  "body_es_text": "\n\nExp: 26-027054-0007-CO \n\nRes. Nº 2026033874\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de setiembre de dos mil veintiseis .\n\nRecurso de amparo que se tramita en expediente Nº26-027054-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE ALAJUELITA.\n\nRESULTANDO:\n\n1.- Por escrito agregado al expediente digital de la Sala a las 10:06 horas del 28 de julio de 2026, la parte recurrente interpone recurso de amparo contra la Municipalidad de Alajuelita. Manifiesta que, colindante con su vivienda existe una construcción de varios departamentos que se encuentra prácticamente sobre su casa y que cuenta con ocho ventanas orientadas hacia su propiedad, con vista directa al patio y al techo de su vivienda. Señala que ha presentado diversas gestiones ante la autoridad recurrida, dado que, entre otras cosas, dicha construcción afecta las bases de su casa, se escucha el agua correr sobre la pared y existe un riesgo de salud y al ambiente por los problemas de manejo de aguas residuales, filtraciones y disposición inadecuada de residuos. Señala que planteó una denuncia el 01 de agosto de 2022 por la construcción de los apartamentos colindantes a su vivienda, el 18 de enero de 2023 gestionó ante la Municipalidad de Alajuelita el acceso al expediente administrativo relacionado con la denuncia; mediante oficio del 10 de febrero de 2023 solicitó la paralización de las obras, la clausura de la construcción y su eventual demolición; el 13 de abril de 2023 reiteró sus objeciones respecto de la construcción denunciada y solicitó nuevamente la intervención municipal y el 25 de enero de 2024 en seguimiento a la denuncia previamente formulada, reiteró su solicitud de cierre de las ventanas o demolición del inmueble. Reclama que no ha recibido respuesta a sus gestiones más recientes, pero tampoco se han adoptado medidas en relación con la denuncia formulada, por lo que el problema persiste. Solicita que se declare con lugar el recurso. \n\n2.- Por resolución de las 15:51 horas del 06 de agosto de 2026 se dio curso al presente proceso y se concedió audiencia al Alcalde y al Jefe del Departamento de Control Urbano, ambos de la Municipalidad de Alajuelita, sobre los hechos alegados por la parte recurrente.\n\n3.- Informa bajo juramento María del Rosario Siles Fernández, en su condición de Alcaldesa de la Municipalidad de Alajuelita, que: \n\n“I. SOBRE LOS HECHOS ALEGADOS POR LA PARTE RECURRENTE\n\nLa recurrente manifiesta ser propietaria colindante de un inmueble sobre el cual se ha desarrollado una construcción de varios apartamentos, que a su juicio afecta las bases de su vivienda, cuenta con ocho ventanas orientadas hacia su propiedad con vista directa a su patio y techo, y que genera un riesgo a la salud y al ambiente por el manejo de aguas residuales, filtraciones y disposición inadecuada de residuos. Señala asimismo haber formulado gestiones ante esta Municipalidad desde el 1° de agosto de 2022, con seguimientos el 18 de enero de 2023, el 10 de febrero de 2023, el 13 de abril de 2023 y el 25 de enero de 2024, sin haber recibido respuesta a sus gestiones más recientes.\n\nEsta autoridad rechaza que exista omisión o inercia administrativa. Por el contrario, y según se acredita documentalmente, la Municipalidad de Alajuelita ha desplegado desde junio de 2022 una actuación sostenida, oportuna y ajustada a derecho respecto del inmueble colindante identificado como Finca de San José N° 259434-000, Plano Catastrado SJ- 0035863-1977, inscrito a nombre de la señora Guiselle Patricia Hidalgo Ureña, cédula de identidad 1-0684-0633, ubicado en Distrito 02 San Josecito, Alajuelita.\n\nII. CRONOLOGÍA DEL EXPEDIENTE ADMINISTRATIVO\n\nConsta en el expediente administrativo instruido por la Dirección de Gestión del Desarrollo Urbano (GDUR) y el Departamento de Control Urbano de esta Municipalidad, referente al desarrollo irregular de un complejo edilicio de aproximadamente 350 metros cuadrados en dos plantas destinado a apartamentos, la siguiente secuencia de actuaciones:\n\n \n\nFecha\n\nActuación\n\nContenido\n\n03-jun-2022 \n\nNotificación N°2204-B \n\nPrimera prevención por obras clandestinas. Se detecta la edificación no autorizada y se ordena la inmediata paralización de los trabajos, advirtiendo la necesidad de planos aprobados y dirección profesional del CFIA.\n\n09-jun-2022\n\nOficio ING-1272-2022 \n\nLa propia administrada, señora Hidalgo Ureña, reconoce expresamente la irregularidad de las obras y solicita un plazo de tres meses para regularizar el proyecto. Dicha solicitud no otorgó autorización para continuar construyendo.\n\n21-jul-2022\n\nNotificación N°2470-B \n\nSegunda prevención por reincidencia. Se constata que, lejos de suspender las labores, la administrada aceleró el proceso constructivo, violentando la orden de paralización inicial.\n\n10-nov-2022 \n\nNotificación N°MA-AM-GDUR-PU-CU-0368-2022\n\nTercera notificación operativa, ejecutada por la asistente de ingeniería municipal Angie Sofía Sanabria Cisneros.\n\nSe constata la ruptura y desacato de los sellos de clausura, se señalan las infracciones por apertura de ventanas hacia predios colindantes y ausencia de profesional responsable del CFIA, y se otorga plazo improrrogable de 8 días naturales bajo apercibimiento de remisión al Ministerio Público por desobediencia a la autoridad (arts. 314 y 319 del Código Penal).\n\n09-ene-2023\n\nResolución MA-AM-GDUR-0004-2023\n\nActo administrativo definitivo, firmado digitalmente por el Ing. Jaime Eduardo Casasa Vargas, Director de Desarrollo Urbano. Declara la clausura total y definitiva de las instalaciones, prohíbe expresamente su ocupación o uso por representar riesgo inminente para la salud y seguridad pública, y ordena la demolición total de las estructuras no autorizadas, con remisión a la Dirección Jurídica y a la Alcaldía para el planteamiento de las denuncias correspondientes.\n\n \n\nEn cuanto a los trámites que la parte recurrente invoca haber presentado el 10 de abril de 2023 y el 25 de enero de 2024, se informa a esa Sala que, según consta en el acta oficial de recepción de trámites de esta Municipalidad, no existe registro de ingreso —ni físico ni informático— correspondiente a dichas gestiones, por lo que la alegación de la recurrente en cuanto a esos extremos carece de sustento probatorio.