  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-028245-0007-CO \n\nRes. Nº 2026035241\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciseis de setiembre de dos mil veintiseis .\n\n Consulta legislativa preceptiva de constitucionalidad formulada por el Directorio de la Asamblea Legislativa, sobre al proyecto de «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)», que se tramita en el expediente legislativo número 25.303.\n\nResultando:\n\n1.- La consulta, que se formula en cumplimiento de lo que establece el inciso a), del artículo 96, de la Ley de la Jurisdicción Constitucional, fue recibida en la Secretaría de la Sala a las 09:20 horas del 05 de agosto del 2026, con una copia certificada del expediente legislativo. \n\n2.- La Presidencia de la Sala tuvo por presentada la consulta mediante resolución de las diez horas once minutos del cinco de agosto de dos mil veintiséis.\n\n3.- En el procedimiento se cumplió con las formalidades establecidas en la ley.\n\n Redacta el Magistrado Cruz Castro; y,\n\nConsiderando:\n\nI.- Objeto y admisibilidad de la consulta.- Esta consulta preceptiva de constitucionalidad se formula por el Directorio de la Asamblea Legislativa en cumplimiento de lo dispuesto en el artículo 10, inciso b), de la Constitución Política, y 96, inciso a), de la Ley de la Jurisdicción Constitucional, en relación con el proyecto de «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)», que se tramita en el expediente legislativo número 25.303, por tratarse de la aprobación legislativa de una enmienda a un convenio internacional. Dado que el citado proyecto de ley fue aprobado en Primer Debate en el Plenario Legislativo, sesión ordinaria N° 40, del 28 de julio del 2026, por votación de 53 votos a favor y 0 en contra, procede su conocimiento, de conformidad con lo dispuesto en el artículo 98, párrafo 1°, de la Ley de la Jurisdicción Constitucional. Siendo, lo primero que procede, a los efectos de evacuar la consulta, verificar los trámites seguidos en este caso, en concordancia con lo que señala el artículo 98, de la Ley de la Jurisdicción Constitucional, al disponer que la consulta deberá hacerse después de aprobado el proyecto en primer debate y antes de la aprobación definitiva y que, al evacuarla, la Sala dictaminará sobre aspectos o motivos que estime relevantes desde el punto de vista constitucional, pero vinculante sólo en lo que se refiere a los trámites. Para los efectos anteriores, en el siguiente considerando se hará una síntesis cronológica del proyecto de ley.\n\n II.- La tramitación del expediente número 25.303 en la Asamblea Legislativa.- El proyecto de «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)», que se tramita en el expediente legislativo número 25.303, ha seguido el siguiente orden cronológico: \n\n \n\na) El 04 de abril de 1991 se firma en Madrid la “Adhesión de la República de Costa Rica al Protocolo al Tratado Antártico sobre protección del medio ambiente (PTAPMA)”. (ver expediente legislativo). \n\nb) El día 17 de noviembre del 2025, por iniciativa del Poder Ejecutivo, y mediante oficio firmado por el Ministro a.i de la Presidencia, se presenta a la Secretaría del Directorio de la Asamblea Legislativa proyecto de «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)» para el trámite correspondiente (expediente legislativo).\n\nc) El proyecto fue publicado en el Diario Oficial La Gaceta N.º 233, Alcance N°158 del 11 de diciembre del 2025 (expediente legislativo). \n\nd) El 11 de diciembre del 2025 ingresa al orden del día y debate de la Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior (expediente legislativo).\n\ne) En Sesión de la Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior se aprobó una moción de consulta a varias instituciones. (expediente legislativo).\n\nf) El 15 de diciembre del 2025, el Departamento de Estudios, Referencias y Servicios Técnicos de la Asamblea Legislativa, elaboró el Informe Jurídico AL-DEST-IJU-426-2025, relativo al proyecto consultado (expediente legislativo).\n\ng) Luego, en sesión del 11 de junio del 2026, celebrada por la Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior, se dictaminó afirmativamente por unanimidad, el proyecto consultado (expediente legislativo);\n\nh) En la Sesión Plenaria Ordinaria del Plenario Legislativo N° 40, del martes 28 de julio del 2026, se aprueba en Primer Debate el EXPEDIENTE N.º 25.303, “APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)“. Por votación de 53 diputados a favor y 0 votos en contra. Luego se dispuso el traslado a la Sala Constitucional en consulta preceptiva (expediente legislativo);\n\ni) El 30 de julio del 2026, se remite la Redacción final del proyecto «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)», que se tramita en el expediente legislativo número 25.303 (ver expediente legislativo). \n\nj) Mediante auto entregado el 05 de agosto de 2026 la Presidenta de la Asamblea Legislativa junto a la primera y segunda Secretaría, remiten copia del expediente n°25.303 «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)», a la Secretaría de la Sala Constitucional (expediente legislativo). \n\n \n\nDe conformidad con lo establecido en el artículo 98, de la ley que rige esta Jurisdicción, este Tribunal revisó el procedimiento legislativo para la tramitación del proyecto de «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)», que se tramita en el expediente legislativo número 25.303. Se observa que, luego de que Costa Rica se adhirió al Tratado Antártico mediante la Ley N° 10.266 del 25 de mayo de 2022, el Poder Ejecutivo propone completar el Tratado con la aprobación del Protocolo a dicho Tratado. Se indica en la exposición de motivos que: \n\n“El Protocolo de Madrid, que entró en vigor el 14 de enero de 1998, “fue diseñado en torno a un conjunto central de principios medioambientales, con una serie de Anexos que establecían reglas y disposiciones más detalladas. Esta metodología permite no solo actualizar los Anexos a fin de adaptarlos a los cambios en materia de conciencia ambiental y prácticas de gestión, sino también agregar anexos a medida que surja la necesidad”. \n\n \n\nEl Apéndice del Protocolo forma parte integrante del Protocolo al Tratado Antártico sobre Protección del Medio Ambiente, conforme lo dispone su propio texto. En consecuencia, resulta jurídicamente necesario dejar constancia de que el Protocolo está estructurado en veintisiete (27) artículos y un Apéndice sobre Arbitraje compuesto por trece (13) artículos, de manera que se asegure la precisión sobre su contenido normativo y se establezca con claridad que el proyecto de adhesión comprende la totalidad del instrumento internacional.\n\n \n\nAl ratificar el Protocolo, Costa Rica fortalece su credibilidad como Estado responsable y respetuoso del derecho internacional y los acuerdos multilaterales.”