"summary_en": "The Constitutional Chamber (Sala Constitucional) granted the amparo application because the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) incurred an unreasonable delay in processing an application for new potable-water service filed on 22 May 2026. Although the institution maintained that the construction permit required by its regulations was missing, its request for that document was communicated on 9 September 2026, more than three months after the application was filed and only in connection with the amparo proceeding. Moreover, the ICAA did not establish that it had issued a final decision. The Chamber treated the matter as an exception to its general practice of referring disputes over administrative deadlines to the administrative-litigation jurisdiction because the application concerned connection to potable-water service and allegedly had not been addressed within a reasonable period. It ordered the officials concerned to issue a final decision and notify the applicant within one month, and ordered the ICAA to pay costs, damages, and losses.",

She indicates that they need to be in San José because her uncle, [Nombre 002], identity card [Valor 006], who is an older adult, has cancer and must travel constantly to Hospital Calderón Guardia and Hospital México for chemotherapy and radiation therapy. She states that water availability was approved and that she began the new-service process on 22 May 2026, under application number [Valor 004], which was approved and accepted. She recounts that she was told personnel would visit to determine where the meter would be installed, and they did in fact mark the location on the sidewalk, but more than three months have passed and it has still not been installed. She adds that on 25 August she went to the AyA facilities in Guadalupe, as she had on other occasions, and although she explained her situation, she was told that the process was taking time because they had few staff members under contract and that it was in progress and she simply had to wait, but they gave her no date. She considers it implausible that, for an essential service, they lack the personnel needed to complete the corresponding installation.\n\n2.- By decision issued at 12:55 p.m. on 8 September 2026, the Presidency of the Chamber admitted the proceeding and requested a report from the executive president and the head of the Guadalupe Office, both of the Icaa.\n\n3.- In a written submission incorporated into the case file on 14 September 2026, Lourdes Suárez Barboza, executive president of the Icaa, reports: “In response to the situation at issue in the amparo application filed by Ms. [Nombre 001] against the Instituto Costarricense de Acueductos y Alcantarillados, based on the technical reports prepared by José Román Naranjo Venegas, an employee of the UEN Servicio al Cliente Zona IV GAM, through memorandum N°UEN-SCZIV-GAM-2026-00622 dated 09 September 2026, and by Verónica Alvarado González, an employee of the UEN Servicio al Cliente Medición GAM, through memorandum N°UEN-SCMED-GAM-2026-01853 dated 11 September 2026, and the annexes thereto, which are attached as evidence supporting this report, as well as the scope of the applicable rule established in the Reglamento para la Prestación de los Servicios de AyA, the following has been demonstrated: 1. The New Service application was processed by the interested party through the Plataforma de Servicios de Guadalupe, which entered the corresponding application into the system on 22 May 2026 under number [Valor 004], cadastral plan (plano catastro) [Valor 003], property registration [Valor 002], in the name of [Nombre 001], to obtain a Potable Water service associated with the property located at [...]. The application at issue was received by the Área de Inspección de Factibilidad on 27 May 2026; it immediately proceeded to verify compliance with the requirements established in Articles 67 and 68 of the Reglamento de Prestación de los Servicios de AyA, published in the Diario Oficial La Gaceta No. 27, Alcance No. 29 of 9 February 2021, Board of Directors Resolution 2020-0442, and its amendments. On 05 March 2026, an application had previously been filed for this project and assigned N°P14132026030004, which was rejected because no construction permit was submitted, since the project was under construction. Consequently, correction of that omission was required, notice of which was provided through official letter N°UEN-SCMED-GAM-DyNS-2026-273, sent on 24 April 2026 to the email address [...]. Nevertheless, on that occasion the interested party did not comply with the requirement or submit the requested documentation within the applicable period, for which reason the file was closed. The application currently under review constitutes a new process related to the same project, with application N°P14132026030004 remaining as its prior record. On 10 June 2026, the file was scheduled for the corresponding feasibility inspection (Inspección de Factibilidad), to be conducted by inspector Olman Solís Hidalgo and Gerson Chavarría, employees of the UEN Servicio al Cliente Medición GAM, Nuevos Servicios y Disponibilidades de AyA, who state: ‘The interested party must submit a construction permit, prior record P14132026030004 (See report N°UEN-SCMED-GAM-2026-01854). The foregoing is evidenced by the following images: 3. CONCLUSIONS In view of the foregoing, it must be made clear that AyA’s actions are subject to the Principle of Legality enshrined in Article 11 of our Constitution and in the Ley General de la Administración Pública; this principle requires the entire Public Administration to act in accordance with the legal system, as well as with the unequivocal rules of science and technology recognized in Article 16 of the Ley General de la Administración Pública and within the scope governed by Articles 7, 8, 9, 67, 68, and 77 of the Reglamento para la Prestación de los Servicios de AyA. Accordingly, it is important to conclude that the protected person’s application could not be processed because the application was initially rejected for failure to submit the construction permit, and she was required to correct that omission; however, on that occasion the interested party did not comply with the requirement or submit the requested documentation. Therefore, the institution has not violated the applicant’s fundamental rights, and none of this Institute’s actions have been capricious, arbitrary, or unfounded.”