\n\nIII. SOBRE LA INEXISTENCIA DE OMISIÓN ADMINISTRATIVA\n\nEl objeto del presente amparo parte de la premisa de que esta Municipalidad ha incurrido en inercia frente a las gestiones de la recurrente. Dicha premisa no se ajusta a la realidad documental del expediente administrativo, el cual evidencia una actuación municipal continua, diligente y proporcional desde el momento mismo de la detección de las obras irregulares:\n\n•La Municipalidad detectó de oficio la construcción no autorizada desde el 3 de junio de 2022, es decir, antes de la primera gestión de la recurrente ante esta sede.\n\n•Se emitieron tres notificaciones formales de paralización y clausura frente a la reiterada desobediencia de la administrada.\n\n•Se dictó resolución administrativa definitiva (MA-AM-GDUR-0004-2023) que ordena la demolición total de las estructuras irregulares, precisamente la pretensión sustantiva de la recurrente.\n\n•Dicha resolución fue remitida a la Dirección Jurídica y a la Alcaldía Municipal para el planteamiento de las denuncias penales correspondientes por los delitos de violación de sellos y desobediencia a la autoridad.\n\nEn consecuencia, no existe el silencio ni la omisión administrativa alegados; por el contrario, la propia pretensión de la recurrente —el cese de la construcción irregular y la afectación a su propiedad— se encuentra ya resuelta mediante acto administrativo firme que ordena la demolición integral del inmueble denunciado.\n\nIV. SOBRE LA EJECUCIÓN DE LA RESOLUCIÓN DE DEMOLICIÓN\n\nSe informa a esa Sala que, conforme al criterio técnico-legal rendido por la Dirección de Planificación Urbana de esta Municipalidad, los plazos otorgados a la administrada tanto por la legislación municipal (artículo 171 del Código Municipal) como por la Ley de Construcciones se encuentran holgadamente vencidos, sin que la señora Hidalgo Ureña haya aportado planos aprobados por el Colegio Federado de Ingenieros y de Arquitectos ni permiso municipal alguno.\n\nPor lo anterior, se ha recomendado a la Dirección de Desarrollo Urbano proceder con la notificación de cobro y ejecución sustitutiva de la demolición de los 350 metros cuadrados de estructura irregular, con fundamento en el artículo 96 de la Ley de Construcciones, que faculta a la Municipalidad a ejecutar la destrucción por cuenta de la administrada en caso de incumplimiento, con el recargo legal correspondiente.\n\nIV. FUNDAMENTO NORMATIVO\n\nLa actuación municipal descrita se sustenta en las siguientes disposiciones:\n\n•Ley de Construcciones, N°833: artículos 74, 78, 79, 88 y 89 (exigencia de licencia municipal y prohibición de obras clandestinas); artículos 54, 81, 83 y 85 (responsabilidad profesional del CFIA); artículo 89 incisos b, c, d y g (violación de sellos, desacato e infracción a retiros); artículo 96 (ejecución sustitutiva de la demolición por cuenta de la administrada).\n\n•Reglamento de Construcciones del INVU, artículos 96, 97 y 98, en cuanto a la apertura irregular de servidumbres de vista y ventanas hacia predios colindantes sin respetar las distancias mínimas reglamentarias.\n\n•Código Penal, artículos 314 (violación de sellos) y 319 (desobediencia a la autoridad).\n\n•Código Municipal, artículo 171, en cuanto a los plazos de impugnación en sede administrativa.\n\nVI. PETITORIA\n\nCon fundamento en lo expuesto y por constar en el expediente administrativo que esta Municipalidad ha actuado de forma diligente, oportuna y conforme a derecho frente a la situación denunciada por la recurrente —incluyendo la emisión de una orden firme de demolición total del inmueble que motiva el reclamo—, se solicita respetuosamente a esa Sala Constitucional:\n\n•Se declare SIN LUGAR el presente recurso de amparo, al no existir omisión ni inercia administrativa atribuible a la Municipalidad de Alajuelita.”\n\n4.- Por escrito incorporado al expediente el 11 de agosto de 2026, la parte recurrente aporta prueba digital.\n\n5.- Informa bajo juramento Jaime Casasa Vargas, en su condición de director de Planificación Urbana de la Municipalidad de Alajuelita, en cuanto a los hechos acusados, lo siguiente: \n\n“ Con referencia a la solicitud para expediente entregado en la plataforma de servicios con en el número ING-1926-2026 de fecha 11 de agosto del 2026, se informa que se adjunta un documento en formato PDF con la información solicitada (Expediente digital). \n\nRESUMEN\n\n(…)\n\n \n\n El presente informe técnico-legal analiza el expediente administrativo instruido por la Municipalidad de Alajuelita, a través de la Dirección de Gestión del Desarrollo Urbano (GDUR) y el Departamento de Control Urbano, referente a las obras de edificaciones ejecutadas sin licencia en la propiedad inscrita a nombre de Guiselle Patricia Hidalgo Ureña (Finca San José N° 259434-000, Plano Catastrado SJ-0035863-1977). \n\nEl caso abarca el desarrollo irregular de un complejo edilicio de aproximadamente 350 metros cuadrados en dos plantas destinado a apartamentos. A lo largo del procedimiento, la administración municipal emitió múltiples prevenciones, ordenanzas de paralización, sellos de clausura y resoluciones sancionatorias, las cuales fueron reiteradamente desobedecidas por la administrada, culminando con la orden formal de demolición integral de las estructuras no autorizadas. \n\nCRONOLÓGICA DE LOS TRÁMITES \n\nA continuación, se expone el recorrido cronológico del expediente administrativo, confrontando los trámites citados en el recurso presentado por la administrada con los registros oficiales y resoluciones emitidas por la Municipalidad de Alajuelita:\n\n(…)\n\nNOTIFICACIONES Y ACTOS ADMINISTRATIVOS \n\na) Notificación N.o 2204-B (03 de junio de 2022) \n\n \n\nActo inicial de fiscalización donde el inspector municipal detecta la edificación no autorizada de apartamentos. Se otorga apercibimiento inicial para la paralización de los trabajos y se advierte sobre la necesidad de contar con planos aprobados y dirección profesional. \n\nB. Solicitud de Prórroga ING-1272-2022 (09 de junio de 2022) \n\nLa señora Guiselle Patricia Hidalgo Ureña reconoce explícitamente la irregularidad de las obras al someter ante la Municipalidad la gestión ING-1272-2022, mediante la cual solicita un plazo de tres meses para regularizar el proyecto (\"ponerse a derecho\"). Dicha solicitud no otorgó autorización para continuar construyendo durante el lapso concedido. \n\nC. Notificación N.o 2470-B (21 de julio de 2022) \n\nSegunda notificación formal de clausura. La autoridad municipal constata que, lejos de mantener suspendidas las labores a la espera de la subsanación de permisos, la administrada aceleró el proceso constructivo, violentando la orden inicial.