\n\n \n\nLuego de presentado a la Secretaría del Directorio de la Asamblea Legislativa, el proyecto fue enviado a la Comisión Permanente Especial de Relaciones Internacionales y de Comercio Exterior, donde se envió en consulta a varias instituciones y posteriormente fue dictaminado de forma unánime. Además, en cumplimiento del principio de publicidad, el texto del proyecto fue publicado. También, se acreditó que el proyecto en consulta fue aprobado en primer debate por una mayoría de 53 diputados, cumpliendo la mayoría absoluta que exige el artículo 121 párrafo 4. Así que no se observa infracción a los derechos y potestades de los legisladores, pues el proyecto de ley fue conocido por el Plenario Legislativo como correspondía, por tratarse de la aprobación de un protocolo a un tratado internacional y, en esa medida, no podía ser delegado en una Comisión Legislativa con Potestad Plena según lo establece el art. 124 párrafo 3 de la Constitución Política en relación con el art. 121 párrafo 4 ibídem. Así que, no se observa ningún vicio en relación con la aprobación del protocolo en cuestión, ni en la tramitación del proyecto de ley, ni irregularidad alguna que implique nulidad por ser contraria al Derecho de la Constitución Política o a los principios y valores que la informan, o al procedimiento legislativo regulado en el Reglamento de la Asamblea Legislativa, que es parámetro de constitucionalidad. En consecuencia, al proyecto de «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)», que se tramita en el expediente legislativo número 25.303, se le dio el trámite legislativo que correspondía. \n\n III.- Observaciones en cuanto al fondo del proyecto.- De acuerdo con lo establecido en el artículo 101, de la Ley de la Jurisdicción Constitucional, el dictamen de esta Sala solo será vinculante en cuanto establezca la existencia de trámites inconstitucionales del proyecto de referencia. Además, en cuanto al contenido de los diversos artículos, se hará relación a los aspectos más relevantes del convenio, sin hacer un análisis de todos y cada uno de sus artículos ya que, en principio, se consideran conformes con el Derecho de la Constitución (principios, valores, normas). De esta manera, en cuando al fondo, se observa que esta iniciativa de ley pretende que Costa Rica, como país signatario del Tratado Antártico ratificado mediante Ley Nº 10.266 del año 2022, proceda también a aprobar un protocolo que no modifica ni enmienda el Tratado Antártico, sino que lo desarrolla y complementa; y que fue firmado en Madrid en el año 1991. Con el Tratado Antártico varios países acordaron el estatuto jurídico de “zona de paz y desmilitarizada” para dicha región, y abrir a la participación de la comunidad internacional dicha declaratoria. Con la aprobación de este protocolo se completa dicha declaratoria designándola además “reserva natural consagrada a la paz y la ciencia” con el compromiso de las Partes de “protección global del medio ambiente antártico y los ecosistemas dependientes y asociados”. Así que este protocolo, tal como lo indica el informe jurídico que consta en este expediente, “es declarativo de creación o ampliación de un determinado estatuto jurídico de protección ambiental para esta región del mundo, con las regulaciones, mecanismos, y procedimientos asociados que eso pueda implicar.” El término “Protocolo”, que se usa en derecho internacional para todo acuerdo relacionado con un Tratado anterior, sea para modificarlo como para complementarlo, como se hace en este caso que se trata de un desarrollo o complemento del Tratado Antártico mencionado. Así que este es un Protocolo viene a desarrollar el Tratado Antártico, pero no a modificarlo o enmendarlo. Así lo establece con claridad y en forma expresa, el inciso 1) del artículo 4 de este Protocolo: “Este Protocolo complementará el Tratado Antártico y no lo modificará ni enmendará.” Por lo cual, se trata de un protocolo que desarrolla o complementa lo ya acordado. Según el resumen que prepara el Informe Jurídico, se tiene lo siguiente:\n\n“ARTÍCULO 1: DEFINICIONES\n\nTodas las definiciones son referencias a conceptos u órganos ya establecidos en virtud del propio Tratado Antártico. No presentan ni dificultad ni problemas de ningún tipo. \n\nARTÍCULO 2: OBJETIVO Y DESIGNACIÓN\n\nMediante el presente Protocolo, designan a la Antártida como reserva natural, consagrada a la paz y a la ciencia. \n\nDe un modo similar a como un Estado designa parte de su territorio como reserva natural o zona protegida, se ha querido hacer a nivel internacional con la Antártida, reiterando o confirmando lo ya establecido por el Tratado Antártico original. \n\nARTÍCULO 3: PRINCIPIOS MEDIOAMBIENTALES\n\nDeclara principio fundamental la protección del ambiente antártico, y sujeto a esa consideración las actividades que se puedan realizar en esa área, con los tradicionales principios de información sustentada en la técnica, minimización de riesgos ambientales, y evaluaciones previas y periódicas de cualquier actividad, priorizando la actividad científica, y remitiendo al propio Tratado para el requisito de autorización previa. \n\nEs una norma enunciativa, que brinda principios o criterios rectores para la autorización de actividades en la Antártida. \n\nARTÍCULO 4: RELACIONES CON LOS OTROS COMPONENTES DEL SISTEMA DEL TRATADO ANTÁRTICO\n\nEn derecho internacional se utiliza la misma terminología de “Protocolo” como otro Acuerdo relacionado, ya sea de enmienda o modificación; pero también como en este caso, para la “reglamentación” o especificación o detalle de las obligaciones de un Tratado principal.\n\nEn la medida que esta norma expresamente confiere ese segundo sentido expreso al Protocolo, (afirmando que no enmienda el Convenio principal), y que solo viene a complementar o reglar lo ya establecido, limita el alcance de sus obligaciones al mismo Tratado Antártico como Convenio principal.\n\nPuede afirmarse que no viene entonces a crear obligaciones o compromisos nuevos, sino solo a desarrollarlos. \n\nARTÍCULO 5: COMPATIBILIDAD CON LOS OTROS COMPONENTES DEL SISTEMA DEL TRATADO ANTÁRTICO\n\nSegún la definición del inciso e) del artículo 1, los otros componentes del sistema antártico son “las medidas en vigor según ese Tratado, sus instrumentos internacionales asociados separados en vigor y las medidas en vigor según esos instrumentos”, o sea, toda la normativa derivada, no necesariamente de valor convencional.\n\nAl ser de menor rango, no se predica la superioridad de toda esta normativa como con respecto al Convenio principal, sino un deber genérico de consultar y cooperar para evitar incoherencias.\n\nPor el carácter genérico de las obligaciones del Protocolo no es dable que se produzcan antinomias con otras normativas, pero en todo caso se enuncia lo que podría ser un principio de interpretación y aplicación, propio además de cualquier sistema jurídico, que es la interpretación armoniosa o que tiende a conciliar eventuales normas aparentemente contradictorias o incoherentes.\n\nAl igual que el artículo anterior, está establecido criterios orientadores en la aplicación e interpretación de las normas del Protocolo. \n\nARTÍCULO 6: COOPERACIÓN\n\nNo puede faltar la genérica disposición en materia de cooperación entre las Partes. Sin que llegue a constituir un normativo directo, porque no tiene ese grado de especificación, es sin embargo un principio de actuación que debe prevalecer, más allá del alcance político de su enunciación. \n\nARTÍCULO 7: PROHIBICIÓN DE LAS ACTIVIDADES RELACIONADAS CON LOS RECURSOS MINERALES\n\nProhíbe principalmente la extracción minera, salvo para la investigación científica. Esta es quizás una de las consecuencias más importantes de toda la declaratoria de reserva natural del continente. “Afecta” a los doce países que tienen “titularidad” territorial sobre el continente.