la inundación del Hospital Enrique Baltodano Briceño y de la sede local del Poder Judicial constituyen manifestaciones materiales irrefutables del agotamiento absoluto de la red pluvial urbana de Liberia\". Con base en las situaciones expuestas, estima que se han vulnerado derechos fundamentales. Pide se declare con lugar el recurso. De conformidad con lo anterior, y en acatamiento al Código Municipal y demás normativa atinente, no es cierto lo que alega el recurrente en este hecho, ya que mediante el oficio PUTGV-0860-06- 2025, de fecha del 22 de junio de 2026, suscrito por el Ing. Dorian A. Ulate Elizondo, Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Liberia, indica lo siguiente: “ III. SOBRE LAS MANIFESTACIONES RELACIONADAS CON LAS DESCARGAS DE AGUAS SERVIDAS AL SISTEMA PLUVIAL El recurrente pretende presentar las manifestaciones públicas realizadas por el señor Alcalde Municipal como una supuesta admisión de responsabilidad institucional respecto de los hechos denunciados. Sin embargo, una lectura integral de dichas declaraciones permite arribar a una conclusión distinta. Tal y como el propio recurrente transcribe en su gestión, el señor Alcalde Municipal comunicó el inicio de operativos de inspección, fiscalización y notificación dirigidos a combatir el vertido ilegal de aguas servidas, aguas negras y aguas residuales hacia caños, cunetas, alcantarillas y demás elementos de la infraestructura pluvial. Lejos de evidenciar una omisión institucional, dichas manifestaciones reflejan las acciones que viene impulsando la Municipalidad de Liberia para atender una problemática que afecta diversos sectores del cantón y que está estrechamente relacionada con las conexiones indebidas al sistema pluvial y la acumulación de residuos sólidos en la infraestructura de drenaje. Debe señalarse además que esta situación no es exclusiva del sector de Barrio La Victoria ni constituye una problemática cuya solución dependa únicamente de la Municipalidad. Por el contrario, su atención requiere la participación y coordinación de diversas instituciones públicas dentro del ámbito de sus competencias, entre ellas el Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados (AyA), el Ministerio Público cuando corresponda, así como la propia Municipalidad de Liberia, mediante labores de inspección, fiscalización, investigación y aplicación de las medidas correctivas correspondientes. Asimismo, las valoraciones técnicas realizadas por esta Unidad han permitido determinar que las condiciones de aguas estancadas y malos olores observadas en determinados puntos no obedecen necesariamente a deficiencias de diseño de la infraestructura pluvial, sino principalmente a la descarga indebida de aguas servidas y a la acumulación de basura, residuos sólidos y sedimentos dentro de los sistemas de drenaje, factores que afectan directamente su funcionamiento. En consecuencia, las declaraciones citadas por el recurrente no constituyen una admisión de errores de diseño, incumplimientos o falta de actuación por parte de la Municipalidad, sino más bien la confirmación de que la Administración se encuentra ejecutando acciones concretas para atender una problemática sanitaria y ambiental compleja, cuya solución requiere actuaciones coordinadas entre distintas instituciones y la corrección de conductas irregulares por parte de terceros. IV. SOBRE LAS REFERENCIAS A INUNDACIONES OCURRIDAS EN OTROS SECTORES DEL CANTÓN Asimismo, resulta importante señalar que el recurrente intenta vincular al objeto del presente recurso una serie de eventos que no guardan relación directa con los hechos denunciados en Barrio La Victoria. En particular, hace referencia a las afectaciones registradas en el casco central de Liberia, el Hospital Enrique Baltodano Briceño y la sede local del Poder Judicial, presentándolas como una supuesta evidencia del agotamiento absoluto de la red pluvial urbana. No obstante, dichos acontecimientos corresponden a una situación extraordinaria ocurrida entre los días 5 y 8 de junio de 2026, período durante el cual el cantón de Liberia se vio afectado por un evento hidrometeorológico de alta intensidad asociado a la influencia de la Zona de Convergencia Intertropical, el cual ocasionó precipitaciones excepcionales, inundaciones y afectaciones en diversos puntos del cantón. Tales eventos responden a una condición de emergencia de carácter generalizado y no guardan relación directa con los hechos objeto del presente recurso ni con las condiciones específicas denunciadas por el señor [Nombre 001]. Por consiguiente, no resulta técnicamente correcto utilizar situaciones de emergencia ocurridas en distintos sectores del cantón para sustentar afirmaciones relacionadas con las condiciones específicas denunciadas en las inmediaciones de la Escuela La Victoria, ni para concluir la existencia de una supuesta omisión administrativa en el sitio objeto del presente recurso. En consecuencia, las referencias realizadas por el recurrente a dichas inundaciones extraordinarias corresponden a situaciones distintas e independientes de la problemática aquí discutida, razón por la cual no constituyen un elemento técnico que permita acreditar las afirmaciones formuladas en contra de la Municipalidad de Liberia respecto del sector de Barrio La Victoria. V. ACCIONES DE MITIGACIÓN Y SEGUIMIENTO Sin perjuicio de las consideraciones técnicas expuestas en el presente informe y del rechazo de las afirmaciones formuladas por el recurrente en cuanto a supuestas fallas de diseño, omisiones absolutas o incumplimientos institucionales, la Municipalidad de Liberia mantiene su compromiso con la mejora continua de las condiciones de movilidad peatonal, drenaje pluvial y salud pública en el sector de Barrio La Victoria y sus alrededores. En ese sentido, la Administración continuará ejecutando las siguientes acciones dentro del marco de sus competencias y disponibilidad de recursos: 1. Mantenimiento periódico del sistema pluvial, incluyendo labores de limpieza de cordón y caño, retiro de sedimentos, eliminación de residuos y desobstrucción de elementos de drenaje en los sectores identificados como prioritarios. 2. Inspecciones técnicas de seguimiento, con el propósito de verificar el funcionamiento de la infraestructura pluvial existente y determinar la necesidad de intervenciones adicionales cuando técnicamente corresponda. 3. Continuación de las mejoras en infraestructura peatonal, conforme a los programas de mantenimiento, rehabilitación y reconstrucción establecidos dentro de la planificación institucional y los criterios de priorización vigentes. 4. Ejecución progresiva del Proyecto Integral de Saneamiento Pluvial de Barrios del Sur, desarrollado a partir de los estudios técnicos contratados por la Municipalidad y programado por etapas conforme a la disponibilidad presupuestaria y la secuencia constructiva definida en el diseño del proyecto. 5. Coordinación interinstitucional con el Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados (AyA) y demás entidades competentes, para la identificación y atención de descargas irregulares de aguas servidas, aguas residuales y otras situaciones que puedan afectar el adecuado funcionamiento de los sistemas pluviales. 6. Fiscalización de situaciones atribuibles a terceros, incluyendo la disposición inadecuada de residuos sólidos y las conexiones indebidas al sistema pluvial, mediante los procedimientos administrativos que correspondan. Las acciones descritas forman parte de la gestión ordinaria que desarrolla la Municipalidad de Liberia para la conservación y mejora de la infraestructura vial y pluvial del cantón, y evidencian que la Administración mantiene un seguimiento permanente de las necesidades existentes en el sector dentro de un proceso de atención integral y progresiva (…)”.\n\n6.- Por escritos incorporados al expediente el 22 y 23 de junio de 2026, el accionante plantea réplicas al informe del alcalde accionado.\n\n7.- Por escrito incorporado al expediente el 23 de junio de 2026, el accionante aporta documentación y resalta que las aceras de determinados sectores referidos no cumplen con disposición de la Ley nro. 7600. \n\n8.- Por escrito incorporado al expediente el 23 de junio de 2026, Luis Enrique Mayorga Díaz, director del Área Rectora de Salud de Liberia del Ministerio de Salud, informa: “PRIMERO- Informe Técnico MS-DRRSCH-DARSL-ER-IT-0082-2026, de fecha 22 junio 2026, para dar respuesta al recurso de amparo que nos notificó. SEGUNDO-. El día 19 de junio de 2026, se realizó visita de seguimiento, para verificar las ordenes sanitaria emitidas en abril del presente año. SOBRE LOS HECHOS DE LO ACTUADO SE INFORMA LO SIGUIENTE: De acuerdo y basados con la información que se ha suministrado, inspección realizada, se determinó que las personas a quienes se le aplico las ordenes sanitaria cumplieron con lo que este Ministerio les ordeno según la normativa vigente.”.\n\n9.- Por escrito incorporado al expediente el 23 de junio de 2026, el accionante plantea réplica al informe rendido por el Área Rectora de Salud de Liberia. \n\n10.- Por escrito incorporado al expediente el 23 de junio de 2026, María Lourdes Ocampo Fernández, presidenta del Concejo Municipal de Liberia, rinde informe en los mismos términos que el alcalde ese gobierno local. \n\n11.- Por escritos incorporados al expediente el 24 de junio de 2026, el accionante plantea réplica a los informes de la municipalidad recurrida y aporta documentación. \n\n12.- Por escrito incorporado al expediente el 21 de julio de 2026, el accionante formula manifestaciones. Dentro de ellas, solicita que se declare la desobediencia de la sentencia dictada en el expediente nro. 23-024765-0007-CO.\n\n13.- Por escrito incorporado al expediente el 1° de agosto de 2026, el accionante realiza manifestaciones relacionadas con el expediente nro. 26-021768-0007-CO\n\n14.- Por escrito incorporado al expediente el 19 de agosto de 2026, el accionante solicita la pronta resolución del recurso. \n\n15.- Por escrito incorporado al expediente el 3 de septiembre de 2026, el accionante aporta imágenes y documentación. Asimismo, plantea réplica a lo informado por la municipalidad recurrida.\n\n16.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\nConsiderando:\n\n \n\nI.- OBJETO DEL RECURSO. El accionante acusa omisiones de las autoridades recurridas respecto de la infraestructura peatonal en el barrio La Victoria de Liberia. En ese tanto, expone: “El propósito medular de este instrumento es acreditar ante este Tribunal la subsistencia de una omisión absoluta de solución técnica y material en el Barrio La Victoria de Liberia (específicamente en el cuadrante de la Escuela local, Calle 11 y Avenidas 6, 8 y 10).”. Detalla que en ese sitio existen problemas de infraestructura pluvial, colapso de desfogues, ausencia absoluta de aceras seguras (particularmente en las inmediaciones de la escuela La Victoria). Esgrime que el sistema pluvial recibe el caudal de distintos comercios, lo que provoca que el agua se desborde justamente en el centro educativo, en lugar de seguir la línea natural de desfogue. Así, acota que las esquinas de las avenidas 8 y 10 y la calle 11 mantienen una acumulación permanente de escorrentías y el agua estancada ocasiona olores fétidos, lo cual implica un foco permanente de contaminación y de criadero de vectores que ponen en riesgo a la población, especialmente a los estudiantes de la escuela referida. Agrega que en el margen derecho de la calle 11 (sentido sur), por aproximadamente 100 metros no hay aceras ni cordón de caño, y en el margen izquierdo la infraestructura se encuentra en ruina (con huecos, fracturada y con obstrucciones físicas), lo que además implica dificultades de acceso según lo exige la ley nro. 7600. Explica que esta situación obliga a los estudiantes y a las personas que transitan por el sitio, a desplazarse por la calzada vehicular, lo cual implica un riesgo para ellos. \n\nII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: \n\nRespecto de la Municipalidad de Liberia:\n\na) Los problemas relacionados con la infraestructura peatonal en “el cuadrante de la Escuela local, Calle 11 y Avenidas 6, 8 y 10” había sido denunciado por el accionante al menos desde 2025. (Informe de la autoridad recurrida).\n\nb) En enero, febrero y mayo de 2026, la municipalidad accionada realizó labores de limpieza de aceras, eliminación de vegetación invasiva, corte de árboles y despeje de zonas que interferían con el tránsito peatonal y el escurrimiento superficial de las aguas. (Informe de la autoridad recurrida). \n\nc) En cuanto al sistema pluvial, la municipalidad accionada indica que “las condiciones observadas en algunos puntos del sector están asociadas principalmente a factores externos, tales como la descarga indebida de aguas servidas al sistema pluvial y la acumulación de residuos sólidos y sedimentos que afectan su funcionamiento.”. Asimismo, se inició un proyecto integral para el manejo de aguas pluviales en los “Barrios del Sur de Liberia”; empero, aún no se ha iniciado la intervención en el sector de Barrio La Victoria. (Informe de la autoridad recurrida).\n\nd) En el oficio nro. 0358-03-2026 de 23 de marzo de 2026, la Unidad Técnica de Gestión Vial del gobierno local accionado detalló: “(…) en relación con la inexistencia parcial de infraestructura peatonal y pluvial en algunos tramos de la Calle 11 y Avenida 10, se reitera que el artículo 84 del Código Municipal establece como obligación primeria de los propietarios registrales la construcción y el mantenimiento de las aceras frente a sus inmuebles. De conformidad con dicha norma corresponde a la Municipalidad fiscalizar y notificar a los propietarios obligados y, en caso de constatarse omisión, valorar la ejecución subsidiaria de las obras necesarias, procediendo posteriormente al cobro del costo mediante tasa o contribución especial (…) En aquellos sectores donde no existen aceras, el citado artículo 84 del Código Municipal mantiene la responsabilidad directa de los propietarios de construirlas frente a sus inmuebles. De acuerdo con lo señalado en los oficios anteriores, y ante solicitudes de revisión o estudios adicionales en otros puntos del sector, la Municipalidad procederá nuevamente con las notificaciones correspondientes en los casos en los que se identifiquen nuevos incumplimientos. De persistir el incumplimiento, y según la disponibilidad presupuestaria, la ejecución de las obras necesarias podrá realizarse con apego al presupuesto municipal del año 2026, o bien ser programada en presupuestos posteriores (…)”.\n\ne) En el oficio nro. PUTGV-0860-06-2025, de fecha del 22 de junio de 2026, la Unidad Técnica de Gestión Vial de la municipalidad accionada consignó: “se afirma una supuesta ausencia de infraestructura peatonal frente a la Escuela La Victoria, cuando en realidad el frente principal de dicho centro educativo se ubica sobre la intersección de la Avenida 10 y Calle 15, sector que cuenta con infraestructura peatonal destinada al tránsito de estudiantes, personal docente y usuarios en general. Asimismo, si bien existen algunos tramos de acera en sectores aledaños que presentan distintos niveles de deterioro y que requieren intervenciones de mantenimiento, rehabilitación o reconstrucción, ello no significa que exista una ausencia total de infraestructura peatonal (…)”. (Informe de la autoridad recurrida).\n\nf) En el oficio nro. PUTGV-0860-06-2025, de fecha del 22 de junio de 2026, la Unidad Técnica de Gestión Vial de la municipalidad accionada detalla que deberá llevar a cabo las siguientes acciones de seguimiento: “1. Mantenimiento periódico del sistema pluvial, incluyendo labores de limpieza de cordón y caño, retiro de sedimentos, eliminación de residuos y desobstrucción de elementos de drenaje en los sectores identificados como prioritarios. 2. Inspecciones técnicas de seguimiento, con el propósito de verificar el funcionamiento de la infraestructura pluvial existente y determinar la necesidad de intervenciones adicionales cuando técnicamente corresponda. 3. Continuación de las mejoras en infraestructura peatonal, conforme a los programas de mantenimiento, rehabilitación y reconstrucción establecidos dentro de la planificación institucional y los criterios de priorización vigentes. 4. Ejecución progresiva del Proyecto Integral de Saneamiento Pluvial de Barrios del Sur, desarrollado a partir de los estudios técnicos contratados por la Municipalidad y programado por etapas conforme a la disponibilidad presupuestaria y la secuencia constructiva definida en el diseño del proyecto. 5. Coordinación interinstitucional con el Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados (AyA) y demás entidades competentes, para la identificación y atención de descargas irregulares de aguas servidas, aguas residuales y otras situaciones que puedan afectar el adecuado funcionamiento de los sistemas pluviales. 6. Fiscalización de situaciones atribuibles a terceros, incluyendo la disposición inadecuada de residuos sólidos y las conexiones indebidas al sistema pluvial, mediante los procedimientos administrativos que correspondan.”. (Informe de la autoridad recurrida).\n\nRespecto del Área Rectora de Salud de Liberia: \n\ng) El 24 de marzo de 2026, el accionante presentó una denuncia ante el Área Rectora de Salud de Liberia, por problemas relaciones con “evacuación de aguas (…) condiciones se seguridad e higiene”, concretamente en “DE LA ESCUELA VICTORIA, UBICADA FTE A AVENIDA 10, A UNA DISTANCIA APROXIMADA DE 6 A 8 MTS AL OESTE, DE ESE PUNTO HACIA ABAJO AL SUR SOBRE CALLE 11 MARGEN IZQUIERDO”. (Prueba documental).\n\nh) El Área Rectora de Salud de Liberia dictó las órdenes sanitarias nros. 018-2026, 019-2026, 021-2026, 022-2026, 024-2026 y 025-2026, contra propietarios de varias viviendas en la zona. En tales órdenes se dispuso: “Disponer sanitariamente de las aguas residuales producidas en la vivienda o establecimiento, dentro de los límites de su propiedad a fin de evitar la contaminación del suelo, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.”