"summary_en": "The Constitutional Chamber (Sala Constitucional) summarily rejected the amparo application filed by the Director of Territorial Development of the Municipalidad de Zarcero, who alleged failures to answer numerous municipal requests concerning, among other matters, territorial planning, Environmental Fragility Indices, road infrastructure, urban control, and citizen participation. To determine admissibility, the Chamber ordered the applicant to identify the email address to which she had sent official letter MZ-DDT-OF-0062-2026. Although she filed a response identifying the institutional account from which she sent the letter and supplying information about its recipients, follow-up, and formal reiteration, the Chamber found that she had not expressly identified the address to which it was sent. The Chamber regarded that information as essential to its admissibility determination and deemed its order unfulfilled. Applying Article 42 of the Ley de la Jurisdicción Constitucional (Constitutional Jurisdiction Law), it rejected the amparo at the threshold without deciding the merits of the alleged administrative omissions.",

To examine the admissibility of this amparo, the applicant was required to comply with the order issued by this Court in the ruling entered at 10:16 on 04 de setiembre de 2026 [4 September 2026], which was served in accordance with the Judicial Notifications Law. Nevertheless, the order was not fulfilled within the specified period because, although the applicant submitted statements in response to it, she did not expressly tell this Chamber “to which email address she sent official letter MZ-DDT-OF-0062-2026,” as the order required. That information is essential to determine the application’s admissibility. In view of the foregoing, the order is deemed unfulfilled. [PRUEBA 12]. [PRUEBA 12]. [EVIDENCE 12]. \n\nSEVENTH: MZ-DDT-OF-0173-2026 \n\nOn 17 June 2026, official letter MZ-DDT-OF-0173-2026 was submitted to the Mayor’s Office, requesting authorization to publish informational and awareness posters on institutional social media accounts. [EVIDENCE 7]. The matter appears as pending in the document table as of 7 July. [EVIDENCE 12]. \n\nEIGHTH: MZ-DDT-OF-0176-2026 \n\nOn 18 June 2026, materials prepared for training processes were sent to the Mayor’s Office, and their assessment and approval for possible institutional use were requested. [EVIDENCE 8]. The matter appears as pending assessment as of 7 July. [EVIDENCE 12]. \n\nNINTH: MZ-DDT-OF-0177-2026 \n\nOn 18 June 2026, the Mayor’s Office was informed of the condition of the institution’s drones and the need to assess administrative action concerning that equipment. [EVIDENCE 9]. The matter appears in the list of pending matters as of 7 July. [EVIDENCE 12]. On 5 August 2026, a follow-up was sent indicating that, as of that date, no communication had been received regarding the analysis of, instructions concerning, or decision on the matter. [EVIDENCE 9]. \n\nTENTH: MZ-DDT-OF-0178-2026 \n\nOn 18 June 2026, the final methodology for a citizen-participation process associated with the Urban Renewal Project for the central district was submitted to the Mayor’s Office for consideration, and approval for its implementation was requested. [EVIDENCE 10]. The matter appears as pending approval as of 7 July. [EVIDENCE 12]. \n\nELEVENTH: MZ-DDT-OF-0140-2026 \n\nThe evidentiary documentation includes official letter MZ-DDT-OF-0140-2026 and its transmission to the Mayor’s Office for follow-up on case files related to unlawful construction, demolition procedures, violation of seals, and actions associated with urban control. [EVIDENCE 6]. The table identifies this matter as pending as of 7 July. \n\nTWELFTH: MZ-DDT-OF-0199-2026 \n\nOn 2 July 2026, official letter MZ-DDT-OF-0199-2026 was submitted to the Mayor’s Office, requesting clarification and supplementation of a previous response concerning the legal basis of an administrative measure. [EVIDENCE 11]. On 5 August 2026, a follow-up was sent, expressly placing on record that, as of that date, no response had been received. [EVIDENCE 9]. \n\nTHIRTEENTH: MZ-DDT-OF-0225-2026 \n\nOn 20 July 2026, this Directorate formally informed the Mayor’s Office of pending administrative actions affecting implementation of the 2026 Work Plan. The official letter stated that several actions remained pending a response or the issuance of authorizations and instructions, and described the institutional risks arising from that situation. [EVIDENCE 12]. \n\nFOURTEENTH: Documented status of the matters. The evidence contains a table entitled “Matters submitted to the Mayor’s Office pending administrative action” and another table concerning reiterated pending matters identified in the follow-up email of 7 July 2026. \n\nThe latter identifies MZ-DDT-OF-0062 2026, MZ-DDT-OF-0072-2026, MZ-DDT-OF-0139-2026, and MZ-DDT-OF-0177-2026, while the table above also includes MZ-DDT-OF-0173-2026, MZ-DDT-OF 0176-2026, MZ-DDT-OF-0178-2026, and MZ-DDT-OF-0140-2026. [EVIDENCE 12]. This table establishes the documentary status as of 7 July 2026. It is not asserted that all those matters necessarily remained pending as of 10 August where there is no subsequent record. Where subsequent evidence exists, it is expressly identified, as in the cases of MZ-DDT-OF-0199-2026 and MZ-DDT-OF-0177-2026. (…) \n\nV. DOCUMENTED PATTERN OF FOLLOW-UP AND OMISSION\n\nThe evidence does not consist solely of isolated official letters. In several instances, there is a verifiable sequence comprising an initial request, proof of transmission, follow-up due to the lack of a response, and a formal reiteration. The clearest sequence concerns MZ-DDT-OF-0062-2026 and MZ DDT-OF-0072-2026: both were submitted in March, followed up on in April and May, and reiterated through MZ-DDT-OF-0156-2026, which expressly stated that no response had been received. [EVIDENCE 3 AND 4]. \n\nIn the case of MZ-DDT-OF-0199-2026, the evidence extends through 5 August and documents that the request for clarification and supplementation remained unanswered. [EVIDENCE 11]. \n\nThe substantive diversity of these matters does not eliminate the legally relevant element: when a matter constitutes a petition capable of receiving a response and has been submitted to the competent authority, the corresponding response must be issued within the applicable statutory period or, where no specific period exists, within a reasonable period in view of its nature. (…)”\n\n2.