"summary_en": "The Constitutional Chamber (Sala Constitucional), by majority, denied the amparo proceeding brought against the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) over the absence of drinking-water service in a Guápiles community. It found that the sector lacked a distribution network and hydraulic capacity and therefore required construction of a branch-line extension connecting it to the HC-A-14 Guápiles – La Rita – Roxana – Jiménez system. The ICAA had technically approved the design through document FRAC-AyA-2024-506, but there was no record that the interested parties had requested review of the materials or formal commencement of construction. The majority considered it reasonable to require interested parties to bear installation costs when service is prevented by missing infrastructure and found no arbitrary conduct. Justices Cruz Castro and Rueda Leal dissented: they would have granted amparo and ordered concrete, reasonable, and progressive measures to secure effective access to drinking water.",

"excerpt_en": "Against this background, the Chamber considers that the application must be denied. As the evidentiary record shows, there is no distribution network in the sector identified by the amparo applicant. Consequently, enabling the supply of drinking water from the HC-A-14 Guápiles – La Rita – Roxana – Jiménez system to the properties in that sector requires construction of a branch-line extension. In other words, a technical or formal impossibility currently prevents provision of the requested service.\n\nAs explained in the preceding consideration, when faced with a formal impossibility—namely, the absence of a water-distribution network—the Chamber has held that it is reasonable not to fulfill service requests or to require the interested party to bear installation costs when no drinking-water distribution network exists and infrastructure must be built. In such cases, this is understood not as a denial of access to drinking water but as an inability to provide it or as the interested party’s necessary participation in overcoming a technical impediment: the absence of infrastructure. Therefore, for the reasons stated, this Court does not find a violation of the protected person’s fundamental rights, and the amparo must accordingly be denied.",

San José, at 9:20 a.m. on 3 September 2026.\n\n Amparo proceeding being processed under case number 26-026093-0007-CO, filed by Nombre01, identity card CED02, against the COSTA RICAN INSTITUTE OF WATER SUPPLY AND SEWERAGE (INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, ICAA).\n\nBACKGROUND:\n\n1.- In a written submission filed with the Office of the Clerk of the Chamber at 21:02 on 20 July 2026, the amparo applicant filed an amparo application against the ICAA. The applicant states that access to drinking-water service has not been guaranteed in the community where the applicant resides (Barrio Los Nombre01, Guápiles), despite the numerous representations and requests that residents have submitted to the competent authorities and institutions. The applicant states that this situation has persisted for an extended period without an effective solution that would provide the community’s inhabitants with a regular water supply to meet their basic needs. The applicant indicates that the absence of service directly affects the living conditions of the families residing in the area, making it difficult to meet essential needs related to human consumption, food preparation, personal hygiene, and household cleaning. The applicant states that the lack of access to drinking water negatively affects the health and well-being of community residents by limiting access to a resource essential to life and disease prevention. The applicant adds that, despite the various efforts undertaken by residents to obtain a solution, they have received neither a satisfactory response nor any concrete measure capable of remedying the reported problem. The applicant requests that the application be granted, with the consequences prescribed by law.\n\n2.- By a decision of the President issued at 16:18 on 31 July 2026, the present proceeding was admitted for processing and served on the MANAGER OF THE LIMÓN BRANCH OF THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\n3.- In a written submission added to the digital case file at 13:14 on 13 August 2026, José Matarrita Cortés, in his capacity as director of the ICAA’s Huetar Caribe Region, reports under oath that: “(…) The area known as Barrio Los Nombre01 or Dirección02, where the applicant Nombre01 and the interested residents live, is accessible by a public road, which lacks hydraulic capacity; this means the existence of installed and operational infrastructure for supply and sanitation systems capable of conveying the flow volumes required for the effective provision of services. The absence of a distribution network means that, to enable drinking-water service from the HC-A-14 Guápiles – La Rita – Roxana – Jiménez system to the properties located in that area, a pipeline branch extension must be constructed in accordance with the applicable technical standards and regulations. SECOND: On 22 March 2018, a request was received from Nombre02 for an extension of a drinking-water pipeline branch to provide drinking water to the property recorded under cadastral plan PRN01 