. (Prueba documental). \n\ni) El Área Rectora de Salud de Liberia fue notificada de la resolución de curso de este proceso el 18 de junio de 2026. (Acta de notificación agregada al expediente).\n\nj) El 19 de junio de 2026, el Área Rectora de Salud de Liberia realizó una inspección de seguimiento de las órdenes sanitarias dictadas y en el informe nro. MS-DRRSCH-DARSL-ER-IT-0082-2026 de 22 junio 2026, se consignó: “se verifica en sitio que se cumplió con la disposición adecuada de las aguas residuales y respectivos sistemas de tratamiento (…)”. (Prueba documental).\n\nIII.- HECHO NO PROBADO. De importancia para la decisión de este asunto, se estima como no demostrados los siguientes hechos:\n\na) Que el Área Rectora de Salud de Liberia le haya notificado al tutelado el informe nro. MS-DRRSCH-DARSL-ER-IT-0082-2026 de 22 junio 2026, dentro del procedimiento de su denuncia. \n\nIV.- SOBRE EL CASO CONCRETO. En el sub lite, el accionante acusa omisiones de las autoridades recurridas respecto de la infraestructura peatonal en el barrio La Victoria de Liberia. En ese tanto, expone: “El propósito medular de este instrumento es acreditar ante este Tribunal la subsistencia de una omisión absoluta de solución técnica y material en el Barrio La Victoria de Liberia (específicamente en el cuadrante de la Escuela local, Calle 11 y Avenidas 6, 8 y 10).”. Detalla que en ese sitio existen problemas de infraestructura pluvial, colapso de desfogues, ausencia absoluta de aceras seguras (particularmente en las inmediaciones de la escuela La Victoria). Agrega que en el margen derecho de la calle 11 (sentido sur), por aproximadamente 100 metros no hay aceras ni cordón de caño, y en el margen izquierdo la infraestructura se encuentra en ruina (con huecos, fracturada y con obstrucciones físicas), lo que además implica dificultades de acceso según lo exige la ley nro. 7600. Explica que esta situación obliga a los estudiantes y a las personas que transitan por el sitio, a desplazarse por la calzada vehicular, lo cual implica un riesgo para ellos.\n\nDel estudio de los autos se tiene por demostrado, que, los problemas relacionados con la infraestructura peatonal en “el cuadrante de la Escuela local, Calle 11 y Avenidas 6, 8 y 10” había sido denunciado por el accionante al menos desde 2025. En enero, febrero y mayo de 2026, la municipalidad accionada realizó labores de limpieza de aceras, eliminación de vegetación invasiva, corte de árboles y despeje de zonas que interferían con el tránsito peatonal y el escurrimiento superficial de las aguas. En cuanto al sistema pluvial, la municipalidad accionada indica que “las condiciones observadas en algunos puntos del sector están asociadas principalmente a factores externos, tales como la descarga indebida de aguas servidas al sistema pluvial y la acumulación de residuos sólidos y sedimentos que afectan su funcionamiento.”. Asimismo, se inició un proyecto integral para el manejo de aguas pluviales en los “Barrios del Sur de Liberia”; empero, aún no se ha iniciado la intervención en el sector de Barrio La Victoria. De acuerdo con lo señalado en los oficios anteriores, y ante solicitudes de revisión o estudios adicionales en otros puntos del sector, la Municipalidad procederá nuevamente con las notificaciones correspondientes en los casos en los que se identifiquen nuevos incumplimientos. De persistir el incumplimiento, y según la disponibilidad presupuestaria, la ejecución de las obras necesarias podrá realizarse con apego al presupuesto municipal del año 2026, o bien ser programada en presupuestos posteriores (…)”. En el oficio nro. PUTGV-0860-06-2025, de fecha del 22 de junio de 2026, la Unidad Técnica de Gestión Vial de la municipalidad accionada consignó: “se afirma una supuesta ausencia de infraestructura peatonal frente a la Escuela La Victoria, cuando en realidad el frente principal de dicho centro educativo se ubica sobre la intersección de la Avenida 10 y Calle 15, sector que cuenta con infraestructura peatonal destinada al tránsito de estudiantes, personal docente y usuarios en general. Asimismo, si bien existen algunos tramos de acera en sectores aledaños que presentan distintos niveles de deterioro y que requieren intervenciones de mantenimiento, rehabilitación o reconstrucción, ello no significa que exista una ausencia total de infraestructura peatonal (…)”. En el oficio nro. PUTGV-0860-06-2025, de fecha del 22 de junio de 2026, la Unidad Técnica de Gestión Vial de la municipalidad accionada detalla que deberá llevar a cabo las siguientes acciones de seguimiento: “1. Mantenimiento periódico del sistema pluvial, incluyendo labores de limpieza de cordón y caño, retiro de sedimentos, eliminación de residuos y desobstrucción de elementos de drenaje en los sectores identificados como prioritarios. 2. Inspecciones técnicas de seguimiento, con el propósito de verificar el funcionamiento de la infraestructura pluvial existente y determinar la necesidad de intervenciones adicionales cuando técnicamente corresponda. 3. Continuación de las mejoras en infraestructura peatonal, conforme a los programas de mantenimiento, rehabilitación y reconstrucción establecidos dentro de la planificación institucional y los criterios de priorización vigentes. 4. Ejecución progresiva del Proyecto Integral de Saneamiento Pluvial de Barrios del Sur, desarrollado a partir de los estudios técnicos contratados por la Municipalidad y programado por etapas conforme a la disponibilidad presupuestaria y la secuencia constructiva definida en el diseño del proyecto. 5. Coordinación interinstitucional con el Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados (AyA) y demás entidades competentes, para la identificación y atención de descargas irregulares de aguas servidas, aguas residuales y otras situaciones que puedan afectar el adecuado funcionamiento de los sistemas pluviales. 6. Fiscalización de situaciones atribuibles a terceros, incluyendo la disposición inadecuada de residuos sólidos y las conexiones indebidas al sistema pluvial, mediante los procedimientos administrativos que correspondan.”. El 24 de marzo de 2026, el accionante presentó una denuncia ante el Área Rectora de Salud de Liberia, por problemas relaciones con “evacuación de aguas (…) condiciones se seguridad e higiene”, concretamente en “DE LA ESCUELA VICTORIA, UBICADA FTE A AVENIDA 10, A UNA DISTANCIA APROXIMADA DE 6 A 8 MTS AL OESTE, DE ESE PUNTO HACIA ABAJO AL SUR SOBRE CALLE 11 MARGEN IZQUIERDO”. El Área Rectora de Salud de Liberia dictó las órdenes sanitarias nros. 018-2026, 019-2026, 021-2026, 022-2026, 024-2026 y 025-2026, contra propietarios de varias viviendas en la zona. En tales órdenes se dispuso: “Disponer sanitariamente de las aguas residuales producidas en la vivienda o establecimiento, dentro de los límites de su propiedad a fin de evitar la contaminación del suelo, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.”. El Área Rectora de Salud de Liberia fue notificada de la resolución de curso de este proceso el 18 de junio de 2026. El 19 de junio de 2026, el Área Rectora de Salud de Liberia realizó una inspección de seguimiento de las órdenes sanitarias dictadas y en el informe nro. MS-DRRSCH-DARSL-ER-IT-0082-2026 de 22 junio 2026, se consignó: “se verifica en sitio que se cumplió con la disposición adecuada de las aguas residuales y respectivos sistemas de tratamiento (…)”. \n\nEn primer lugar, respecto de la Municipalidad de Liberia, resulta necesaria la intervención de esta jurisdicción constitucional.\n\nAl respecto, si bien el gobierno local accionada ha ejecutado algunas obras para atender la problemática denunciada por el tutelado (verbigracia, limpieza de aceras, eliminación de vegetación invasiva, corte de árboles y despeje de zonas que interferían con el tránsito peatonal y el escurrimiento superficial de las aguas), no se constata que se haya solucionado, de manera definitiva e integral, la situación de marras. \n\nAl respecto, véase que uno de los problemas acusados en el sector (“Barrio La Victoria de Liberia (específicamente en el cuadrante de la Escuela local, Calle 11 y Avenidas 6, 8 y 10)”, es el relativo al sistema pluvial, que según aduce el accionante, ocasiona que el agua se desborde y se acumule en determinados sitios, produciendo contaminación y riesgo para las personas. En ese tanto, la autoridad recurrida no niega que existan situaciones como las referidas, pues informa: “las condiciones observadas en algunos puntos del sector están asociadas principalmente a factores externos, tales como la descarga indebida de aguas servidas al sistema pluvial y la acumulación de residuos sólidos y sedimentos que afectan su funcionamiento.”. Además, explicó la necesidad de ejecutar un proyecto integral para el manejo de aguas pluviales, el cual ya inició en otros sectores de los barrios del sur de Liberia, pero aún no en el Barrio La Victoria. \n\nDe tal manera, en relación con este aspecto, la municipalidad accionada no da garantía de que, finalmente, la situación se vaya a intervenir y solucionar dentro de un plazo razonable. \n\nPor otra parte, respecto de la falta de aceras y los problemas de la infraestructura en el sitio de marras, tampoco se observa una gestión de la municipalidad accionada para solucionar el asunto de manera célere y efectiva. En primer lugar, véase que, mediante el oficio nro. 0358-03-2026 de 23 de marzo de 2026, la Unidad Técnica de Gestión Vial del gobierno local accionado no refutó el problema de marras, sino que se limitó a indicar: “en relación con la inexistencia parcial de infraestructura peatonal y pluvial en algunos tramos de la Calle 11 y Avenida 10, se reitera que el artículo 84 del Código Municipal establece como obligación primeria de los propietarios registrales la construcción y el mantenimiento de las aceras frente a sus inmuebles. De conformidad con dicha norma corresponde a la Municipalidad fiscalizar y notificar a los propietarios obligados y, en caso de constatarse omisión, valorar la ejecución subsidiaria de las obras necesarias, procediendo posteriormente al cobro del costo mediante tasa o contribución especial (…) En aquellos sectores donde no existen aceras, el citado artículo 84 del Código Municipal mantiene la responsabilidad directa de los propietarios de construirlas frente a sus inmuebles. De acuerdo con lo señalado en los oficios anteriores, y ante solicitudes de revisión o estudios adicionales en otros puntos del sector, la Municipalidad procederá nuevamente con las notificaciones correspondientes en los casos en los que se identifiquen nuevos incumplimientos. De persistir el incumplimiento, y según la disponibilidad presupuestaria, la ejecución de las obras necesarias podrá realizarse con apego al presupuesto municipal del año 2026, o bien ser programada en presupuestos posteriores (…)”. Sin embargo, no constan acciones concretas ni para fiscalizar la construcción de aceras por parte de los propietarios ni para ejecutar directamente las obras en cuestión. \n\nAhora, si bien posteriormente en el oficio nro. PUTGV-0860-06-2025, de 22 de junio de 2026, la Unidad Técnica de Gestión Vial de la municipalidad accionada indicó que frente a la escuela La Victoria sí hay infraestructura peatonal, no menos cierto es que reconoce que “existen algunos tramos de acera en sectores aledaños que presentan distintos niveles de deterioro y que requieren intervenciones de mantenimiento, rehabilitación o reconstrucción”. Además, tampoco se detallan posibles fechas para una eventual intervención.\n\nDe este modo, se acredita que en el sitio referido por el tutelado existe un problema de falta de aceras en algunos sectores y de deterioro de estructuras existentes, lo cual no ha sido solucionado por la municipalidad recurrida, quien tampoco ha garantizado un plazo razonable para atender y solventar de manera definitiva la situación. \n\nEn consecuencia, se declara con lugar el recurso en relación con estos extremos y respecto de la Municipalidad de Liberia, en los términos que se indican en la parte dispositiva de este pronunciamiento. \n\nV.- Por otra parte, concerniente al Área Rectora de Salud de Liberia, se verifica que la denuncia interpuesta por el tutelado el 24 de marzo de 2026 fue inicialmente atendida; incluso se dictaron distintas órdenes sanitarias contra propietarios de inmuebles a fin de “Disponer sanitariamente de las aguas residuales producidas en la vivienda o establecimiento, dentro de los límites de su propiedad a fin de evitar la contaminación del suelo, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.”. \n\nSin embargo, no fue sino con ocasión del trámite de este proceso de amparo, que el 19 de junio de 2026 la autoridad recurrida realizó una inspección para verificar el cumplimiento de tales disposiciones y emitió el informe nro. DRRSCH-DARSL-ER-IT-0082-2026 de 22 junio de 2026, en el que precisamente determinó que se había acatado lo dispuesto. \n\nAhora, si bien no le corresponde a esta Sala revisar por el fondo lo decidido por la autoridad accionada ni establecer si finalmente hubo o no un cumplimiento de los actos administrativos, sí puede intervenir esta Cámara para garantizar aspectos mínimos del procedimiento, como la efectiva comunicación al amparado acerca de lo concluido en la sumaria. En ese tanto, de los autos no se desprende que el informe nro. DRRSCH-DARSL-ER-IT-0082-2026 de 22 junio 2026 se le haya notificado formalmente al tutelado en su condición de denunciante, a fin de que tuviera pleno conocimiento de la conclusión de la autoridad recurrida en cuanto a la situación de marras. \n\nEn virtud de lo anterior, se declara con lugar este punto del recurso en relación con el Área Rectora de Salud de Liberia, en los términos que se indican en la parte dispositiva de este pronunciamiento. \n\nVI.- Ahora bien, en manifestaciones posteriores, el tutelado reclama que no se haya traído al proceso a la Contraloría General de la República (CGR), pues a su juicio se ha incurrido en “omisiones fiscalizadoras” por una presunta inacción en una auditoría externa a la municipalidad. Sin embargo, en consideración al objeto principal de este asunto (el problema de infraestructura vial y sanitario denunciado), en la resolución de curso del sub lite únicamente se requirió informe a la Municipalidad de Liberia y al Ministerio de Salud, pues son los órganos directamente competentes para atender dicha situación en concreto. Ahora, si el tutelado considera que ha existido alguna irregularidad en algún proceso de auditoría o fiscalización de la CGR, lo procedente es que acuda a las instancias administrativas o jurisdiccionales ordinarias competentes, pues tal situación constituye un diferendo de legalidad ordinaria que en tesis de principio excede la naturaleza sumaria de este proceso de amparo. \n\nPor otra parte, el accionante hace referencia a un presunto incumplimiento de la municipalidad a lo ordenado en el expediente nro. 23-024765-0007-CO; sin embargo, tal situación se refiere a una discusión ajena al objeto concreto del sub examine. Por ello, ese alegato en particular deberá el tutelado formularlo, si a bien lo tiene, propiamente en el expediente nro. 23-024765-0007-CO, para que en esa vía de ejecución se resuelva lo correspondiente.\n\nVII.- NOTA DEL MAGISTRADO SALAZAR ALVARADO. En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente plantea una denuncia sobre infraestructura que presuntamente no ha sido atendida dentro de un plazo razonable.\n\nVIII.- VOTO SALVADO PARCIAL DE LA MAGISTRADA GARRO VARGAS SOBRE LA EJECUCIÓN DE LA SENTENCIA. Salvo el voto respecto de la ejecución de la sentencia, para que, de conformidad con el art. 56 de la Ley de la Jurisdicción Constitucional (LJC), sea residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda. \n\nLa ejecución de las órdenes dictadas por la Sala Constitucional corresponde, en principio, ser fiscalizada por la propia Sala. Sin embargo, esa norma contempla supuestos de excepción en los que, por determinación de la propia Sala, se ordene residenciar la ejecución de la sentencia en la jurisdicción contencioso-administrativa: \n\n“Art. 56. La ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias, o en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción.” (Lo destacado no corresponde al original). \n\n \n\nRecuérdese que en el proyecto de ley de discusión de la LJC se preveía originalmente lo siguiente: \n\n“Art. 56. Las sentencias favorables al recurrente se ejecutarán en la vía contencioso-administrativa por el procedimiento de ejecución de sentencia previsto en la ley Reguladora de esa Jurisdicción.” (Lo destacado no corresponde al original). \n\n \n\nSin embargo, el texto fue modificado vía moción para que la norma fuera coincidente con lo regulado en el art. 153 de la Constitución Política, pero se realizó la siguiente explicación: \n\n“EL SECRETARIO:\n\n Moción No. 68 (32-19) del diputado Chacón Jiménez:\n\n“artículo 57 (antes 56): para que el texto se lea así: “la ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones o responsabilidades pecuniarias en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción”.\n\n \n\nEL PRESIDENTE:\n\n En discusión la moción leída?\n\n \n\nDoctor Piza Escalante:\n\n Aquí había una contradicción con la tesis genérica de que son los Tribunales los que ejecutan sus sentencias y enviaba la Jurisdicción Contencioso Administrativo toda la ejecución; entonces quedaban al aire los otros artículos que le permitían a la Sala ejecutarlos.\n\n \n\nDiputado Corrales Bolaños:\n\n En esa parte dice: “o en otros aspectos que la propia Sala considere del aso…”, a qué se está refiriendo?\n\n \n\nDoctor Piza Escalante:\n\n La idea es que la Sala, en la vía de ejecución de sentencia, resuelva lo que ella considere que le corresponde. Lo que demás, lo envía a la vía Contencioso Administrativa.\n\n \n\nEL SECRETARIO:\n\n Se considera suficientemente discutida la moción?