"summary_en": "The Constitutional Chamber (Sala Constitucional) decided an amparo proceeding concerning complaints filed by a landowner whose property was allegedly suffering severe erosion from stormwater discharged through a culvert. Although disputes over administrative time limits ordinarily belong before the administrative-litigation jurisdiction, the majority applied an exception because the complaint concerned a risk to property and allegedly had not been resolved within a reasonable time. The Municipality of Paraíso had advised the applicant before the amparo proceeding that it lacked authority over the discharged water and that she should contact Oreamuno; the application was therefore denied as to Paraíso. Oreamuno, by contrast, issued its technical explanation only after being notified that the amparo had been admitted and failed to prove either formal notice of that document or another formal response to the complaint. The Chamber granted the amparo, ordered notice of the response within five days, and assessed costs, damages, and losses against Oreamuno, to be quantified during enforcement before the administrative-litigation jurisdiction.",

San José, at 9:20 a.m. on 24 September 2026.\n\nAmparo proceeding filed by [Name 001], identity card [Value 001], against the MUNICIPALIDAD DE OREAMUNO and the MUNICIPALIDAD DE PARAÍSO.\n\nBackground:\n\n1.- In a written submission filed with the Clerk’s Office of this Chamber at 2:26 p.m. on 12 August 2026, the amparo applicant filed an amparo application against the Municipalidad de Oreamuno and the Municipalidad de Paraíso. She states that she owns the property registered in the Province of Cartago under real property folio No. 184782-000, located in Paraíso de Cartago, Asentamiento La Pradera, in the upper area of calle El Cerro, land intended for construction, whose northern boundary adjoins a public road that serves as the territorial boundary between the cantons of Paraíso and Oreamuno. She recounts that, because this public road lacks gutters and suitable drainage systems, the entire volume of stormwater is discharged directly onto the northern boundary of her property through a culvert installed by the Municipalidad de Oreamuno. She states that, because there is no regulated outlet on the public road, this flow has caused severe water erosion on her land, opening an irregular transverse ditch, varying in depth from one meter to one and a half meters depending on the area, which crosses the lot from its northern boundary to its southern boundary. She adds that this phenomenon of scouring and continuous sediment transport worsens with each rainfall event, fragmenting and destroying the only portion of soil with sufficient firmness and suitable geotechnical characteristics for the future construction of a dwelling, which drastically diminishes the commercial value and use of her property. She states that she informed both respondent local governments of the situation, both orally and by email, explaining the matter and requesting their intervention, but neither municipal corporation has adopted the measures necessary to prevent this stormwater from entering her property. She attributes responsibility to the Municipalidad de Oreamuno because the water originates from its infrastructure, and to the Municipalidad de Paraíso for failing to provide her with due protection, insofar as the property is located within its jurisdiction. She alleges a violation of her fundamental rights to petition and receive a response, to health and life, given that the damage caused by uncontrolled stormwater constitutes a public-health hazard, and a violation of her rights to private property and to a healthy and ecologically balanced environment as a result of inadequate urban planning and negligent management of stormwater drainage systems. She further bases her claim on the municipalities’ legal obligation to construct and maintain stormwater-sewer infrastructure, as well as on the laws governing water, public roads, the municipal system, public health, and urban planning, and on precedents of this Chamber. She requests that the application be granted and that, as an urgent interim measure, the Municipalidad de Oreamuno de Cartago be ordered immediately to suspend the discharge of stormwater onto her property.\n\n2.- By order issued at 5:40 p.m. on 21 August 2026, this amparo proceeding was admitted for consideration, and reports were requested from the MAYOR AND THE HEAD OF THE ROAD MANAGEMENT TECHNICAL UNIT, BOTH OF THE MUNICIPALIDAD DE OREAMUNO, AS WELL AS FROM THE MAYOR, THE HEAD OF THE URBAN DEVELOPMENT DEPARTMENT, AND THE HEAD OF COMMERCIAL MANAGEMENT AND CUSTOMER SERVICE, ALL OF THE MUNICIPALIDAD DE PARAÍSO (see electronic record).\n\n3.- ERICK MAURICIO JIMENEZ VALVERDE, in his capacity as Mayor of the Municipalidad de Oreamuno de Cartago, reports under oath (see electronic record) that the official in charge of the Technical and Road Management Unit provided a technical report concerning the allegations made by the amparo applicant. The Municipality verified on site that water flows naturally because of the terrain conditions. The Municipality has neither altered nor modified the channels through which water flows across private properties. The applicant knew of the erosion problems because the gutter that collects wastewater may have existed for more than 9 years. The culvert collects stormwater without changing the natural effect of the water’s flow. The applicant knew of the problems affecting the land when she acquired the property registered in the Province of Cartago under real property folio 184782, Right 000. The area where the described property is located has always experienced stormwater runoff because of the topography of the land. He requests that the application be denied.