\n\nPero es obvio que la declaratoria que luego es suscrita por el resto de la comunidad internacional, constituye un compromiso internacional que va más allá de la decisión interna de cada Estado, e incluso de la decisión de dichos miembros considerados en su conjunto, pues han extendido esta declaratoria con carácter universal. \n\nARTÍCULO 8: EVALUACIÓN DEL IMPACTO SOBRE EL MEDIO AMBIENTE\n\nNo importa la transitoriedad o la intensidad del impacto (porque puede ir desde mínimo), todas las actividades autorizadas requerirán evaluación de impacto ambiental al igual que sucede con el ordenamiento interno de los Estados. Es un compromiso concreto, que obviamente solo aplica sobre los “titulares” o “administradores” de la Antártida.\n\nARTÍCULO 9: ANEXOS\n\nEsta es una norma del derecho de los tratados, como se denomina las reglas comunes que no regulan aspectos sustantivos, sino únicamente aspectos del propio instrumento jurídico. En este caso la “integralidad” de los Anexos con el mismo Tratado queda establecida expresamente. \n\nEl inciso 2 y 3 equipara las Enmiendas a los Anexos del Protocolo, a la aprobación de normativa derivada según el propio Tratado Antártico (artículo IX), pero en cuanto precisa consenso de todas las Partes, excluye problemas jurídicos relacionados con dicho procedimiento. \n\nARTÍCULO 10: REUNIONES CONSULTIVAS DEL TRATADO ANTÁRTICO\n\nDispone para las mismas reuniones consultivas del Tratado Antártico, el seguimiento y las decisiones sobre implementación del Protocolo, igualmente equiparadas a normativa derivada del Convenio principal. Es una decisión normal y natural que no presenta problemas de ningún tipo. \n\nARTÍCULO 11: COMITÉ PARA LA PROTECCIÓN DEL MEDIO AMBIENTE\n\nCrea la Institucionalidad del Protocolo: un Comité para la Protección del Medio Ambiente, integrado por todas Partes con derecho a nombrar expertos. Como el Protocolo ya entró en vigor, El Comité ya ha sido instalado y se encuentra operativo desde 1998. \n\nLa regla del deber de presentar informes y la remisión al propio Comité para adoptar su reglamento o reglas de funcionamiento son del todo naturales. \n\nARTÍCULO 12: FUNCIONES DEL COMITÉ\n\nLas funciones del Comité son de asesoramiento técnico a las Partes en todo lo relativo a la protección ambiental. Sus funciones son consultivas y técnicas, y en ningún caso vinculantes. \n\nARTÍCULO 13: CUMPLIMIENTO DE ESTE PROTOCOLO\n\nEsta norma enuncia el deber genérico de todas las Partes de cumplir el Protocolo, lo cual es completamente natural y casi que innecesario de ser proclamado en forma expresa, sin perjuicio del acento político de una disposición de este tipo. \n\nARTÍCULO 14: INSPECCIÓN\n\nEste artículo desarrolla la posibilidad de inspecciones técnicas con fundamento o remisión al artículo VII del Tratado Antártico, que ya las prevé como derecho de las Partes para garantizar el debido cumplimiento del Tratado, y que ahora, el mismo mecanismo se extiende a los propósitos o implementación del Protocolo. No se trata de una función nueva, sino algo ya contraído bajo el Tratado principal, pero que ahora se hace extensivo también a la implementación del Protocolo. \n\nARTÍCULO 15: ACCIONES DE RESPUESTA EN CASOS DE EMERGENCIA\n\nComo mecanismo adicional, se acuerda adoptar protocolos de acciones de emergencia en respuesta rápida los cuales quedan librados a la decisión de cada una de las Partes, pero bajo el compromiso genérico de cooperación internacional.\n\nEsta medida obviamente está directamente relacionada con las Partes que poseen estaciones o equipos de investigación en el área, y que prácticamente no tendría relación con nuestro país. \n\nARTÍCULO 16: RESPONSABILIDAD\n\nEsta norma es programática y conforme los modernos desarrollos del derecho ambiental, las Partes se comprometen a adoptar normas de responsabilidad por daños provocados al ecosistema, las cuales podrán ser adoptadas como Anexos conforme los procedimientos de normativa derivada, tanto del Convenio, como por extensión del Protocolo. \n\nLa adopción de esos Anexos no sería obligatoria sino opcional, lo cual excluye problemas jurídicos de principio. \n\nARTÍCULO 17: INFORME ANUAL DE LAS PARTES\n\nHay una obligación concreta de brindar un Informe sobre medidas adoptadas para dar cumplimiento al Protocolo. Como miembro no original, este compromiso no aplica para nuestro país en la medida que no mantiene jurisdicción o reclamación sobre la Antártida. \n\nARTÍCULO 18: SOLUCIÓN DE CONTROVERSIAS\n\nSe disponen todos los medios de solución controversias, tanto los políticos como los jurisdiccionales, pero siempre sobre acuerdo de las Partes involucradas, lo cual excluye problemas jurídicos de principio. \n\nARTÍCULO 19: ELECCIÓN DEL PROCEDIMIENTO PARA LA SOLUCIÓN DE CONTROVERSIAS\n\nEn cuanto a medios jurisdiccionales (arbitraje o Corte Internacional de Justicia) las Partes al momento de adherirse al Protocolo manifestaran su disposición de obligarse mediante estos procedimientos.\n\nEl Protocolo se presenta únicamente a aprobación, por lo que esto significa que en este momento el país no está aceptando ningún medio jurisdiccional de solución de controversias, lo cual tiene sentido, dada que su condición (como tercero o miembro de la comunidad internacional si jurisdicción sobre la Antártida) hace impensable que surja al motivo de controversia. \n\nSin embargo, por disposición de este artículo, el no señalamiento de medio expresa significa automáticamente la aceptación del arbitraje (inciso 3), lo cual obviamente no tiene problema al ser el método más tradicional de solución de controversias de tipo jurisdiccional en el derecho internacional. \n\nARTÍCULO 20: PROCEDIMIENTO PARA LA SOLUCIÓN DE CONTROVERSIAS\n\nDispone una especie de agotamiento de medios políticos, o un plazo (12 meses o un año) lo cual da lugar posteriormente a los medios jurisdiccionales. \n\nEsta regla es común en el derecho internacional, aunque no tanto el plazo, pero de todos modos no implica problemas jurídicos de ningún tipo. \n\nARTÍCULO 21: FIRMA\n\nEl Protocolo queda abierto a la firma de los Estados contratantes del Tratado Antártico. En esa condición es que nuestro país tramita ahora la adhesión. \n\nEste Protocolo quedará abierto a la firma de cualquier Estado que sea Parte Contratante del Tratado Antártico en Madrid el 4 de octubre de 1991 y posteriormente en Washington hasta el 3 de octubre de 1992.