\n\n \n\nEL PRESIDENTE:\n\n Discutida. Aprobada (unanimidad, cinco señores diputados presentes).” (sic). Ver actas de aprobación de la LJC. Lo destacado no corresponde al original). \n\n \n\nA partir de lo anterior, está claro que la propia LJC autoriza a esta Sala para que valore y decida si es preciso derivar a la jurisdicción contencioso-administrativa todos o algunos los aspectos relativos a la ejecución de la sentencia. \n\nEn este caso concreto, en virtud de la entidad de la primera orden dada, estimo que lo procedente es residenciar la fase de ejecución del asunto en la jurisdicción contencioso-administrativa. Lo anterior, debido a la inexistencia de mecanismos idóneos previstos por la normativa que rige a esta jurisdicción constitucional para dar seguimiento a las órdenes consignadas en esta sentencia que revisten aspectos técnicos de gran complejidad. \n\nEn cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (art. 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el art. 56 de LJC, considero que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.\n\nIV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012. \n\nPor tanto:\n\nSe declara con lugar el recurso. Se ordena a José Javier Calvo Darcia y María Lourdes Ocampo Fernández, cada uno en su condición de alcalde y presidenta del Concejo, ambos de la Municipalidad de Liberia, o a quienes ocupen tales cargos, que coordinen lo pertinente, tomen las medidas necesarias y giren las órdenes correspondientes dentro del ámbito de sus respectivas competencias para que, en el plazo máximo de DOCE MESES, contado a partir de la notificación de esta sentencia, se realicen las acciones y obras necesarias para solucionar los problemas de infraestructura peatonal y pluvial en la zona referida por el tutelado, a fin de garantizar la seguridad y salubridad de las personas que habitan y transitan por ese sitio. Asimismo, se ordena a Luis Enrique Mayorga Díaz, director del Área Rectora de Salud de Liberia, o a quien ocupe ese cargo, que gire las órdenes correspondientes y tome las medidas necesarias dentro del ámbito de sus competencias para que, en el plazo máximo de TRES DÍAS, contado a partir de la notificación de esta sentencia, se le notifique formalmente al denunciante el oficio nro. DRRSCH-DARSL-ER-IT-0082-2026 de 22 junio 2026, relativo a la conclusión de las diligencias efectuadas en la sumaria administrativa. Se le advierte a la autoridad recurridas que, según lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Liberia y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso-administrativo. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto respecto de la sede de la ejecución de la sentencia, en lo referente a la primera orden dada y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que esa fase sea residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda.   "body_en_text": "Review of the Document\n\n\n\nExp: 26-018775-0007-CO \n\nRes. Nº 2026033788\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 3 September 2026.\n\nAmparo proceeding in expediente No. 26-018775-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the MUNICIPALITY OF LIBERIA AND THE MINISTRY OF HEALTH.\n\nBackground:\n\n1.- In filings added to the expediente on 26 and 27 May 2026, the applicant files an amparo proceeding. He alleges institutional inaction across multiple agencies, chronic disobedience of final judgments, and the flagrant failure to provide practical solutions, causing serious and ongoing harm to diffuse interests and the public interest in Barrio La Victoria, Liberia. A putrid source of infection is being maintained in front of the local school, along with an imminent road-safety risk to children because of the lack of adequate pedestrian infrastructure. The central purpose of this filing is to establish before this Court that an absolute failure to provide a technical and practical solution persists in Barrio La Victoria, Liberia (specifically in the area around the local school, Calle 11 and Avenidas 6, 8 and 10). The evasive responses of the Municipality of Liberia, combined with the failure of the Ministry of Health and the Contraloría General de la República to enforce the law, constitute a flagrant violation of the constitutional principles of legality, continuity of public service, reasonableness, proportionality, and environmental protection (the pro natura principle), leaving highly vulnerable groups entirely unprotected, including children, older adults, and persons with disabilities. As an immediate antecedent, this party pursued the community’s complaint under expediente 26-012198-0007-CO. However, following the internal irregularities reported, on 26 May 2026 the full panel of titular justices issued a recusal decision. The imperative and urgent reason for filing this new amparo proceeding as entirely autonomous and independent is that, after that recusal, there has been an absolute failure in practice to appoint, constitute, and swear in a tribunal of seven independent substitute justices. Since no such replacement body has been appointed or exists, the original case has been trapped in an absolute procedural limbo and left without a natural judge, resulting in a flagrant denial of justice (Article 41 CP). In light of this breakdown in the judicial system, this new independent action is the only suitable and available legal avenue to stop the irreversible material harm suffered daily by children and residents of Barrio La Victoria, preventing bureaucratic dysfunction from resulting in impunity for the local authorities named as respondents. The stormwater infrastructure problem, the failure of drainage outlets, and the absolute absence of safe sidewalks near Escuela La Victoria are chronic structural deficiencies arising from topographic and hydraulic design failures carried out by the Technical Road Management Unit (UTGV) of the Municipality of Liberia. The stormwater system receives runoff converging from high-impact commercial areas (such as Farmacia Guanacasteca and Súper Económico), but because of a severe negative gradient, the water pools directly against the boundaries of the school rather than following a natural, straight drainage path. As a result of this engineering error, the corners of Avenidas 8 and 10 and Calle 11 are subject to permanent runoff accumulation. It has been fully established that the standing water turns green and gives off strong foul odors (organic decomposition) even at the height of the dry season or summer. This confirms the existence of a permanent source of contamination and an ideal breeding ground for dengue vectors in front of the school population, located at the exact satellite coordinates: Lat: 10.626663, Long: 85.430786. Along the right side of Calle 11 (southbound), for approximately 100 meters adjoining the school, there is a total failure to provide pedestrian infrastructure (an absolute absence of sidewalks, curbs, and gutters). On the left side, the infrastructure is visibly in ruins (cracked, with holes and physical obstructions). This structural deficiency forces hundreds of primary-school students, mothers with strollers, older adults, and persons with reduced mobility to step off the sidewalk every day and walk directly on the active roadway, exposing them to an imminent risk of being struck by a vehicle. The respondent authorities’ neglect constitutes a systematic pattern of omission. In the final judgment in expediente No. 23-024765-0007CO, this Constitutional Chamber ordered the Municipality of Liberia to intervene in the infrastructure on the south side of Estadio Edgardo Baltodano Briceño. Nevertheless, through the harmful practice of “de facto actions” and bureaucratic inaction, the municipal corporation disobeyed that order by limiting itself to making deficient patches to the sidewalk, failing to continue the work as far as Iglesia Evangélica (in front of Panadería Sánchez), and avoiding the installation of a tactile yellow line for pedestrians who are blind, in clear violation of Ley 7600. This antecedent shows that the current abandonment of Barrio La Victoria is a continuation of a chronic pattern of disobedience to judicial authority. The community’s lack of protection is worsened by the co-respondent oversight bodies’ failure to perform their duties:\n\n• Ministry of Health (Liberia Health Regulatory Area): Despite complaints having been filed, it has failed to carry out timely expert field inspections or issue binding Sanitary Orders requiring the Municipality to intervene immediately in the area for reasons of public-health emergency.\n\n• Contraloría General de la República (CGR): In response to the formal complaint of 14 March 2026 (Expediente CGRADIN2026002405) concerning the inefficient use and diversion of the funds specifically allocated under Ley N° 8114, the CGR has not completed the external audit of the UTGV of Liberia, allowing the local corporation to leave those resources under-executed.\n\nHe adds: “1. TRANSFER WITHOUT NOTICE: I report that all the documentation and evidence in expediente 26-008745-0007-CO (folios 1 through 93) were transferred to expediente 25026749-0007-CO, which had been closed and declared unfounded. The justices of Sala IV made this move without giving any logical explanation and without informing me at all, leaving me completely defenseless. 2. COORDINATED INACTION (MAYOR’S OFFICE, MUNICIPAL COUNCIL, AND UTGV): I exhausted the administrative process through the reply filed on 09 April 2026 (folios 91 and 92), in which I rejected agreement CM0292042026. The Mayor’s Office, Municipal Council, and UTGV have maintained an evasive position, passing correspondence among themselves without carrying out the stormwater and pedestrian works needed in the area around Escuela La Victoria. 3. NEW FACTS (FOLIO 93): The evidence in Folio 93 shows that water continues to pool during the dry season, which is a subsequent fact that the Chamber did not assess in 2025. Ignoring this evidence under the pretext of transferring expedientes violates the principle of substantive truth. 4. VIOLATION OF THE RIGHTS OF VULNERABLE GROUPS: This neglect by the Municipality of Liberia directly affects the best interests of children, older adults, and persons with disabilities (invalids), who are forced to walk among sources of contamination and standing water, putting their lives and health at risk. SOLE POINT: On the absence of lis pendens and the request for immediate consideration. To ensure the utmost procedural transparency and avoid any erroneous interpretation that the cases are identical, I formally inform this Court that, as of today, I have filed a total and definitive withdrawal of expediente No. 26-012198-0007-CO. Accordingly, there is no risk of duplication or lis pendens, and this expediente (26-018775-0007-CO) remains the only active avenue through which urgent protection is sought for the rights to health, life, and accessibility (Ley 7600) of the school population and residents of Barrio La Victoria in Liberia.”\n\nHe further adds that, “IN THE MATTER OF: SUBMISSIONS; ASSESSMENT OF NEW EVIDENCE ADDED TO THE EXPEDIENTE (MUNICIPAL LETTER CM-0453-05-2026 IN FOLIO 143 AND SATELLITE UPDATE OF STORMWATER CONDITIONS IN FOLIO 144). Exercising the right of defense and with the firm intention of keeping this judicial expediente duly developed, updated, and supported, I respectfully appear before this Court to present and set out a legal analysis of the documentary and technical-satellite evidence added to the case file under the referenced folios, so that it may be assessed as a whole when deciding the merits of this case: FIRST: ON THE MUNICIPALITY’S INACTION FULLY ESTABLISHED IN FOLIO 1431. FOLIO 143 of the expediente has been added to the case file and contains letter number CM-0453-05-2026 dated 27 May 2026, issued by the Secretariat of the Municipal Council of Liberia. That document transcribes the agreement adopted by the Municipal Council under Article Three of Ordinary Session No. 127-2026, held on 26 May 2026. (...) Exercising the right of defense and with the firm intention of keeping this judicial expediente duly developed, updated, and supported, I respectfully appear before this Court to present and set out a legal analysis of the documentary, technical-satellite, instrumental field-inspection, and subsequent correspondence evidence added to the case file, so that it may be assessed as a whole when deciding the merits of this case: (...) SECOND: ON THE MUNICIPALITY’S INACTION FULLY ESTABLISHED IN FOLIO 143 FOLIO 143 of the expediente has been added to the case file and contains letter number CM045305-2026 dated 27 May 2026, issued by the Secretariat of the Municipal Council of Liberia. That document transcribes the agreement adopted by the Municipal Council under Article Three of Ordinary Session No. 127-2026, held on 26 May 2026. I respectfully ask the justices to verify and assess that, in response to the formal complaint of disobedience and the flagrant presence of a putrid source of infection in front of a children’s school, the highest authority in the canton of Liberia chose to dismiss the community’s situation as purely ‘informational,’ adopting the following resolution verbatim: ‘IT IS AGREED TO TAKE NOTE, AS THIS IS AN INFORMATIONAL MATTER; THE CORRESPONDING REPORT WILL BE SUBMITTED WHEN THE CONSTITUTIONAL CHAMBER GIVES NOTICE.’ This posture of passive expectation and deliberate inaction, recorded in FOLIO 143, whereby any practical intervention or technical solution is made contingent on this Constitutional Court ordering them to account for themselves, demonstrates a total lack of commitment to good public service and fully establishes the serious, ongoing, and irreversible harm suffered by minors and residents of Barrio La Victoria. Further submissions concerning the abandonment of powers and violation of the duties of the active administration: The Municipal Council’s agreement documented in Folio 143 exemplifies what the most authoritative administrative-law doctrine calls the voluntary abdication of statutory powers of authority and public-health policing. By dismissing as a mere ‘informational matter’ the existence of a source of organic contamination and stormwater decomposition in front of a primary-school establishment, the municipal deliberative body directly violates the body of law established in Article 4 of the Municipal Code. Local municipal entities have autonomy, but this does not authorize their abandonment of their immediate obligations concerning the health and environmental safety of their residents. (...) FOURTH: SUBSEQUENT ADMISSION OF THE SANITARY CRISIS BY THE MUNICIPAL MAYOR (FOLIO 145) To strengthen the case file, I ask that the official public statement issued on Sunday, 31 May 2026, by the head of the executive body of the same respondent entity, Liberia Mayor José Javier Calvo Darcia, be added and considered together with the other evidence. This public statement constitutes an unavoidable extrajudicial admission concerning the reported facts, in which the highest municipal authority states verbatim: ‘I respectfully wish to warn all citizens that, starting tomorrow, I have instructed the Liberia Municipal Police and the Municipal Inspectors Department to conduct inspection and notification operations throughout the canton to combat an unacceptable practice that affects public health, the environment, and our city’s image. I refer to the illegal discharge of sewage, black water, and wastewater from homes and businesses into gutters, ditches, drains, and public spaces. We can no longer tolerate a few people continuing to pollute our neighborhoods, creating bad odors, sources of infection, proliferation of insects, and affecting residents’ quality of life (...) If necessary, we will exhaust every available administrative and legal avenue to the fullest extent to eradicate this disgusting and irresponsible practice once and for all. Liberia deserves a clean, orderly, healthy city that respects the environment. Public cooperation will be essential to achieving this objective. There will be no tolerance for those who threaten the health and well-being of our community.’ In light of this new item of evidence, it is essential to highlight before this Constitutional Court: • Admission of the harmful conditions: The Mayor of the Municipality of Liberia himself publicly and expressly acknowledges the factual existence of ‘sources of infection,’ ‘proliferation of insects,’ ‘bad odors,’ and direct harm to ‘public health’ and the ‘environment,’ exactly as this applicant has technically established for Barrio La Victoria in Folio 144. • Internal institutional contradiction: While the Municipal Council adopts an omission-based position in Folio 143 of ‘taking note’ and characterizes the school emergency as a mere ‘informational matter,’ pending notification from this Chamber, the Municipal Mayor describes the situation across the canton as a ‘disgusting and irresponsible practice’ warranting the immediate deployment of the public force and inspectors.” (...) The collapse of the central district, the flooding of Hospital Enrique Baltodano Briceño and of the local seat of the Judiciary constitute irrefutable material manifestations that Liberia’s urban stormwater network has been completely exhausted.” On the basis of the situations described, he considers that fundamental rights have been violated. He asks that the amparo be granted.\n\n2.- In filings added to the expediente on 27 and 31 May and 1, 2, 7 and 8 June, all in 2026, the applicant submits documents.\n\n3.- By resolution issued at 12:11 p.m. on 12 June 2026, the President of the Chamber initiated the proceeding and requested a report from the mayor and the president of the Municipal Council of the Municipality of Liberia, and also from the director of the Liberia Health Regulatory Area of the Ministry of Health.\n\n4.- In a filing added to the expediente on 15 June 2026, the applicant submits further statements. He asks that the Contraloría General de la República also be treated as a respondent.