\n\n4.- Michaell Álvarez Quirós, in his capacity as Mayor of the Municipalidad del Cantón de Paraíso, reports under oath (see electronic record) as follows: “REGARDING THE FACTS ALLEGED BY THE APPLICANT FIRST: Regarding the location of the property: This is true. The applicant owns property No. 184782-000, located in Asentamiento La Pradera, canton of Paraíso. SECOND: Regarding the source of the water and the infrastructure causing the damage: It is denied that the Municipalidad de Paraíso bears direct responsibility for the discharge of water. The applicant herself states in her submission that the volume of stormwater is discharged onto her property through a culvert installed directly by the Municipalidad de Oreamuno. Moreover, the technical inspection conducted confirmed that some of the surface water affecting the area originates from the road under the jurisdiction of the Municipalidad de Oreamuno. THIRD: Regarding the alleged municipal inaction and omission: It is categorically denied that the Municipalidad de Paraíso failed to act, remained inactive, or abandoned its duties. In response to the complaint, the Municipalidad de Paraíso conducted a joint site visit at calle El Cerro. Officials from the Municipalidad de Oreamuno and the former head of the Urban Development Department of Paraíso participated in this inspection, as did engineers Víctor Meza Calderón, Oscar Fernández Rodríguez, and Nelson Montenegro. During this visit, the situation was verified and alternatives for mitigating the problem were analyzed from technical and interinstitutional perspectives. II. MERITS Based on Technical Report MUPA-DEUR-INF-0004-2026, issued on 01 de September de 2026 by the Urban Development Department, we submit the following constitutional arguments to refute the applicant’s claims against our municipal corporation: A. Lack of Standing as a Respondent and Absence of a Causal Link on the Part of the Municipalidad de Paraíso: In constitutional jurisdiction, for an amparo application against an authority to succeed, there must be an irrefutable causal link between that authority’s action or omission and the injury to fundamental rights alleged by the applicant. In this case, no such link exists with respect to the Municipalidad de Paraíso. The technical evidence clearly establishes that the surface runoff originates, in part, from road infrastructure located within the jurisdiction of the Municipalidad de Oreamuno. Likewise, the applicant expressly attributes responsibility for the work to the Municipalidad de Oreamuno. Therefore, the alleged public-health risk and severe water erosion of the land originate from the actions of a territorial entity outside our administration. B. Diligent Administrative Action and Technical Reasonableness: The applicant alleges a violation of her right to petition and receive a prompt response, and a failure to protect her property due to alleged negligence. Nevertheless, the Paraíso administration acted in strict compliance with the principles of efficiency and interinstitutional coordination. An on-site visit was conducted to observe the behavior of the surface water. During that inspection, the feasibility of piping the water to redirect it to another point along the road was assessed. However, after applying technical standards of reasonableness and proportionality, that alternative was ruled out because it would create a concentration of water that could ultimately affect both the applicant’s property and adjoining land. The Municipalidad de Paraíso cannot carry out hastily planned works that transfer the damage or violate third-party rights; the duty to protect the environment and property requires decisions based on engineering criteria. C. Delimitation of Powers and Obligations Assumed by the Municipalidad de Oreamuno: Our corporation’s technical report expressly delimits its powers and records that the participation of the Urban Development Department of Paraíso was limited to inspection and intermunicipal coordination. Any potential measures concerning the section of road corresponding to Oreamuno must be evaluated by that municipality on the basis of its powers, budget, and technical criteria. Indeed, the handling of the matter showed that Mr. Carlos Núñez, an official of the Municipalidad de Oreamuno, had already directly informed the applicant of the alternatives that his institution would evaluate, such as making a surface cut upstream to reduce the flow directed toward the property. Within the Municipalidad de Paraíso, any potential intervention involving drainage works on the cantonal road network falls outside the authority of Urban Development and lies exclusively with the Road Management Technical Unit, under the applicable technical and administrative procedures. Therefore, the visit conducted by Urban Development did not constitute authorization, an order, or the assumption by the Municipalidad de Paraíso of responsibility or an obligation to carry out works. III. RELIEF REQUESTED The arguments and evidence submitted plainly demonstrate that the Municipalidad de Paraíso has not violated Ms. [Name 001]’s rights to health, life, private property, or a healthy and ecologically balanced environment. On the contrary, it actively performed coordination and technical-assessment functions, concluding that the original source of the water is located within the neighboring jurisdiction and that structural mitigation measures are being addressed by the Municipalidad de Oreamuno.”\n\n5.