and real-property folio PRN02, as well as to provide service to another 14 homes located in the area in question. (see Annex 1). THIRD: Once the requirements had been verified, case number 2018-027 was assigned for the corresponding analysis and decision. Initially, technical report GSP-RHC-2018-00846 dated 7 May 2018 was prepared, which served as the basis for decisions GSP-RHC-P-2018-00441 and GSP-RHC-P-2018-00444, communicated to Nombre01 on 23 May 2018. Nombre02 collected that decision on 28 May 2018 (see Annex 2). On that occasion, he was informed of the supply system’s limited water capacity, which made it impossible to issue further confirmations of water availability for projects or pipeline branch extensions until the conditions required for an adequate supply were established. The case file was placed on a waiting list, and subsequently, in July 2018, he was invited to submit his consent to resume processing the case. In a written submission dated 17 July 2018, Mr. Nombre02 confirmed his interest in resuming the project to supply the property recorded under real-property folio PRN02. Indeed, on 19 July 2018, Nombre02 and Nombre03 submitted an additional written statement informing AyA of their interest in processing cases N°2016-111 and N°2018-027 together (see Annex 3). AyA also addressed this matter by issuing technical report GSP-RA-2018- 01621 dated 13 August 2018 (see Annex 4). As to the pipeline branch procedure itself, AyA proceeded to issue an assessment of the application in case N°2018-027, which resulted in technical report N° GSP-RA-2018-002401 dated 23 October 2028, certification of unavailability of services GSP-RA-P-2018-01083, and authorization to extend the pipeline branch GSP-RA-P-2018-01085, both dated 12 November 2018 (see Annexes 5, 6, and 7, respectively). FOURTH: On 30 September 2019, the interested parties submitted a proposal to AyA under which the residents would contribute one million colones, the municipality would provide machinery, and AyA would bear the remaining costs. As a result of that request, technical report N° GSP-RA-2019-02552 was issued on 18 October 2019 (see Annex 8) and was notified to Nombre02 by official letter GSP-RA-P-2019-00869 (see Annex 9). That report informed the interested party of the requirements for renewal and that the request itself did not constitute a renewal but rather an express inquiry as to whether AyA could contribute some of the materials for construction of the works; he was therefore informed that the interested party must bear the construction costs pursuant to Article 13 of the Reglamento para la Prestación de los Servicios de AyA. On 12 November 2019, a written submission was received from Nombre03 and other residents requesting the pipeline branch extension. That request was addressed through official letter GSP-RA-2019-03122 (see Annex 10) and communicated to the user through official letter GSP-RA-P-2019-01012 (see Annex 11). Upon receipt of the interested party’s renewal request, AyA issued new technical report N° GSP-RA-2020-00157, certification of unavailability of services N° GSP-RA-2020-00088, and certificate of water capacity N° GSP-RA-P-2020-00089 (see Annexes 12, 13, and 14, respectively). With the documents authorizing the pipeline branch extension, the interested parties then prepared the pipeline design under contract number Colegio Federado de Ingenieros y Arquitectos de Costa Rita OC N° 848720, which was not approved because corrections were required. The case file also contains a request for materials submitted by the Asociación de Desarrollo Específica Pro-Mejoras de La Emilia to the Municipal Council of the Municipality of Pococí. FIFTH: The CED01 case file having expired because approval of the pipeline branch design had not been obtained, the interested parties submitted a new request for a pipeline branch extension, which was assigned case N° 2024-006. To address that request, technical report N° GSP-RHC-2024-00152 dated 05 February 2024 was issued (see Annex 15), indicating that they could submit the corrections together with a new certificate of water capacity. For that purpose, certification of unavailability of services SIGDD-2024-003629-1-1-1 and the corresponding certificate of water capacity SIGDD-2024- 003629-1-2-1 were issued (see Annexes 16 and 17, respectively), and the decision was notified to email address ...01, the designated means for service. Once the interested parties corrected the observations made regarding the submitted design, this gave rise to a new design identified by CFIA contract number OC-1150719. The Instituto Costarricense de Acueductos y Alcantarillados issued document FRAC-AyA-2024-506 dated 15-11-2024, by which the proposed pipeline branch extension design was granted technical approval (see Annex 18). That approval is an indispensable requirement for proceeding with the physical execution of the works necessary to provide service to the area. As of the date of this report, there is no record of any communication from the interested parties requesting review of the materials or the formal commencement of construction of the approved works, a stage for which AyA remains fully prepared to provide the corresponding technical supervision and assistance. SIXTH: It is important to note that the decisions issued by AyA are not arbitrary but are based