\n\n5.- In a written submission added to the case file on 22 June 2026, José Javier Calvo Darcia, mayor of the Liberia Municipality, reports:\n\n“FIRST: The Liberia Municipality is an institution that forms part of the Public Administration, whose objectives are embodied in its nature as a public entity serving the Municipality. Given its legal nature and the public function it performs, the LIBERIA MUNICIPALITY is governed by administrative law, which requires it to direct its actions toward satisfying the public interest and to comply with the principle of legality, which entails acting efficiently and responsibly, in strict accordance with the basic principles of justice, logic, and expediency (Articles 10, 11, and 16 subsection l. of the General Law of Public Administration).\n\nIt is of utmost importance to clarify first to this honorable Constitutional Chamber (Sala Constitucional) that the Liberia Municipality has not violated the constitutional rights of the applicant. The Liberia Municipality administers approximately 600 kilometers of cantonal road network (including urban streets and district roads), which must be maintained in accordance with the principles of efficiency and rational use of public resources, and the technical guidelines established in:\n\n• Law No. 9329, “Law on the Transfer of Competencies.”\n\n• Executive Decree No. 40137-MOPT.\n\n• Cantonal Road Conservation, Development, and Safety Plan (PCDSVC).\n\nUnder this legislation, the Municipality is required to prioritize road interventions based on technical and social assessments, and not solely according to the order in which residents submit requests. The municipal functions for road management are established in Decree No. 40137-MOPT, Regulation to the First Special Law on the Transfer of Competencies: Full and Exclusive Responsibility for the Cantonal Road Network. Article 5 provides:\n\nArticle 5.—Municipal functions for road management\n\nJ) Prioritize the road projects to be carried out within the respective jurisdictions, taking technical criteria into consideration. Such prioritization must be supported by a socioeconomic assessment of the different roads to be addressed that quantifies the benefits to their users. These assessments will involve parameters such as connectivity and the concept of a network, average daily traffic, access to community services, population density, and production volume. In addition, the Technical-Social Viability Index (IVTS), established by the MOPT Sectoral Planning Secretariat, may be used. (Emphasis added.)\n\nRoad management is the set of activities necessary to achieve a road conservation, improvement, rehabilitation, or construction goal. The objective of road management is to establish action plans that take into account the condition of the cantonal road infrastructure and needs arising from growth in traffic volume, population, and production.\n\nIn this regard, the Constitutional Chamber of the Supreme Court of Justice states in decision 2011-006514, issued at ten hours and twenty-one minutes on 20 May 2011, with respect to the Municipality’s prioritization criteria:\n\n“Moreover, in judgment No. 2010-16417, issued at 09:45 hrs. on 1 October 2010, the Chamber stated: ‘The construction of a new storm sewer in Ciudad Colón is a municipal decision that will respond to criteria of opportunity and expediency of the local government, in accordance with political and budgetary priorities, in the exercise of its autonomous powers.’ These considerations undoubtedly apply in this case, in which the Constitutional Chamber lacks the information needed to determine the priority with which the paving requested by the applicants should be carried out. Accordingly, the proper course is to dismiss the amparo application, as is hereby ordered.” (Emphasis added.)\n\nIn light of the foregoing, it is important to note that the Liberia Municipality has a Cantonal Road Conservation, Development, and Safety Plan, which allows it to prioritize public investment efficiently. This Municipality aims to comply with that plan in accordance with the binding laws governing road conservation. This legislation includes the Political Constitution, General Roads Law, Municipal Code, Tax Simplification and Efficiency Law, Law 8114, Special Law on the Transfer of Competencies: Full and Exclusive Responsibility for the Cantonal Road Network, Law 9329, Decree No. 40137, Decree No. 40138, Decree No. 40139, among others. Accordingly, the requested works must conform to the five-year plan so as not to prejudice the rest of the population. As stated in the second paragraph, this is a matter of ordinary legality, entailing efficient and responsible action in strict accordance with the basic principles of justice, logic, and expediency (Articles 10, 11, and 16 subsection l. of the General Law of Public Administration).\n\nIt should be clarified to this respected Chamber that the scope of action of the Public Administration, specifically of municipalities, is governed by the principle of legality set out in the Political Constitution and the General Law of Public Administration. In public law, and specifically administrative law, the principle of legality is one of the fundamental pillars on which the daily work of the Public Administration rests. It arose alongside the modern political institutions and with the development and expansion of administrative law, which regulates the actions of the administration in the exercise of its administrative function. It is positively recognized in our legal system in Article 11 of the Political Constitution and Articles 11, 12, 6, and 13 of the General Law of Public Administration. It means that every act or conduct of the Public Administration must be regulated and authorized by the legal system, applying the old maxim that the Administration may do only what it is permitted to do. This is quite unlike the conduct of a private individual, whose private activity is governed by the principle of autonomy of will and who may engage in acts or activities that are not prohibited.\n\nAs regards municipalities, Article 169 of the Political Constitution establishes their powers by placing local interests and services under the responsibility of local government. The Municipal Code likewise sets out municipal powers intended to promote the comprehensive development of cantons, including a very extensive list of such powers. They include local public services, urban planning, administration of the maritime-terrestrial zone, and so forth.\n\nIn accordance with the foregoing, and in compliance with the Municipal Code and other applicable legislation, the applicant’s allegation in this regard is incorrect because, with the limited resources available to it, the Municipality maintains the roads of the canton to the extent of its means and within its five-year plan, which is the planning instrument for road management over a five-year period, as established in Article 2 of Law No. 9329.\n\nIn this regard, the Procuraduría General de la República (Office of the Attorney General of the Republic), in opinion C-11-2019 of 16 January 2019, stated:\n\n“It is likewise concluded that, for municipalities to validly exercise their powers concerning conservation and development of the Cantonal Road Network, they must have approved a Five-Year Road Conservation and Development Plan. Municipal budgets and actions relating to the Cantonal Road Network must comply with the respective Five-Year Road Conservation and Development Plan approved by the Municipal Council. Therefore, the fact that the Cantonal Road Board has ceased to function does not mean that the municipality concerned may disregard the provisions of the Five-Year Road Conservation and Development Plan.” (Emphasis added.)\n\nIn this regard, Magistrate Hernández López’s Note in decision No. 2019-020645, issued at nine hours and thirty minutes on 29 October 2019, states: “… I believe that a developing society cannot meet one hundred percent of its infrastructure needs (streets, bridges, schools, etc.) all at once. Planning and scheduling are therefore required, with prioritization based on technical criteria and planning that falls within the exclusive competence of local authorities…” (Emphasis added.)\n\nAccordingly, all works carried out by the Liberia Municipality are included in this five-year plan. It is of utmost importance to clarify first to this honorable Constitutional Chamber that the Liberia Municipality has not violated the applicant’s constitutional rights. The Municipality therefore requests that the amparo application be dismissed.\n\nSECOND: The applicant alleges that institutional inaction by multiple bodies, chronic disobedience of final judgments, and the flagrant omission of material solutions cause serious and continuing harm to diffuse interests and the public interest in Barrio La Victoria, Liberia. The applicant alleges that a putrid infectious focus is being maintained in front of the local school and that, due to the absence of adequate pedestrian infrastructure, there is an imminent road safety risk to children. The central purpose of this filing is to establish before this Court the continuing existence of an absolute omission of a technical and material solution in Barrio La Victoria, Liberia (specifically in the area around the local school, Calle 11, and Avenues 6, 8, and 10). The Liberia Municipality’s evasive responses, combined with the failure of the Ministry of Health and the Office of the Comptroller General of the Republic to carry out oversight, constitute a flagrant violation of the constitutional principles of legality, continuity of public services, reasonableness, proportionality, and environmental protection (the pro natura principle), leaving the following populations completely unprotected:\n\nIn accordance with the foregoing, and in compliance with the Municipal Code and other applicable legislation, the applicant’s allegation in this regard is incorrect because, by official letter PUTGV-0860-06-2025 dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Liberia Municipality’s Technical Road Management Unit, the following was stated:\n\n“I. ADMINISTRATIVE AND CONSTITUTIONAL BACKGROUND\n\nThe situation raised by Mr. [Name 001] is neither new nor unknown to this Administration. On the contrary, matters concerning pedestrian and stormwater infrastructure near Escuela La Victoria, Calle 11, and adjacent areas have previously received administrative attention and analysis in constitutional case file No. 25- 026749-0007-CO, in connection with which this Technical Unit timely submitted the corresponding report.\n\nThat report informed the Constitutional Chamber that the Liberia Municipality had conducted technical assessments of the area, identifying properties with possible noncompliance relating to pedestrian infrastructure and defining the corresponding administrative actions under the applicable legal framework. Likewise, in follow-up to the applicant’s submissions and the needs identified in the area, during the first half of 2026 the Liberia Municipality carried out direct work near Escuela La Victoria and adjacent areas, consisting of repairs to deteriorated sections of sidewalk and cleaning and maintenance of gutters and surface stormwater drainage systems. These actions formed part of the ordinary conservation and improvement of the canton’s road and pedestrian infrastructure, demonstrating the Administration’s ongoing attention to the conditions identified by the applicant.\n\nThe Constitutional Chamber was also informed that the Liberia Municipality had been developing a comprehensive strategy for pedestrian mobility through the Sustainable and Inclusive Urban Mobility Plan and the schedule established in the institutional Five-Year Plan, under which the Barrios del Sur area was identified as a priority area for intervention. It was established in those constitutional proceedings that the Liberia Municipality had addressed the various submissions made by Mr. [Name 001]. Furthermore, after that application was filed, the applicant continued to submit new requests, observations, complaints, and demands concerning the same area, all of which were duly considered, analyzed, and addressed by the Administration through the corresponding actions, technical assessments, and administrative responses. Consequently, the applicant’s various submissions have received continuous and timely institutional attention, in accordance with the Municipality’s legal powers.\n\nAccordingly, it is incorrect to claim that there was a supposed ‘absolute omission,’ ‘institutional inaction,’ or failure to respond by the Liberia Municipality, since the facts giving rise to this application have been repeatedly considered, analyzed, and addressed administratively, with concrete technical and administrative actions having been taken. It should also be noted that several statements included in case file No. 26- 018775-0007-CO repeat, expand upon, or reformulate arguments previously made by the applicant and already analyzed and answered by\n\nI. REGARDING THE APPLICANT’S STATEMENTS\n\nAll statements attributing a supposed ‘absolute omission,’ ‘institutional inaction,’ ‘chronic disobedience,’ ‘chronic structural deficiency,’ ‘topographic and hydraulic design failures,’ or similar expressions to this Technical Unit are rejected in their entirety, because they are subjective assessments and unilateral conclusions unsupported by technical or expert evidence in the case file. It should be noted that the applicant draws technical conclusions about alleged hydraulic and topographic design errors attributed to the Municipality without providing hydraulic, topographic, geotechnical, structural, or expert studies to objectively support those assertions.” (Emphasis added.)\n\nThis Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all of its actions must conform to its five-year plan and comply with the principle of legality, the cornerstone of all Public Administration action. The amparo application should therefore be dismissed, as the applicant’s fundamental rights have not been violated (…)\n\nIn accordance with the foregoing, and in compliance with the Municipal Code and other applicable legislation, the applicant’s allegation in this regard is incorrect because, by official letter PUTGV-0860-06- 2025 dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Liberia Municipality’s Technical Road Management Unit, the following was stated:\n\n“III. REGARDING THE ABSENCE OF AN ABSOLUTE OMISSION BY THE ADMINISTRATION\n\nThe assertion that the Liberia Municipality remained inactive in response to the reported situations is incorrect. Before this application was filed, the Administration issued various technical assessments and formal responses to Mr. [Name 001], addressing submissions concerning Barrio La Victoria and the area near Escuela La Victoria.\n\nThose responses expressly stated that:\n\n• The area would be included in the Municipality’s preventive maintenance and cleaning programs.\n\n• Cleaning of the curb and gutter, removal of sediment, and removal of obstructions affecting stormwater runoff had been scheduled.\n\n• During January, February, and May 2026, work was carried out to clean sidewalks, remove invasive vegetation, cut trees, and clear areas that interfered with pedestrian traffic and surface water runoff.\n\n• Additional technical inspections were contemplated to verify drainage conditions and determine the appropriate measures.\n\nThis demonstrates that the Administration did not remain inactive and did not commit the alleged absolute omission described by the applicant.\n\nIII. REGARDING THE ALLEGED HYDRAULIC AND STRUCTURAL DESIGN FAILURES\n\nThe claim that the reported situation resulted from alleged hydraulic or structural design failures attributable to the UTGV is rejected because the applicant provides no technical study, expert report, or professional opinion to support that conclusion. Assessments conducted by this Unit indicate that the conditions observed at certain points in the area are primarily associated with external factors, such as the improper discharge of wastewater into the stormwater system and the accumulation of solid waste and sediment affecting its operation.\n\nThe Liberia Municipality has also informed the applicant of these circumstances in responses to his various submissions and has included the area in its ordinary preventive maintenance and cleaning programs. As part of these actions, periodic cleaning and unclogging of the stormwater system has been carried out, most recently in May 2026.\n\nIt should also be noted that the claim that there is a supposed ‘putrid infectious focus in front of Escuela La Victoria’ is inconsistent with the conditions observed at the site. The main frontage of that school is at the intersection of Avenida 10 and Calle 15, an area with pedestrian infrastructure that does not exhibit the conditions described by the applicant. According to inspections and available photographic records, the main frontage of Escuela La Victoria, located on Avenida 10 and Calle 15, does not have persistent water accumulation or the conditions described by the applicant. The situations identified concern specific points in the area, not the immediate surroundings of the school. Accordingly, it is not technically appropriate to attribute an alleged sanitation or drainage problem to the school frontage or to conclude that the stormwater system has hydraulic or structural design failures.\n\nAll of the foregoing shows that the Liberia Municipality has not remained inactive in response to the situations identified by the applicant, but has carried out maintenance, cleaning, technical follow-up, and periodic attention within the scope of its powers and its regular programs for conserving the canton’s road and stormwater infrastructure.