  "body_es_text": "\n\nExp: 26-029342-0007-CO \n\nRes. Nº 2026035772\n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cinco minutos del diecisiete de setiembre de dos mil veintiseis .\n\nRecurso de amparo presentado por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE GRECIA.\n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de esta Sala a las 07:39 horas del 13 de agosto de 2026 la recurrente presenta recurso de amparo contra la Municipalidad de Grecia. Manifiesta que desde hace varios años su propiedad se encuentra afectada por un sistema de drenaje de aguas pluviales provenientes de la vía pública, las cuales son recolectadas y conducidas mediante tuberías y estructuras de drenaje hasta un punto cercano a su inmueble, donde finalmente descargan sobre su terreno, provocando erosión y lavado del suelo. Indica que en el año 2019 presentó una gestión ante la Municipalidad de Grecia solicitando atención a la problemática. Refiere que, como resultado, la administración realizó una inspección y, mediante el oficio U.T.G.V./MG-268-2019 de 30 de abril de 2019, reconoció la existencia de un sistema de conducción de aguas proveniente de la calle pública que descargaba hacia un canal de tierra debido a la topografía del terreno. Asimismo, señaló la posibilidad de coordinar trabajos para mejorar la canalización de las aguas. Afirma que, pese a lo anterior, la situación no fue solucionada de forma definitiva y que las aguas continúan causando erosión en su propiedad. Añade que, ante la persistencia del problema, el 26 de mayo de 2026 presentó una nueva gestión ante la Municipalidad de Grecia, mediante el Comprobante de Trámite n.° 000939, para solicitar nuevamente la intervención de la municipalidad accionada. No obstante, reclama que a la fecha de interposición del recurso no ha recibido resolución de fondo ni respuesta formal y motivada respecto de dicho trámite, ni se le ha comunicado una solución técnica definitiva al problema, pese a que la municipalidad conoce la situación desde el año 2019. Estima lesionados sus derechos fundamentales. Solicita la intervención de esta Sala. \n\n2.- Por resolución de las 16:12 horas del 27 de agosto de 2026 se dio curso al presente amparo y se solicitó informe al alcalde y al encargado de la Unidad Técnica de Gestión Vial, ambos de la Municipalidad de Grecia (ver registro electrónico).\n\n3.-Informa bajo juramento DONALD ALBERTO QUESADA RODRÍGUEZ en su calidad de ALCALDE MUNICIPAL y CESAR SOLÓRZANO ARAYA en su calidad de Encargado (Recargo de funciones) de la Unidad Técnica de Gestión Vial (UTGV), ambos de la Municipalidad de Grecia (ver registro electrónico) en los siguientes términos: “I. SOBRE LOS HECHOS ALEGADOS POR LA RECURRENTE PRIMERO: Es cierto que las aguas pluviales provenientes de la vía pública descargan hacia la propiedad de la recurrente. Sin embargo, se aclara que esta situación obedece estrictamente a la topografía natural del terreno (por ser el punto más bajo del sector) y a la existencia de un desagüe funcional y necesario del camino público. SEGUNDO: Es cierto que en el año 2019 la administración realizó una inspección técnica (boleta N.° 2952) y emitió el oficio U.T.G.V./MG-268-2019 del 30 de abril de 2019. En dicho documento, se le informó a la señora [Nombre 001] de manera clara y motivada que el desagüe no podía cerrarse por su funcionalidad para la evacuación del caudal pluvial, indicándole la vía de solución correspondiente según nuestras competencias. TERCERO: Es cierto que el 26 de mayo de 2026 la recurrente presentó una nueva gestión mediante el Comprobante de Trámite N.° 000939. Con la lealtad procesal y buena fe que exige esta jurisdicción, reconocemos que previo a la interposición de este recurso no se había emitido una respuesta formal a dicho trámite específico. No obstante, la situación técnica de fondo es idéntica a la diagnosticada en el año 2019. Mediante el presente informe y su debida notificación, la Administración subsana esta omisión, reiterando a la recurrente el criterio técnico inalterado y dando por satisfecho el derecho de petición II. SOBRE EL FONDO DEL RECURSO A. Aplicación del artículo 20 de la Ley General de Caminos Públicos (N.° 5060): La controversia planteada se enmarca dentro del supuesto regulado en el artículo 20 de la Ley General de Caminos Públicos. Dicha norma impone al propietario colindante con el desagüe de un camino público la obligación ineludible de recibir las aguas cuando el desnivel del terreno así lo determine, y de mantener dichos desagües limpios, en perfecto estado de servicio y libres de obstáculos dentro de su fundo. El ordenamiento jurídico no le impone a la Municipalidad la obligación de intervenir o dar mantenimiento a los sistemas de conducción de aguas que se ubiquen dentro de propiedades privadas. B. Óptimo estado de la infraestructura pública: Según consta en el criterio técnico emitido mediante oficio MG-UTGV-CS0119-2026, la infraestructura pública de recolección y conducción de aguas pluviales asociada a este camino se encuentra en buen estado y en pleno funcionamiento. La erosión y el lavado de suelo que alega la recurrente no se derivan de un deterioro, obstrucción o deficiencia en la obra pública, sino de la falta de mantenimiento del tramo del canal de tierra que se ubica estrictamente dentro de su propiedad privada, cuya tutela y conservación le corresponde de forma exclusiva a ella, a tenor de la legislación citada. C. Imposibilidad legal de invertir fondos públicos en propiedad privada: La Municipalidad de Grecia se encuentra jurídicamente inhibida para destinar recursos públicos, materiales o humanos en la mejora, mitigación o mantenimiento de infraestructura ubicada dentro de terrenos privados. Actuar en sentido contrario implicaría una violación directa al Principio de Legalidad y al bloque de legalidad presupuestaria (artículo 11 de la Constitución Política y artículo 11 de la Ley General de la Administración Pública). D. Sobre la presunta lesión al Derecho de Petición y Pronta Resolución: Si bien existió una dilación en la respuesta al trámite N.° 000939 del año 2026, la Administración Municipal hace uso del presente informe rendido ante la Sala Constitucional para comunicar material, formal y expresamente a la recurrente que la condición del desagüe se mantiene invariable respecto al estudio de 2019. Se le reitera que es un desagüe funcional que no puede cerrarse y que los trabajos internos le competen a su persona. Con ello, se subsana cualquier omisión y se restituye el derecho invocado, dejando el amparo desprovisto de interés actual en este extremo”.