"summary_en": "The Constitutional Chamber (Sala Constitucional) denied an amparo application filed by three co-owners of land near Juan Santamaría International Airport. They attributed extreme noise, vibrations, fuel odors, damage to a home, and harm to health, rest, and the environment to afternoon and nighttime turbine and engine tests. The Chamber reiterated that an alleged environmental-rights violation, such as noise pollution, must ordinarily first be reported to the competent administrative authorities; this requirement does not amount to exhaustion of administrative remedies. It recognized two exceptions: matters of major scope and situations in which the authorities already knew of the alleged environmental threat or harm but took no action. Neither exception was established because no prior complaint existed, the matter lacked the required exceptional scope, and the authorities had not previously known of the allegations. A Ministry of Health inspection also determined that the applicants did not live at the stated location. Any request for expropriation had to be pursued, if appropriate, through the corresponding ordinary legality proceedings.",

"excerpt_en": "Consistent with the judgments cited above, it must be stated that this Chamber has emphatically indicated the need to file a prior complaint before it may hear matters involving alleged environmental issues, such as noise pollution. In this particular case, it is apparent that the applicant did not previously file a complaint with any of the respondent authorities. It is also important to note that neither of the two circumstances identified in the precedents is present: 1) a matter of major scope; or 2) a record showing that the competent authorities knew of the alleged situation threatening or causing environmental harm and took no action in response.\n\nFinally, none of these facts was reported to the authorities; nor do they concern a matter of major scope or one previously known to the respondent authorities. It should also be noted that the persons on whose behalf the amparo was filed do not live in the area identified in the complaint. It was further established that the applicants’ actual claim in filing this amparo is to obtain expropriation of their properties. This is not a matter for this Chamber to determine; instead, the applicants may raise any related claim, if they deem it appropriate, through the corresponding ordinary legality proceedings.\n\nAccordingly, because the applicants filed no formal complaint, neither of the two exceptional circumstances heard by this Court is present, and, in any event, it was established that the persons protected by the application do not live there, the appropriate disposition is to deny the application, as is hereby ordered.",

\n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at nine thirty-five a.m. on 17 September 2026.\n\n Amparo proceeding filed by Nombre01, identity card CED01, Nombre02, identity card CED02, and Nombre03, identity card CED03, against the DIRECCIÓN GENERAL DE AVIACIÓN CIVIL and the MINISTERIO DE SALUD.\n\nBackground:\n\n1.- In a brief filed with the Chamber’s Clerk’s Office at 10:18 a.m. on 19 February 2026, the amparo applicants bring an amparo proceeding against the Dirección General de Aviación Civil and the Ministerio de Salud. They state that they own a home located in Alajuela, San Antonio del Tejar, 700 meters east of the former radar facility of the Aeropuerto Internacional Juan Santamaría, in a densely populated area that, according to them, has been severely affected by airport operations. They allege that aircraft turbine and engine tests are frequently conducted in the afternoon and at night, when there is no commercial air traffic, and that they generate extreme levels of noise and vibrations that directly affect the peace, mental health, and safety of those living in the area. They maintain that the constant vibrations have affected the stability and structure of their home, caused accelerated deterioration, and disrupted rest and family life. They add that they frequently perceive strong odors of aviation fuel, causing them nausea, headaches, respiratory discomfort, and skin allergies, circumstances that they claim to have documented through medical and environmental reports. They consider that these conditions have created an unacceptable living environment inconsistent with adequate housing, infringing their rights to health, life, a healthy and ecologically balanced environment, privacy, peace, property, and human dignity. They request that the application be granted; that the respondent authorities be ordered to implement measures to bring the adverse effects to a permanent end; and that their homes and properties be declared to be of public interest and expropriated.\n\n2.- By an order issued at 11:04 a.m. on 27 February 2026, the proceeding was admitted for processing, and reports concerning the facts alleged by the applicants were requested from the Director General of Aviación Civil, as well as from the Minister and the Director of the Área Rectora de Salud de Alajuela, both of the Ministerio de Salud.\n\n3.- In an order issued at 3:47 p.m. that same day, a clerical error in the order admitting the proceeding was corrected with respect to the commission to serve notice on the Director of the Área Rectora de Salud de Alajuela.\n\n4.