\n\nARTÍCULO 22: RATIFICACIÓN, ACEPTACIÓN, APROBACIÓN O ADHESIÓN\n\nEl Protocolo como un tratado independiente debe ser ratificado por las Partes según sus propios procedimientos constitucionales o internos. \n\nLo peculiar de esta norma es que se declara al Gobierno de los Estados Unidos como depositario del Protocolo, a diferencia del Tratado principal. \n\nARTÍCULO 23: ENTRADA EN VIGOR\n\nDado que el Protocolo entró en vigor desde 1998, aplicaría para nuestro país la regla de que 30 días después del depósito del instrumento de ratificación empezaría a regir para nuestro país. \n\nARTÍCULO 24: RESERVAS\n\nNo se admiten reservas. Disposición expresa y específica que no requiere mayor comentario. \n\nARTÍCULO 25: MODIFICACIÓN O ENMIENDA\n\nRemite al artículo XII del Tratado Antártico para el procedimiento de adopción de Enmiendas, las cuales requieren consenso, con la particularidad que si adoptada una enmienda en el plazo de dos años, un Estado no la acepta, se considera que ha decidido dejar de ser Parte del Convenio. Mantiene un mecanismo especialmente agravado para la decisión de prohibir la explotación minera. \n\nEste mecanismo en cuanto supedita la aprobación de cada enmienda a los procedimientos internos de cada Partes excluye problemas jurídicos. \n\nARTÍCULO 26: NOTIFICACIONES POR EL DEPOSITARIO\n\nSon reglas procedimentales para el Depositario según lo que es característico y tradicional de sus funciones. No presenta problemas de ningún tipo. \n\nARTÍCULO 27: TEXTOS AUTÉNTICOS Y REGISTRO EN NACIONES UNIDAS\n\nTodos los idiomas oficiales de Naciones Unidos son textos auténticos del Protocolo, incluido el español, lo que excluye problemas jurídicos. \n\nAPÉNDICE DEL PROTOCOLO: ARBITRAJE\n\nEstablece reglas de procedimiento para el caso de tener que recurrir a este mecanismo jurisdiccional de solución de controversias. Sigue un esquema común, y no presenta problemas jurídicos de ningún tipo. “\n\n \n\nLuego, se indica en el dictamen afirmativo de unanimidad que las disposiciones de este protocolo no crea obligaciones para Costa Rica: \n\n“… no crean nuevas obligaciones sustanciales para Costa Rica, sino que detallan y fortalecen los principios ya establecidos en el régimen antártico.\n\nEn cuanto a su relevancia internacional, el documento vincula el Protocolo con varios Objetivos de Desarrollo Sostenible (ODS), particularmente el ODS 13 sobre acción climática, el ODS 14 sobre vida submarina, el ODS 15 sobre ecosistemas terrestres y el ODS 17 sobre alianzas para lograr los objetivos.”\n\nAdemás, el dictamen indica que la adhesión de Costa Rica a esta protocolo tiene un valor principalmente simbólico y diplomático, al reforzar la imagen internacional de Costa Rica como un país comprometido con la sostenibilidad, la protección ambiental y la cooperación internacional:\n\n \n\n“Respecto al contenido del Protocolo, el análisis subraya como aspectos centrales la prohibición de las actividades mineras, salvo aquellas destinadas a la investigación científica; la obligación de realizar evaluaciones de impacto ambiental para cualquier actividad en la región; la creación de un Comité para la Protección del Medio Ambiente con funciones técnicas y consultivas; y el establecimiento de mecanismos de cooperación, inspección, respuesta ante emergencias y solución de controversias. Muchas de estas obligaciones recaen principalmente sobre los Estados que mantienen reclamaciones territoriales o infraestructura científica en la Antártida. \n\nSi bien, la adhesión al Protocolo no genera efectos prácticos debido a que no posee reclamaciones territoriales, estaciones científicas ni jurisdicción sobre la Antártida, la adhesión tiene un valor principalmente simbólico y diplomático, al reforzar la imagen internacional de Costa Rica como un país comprometido con la sostenibilidad, la protección ambiental y la cooperación internacional.\n\n \n\nPor lo tanto, en dicho dictamen se concluye las razones para recomendar su aprobación de la siguiente manera:\n\n \n\n“La adhesión al Protocolo es plenamente congruente con la trayectoria histórica de Costa Rica como un país comprometido con la protección ambiental y el desarrollo sostenible. La consolidación de un modelo de conservación basado en áreas protegidas, el impulso de políticas de descarbonización y el liderazgo en foros internacionales sobre cambio climático y biodiversidad han convertido al país en un referente global en materia ambiental. \n\nEn este contexto, la aprobación del Protocolo fortalece la coherencia entre la política exterior costarricense y reafirma el compromiso del país con la protección de los bienes comunes globales y con la promoción de soluciones colectivas frente a desafíos transnacionales como la crisis climática y la pérdida de biodiversidad.\n\nAdicionalmente, la adhesión se alinea con diversos Objetivos de Desarrollo Sostenible de la Agenda 2030, particularmente el ODS 13 sobre acción por el clima, el ODS 14 sobre vida submarina, el ODS 15 sobre vida de ecosistemas terrestres y el ODS 17 sobre alianzas para lograr los objetivos, consolidando la participación activa de Costa Rica en los esfuerzos internacionales orientados a garantizar un desarrollo sostenible e inclusivo.\n\nPor todo lo anterior, la aprobación del expediente N° 25.303 representa una oportunidad para fortalecer el liderazgo internacional de Costa Rica en materia ambiental, respaldar la protección de uno de los ecosistemas más estratégicos y vulnerables del planeta y reafirmar la vocación histórica del país por la paz, la ciencia, la cooperación internacional y la sostenibilidad.”\n\n \n\nFinalmente, en la discusión que se dio en el debate parlamentario del primer debate, se indicó lo siguiente:\n\n \n\nDiputado José Miguel Villalobos Umaña: “… Este protocolo lo que pretende es designar a la Antártida como reserva natural de la humanidad, consagrada a la paz y a la ciencia. Es uno de esos documentos que no debería tener ninguna discusión. Es un acto de homenaje universal a una región que no debe ser de nadie, porque es de todos y que se destine a la paz y a la ciencia.”\n\n \n\nDiputada Joselyn Sáenz Núñez: “este proyecto tiene un enorme valor simbólico y práctico para Costa Rica, porque reafirma una política exterior nacional basada en paz, en el derecho internacional, la ciencia y la protección ambiental; una tradición de larga data costarricense que siempre vamos a defender, vamos a exaltar y vamos a exhortar que se siga cumpliendo. \n\nLa Antártida es un continente excepcional. No es únicamente el continente más frío del planeta, sino que es un territorio de aproximadamente catorce millones de kilómetros cuadrados, cubierto en un noventa y ocho por ciento de hielo, que contiene cerca del noventa por ciento del hielo terrestre y alrededor del setenta por ciento del agua dulce del mundo.\n\nLo que sucede en la Antártida repercute en absolutamente todos los continentes. Las corrientes oceánicas que nacen alrededor de este continente regulan el clima mundial, distribuyen nutrientes en los océanos y ayudan a estabilizar las temperaturas del planeta. Es por eso que los científicos suelen describirla como uno de los grandes termostatos de la Tierra.\n\nEse gran valor ambiental y de equilibrio ecológico que tiene la Antártida para el mundo es el que nos lleva a la urgencia de aprobar justamente este proyecto. \n\n(…) Por eso, en 1991 se adoptó el Protocolo al Tratado Antártico sobre Protección del Medio Ambiente que entró en vigor en 1998; un protocolo que representa uno de los instrumentos ambientales más avanzados del derecho internacional, donde declara medidas justamente como que la Antártida es una reserva natural dedicada a la paz y a la ciencia, donde se prohíbe la explotación minera con fines comerciales, donde se obliga a las evaluaciones de impacto ambiental, donde se protege la flora y la fauna, donde se regula el manejo de residuos y la prevención de la contaminación, donde establece reglas estrictas para todas las actividades humanas que se desarrollen ahí.”