  "body_es_text": "\n\nExp: 26-026807-0007-CO \n\nRes. Nº 2026035684\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cinco minutos del diecisiete de setiembre de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente No. 26-026807-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTERIO DE SEGURIDAD PÚBLICA.\n\nResultando:\n\n1.- Por escrito incorporado al expediente electrónico el 25 de julio de 2026, el recurrente interpone recurso de amparo contra el MINISTERIO DE SEGURIDAD PÚBLICA. Manifiesta que un grupo de campesinos ingresaron a las fincas inscritas bajo los folios reales 260430 y 355095, ubicadas en [...], de forma pacífica, sin violencia, pública y continua, desarrollando actividades propias de subsistencia, sin alterar el orden público. Explica que, las fincas mencionadas pertenecen registralmente a Life Forestry Costa Rica S.A., sociedad vinculada al grupo empresarial Life Forestry Switzerland AG, el cual ha sido objeto de procesos de insolvencia y liquidación en Suiza, así como de cuestionamientos e investigaciones en distintos países europeos relacionados con su modelo de inversión forestal. Aduce que, es de conocimiento público que la sociedad matriz fue declarada en quiebra por los tribunales suizos y que autoridades europeas, entre ellas la BaFin de Alemania y el Tribunal Supremo Alemán, emitieron resoluciones relacionadas con la falta de transparencia de los contratos ofrecidos a inversionistas. Alude que, en Costa Rica no existe información pública que indique la apertura de un proceso penal masivo por fraude financiero contra la filial costarricense; sin embargo, existen procesos civiles y registrales promovidos por inversionistas extranjeros, quienes han solicitado medidas cautelares, embargos y anotaciones de demanda sobre las fincas inscritas a nombre de Life Forestry Costa Rica S.A., con el propósito de preservar esos bienes mientras se resuelven las controversias judiciales. Menciona que, los inversionistas afectados son principalmente ciudadanos alemanes, suizos y austriacos, quienes han organizado acciones colectivas en Europa y en Costa Rica para procurar la recuperación de sus inversiones mediante los procedimientos legales correspondientes. Arguye que, la existencia de esos litigios evidencia que la situación jurídica de las fincas no se encuentra definitivamente resuelta, por lo que cualquier actuación que implique desalojar a los campesinos antes de que exista claridad sobre el estado jurídico de los inmuebles podría ocasionar afectaciones irreparables a sus derechos fundamentales. Alega que, desde hace varias semanas, oficiales de la Fuerza Pública de Los Chiles han realizado diversas visitas al lugar donde permanecen los campesinos y, en distintas oportunidades, han manifestado verbalmente que procederán a desalojarlos del inmueble, pese a que no ban exhibido orden judicial ni administrativa que autorice dicho desalojo. Estas actuaciones generan una amenaza real e inminente contra los derechos fundamentales de las familias ocupantes, quienes viven bajo la incertidumbre de ser desalojadas sin el debido proceso. Los campesinos ban manifestado que dichas advertencias provienen de funcionarios policiales actuando en ejercicio de sus funciones, lo que constituye el acto lesivo cuya tutela constitucional. Con base en los alegatos expuestos, estima que, con las actuaciones acusadas, se están vulnerando derechos fundamentales. Solicita que se declare con lugar el recurso con las consecuencias de ley. \n\n2.- Por resolución dictada a las 17:52 horas del 28 de agosto de 2026, se dio curso al presente recurso de amparo.\n\n3.- Informa bajo juramento BETHSY Mª AIZA JUÁREZ, en su condición de JEFE DEL SUB PROCESO DE DESALOJOS ADMINISTRATIVOS DEL MINISTERIO DE SEGURIDAD PÚBLICA, quien manifiesta lo siguiente: “… PRIMERO: Respecto a los argumentos que constituyen el presente recurso, procedo a informar que el Sub Proceso de Desalojos Administrativos de este Ministerio no ha instruido ni dictado el desalojo referido por el recurrente. SEGUNDO: En aras de tener un panorama claro sobre la situación que expone el amparado, se solicitó información a la Delegación Policial de Los Chiles; respondiendo el señor Víctor López López, en su condición de jefe de la misma, que revisada la información concerniente a las solicitudes de desalojo administrativos y judiciales, llevados para tales efectos por la oficina de Operaciones de la Delegación Policial de los Chiles (incluye los