\n\nIV. REGARDING THE COMPREHENSIVE STORMWATER MANAGEMENT PROJECT\n\nIt should be noted that the stormwater problem in Liberia’s Barrios del Sur is neither isolated nor limited to the point identified by the applicant; rather, it is a condition that the Municipality has analyzed comprehensively. As part of that process, in 2024 it commissioned the study entitled ‘Procurement of feasibility studies, designs, and preparation of final plans for the stormwater system in the Barrios del Sur area, Liberia district,’ which developed a technical assessment of the existing network, designs for the proposed system, implementation phases, and the corresponding budget estimate.\n\nThe study determined that the estimated investment exceeded five million United States dollars, and for that reason implementation was planned in phases, based on technical prioritization criteria, budget availability, operational capacity, and institutional scheduling. Given the scale of the required investment and the technical complexity of the proposed system, the work must be developed gradually, ensuring the functionality and integration of each construction phase.\n\nAs part of this strategy, during 2025-2026 the Liberia Municipality began the first phase of the comprehensive stormwater sanitation project for the Barrios del Sur, with an investment of approximately ₡100 million. Although this work is not being carried out directly in the specific area identified by the applicant, it forms part of the same stormwater drainage system designed for the relevant watershed.\n\nFrom a technical standpoint, the project follows a logical construction sequence, beginning in downstream areas to ensure the system’s conveyance and discharge capacity before adding new inflows from higher areas of the watershed. Barrio La Victoria is located in the upper part of that watershed, so interventions must be carried out in an orderly manner and in accordance with the sequence established in the comprehensive design.\n\nThis shows that the Municipality has been taking concrete and sustained action to address the stormwater drainage problem in the southern part of the canton structurally, ruling out institutional inaction or abandonment in this matter.\n\nI. REGARDING PEDESTRIAN INFRASTRUCTURE\n\nAs to statements concerning the absence or deterioration of sidewalks, it should be noted that current legislation establishes specific obligations for property owners in front of their respective properties. The Municipality is responsible for oversight and, where appropriate, for taking the administrative actions provided by the legal system. In addition, the Municipality has been carrying out maintenance and cleaning in the area and continues to assess further interventions in accordance with institutional planning and the corresponding budget availability.\n\nII. REGARDING STATEMENTS ABOUT PEDESTRIAN INFRASTRUCTURE AT ESCUELA LA VICTORIA\n\nIt should also be clarified that the applicant’s statements do not accurately describe the actual conditions at the site. In particular, the applicant claims that there is no pedestrian infrastructure in front of Escuela La Victoria, when the main frontage of that school is actually at the intersection of Avenida 10 and Calle 15, an area with pedestrian infrastructure for students, teaching staff, and the public generally.\n\nAlthough some sidewalk sections in adjacent areas show varying degrees of deterioration and require maintenance, rehabilitation, or reconstruction, this does not mean that pedestrian infrastructure is entirely absent or that the Municipality has committed an absolute omission, as the applicant seeks to suggest.\n\nIt should be taken into account that the Liberia Municipality addresses the canton’s pedestrian infrastructure needs through planning, scheduling, and technical prioritization processes. These processes determine the order in which interventions are addressed based on objective criteria such as risk level, degree of deterioration, number of users who would benefit, pedestrian connectivity, budget availability, and the targets established in institutional planning instruments.\n\nIn this regard, it is important to note that during the first half of 2026 the Municipality carried out pedestrian infrastructure improvement works at various points identified as critical within the area initially identified by the applicant, including work on Avenida 10, which was part of the subject matter of his original complaints. These actions show that the Administration has been progressively addressing identified needs in the area in accordance with established technical criteria and within the limits of its institutional budget.\n\nAccordingly, the existence of areas requiring further improvements does not mean that those interventions must be carried out immediately or exclusively in response to an individual request, since the Administration has a duty to ensure a rational, equitable, and efficient allocation of available public resources, seeking to address the many pedestrian infrastructure needs throughout the canton in a balanced manner. Municipal works and interventions therefore follow previously defined planning, scheduling, and technical prioritization processes, ensuring the efficient use of public resources and the greatest benefit to the community.\n\nConsequently, the applicant’s assertions that sidewalks are absent in front of Escuela La Victoria do not reflect the actual conditions at the site, since the school has pedestrian infrastructure along its main frontage. They also fail to take account of the interventions carried out by the Municipality, including work completed during the first half of 2026 at critical points in the area originally identified in the complaint, as well as the planning processes through which the canton’s pedestrian mobility needs are being addressed progressively.” (Emphasis added.)\n\nThis Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all of its actions must conform to its five-year plan and comply with the principle of legality, the cornerstone of all Public Administration action. The amparo application should therefore be dismissed, as the applicant’s fundamental rights have not been violated.\n\nFOURTH: The applicant also claims that the indifference of the respondent authorities constitutes a systematic pattern of omission. In the final judgment in case file No. 23-024765-0007CO, this Constitutional Chamber ordered the Liberia Municipality to intervene in the infrastructure on the south side of Estadio Edgardo Baltodano Briceño. Nevertheless, through the harmful practice of “de facto action” and bureaucratic inaction, the municipal corporation disobeyed that order by limiting itself to making deficient patches to the sidewalk, omitting continuation of the work as far as the Iglesia Evangélica (in front of Panadería Sánchez) and evading installation of the tactile yellow line for blind pedestrians, in clear violation of Law 7600. This precedent demonstrates that the current abandonment in Barrio La Victoria is a continuation of a chronic pattern of disobedience to judicial authority:\n\nIn accordance with the foregoing, and in compliance with the Municipal Code and other applicable legislation, the applicant’s allegation in this regard is incorrect because, by official letter PUTGV-0860-06- 2025 dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Liberia Municipality’s Technical Road Management Unit, the following was stated (…):\n\n“I. REGARDING STATEMENTS RELATING TO CASE FILE No. 23-024765-0007-CO\n\nAs to the applicant’s assertion that the Liberia Municipality disobeyed what the Constitutional Chamber ordered in case file No. 23-024765-0007-CO by failing to extend the pedestrian infrastructure works to the area of the Iglesia Evangélica in front of Panadería Sánchez, those allegations are rejected as lacking factual and technical support.\n\nIt should be noted that the Administration had already expressly addressed these same facts in response to submissions made by Mr. [Name 001], informing him that the Liberia Municipality carried out the pedestrian infrastructure works ordered by the Constitutional Chamber in case file No. 23-024765-0007-CO, within the prescribed time and in accordance with the scope defined in the relevant decision. The works included the construction and improvement of pedestrian infrastructure on the south side of Estadio Edgardo Baltodano Briceño and in areas included within the technical scope of the project developed by the Municipality. Accordingly, there was no failure to comply with the order of the competent judicial authority.\n\nThe applicant was also advised that the existence of new sections interspersed with preexisting infrastructure was not due to defective execution or the use of ‘patches,’ as he claims in this application, but to the application of technical intervention criteria based on the actual condition of each sidewalk section. Inspections determined that some areas were in adequate functional condition and did not require reconstruction, while others were significantly deteriorated and warranted intervention. Consequently, the works were carried out according to criteria of need, functionality, and efficient use of public resources, prioritizing areas with greater deterioration or risk to pedestrians.\n\nThe applicant was also informed that continuity of pedestrian infrastructure is an institutional planning objective pursued progressively, in accordance with the technical prioritization of projects and municipal budget availability. For that reason, the absence of comprehensive intervention along the entire corridor mentioned by the applicant does not constitute noncompliance with the constitutional decision and cannot be interpreted as disobedience to judicial authority.\n\nConsequently, the applicant’s reference to case file No. 23-024765-0007-CO reflects his subjective assessment of the desired scope of the work performed, not an established failure to comply with the Constitutional Chamber’s order. The Municipality carried out the corresponding works within the defined scope and timely informed the applicant of those actions.” (Emphasis added.)\n\nThis Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all of its actions must conform to its five-year plan and comply with the principle of legality, the cornerstone of all Public Administration action. The amparo application should therefore be dismissed, as the applicant’s fundamental rights have not been violated.\n\nFIFTH: The applicant alleges that the community’s lack of protection is compounded by the failure of the co-respondent oversight bodies to perform their duties:\n\n• Ministry of Health (Liberia Health Area), despite the complaints filed, has failed to conduct timely field inspections and expert assessments or to issue binding Sanitary Orders requiring the Municipality to intervene immediately in the area on grounds of a public health emergency:\n\nIt should be clarified to this respected Chamber that, in compliance with the Municipal Code, Article 4 et seq. and related provisions, the Municipality has the political, administrative, and financial autonomy conferred on it by the Political Constitution, within the scope of its powers. Accordingly, under that legislation, this Municipality may not intervene in a matter outside the powers granted by the Municipal Code and the Political Constitution, as it is a matter within the remit of other state institutions, namely the Ministry of Health, and not this Municipality. This Municipality considers that the applicant’s alleged fundamental rights have not been violated; therefore, the amparo application should be dismissed.\n\nSIXTH: The Office of the Comptroller General of the Republic (CGR): Following the formal complaint of 14 March 2026 (File CGRADIN2026002405) concerning the inefficient use and diversion of funds earmarked under Law No. 8114, the CGR has not completed the external audit of the Liberia UTGV, allowing the local corporation to keep the resources underexecuted:\n\nIt should be clarified to this respected Chamber that, in compliance with the Municipal Code, Article 4 et seq. and related provisions, the Municipality has the political, administrative, and financial autonomy conferred on it by the Political Constitution, within the scope of its powers. Accordingly, under that legislation, this Municipality may not intervene in a matter outside the powers granted by the Municipal Code and the Political Constitution, as it is a matter within the remit of other state institutions, namely the Office of the Comptroller General of the Republic.\n\nIn accordance with the foregoing, and in compliance with the Municipal Code and other applicable legislation, the applicant’s allegation in this regard is incorrect because, by official letter PUTGV-0860-06- 2025 dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Liberia Municipality’s Technical Road Management Unit, the following was stated:\n\n“I. REGARDING STATEMENTS RELATING TO THE EXECUTION OF RESOURCES UNDER LAW No. 8114\n\nThe applicant’s assertions concerning the alleged inefficient use, diversion, or underexecution of funds from Law No. 8114 are rejected as unsupported by technical, financial, or documentary evidence in this case file. The applicant makes only general assertions about alleged budget underexecution and funds supposedly left unspent, without providing objective information identifying the budget period in question, the amount allegedly underexecuted, the projects affected, or any evidence supporting those conclusions.\n\nIt should also be noted that the Liberia Municipality administers funds from Law No. 8114 in accordance with the applicable legal framework, current technical guidelines, and relevant institutional planning instruments. The programming and execution of those funds are based on the projects, targets, and priorities established in the Cantonal Road Conservation, Development, and Safety Five-Year Plan, as well as duly approved ordinary and extraordinary budgets.\n\nLikewise, the Municipality periodically prepares and submits the budget, financial, and execution reports required by the legal system. Those reports are subject to the ordinary control, oversight, and accountability mechanisms established by national legislation. Consequently, the applicant’s assertions on this matter are unilateral assessments unsupported by any evidence in the case file. There is therefore no objective basis to conclude that there has been diversion of resources, irregular use of funds, or alleged budget underexecution attributable to this Municipality. The complaints raised are thus statements by the applicant unsupported by documentary or technical evidence in this constitutional proceeding, and they do not disprove the Municipality of Liberia’s compliance with the planning, budgeting, execution, and control procedures established under current law.” (Emphasis added.)\n\nThis Municipality considers that the applicant’s alleged fundamental rights have not been violated; therefore, the amparo application should be dismissed (…)\n\nEIGHTH: 2. COORDINATED INACTION (MAYOR’S OFFICE, COUNCIL, AND UTGV): I exhausted the administrative remedies by submitting the reply on 09 April 2026 (folios 91 and 92), in which I rejected resolution CM- 0292042026. The Mayor’s Office, the Municipal Council, and the UTGV have maintained an evasive position, transferring correspondence among themselves without carrying out the necessary stormwater and pedestrian works in the area around Escuela La Victoria:\n\nIn accordance with the foregoing, and in compliance with the Municipal Code and other applicable legislation, the applicant’s allegation in this regard is incorrect because, by official letter PUTGV-0860-06- 2025 dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Liberia Municipality’s Technical Road Management Unit, the following was stated:\n\n“IX. REGARDING THE ALLEGED ‘COORDINATED INACTION’ OF THE MAYOR’S OFFICE, THE MUNICIPAL COUNCIL, AND THE TECHNICAL ROAD MANAGEMENT UNIT\n\nThe applicant’s allegation of supposed ‘coordinated inaction’ by the Mayor’s Office, the Municipal Council, and the Technical Road Management Unit is rejected, as it is a subjective assessment that does not reflect the actions actually taken by the Liberia Municipality. As set out in the background to this report, the various submissions made by Mr. [Name 001] have been considered, analyzed, and addressed by the competent municipal departments through formal responses, technical assessments, field inspections, maintenance work, and interventions carried out in the area, as well as by incorporating identified needs into institutional planning and scheduling processes.\n\nIt should also be noted that the fact that the applicant disagrees with the technical criteria, the scope of the interventions carried out, institutional priorities, or the timelines communicated by the Administration does not mean that no administrative attention was given or establish that the Municipality omitted action or remained inactive. On the contrary, the many official letters, technical opinions, and administrative actions issued in response to the applicant’s various requests show that the Administration has continuously managed the matters raised, within the scope of its legal powers, budgetary capacity, and institutional planning.”\n\nAccordingly, it is not appropriate to claim that there is “coordinated inaction” among the municipal departments named as respondents, since the actions taken demonstrate ongoing attention to the requests submitted by the applicant, as well as the adoption of technical and administrative measures aimed at progressively addressing the pedestrian infrastructure and stormwater drainage conditions in the sector at issue.” (Emphasis added). This Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all action by this Municipality must comply with its five-year plan and the principle of legality, which is the cornerstone of all public administration action. The application filed must therefore be dismissed, since the applicant’s fundamental rights have not been violated.