\n\nD. Notificación N.o MA-AM-GDUR-PU-CU-0368-2022 (10 de noviembre de 2022) \n\nCorresponde a la Tercera Notificación Operativa, ejecutada por la asistente de ingeniería municipal Angie Sofía Sanabria Cisneros (Cédula 3-0511-0187) a las 11:00 a.m. En este documento formal: \n\nSe hace constar expresamente la ruptura y desacato de los sellos de clausura colocados por el municipio. \n\nSe señalan las infracciones por apertura de ventanas hacia predios colindantes y la ausencia de profesional responsable del Colegio Federado de Ingenieros y de Arquitectos (CFIA). \n\nSe otorga un plazo improrrogable de 8 días naturales para cumplir la orden de paralización absoluta, bajo apercibimiento de remitir el expediente al Ministerio Público por el delito de desobediencia a la autoridad (Art. 314 y 319 Código Penal). \n\nE. Demolición MA-AM-GDUR-0004-2023 (09 de enero de 2023) \n\nEmitida y firmada digitalmente por el Ing. Jaime Eduardo Casasa Vargas, MSc. ; Director de Desarrollo Urbana. Constituye el acto administrativo definitivo mediante el cual se resuelve: \n\n• Declarar la clausura total y definitiva de las instalaciones (aproximadamente 350 m2 en 2 plantas). \n\n• Prohibir expresamente la ocupación o uso de los apartamentos, al representar un riesgo inminente para la salud y la seguridad pública. \n\n• Conceder un plazo de 8 días naturales para iniciar los trabajos de demolición y 30 días naturales para concluir la demolición total y el desalojo de escombros. \n\n• Advertir la aplicación del Artículo 96 de la Ley de Construcciones: si la propietaria no demuele, la Municipalidad ejecutará la destrucción por cuenta de la administrada, cobrando un recargo del 150% (1.5 veces) del costo total de las obras de demolición. \n\n• Remisión a Instancias Internas para Denuncias Formales: El documento MA-AM-GDUR-0004-2023 fue enviado formalmente a la Dirección Jurídica / Departamento Legal y a la Alcaldía Municipal con el propósito expreso de interponer y dar curso a las respectivas denuncias legales y penales, habida cuenta de las graves e iterativas infracciones cometidas contra la normativa urbanística y de construcciones vigente. \n\nINFRACCIONES A LA NORMATIVA CONSTRUCTIVA Y URBANÍSTICA DE COSTA RICA \n\nEl expediente evidencia una reiterada y gravísima transgresión al ordenamiento jurídico costarricense en materia de construcciones, urbanismo y salubridad. A continuación, se detallan las infracciones legales fundamentadas: \n\n• Ley de Construcciones (Ley N.o 833) \n\n• Ejecución de obras sin licencia municipal (Arts. 74, 78, 79, 88 y 89): Toda obra de construcción requiere contar de previo con la licencia municipal y el pago de tributos. Realizar obras clandestinas constituye la falta primaria del expediente. \n\n• Ausencia de Profesional Responsable del CFIA (Arts. 54, 81, 83 y 85): Toda edificación debe estar bajo el diseño, inspección y responsabilidad técnica de un profesional incorporado al Colegio Federado de Ingenieros y de Arquitectos. \n\n• Violación de Sellos y Desobediencia (Art. 89 incisos c, g): Incurrir en el desacato a la orden de suspensión emitida por el cuerpo de inspectores y destruir o ignorar las fajas de clausura. \n\n• Infracción a Retiros y Normas Técnicas (Art. 89 inc. b, d): Construcción sin respetar las colindancias y lineamientos reglamentarios. \n\nReglamento de Construcciones e Infracciones al Código Civil \n\n Reglamento de Construcciones del INVU ART. 96, 97 y 98: Se abrió servidumbre de vista/ventanas en paredes colindantes sin respetar la distancia mínima, cobertura, densidad. \n\n \n\n. Código Penal de la República de Costa Rica \n\n Delito de Violación de Sellos (Artículo 314 del Código Penal): Se sanciona con pena de prisión a quien violentare los sellos puestos por la autoridad para asegurar la conservación o la identidad de una cosa. \n\n El romper deliberadamente las fajas municipales para continuar la obra configura esta figura tipificada. Delito de Desobediencia a la Autoridad (Artículo 319 del Código Penal): Incumplimiento sistemático de las órdenes impartidas por funcionarios públicos en el ejercicio legítimo de sus funciones. \n\nCONCLUSIONES \n\n1) Solidez del Procedimiento Sancionatorio: El expediente administrativo cuenta con la debida notificación de la Resolución de Demolición (MA-AM-GDUR-0004-2023) y tres notificaciones previas, cumpliendo cabalmente con el debido proceso y la garantía de audiencia. \n\n2) Acreditación de Traslados para Denuncias: Se confirma que la Resolución MA-AM-GDUR-0004-2023 fue debidamente remitida a la Alcaldía Municipal y al Departamento Legal para el planteamiento formal de las denuncias correspondientes ante las autoridades judiciales competente (Ministerio Público), dada la comisión continuada de infracciones normativas y desacato de sellos. \n\n3) Improcedencia de Recursos Extemporáneos: Los plazos otorgados por la legislación (Código Municipal Art. 171) y la Ley de Construcciones se encuentran holgadamente vencidos. La solicitud de prórroga ING-1272-2022 venció sin que la administrada obtuviera ni aportara planos aprobados por el CFIA ni permiso municipal. \n\n4) Inexistencia del Trámite del 10-abr-2023: Al no existir registro de ingreso del segundo trámite alegado con fecha 10 de abril de 2023, la alegación de la administrada carece de sustento probatorio y no suspende los efectos de la orden de demolición firme. \n\n5) Ejecución Sustitutiva de Demolición: Se recomienda a la Dirección de Desarrollo Urbano proceder con la notificación de cobro y ejecución subsidiaria de la demolición de los 350 m2 de estructura irregular conforme al Art. 96 de la Ley de Construcciones, aplicando la sobretasa del 1% sobre el costo de ejecución”. \n\n 6.- En los procedimientos seguidos se han observado las prescripciones legales. \n\n Redacta el Magistrado Salazar Alvarado; y,\n\nCONSIDERANDO:\n\nI.- SOBRE EL CONOCIMIENTO DE ESTE CASO POR LESIÓN AL ARTÍCULO 41 DE LA CONSTITUCIÓN POLÍTICA. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia N° 2008-002545 de las 08:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones- aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite se plantea un supuesto de excepción, pues se discute una presunta omisión en atención de lo resuelto respecto de una denuncia planteada por la parte recurrente ante la Municipalidad de Alajuelita. En ese sentido, la recurrente cuestiona que, pese a haber interpuesto dicha denuncia por construcciones ilegales que afectan su derecho de propiedad desde agosto de 2022 (aguas residuales, filtraciones y disposición de residuos, con riesgos para la salud y el ambiente), al momento de acudir en amparo aún no se había dictado una resolución definitiva, por lo que estima lesionado su derecho a una justicia pronta y cumplida. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.\n\nII.- OBJETO DEL RECURSO. La recurrente manifiesta que una construcción de varios apartamentos colindante con su vivienda afecta las bases de su casa y genera problemas relacionados con aguas residuales, filtraciones y disposición de residuos, con riesgos para la salud y el ambiente. Señala que desde el año 2022 ha presentado diversas gestiones ante la Municipalidad de Alajuelita solicitando la intervención municipal, la paralización y clausura de las obras, su eventual demolición y el cierre de ventanas que tienen vista hacia su propiedad. No obstante, acusa que sus gestiones no han sido respondidas y que tampoco se han adoptado medidas respecto de la denuncia, por lo que la situación persiste.\n\nIII.- HECHOS PROBADOS. Se estiman como debidamente demostrados los siguientes hechos de importancia para la resolución del presente asunto:\n\nb) El 03 de junio de 2022, la Municipalidad de Alajuelita emitió la notificación N° 2204-B, mediante la cual constató la existencia de una edificación no autorizada en la finca de San José N° 259434-000, plano castrado SJ-0035863-1977 y ordenó la inmediata paralización de los trabajos (ver informe rendido).\n\nc) El 09 de junio de 2022, la propietaria del inmueble referido presentó la gestión ING-1272-2022, mediante la cual solicitó un plazo de tres meses para regularizar el proyecto (ver informe rendido).\n\nd) El 21 de julio de 2022, la Municipalidad emitió la notificación N° 2470-B, en la que constató la violación a la orden previa de paralización (ver informe rendido).\n\ne) El 01 de agosto de 2022, la recurrente presentó ante la Municipalidad de Alajuelita una gestión relacionada con la construcción de apartamentos ubicados en un inmueble colindante con su vivienda (ver prueba aportada).\n\nf) El 10 de noviembre de 2022, mediante la notificación N° MA-AM-GDUR-PU-CU-0368-2022, la Municipalidad constató la ruptura de los sellos de clausura y otorgó un plazo de ocho días naturales para cumplir la orden de paralización (ver informe rendido).\n\ng) El 09 de enero de 2023, mediante la resolución N° MA-AM-GDUR-0004-2023, la Municipalidad de Alajuelita ordenó la clausura total y definitiva de las instalaciones, prohibió su ocupación o uso y ordenó la demolición total de las estructuras no autorizadas (ver informe rendido).\n\nh) La resolución de curso de este proceso se les notificó a las autoridades recurridas el 11 de agosto de 2026 (véanse al respecto las actas de notificación agregadas en autos). \n\nIV- HECHO NO PROBADO. No se estima demostrado el siguiente hecho de relevancia para esta resolución: \n\nÚNICO. Que la Municipalidad recurrida haya resuelto en forma definitiva la denuncia presentada por la tutelada (los autos).\n\nV.- SOBRE EL DERECHO A UNA JUSTICIA PRONTA Y CUMPLIDA. La Administración, a la luz del artículo 41, Constitucional, tiene la obligación de garantizar a las personas el cumplimiento de la justicia pronta y cumplida, lo que implica, en el ámbito de la justicia administrativa, su obligación de decidir con diligencia y celeridad los reclamos planteados por los administrados, de tal manera que su resolución sea congruente con los extremos alegados, así como de comunicar a los interesados lo dispuesto, todo ello dentro de un plazo razonable. En este sentido, el carácter \"razonable\" de la duración de la actividad administrativa se determina, casuísticamente, con base en diversos elementos, tales como: la complejidad técnica del asunto administrativo, la amplitud de la prueba por evacuar o el grado de afectación a la persona o al ambiente del acto impugnado, de lo cual se infiere que no existe un derecho estricto a la constitucionalización de los plazos, sino, más bien, un derecho a que se aplique el control de constitucionalidad sobre aquellas actuaciones de la Administración, en las cuales no existan motivos suficientes para justificar el tiempo demorado en la solución de algún tipo de gestión administrativa.\n\nVI.- SOBRE EL CASO CONCRETO. En el sub lite, la recurrente manifiesta que una construcción de varios apartamentos colindante con su vivienda afecta las bases de su casa y genera problemas relacionados con aguas residuales, filtraciones y disposición de residuos, con riesgos para la salud y el ambiente. Señala que desde el año 2022 ha presentado diversas gestiones ante la Municipalidad de Alajuelita solicitando la intervención municipal, la paralización y clausura de las obras, su eventual demolición y el cierre de ventanas que tienen vista hacia su propiedad. No obstante, acusa que sus gestiones no han sido respondidas en forma definitiva y que tampoco se han adoptado medidas respecto de la denuncia, por lo que la situación persiste.\n\nAhora bien, a pesar de que es cierto que las autoridades de la Municipalidad de Alajuelita, dentro del ámbito de sus competencias, han realizado algunas actuaciones dirigidas a atender la situación denunciada y emitieron resoluciones ordenando la suspensión y posterior demolición de las estructuras, no consta que ésta haya sido notificada a la parte amparada, ni tampoco consta que finalmente se haya ejecutado la orden de demoler las construcciones ilegales, pese a que las denuncias se remontan al 2022. Al no tener por acreditado que la recurrente tenga conocimiento del resultado de la gestión planteada ni las fechas en las que finalmente se demolerán las construcciones ilegales, se estima lesionado su derecho a una justicia pronta y cumplida. Por lo anterior, lo procedente es declarar con lugar el recurso.\n\nVII.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\nVIII.- NOTA DEL MAGISTRADO SALAZAR ALVARADO. En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente indica que ha presentado diversas denuncias relacionadas con construcciones ilegales en la propiedad continua a la suya desde el 2022, alegando afectaciones estructurales, filtraciones y riesgos a su propiedad y a su núcleo familiar, que no han sido resueltas en forma definitiva.\n\nIX.