\n\n \n\nAsí entonces, analizado el contenido del articulado que conforman el protocolo al tratado, este Tribunal Constitucional estima que, en términos generales, es un protocolo típico, sustancialmente conforme con los preceptos, valores y principios fundamentales del Derecho de la Constitución. De tal manera, se concluye que el contenido del protocolo que se consulta, se encuentra conforme con el Derecho de la Constitución, en los términos que el mismo ha sido reconocido por esta Sala.\n\nV.- Conclusión. En mérito de lo expuesto, se evacua la consulta en el sentido de que, el proyecto de «APROBACIÓN DE LA ADHESIÓN DE LA REPÚBLICA DE COSTA RICA AL PROTOCOLO AL TRATADO ANTÁRTICO SOBRE PROTECCIÓN DEL MEDIO AMBIENTE (PTAPMA)», que se tramita en el expediente legislativo número 25.303, en cuanto a su articulado, no contiene vicios esenciales de procedimiento o disposiciones de fondo que lo invaliden. \n\nVI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. San José, at nine thirty a.m. on 16 September 2026.\n\nMandatory legislative review of constitutionality submitted by the Board of the Legislative Assembly concerning the bill “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” which is being processed under legislative expediente number 25.303.\n\nBackground:\n\n1.- The review, submitted in compliance with Article 96(a) of the Law on Constitutional Jurisdiction, was received by the Chamber Clerk’s Office at 09:20 on 05 August 2026, together with a certified copy of the legislative expediente.\n\n2.- The President of the Chamber accepted the review by resolution issued at ten eleven a.m. on 5 August 2026.\n\n3.- The formalities established by law were observed in the proceedings.\n\nJustice Cruz Castro writes the opinion; and,\n\nReasons:\n\nI.- Subject and admissibility of the review.- This mandatory review of constitutionality was submitted by the Board of the Legislative Assembly in compliance with Article 10(b) of the Political Constitution and Article 96(a) of the Law on Constitutional Jurisdiction, concerning the bill “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” which is being processed under legislative expediente number 25.303, because it concerns legislative approval of an amendment to an international agreement. Since the cited bill was approved at First Debate in the Legislative Plenary, ordinary session No. 40 of 28 July 2026, by a vote of 53 in favor and 0 against, it is appropriate to consider it, in accordance with Article 98, paragraph 1, of the Law on Constitutional Jurisdiction. The first step in disposing of the review is to verify the procedure followed in this case, in accordance with Article 98 of the Law on Constitutional Jurisdiction, which provides that the review must be conducted after the bill has passed First Debate and before final approval, and that, in disposing of it, the Chamber will issue an opinion on aspects or grounds it considers relevant from a constitutional standpoint, but that opinion is binding only with respect to procedure. (See legislative expediente.)\n\nb) On 17 November 2025, at the initiative of the Executive Branch and by means of an official letter signed by the acting Minister of the Presidency, the bill “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA)” was submitted to the Secretariat of the Board of the Legislative Assembly for the corresponding proceedings (legislative expediente).\n\nc) The bill was published in the official gazette La Gaceta No. 233, Supplement No. 158, on 11 December 2025 (legislative expediente).\n\nd) On 11 December 2025, it was placed on the agenda of the Permanent Special Committee on International Relations and Foreign Trade (legislative expediente).\n\ne) At a session of the Permanent Special Committee on International Relations and Foreign Trade, a motion was approved to consult several institutions. (Legislative expediente.)\n\nf) On 15 December 2025, the Legislative Assembly’s Department of Studies, References and Technical Services prepared Legal Report AL-DEST-IJU-426-2025 concerning the bill under review (legislative expediente).\n\ng) Then, at its session of 11 June 2026, the Permanent Special Committee on International Relations and Foreign Trade issued a unanimous favorable report on the bill under review (legislative expediente);\n\nh) At Ordinary Plenary Session No. 40 of the Legislative Plenary, on Tuesday, 28 July 2026, EXPEDIENTE No. 25.303, “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” was approved at First Debate by a vote of 53 deputies in favor and 0 against. It was then ordered referred to the Constitutional Chamber for mandatory review (legislative expediente);\n\ni) On 30 July 2026, the final text of the bill “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” being processed under legislative expediente number 25.303, was submitted (see legislative expediente).\n\nj) By an order delivered on 05 August 2026, the President of the Legislative Assembly, together with the First and Second Secretaries, sent a copy of expediente No. 25.303, “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” to the Constitutional Chamber Clerk’s Office (legislative expediente).\n\nIn accordance with Article 98 of the law governing this Jurisdiction, this Court reviewed the legislative procedure for processing the bill “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” which is being processed under legislative expediente number 25.303. It is observed that, after Costa Rica acceded to the Antarctic Treaty through Law No. 10.266 of 25 May 2022, the Executive Branch proposed completing the Treaty by approving the Protocol to that Treaty. The statement of reasons indicates:\n\n“The Madrid Protocol, which entered into force on 14 January 1998, ‘was designed around a core set of environmental principles, with a series of Annexes establishing more detailed rules and provisions. This approach makes it possible not only to update the Annexes to adapt them to changes in environmental awareness and management practices, but also to add annexes as the need arises.’”\n\nThe Appendix to the Protocol forms an integral part of the Protocol to the Antarctic Treaty on Environmental Protection, as its own text provides. Accordingly, it is legally necessary to state that the Protocol is structured in twenty-seven (27) articles and an Appendix on Arbitration consisting of thirteen (13) articles, so as to ensure precision as to its normative content and clearly establish that the accession bill encompasses the entire international instrument.\n\n“By ratifying the Protocol, Costa Rica strengthens its credibility as a responsible State that respects international law and multilateral agreements.”