on technical criteria related to the operation of the supply system, the available hydraulic capacity, and compliance with the requirements established by the applicable regulations. SEVENTH: It should also be noted that the definition of service availability contained in the Reglamento para la Prestación de los Servicios de AyA requires the actual and current existence of sufficient infrastructure and water capacity to meet new demand. In this case, precisely because there is no distribution infrastructure on the public road providing access to the properties, it was determined that the proper mechanism was to process a pipeline branch extension pursuant to Article 14 of the same Regulations, which states: ‘If the public network does not reach the connection point, AyA shall, within a period not exceeding 15 days, propose to the owner or possessor the construction of a pipeline branch extension or other components of the hydraulic system, in accordance with the requirements specified by AyA in Article 39 of these Regulations through the corresponding technical study.’ EIGHTH: It is incorrect to assert that AyA has remained inactive or failed to address the requests submitted by residents of the area. To the contrary, the administrative case file shows that the institution has continuously addressed the various requests submitted since 2018, issuing technical reports, certificates of water capacity, certifications, response letters, and notices to the interested parties. Nor has the institution refused to analyze or process access to drinking-water service in the area. AyA’s actions have been directed precisely toward facilitating the technical procedure required to enable the future provision of service through construction of the missing infrastructure (…) The current lack of service is not attributable to an arbitrary or unjustified omission by the institution, but to the technical need to construct a pipeline branch extension to enable service in an area where no distribution infrastructure is installed. Under the Reglamento de Prestación de Servicios de AyA, the interested parties are responsible for constructing the necessary infrastructure, for which AyA will provide technical assistance in supervising the work, as well as any recommendations deemed appropriate.” He requests that the Chamber deny the application.\n\n4.- In a written submission added to the digital case file at 14:23 on 17 August 2026, the amparo applicant appeared to reiterate the allegations. The applicant requests that the Chamber grant the application.\n\n5.- In a written submission added to the digital case file at 10:34 on 27 August 2026, the amparo applicant appeared again to reiterate the allegations and request that this Chamber intervene on behalf of the persons protected by the amparo so that the ICAA may sign the agreement and thereby enable them to receive drinking-water service. The applicant requests that the Chamber grant the application.\n\n6.- The legal requirements have been observed in the proceedings.\n\n Justice Salazar Alvarado writes the opinion; and,\n\nREASONS:\n\nI.- SUBJECT MATTER OF THE APPLICATION. The amparo applicant states that access to drinking-water service has not been guaranteed in the community where the applicant resides (Barrio Los Nombre01, Guápiles), despite the numerous representations and requests that residents have submitted to the competent authorities and institutions. The applicant states that this situation has persisted for an extended period without an effective solution that would provide the community’s inhabitants with a regular water supply to meet their basic needs. The applicant adds that, despite the various efforts undertaken by residents to obtain a solution, they have received neither a satisfactory response nor any concrete measure capable of remedying the reported problem.\n\nII.- PROVEN FACTS. The following facts, which are relevant to the decision in this matter, are deemed duly established, either because they have been substantiated or because the respondent failed to address them as ordered in the initial order:\n\na) The area known as Barrio Los Nombre01 or Dirección02 is accessible by a public road, which lacks hydraulic capacity (see report submitted under oath and evidence provided).\n\nb) At that location, there is no installed and operational infrastructure for supply and sanitation systems capable of conveying the flow volumes required for the effective provision of services (see report submitted under oath and evidence provided).\n\nc) The absence of a distribution network means that, to enable drinking-water service from the HC-A-14 Guápiles – La Rita – Roxana – Jiménez system to the properties located in that area, a pipeline branch extension must be constructed (see report submitted under oath and evidence provided).\n\nd) On 22 March 2018, a request was received from Nombre02 for an extension of a drinking-water pipeline branch to provide drinking water to the property recorded under cadastral plan L-1143604-2007 and real-property folio PRN02, as well as to provide service to another 14 homes located in the area in question (see report submitted under oath and evidence provided).