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPOR TANTO:\n\n Se declara con lugar el recurso. Se ordena a María del Rosario Siles Fernández en su condición de Alcaldesa de la Municipalidad de Alajuelita, o a quien ejerza el cargo, que dentro de plazo de TRES MESES, contado a partir de la notificación de esta sentencia, se dicten las órdenes necesarias, dentro del ámbito de sus competencias, para que resuelva en forma definitiva la denuncia presentada por la recurrente desde el 01 de agosto de 2022, se notifique lo resuelto y, además, en ese mismo plazo, se ejecute la demolición de estructuras ilegales, de ser procedente conforme a derecho y si otra causa ajena al conocimiento de este proceso no lo impide. Se condena a la Municipalidad de Alajuelita al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se advierte a las autoridades recurridas, que de no acatar la orden dicha, incurrirán en el delito de desobediencia y que, de conformidad con el artículo 71, de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. San José, at 9:20 a.m. on 3 September 2026.\n\nAmparo proceeding in expediente Nº26-027054-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the MUNICIPALITY OF ALAJUELITA.\n\nBACKGROUND:\n\n1.- By a brief added to the Chamber’s digital expediente at 10:06 a.m. on 28 July 2026, the petitioner files an amparo proceeding against the Municipality of Alajuelita. The petitioner states that, adjacent to the petitioner’s home, there is a building with several apartments that is practically on top of the home and has eight windows facing the petitioner’s property, with a direct view of the patio and roof of the home. The petitioner indicates that various requests have been submitted to the respondent authority because, among other things, the building affects the foundations of the home, running water can be heard on the wall, and there is a risk to health and the environment due to problems with wastewater management, leaks, and improper waste disposal. The petitioner states that a complaint was filed on 01 August 2022 regarding the construction of apartments adjacent to the home; on 18 January 2023, the petitioner sought access from the Municipality of Alajuelita to the administrative expediente related to the complaint; by letter dated 10 February 2023, the petitioner requested that the works be halted, the building closed, and that it eventually be demolished; on 13 April 2023, the petitioner reiterated objections to the reported construction and again requested municipal intervention; and on 25 January 2024, following up on the previously filed complaint, the petitioner again requested that the windows be closed or the property demolished. The petitioner claims not to have received a response to the most recent requests, and that no measures have been taken in relation to the complaint either, so the problem persists. The petitioner asks that the application be granted.\n\n2.- By resolution issued at 3:51 p.m. on 06 August 2026, these proceedings were commenced and a hearing was granted to the Mayor and the Head of the Urban Control Department, both of the Municipality of Alajuelita, regarding the facts alleged by the petitioner.\n\n3.- María del Rosario Siles Fernández, in her capacity as Mayor of the Municipality of Alajuelita, reports under oath as follows:\n\n“I. REGARDING THE FACTS ALLEGED BY THE PETITIONER\n\nThe petitioner states that the petitioner owns a property adjacent to a property on which a building with several apartments has been constructed, which in the petitioner’s view affects the foundations of the petitioner’s home, has eight windows facing the petitioner’s property with a direct view of the patio and roof, and poses a risk to health and the environment due to wastewater management, leaks, and improper waste disposal. The petitioner also states that requests were made to this Municipality starting on 1 August 2022, with follow-ups on 18 January 2023, 10 February 2023, 13 April 2023, and 25 January 2024, without receiving a response to the most recent requests.\n\nThis authority denies that any administrative omission or inaction occurred. To the contrary, as documented, the Municipality of Alajuelita has taken sustained, timely, and lawful action since June 2022 regarding the adjacent property identified as Finca de San José N° 259434-000, Cadastral Plan SJ- 0035863-1977, registered in the name of Guiselle Patricia Hidalgo Ureña, identity card 1-0684-0633, located in District 02 San Josecito, Alajuelita.\n\nII. CHRONOLOGY OF THE ADMINISTRATIVE EXPEDIENTE\n\nThe administrative expediente conducted by the Directorate of Urban Development Management (GDUR) and the Urban Control Department of this Municipality, concerning the irregular construction of an approximately 350-square-meter, two-story apartment building, records the following sequence of actions:\n\n| Date | Action | Content |\n| --- | --- | --- |\n| 03-jun-2022 | Notice N°2204-B | First warning regarding unauthorized works. The petitioner’s allegations as to those matters therefore lack evidentiary support.\n\nIII. REGARDING THE ABSENCE OF ADMINISTRATIVE OMISSION\n\nThe present amparo is based on the premise that this Municipality has been inactive in response to the petitioner’s requests. That premise is inconsistent with the documentary record in the administrative expediente, which shows continuous, diligent, and proportionate municipal action from the moment the irregular works were detected:\n\n• The Municipality detected the unauthorized construction on its own initiative as of 3 June 2022, that is, before the petitioner’s first filing with this authority.\n\n• Three formal notices to cease work and close the premises were issued in response to the property owner’s repeated disobedience.\n\n• A final administrative resolution (MA-AM-GDUR-0004-2023) was issued, ordering the total demolition of the irregular structures, precisely the petitioner’s substantive request.\n\n• That resolution was referred to the Legal Directorate and the Municipal Mayor’s Office for the filing of the corresponding criminal complaints for breaking seals and disobedience of authority.\n\nConsequently, there is no silence or administrative omission as alleged; on the contrary, the petitioner’s own request—that the irregular construction cease and the petitioner’s property no longer be affected—has already been resolved by a final administrative act ordering the complete demolition of the reported property.\n\nIV. REGARDING IMPLEMENTATION OF THE DEMOLITION RESOLUTION\n\nThis Chamber is informed that, according to the technical-legal opinion issued by the Directorate of Urban Planning of this Municipality, the periods granted to the property owner under both municipal legislation (Article 171 of the Municipal Code) and the Construction Law have long since expired, and Ms. Hidalgo Ureña has provided neither plans approved by the Colegio Federado de Ingenieros y de Arquitectos nor any municipal permit.