distritos de todo el cantón de los Chiles, además de Cutris y Pocosol de San Carlos) hasta la fecha no han tramitado desalojo administrativo ni judicial o puesta en posesión sobre los inmuebles 260430-000 y 355095-000 que les pertenecen a Life Forestry Costa Rica S.A. Reitera el jefe de la delegación policial que no han realizado actuaciones que atenten ni lesionen los derechos del recurrente o las demás personas que ocupan dichos bienes. TERCERO: Adicionalmente ha indicado que desconoce el decir del amparado sobre los procesos de insolvencia y liquidación que se haya interpuesto contra Life Forestry Costa Rica S.A., así como los cuestionamientos e investigaciones indicados por el recurrente y mucho menos sobre los procesos de quiebra que se tramitan a nivel internacional. CUARTO: Señala, además, que fechas 06, 26, 27 y 28 de julio así como los días 10, 14, 15, 17 y 21 de agosto, todos del 2026, la Fuerza Pública de los Chiles atendió varios incidentes en los inmuebles mencionados pero por delitos ambientales como la tala y transporte ilegal de recursos maderables, alteración del orden público, entre otros, pero en ningún caso se ha insinuado la futura ejecución de desalojos sobre los inmuebles. QUINTO: Que la Autoridad Policial de los Chiles no ha ejecutado diligencia alguna que atente o lesione los derechos del amparado y demás ocupantes; además aclara que, ante el trámite de ejecución de desalojos, sean administrativos o judiciales, de forma previa, requieren a la parte interesada los documentos registrales, planos catastrados e inclusive la participación de peritos -cuando sea necesario- con el fin de determinar la ubicación cierta y real del inmueble a desalojar. Inclusive, cuando el asunto lo amerite realizan las coordinaciones necesarias para garantizar la participación directa de autoridades administrativas e instituciones de bien social, sea Patronato Nacional de la Infancia (PANI), Instituto Mixto de Ayuda Social (IMAS), Consejo Nacional de la Persona Adulto Mayor (CONAPAM), Consejo Nacional para Personas con Discapacidad (CONAPDIS) y con ello garantizar que las personas que se pretenden desalojar no queden en una situación de posible vulnerabilidad social. SEXTO: Como puede apreciarse, ningún desalojo contra las personas amparadas ha sido ordenado por el Sub Proceso de Desalojos Administrativos de este Ministerio, ni ha sido ejecutado por la Delegación Policial de Los Chiles; por lo que, no se han violentado los derechos fundamentales del amparado ni de las otras personas que ocupen dichos inmuebles, como lo asegura en la interposición de esta acción.”.\n\n4.- Informa bajo juramento VÍCTOR LÓPEZ LÓPEZ, en su condición de JEFE DE LA DELEGACIÓN POLICIAL DE LOS CHILES DE LA REGIÓN ONCEAVA, CHOROTEGA NORTE DEL MINISTERIO DE SEGURIDAD PÚBLICA, quien señala lo siguiente: “… Primero. En mi condición de jefe de la Delegación Policial de Los Chiles desconozco la condición en la que un grupo de personas se encuentran ocupando en condición precaria inmuebles propiedad de Life Forestry Sociedad Anónima inscritos en el registro Público de la Propiedad a folios 2-00260430-000 y 2-00355095-000, como tampoco es de mi conocimiento las actividades desarrolladas sobre estos inmuebles por sus ocupantes. Segundo. Que se ha revisado la información concerniente a solicitudes de desalojos administrativos y judiciales, llevados para tales efectos por la oficina de Operaciones de la Delegación Policial de Los Chiles (incluye los distritos de todo el cantón de Los Chiles, además los distritos Cutris y Pocosol de San Carlos) y a la fecha no se está tramitando solicitud alguna de desalojo o puesta en posesión de los inmuebles inscritos a folios reales 2-00260430-000 y 2-00355095-000; propiedad de Life Forestry Costa Rica S.A. Tercero. En virtud de que no existe solicitud alguna de desalojo sea administrativo o judicial y solicitud de puesta en posesión en la que se involucren inmuebles ubicados en Las Banderas Pocosol. San Carlos en Propiedad de Life Forestry Sociedad Anónima, la Fuerza Pública de Los Chiles no ha ejecutado diligencia alguna relacionada a la realización del desalojo alegado por el recurrente. Cuarto. Desconozco el decir del recurrente en cuanto a procesos de insolvencia y liquidación que se hayan instaurado contra LIFE FORESTRY COSTA RICA SOCIEDAD ANÓNIMA, cédula jurídica 3-101-436260, así como los cuestionamientos e investigaciones indicados por el amparado, o procesos de quiebra establecidos a