\n\n4.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Cruz Castro; y,\n\nConsiderando:\n\nI.- CUESTIÓN PRELIMINAR: De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la Sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción -respaldado por la mayoría de este Tribunal Constitucional-, pues se está ante la interposición de una denuncia relacionada con el riesgo de una propiedad y que presuntamente no ha sido resuelta en un plazo razonable. Aclarando lo anterior, se entra a resolver la situación concreta planteada en este recurso.\n\nII.- OBJETO DEL RECURSO: La recurrente alega que desde hace varios años su propiedad se encuentra afectada por un sistema de drenaje de aguas pluviales provenientes de la vía pública, las cuales son recolectadas y conducidas mediante tuberías y estructuras de drenaje hasta un punto cercano a su inmueble, donde finalmente descargan sobre su terreno, provocando erosión y lavado del suelo. Indica que en el año 2019 presentó una gestión ante la Municipalidad de Grecia solicitando atención a la problemática. Refiere que, como resultado, la administración realizó una inspección y, mediante el oficio U.T.G.V./MG-268-2019 de 30 de abril de 2019, reconoció la existencia de un sistema de conducción de aguas proveniente de la calle pública que descargaba hacia un canal de tierra debido a la topografía del terreno. Asimismo, señaló la posibilidad de coordinar trabajos para mejorar la canalización de las aguas. Afirma que, pese a lo anterior, la situación no fue solucionada de forma definitiva y que las aguas continúan causando erosión en su propiedad. Añade que, ante la persistencia del problema, el 26 de mayo de 2026 presentó una nueva gestión ante la Municipalidad de Grecia, mediante el Comprobante de Trámite n.° 000939, para solicitar nuevamente la intervención de la municipalidad accionada. No obstante, reclama que a la fecha de interposición del recurso no ha recibido resolución de fondo ni respuesta formal y motivada respecto de dicho trámite, ni se le ha comunicado una solución técnica definitiva al problema, pese a que la municipalidad conoce la situación desde el año 2019. \n\nIII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos:\n\na) Que en fecha 26 de mayo de 2026 la recurrente presentó una denuncia mediante el Comprobante de Trámite n.° 000939, para solicitar nuevamente la intervención de la municipalidad en cuanto al OFICIO U.T.G.V./MG-268-2019 DEL 30 DE ABRIL DE 2019 (ver informe de la autoridad recurrida).\n\nb) Que en fecha 01 de setiembre de 2026 se notificó la resolución de curso a la autoridad recurrida (ver acta de notificación).\n\nc) Que mediante oficio MG-UTGV-CS-0119-2026 de fecha 03 de Setiembre de 2026 la Unidad Técnica de Gestión Vial de la Municipalidad de Grecia le indicó al Alcalde Municipal “Asunto: “Criterio técnico UTGV con respecto al Recurso de Amparo – Expediente N.° 26-029342-0007-CO” En atención y análisis del proceso de RECURSO DE AMPARO del expediente N°26-029342-0007-CO me permito referirme a la forma y fondo técnico en los siguientes puntos: I. SOBRE LOS HECHOS Y EL OBJETO DEL RECURSO La recurrente [Nombre 001] manifiesta que su propiedad se ve afectada por aguas pluviales provenientes de la vía pública, las cuales son conducidas mediante tubería hasta un punto cercano a su inmueble donde descargan, generando erosión y lavado de suelo. Indica que en el año 2019 gestionó ante esta Municipalidad una atención a la problemática, donde como resultado de la misma la administración realizó una inspección técnica, y que mediante el oficio U.T.G.V./MG-268-2019 del 30 de abril de 2019 se le informó de la situación. Añade que el 26 de mayo de 2026 presentó una nueva gestión (Comprobante de Trámite N.° 000939) sin que a la fecha de interposición del recurso hubiera recibido respuesta formal. Sobre el particular, esta Administración confirma que los hechos descritos corresponden, en su sustancia técnica, a la misma situación diagnosticada y comunicada a la recurrente desde el año 2019, sin que se trate de una condición nueva o distinta. II. SOBRE EL MARCO JURÍDICO APLICABLE: ARTÍCULO 20 DE LA LEY GENERAL DE CAMINOS PÚBLICOS El caso planteado corresponde al supuesto regulado en el artículo 20 de la Ley General de Caminos Públicos, N.° 5060, el cual dispone: \"ARTÍCULO 20.- Todos los poseedores de bienes raíces, por cualquier título, están obligados a recibir y dejar discurrir dentro de sus predios, las aguas de los caminos cuando así lo determine el desnivel del terreno y, cuando sus fundos estén inmediatos a los desagües de un camino, deberán mantener estos desagües limpios, en perfecto estado de servicio y libres de obstáculos. El Ministerio o las Municipalidades mandarán a ejecutar el trabajo y cobrarán el trabajo más el cincuenta por ciento (50%) de recargo, si esta obligación no se cumpliere. (...)\" De la norma transcrita se desprende que el ordenamiento jurídico impone al propietario colindante con el desagüe de un camino público la obligación de recibir esas aguas y de mantener limpio y en buen estado el punto de descarga dentro de su propio predio, previendo incluso que, ante el incumplimiento de dicha obligación, sea la propia Administración quien ejecute el trabajo con cargo al propietario, más un recargo del 50%. La norma no impone a la Municipalidad la obligación de intervenir o dar mantenimiento dentro de propiedad privada por iniciativa propia y con fondos públicos. III. SOBRE EL OFICIO U.T.G.V./MG-268-2019 DEL 30 DE ABRIL DE 2019 En atención a la boleta N.° 2952, recibida el 04 de marzo de 2019, la UTGV realizó una inspección en el sitio y constató que se trata de un corte de agua de la calle pública que atraviesa el terreno de la recurrente por la colindancia con el vecino superior, con tubería subterránea a lo largo de aproximadamente 20 metros, la cual desfoga en un canal de tierra formado naturalmente por la topografía del terreno, al ser este el punto más bajo del sector. En dicho oficio se indicó expresamente a la señora [Nombre 001] que ese corte de agua no puede cerrarse, por tratarse de un desagüe funcional del camino público que libera el caudal recolectado en época de lluvias. De lo anterior queda acreditado que, desde el año 2019, la Administración diagnosticó técnicamente la situación, informó de manera clara y motivada a la recurrente, y le indicó la vía de solución disponible dentro del marco de sus competencias. IV. SOBRE EL TRÁMITE N.