- In a filing added to the digital case file at 10:45 a.m. on 5 March 2026, Melandi Dayanna Azofeifa Ocampo, in her capacity as special judicial attorney-in-fact for the Dirección General de Aviación Civil, reported under oath that: “II. Technical opinions issued by the competent departments: The technical opinion issued by Mr. Luis Jiménez Campos, Acting Head of the Airworthiness Unit, contained in official letter number DGAC-DSO-AIR-OF-0270-2025 of 3 March 2026, states as follows: ‘(…) Although the issue of noise levels emitted by aircraft is indeed related to airworthiness, in the matter presented this Unit has no authority over it because, in principle, aircraft belonging to domestic and foreign operators that operate at the airport in question (AIJS) comply with the international ICAO standards—and therefore with the national regulations currently in force—regarding accepted noise levels. Under ICAO guidelines, all aircraft engaged in international air navigation operations must have a certification issued by the Civil Aviation Authority of the State of Registry concerning the noise level under different operating circumstances. That does not necessarily mean that the noise emitted, even within the established limits, is not disturbing or cannot cause problems such as those reported by the affected parties. A-Regulatory support. 1. ICAO International Standards. 1.1 Annex 16, Volume I, Part II, Aircraft Noise Certification. That ICAO annex establishes that the State of Registry is responsible for assessing and granting a Noise Certificate to each aircraft registered in that State, based on evidence that the aircraft complies with the applicable specified standards contained in said Annex 16, Volume 1 (permitted noise levels). Contracting States (ICAO Member States) must recognize the Noise Certificate granted by the State of Registry as valid. Such certificates apply to all aircraft used in international air navigation. Attachment 1 includes excerpts from Annex 16 demonstrating the foregoing. 2. National Regulations. Domestic operators. 2.1 RAC 02 Rules of the Air and Operational Directive DO-AIR-RAC21-0001-2025. ICAO standards concerning aircraft noise emissions have been incorporated into our regulations in RAC 02 Rules of the Air and, more recently, in Operational Directive DGAC-DO-AIR-RAC21-0001-2025, approved on 27 October 2025, for the purpose of updating our regulations to the current version of Annex 16 on environmental matters. Note: There is also a proposed regulation (RAC 21), which is already undergoing public consultation, that includes these matters, which are currently covered by the aforementioned Operational Directive. These requirements apply to nationally registered (TI) aircraft engaged in international air transport operations. Domestic operators whose fleets include foreign aircraft are likewise governed by these same guidelines, but in that case the Noise Certificates are issued by the relevant State of Registry and recognized by the Costa Rican State. Attachment 2 includes sections of the cited Operational Directive demonstrating its consistency with the standards of Annex 16 and, therefore, the same requirements. 2.2 RAC 119.70 Foreign Air Operators. All aircraft operated internationally to and from Costa Rica by foreign air operators are required by the DGAC to have the Noise Certificate required by ICAO. This is established in Regulation RAC 119.70 for Foreign Air Operators. This requirement is verified by this Airworthiness Unit during the foreign operator certification process and during subsequent additions of aircraft to the approved fleet. The DGAC provides each foreign operator with document 7F225, corresponding to the Operations Specifications, which lists the aircraft fleet approved to fly to Costa Rica. All of the foregoing completes the national regulatory framework and international standards concerning noise emitted by aircraft. 3. Conclusions: We understand that this case does not concern a particular aircraft, but rather all aircraft operations at the AIJS. Accordingly, this is an airport operations matter inherent in facilities of that kind. Noise and vibrations transmitted by aircraft, whether during overflight, takeoff, landing, or engine testing, are strong and could adversely affect or disturb populations located very close to the airport. The foregoing would have to be established through evidence specific to the case. As to the times when the noise allegedly occurs according to the affected parties, the Airworthiness Unit likewise has no authority over the schedules during which the airport operator permits engine-testing operations. (…)’ As noted above, the technical report establishes that this office has no authority over the planning, authorization, performance, or supervision of ground engine tests, airport operating schedules, operational noise management, or the activities of the airport operator. This is because the Airworthiness Unit’s sole function is to verify compliance with technical airworthiness requirements and international aircraft certifications. The technical analysis establishes that all domestic and foreign aircraft operating at the Aeropuerto Internacional Juan Santamaría comply with the noise standards established by the International Civil Aviation Organization, specifically Annex 16 of the International Civil Aviation Organization, Volume I (Noise