nivel internacional contra dicha sociedad (Life Forestry Switzerland AG), y o procesos civiles en los que se hayan otorgado medida cautelar alguna. Quinto. En fechas 06, 26, 27 y 28 de Julio de 2026; 10, 14, 15, 17 y 21 de agosto de 2026, la Fuerza Pública de Los Chiles le ha correspondido la atención de incidentes del Sistema de Emergencias 9.1.1, relacionados a inmuebles inscritos en el Registro Público de la Propiedad según folio reales 2-00260430-000 y 2-00355095-000, sin embargo, dichos incidentes se encontraban relacionados a delitos ambientales como tala y transporte ilegal de recursos maderables, alteración al orden público, entre otros. En ningún caso se ha indicado o siquiera insinuado la futura ejecución de desalojo en dichos inmuebles. Sexto. La Fuerza Pública de Los Chiles no ha ejecutado diligencia alguna que atente y lesione los derechos de los recurrentes o sus familias, asimismo, en todos los desalojos en los que participa la Fuerza Pública de Los Chiles, previo a su ejecución se realizan las diligencias de coordinación necesarias para garantizar la participación directa de autoridades administrativas e instituciones de bien social, sea Patronato Nacional de la Infancia (PANI), Instituto Mixto de Ayuda Social (IMAS), Consejo Nacional de la Persona Adulto Mayor (CONAPAM), Consejo Nacional para Personas con Discapacidad (CONAPDIS) y con ello garantizar que las personas a desalojar no queden en una situación de posible vulnerabilidad social. Sétimo. La Fuerza Pública de Los Chiles no se encuentra realizando diligencias de desalojo en inmuebles propiedad de Life Forestry Sociedad Anónima e inscritos en el Registro Público de la Propiedad según folio reales 2-00260430-000 y 2-00355095-000. Como puede apreciarse, ningún desalojo contra el recurrente ha sido ordenado, ni ejecutado por parte de la Fuerza Pública de Los Chiles en dichos inmuebles, por lo que, no se han violentado los derechos fundamentales del recurrente, como lo aseguran en la interposición de esta acción.”.\n\n5.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta la Magistrada Hess Herrera; y,\n\nConsiderando:\n\nI.- OBJETO DEL RECURSO. La parte recurrente interpone recurso de amparo contra el Ministerio de Seguridad Pública, al considerar que oficiales de la Fuerza Pública de Los Chiles han amenazado con desalojar a un grupo de campesinos que ocupan las fincas 260430 y 355095, sin exhibir orden judicial ni administrativa. Sostiene que ello constituye una amenaza real e inminente a sus derechos fundamentales y solicita que se declare con lugar el recurso.\n\nII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estima como debidamente demostrado el siguiente hecho, sea porque así ha sido acreditado o bien porque el recurrido haya omitido referirse a ello según lo prevenido en el auto inicial:\n\na) El 06 de julio de 2026, la Fuerza Pública de Los Chiles atendió un incidente relacionado con los inmuebles inscritos bajo los folios reales 2-00260430-000 y 2-00355095-000, propiedad de Life Forestry Costa Rica S.A.; dicha intervención estuvo vinculada con situaciones relativas a delitos ambientales, tala y transporte ilegal de recursos maderables, alteración del orden público u otros hechos similares, sin que se indicara o insinuara la futura ejecución de un desalojo (ver informe rendido bajo juramento y prueba adjunta).\n\nb) Los días 26, 27 y 28 de julio de 2026, la Fuerza Pública de Los Chiles atendió diversos incidentes relacionados con los inmuebles inscritos bajo los folios reales 2-00260430-000 y 2-00355095-000, vinculados con delitos ambientales, tala y transporte ilegal de recursos maderables, alteración del orden público u otros hechos similares, sin que en esas actuaciones se indicara o insinuara la futura ejecución de un desalojo (ver informe rendido bajo juramento y prueba adjunta).\n\nc) El 10 de agosto de 2026, la Fuerza Pública de Los Chiles atendió un incidente relacionado con los inmuebles inscritos bajo los folios reales 2-00260430-000 y 2-00355095-000, sin que dicha actuación estuviera relacionada con la ejecución o preparación de un desalojo (ver informe rendido bajo juramento y prueba adjunta).\n\nd) Los días 14, 15, 17 y 21 de agosto de 2026, la Fuerza Pública de Los Chiles atendió diversos incidentes vinculados con los inmuebles inscritos bajo los folios reales 2-00260430-000 y 2-00355095-000, relacionados con delitos ambientales, tala y transporte ilegal de recursos maderables, alteración del orden público u otros hechos similares, sin que en ninguno de ellos se indicara o insinuara la futura ejecución de un desalojo (ver informe rendido bajo juramento y prueba adjunta).