° 000939 DEL 26 DE MAYO DE 2026 Este departamento reconoce, con la lealtad y buena fe que debe caracterizar la información técnica que sustentará el informe que esta Alcaldía rendirá bajo juramento ante la Sala Constitucional, que no se emitió una respuesta formal y expresa a la gestión presentada por la recurrente mediante el Comprobante de Trámite N.° 000939. No obstante, se aclara que dicha omisión no obedeció a un cambio en la situación de fondo, la cual —según lo constatado por esta misma Administración— es idéntica a la ya diagnosticada y comunicada mediante el oficio U.T.G.V./MG-268-2019 del año 2019. Con el fin de subsanar dicha omisión y en cumplimiento del deber de responder de forma expresa las gestiones de los administrados, se comunica formalmente a la recurrente, por medio del presente informe, que la condición técnica del corte de agua se mantiene conforme a lo indicado desde 2019: se trata de un desagüe funcional de la vía pública que no puede cerrarse, y cuyo mantenimiento dentro de la propiedad privada corresponde a la persona propietaria conforme al artículo 20 de la Ley General de Caminos Públicos. V. SOBRE EL ESTADO DE LA INFRAESTRUCTURA PÚBLICA Se informa a esta Alcaldía que la infraestructura pública de recolección y conducción de aguas pluviales asociada al camino público en el sector se encuentra en buen estado y en pleno funcionamiento, cumpliendo su función de drenaje conforme a su diseño y a la topografía natural del terreno. La afectación que alega la recurrente no deriva de un deterioro, obstrucción o deficiencia de la obra pública, sino de la falta de mantenimiento del tramo del corte de agua que se ubica dentro de su propiedad privada, cuya atención le corresponde a ella conforme a la normativa citada. Se reitera que la Municipalidad de Grecia carece de competencia legal para invertir fondos públicos en el mantenimiento o mejora de infraestructura ubicada dentro de propiedad privada, conforme al principio de legalidad presupuestaria que rige la actuación administrativa (artículo 11 de la Constitución Política y de la Ley General de la Administración Pública). VI. PETITORIA Con fundamento en lo expuesto, se recomienda solicitarle a la Sala Constitucional declarar SIN LUGAR el presente recurso de amparo, por no existir omisión ni lesión a derecho fundamental alguno atribuible a la Municipalidad de Grecia, la cual ha actuado dentro del marco de sus competencias legales, diagnosticando oportunamente la situación desde el año 2019 e informando debidamente a la recurrente sobre la solución técnica y jurídica aplicable, subsanándose en este acto la omisión de respuesta formal al trámite N.° 000939”(ver informe de la autoridad recurrida).\n\nIV.- HECHO NO PROBADO: No se estima como probado el siguiente hecho: ÚNICO: Que la autoridad recurrida le haya brindado a la recurrente una respuesta formal de la denuncia presentada el 26 de mayo de 2026.\n\nV.- SOBRE EL CASO CONCRETO: Del informe rendido por la autoridad recurrida el cual es dado bajo la solemnidad del juramento con las consecuencias legales que ello implica se desprende que en fecha 26 de mayo de 2026 la recurrente presentó una denuncia mediante el Comprobante de Trámite n.° 000939, para solicitar nuevamente la intervención de la municipalidad en cuanto al OFICIO U.T.G.V./MG-268-2019 DEL 30 DE ABRIL DE 2019. Se verificó que en fecha 01 de setiembre de 2026 se notificó la resolución de curso a la autoridad recurrida. Quedó demostrado que mediante oficio MG-UTGV-CS-0119-2026 de fecha 03 de Setiembre de 2026 la Unidad Técnica de Gestión Vial de la Municipalidad de Grecia le indicó al Alcalde Municipal “Asunto: “Criterio técnico UTGV con respecto al Recurso de Amparo – Expediente N.° 26-029342-0007-CO” En atención y análisis del proceso de RECURSO DE AMPARO del expediente N°26-029342-0007-CO me permito referirme a la forma y fondo técnico en los siguientes puntos: I. SOBRE LOS HECHOS Y EL OBJETO DEL RECURSO La recurrente [Nombre 001] manifiesta que su propiedad se ve afectada por aguas pluviales provenientes de la vía pública, las cuales son conducidas mediante tubería hasta un punto cercano a su inmueble donde descargan, generando erosión y lavado de suelo. Indica que en el año 2019 gestionó ante esta Municipalidad una atención a la problemática, donde como resultado de la misma la administración realizó una inspección técnica, y que mediante el oficio U.T.G.V./MG-268-2019 del 30 de abril de 2019 se le informó de la situación. Añade que el 26 de mayo de 2026 presentó una nueva gestión (Comprobante de Trámite N.° 000939) sin que a la fecha de interposición del recurso hubiera recibido respuesta formal. Sobre el particular, esta Administración confirma que los hechos descritos corresponden, en su sustancia técnica, a la misma situación diagnosticada y comunicada a la recurrente desde el año 2019, sin que se trate de una condición nueva o distinta. II. SOBRE EL MARCO JURÍDICO APLICABLE: ARTÍCULO 20 DE LA LEY GENERAL DE CAMINOS PÚBLICOS El caso planteado corresponde al supuesto regulado en el artículo 20 de la Ley General de Caminos Públicos, N.° 5060, el cual dispone: \"ARTÍCULO 20.- Todos los poseedores de bienes raíces, por cualquier título, están obligados a recibir y dejar discurrir dentro de sus predios, las aguas de los caminos cuando así lo determine el desnivel del terreno y, cuando sus fundos estén inmediatos a los desagües de un camino, deberán mantener estos desagües limpios, en perfecto estado de servicio y libres de obstáculos. El Ministerio o las Municipalidades mandarán a ejecutar el trabajo y cobrarán el trabajo más el cincuenta por ciento (50%) de recargo, si esta obligación no se cumpliere. (...)\" De la norma transcrita se desprende que el ordenamiento jurídico impone al propietario colindante con el desagüe de un camino público la obligación de recibir esas aguas y de mantener limpio y en buen estado el punto de descarga dentro de su propio predio, previendo incluso que, ante el incumplimiento de dicha obligación, sea la propia Administración quien ejecute el trabajo con cargo al propietario, más un recargo del 50%. La norma no impone a la Municipalidad la obligación de intervenir o dar mantenimiento dentro de propiedad privada por iniciativa propia y con fondos públicos. III. SOBRE EL OFICIO U.T.G.V./MG-268-2019 DEL 30 DE ABRIL DE 2019 En atención a la boleta N.