\n\nNINTH: 3. NEW FACTS (FOLIO 93): The evidence contained in Folio 93 shows that water stagnation persists during the dry season, which is a supervening fact that the Chamber did not assess in 2025. Ignoring this evidence on the pretext of transferring case files violates the principle of material truth: In accordance with the foregoing, and in compliance with the Código Municipal and other applicable regulations, the applicant’s allegation in this matter is untrue, since, by official letter PUTGV-0860-06- 2025, dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Road Management Technical Unit of the Municipality of Liberia, the following is stated: “II. ON THE ABSENCE OF AN ABSOLUTE OMISSION BY THE ADMINISTRATION\n\nIt is incorrect to claim that the Municipality of Liberia remained inactive in response to the reported situations. Before this application was filed, this Administration issued various technical assessments and formal responses addressed to Mr. [Nombre 001], addressing requests concerning the Barrio La Victoria area and the vicinity of Escuela La Victoria. Those responses expressly stated that:\n\n• The area would be included in the Municipality’s preventive maintenance and cleaning programs.\n\n• Cleaning of the curb and gutter, removal of sediment, and elimination of obstructions affecting stormwater runoff had been scheduled.\n\n• During January, February, and May 2026, work was carried out to clean sidewalks, remove invasive vegetation, cut trees, and clear areas that interfered with pedestrian traffic and surface water runoff.\n\n• Additional technical inspections were contemplated to verify drainage conditions and define the corresponding measures.\n\nThe foregoing demonstrates that the Administration has not remained inactive or incurred the alleged absolute omission described by the applicant. (Emphasis added). This Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all action by this Municipality must comply with its five-year plan and the principle of legality, which is the cornerstone of all public administration action. The application filed must therefore be dismissed, since the applicant’s fundamental rights have not been violated.\n\nTENTH: 4. VIOLATION OF THE RIGHTS OF VULNERABLE GROUPS: This neglect by the Municipality of Liberia directly affects the best interests of children, older adults, and persons with disabilities (invalids), who are forced to travel among sources of contamination and stagnant water, putting their lives and health at risk: In accordance with the foregoing, and in compliance with the Código Municipal and other applicable regulations, the applicant’s allegation in this matter is untrue, since, by official letter PUTGV-0860-06-2025, dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Road Management Technical Unit of the Municipality of Liberia, the following is stated: “III. ON THE ABSENCE OF AN ABSOLUTE OMISSION BY THE ADMINISTRATION\n\nIt is incorrect to claim that the Municipality of Liberia remained inactive in response to the reported situations. Before this application was filed, this Administration issued various technical assessments and formal responses addressed to Mr. [Nombre 001], addressing requests concerning the Barrio La Victoria area and the vicinity of Escuela La Victoria. Those responses expressly stated that:\n\n• The area would be included in the Municipality’s preventive maintenance and cleaning programs.\n\n• Cleaning of the curb and gutter, removal of sediment, and elimination of obstructions affecting stormwater runoff had been scheduled.\n\n• During January, February, and May 2026, work was carried out to clean sidewalks, remove invasive vegetation, cut trees, and clear areas that interfered with pedestrian traffic and surface water runoff.\n\n• Additional technical inspections were contemplated to verify drainage conditions and define the corresponding measures.\n\nThe foregoing demonstrates that the Administration has not remained inactive or incurred the alleged absolute omission described by the applicant. (Emphasis added). This Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all action by this Municipality must comply with its five-year plan and the principle of legality, which is the cornerstone of all public administration action. The application filed must therefore be dismissed, since the applicant’s fundamental rights have not been violated.\n\nELEVENTH: On the absence of lis pendens and petition for immediate adjudication. To ensure the utmost procedural transparency and prevent any erroneous interpretation that the causes are identical, I formally inform this Court that, as of today, I have filed a total and final withdrawal of case file No. 26-012198-0007- CO. Accordingly, there is no risk of duplication or lis pendens, and this case file (26-018775-0007-CO) remains the only active avenue through which urgent protection is sought for the rights to health, life, and accessibility (Ley 7600) of the school population and residents of Barrio La Victoria in Liberia.” He further adds, in any event, that “SUBJECT: SUBMISSIONS, ASSESSMENT OF NEW EVIDENCE ADDED TO THE CASE FILE (MUNICIPAL OFFICIAL LETTER CM-0453-05-2026 IN FOLIO 143 AND STORMWATER SATELLITE UPDATE IN FOLIO 144). Exercising my right of defense, and with the firm intention of keeping this judicial case file duly developed, updated, and substantiated, I respectfully appear before this Court to set out, state, and present a legal analysis of the documentary and technical-satellite evidence added to the record under the referenced folios, so that it may be assessed together when the merits of this case are decided: In accordance with the foregoing, and in compliance with the Código Municipal and other applicable regulations, the applicant’s allegation in this matter is untrue, since, by official letter PUTGV-0860-06-2025, dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Road Management Technical Unit of the Municipality of Liberia, the following is stated: “I. ON THE REPEATED ATTENTION GIVEN TO THE APPLICANT’S REQUESTS\n\nIt should be noted that the Municipality of Liberia has maintained ongoing attention to the various requests, complaints, observations, and demands submitted by Mr. [Nombre 001] concerning the pedestrian infrastructure and stormwater conditions in the sector at issue. A review of the administrative records shows that the applicant has submitted multiple writings concerning the same facts or closely related matters, which the Administration has duly considered and addressed through formal responses, technical assessments, inspections, and administrative actions consistent with its municipal powers. In addition, many statements in the more recent submissions repeat, expand upon, or reformulate points that the Municipality had already analyzed and answered. Nevertheless, even where prior determinations had been made, the Administration continued to respond to the applicant’s new submissions, at all times maintaining its duty to attend to and communicate with the person dealing with the Administration. Accordingly, the applicant’s assertion that there has been a refusal to provide attention, a failure to respond, or institutional disinterest in the requests submitted is untrue, since the Municipality has maintained continuous and documented action on the matters raised, both in administrative proceedings and in the various constitutional proceedings brought by him.” (Emphasis added). This Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all action by this Municipality must comply with its five-year plan and the principle of legality, which is the cornerstone of all public administration action. The application filed must therefore be dismissed, since the applicant’s fundamental rights have not been violated.\n\nTWELFTH: 4. FIRST: ON THE MUNICIPALITY’S INACTION, FULLY ESTABLISHED IN FOLIO 1431. The record includes FOLIO 143 of the case file, which contains official letter No. CM-0453-05-2026 dated 27 May 2026, issued by the Secretariat of the Municipal Council of Liberia. That document transcribes the agreement adopted by the Municipal Council under the third item of Ordinary Session No. 127-2026, held on 26 May 2026. (...) Exercising my right of defense, and with the firm intention of keeping this judicial case file duly developed, updated, and substantiated, I respectfully appear before this Court to set out, state, and present a legal analysis of the documentary, technical-satellite, field inspection, and subsequently received written evidence added to the record, so that it may be assessed together when the merits of this case are decided: On this point, this Municipality clarifies to this honorable authority that these are matters for the Municipal Council, as a collegiate deliberative body, to address pursuant to Article 13 of the Código Municipal, which sets out the powers and functions that this collegiate body must exercise. This Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all action by this Municipality must comply with its five-year plan and the principle of legality, which is the cornerstone of all public administration action. The application filed must therefore be dismissed, since the applicant’s fundamental rights have not been violated.\n\nTHIRTEENTH: 5. SECOND: ON THE MUNICIPALITY’S INACTION, FULLY ESTABLISHED IN FOLIO 143 The record includes FOLIO 143 of the case file, which contains official letter No. CM045305-2026 dated 27 May 2026, issued by the Secretariat of the Municipal Council of Liberia. That document transcribes the agreement adopted by the Municipal Council under the third item of Ordinary Session No. 127-2026, held on 26 May 2026. I respectfully ask the Justices to verify and assess that, in response to a formal complaint of disobedience and the flagrant presence of a putrid infectious focus in front of a school for children, the highest authority in the canton of Liberia chose to dismissively classify the community situation as a purely “informational” matter, expressly resolving, verbatim: “IT IS AGREED TO TAKE NOTE, AS THIS IS AN INFORMATIONAL MATTER; THE CORRESPONDING REPORT WILL BE SUBMITTED WHEN THE CONSTITUTIONAL CHAMBER NOTIFIES US.” This posture of complacent expectation and deliberate inaction recorded in FOLIO 143, whereby any material intervention or technical solution is made contingent on this Constitutional Court ordering them to account for their actions, demonstrates the total absence of a commitment to good public service and constitutes the serious, ongoing, and irreversible harm suffered by minors and residents of Barrio La Victoria. Expansion on the Abandonment of Powers and Breach of the Duties of the Active Administration: The Municipal Council’s agreement documented in Folio 143 exemplifies what the most authoritative doctrine of administrative law calls a voluntary abdication of its legal powers of authority and sanitary policing. By classifying the existence of an organic contamination and stormwater decomposition site in front of a primary school as a mere “informational matter,” the municipal deliberative body directly violates the block of legality established in Article 4 of the Código Municipal. Local corporate entities have autonomy, but this does not empower them to fail to meet their immediate obligations concerning the health and environmental safety of their residents. (...) On this point, this Municipality clarifies to this honorable authority that these are matters for the Municipal Council, as a collegiate deliberative body, to address pursuant to Article 13 of the Código Municipal, which sets out the powers and functions that this collegiate body must exercise. This Municipality considers that the applicant’s alleged fundamental rights have not been violated, since all action by this Municipality must comply with its five-year plan and the principle of legality, which is the cornerstone of all public administration action. The application filed must therefore be dismissed, since the applicant’s fundamental rights have not been violated.\n\nFOURTEENTH: 6, FOURTH: SUBSEQUENT ADMISSION OF THE HEALTH CRISIS BY THE MUNICIPAL MAYOR (FOLIO 145) To further strengthen the record, I ask that the official public statement issued on Sunday, 31 May 2026, by the head of the executive body of the same respondent entity, the Mayor of Liberia, José Javier Calvo Darcia, be added and assessed together with the other evidence. This public statement constitutes an unavoidable extrajudicial admission concerning the reported facts, in which the highest municipal authority expressly states: “I respectfully wish to warn the public that, as of tomorrow, I have instructed the Municipal Police of Liberia and the Municipal Inspectors Department to carry out inspection and notification operations throughout the canton, in order to combat an unacceptable practice that affects public health, the environment, and the image of our city. I refer to the illegal discharge of sewage, blackwater, and wastewater from homes and businesses into drains, roadside ditches, sewers, and public spaces. We can no longer tolerate a few people continuing to pollute our neighborhoods, causing foul odors, sources of infection, insect proliferation, and harm to residents’ quality of life (...) If necessary, we will pursue every available administrative and legal avenue to the fullest extent to eradicate this disgusting and irresponsible practice once and for all. Liberia deserves a clean, orderly, healthy, and environmentally responsible city. Public cooperation will be essential to achieving this goal. There will be no tolerance for those who threaten the health and well-being of our community.” On the basis of this new evidence, it is essential to emphasize to this Constitutional Court:\n\n• Admission of harmful conditions: The Mayor of the Municipality of Liberia himself publicly and expressly acknowledges the factual existence of “sources of infection,” “insect proliferation,” “foul odors,” and direct effects on “public health” and the “environment,” exactly as this applicant has technically established for Barrio La Victoria in Folio 144.\n\n• Internal institutional contradiction: While the Municipal Council adopts in Folio 143 an omission-based position of “taking note” and classifies the school emergency as a mere “informational matter,” pending notification by this Chamber, the Municipal Mayor characterizes the situation across the canton as a “disgusting and irresponsible practice” warranting the immediate deployment of the public force and inspectors.” (...) “The collapse of Liberia’s central district, the flooding of Hospital Enrique Baltodano Briceño and the local seat of the Judiciary constitute irrefutable material manifestations that Liberia’s urban stormwater network is completely exhausted.” Based on the situations described, he considers that fundamental rights have been violated. He asks that the application be granted. In accordance with the foregoing, and in compliance with the Código Municipal and other applicable regulations, the applicant’s allegation in this matter is untrue, since, by official letter PUTGV-0860-06- 2025, dated 22 June 2026, signed by Eng. Dorian A. Ulate Elizondo, Director of the Road Management Technical Unit of the Municipality of Liberia, the following is stated: “III. ON STATEMENTS CONCERNING DISCHARGES OF SEWAGE INTO THE STORMWATER SYSTEM\n\nThe applicant seeks to present the public statements made by the Municipal Mayor as a supposed admission of institutional responsibility for the reported facts. However, a comprehensive reading of those statements leads to a different conclusion. As the applicant himself quotes in his submission, the Municipal Mayor announced the start of inspection, enforcement, and notification operations aimed at combating the illegal discharge of sewage, blackwater, and wastewater into drains, roadside ditches, sewers, and other elements of the stormwater infrastructure. Far from demonstrating institutional inaction, those statements reflect the actions being promoted by the Municipality of Liberia to address a problem affecting various areas of the canton and closely related to improper connections to the stormwater system and the accumulation of solid waste in the drainage infrastructure. It should also be noted that this situation is not unique to Barrio La Victoria and is not a problem whose resolution depends solely on the Municipality. Rather, addressing it requires the participation and coordination of various public institutions within their respective areas of competence, including the Ministerio de Salud, the Instituto Costarricense de Acueductos y Alcantarillados (AyA), the Ministerio Público where appropriate, and the Municipality of Liberia itself, through inspection, enforcement, investigation, and implementation of the corresponding corrective measures. In addition, technical assessments conducted by this Unit have determined that stagnant water and foul odors observed at certain points are not necessarily due to design deficiencies in the stormwater infrastructure, but mainly to the improper discharge of sewage and the accumulation of garbage, solid waste, and sediment within the drainage systems, factors that directly affect their operation. Accordingly, the statements cited by the applicant do not constitute an admission of design errors, noncompliance, or failure to act by the Municipality, but rather confirm that the Administration is carrying out concrete actions to address a complex sanitary and environmental problem whose resolution requires coordinated action by different institutions and correction of irregular conduct by third parties.