Certification), RAC 02, Operational Directive number DO-AIR-RAC21-0001-2025, and RAC 119.70 for foreign operators. These rules require every aircraft to have a valid Noise Certificate issued by the State of Registry and recognized internationally. The report states that the office I represent verifies such compliance through the initial and continuing certification processes for air operators. The technical report emphasizes that the situation of populations located very close to airports is a phenomenon inherent in airport operations, not aircraft certification. Moreover, the office I represent regulates only technical aviation matters and has no authority to designate residential-use zones, conduct urban-impact studies, order expropriations or relocations, or authorize or deny land uses. In addition, in official letter number CETAC-OFGI-FG-OF-0172-2026 of 3 March 2026, Mr. Rodolfo Garbanzo Arguedas, Acting Inspector General of the Oversight Body for the Aeropuerto Internacional Juan Santamaria Management Contract, reported that, through official letter number OFGI-FG-OF-0170-2026, the Interested Operator of the aforementioned airport was asked to submit the corresponding report and evidence; the operator responded through official letter number GO-LE-26-234 of 3 March 2026, stating, insofar as relevant, the following: ‘(…) II. CONCERNING THE ACCOUNT OF FACTS ON WHICH THE ACTION IS BASED. The documents transmitted with the referenced official letters include the order issued at 11:04 a.m. on 27 February 2026 by the Constitutional Chamber (Sala Constitucional) of the Supreme Court of Justice, through which the amparo proceeding was referred to the DGAC and the alleged facts were detailed. 1- Concerning ownership of homes at the location: According to information contained in public records, the applicants are the registered owners of the rights described below: a) Nombre01, holder of identity card number CED04: i. Right 004 over property PRN01, which is classified as pastureland, with no survey plan indicated. ii. Right 007 over property PRN02, which is classified as land for construction, with survey plan A-0411053-1980. b) Nombre02, holder of identity card number CED05: i. Right 010 over property PRN01, which is classified as pastureland, with no survey plan indicated. c) Nombre03, holder of identity card number CED06: i. Right 008 over property PRN01, which is classified as pastureland, with no survey plan indicated. Nevertheless, although this information shows that the applicants participate in a co-ownership arrangement, it does not establish the existence of structures on the property, the nature of any such structures (whether they are of the residential type alleged), and/or the legal permissibility of constructing them at the location under any land-use restrictions that may apply in the area precisely because of the presence of the Aeropuerto Internacional Juan Santamaría (AIJS). All of this information is considered decisive for analyzing their allegations. 2- Civil aviation activities and engine tests: In accordance with the manuals and procedures that will be detailed in subsequent sections, AERIS is indeed aware that aircraft engine tests are conducted at the AIJS at various times, but with a clear limit requiring their completion before 11:00 p.m. Although the details will be provided below, a DGAC provision currently in force permits such tests during these time periods: (chart attached). Moreover, it is unclear what the applicants mean by “extreme levels” of noise or vibration, or which regulations or comparative parameters form the basis of these claims. 3- Concerning damage to structures caused by vibration: The applicants do not specify the evidentiary basis for their assertion that the structures they claim were built on their property have been affected by the alleged vibrations caused by engine tests. It bears noting that this assertion is scarcely credible because the propulsion systems of any aircraft would be incapable of producing vibrations strong enough to affect nearby buildings without affecting the structure of the aircraft itself. Moreover, the thrust produced by engines during engine tests is not directed toward any structure outside the airport, since, for reasons amply known to the DGAC, doing so would cause any object to be propelled away. 4- Concerning the habitability of the location and noise levels: The applicants allege that noise-level studies indicate that the acceptable levels for residential-use areas are exceeded; however, those studies have not been provided to AERIS, making it impossible to address them. On this same issue, and without prejudice to what will be stated regarding the procedures for conducting engine tests at the AIJS, it should be noted that the very nature of airport operations naturally or unavoidably entails industrial activity at the site. Nevertheless, the technical basis for the applicants’ assertion that the conditions exceed the applicable maximum requirements is unknown. 