° 2952, recibida el 04 de marzo de 2019, la UTGV realizó una inspección en el sitio y constató que se trata de un corte de agua de la calle pública que atraviesa el terreno de la recurrente por la colindancia con el vecino superior, con tubería subterránea a lo largo de aproximadamente 20 metros, la cual desfoga en un canal de tierra formado naturalmente por la topografía del terreno, al ser este el punto más bajo del sector. En dicho oficio se indicó expresamente a la señora [Nombre 001] que ese corte de agua no puede cerrarse, por tratarse de un desagüe funcional del camino público que libera el caudal recolectado en época de lluvias. De lo anterior queda acreditado que, desde el año 2019, la Administración diagnosticó técnicamente la situación, informó de manera clara y motivada a la recurrente, y le indicó la vía de solución disponible dentro del marco de sus competencias. IV. SOBRE EL TRÁMITE N.° 000939 DEL 26 DE MAYO DE 2026 Este departamento reconoce, con la lealtad y buena fe que debe caracterizar la información técnica que sustentará el informe que esta Alcaldía rendirá bajo juramento ante la Sala Constitucional, que no se emitió una respuesta formal y expresa a la gestión presentada por la recurrente mediante el Comprobante de Trámite N.° 000939. No obstante, se aclara que dicha omisión no obedeció a un cambio en la situación de fondo, la cual —según lo constatado por esta misma Administración— es idéntica a la ya diagnosticada y comunicada mediante el oficio U.T.G.V./MG-268-2019 del año 2019. Con el fin de subsanar dicha omisión y en cumplimiento del deber de responder de forma expresa las gestiones de los administrados, se comunica formalmente a la recurrente, por medio del presente informe, que la condición técnica del corte de agua se mantiene conforme a lo indicado desde 2019: se trata de un desagüe funcional de la vía pública que no puede cerrarse, y cuyo mantenimiento dentro de la propiedad privada corresponde a la persona propietaria conforme al artículo 20 de la Ley General de Caminos Públicos. V. SOBRE EL ESTADO DE LA INFRAESTRUCTURA PÚBLICA Se informa a esta Alcaldía que la infraestructura pública de recolección y conducción de aguas pluviales asociada al camino público en el sector se encuentra en buen estado y en pleno funcionamiento, cumpliendo su función de drenaje conforme a su diseño y a la topografía natural del terreno. La afectación que alega la recurrente no deriva de un deterioro, obstrucción o deficiencia de la obra pública, sino de la falta de mantenimiento del tramo del corte de agua que se ubica dentro de su propiedad privada, cuya atención le corresponde a ella conforme a la normativa citada. Se reitera que la Municipalidad de Grecia carece de competencia legal para invertir fondos públicos en el mantenimiento o mejora de infraestructura ubicada dentro de propiedad privada, conforme al principio de legalidad presupuestaria que rige la actuación administrativa (artículo 11 de la Constitución Política y de la Ley General de la Administración Pública). VI. PETITORIA Con fundamento en lo expuesto, se recomienda solicitarle a la Sala Constitucional declarar SIN LUGAR el presente recurso de amparo, por no existir omisión ni lesión a derecho fundamental alguno atribuible a la Municipalidad de Grecia, la cual ha actuado dentro del marco de sus competencias legales, diagnosticando oportunamente la situación desde el año 2019 e informando debidamente a la recurrente sobre la solución técnica y jurídica aplicable, subsanándose en este acto la omisión de respuesta formal al trámite N.° 000939”. De otra parte no fue posible tener por cierto que la autoridad recurrida le haya brindado a la recurrente una respuesta formal de la denuncia presentada el 26 de mayo de 2026. En conclusión, es cierto que la denuncia planteada por la recurrente en fecha 26 de mayo de 2026 no ha sido resuelta por la Municipalidad recurrida. Por su parte la autoridad recurrida señala que “Según consta en el criterio técnico emitido mediante oficio MG-UTGV-CS0119-2026, la infraestructura pública de recolección y conducción de aguas pluviales asociada a este camino se encuentra en buen estado y en pleno funcionamiento. La erosión y el lavado de suelo que alega la recurrente no se derivan de un deterioro, obstrucción o deficiencia en la obra pública, sino de la falta de mantenimiento del tramo del canal de tierra que se ubica estrictamente dentro de su propiedad privada, cuya tutela y conservación le corresponde de forma exclusiva a ella, a tenor de la legislación citada” y que “Si bien existió una dilación en la respuesta al trámite N.° 000939 del año 2026, la Administración Municipal hace uso del presente informe rendido ante la Sala Constitucional para comunicar material, formal y expresamente a la recurrente que la condición del desagüe se mantiene invariable respecto al estudio de 2019. Se le reitera que es un desagüe funcional que no puede cerrarse y que los trabajos internos le competen a su persona.” Partiendo de lo anterior y tomando en cuenta que si bien es cierto internamente se generó el oficio MG-UTGV-CS-0119-2026 de fecha 03 de Setiembre de 2026 emitido por la Unidad Técnica de Gestión Vial de la Municipalidad de Grecia que resuelve la denuncia de la amparada no menos cierto es que no consta que se haya notificado a la recurrente ni el oficio ni la contestación formal de la denuncia. Así las cosas lo procedente es declarar con lugar el recurso con las consecuencias que se indican en la parte dispositiva de esta sentencia. \n\nVI.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídicoconstitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\nVII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI. \n\nPor tanto:\n\nSe declara con lugar el recurso. Se ordena a DONALD ALBERTO QUESADA RODRÍGUEZ en su calidad de ALCALDE MUNICIPAL y a CESAR SOLÓRZANO ARAYA en su calidad de Encargado (Recargo de funciones) de la Unidad Técnica de Gestión Vial (UTGV), ambos de la Municipalidad de Grecia o a quienes ocupen los cargos, que giren las órdenes pertinentes y dispongan lo necesario dentro del ámbito de sus respectivas competencias, para que en el plazo máximo de TRES DÍAS, contado a partir de la notificación de este pronunciamiento, se resuelva la denuncia planteada por la recurrente en fecha 26 de mayo de 2026. Se advierte a las autoridades recurridas que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Grecia al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo.   "body_en_text": "\n\nExp: 26-029342-0007-CO\n\nRes. Nº 2026035772\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty-five minutes on 17 September 2026.