\n\ne) Revisados los registros de la oficina de Operaciones de la Delegación Policial de Los Chiles, no se encontraba en trámite solicitud alguna de desalojo administrativo, judicial o de puesta en posesión respecto de los inmuebles inscritos bajo los folios reales 2-00260430-000 y 2-00355095-000, propiedad de Life Forestry Costa Rica S.A. (ver informe rendido bajo juramento y prueba adjunta).\n\nf) Según el Sub Proceso de Desalojos Administrativos del Ministerio de Seguridad Pública no había instruido ni dictado orden de desalojo alguna respecto de los inmuebles indicados, ni la Delegación Policial de Los Chiles había ejecutado diligencia de desalojo relacionada con estos (ver informe rendido bajo juramento y prueba adjunta).\n\ng) La Fuerza Pública de Los Chiles no se encuentra realizando diligencias de desalojo respecto de los inmuebles inscritos bajo los folios reales 2-00260430-000 y 2-00355095-000, ni ha ejecutado actuaciones dirigidas a desalojar al recurrente o a las demás personas ocupantes de esos bienes (ver informe rendido bajo juramento y prueba adjunta).\n\n III.- SOBRE EL CASO CONCRETO. Del análisis de los hechos acreditados, de los informes rendidos bajo juramento y de la prueba incorporada al expediente, este Tribunal estima que el recurso debe ser declarado sin lugar.\n\n En el presente asunto, la parte recurrente sostiene que funcionarios de la Fuerza Pública de Los Chiles habrían realizado diversas visitas a los inmuebles inscritos bajo los folios reales 2-00260430-000 y 2-00355095-000, ocupados por un grupo de campesinos y que, en esas oportunidades, habrían manifestado verbalmente que procederían a desalojarlos, pese a no existir una orden judicial o administrativa que autorizara tal actuación. A partir de ello, considera configurada una amenaza real e inminente a los derechos fundamentales de las personas ocupantes.\n\n Sin embargo, de los elementos probatorios incorporados al expediente no se acredita la existencia de una orden de desalojo, administrativa o judicial, ni tampoco la realización de actuaciones dirigidas a ejecutar o preparar materialmente un desalojo respecto de los inmuebles referidos. Por el contrario, se tuvo por demostrado que, revisados los registros de la oficina de Operaciones de la Delegación Policial de Los Chiles, no se encontraba en trámite solicitud alguna de desalojo administrativo, judicial o de puesta en posesión respecto de esos bienes. Asimismo, el Sub Proceso de Desalojos Administrativos del Ministerio de Seguridad Pública informó bajo juramento que no había instruido ni dictado orden de desalojo alguna, mientras que la Delegación Policial de Los Chiles indicó que no había ejecutado diligencias con esa finalidad.\n\n Ciertamente, consta que funcionarios de la Fuerza Pública atendieron diversos incidentes en esos inmuebles los días 6, 26, 27 y 28 de julio, así como 10, 14, 15, 17 y 21 de agosto de 2026. No obstante, tales intervenciones estuvieron relacionadas con incidentes vinculados con delitos ambientales, tala y transporte ilegal de recursos maderables, alteración del orden público u otras situaciones semejantes, sin que se haya acreditado que, con ocasión de esas actuaciones, se hubiera comunicado, insinuado o ejecutado algún desalojo.\n\n Así las cosas, no existe prueba directa ni indiciaria suficiente que permita tener por demostrada la amenaza denunciada por la parte recurrente. La sola afirmación de que determinados funcionarios policiales habrían anunciado verbalmente un eventual desalojo, sin otros elementos objetivos que la respalden y frente a los informes rendidos bajo juramento que descartan la existencia de una orden, trámite o actuación encaminada a ese propósito, no resulta suficiente para tener por configurada una amenaza cierta, concreta e inminente susceptible de tutela en esta vía constitucional. La jurisdicción de amparo puede intervenir frente a amenazas a derechos fundamentales, pero estas deben encontrarse sustentadas en circunstancias objetivas que permitan apreciar razonablemente su existencia, y no en una posibilidad meramente hipotética o eventual.\n\n En consecuencia, al no comprobarse que exista orden de desalojo alguna, ni actuación material o preparatoria dirigida a desalojar al recurrente o a las demás personas ocupantes de los inmuebles mencionados, no se advierte una amenaza o afectación actual a los derechos fundamentales invocados. Por ende, lo procedente es declarar sin lugar el recurso, como en efecto se dispone.