\n\nIV. ON REFERENCES TO FLOODING IN OTHER AREAS OF THE CANTON\n\nIt is also important to note that the applicant attempts to link to the subject of this application a series of events that are not directly related to the facts reported in Barrio La Victoria. In particular, he refers to the effects recorded in Liberia’s central district, Hospital Enrique Baltodano Briceño, and the local seat of the Judiciary, presenting them as supposed evidence that the urban stormwater network is completely exhausted. However, those events arose from an extraordinary situation that occurred between 5 and 8 June 2026, during which the canton of Liberia was affected by a high-intensity hydrometeorological event associated with the influence of the Intertropical Convergence Zone, which caused exceptional rainfall, flooding, and impacts at various points in the canton. Those events resulted from a widespread emergency and are not directly related to the facts at issue in this application or to the specific conditions reported by Mr. [Nombre 001]. Therefore, it is not technically correct to use emergency situations that occurred in different areas of the canton to support claims concerning the specific conditions reported in the vicinity of Escuela La Victoria, or to conclude that an alleged administrative omission occurred at the site at issue in this application. Accordingly, the applicant’s references to those extraordinary floods concern separate and independent situations from the problem discussed here and do not constitute technical evidence capable of substantiating the claims made against the Municipality of Liberia concerning Barrio La Victoria.\n\nV. MITIGATION AND FOLLOW-UP ACTIONS\n\nWithout prejudice to the technical considerations set out in this report and the rejection of the applicant’s claims concerning alleged design failures, absolute omissions, or institutional noncompliance, the Municipality of Liberia remains committed to the continuous improvement of pedestrian mobility, stormwater drainage, and public health conditions in Barrio La Victoria and its surroundings. In that regard, the Administration will continue to carry out the following actions within its powers and available resources:\n\n1. Periodic maintenance of the stormwater system, including cleaning of the curb and gutter, removal of sediment, removal of waste, and clearing of drainage elements in areas identified as priorities.\n\n2. Follow-up technical inspections to verify the operation of the existing stormwater infrastructure and determine whether additional interventions are needed where technically appropriate.\n\n3. Continued improvements to pedestrian infrastructure in accordance with the maintenance, rehabilitation, and reconstruction programs established under institutional planning and current prioritization criteria.\n\n4. Progressive implementation of the Comprehensive Stormwater Sanitation Project for the Southern Neighborhoods, developed on the basis of technical studies commissioned by the Municipality and scheduled in stages according to budget availability and the construction sequence established in the project design.\n\n5. Interinstitutional coordination with the Ministerio de Salud, the Instituto Costarricense de Acueductos y Alcantarillados (AyA), and other competent entities to identify and address irregular discharges of sewage and wastewater and other situations that could affect the proper functioning of stormwater systems.\n\n6. Enforcement concerning situations attributable to third parties, including improper disposal of solid waste and improper connections to the stormwater system, through the corresponding administrative procedures.\n\nThe actions described form part of the ordinary management carried out by the Municipality of Liberia to preserve and improve the canton’s road and stormwater infrastructure, and demonstrate that the Administration is continuously monitoring the needs in the area as part of an integrated and progressive response (…)”.\n\n6.- By submissions added to the case file on 22 and 23 June 2026, the applicant replies to the report of the respondent mayor.\n\n7.- By a submission added to the case file on 23 June 2026, the applicant provides documents and points out that the sidewalks in certain sectors mentioned do not comply with the provisions of Law No. 7600.\n\n8.- By a submission added to the case file on 23 June 2026, Luis Enrique Mayorga Díaz, director of the Liberia Health Area, Ministry of Health, reports: “FIRST—Technical Report MS-DRRSCH-DARSL-ER-IT-0082-2026, dated 22 June 2026, to respond to the amparo application of which you notified us. SECOND—On 19 June 2026, a follow-up visit was conducted to verify the sanitary orders issued in April of this year. THE FOLLOWING IS REPORTED REGARDING THE FACTS AND ACTIONS TAKEN: Based on the information provided and the inspection conducted, it was determined that the persons to whom the sanitary orders were issued complied with what this Ministry ordered under the regulations in force.”\n\n9.- By a submission added to the case file on 23 June 2026, the applicant replies to the report submitted by the Liberia Health Area.\n\n10.- By a submission added to the case file on 23 June 2026, María Lourdes Ocampo Fernández, president of the Liberia Municipal Council, submits a report on the same terms as the mayor of that local government.\n\n11.- By submissions added to the case file on 24 June 2026, the applicant replies to the reports of the respondent municipality and provides documents.\n\n12.- By a submission added to the case file on 21 July 2026, the applicant makes statements. Among them, he requests that noncompliance with the judgment issued in case file No. 23-024765-0007-CO be declared.\n\n13.- By a submission added to the case file on 1 August 2026, the applicant makes statements concerning case file No. 26-021768-0007-CO.\n\n14.- By a submission added to the case file on 19 August 2026, the applicant requests a prompt decision on the amparo application.\n\n15.- By a submission added to the case file on 3 September 2026, the applicant provides images and documents. He also replies to the information reported by the respondent municipality.\n\n16.- The legal requirements have been observed in the proceedings.\n\nJustice Rueda Leal drafts this opinion; and,\n\nReasons:\n\nI.- SUBJECT OF THE AMPARO APPLICATION. The applicant alleges omissions by the respondent authorities concerning pedestrian infrastructure in the La Victoria neighborhood of Liberia. In this regard, he states: “The central purpose of this instrument is to establish before this Court the continued existence of an absolute omission to provide a technical and material solution in Barrio La Victoria, Liberia (specifically in the area around the local school, Calle 11 and Avenues 6, 8, and 10).” He details that the site has problems with stormwater infrastructure, collapsed outfalls, and a complete lack of safe sidewalks, particularly near La Victoria School. He argues that the stormwater system receives runoff from various businesses, causing water to overflow at the school itself instead of following its natural drainage route. He notes that the corners of Avenues 8 and 10 and Calle 11 are subject to constant accumulation of runoff, and that the standing water causes foul odors, creating a persistent source of contamination and a breeding ground for vectors that endanger the public, especially the students at the school in question. He adds that there are no sidewalks or curb and gutter along approximately 100 meters of the right side of Calle 11 (southbound), and that the infrastructure on the left side is in ruins, with holes, cracks, and physical obstructions, also creating accessibility difficulties contrary to the requirements of Law No. 7600. He explains that this situation forces students and others walking through the area to use the roadway, putting them at risk.\n\nII.- FACTS FOUND. The following facts are deemed duly established and relevant to the decision in this matter:\n\nRegarding the Municipality of Liberia:\n\na) The applicant had reported the problems with pedestrian infrastructure in “the area around the local school, Calle 11 and Avenues 6, 8, and 10” at least since 2025. (Report of the respondent authority).\n\nb) In January, February, and May 2026, the respondent municipality cleaned sidewalks, removed invasive vegetation, cut trees, and cleared areas that obstructed pedestrian traffic and surface water runoff. (Report of the respondent authority).\n\nc) Regarding the stormwater system, the respondent municipality states that “the conditions observed at some points in the area are primarily associated with external factors, such as the improper discharge of wastewater into the stormwater system and the accumulation of solid waste and sediment affecting its operation.” It also began an integrated stormwater management project in the “Southern Neighborhoods of Liberia”; however, work has not yet begun in Barrio La Victoria. (Report of the respondent authority).\n\nd) In official letter No. 0358-03-2026 of 23 March 2026, the Technical Road Management Unit of the respondent local government stated: “(…) regarding the partial lack of pedestrian and stormwater infrastructure along some sections of Calle 11 and Avenida 10, it is reiterated that Article 84 of the Municipal Code establishes that registered property owners have the primary obligation to construct and maintain sidewalks in front of their properties. Under that provision, the Municipality is responsible for inspecting and notifying the owners subject to that obligation and, if an omission is confirmed, considering subsidiary execution of the necessary works, then collecting the cost through a fee or special contribution (…) In areas where there are no sidewalks, the cited Article 84 of the Municipal Code continues to place direct responsibility on the owners to build them in front of their properties. As indicated in the previous official letters, and in response to requests for reviews or additional studies at other points in the area, the Municipality will again issue the corresponding notices in cases where new instances of noncompliance are identified. If noncompliance continues, and depending on budget availability, the necessary works may be carried out under the 2026 municipal budget or scheduled in later budgets (…)”.\n\ne) In official letter No. PUTGV-0860-06-2025, dated 22 June 2026, the Technical Road Management Unit of the respondent municipality stated: “It is alleged that there is no pedestrian infrastructure in front of La Victoria School, whereas in fact the main frontage of that educational center is at the intersection of Avenida 10 and Calle 15, an area with pedestrian infrastructure intended for students, teaching staff, and users generally. Also, although some sidewalk sections in nearby areas have varying degrees of deterioration and require maintenance, rehabilitation, or reconstruction, this does not mean that pedestrian infrastructure is entirely absent (…)”. (Report of the respondent authority).\n\nf) In official letter No. PUTGV-0860-06-2025, dated 22 June 2026, the Technical Road Management Unit of the respondent municipality detailed the following follow-up actions to be carried out: “1. Periodic maintenance of the stormwater system, including cleaning the curb and gutter, removing sediment and waste, and clearing drainage components in areas identified as priorities. 2. Technical follow-up inspections to verify the operation of existing stormwater infrastructure and determine whether additional interventions are technically necessary. 3. Continued improvements to pedestrian infrastructure under the maintenance, rehabilitation, and reconstruction programs established in institutional planning and the current prioritization criteria. 4. Progressive implementation of the Integrated Stormwater Sanitation Project for the Southern Neighborhoods, developed on the basis of technical studies commissioned by the Municipality and scheduled in stages according to budget availability and the construction sequence set out in the project design. 5. Interinstitutional coordination with the Ministry of Health, the Costa Rican Institute of Aqueducts and Sewers (AyA), and other competent entities to identify and address irregular discharges of wastewater, sewage, and other conditions that could affect proper operation of stormwater systems. 6. Oversight of situations attributable to third parties, including improper disposal of solid waste and improper connections to the stormwater system, through the applicable administrative procedures.” (Report of the respondent authority).\n\nRegarding the Liberia Health Area:\n\ng) On 24 March 2026, the applicant filed a complaint with the Liberia Health Area concerning problems related to “water disposal (…) safety and hygiene conditions,” specifically “FROM LA VICTORIA SCHOOL, LOCATED IN FRONT OF AVENIDA 10, APPROXIMATELY 6 TO 8 METERS WEST, FROM THAT POINT DOWN SOUTH ALONG CALLE 11 ON THE LEFT SIDE.” (Documentary evidence).\n\nh) The Liberia Health Area issued sanitary orders Nos. 018-2026, 019-2026, 021-2026, 022-2026, 024-2026, and 025-2026 against owners of several homes in the area. Those orders provided: “Ensure the sanitary disposal of wastewater produced in the home or establishment, within the boundaries of the property, in order to prevent soil contamination, the formation of vector breeding sites and disease, and air pollution through conditions that compromise its purity or quality.” (Documentary evidence).\n\ni) The Liberia Health Area was notified of the order initiating this proceeding on 18 June 2026. (Notice of service added to the case file).\n\nj) On 19 June 2026, the Liberia Health Area conducted a follow-up inspection of the sanitary orders issued, and report No. MS-DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026 stated: “on-site verification confirms compliance with the proper disposal of wastewater and the respective treatment systems (…)”. (Documentary evidence).\n\nIII.- FACT NOT FOUND. The following fact, relevant to the decision in this matter, is deemed not established:\n\na) That the Liberia Health Area notified the protected party of report No. MS-DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026 during the proceedings on his complaint.\n\nIV.- THE CASE BEFORE THE COURT. In this case, the applicant alleges omissions by the respondent authorities concerning pedestrian infrastructure in the La Victoria neighborhood of Liberia. In this regard, he states: “The central purpose of this instrument is to establish before this Court the continued existence of an absolute omission to provide a technical and material solution in Barrio La Victoria, Liberia (specifically in the area around the local school, Calle 11 and Avenues 6, 8, and 10).” He details that the site has problems with stormwater infrastructure, collapsed outfalls, and a complete lack of safe sidewalks, particularly near La Victoria School. He argues that the stormwater system receives runoff from various businesses, causing water to overflow at the school itself instead of following its natural drainage route. He notes that the corners of Avenues 8 and 10 and Calle 11 are subject to constant accumulation of runoff, and that the standing water causes foul odors, creating a persistent source of contamination and a breeding ground for vectors that endanger the public, especially the students at the school in question. He adds that there are no sidewalks or curb and gutter along approximately 100 meters of the right side of Calle 11 (southbound), and that the infrastructure on the left side is in ruins, with holes, cracks, and physical obstructions, also creating accessibility difficulties contrary to the requirements of Law No. 7600. He explains that this situation forces students and others walking through the area to use the roadway, putting them at risk.\n\nThe case file establishes that the applicant had reported the problems with pedestrian infrastructure in “the area around the local school, Calle 11 and Avenues 6, 8, and 10” at least since 2025. In January, February, and May 2026, the respondent municipality cleaned sidewalks, removed invasive vegetation, cut trees, and cleared areas that obstructed pedestrian traffic and surface water runoff. Regarding the stormwater system, the respondent municipality states that “the conditions observed at some points in the area are primarily associated with external factors, such as the improper discharge of wastewater into the stormwater system and the accumulation of solid waste and sediment affecting its operation.” It also began an integrated stormwater management project in the “Southern Neighborhoods of Liberia”; however, work has not yet begun in Barrio La Victoria. In official letter No. 0358-03-2026 of 23 March 2026, the Technical Road Management Unit of the respondent local government stated: “(…) regarding the partial lack of pedestrian and stormwater infrastructure along some sections of Calle 11 and Avenida 10, it is reiterated that Article 84 of the Municipal Code establishes that registered property owners have the primary obligation to construct and maintain sidewalks in front of their properties. Under that provision, the Municipality is responsible for inspecting and notifying the owners subject to that obligation and, if an omission is confirmed, considering subsidiary execution of the necessary works, then collecting the cost through a fee or special contribution (…) In areas where there are no sidewalks, the cited Article 84 of the Municipal Code continues to place direct responsibility on the owners to build them in front of their properties. As indicated in the previous official letters, and in response to requests for reviews or additional studies at other points in the area, the Municipality will again issue the corresponding notices in cases where new instances of noncompliance are identified. If noncompliance continues, and depending on budget availability, the necessary works may be carried out under the 2026 municipal budget or scheduled in later budgets (…)”. In official letter No. PUTGV-0860-06-2025, dated 22 June 2026, the Technical Road Management Unit of the respondent municipality stated: “It is alleged that there is no pedestrian infrastructure in front of La Victoria School, whereas in fact the main frontage of that educational center is at the intersection of Avenida 10 and Calle 15, an area with pedestrian infrastructure intended for students, teaching staff, and users generally. Also, although some sidewalk sections in nearby areas have varying degrees of deterioration and require maintenance, rehabilitation, or reconstruction, this does not mean that pedestrian infrastructure is entirely absent (…)”. In official letter No. PUTGV-0860-06-2025, dated 22 June 2026, the Technical Road Management Unit of the respondent municipality detailed the following follow-up actions to be carried out: “1. Periodic maintenance of the stormwater system, including cleaning the curb and gutter, removing sediment and waste, and clearing drainage components in areas identified as priorities. 