\n\nAmparo proceeding filed by [Nombre 001], identity card [Valor 001], against the MUNICIPALITY OF GRECIA.\n\nBackground:\n\n1.- By a filing submitted to the Secretariat of this Chamber at 07:39 on 13 August 2026, the petitioner files an amparo proceeding against the Municipality of Grecia. She states that for several years her property has been affected by a stormwater drainage system from the public road. The water is collected and conveyed through pipes and drainage structures to a point near her property, where it ultimately discharges onto her land, causing erosion and soil washout. She indicates that in 2019 she submitted a request to the Municipality of Grecia seeking attention to the problem. She reports that, as a result, the administration conducted an inspection and, by memorandum U.T.G.V./MG-268-2019 dated 30 April 2019, acknowledged the existence of a water conveyance system from the public road that discharged into an earth channel because of the terrain’s topography. It also noted the possibility of coordinating work to improve the channeling of the water. She asserts that, despite the foregoing, the situation was not definitively resolved and that the water continues to cause erosion on her property. She adds that, because the problem persisted, on 26 May 2026 she submitted a new request to the Municipality of Grecia, under Processing Receipt No. 000939, to again request intervention by the respondent municipality. However, she complains that as of the filing of the amparo she had received neither a decision on the merits nor a formal, reasoned response regarding that request, and that no definitive technical solution to the problem had been communicated to her, despite the municipality’s knowledge of the situation since 2019. She considers her fundamental rights to have been violated. She requests the intervention of this Chamber.\n\n2.- By resolution issued at 16:12 on 27 August 2026, this amparo was admitted for processing and a report was requested from the mayor and the person in charge of the Technical Unit for Road Management, both of the Municipality of Grecia (see electronic record).\n\n3.- DONALD ALBERTO QUESADA RODRÍGUEZ, in his capacity as MUNICIPAL MAYOR, and CESAR SOLÓRZANO ARAYA, in his capacity as person in charge (additional assigned duties) of the Technical Unit for Road Management (UTGV), both of the Municipality of Grecia, report under oath (see electronic record) as follows: “I. REGARDING THE FACTS ALLEGED BY THE PETITIONER FIRST: It is true that stormwater from the public road discharges onto the petitioner’s property. However, it is clarified that this situation is due strictly to the natural topography of the land (because it is the lowest point in the area) and to the existence of a functional and necessary drainage outlet for the public road. SECOND: It is true that in 2019 the administration conducted a technical inspection (form No. 2952) and issued memorandum U.T.G.V./MG-268-2019 dated 30 April 2019. In that document, Ms. [Nombre 001] was clearly and with reasons informed that the drainage outlet could not be closed because it serves to evacuate stormwater flow, and was advised of the appropriate solution within the scope of our authority. THIRD: It is true that on 26 May 2026 the petitioner submitted a new request under Processing Receipt No. 000939. In keeping with the procedural candor and good faith required in this jurisdiction, we acknowledge that no formal response to that specific request had been issued before this amparo was filed. Nevertheless, the underlying technical situation is identical to the one diagnosed in 2019. Through this report and its proper notification, the Administration remedies this omission, reiterates to the petitioner the unchanged technical opinion, and deems the right to petition satisfied. II. REGARDING THE MERITS OF THE AMPARO A. Application of Article 20 of the General Public Roads Law (No. 5060): The dispute raised falls within the situation governed by Article 20 of the General Public Roads Law. That provision imposes on the owner whose property adjoins a public road’s drainage outlet the unavoidable obligation to receive the water when the difference in elevation so requires, and to keep those drainage outlets on their property clean, in perfect working order, and free of obstructions. The legal system does not require the Municipality to intervene in or maintain water conveyance systems located on private property. B. Proper condition of public infrastructure: According to the technical opinion issued in memorandum MG-UTGV-CS0119-2026, the public stormwater collection and conveyance infrastructure associated with this road is in good condition and fully operational. The erosion and soil washout alleged by the petitioner do not result from deterioration, obstruction, or a deficiency in the public works, but from a lack of maintenance of the section of the earth channel located strictly within her private property, whose protection and upkeep are her exclusive responsibility under the cited legislation. C. Legal impossibility of investing public funds in private property: The Municipality of Grecia is legally barred from allocating public resources, materials, or personnel to improve, mitigate, or maintain infrastructure located on private land. Acting otherwise would directly violate the Principle of Legality and the budgetary legality framework (Article 11 of the Political Constitution and Article 11 of the General Law of Public Administration). D. Regarding the alleged violation of the right to petition and prompt resolution: Although there was a delay in responding to request No. 000939 of 2026, the Municipal Administration is using this report submitted to the Constitutional Chamber to inform the petitioner materially, formally, and expressly that the condition of the drainage outlet remains unchanged from the 2019 study. She is again advised that this is a functional drainage outlet that cannot be closed and that the work inside the property is her responsibility. This remedies any omission and restores the asserted right, leaving the amparo without a current interest on this point.”\n\n4.- The legal requirements have been observed in the proceedings.\n\nDrafted by Justice Cruz Castro; and,\n\nReasons:\n\nI.