\n\nAfter it was submitted to the Secretariat of the Board of the Legislative Assembly, the bill was sent to the Permanent Special Committee on International Relations and Foreign Trade, where it was referred to several institutions for consultation and subsequently received a unanimous report. In addition, in compliance with the principle of publicity, the bill’s text was published. It was also established that the bill under review was approved at First Debate by a majority of 53 deputies, meeting the absolute majority required by Article 121, paragraph 4. Thus, no infringement of the legislators’ rights and powers is observed, since the bill was considered by the Legislative Plenary as required because it concerned approval of a protocol to an international treaty and, to that extent, could not be delegated to a Legislative Committee with Full Legislative Powers, as provided by Article 124, paragraph 3, of the Political Constitution in relation to Article 121, paragraph 4, thereof. Accordingly, no defect is observed in relation to approval of the Protocol in question, in the processing of the bill, or any irregularity that would entail nullity for being contrary to the Law of the Political Constitution or to the principles and values informing it, or to the legislative procedure governed by the Rules of Procedure of the Legislative Assembly, which is a constitutional benchmark. Consequently, the bill “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” being processed under legislative expediente number 25.303, was given the legislative procedure that applied.\n\nIII.- Observations on the substance of the bill.- In accordance with Article 101 of the Law on Constitutional Jurisdiction, this Chamber’s opinion is binding only insofar as it establishes that the bill in question contains unconstitutional procedural steps. Further, as to the content of the various articles, the most relevant aspects of the agreement will be discussed, without analyzing each and every one of its articles, since, as a general matter, they are considered consistent with the Law of the Constitution (principles, values, rules). On the substance, this legislative initiative seeks for Costa Rica, as a signatory country to the Antarctic Treaty ratified by Law No. 10.266 of 2022, also to approve a Protocol that does not modify or amend the Antarctic Treaty, but develops and supplements it; the Protocol was signed in Madrid in 1991. Through the Antarctic Treaty, several countries agreed to the legal status of a “zone of peace and demilitarized zone” for that region and opened that declaration to the participation of the international community. Approval of this Protocol completes that declaration by also designating it a “natural reserve, devoted to peace and science,” with the Parties’ commitment to the “comprehensive protection of the Antarctic environment and dependent and associated ecosystems.” Thus, as the legal report in this expediente states, the Protocol “declares the creation or expansion of a specific legal status of environmental protection for this region of the world, together with the regulations, mechanisms, and procedures that this may entail.” In international law, the term “Protocol” is used for any agreement related to an earlier Treaty, whether to modify it or supplement it, as is the case here, where the Protocol develops or supplements the aforementioned Antarctic Treaty. Thus, this Protocol develops the Antarctic Treaty, but does not modify or amend it. Article 4(1) of this Protocol expressly and clearly provides: “This Protocol shall supplement the Antarctic Treaty and shall neither modify nor amend that Treaty.” It is therefore a Protocol that develops or supplements what has already been agreed. According to the summary prepared in the Legal Report, the following applies:\n\n“ARTICLE 1: DEFINITIONS\n\nAll definitions refer to concepts or bodies already established under the Antarctic Treaty itself. They present no difficulty or problem of any kind.\n\nARTICLE 2: OBJECTIVE AND DESIGNATION\n\nThrough this Protocol, Antarctica is designated a natural reserve, devoted to peace and science.\n\nIn a manner similar to a State designating part of its territory as a natural reserve or protected area, the intention at the international level has been to do so for Antarctica, reiterating or confirming what was already established by the original Antarctic Treaty.\n\nARTICLE 3: ENVIRONMENTAL PRINCIPLES\n\nIt declares the protection of the Antarctic environment to be a fundamental principle, and subjects activities that may be carried out in that area to that consideration, with the traditional principles of technically supported information, minimization of environmental risks, and prior and periodic assessments of any activity, giving priority to scientific activity and referring to the Treaty itself for the requirement of prior authorization.\n\nThis is a declaratory provision that provides guiding principles or criteria for authorizing activities in Antarctica.\n\nARTICLE 4: RELATIONS WITH THE OTHER COMPONENTS OF THE ANTARCTIC TREATY SYSTEM\n\nIn international law, the same term “Protocol” is used for another related Agreement, whether one of amendment or modification, or, as in this case, for the “regulation,” specification, or detailing of the obligations of a principal Treaty.\n\nTo the extent that this provision expressly gives the Protocol that second meaning (stating that it does not amend the principal Convention), and that it only supplements or regulates what has already been established, it limits the scope of its obligations to the Antarctic Treaty as the principal Convention.\n\nIt may therefore be stated that it does not create new obligations or commitments, but only develops them.\n\nARTICLE 5: COMPATIBILITY WITH THE OTHER COMPONENTS OF THE ANTARCTIC TREATY SYSTEM\n\nUnder the definition in Article 1(e), the other components of the Antarctic system are “the measures in force under that Treaty, its separate associated international instruments in force, and the measures in force under those instruments”; that is, all derived rules, not necessarily of conventional value.\n\nSince these are of lower rank, the superiority of all such rules over the principal Convention is not asserted; rather, there is a general duty to consult and cooperate to avoid inconsistencies.\n\nGiven the general character of the Protocol’s obligations, conflicts with other rules cannot arise. In any event, it sets out what could be a principle of interpretation and application, which is also inherent in any legal system: harmonious interpretation, or interpretation that seeks to reconcile rules that may appear contradictory or inconsistent.\n\nLike the preceding article, it establishes guiding criteria for applying and interpreting the Protocol’s rules.\n\nARTICLE 6: COOPERATION\n\nA general provision on cooperation between the Parties cannot be absent. Although it does not amount to a direct rule, because it is not specified to that degree, it is nonetheless a principle of conduct that must prevail beyond the political import of its statement.\n\nARTICLE 7: PROHIBITION OF ACTIVITIES RELATING TO MINERAL RESOURCES\n\nIt principally prohibits mining extraction, except for scientific research. This is perhaps one of the most important consequences of the entire declaration of the continent as a natural reserve. It “affects” the twelve countries with territorial “title” to the continent.\n\nBut it is obvious that the declaration, which is later subscribed to by the rest of the international community, constitutes an international commitment that goes beyond each State’s internal decision, and even beyond the decision of those members considered as a whole, since they have extended this declaration universally.