5-Concerning expropriations at locations near the AIJS: Finally, it is legally improper to equate this claim with, or seek to extend it to, a potential obligation to expropriate, because expropriation constitutes a public power vested exclusively in the State, exercised exceptionally to satisfy overriding public interests following a duly reasoned formal declaration of public or social interest, in accordance with the constitutional and statutory framework currently in force. It was precisely under those parameters that expropriation proceedings connected with the expansion of the AIJS were conducted in the past; those proceedings responded to objective, general, and strategic needs of the public airport service. That situation does not apply to the case at hand because the relief sought by the applicants does not serve a public purpose or collective need. Rather, it constitutes a strictly private claim arising from subjective dissatisfaction with the location of their home, a circumstance that could also be influenced by the property’s co-ownership status. Because these matters are private in nature, they cannot and must not be addressed through the exercise of expropriation powers or give rise to any liability on the part of the Administration. (…) The analysis of the information provided by Aeris Holding Costa Rica sociedad anónima and the registry data submitted establishes co-ownership by the applicants of properties (pastureland/land for construction), but not the existence, nature, use, or legal permissibility of residential buildings at the specific location; those matters—if such buildings exist—are not established in the official letters submitted. These elements are decisive in assessing the alleged impairment of “adequate housing,” and have not been demonstrated by the party making the allegation. Furthermore, it is established that engine/turbine tests are an inherent part of aviation operations and are expressly regulated by the office I represent, both through the airport’s operating procedures (MPO, Section 16.2)—coordination with the Operations Center/Aeris and ATC; tests at idle power when conducted at a parking position, with a five-minute time limit; and safety measures and location-based restrictions—and through aeronautical information publications (AIC) setting out schedules, conditions, and exceptional scenarios. This confirms that these are not discretionary practices, but regulated aviation operations conducted under operational-safety parameters. (The MPO and AIC cited in your text; AIC Series A No. 19/2023 is cited as the regulation currently in force, with time periods and exceptions.) At the regulatory level, Costa Rica incorporates and requires compliance with the International Civil Aviation Organization’s noise standards (Annex 16) for domestic and foreign aircraft (for example, DO-AIR-RAC21-0001-2025 and RAC 119.70), and recognizes the Noise Certificates issued by the State of Registry. The Dirección General de Aviación Civil verifies this compliance through operator certification and continuing-surveillance processes. This is precisely why the legal framework regulates—rather than prohibits—the tests by establishing conditions, schedules, locations, and responsibilities to mitigate risks, all of which are complied with at the Aeropuerto Internacional Juan Santamaría under the supervision of the office I represent (…)’.”\n\n4.- In a filing added to the digital case file at 8:53 a.m. on 6 March 2026, Mary Denisse Munive Angermüller and Víctor González Jiménez, respectively Minister and Director of the Área Rectora de Salud Alajuela 1, both of the Ministerio de Salud, reported under oath that: “(…) Report N°MS-DRRSCN-DARSA1-00234-2026, dated 02 March 2026, issued by the undersigned, Dr. Víctor González Jiménez, and Lic. Carolin Zeledón Téllez, respectively Director and Environmental Manager, both of the Área Rectora de Salud Alajuela 1, stated that there is no record of any complaint filed with that office by Ms. Nombre01, Ms. Nombre02, or Ms. Nombre03. It further stated that, to obtain additional information and properly address the case, an on-site inspection was conducted, during which it was established that the complainants do not reside at the specified address (San Antonio del Tejar, 700 meters east of the former radar facility of the Aeropuerto Internacional Juan Santamaría). Residents of the area were interviewed and stated that two of the applicants herein live in Dirección02, near the church and in barrio La Julieta, and that the third lives in downtown Alajuela. Accordingly, the alleged adverse effect is unknown because none of them resides at that location.”\n\n5.- The statutory requirements have been observed in the proceedings conducted.\n\n Justice Araya García authors the decision; and,\n\nReasons:\n\n I.- Subject matter of the application. The applicants allege that they own a home located near the Aeropuerto Internacional Juan Santamaría, in San Antonio del Tejar, Alajuela, and that airport operations, particularly turbine and engine tests conducted in the afternoon and at night, generate extreme levels of noise, vibrations, and fuel odors that affect their health, safety, rest, and the structure of their home. They maintain that the area is unsuitable for residential use and that remaining there poses a risk to their fundamental rights. They request the intervention of this Chamber so that the respondent authorities will resolve their situation and, if appropriate, expropriate their properties.\n\nII.