- PRELIMINARY ISSUE: Before analyzing the merits of the matter—concerning the alleged violation of the right to a prompt and duly conducted proceeding—it must be clarified that, since Judgment No. 2008-02545, issued at 8:55 on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—matters in which it is disputed whether the public administration has complied with the time limits set by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, either to issue a final decision in an administrative procedure—initiated ex officio or at the request of a party—or to hear the available administrative appeals. This case presents one such exception, supported by the majority of this Constitutional Court, because it concerns the filing of a complaint related to a risk to property that allegedly has not been resolved within a reasonable time. Having clarified the foregoing, the specific situation raised in this amparo will now be decided.\n\nII.- SUBJECT OF THE AMPARO: The petitioner alleges that for several years her property has been affected by a stormwater drainage system from the public road. The water is collected and conveyed through pipes and drainage structures to a point near her property, where it ultimately discharges onto her land, causing erosion and soil washout. She adds that, because the problem persisted, on 26 May 2026 she submitted a new request to the Municipality of Grecia, under Processing Receipt No. 000939, to again request intervention by the respondent municipality. However, she complains that as of the filing of the amparo she had received neither a decision on the merits nor a formal, reasoned response regarding that request, and that no definitive technical solution to the problem had been communicated to her, despite the municipality’s knowledge of the situation since 2019.\n\nIII.- FACTS PROVEN. The following facts relevant to deciding this matter are deemed duly established, either because they have been proven or because the respondent authority failed to address them:\n\na) On 26 May 2026, the petitioner filed a complaint under Processing Receipt No. 000939 to again request the municipality’s intervention regarding MEMORANDUM U.T.G.V./MG-268-2019 DATED 30 APRIL 2019 (see report of the respondent authority).\n\nb) On 01 September 2026, the resolution admitting the amparo for processing was served on the respondent authority (see notice of service).\n\nc) By memorandum MG-UTGV-CS-0119-2026 dated 03 September 2026, the Technical Unit for Road Management of the Municipality of Grecia informed the Municipal Mayor as follows: “Subject: ‘UTGV technical opinion regarding the Amparo Proceeding – Case File No. 26-029342-0007-CO.’ In connection with the review and analysis of the AMPARO PROCEEDING in case file No. 26-029342-0007-CO, I hereby address the technical form and merits as follows: I. REGARDING THE FACTS AND SUBJECT OF THE AMPARO The petitioner [Nombre 001] states that her property is affected by stormwater from the public road, conveyed through a pipe to a point near her property where it discharges, causing erosion and soil washout. She indicates that in 2019 she requested that this Municipality address the problem and, as a result, the administration conducted a technical inspection; she was informed of the situation by memorandum U.T.G.V./MG-268-2019 dated 30 April 2019. She adds that on 26 May 2026 she submitted a new request (Processing Receipt No. 000939) and had received no formal response as of the date the amparo was filed. In this regard, this Administration confirms that, in its technical substance, the facts described correspond to the same situation diagnosed and communicated to the petitioner since 2019, and do not concern a new or different condition. II. APPLICABLE LEGAL FRAMEWORK: ARTICLE 20 OF THE GENERAL PUBLIC ROADS LAW The matter raised falls within the situation governed by Article 20 of the General Public Roads Law, No. 5060, which provides: ‘ARTICLE 20.- All possessors of real property, under any title, are obliged to receive and allow the water from roads to flow through their properties whenever the slope of the land so requires and, when their properties are adjacent to a road’s drainage outlets, they must keep those outlets clean, in perfect working order, and free of obstructions. The Ministry or the Municipalities shall order the work to be carried out and charge for the work plus a fifty percent (50%) surcharge if this obligation is not fulfilled. (...)’ The provision quoted establishes that the legal system imposes on the owner whose property adjoins a public road’s drainage outlet the obligation to receive that water and to keep the discharge point within their own property clean and in good condition. It even provides that, if this obligation is not fulfilled, the Administration itself will carry out the work at the owner’s expense, plus a 50% surcharge. The provision does not require the Municipality to intervene in or maintain private property on its own initiative and with public funds. III. REGARDING MEMORANDUM U.T.G.V./MG-268-2019 DATED 30 APRIL 2019 In response to form No. 2952, received on 04 March 2019, the UTGV conducted an on-site inspection and determined that this is a drainage channel from the public road that crosses the petitioner’s land along its boundary with the uphill neighbor, with underground piping extending approximately 20 meters, which discharges into an earth channel formed naturally by the terrain’s topography, as this is the lowest point in the area. That memorandum expressly informed Ms. [Nombre 001] that the drainage channel cannot be closed, because it is a functional drainage outlet for the public road that releases the flow collected during the rainy season. This establishes that, since 2019, the Administration has technically diagnosed the situation, clearly and with reasons informed the petitioner, and advised her of the available solution within the scope of its authority. IV. REGARDING REQUEST No. 000939 OF 26 MAY 2026 This department acknowledges, with the candor and good faith that should characterize the technical information supporting the report this Mayor’s Office will submit under oath to the Constitutional Chamber, that no formal and express response was issued to the petitioner’s request under Processing Receipt No. 000939. Nevertheless, it is clarified that this omission did not result from a change in the underlying situation, which—as confirmed by this same Administration—is identical to the one already diagnosed and communicated in memorandum U.T.G.V./MG-268-2019 in 2019. To remedy that omission and fulfill the duty to respond expressly to requests from members of the public, this report