\n\nAccordingly, the Directorate of Urban Development has been advised to proceed with notice of collection and substitute execution of the demolition of the 350 square meters of irregular structure, pursuant to Article 96 of the Construction Law, which empowers the Municipality to carry out the destruction at the property owner’s expense in the event of noncompliance, with the applicable statutory surcharge.\n\nIV. LEGAL BASIS\n\nThe municipal action described is based on the following provisions:\n\n• Construction Law, N°833: Articles 74, 78, 79, 88, and 89 (requirement of a municipal license and prohibition of unauthorized works); Articles 54, 81, 83, and 85 (professional responsibility of the CFIA); Article 89, subsections b, c, d, and g (breaking seals, disobedience, and violation of setbacks); Article 96 (substitute execution of demolition at the property owner’s expense).\n\n• INVU Construction Regulations, Articles 96, 97, and 98, regarding the irregular opening of view easements and windows toward adjacent properties without observing the minimum regulatory distances.\n\n• Penal Code, Articles 314 (breaking seals) and 319 (disobedience of authority).\n\n• Municipal Code, Article 171, regarding periods for challenging decisions in administrative proceedings.\n\nVI. REQUEST\n\nOn the basis of the foregoing, and because the administrative expediente shows that this Municipality has acted diligently, promptly, and lawfully in response to the situation reported by the petitioner—including issuing a final order for the total demolition of the property underlying the complaint—it respectfully requests that the Constitutional Chamber:\n\n• Declare this amparo proceeding WITHOUT MERIT, as there has been no administrative omission or inaction attributable to the Municipality of Alajuelita.”\n\n4.- By a brief incorporated into the expediente on 11 August 2026, the petitioner submits digital evidence.\n\n5.- Jaime Casasa Vargas, in his capacity as Director of Urban Planning of the Municipality of Alajuelita, reports under oath regarding the alleged facts as follows:\n\n“With reference to the request for the expediente submitted through the service platform under number ING-1926-2026, dated 11 August 2026, a PDF document containing the requested information (digital expediente) is attached.\n\nSUMMARY\n\n(…)\n\nThis technical-legal report analyzes the administrative expediente conducted by the Municipality of Alajuelita, through the Directorate of Urban Development Management (GDUR) and the Urban Control Department, regarding construction works carried out without a license on the property registered in the name of Guiselle Patricia Hidalgo Ureña (Finca San José N° 259434-000, Cadastral Plan SJ-0035863-1977).\n\nThe case concerns the irregular construction of an approximately 350-square-meter, two-story apartment building. Throughout the proceedings, the municipal administration issued multiple warnings, orders to cease work, closure seals, and penalty resolutions, which the property owner repeatedly disobeyed, culminating in the formal order for the complete demolition of the unauthorized structures.\n\nCHRONOLOGY OF THE FILINGS\n\nThe administrative expediente is set out below in chronological order, comparing the filings cited in the application submitted by the property owner with the Municipality of Alajuelita’s official records and resolutions:\n\n(…)\n\nNOTICES AND ADMINISTRATIVE ACTS\n\na) Notice N.o 2204-B (03 June 2022)\n\nInitial enforcement action in which the municipal inspector detects the unauthorized construction of apartments. An initial warning is issued to cease work, and notice is given of the requirement to have approved plans and professional supervision.\n\nB. Extension Request ING-1272-2022 (09 June 2022)\n\nMs. Guiselle Patricia Hidalgo Ureña explicitly acknowledges the irregularity of the works by submitting request ING-1272-2022 to the Municipality, seeking three months to regularize the project (“bring it into compliance”). That request did not grant authorization to continue construction during the period requested.\n\nC. Notice N.o 2470-B (21 July 2022)\n\nSecond formal closure notice. The municipal authority establishes that, instead of keeping the work suspended while awaiting correction of the permits, the property owner accelerated construction, violating the initial order.\n\nD. Notice N.o MA-AM-GDUR-PU-CU-0368-2022 (10 November 2022)\n\nThis is the Third Operational Notice, carried out by municipal engineering assistant Angie Sofía Sanabria Cisneros (Identity card 3-0511-0187) at 11:00 a.m. This formal document:\n\nExpressly records the breaking and disobedience of the closure seals placed by the municipality.\n\nIdentifies violations for opening windows toward adjacent properties and the absence of a responsible professional from the Colegio Federado de Ingenieros y de Arquitectos (CFIA).\n\nGrants a non-extendable period of 8 calendar days to comply with the order to halt all work, on notice that the expediente will be referred to the Ministerio Público for the offense of disobedience of authority (Art. 314 and 319, Penal Code).\n\nE. Demolition MA-AM-GDUR-0004-2023 (09 January 2023)\n\nIssued and digitally signed by Eng. Jaime Eduardo Casasa Vargas, MSc.; Director of Urban Development. This is the final administrative act resolving as follows:\n\n• Declare the total and definitive closure of the premises (approximately 350 m2 on 2 floors).\n\n• Expressly prohibit occupancy or use of the apartments because they pose an imminent risk to public health and safety.\n\n• Grant a period of 8 calendar days to begin demolition work and 30 calendar days to complete the total demolition and debris removal.\n\n• Give notice of the application of Article 96 of the Construction Law: if the owner does not demolish, the Municipality will carry out the destruction at the property owner’s expense, charging a surcharge of 150% (1.5 times) of the total cost of the demolition work.\n\n• Referral to Internal Offices for Formal Complaints: Document MA-AM-GDUR-0004-2023 was formally sent to the Legal Directorate / Legal Department and the Municipal Mayor’s Office for the express purpose of filing and pursuing the corresponding legal and criminal complaints, in view of the serious and repeated violations of the current urban-planning and construction regulations.