- By decision issued at 10:16 a.m. on 04 September 2026, the amparo applicant was ordered to cure the following deficiency: “(…) within THREE DAYS from notification of this decision, the applicant shall state the following: to which email address she sent official letter MZ-DDT-OF-0062-2026, given that this information cannot be inferred from the evidence submitted. (…)”. The applicant was advised that failure to do so would result in summary rejection of the application.\n\n3.- According to the notification record issued at 10:26 a.m. on 04 September 2026, the amparo applicant was notified at the electronic address specified in the initial filing.\n\n4.- In a filing added to the electronic case file at 4:23 p.m. on 04 September 2026, the amparo applicant stated the following: \n\n“(…) FIRST. COMPLIANCE WITH THE ORDER TO CURE \n\nThe order to cure requests identification of the email address from which official letter MZ-DDT-OF-0062-2026 was sent and submission of evidence establishing that it was sent, as well as any other additional evidence supporting the allegations. \n\nIn that regard, I state that official letter MZ-DDT-OF-0062-2026, dated 16 March 2026, was sent by the undersigned through institutional email from the address ...01, which I use in performing my duties as Director of Territorial Development of the Municipalidad de Zarcero. \n\nIt was sent on Monday, 16 March 2026, at 10:55 a.m., to Mr. Fabián Jiménez Rodríguez, Director of the Road Management Technical Unit, with copies to Ms. Gina María Rodríguez Rojas, Municipal Mayor, and other municipal officials. The subject line of the email is “OFFICIAL LETTER MZ-DDT-OF-0062-2026,” and the attachment is identified as “MZ-DDT OF-0062-2026 UTGV.pdf.” \n\nAttached as ANNEX 1 is a copy of the complete email by which it was sent, so that this Chamber may directly verify the sender’s email address, the date, time, recipient, copied recipients, subject line, and attached document. SECOND. FOLLOW-UP ON THE MATTER \n\nAs supplementary evidence, I submit the follow-up email dated 20 April 2026, by which the undersigned placed on record that no response had been received concerning official letter MZ-DDT-OF 0062-2026 and that the corresponding period had elapsed. \n\nThat follow-up is relevant because it establishes that sending the official letter was not an isolated action, but was subsequently followed up on formally due to the lack of a response. \n\nTHIRD. FORMAL REITERATION \n\nI also submit official letter MZ-DDT-OF-0156-2026, dated 29 May 2026, by which this Directorate formally reiterated the requests contained in official letters MZ-DDT-OF-0062 2026 and MZ-DDT-OF-0072-2026. \n\nThat official letter placed on record that, as of that date, the Directorate of Territorial Development had not received a formal response to the aforementioned matters. It also explained that the requested information was necessary for the traceability of administrative processes, institutional monitoring, interdepartmental coordination, and handling of matters related to roadway infrastructure, stormwater drainage, and public space. \n\nThe official letter was sent with a copy to Ms. Gina María Rodríguez Rojas, Municipal Mayor, and the situation had therefore been formally brought to her attention. (…)”.\n\n 5.- Article 42 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily reject an amparo application when defects existing at the time of filing have not been cured.\n\n Drafted by Justice Castillo Víquez; and, \n\nReasons:\n\nI.- INADMISSIBILITY OF THE APPLICATION. To enable examination of the admissibility of this amparo, the applicant was required to comply with the order to cure issued by this Court in its decision of 10:16 a.m. on 04 September 2026, which was served in accordance with the Ley de Notificaciones Judiciales. Nevertheless, the order to cure was not complied with within the specified period because, although the applicant submitted statements in response to that order, she did not expressly tell this Chamber “to which email address she sent official letter MZ-DDT-OF-0062-2026,” as requested in the order in question. That information is essential for deciding the admissibility of the application. In view of the foregoing, the order to cure is deemed not to have been complied with. Consequently, the application must be rejected in accordance with Article 42 of the Ley de la Jurisdicción Constitucional. \n\n II.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the Chamber’s offices within no more than 30 business days from notification of this judgment. Otherwise, any such material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\n The application is summarily rejected.\n\n \n\n \n\nFernando Castillo V.\n\nPresident\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.