\n\nARTICLE 8: ENVIRONMENTAL IMPACT ASSESSMENT\n\nRegardless of whether an impact is temporary or intense (since it may range from minimal), all authorized activities will require an environmental impact assessment, as also occurs under the domestic laws of States. This is a specific commitment that obviously applies only to those who “hold title” to or “administer” Antarctica.\n\nARTICLE 9: ANNEXES\n\nThis is a rule of the law of treaties, as the common rules that do not regulate substantive matters but only matters of the legal instrument itself are called. In this case, the “integral” status of the Annexes with the Treaty itself is expressly established.\n\nParagraphs 2 and 3 equate Amendments to the Protocol’s Annexes with the approval of derived rules under the Antarctic Treaty itself (Article IX), but, by requiring consensus of all the Parties, exclude legal problems related to that procedure.\n\nARTICLE 10: ANTARCTIC TREATY CONSULTATIVE MEETINGS\n\nIt provides for the same Antarctic Treaty consultative meetings to monitor and make decisions on implementation of the Protocol, likewise equated with derived rules of the principal Convention. This is a normal and natural decision that presents no problem of any kind.\n\nARTICLE 11: COMMITTEE FOR ENVIRONMENTAL PROTECTION\n\nIt creates the Protocol’s institutional structure: a Committee for Environmental Protection, comprising all Parties with the right to appoint experts. Since the Protocol has already entered into force, the Committee has already been established and has been operational since 1998.\n\nThe requirement to submit reports and the referral to the Committee itself to adopt its regulations or rules of procedure are entirely natural.\n\nARTICLE 12: FUNCTIONS OF THE COMMITTEE\n\nThe Committee’s functions are to provide technical advice to the Parties on all matters relating to environmental protection. Its functions are consultative and technical, and are in no case binding.\n\nARTICLE 13: COMPLIANCE WITH THIS PROTOCOL\n\nThis provision states the general duty of all Parties to comply with the Protocol, which is entirely natural and almost unnecessary to proclaim expressly, without prejudice to the political emphasis of a provision of this kind.\n\nARTICLE 14: INSPECTION\n\nThis article develops the possibility of technical inspections based on or referring to Article VII of the Antarctic Treaty, which already provides for them as a right of the Parties to ensure due compliance with the Treaty; that same mechanism is now extended to the purposes or implementation of the Protocol. This is not a new function, but something already undertaken under the principal Treaty, now extended to the implementation of the Protocol as well.\n\nARTICLE 15: EMERGENCY RESPONSE ACTIONS\n\nAs an additional mechanism, the Parties agree to adopt emergency response action protocols for a rapid response. These are left to each Party’s decision, subject to a general commitment to international cooperation.\n\nThis measure is obviously directly related to the Parties that have research stations or equipment in the area, and would practically have no relation to our country.\n\nARTICLE 16: LIABILITY\n\nThis provision is programmatic and, in keeping with modern developments in environmental law, the Parties undertake to adopt rules on liability for damage caused to the ecosystem. These may be adopted as Annexes under the procedures for adopting derived rules, both under the Convention and, by extension, under the Protocol.\n\nAdoption of those Annexes would be optional, not mandatory, which excludes fundamental legal problems.\n\nARTICLE 17: ANNUAL REPORT OF THE PARTIES\n\nThere is a specific obligation to provide a report on measures adopted to comply with the Protocol. As a non-original member, this commitment does not apply to our country insofar as it has no jurisdiction or claim over Antarctica.\n\nARTICLE 18: SETTLEMENT OF DISPUTES\n\nAll means of dispute settlement are provided for, both political and judicial, but always subject to agreement among the Parties involved, which excludes fundamental legal problems.\n\nARTICLE 19: CHOICE OF PROCEDURE FOR SETTLEMENT OF DISPUTES\n\nAs regards judicial means (arbitration or the International Court of Justice), when acceding to the Protocol, the Parties will state their willingness to be bound by these procedures.\n\nThe Protocol is submitted solely for approval, so this means that the country is not accepting any judicial means of dispute settlement at this time. This makes sense, given that its status as a third party or member of the international community without jurisdiction over Antarctica makes the possibility of a dispute arising unthinkable.\n\nHowever, under this article, failure expressly to designate a means automatically signifies acceptance of arbitration (paragraph 3), which obviously poses no problem, as it is the most traditional method of judicial dispute settlement in international law.\n\nARTICLE 20: PROCEDURE FOR SETTLEMENT OF DISPUTES\n\nIt provides for a kind of exhaustion of political means, or a period (12 months or one year), after which judicial means may be used.\n\nThis rule is common in international law, although the time period is less so; in any event, it entails no legal problems of any kind.\n\nARTICLE 21: SIGNATURE\n\nThe Protocol is open for signature by the Contracting States to the Antarctic Treaty. It is in that capacity that our country is now processing its accession.\n\nThis Protocol shall be open for signature by any State that is a Contracting Party to the Antarctic Treaty, in Madrid on 4 October 1991 and subsequently in Washington until 3 October 1992.\n\nARTICLE 22: RATIFICATION, ACCEPTANCE, APPROVAL OR ACCESSION\n\nAs an independent treaty, the Protocol must be ratified by the Parties in accordance with their own constitutional or domestic procedures.\n\nThe distinctive feature of this provision is that it designates the Government of the United States as the depositary of the Protocol, unlike the principal Treaty.\n\nARTICLE 23: ENTRY INTO FORCE\n\nSince the Protocol entered into force in 1998, the rule applicable to our country would be that it begins to apply to our country 30 days after deposit of the instrument of ratification.\n\nARTICLE 24: RESERVATIONS\n\nReservations are not permitted. This is an express and specific provision that requires no further comment.\n\nARTICLE 25: MODIFICATION OR AMENDMENT\n\nIt refers to Article XII of the Antarctic Treaty for the procedure for adopting Amendments, which require consensus. A particular feature is that if an amendment is adopted and a State does not accept it within two years, it is considered to have decided to cease being a Party to the Convention. A particularly stringent mechanism is retained for the decision to prohibit mining exploitation.\n\nSince this mechanism makes approval of each amendment subject to each Party’s domestic procedures, it excludes legal problems.\n\nARTICLE 26: NOTIFICATIONS BY THE DEPOSITARY\n\nThese are procedural rules for the Depositary, in keeping with the customary and traditional nature of its functions. They present no problem of any kind.\n\nARTICLE 27: AUTHENTIC TEXTS AND REGISTRATION WITH THE UNITED NATIONS\n\nAll official languages of the United Nations are authentic texts of the Protocol, including Spanish, which excludes legal problems.