- According to a certification dated 16 de September del 2026 and signed by the Judicial Assistant and the Clerk of the Court, there was no record that, between 10 de September and 14 de September del 2026, the HEAD OF THE ROAD MANAGEMENT TECHNICAL UNIT OF THE MUNICIPALIDAD DE OREAMUNO, THE HEAD OF THE URBAN DEVELOPMENT DEPARTMENT, OR THE HEAD OF COMMERCIAL MANAGEMENT AND CUSTOMER SERVICE, THE LATTER TWO OF THE MUNICIPALIDAD DE PARAÍSO, had filed any submission or document in order to provide the report requested in the order issued at 5:40 p.m. on 21 August 2026 (see electronic record).\n\n6.- The statutory requirements have been observed in the proceedings conducted.\n\nJustice Cruz Castro authors the decision; and,\n\nReasons:\n\nI.- PRELIMINARY ISSUE: Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and effective proceedings—it must be clarified that, since Judgment No. 2008-02545 of 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa), subject to certain exceptions, matters involving disputes over whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude administrative proceedings—initiated ex officio or at the request of a party—by issuing a final administrative act or to decide the applicable administrative challenges. This case specifically presents an exception—supported by the majority of this Constitutional Court—because it concerns a complaint relating to a risk to property that allegedly was not resolved within a reasonable period. Having clarified the foregoing, the Chamber proceeds to decide the specific situation raised in this application.\n\nII.- SUBJECT MATTER OF THE APPLICATION: The applicant states that a public road to the north of her property serves as the territorial boundary between the cantons of Paraíso and Oreamuno. She states that she informed both respondent local governments of the situation, both orally and by email, explaining the matter and requesting their intervention, but neither municipal corporation has adopted the measures necessary to prevent this stormwater from entering her property.\n\nIII.- PROVEN FACTS. The following facts are deemed duly established and material to the decision in this matter, either because they have been proven or because the respondent authority failed to address them:\n\na) The applicant owns property No. 184782-000, located in Asentamiento La Pradera, canton of Paraíso (see report of the respondent authority).\n\nb) On 09 de May de 2022, the applicant filed a complaint with the Municipalidad de Oreamuno concerning the outlet of a stormwater pipe onto land she owns (see report of the respondent authority).\n\nc) On 19 de June de 2023, the applicant filed a complaint with the Municipalidad de Paraíso concerning the outlet of a stormwater pipe onto land she owns (see report of the respondent authority).\n\nd) By official letter GEM-DEUR-461-2025 dated 19 de June de 2025, the Municipalidad de Paraíso informed the applicant that it had no authority over the water discharged onto her property and that she should therefore contact the Municipalidad de Oreamuno (see report of the respondent authority).\n\ne) By official letter MUOR-AM-UTGV-398-2026 dated 01 de September de 2026, the Director of the Road Management Technical Unit of the Municipalidad de Oreamuno informed the applicant as follows: “As we informed Ms. [Name 001] by August of last year, it is not presently possible to eliminate the entire flow of water because, for topographical reasons, this is the outlet both for water coming from the other side of the road (Oreamuno sector) and for water coming from the side of the road in front of her property (Paraíso sector). She should have assessed this particular characteristic of the property when she purchased it because this watercourse has been formally established for more than 10 years and apparently has existed for as long as anyone can remember, because most of the land in the area consists of undeveloped rural properties and this is how water drains in such places. There is no formal record of when the Municipality made improvements by installing an inspection chamber and pipes to channel the water across the road (apparently they were constructed no less than 5 years ago), after which the water naturally drains through the interested party’s property. However, in engineering terms, this constitutes a mitigation measure for unchanneled water and a means of managing the preexisting natural flow. This plainly constitutes an improvement that prevents greater uncontrolled surface runoff and further soil erosion, rather than causing harm to the property owner; it is therefore clarified that, by installing the inspection chamber and piping system, the Municipality did not intend to cause harm but, instead, to help improve the surrounding area. A matter of public interest, which is also invoked on technical grounds, is involved: any improvement to the stormwater-sewer system, particularly along this street in front of the interested party’s property, which is classified as a local road and has a gravel surface, protects the road itself and the road safety and personal safety of those who live in or pass through the area. This watercourse must not be arbitrarily eliminated without the Municipalidad de Paraíso assessing the investment and completing a project to connect and channel the stormwater, extending it southward from those properties, as required by the topography” (see report of the respondent authority).\n\nIV.