\n\ne) Through decisions N° GSP-RHC-P-2018-00441 and GSP-RHC-P-2018-00444, communicated to Nombre01 on 23 May 2018, he was informed of the supply system’s limited water capacity, which made it impossible to issue further confirmations of water availability for projects or pipeline branch extensions until the conditions required for an adequate supply were established (see report submitted under oath and evidence provided).\n\nf) On 30 September 2019, the interested parties submitted a proposal to AyA under which the residents would contribute one million colones, the municipality would provide machinery, and AyA would bear the remaining costs (see report submitted under oath and evidence provided).\n\ng) On 18 October 2019, technical report N° GSP-RA-2019-02552 was issued, informing the interested party that the interested party must bear the construction costs (see report submitted under oath and evidence provided).\n\nh) The ICAA issued document N° FRAC-AyA-2024-506 dated 15 November 2024, by which the proposed pipeline branch extension design was granted technical approval (see report submitted under oath and evidence provided).\n\ni) To date, there is no record of any communication from the interested parties requesting review of the materials or the formal commencement of construction of the approved works, a stage for which AyA remains fully prepared to provide the corresponding technical supervision and assistance (see report submitted under oath and evidence provided).\n\nIII.- TECHNICAL IMPEDIMENTS TO THE SUPPLY OF DRINKING WATER. In Judgment N° 2010-001516 issued at 18:36 on 26 January 2010, this Chamber addressed technical or legal impediments to providing drinking-water service. On that occasion, it held as follows:\n\n“IV.- On why a legal or formal impediment to providing drinking-water service does not violate fundamental rights.- This Chamber has repeatedly held that the supply of drinking water is regarded under Costa Rican law as a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under conditions of equality, and in a manner adaptable to technological changes (see, in this regard, Judgment 2001-09676 issued at 11:25 a.m. on 26 September 2001 and Judgment 2004-08161 issued at 10:53 a.m. on 23 July 2004). Accordingly, it is clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public service of drinking water, is also required to provide that service continuously, adaptably, efficiently, and equally to all inhabitants. Nevertheless, notwithstanding the foregoing, the case law of this Constitutional Court has also held that, when there is a legal impediment (failure to comply with requirements established in the applicable regulations) or a formal impediment (the lack of a Water Distribution Network), it is reasonable not to grant service requests or to require the interested party to bear the installation costs where no drinking-water distribution network exists and infrastructure must be constructed. Thus, in such cases, it is clear that this does not constitute a denial of access to drinking-water service, but rather an inability to provide it or the necessary participation of the interested party in overcoming a technical impediment, namely, the lack of infrastructure. Of course, AyA, as a state entity principally responsible for providing drinking-water service, has an obligation to continue expanding its infrastructure so that more and more people have access to this precious resource; however, while gaps remain, the cooperation of the interested parties is indispensable (see decisions Nº 2006-014218 issued at 3:04 p.m. on 26 September 2006 and Nº 2007-11190 issued at 2:36 p.m. on 7 August 2007). In other words, provided that the failure to provide drinking-water service is not capricious, arbitrary, or unfounded but is instead justified by a legal or material impediment, there is no violation of fundamental rights.”\n\nIV.- THE SPECIFIC CASE. In the matter under review, the amparo applicant alleges that access to drinking-water service has not been guaranteed in the community where the applicant resides (Barrio Los Nombre01, Guápiles), despite the numerous representations and requests that residents have submitted to the competent authorities and institutions. The applicant states that this situation has persisted for an extended period without an effective solution that would provide the community’s inhabitants with a regular water supply to meet their basic needs. The applicant adds that, despite the various efforts undertaken by residents to obtain a solution, they have received neither a satisfactory response nor any concrete measure capable of remedying the reported problem. In this regard, the Chamber finds it established that the area known as Barrio Los Nombre01 or Dirección02 is accessible by a public road, which lacks hydraulic capacity. At that location, there is no installed and operational infrastructure for supply and sanitation systems capable of conveying the flow volumes required for the effective provision of services. The absence of a distribution network means that, to enable drinking-water service from the HC-A-14 Guápiles – La Rita – Roxana – Jiménez system to the properties located in that area, a pipeline branch extension must be constructed. On 22 March 2018, a request was received from Nombre02 for an extension of a drinking-water pipeline branch to provide drinking water to the property recorded under cadastral plan L-1143604-2007 and real-property folio PRN02, as well as