formally informs the petitioner that the technical condition of the drainage channel remains as stated since 2019: it is a functional drainage outlet for the public road that cannot be closed, and its maintenance within the private property is the property owner’s responsibility under Article 20 of the General Public Roads Law. V. REGARDING THE CONDITION OF PUBLIC INFRASTRUCTURE This Mayor’s Office is informed that the public stormwater collection and conveyance infrastructure associated with the public road in the area is in good condition and fully operational, performing its drainage function according to its design and the natural topography of the land. The impact alleged by the petitioner does not result from deterioration, obstruction, or a deficiency in the public works, but from a lack of maintenance of the section of the drainage channel located within her private property, which she is responsible for addressing under the cited regulations. It is reiterated that the Municipality of Grecia lacks legal authority to invest public funds in maintaining or improving infrastructure located on private property, pursuant to the principle of budgetary legality governing administrative action (Article 11 of the Political Constitution and the General Law of Public Administration). VI. REQUEST For the foregoing reasons, it is recommended that the Constitutional Chamber declare this amparo WITHOUT MERIT, because there was no omission or violation of any fundamental right attributable to the Municipality of Grecia, which acted within the scope of its legal authority, timely diagnosing the situation in 2019 and duly informing the petitioner of the applicable technical and legal solution, thereby remedying at this time the omission of a formal response to request No. 000939” (see report of the respondent authority).\n\nIV.- FACT NOT PROVEN: The following fact is not deemed proven: SOLE: That the respondent authority provided the petitioner with a formal response to the complaint filed on 26 May 2026.\n\nV.- REGARDING THE SPECIFIC CASE: It follows from the report submitted by the respondent authority, which is given under oath with the legal consequences that entails, that on 26 May 2026 the petitioner filed a complaint under Processing Receipt No. 000939 to again request the municipality’s intervention regarding MEMORANDUM U.T.G.V./MG-268-2019 DATED 30 APRIL 2019. It was verified that on 01 September 2026 the resolution admitting the amparo for processing was served on the respondent authority. It was established that, by memorandum MG-UTGV-CS-0119-2026 dated 03 September 2026, the Technical Unit for Road Management of the Municipality of Grecia informed the Municipal Mayor as follows: “Subject: ‘UTGV technical opinion regarding the Amparo Proceeding – Case File No. 26-029342-0007-CO.’ In connection with the review and analysis of the AMPARO PROCEEDING in case file No. 26-029342-0007-CO, I hereby address the technical form and merits as follows: I. REGARDING THE FACTS AND SUBJECT OF THE AMPARO The petitioner [Nombre 001] states that her property is affected by stormwater from the public road, conveyed through a pipe to a point near her property where it discharges, causing erosion and soil washout. She indicates that in 2019 she requested that this Municipality address the problem and, as a result, the administration conducted a technical inspection; she was informed of the situation by memorandum U.T.G.V./MG-268-2019 dated 30 April 2019. She adds that on 26 May 2026 she submitted a new request (Processing Receipt No. 000939) and had received no formal response as of the date the amparo was filed. In this regard, this Administration confirms that, in its technical substance, the facts described correspond to the same situation diagnosed and communicated to the petitioner since 2019, and do not concern a new or different condition. II. APPLICABLE LEGAL FRAMEWORK: ARTICLE 20 OF THE GENERAL PUBLIC ROADS LAW The matter raised falls within the situation governed by Article 20 of the General Public Roads Law, No. 5060, which provides: ‘ARTICLE 20.- All possessors of real property, under any title, are obliged to receive and allow the water from roads to flow through their properties whenever the slope of the land so requires and, when their properties are adjacent to a road’s drainage outlets, they must keep those outlets clean, in perfect working order, and free of obstructions. The Ministry or the Municipalities shall order the work to be carried out and charge for the work plus a fifty percent (50%) surcharge if this obligation is not fulfilled. (...)’ The provision quoted establishes that the legal system imposes on the owner whose property adjoins a public road’s drainage outlet the obligation to receive that water and to keep the discharge point within their own property clean and in good condition. It even provides that, if this obligation is not fulfilled, the Administration itself will carry out the work at the owner’s expense, plus a 50% surcharge. The provision does not require the Municipality to intervene in or maintain private property on its own initiative and with public funds. III. REGARDING MEMORANDUM U.T.G.V./MG-268-2019 DATED 30 APRIL 2019 In response to form No. 2952, received on 04 March 2019, the UTGV conducted an on-site inspection and determined that this is a drainage channel from the public road that crosses the petitioner’s land along its boundary with the uphill neighbor, with underground piping extending approximately 20 meters, which discharges into an earth channel formed naturally by the terrain’s topography, as this is the lowest point in the area. That memorandum expressly informed Ms. [Nombre 001] that the drainage channel cannot be closed, because it is a functional drainage outlet for the public road that releases the flow collected during the rainy season. This establishes that, since 2019, the Administration has technically diagnosed the situation, clearly and with reasons informed the petitioner, and advised her of the available solution within the scope of its authority. IV. REGARDING REQUEST No. 000939 OF 26 MAY 2026 This department acknowledges, with the candor and good faith that should characterize the technical information supporting the report this Mayor’s Office will submit under oath to the Constitutional Chamber, that no formal and express response was issued to the petitioner’s request under Processing Receipt No. 000939. Nevertheless, it is clarified that this