\n\nIV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "\n\nExp: 26-026807-0007-CO\n\nRes. Nº 2026035684\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:35 a.m. on 17 September 2026.\n\nAmparo proceeding recorded under expediente No. 26-026807-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the MINISTRY OF PUBLIC SECURITY.\n\nBackground:\n\n1.- In a document added to the electronic expediente on 25 July 2026, the applicant files an amparo proceeding against the MINISTRY OF PUBLIC SECURITY. The applicant states that a group of farmworkers entered the farms registered under folios reales 260430 and 355095, located in [...], peacefully, without violence, openly and continuously, engaging in activities necessary for their subsistence without disturbing public order. The applicant explains that the farms belong in the registry to Life Forestry Costa Rica S.A., a company linked to the Life Forestry Switzerland AG corporate group, which has been subject to insolvency and liquidation proceedings in Switzerland, as well as scrutiny and investigations in various European countries concerning its forestry investment model. The applicant alleges that it is publicly known that the parent company was declared bankrupt by the Swiss courts and that European authorities, including Germany’s BaFin and the German Supreme Court, issued decisions concerning the lack of transparency in contracts offered to investors. The applicant notes that there is no public information in Costa Rica indicating that large-scale criminal proceedings for financial fraud have been opened against the Costa Rican subsidiary; however, foreign investors have brought civil and registry proceedings, seeking interim measures, attachments, and notices of claim against the farms registered in the name of Life Forestry Costa Rica S.A., with the aim of preserving those assets while the judicial disputes are resolved. The applicant mentions that the affected investors are mainly German, Swiss, and Austrian citizens who have organized collective actions in Europe and Costa Rica to seek recovery of their investments through the applicable legal procedures. The applicant argues that the existence of those disputes shows that the legal status of the farms has not been definitively resolved, and that any action to evict the farmworkers before the legal status of the properties is clear could cause irreparable harm to their fundamental rights. The applicant alleges that, for several weeks, officers of the Los Chiles Public Force have made several visits to the place where the farmworkers remain and, on different occasions, have verbally stated that they would evict them from the property, even though they have not shown a judicial or administrative order authorizing the eviction. These actions pose a real and imminent threat to the fundamental rights of the occupying families, who live with the uncertainty of being evicted without due process. The farmworkers have stated that these warnings came from police officers acting in the performance of their duties, which constitutes the harmful act for which constitutional protection is sought. Based on the allegations presented, the applicant considers that the challenged actions violate fundamental rights. The applicant requests that the amparo proceeding be granted, with the legal consequences that follow.\n\n2.- By resolution issued at 17:52 on 28 August 2026, this amparo proceeding was admitted for processing.\n\n3.- BETHSY Mª AIZA JUÁREZ, in her capacity as HEAD OF THE ADMINISTRATIVE EVICTIONS SUBPROCESS OF THE MINISTRY OF PUBLIC SECURITY, reports under oath as follows: “… FIRST: Regarding the arguments underlying this proceeding, I report that this Ministry’s Administrative Evictions Subprocess has neither initiated nor ordered the eviction mentioned by the applicant. SECOND: To obtain a clear picture of the situation described by the amparo applicant, information was requested from the Los Chiles Police Station. Its chief, Víctor López López, responded that, after reviewing the information concerning administrative and judicial eviction requests handled for that purpose by the Operations Office of the Los Chiles Police Station (which includes the districts throughout the canton of Los Chiles, as well as