to provide service to another 14 homes located in the area in question. Through decisions N° GSP-RHC-P-2018-00441 and GSP-RHC-P-2018-00444, communicated to Nombre01 on 23 May 2018, he was informed of the supply system’s limited water capacity, which made it impossible to issue further confirmations of water availability for projects or pipeline branch extensions until the conditions required for an adequate supply were established. On 30 September 2019, the interested parties submitted a proposal to AyA under which the residents would contribute one million colones, the municipality would provide machinery, and AyA would bear the remaining costs. On 18 October 2019, technical report N° GSP-RA-2019-02552 was issued, informing the interested party that the interested party must bear the construction costs. The ICAA issued document N° FRAC-AyA-2024-506 dated 15 November 2024, by which the proposed pipeline branch extension design was granted technical approval. To date, there is no record of any communication from the interested parties requesting review of the materials or the formal commencement of construction of the approved works, a stage for which AyA remains fully prepared to provide the corresponding technical supervision and assistance. Given these circumstances, the Chamber considers that the application must be denied. As is apparent from the body of evidence, there is no distribution network in the area identified by the applicant, meaning that, to enable drinking-water service from the HC-A-14 Guápiles – La Rita – Roxana – Jiménez system to the properties located in that area, a pipeline branch extension must be constructed. In other words, there is currently a technical or formal impediment to providing the requested service. As explained in the preceding reason, when there is a formal impediment (the lack of a Water Distribution Network), the Chamber has held that it is reasonable not to grant service requests or to require the interested party to bear the installation costs where no drinking-water distribution network exists and infrastructure must be constructed. Thus, in such cases, it is clear that this does not constitute a denial of access to drinking-water service, but rather an inability to provide it or the necessary participation of the interested party in overcoming a technical impediment, namely, the lack of infrastructure. Therefore, for the reasons stated, this Court does not find that the fundamental rights of the person protected by the amparo have been violated, and the amparo must consequently be denied.\n\nV.- DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, WRITTEN BY THE FORMER. Based on the considerations set out below, we believe that this application should be granted. In the majority’s view, the judgment denies the amparo because the challenged refusal, in its opinion, is not attributable to arbitrary or discriminatory conduct but is instead based on technical criteria; however, it fails to give adequate weight to the fact that access to drinking water is a fundamental right indispensable to life, health, and human dignity.\n\nArticle 21 of the Political Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution imposes on the State the duty to guarantee the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—as interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to adopt positive measures for its full realization. The State is subject to a heightened obligation in a social and democratic state governed by the rule of law; for this reason, the supply of water is a priority obligation of public authorities.\n\nThe public-service provider cannot merely note the system’s deficiencies; it has a legal duty to plan, anticipate, and implement the actions necessary to guarantee progressive access to water service, especially where water for human consumption is concerned.\n\nThis is not a matter of requiring the impossible, but of requiring the adoption of reasonable, alternative, or progressive measures so that people are not left without protection.\n\nWater is not just another service; it is an essential human right. The respondent entity therefore cannot disregard its duty to guarantee that right by invoking technical limitations without offering effective solutions.\n\nFor these reasons, we believe that the application should be granted, at least to order the adoption of concrete and progressive measures that would guarantee, within a reasonable period, effective access to drinking water for the party protected by the amparo. Water is a fundamental good and right whose effective enjoyment must be ensured; this is an unavoidable duty.\n\nVI.- DOCUMENTATION SUBMITTED TO THE CASE FILE. This Chamber must advise the parties that, if they submitted any paper documents, objects, or evidence stored on any additional device or by electronic, computer, magnetic, optical, telematic, or new-technology media, those items must be collected from the Court’s offices within thirty business days after notice of this judgment is received; otherwise, all such items will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at Session N°27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial N°19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at Session N°43-12 held on 03 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe application is denied.