\n\nVIOLATIONS OF COSTA RICAN CONSTRUCTION AND URBAN-PLANNING REGULATIONS\n\nThe expediente shows repeated and very serious violations of Costa Rican law concerning construction, urban planning, and public health. The legal violations established are detailed below:\n\n• Construction Law (Law N.o 833)\n\n• Construction work without a municipal license (Arts. 74, 78, 79, 88, and 89): All construction work must have a municipal license in advance and the applicable taxes must be paid. Carrying out unauthorized works constitutes the primary violation in the expediente.\n\n• Absence of a Responsible CFIA Professional (Arts. 54, 81, 83, and 85): Every building must be designed, inspected, and technically supervised by a professional registered with the Colegio Federado de Ingenieros y de Arquitectos.\n\n• Breaking Seals and Disobedience (Art. 89, subsections c, g): Disobeying the suspension order issued by the inspection corps and destroying or disregarding the closure strips.\n\n• Violation of Setbacks and Technical Standards (Art. 89, subsections b, d): Construction without observing property boundaries and regulatory requirements.\n\nConstruction Regulations and Violations of the Civil Code\n\nINVU Construction Regulations, Arts. 96, 97, and 98: View easements/windows were opened in walls on property boundaries without observing the minimum distance, coverage, or density.\n\n. Penal Code of the Republic of Costa Rica\n\nOffense of Breaking Seals (Article 314 of the Penal Code): A person who breaks seals placed by an authority to ensure the preservation or identity of an item is punishable by imprisonment.\n\nDeliberately breaking municipal closure strips to continue the work constitutes this defined offense. Offense of Disobedience of Authority (Article 319 of the Penal Code): Systematic failure to comply with orders issued by public officials in the lawful exercise of their duties.\n\nCONCLUSIONS\n\n1) Soundness of the Penalty Proceedings: The administrative expediente includes proper notice of the Demolition Resolution (MA-AM-GDUR-0004-2023) and three prior notices, fully satisfying due process and the right to be heard.\n\n2) Confirmation of Referrals for Complaints: It is confirmed that Resolution MA-AM-GDUR-0004-2023 was duly referred to the Municipal Mayor’s Office and the Legal Department for the formal filing of the corresponding complaints with the competent judicial authorities (Ministerio Público), given the continuing commission of regulatory violations and disobedience of seals.\n\n3) Inadmissibility of Untimely Appeals: The periods granted by legislation (Municipal Code Art. 171) and the Construction Law have long since expired. Extension request ING-1272-2022 expired without the property owner obtaining or providing plans approved by the CFIA or a municipal permit.\n\n4) Absence of the Filing of 10 April 2023: As there is no record of receipt of the second filing alleged to have been submitted on 10 April 2023, the property owner’s allegation lacks evidentiary support and does not suspend the effects of the final demolition order.\n\n5) Substitute Execution of Demolition: The Directorate of Urban Development is advised to proceed with notice of collection and substitute execution of the demolition of the 350 m2 of irregular structure, pursuant to Art. 96 of the Construction Law, applying the 1% surcharge on the execution cost.”\n\n6.- The legal requirements have been observed in the proceedings followed.\n\nDrafted by Justice Salazar Alvarado; and,\n\nREASONS:\n\nI.- REGARDING THIS CASE’S REVIEW FOR VIOLATION OF ARTICLE 41 OF THE POLITICAL CONSTITUTION. Before analyzing the merits, it must be clarified that, since judgment N° 2008-002545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—those matters in which it is disputed whether the Public Administration has complied with the periods established by the General Law of Public Administration (Articles 261 and 325) or sectoral laws governing special administrative procedures, to resolve an administrative proceeding by final act—whether initiated on its own motion or at the request of a party—or to hear the applicable administrative appeals. In this case, an exception is presented, because the dispute concerns an alleged omission in addressing the outcome of a complaint filed by the petitioner with the Municipality of Alajuelita. In this regard, the petitioner challenges that, despite having filed that complaint regarding illegal construction affecting the petitioner’s property rights since August 2022 (wastewater, leaks, and waste disposal, with risks to health and the environment), no final resolution had been issued by the time the petitioner sought amparo. The petitioner therefore considers the right to prompt and effective justice to have been violated. That point clarified, the specific situation raised in this amparo will be resolved.\n\nII.- SUBJECT OF THE APPLICATION. The petitioner states that a building with several apartments adjacent to the petitioner’s home affects the foundations of the home and causes problems related to wastewater, leaks, and waste disposal, posing risks to health and the environment. The petitioner states that since 2022, various requests have been submitted to the Municipality of Alajuelita seeking municipal intervention, cessation and closure of the works, their eventual demolition, and closure of windows that overlook the petitioner’s property. The petitioner alleges, however, that these requests have not been answered and that no measures have been taken regarding the complaint, so the situation persists.\n\nIII.- FACTS PROVEN. The following facts of importance to resolution of this matter are considered duly established:\n\nb) On 03 June 2022, the Municipality of Alajuelita issued notice N° 2204-B, establishing the existence of an unauthorized building on Finca de San José N° 259434-000, cadastral plan SJ-0035863-1977, and ordering immediate cessation of the work (see report submitted).\n\nc) On 09 June 2022, the owner of the property in question submitted request ING-1272-2022, seeking three months to regularize the project (see report submitted).\n\nd) On 21 July 2022, the Municipality issued notice N° 2470-B, establishing that the prior cessation order had been violated (see report submitted).\n\ne) On 01 August 2022, the petitioner submitted a request to the Municipality of Alajuelita concerning construction of apartments on a property adjacent to the petitioner’s home (see evidence submitted).\n\nf) On 10 November 2022, by notice N° MA-AM-GDUR-PU-CU-0368-2022, the Municipality established that the closure seals had been broken and granted eight calendar days to comply with the cessation order (see report submitted).