Cutris and Pocosol in San Carlos), no administrative or judicial eviction, or transfer of possession, had been processed to date with respect to properties 260430-000 and 355095-000, which belong to Life Forestry Costa Rica S.A. The police station chief reiterates that they have taken no actions that threaten or harm the rights of the applicant or the other people occupying those properties. THIRD: He further indicated that he was unaware of the applicant’s statements regarding insolvency and liquidation proceedings brought against Life Forestry Costa Rica S.A., or the scrutiny and investigations mentioned by the applicant, and even less so of bankruptcy proceedings conducted internationally. FOURTH: He also states that on 06, 26, 27, and 28 July, and on 10, 14, 15, 17, and 21 August, all in 2026, the Los Chiles Public Force responded to several incidents at the aforementioned properties involving environmental offenses such as illegal logging and transport of timber resources, disturbance of public order, among other matters, but in no case was a future eviction from the properties suggested. FIFTH: The Los Chiles Police Authority has not carried out any measure that threatens or harms the rights of the amparo applicant and the other occupants. It further clarifies that, before proceeding with an eviction, whether administrative or judicial, it first requires the interested party to provide registry documents, cadastral plans, and even the participation of experts when necessary, in order to determine the precise and actual location of the property to be evicted. When warranted, it also makes the necessary arrangements to ensure the direct participation of administrative authorities and social welfare institutions, namely the National Child Welfare Agency (PANI), the Joint Social Assistance Institute (IMAS), the National Council for the Elderly (CONAPAM), and the National Council for Persons with Disabilities (CONAPDIS), thereby ensuring that the people intended to be evicted are not left in a situation of potential social vulnerability. SIXTH: As can be seen, no eviction of the persons protected by the amparo has been ordered by this Ministry’s Administrative Evictions Subprocess or carried out by the Los Chiles Police Station. Therefore, the fundamental rights of the amparo applicant or the other people occupying those properties have not been violated, contrary to what the filing of this action asserts.”\n\n4.- VÍCTOR LÓPEZ LÓPEZ, in his capacity as CHIEF OF THE LOS CHILES POLICE STATION, ELEVENTH REGION, NORTHERN CHOROTEGA, OF THE MINISTRY OF PUBLIC SECURITY, reports under oath as follows: “… First. In my capacity as chief of the Los Chiles Police Station, I am unaware of the circumstances under which a group of people are occupying, on a precarious basis, properties belonging to Life Forestry Sociedad Anónima, registered in the Public Property Registry under folios 2-00260430-000 and 2-00355095-000. Nor am I aware of the activities carried out by their occupants on those properties. Second. The information concerning administrative and judicial eviction requests handled for that purpose by the Operations Office of the Los Chiles Police Station (which includes the districts throughout the canton of Los Chiles, as well as the districts of Cutris and Pocosol in San Carlos) has been reviewed. To date, no request for eviction or transfer of possession is being processed for the properties registered under folios reales 2-00260430-000 and 2-00355095-000, owned by Life Forestry Costa Rica S.A. Third. Since there is no request for an administrative or judicial eviction, or for transfer of possession, involving properties located in Las Banderas, Pocosol, San Carlos, owned by Life Forestry Sociedad Anónima, the Los Chiles Public Force has not carried out any measure related to the eviction alleged by the applicant. Fourth. I am unaware of the applicant’s statements concerning insolvency and liquidation proceedings brought against LIFE FORESTRY COSTA RICA SOCIEDAD ANÓNIMA, corporate ID 3-101-436260, or the scrutiny and investigations mentioned by the amparo applicant, or bankruptcy proceedings instituted internationally against that company (Life Forestry Switzerland AG), and/or civil proceedings in which any interim measure was granted. Fifth. On 06, 26, 27, and 28 July 2026, and on 10, 14, 15, 17, and 21 August 2026, the Los Chiles Public Force was responsible for responding to incidents reported