omission did not result from a change in the underlying situation, which—as confirmed by this same Administration—is identical to the one already diagnosed and communicated in memorandum U.T.G.V./MG-268-2019 in 2019. To remedy that omission and fulfill the duty to respond expressly to requests from members of the public, this report formally informs the petitioner that the technical condition of the drainage channel remains as stated since 2019: it is a functional drainage outlet for the public road that cannot be closed, and its maintenance within the private property is the property owner’s responsibility under Article 20 of the General Public Roads Law. V. REGARDING THE CONDITION OF PUBLIC INFRASTRUCTURE This Mayor’s Office is informed that the public stormwater collection and conveyance infrastructure associated with the public road in the area is in good condition and fully operational, performing its drainage function according to its design and the natural topography of the land. The impact alleged by the petitioner does not result from deterioration, obstruction, or a deficiency in the public works, but from a lack of maintenance of the section of the drainage channel located within her private property, which she is responsible for addressing under the cited regulations. It is reiterated that the Municipality of Grecia lacks legal authority to invest public funds in maintaining or improving infrastructure located on private property, pursuant to the principle of budgetary legality governing administrative action (Article 11 of the Political Constitution and the General Law of Public Administration). VI. REQUEST For the foregoing reasons, it is recommended that the Constitutional Chamber declare this amparo WITHOUT MERIT, because there was no omission or violation of any fundamental right attributable to the Municipality of Grecia, which acted within the scope of its legal authority, timely diagnosing the situation in 2019 and duly informing the petitioner of the applicable technical and legal solution, thereby remedying at this time the omission of a formal response to request No. 000939.” On the other hand, it was not possible to find as fact that the respondent authority provided the petitioner with a formal response to the complaint filed on 26 May 2026. In conclusion, it is true that the complaint filed by the petitioner on 26 May 2026 has not been resolved by the respondent Municipality. The respondent authority, for its part, states that “According to the technical opinion issued in memorandum MG-UTGV-CS0119-2026, the public stormwater collection and conveyance infrastructure associated with this road is in good condition and fully operational. The erosion and soil washout alleged by the petitioner do not result from deterioration, obstruction, or a deficiency in the public works, but from a lack of maintenance of the section of the earth channel located strictly within her private property, whose protection and upkeep are her exclusive responsibility under the cited legislation,” and that “Although there was a delay in responding to request No. 000939 of 2026, the Municipal Administration is using this report submitted to the Constitutional Chamber to inform the petitioner materially, formally, and expressly that the condition of the drainage outlet remains unchanged from the 2019 study. She is again advised that this is a functional drainage outlet that cannot be closed and that the work inside the property is her responsibility.” On that basis, and taking into account that although memorandum MG-UTGV-CS-0119-2026 dated 03 September 2026 was prepared internally by the Technical Unit for Road Management of the Municipality of Grecia to resolve the amparada’s complaint, it is nonetheless true that there is no record that either the memorandum or the formal response to the complaint was served on the petitioner. Accordingly, the appropriate course is to grant the amparo, with the consequences stated in the operative part of this judgment.\n\nVI.- NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND DULY CONDUCTED ADMINISTRATIVE JUSTICE. I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and duly conducted justice in the administrative sphere, the legal dispute must be heard by the Administrative Litigation Courts and not by this Chamber. However, with the recent enactment of Law No. 9097, Law on the Regulation of the Right to Petition, it has been established that this right may be judicially protected through the amparo proceeding provided for in Article 32 of the Law on Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not mean that this Court should change its line of precedent; under Article 7 of its Law, this Court alone defines its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo remedy, in all other cases, for the reasons this Court has given (Judgment No. 2008-02545, issued at 8:55 on 22 February 2008), the competent authorities are the judges of the administrative-litigation jurisdiction. This is all consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable legal provisions, based on a logical, systemic, and teleological interpretation of the legal system.\n\nVII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device they may have submitted, must be collected from the office within a maximum period of 30 working days from service of this judgment. Otherwise, all material not collected within this period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the resolution approved by the Judiciary’s Superior Council at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo is granted. DONALD ALBERTO QUESADA RODRÍGUEZ, in his capacity as MUNICIPAL MAYOR, and CESAR SOLÓRZANO ARAYA, in his capacity as person in charge (additional assigned duties) of the Technical Unit for Road Management (UTGV), both of the Municipality of Grecia, or whoever holds those positions, are ordered to issue the pertinent directives and take the necessary steps within the scope of their respective authority so that, within a maximum period of THREE DAYS from service of this decision, the complaint filed by the petitioner on 26 May 2026 is resolved. The respondent authorities are warned that, pursuant to Article 71 of the Law on Constitutional Jurisdiction, a person who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Municipality of Grecia is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be assessed in enforcement proceedings before the administrative-litigation jurisdiction.