\n\nAPPENDIX TO THE PROTOCOL: ARBITRATION\n\nIt establishes procedural rules for the event that it becomes necessary to resort to this judicial mechanism for dispute settlement. It follows a common framework and presents no legal problems of any kind.”\n\nThe unanimous favorable report then states that the provisions of this Protocol do not create obligations for Costa Rica:\n\n“… they do not create new substantive obligations for Costa Rica, but detail and strengthen the principles already established in the Antarctic regime.\n\nAs to its international relevance, the document links the Protocol to several Sustainable Development Goals (SDGs), particularly SDG 13 on climate action, SDG 14 on life below water, SDG 15 on terrestrial ecosystems, and SDG 17 on partnerships to achieve the goals.”\n\nIn addition, the report states that Costa Rica’s accession to this Protocol has primarily symbolic and diplomatic value, as it reinforces Costa Rica’s international image as a country committed to sustainability, environmental protection, and international cooperation:\n\n“Regarding the Protocol’s content, the analysis highlights as central aspects the prohibition of mining activities, except those intended for scientific research; the obligation to conduct environmental impact assessments for any activity in the region; the creation of a Committee for Environmental Protection with technical and consultative functions; and the establishment of mechanisms for cooperation, inspection, emergency response, and dispute settlement. Many of these obligations fall primarily on States that maintain territorial claims or scientific infrastructure in Antarctica.\n\nAlthough accession to the Protocol produces no practical effects because the country has no territorial claims, scientific stations, or jurisdiction over Antarctica, accession has primarily symbolic and diplomatic value, as it reinforces Costa Rica’s international image as a country committed to sustainability, environmental protection, and international cooperation.\n\nTherefore, that report concludes with the following reasons for recommending approval:\n\n“Accession to the Protocol is fully consistent with Costa Rica’s historical record as a country committed to environmental protection and sustainable development. The establishment of a conservation model based on protected areas, the promotion of decarbonization policies, and leadership in international forums on climate change and biodiversity have made the country a global benchmark in environmental matters.\n\nIn this context, approval of the Protocol strengthens the consistency of Costa Rican foreign policy and reaffirms the country’s commitment to protecting global commons and promoting collective solutions to transnational challenges such as the climate crisis and biodiversity loss.\n\nAdditionally, accession is aligned with several Sustainable Development Goals of the 2030 Agenda, particularly SDG 13 on climate action, SDG 14 on life below water, SDG 15 on life on land, and SDG 17 on partnerships to achieve the goals, consolidating Costa Rica’s active participation in international efforts to ensure sustainable and inclusive development.\n\nFor all the foregoing reasons, approval of expediente No. 25.303 represents an opportunity to strengthen Costa Rica’s international leadership in environmental matters, support the protection of one of the planet’s most strategic and vulnerable ecosystems, and reaffirm the country’s historical commitment to peace, science, international cooperation, and sustainability.”\n\nFinally, the following was stated in the discussion during the parliamentary debate at First Debate:\n\nDeputy José Miguel Villalobos Umaña: “… This Protocol seeks to designate Antarctica as a natural reserve of humanity, devoted to peace and science. It is one of those documents that should not be subject to any debate. It is a universal tribute to a region that should belong to no one, because it belongs to everyone, and that should be devoted to peace and science.”\n\nDeputy Joselyn Sáenz Núñez: “This bill has enormous symbolic and practical value for Costa Rica because it reaffirms a national foreign policy based on peace, international law, science, and environmental protection—a long-standing Costa Rican tradition that we will always defend, uphold, and urge others to continue honoring.\n\nAntarctica is an exceptional continent. It is not only the coldest continent on the planet, but also a territory of approximately fourteen million square kilometers, 98 percent of which is covered in ice, containing approximately 90 percent of terrestrial ice and around 70 percent of the world’s fresh water.\n\nWhat happens in Antarctica affects every continent. Ocean currents that originate around this continent regulate the world’s climate, distribute nutrients in the oceans, and help stabilize the planet’s temperatures. That is why scientists often describe it as one of Earth’s great thermostats.\n\nThe great environmental and ecological-balance value Antarctica holds for the world is what makes it urgent for us to approve this bill.\n\n(…) That is why, in 1991, the Protocol to the Antarctic Treaty on Environmental Protection was adopted; it entered into force in 1998. It is one of the most advanced environmental instruments in international law. It declares measures such as designating Antarctica a natural reserve devoted to peace and science, prohibiting mining for commercial purposes, requiring environmental impact assessments, protecting flora and fauna, regulating waste management and pollution prevention, and establishing strict rules for all human activities carried out there.”\n\nThus, having analyzed the content of the articles comprising the Protocol to the Treaty, this Constitutional Court considers that, in general terms, it is a typical Protocol, substantially consistent with the fundamental provisions, values, and principles of the Law of the Constitution. Accordingly, it concludes that the content of the Protocol under review is consistent with the Law of the Constitution, on the terms recognized by this Chamber.\n\nV.- Conclusion. In light of the foregoing, the review is disposed of in the sense that the bill “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” being processed under legislative expediente number 25.303, contains no essential procedural defects or substantive provisions that invalidate it.\n\nVI.- DOCUMENTATION SUBMITTED TO THE EXPEDIENTE. The parties are advised that if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must collect it from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not collected within this period will be destroyed, as provided in the “Regulations on Electronic Expedientes before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe review is disposed of in the sense that the bill “APPROVAL OF THE REPUBLIC OF COSTA RICA’S ACCESSION TO THE PROTOCOL TO THE ANTARCTIC TREATY ON ENVIRONMENTAL PROTECTION (PTAPMA),” being processed under legislative expediente number 25.303, contains no essential procedural defects or unconstitutional provisions.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