through the 9.1.1 Emergency System concerning properties registered in the Public Property Registry under folios reales 2-00260430-000 and 2-00355095-000. However, those incidents concerned environmental offenses such as illegal logging and transport of timber resources, disturbance of public order, among other matters. In no case was a future eviction from those properties stated or even suggested. Sixth. The Los Chiles Public Force has not carried out any measure that threatens or harms the rights of the applicants or their families. Furthermore, in every eviction in which the Los Chiles Public Force participates, the necessary arrangements are made before its execution to ensure the direct participation of administrative authorities and social welfare institutions, namely the National Child Welfare Agency (PANI), the Joint Social Assistance Institute (IMAS), the National Council for the Elderly (CONAPAM), and the National Council for Persons with Disabilities (CONAPDIS), thereby ensuring that the people to be evicted are not left in a situation of potential social vulnerability. Seventh. The Los Chiles Public Force is not carrying out eviction measures on properties owned by Life Forestry Sociedad Anónima and registered in the Public Property Registry under folios reales 2-00260430-000 and 2-00355095-000. As can be seen, no eviction of the applicant has been ordered or carried out by the Los Chiles Public Force on those properties. Therefore, the applicant’s fundamental rights have not been violated, contrary to what the filing of this action asserts.”\n\n5.- The legal requirements have been observed in the proceedings followed.\n\nJustice Hess Herrera drafted this decision; and,\n\nReasons:\n\nI.- SUBJECT OF THE AMPARO PROCEEDING. The applicant files an amparo proceeding against the Ministry of Public Security, on the grounds that officers of the Los Chiles Public Force threatened to evict a group of farmworkers occupying farms 260430 and 355095 without showing a judicial or administrative order. The applicant maintains that this constitutes a real and imminent threat to their fundamental rights and requests that the amparo proceeding be granted.\n\nII.- FACTS FOUND. For purposes of deciding this matter, the following fact is considered duly established, either because it has been proven or because the respondent failed to address it, as required in the initial order:\n\na) On 06 July 2026, the Los Chiles Public Force responded to an incident concerning the properties registered under folios reales 2-00260430-000 and 2-00355095-000, owned by Life Forestry Costa Rica S.A. That intervention was connected with matters involving environmental offenses, logging and illegal transport of timber resources, disturbance of public order, or other similar events, and no future eviction was stated or suggested (see report made under oath and attached evidence).\n\nb) On 26, 27, and 28 July 2026, the Los Chiles Public Force responded to various incidents concerning the properties registered under folios reales 2-00260430-000 and 2-00355095-000. These were connected with environmental offenses, logging and illegal transport of timber resources, disturbance of public order, or other similar events, and no future eviction was stated or suggested during those actions (see report made under oath and attached evidence).\n\nc) On 10 August 2026, the Los Chiles Public Force responded to an incident concerning the properties registered under folios reales 2-00260430-000 and 2-00355095-000, and that action was not related to carrying out or preparing an eviction (see report made under oath and attached evidence).\n\nd) On 14, 15, 17, and 21 August 2026, the Los Chiles Public Force responded to various incidents concerning the properties registered under folios reales 2-00260430-000 and 2-00355095-000. These involved environmental offenses, logging and illegal transport of timber resources, disturbance of public order, or other similar events, and none involved a future eviction being stated or suggested (see report made under oath and attached evidence).\n\ne) A review of the records of the Operations Office of the Los Chiles Police Station showed that no request for administrative or judicial eviction, or transfer of possession, was being processed with respect to the properties registered under folios reales 2-00260430-000 and 2-00355095-000, owned by Life Forestry Costa Rica S.A. (see report made under oath and attached evidence).