\n\ng) On 09 January 2023, by resolution N° MA-AM-GDUR-0004-2023, the Municipality of Alajuelita ordered the total and definitive closure of the premises, prohibited their occupancy or use, and ordered total demolition of the unauthorized structures (see report submitted).\n\nh) The resolution commencing these proceedings was notified to the respondent authorities on 11 August 2026 (see the notices of service added to the case file).\n\nIV.- FACT NOT PROVEN. The following relevant fact is not considered established for this resolution:\n\nSOLE. That the respondent Municipality finally resolved the complaint submitted by the protected party (the record).\n\nV.- THE RIGHT TO PROMPT AND EFFECTIVE JUSTICE. Under Article 41 of the Constitution, the Administration is obligated to guarantee prompt and effective justice to people. In the sphere of administrative justice, this entails a duty to decide diligently and promptly the claims submitted by members of the public, so that the resolution addresses the matters alleged, and to notify interested parties of the decision, all within a reasonable period. The “reasonableness” of the duration of administrative activity is determined case by case, based on various factors, such as the technical complexity of the administrative matter, the amount of evidence to be taken, or the degree to which the challenged act affects a person or the environment. It follows that there is no strict right to constitutional enforcement of deadlines, but rather a right to constitutional review of those actions of the Administration for which there are no sufficient grounds to justify the time taken to resolve an administrative request.\n\nVI.- THE SPECIFIC CASE. In this case, the petitioner states that a building with several apartments adjacent to the petitioner’s home affects the foundations of the home and causes problems related to wastewater, leaks, and waste disposal, posing risks to health and the environment. The petitioner states that since 2022, various requests have been submitted to the Municipality of Alajuelita seeking municipal intervention, cessation and closure of the works, their eventual demolition, and closure of windows that overlook the petitioner’s property. The petitioner alleges, however, that these requests have not been finally answered and that no measures have been taken regarding the complaint, so the situation persists.\n\nNow, although it is true that the authorities of the Municipality of Alajuelita have, within their powers, taken certain actions directed at addressing the reported situation and issued resolutions ordering suspension and subsequent demolition of the structures, there is no evidence that the latter was notified to the amparo petitioner. Nor is there evidence that the order to demolish the illegal buildings was ultimately carried out, despite the complaints dating back to 2022. Since it has not been established that the petitioner knows the outcome of the request submitted, or the dates on which the illegal buildings will ultimately be demolished, the petitioner’s right to prompt and effective justice is considered violated. Accordingly, the application should be granted.\n\nVII.- SEPARATE NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the Administrative-Litigation Courts, not by this Chamber. However, with the recent enactment of Law n.° 9097, Law Regulating the Right of Petition, it has been established that this right may be protected judicially through the amparo proceeding set out in Article 32 of the Law on Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of precedent; under Article 7 of its Law, this Court alone defines its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptions that may be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases, for the reasons this Court has given (judgment N° 2008-02545, issued at 8:55 a.m. on 22 February 2008), jurisdiction lies with the Judges of the administrative-litigation jurisdiction. This is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable legal provisions, based on a logical, systemic, and teleological interpretation of the legal system.\n\nVIII.- SEPARATE NOTE BY JUSTICE SALAZAR ALVARADO. In environmental matters, it is my view that, if the Public Administration has already intervened, the administrative-litigation jurisdiction is responsible for hearing and resolving the matter. However, I do hear the merits when other rights of the people affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy an environment that is healthy and free from contamination (Article 50 of the Political Constitution), as in this case, where the petitioner states that various complaints concerning illegal construction on the property adjoining the petitioner’s have been filed since 2022, alleging structural impacts, leaks, and risks to the petitioner’s property and family, which have not been finally resolved.\n\nIX.- DOCUMENTATION SUBMITTED TO THE EXPEDIENTE. The parties are advised that if they submitted any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the clerk’s office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulations on the Electronic Expediente before the Judiciary,” approved by the Full Court at Session N° 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin N° 19 on 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at Session N° 43-12 held on 3 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe amparo proceeding is granted. María del Rosario Siles Fernández, in her capacity as Mayor of the Municipality of Alajuelita, or whoever holds that office, is ordered, within a period of THREE MONTHS from notification of this judgment, to issue the necessary orders within the scope of her powers so that the complaint submitted by the petitioner on 01 August 2022 is finally resolved and the decision notified, and, within that same period, to carry out demolition of the illegal structures if appropriate under law and if no cause outside the scope of these proceedings prevents it. The Municipality of Alajuelita is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be assessed in enforcement proceedings before the administrative-litigation jurisdiction. The respondent authorities are warned that failure to comply with the said order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law on this jurisdiction, anyone who receives an order to be complied with or enforced, issued in an amparo proceeding, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty.