2. Technical follow-up inspections to verify the operation of existing stormwater infrastructure and determine whether additional interventions are technically necessary. 3. Continued improvements to pedestrian infrastructure under the maintenance, rehabilitation, and reconstruction programs established in institutional planning and the current prioritization criteria. 4. Interinstitutional coordination with the Ministry of Health, the Costa Rican Institute of Aqueducts and Sewers (AyA), and other competent entities to identify and address irregular discharges of wastewater, sewage, and other conditions that could affect proper operation of stormwater systems. 6. Oversight of situations attributable to third parties, including improper disposal of solid waste and improper connections to the stormwater system, through the applicable administrative procedures.” On 24 March 2026, the applicant filed a complaint with the Liberia Health Area concerning problems related to “water disposal (…) safety and hygiene conditions,” specifically “FROM LA VICTORIA SCHOOL, LOCATED IN FRONT OF AVENIDA 10, APPROXIMATELY 6 TO 8 METERS WEST, FROM THAT POINT DOWN SOUTH ALONG CALLE 11 ON THE LEFT SIDE.” The Liberia Health Area issued sanitary orders Nos. 018-2026, 019-2026, 021-2026, 022-2026, 024-2026, and 025-2026 against owners of several homes in the area. Those orders provided: “Ensure the sanitary disposal of wastewater produced in the home or establishment, within the boundaries of the property, in order to prevent soil contamination, the formation of vector breeding sites and disease, and air pollution through conditions that compromise its purity or quality.” The Liberia Health Area was notified of the order initiating this proceeding on 18 June 2026. On 19 June 2026, the Liberia Health Area conducted a follow-up inspection of the sanitary orders issued, and report No. MS-DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026 stated: “on-site verification confirms compliance with the proper disposal of wastewater and the respective treatment systems (…)”.\n\nFirst, regarding the Municipality of Liberia, intervention by this constitutional jurisdiction is necessary.\n\nAlthough the respondent local government has carried out some works to address the problem reported by the protected party (for example, cleaning sidewalks, removing invasive vegetation, cutting trees, and clearing areas that obstructed pedestrian traffic and surface water runoff), it has not been established that the situation at issue has been definitively and comprehensively resolved.\n\nIn this regard, one of the problems alleged in the area (“Barrio La Victoria de Liberia (specifically in the area around the local school, Calle 11 and Avenues 6, 8, and 10)”) concerns the stormwater system, which, according to the applicant, causes water to overflow and accumulate in certain places, resulting in contamination and risk to people. The respondent authority does not deny that conditions such as those described exist; it reports that “the conditions observed at some points in the area are primarily associated with external factors, such as the improper discharge of wastewater into the stormwater system and the accumulation of solid waste and sediment affecting its operation.” It also explained the need to carry out an integrated stormwater management project, which has already begun in other areas of the southern neighborhoods of Liberia, but not yet in Barrio La Victoria.\n\nAccordingly, as to this matter, the respondent municipality does not guarantee that the situation will ultimately be addressed and resolved within a reasonable time.\n\nFurthermore, with regard to the lack of sidewalks and the infrastructure problems at the site in question, there is likewise no evidence that the respondent municipality has taken action to resolve the matter promptly and effectively. First, by official letter No. 0358-03-2026 of 23 March 2026, the Technical Road Management Unit of the respondent local government did not dispute the problem at issue, but merely stated: “(…) regarding the partial lack of pedestrian and stormwater infrastructure along some sections of Calle 11 and Avenida 10, it is reiterated that Article 84 of the Municipal Code establishes that registered property owners have the primary obligation to construct and maintain sidewalks in front of their properties. Under that provision, the Municipality is responsible for inspecting and notifying the owners subject to that obligation and, if an omission is confirmed, considering subsidiary execution of the necessary works, then collecting the cost through a fee or special contribution (…) In areas where there are no sidewalks, the cited Article 84 of the Municipal Code continues to place direct responsibility on the owners to build them in front of their properties. As indicated in the previous official letters, and in response to requests for reviews or additional studies at other points in the area, the Municipality will again issue the corresponding notices in cases where new instances of noncompliance are identified. If noncompliance continues, and depending on budget availability, the necessary works may be carried out under the 2026 municipal budget or scheduled in later budgets (…)”. However, there is no record of concrete actions either to oversee construction of sidewalks by property owners or to directly carry out the works in question.\n\nNow, although in official letter No. PUTGV-0860-06-2025 of 22 June 2026 the Technical Road Management Unit of the respondent municipality later indicated that pedestrian infrastructure does exist in front of La Victoria School, it nevertheless acknowledges that “some sidewalk sections in nearby areas have varying degrees of deterioration and require maintenance, rehabilitation, or reconstruction.” In addition, no possible dates for any eventual intervention are specified.\n\nThus, it is established that the site identified by the protected party has a problem involving a lack of sidewalks in some areas and deterioration of existing structures, which the respondent municipality has not resolved, nor has it guaranteed a reasonable timeframe for addressing and definitively remedying the situation.\n\nAccordingly, the amparo application is granted as to these matters and with respect to the Municipality of Liberia, on the terms set out in the operative part of this decision.\n\nV.- As for the Liberia Health Area, the complaint filed by the protected party on 24 March 2026 was initially addressed; several sanitary orders were even issued against property owners to “Ensure the sanitary disposal of wastewater produced in the home or establishment, within the boundaries of the property, in order to prevent soil contamination, the formation of vector breeding sites and disease, and air pollution through conditions that compromise its purity or quality.”\n\nHowever, it was not until this amparo proceeding was underway that, on 19 June 2026, the respondent authority conducted an inspection to verify compliance with those orders and issued report No. DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026, which found that the orders had been complied with.\n\nAlthough this Chamber is not responsible for reviewing the substance of the respondent authority’s decision or determining whether the administrative acts were ultimately complied with, it may intervene to ensure minimum procedural requirements, such as effective communication to the amparo applicant of the conclusions reached in the summary proceedings. In this regard, the case file does not show that report No. DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026 was formally notified to the protected party in his capacity as complainant, so that he would have full knowledge of the respondent authority’s conclusion regarding the matter in question.\n\nIn light of the foregoing, this part of the amparo application is granted with respect to the Liberia Health Area, on the terms set out in the operative part of this decision.\n\nVI.- In subsequent statements, the protected party complains that the Office of the Comptroller General of the Republic (CGR) was not brought into the proceedings, because, in his view, there were “oversight omissions” arising from alleged inaction in an external audit of the municipality. However, given the principal subject of this matter—the reported road infrastructure and sanitary problem—the order initiating these proceedings requested reports only from the Municipality of Liberia and the Ministry of Health, as they are the bodies directly competent to address this particular situation. If the protected party considers that an irregularity occurred in any audit or oversight process by the CGR, the proper course is to apply to the competent ordinary administrative or judicial bodies, since the matter is an ordinary legality dispute that, in principle, falls outside the summary nature of this amparo proceeding.\n\nThe applicant also refers to the municipality’s alleged noncompliance with what was ordered in case file No. 23-024765-0007-CO. However, that matter concerns a dispute unrelated to the specific subject of this case. The protected party must therefore raise that particular allegation, if he so wishes, in case file No. 23-024765-0007-CO, so that it may be resolved in that enforcement proceeding.\n\nVII.- NOTE BY JUSTICE SALAZAR ALVARADO. As a general principle, I consider that cases concerning the activity or inactivity of the Public Administration in repairing, constructing, modifying, or demolishing any infrastructure works should be dismissed because such an omission is a matter of legality, the discussion of which belongs before the ordinary jurisdiction, where the interested person can debate their objections more fully. However, when that administrative conduct, whether by action or omission, results in a violation of other fundamental rights protected by this constitutional jurisdiction, or affects groups considered vulnerable, I do consider the merits of the matter, as this situation constitutes an exception to my position in this area. That is the case here, where the applicant alleges that infrastructure has not been addressed within a reasonable time.\n\nVIII.- PARTIAL DISSENT BY JUSTICE GARRO VARGAS REGARDING ENFORCEMENT OF THE JUDGMENT. I dissent with respect to enforcement of the judgment, so that, pursuant to Article 56 of the Law on Constitutional Jurisdiction (LJC), enforcement be assigned to the Enforcement Division of the Administrative Litigation and Civil Treasury Court.\n\nEnforcement of orders issued by the Constitutional Chamber is, in principle, to be overseen by the Chamber itself. However, that provision contemplates exceptions under which the Chamber may determine that enforcement of the judgment be assigned to the administrative-litigation jurisdiction:\n\n“Art. 56. Enforcement of judgments falls to the Constitutional Chamber, except with respect to the assessment and payment of compensation and pecuniary liabilities, or other matters that the Chamber itself considers appropriate, in which case it shall be carried out in the administrative-litigation jurisdiction under the judgment enforcement procedure established by the law governing that jurisdiction.” (Emphasis not in the original).\n\nRecall that the bill debated for the LJC originally provided as follows:\n\n“Art. 56. Judgments in favor of the applicant shall be enforced in the administrative-litigation jurisdiction under the judgment enforcement procedure established by the law governing that jurisdiction.” (Emphasis not in the original).\n\nHowever, the text was amended by motion so that the provision would be consistent with Article 153 of the Political Constitution, and the following explanation was given:\n\n“THE SECRETARY:\n\nMotion No. 68 (32-19) by Deputy Chacón Jiménez:\n\n“Article 57 (formerly 56): so that it reads as follows: ‘Enforcement of judgments falls to the Constitutional Chamber, except with respect to the assessment and payment of compensation or pecuniary liabilities, or other matters that the Chamber itself considers appropriate, in which case it shall be carried out in the administrative-litigation jurisdiction under the judgment enforcement procedure established by the law governing that jurisdiction.’\n\nTHE PRESIDENT:\n\nThe motion just read is open for discussion.\n\nDoctor Piza Escalante:\n\nThere was a contradiction here with the general principle that courts enforce their own judgments, and it sent all enforcement to the Administrative Litigation Jurisdiction; the other articles that allowed the Chamber to enforce them were then left without effect.\n\nDeputy Corrales Bolaños:\n\nIn that part it says ‘or other matters that the Chamber itself considers appropriate…’; what does that refer to?\n\nDoctor Piza Escalante:\n\nThe idea is for the Chamber, in the judgment enforcement proceeding, to resolve whatever it considers its responsibility. The rest is sent to the Administrative Litigation Jurisdiction.\n\nTHE SECRETARY:\n\nHas the motion been sufficiently discussed?\n\nTHE PRESIDENT:\n\nDiscussed. Approved (unanimously, with five deputies present).” (sic). See the minutes of approval of the LJC. (Emphasis not in the original).\n\nOn the basis of the foregoing, it is clear that the LJC authorizes this Chamber to assess and decide whether it is necessary to refer all or some aspects of judgment enforcement to the administrative-litigation jurisdiction.\n\nIn this specific case, given the scope of the first order issued, I consider that the enforcement phase should be assigned to the administrative-litigation jurisdiction. This is because the regulations governing this constitutional jurisdiction provide no suitable mechanisms for monitoring the orders set out in this judgment, which involve highly complex technical matters.\n\nBy contrast, the provisions on enforcement in the Code of Administrative Litigation Procedure (Article 155 et seq.) have clear advantages, such as the ability to request schedules, impose fines, establish liability, monitor stages of compliance, and so on. For that reason, pursuant to Article 56 of the LJC, I consider that the enforcement phase should take place before the Enforcement Division of the Administrative Litigation and Civil Treasury Court, under the judgment enforcement rules in that Code.\n\nIV.- DOCUMENTATION ADDED TO THE CASE FILE. The parties are notified that any paper documents, as well as objects or evidence contained on electronic, computer, magnetic, optical, telematic, or new-technology devices, must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Any material not collected within that period will be destroyed, as provided by the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court in Article XXVI of session No. 27-11 of 22 August 2011, published in Judicial Bulletin No. 19 of 26 January 2012, and by the resolution of the Judicial Branch’s Superior Council, approved in Article LXXXI of session No. 43-12 held on 3 May 2012.\n\nTherefore:\n\nThe amparo application is granted. José Javier Calvo Darcia and María Lourdes Ocampo Fernández, each in their capacity as mayor and president of the Council, respectively, both of the Municipality of Liberia, or whoever holds those offices, are ordered to coordinate as appropriate, take the necessary measures, and issue the corresponding orders within the scope of their respective powers so that, within a maximum period of TWELVE MONTHS from notification of this judgment, the necessary actions and works are carried out to resolve the pedestrian and stormwater infrastructure problems in the area identified by the protected party, in order to ensure the safety and health of those who live in and travel through that area. Luis Enrique Mayorga Díaz, director of the Liberia Health Area, or whoever holds that office, is also ordered to issue the corresponding orders and take the necessary measures within the scope of his powers so that, within a maximum period of THREE DAYS from notification of this judgment, the complainant is formally notified of official letter No. DRRSCH-DARSL-ER-IT-0082-2026 of 22 June 2026, concerning the conclusion of the actions taken in the administrative summary proceedings. The respondent authorities are warned that, under Article 71 of the Law on Constitutional Jurisdiction, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Municipality of Liberia and the State are ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be assessed in the administrative-litigation judgment enforcement proceeding. Justice Salazar Alvarado files a note. Justice Garro Vargas dissents regarding the venue for enforcement of the judgment, with respect to the first order issued, and, pursuant to Article 56 of the Law on Constitutional Jurisdiction, directs that this phase be assigned to the Enforcement Division of the Administrative Litigation and Civil Treasury Court.