\n\n5.- The legal requirements have been observed in the proceedings conducted.\n\nJustice Rueda Leal drafts the decision; and,\n\nReasons:\n\nI.- PRELIMINARY MATTER. Before examining the merits of the matter—concerning the alleged violation of the right to prompt and effective administrative proceedings—it must be clarified that, since judgment No. 2008-02545 issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa), with some exceptions, matters concerning whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, both for issuing a final administrative act deciding an administrative proceeding—initiated ex officio or at a party’s request—and for hearing the applicable administrative remedies. This case presents precisely such an exception, because it concerns an application relating to connection to the potable-water service that allegedly was not addressed within a reasonable period. Having clarified that point, the Chamber proceeds to decide the specific situation raised in this amparo.\n\nII.- SUBJECT MATTER OF THE APPLICATION. The applicant alleges that on 22 May 2026 she filed an application for a new potable-water service with the Icaa; however, as of the filing of the application, the corresponding installation had not been performed. She considers the elapsed period disproportionate.\n\nIII.- PROVEN FACTS. The following facts, which are important to the decision in this matter, are deemed duly established, either because they have been proven or because the respondent authority failed to address them as required in the initial order:\n\na) On 22 May 2026, the applicant filed an application for a new potable-water service with the ICAA. (Report of the respondent authority).\n\nb) On 10 June 2025, the file was scheduled for a feasibility inspection. (Report of the respondent authority).\n\nc) The Icaa authorities were notified of the order admitting this proceeding on 8 and 14 September 2026. (Service records added to the case file).\n\nd) On 9 September 2026, the Icaa notified the protected person of official letter no. UEN-SCMED-GAM-DyNS-2026-348 of that same date, in which it required her to: “1-Submit the construction permit issued by the corresponding municipal authority, which must match the project for which the confirmation of availability was requested (…)”. (Report of the respondent authority and documentary evidence).\n\nIV.- UNPROVEN FACT. It is deemed unproven, as relevant to the decision in this matter, that the Icaa issued a final decision on the protected person’s application.\n\nV.- THE SPECIFIC CASE. In the case at hand, the applicant alleges that on 22 May 2026 she filed an application for a new potable-water service with the Icaa; however, as of the filing of the amparo application, the corresponding installation had not been performed. She considers the elapsed period disproportionate.\n\nA review of the record establishes that, on 22 May 2026, the applicant filed an application for a new potable-water service with the ICAA. On 10 June 2025, the file was scheduled for a feasibility inspection. The Icaa authorities were notified of the order admitting this proceeding on 8 and 14 September 2026. On 9 September 2026, the Icaa notified the protected person of official letter no. UEN-SCMED-GAM-DyNS-2026-348 of that same date, in which it required her to: “1-Submit the construction permit issued by the corresponding municipal authority, which must match the project for which the confirmation of availability was requested (…)”.\n\nIn this regard, a violation of the protected person’s fundamental rights is established because the respondent authority incurred a disproportionate delay in deciding the application for a new potable-water service, which had been pending since May of this year.\n\nIndeed, it was only in connection with the processing of this amparo proceeding, more than three months after the application was filed, that the applicant was required to submit additional documentation; nevertheless, the record ultimately does not show that the respondent office issued a final decision on the application at issue.\n\nConsequently, the application is granted on the terms stated in the operative portion of this decision.\n\nVI.- NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the Administrative-Litigation Courts, and not this Chamber, must hear the legal dispute. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right may receive judicial protection through the amparo proceeding established by Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to modify its line of precedent, because, under Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 issued at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution—its values, principles, and rules—and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.\n\nVII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, object, or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve it within a maximum period of 30 business days from notice of this judgment. They are advised that any material not collected within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial” (approved by the Full Court under Article XXVI of session no. 27-11 of 22 August 2011 and published in Boletín Judicial no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Consejo Superior del Poder Judicial of 3 May 2012.\n\nTherefore:\n\nThe application is granted. Lourdes Suárez Barboza and Román José Naranjo Venegas, in their respective capacities as executive president and head of the Agencia de Guadalupe, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those offices, are ordered to undertake the appropriate coordination, adopt the necessary measures, and issue the corresponding orders within the scope of their respective authority so that, within a maximum period of ONE MONTH from notice of this judgment, a final decision is issued on the application filed by the amparo applicant and she is duly notified. The respondent authorities are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they must comply with or enforce and fails to comply with or enforce it shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs and damages caused by the facts on which this ruling is based, which shall be assessed during enforcement of the judgment in the administrative-litigation jurisdiction.