- THE SPECIFIC CASE: The reports submitted by the respondent authorities, which were given under the solemnity of an oath with the legal consequences that this entails, show that the applicant owns property No. 184782-000, located in Asentamiento La Pradera, canton of Paraíso. It was established that, on 09 de May de 2022, the applicant filed a complaint with the Municipalidad de Oreamuno concerning the outlet of a stormwater pipe onto land she owns. It was proven that, on 19 de June de 2023, the applicant filed a complaint with the Municipalidad de Paraíso concerning the outlet of a stormwater pipe onto land she owns. It was demonstrated that, by official letter GEM-DEUR-461-2025 dated 19 de June de 2025, the Municipalidad de Paraíso informed the applicant that it had no authority over the water discharged onto her property and that she should therefore contact the Municipalidad de Oreamuno. Finally, it was established that, by official letter MUOR-AM-UTGV-398-2026 dated 01 de September de 2026, the Director of the Road Management Technical Unit of the Municipalidad de Oreamuno informed the applicant as follows: “As we informed Ms. This watercourse must not be arbitrarily eliminated without the Municipalidad de Paraíso assessing the investment and completing a project to connect and channel the stormwater, extending it southward from those properties, as required by the topography.” In conclusion, it is true that the applicant owns property No. 184782-000, located in Asentamiento La Pradera, canton of Paraíso, and that she filed two requests concerning the flow of water through her property. For its part, the Municipalidad de Paraíso stated that it had no authority over the water discharged onto the applicant’s property and, by official letter GEM-DEUR-461-2025 dated 19 de June de 2025, instructed her to contact the Municipalidad de Oreamuno. The Municipalidad de Oreamuno, for its part, stated that “it is not presently possible to eliminate the entire flow of water because, for topographical reasons, this is the outlet both for water coming from the other side of the road (Oreamuno sector) and for water coming from the side of the road in front of her property (Paraíso sector). She should have assessed this particular characteristic of the property when she purchased it because this watercourse has been formally established for more than 10 years and apparently has existed for as long as anyone can remember, because most of the land in the area consists of undeveloped rural properties and this is how water drains in such places.” Based on the foregoing, and considering that the Municipalidad de Paraíso addressed the complaint filed on 19 de June de 2023 through official letter GEM-DEUR-461-2025 dated 19 de June de 2025, informing the applicant that it had no authority over the water discharged onto her property and that she should therefore contact the Municipalidad de Oreamuno—which occurred before notice was given of the order admitting this amparo proceeding—the application is inadmissible with respect to that authority. With respect to the Municipalidad de Oreamuno, however, it was demonstrated that the Director of the Road Management Technical Unit of the Municipalidad de Oreamuno did not issue official letter MUOR-AM-UTGV-398-2026 dated 01 de September de 2026, extensively explaining the situation reported by the applicant, until notice of the order admitting the application was given. Consequently, because there is no evidence that the cited official letter was served on the person protected by the amparo, nor is there a formal response to the complaint filed, the application must be granted on this point, under the terms set forth in the operative portion of this judgment. Accordingly, the application is granted.\n\nV.- SEPARATE NOTE OF JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a person seeking judicial relief alleges a violation of the right to prompt and effective justice in administrative proceedings, the Administrative-Litigation Courts, rather than this Chamber, must hear the legal dispute. However, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right is eligible for judicial protection through the amparo proceeding established by Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner believes that the Administration’s material conduct, its administrative acts, or its response is affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to modify its jurisprudence, because, pursuant to Section 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional cases that may properly be heard within this jurisdiction through the constitutional protective proceeding of amparo, in all other cases, and for the reasons given by this Court (Judgment No. 2008-02545 of 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.\n\nVI.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that, if they submitted any paper document, as well as any objects or evidence contained in any additional electronic, computerized, magnetic, optical, or telematic device or produced through new technologies, they must retrieve them from the Court within a maximum period of 30 business days from notice of this judgment. Otherwise, any materials not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe application is granted. ERICK MAURICIO JIMENEZ VALVERDE, in his capacity as Mayor of the Municipalidad de Oreamuno de Cartago, or whoever holds that office in his stead, is ordered to issue the appropriate instructions and make the necessary arrangements within the scope of his respective authority so that, within no more than FIVE DAYS from notice of this decision, official letter MUOR-AM-UTGV-398-2026 dated 01 de September de 2026 is served on the applicant. The respondent authorities are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced and who fails to comply with or enforce it shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Oreamuno de Cartago is ordered to pay the legal costs and the damages caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment in the administrative-litigation jurisdiction. As to the Municipalidad de Paraíso de Cartago, the application is denied. Justice Castillo Víquez files a separate note.