\n\nf) According to the Administrative Evictions Subprocess of the Ministry of Public Security, no eviction order concerning the aforementioned properties had been initiated or issued, nor had the Los Chiles Police Station carried out any eviction measure concerning them (see report made under oath and attached evidence).\n\ng) The Los Chiles Public Force is not carrying out eviction measures concerning the properties registered under folios reales 2-00260430-000 and 2-00355095-000, and has taken no action directed at evicting the applicant or the other people occupying those properties (see report made under oath and attached evidence).\n\nIII.- THE SPECIFIC CASE. Upon analyzing the established facts, the reports made under oath, and the evidence added to the expediente, this Court considers that the amparo proceeding must be dismissed.\n\nIn this matter, the applicant maintains that officials of the Los Chiles Public Force allegedly made several visits to the properties registered under folios reales 2-00260430-000 and 2-00355095-000, occupied by a group of farmworkers, and on those occasions allegedly stated verbally that they would evict them, despite the absence of a judicial or administrative order authorizing such action. On that basis, the applicant considers that there is a real and imminent threat to the fundamental rights of the occupants.\n\nHowever, the evidence added to the expediente does not establish that an administrative or judicial eviction order exists, or that actions were taken to carry out or materially prepare an eviction from the aforementioned properties. On the contrary, it was established that, after reviewing the records of the Operations Office of the Los Chiles Police Station, no request for administrative or judicial eviction, or transfer of possession, was being processed with respect to those properties. In addition, the Administrative Evictions Subprocess of the Ministry of Public Security reported under oath that it had neither initiated nor issued an eviction order, while the Los Chiles Police Station indicated that it had carried out no measures for that purpose.\n\nIt is true that officers of the Public Force responded to various incidents at those properties on 6, 26, 27, and 28 July, and on 10, 14, 15, 17, and 21 August 2026. However, those interventions concerned incidents involving environmental offenses, logging and illegal transport of timber resources, disturbance of public order, or other similar situations. It has not been established that any eviction was communicated, suggested, or carried out in connection with those actions.\n\nAccordingly, there is no direct evidence or sufficient circumstantial evidence to establish the threat alleged by the applicant. The mere assertion that certain police officers allegedly announced verbally that an eviction might take place, without other objective evidence to support it and in the face of the reports made under oath denying the existence of any order, proceeding, or action directed toward that purpose, is insufficient to establish a certain, concrete, and imminent threat that may be remedied through this constitutional procedure. The amparo jurisdiction may intervene in response to threats to fundamental rights, but those threats must be supported by objective circumstances that make it reasonable to find that they exist, rather than being merely hypothetical or possible.\n\nConsequently, since it has not been established that an eviction order exists or that any action has been taken, or prepared, to evict the applicant or the other people occupying the aforementioned properties, there is no apparent current threat to or impairment of the fundamental rights invoked. Therefore, the amparo proceeding must be dismissed, as is hereby ordered.\n\nIV.- DOCUMENTATION ADDED TO THE EXPEDIENTE. The applicant is advised that any paper document, as well as any object or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device that may have been submitted must be collected from the court office within a maximum of 30 working days counted from service of this judgment. Otherwise, any material not collected within this period will be destroyed, pursuant to the “Regulation on the Electronic Expediente before the Poder Judicial,” approved by the Full Court in session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo proceeding is dismissed. -\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