- Proven facts. The following facts are deemed duly established and material to the disposition of this matter:\n\n1) Applicant Nombre01 holds right 004 over property PRN01 and right 007 over property PRN02; applicant Nombre02 holds right 010 over property PRN01; and applicant Nombre03 holds right 008 over property 2-93551. All these properties are located in the area near the Aeropuerto Juan Santamaría, but are classified as pastureland and land for construction (see evidence submitted in the case file).\n\n2) Under the Operating Procedures Manual, every engine or turbine test must be coordinated with the AERIS Operations Center, which coordinates with Air Traffic Services for final approval; when conducted at a parking position, the maximum duration is five minutes, the test must be conducted at idle power, under the air operator’s responsibility, and with the prescribed safety measures for persons, vehicles, equipment, and aircraft (see report submitted by the Dirección General de Aviación Civil and evidence provided in the case file).\n\n3) Aeronautical Information Circular AIC Series A number 19 establishes that tests at idle power are not subject to time restrictions and, if conducted at a position on the main or remote apron, are limited to a maximum of five minutes. For tests at medium or maximum power, the circular prescribes time periods and coordination requirements; between 23:00 and 06:00 hours, they are authorized only when the aircraft has a mechanical malfunction and requires emergency maintenance (see report submitted by the Dirección General de Aviación Civil and evidence provided in the case file).\n\n4) On 27 February and 2 March, both in 2026, the respondent authorities were served with the order admitting this proceeding (see certificates of service).\n\n5) As a result of this application, the Área Rectora de Salud Alajuela 1 conducted an on-site inspection at the address specified by the applicants and established that they do not live there. It reported that residents of the area stated that two of the applicants live in Dirección02, near the church and in barrio La Julieta, and that the third lives in downtown Alajuela (see report submitted by the authorities of the Ministerio de Salud).\n\nIII.- Unproven fact. The following fact is not deemed duly established: Sole fact. That the applicants filed any complaint with the respondent authorities concerning the facts alleged in the application.\n\nIV.- The specific case. In the sub lite, the applicants allege that they own a home located near the Aeropuerto Internacional Juan Santamaría, in San Antonio del Tejar, Alajuela, and that airport operations, particularly turbine and engine tests conducted in the afternoon and at night, generate extreme levels of noise, vibrations, and fuel odors that affect their health, safety, rest, and the structure of their home. They maintain that the area is unsuitable for residential use and that remaining there poses a risk to their fundamental rights. They request the intervention of this Chamber so that the respondent authorities will resolve their situation and, if appropriate, expropriate their properties.\n\nIn this regard, it should first be noted that it could not be established that the applicants had filed any complaint with the respondent authorities concerning the facts alleged in the application.\n\nOn this matter, this Chamber has repeatedly addressed the failure to file a complaint with the competent authorities concerning various types of situations, which is an essential prerequisite to seeking relief from this Chamber.\n\nIn that regard, in judgment number 2023-29457 issued at 12:50 p.m. on 10 November 2023, this Court ruled as follows:\n\n“V.- THE NEED TO FILE A COMPLAINT IN ENVIRONMENTAL MATTERS. As an initial matter, the Chamber considers it essential to make certain observations regarding the need to file a complaint in environmental matters.\n\nA review of the record shows that the Secretary General of SETENA emphasized the following key points in the attached report:\n\n‘After reviewing this Secretariat’s databases, no Environmental Assessment case file matching the stated characteristics was found (…) Nor was any request found from the petitioner to this office reporting any specific event; had such a request been found, it would have been forwarded to the Tribunal Ambiental Administrativo upon determining that there was no open Environmental Assessment case file.’\n\nRegarding this matter, this Chamber has held that, for an infringement or threat to environmental rights, whether generally or specifically, to be heard, the affected person must ordinarily have filed a complaint; the processing of that complaint must have established a threat or actual harm to the environment; and, despite that finding, the respondent administrative authorities must have failed to take any measure in response, thereby infringing the constitutional right enshrined in Article 50 of the Constitution. Thus, judgment No. 2016-007678 issued at 10:50 a.m. on 03 June 2016 ruled as follows:\n\n‘III.- MERITS. In its settled case law, this Constitutional Chamber has had the opportunity to rule on the precautionary principle in environmental matters, as well as on the State’s duty to ensure that all public or private projects are carried out under strict standards that prevent any harm to the environment. Accordingly, the State, through the institutions created for such purposes, must exercise prior and subsequent oversight of the manner in which work, construction, projects, or the activities of businesses and commercial establishments are carried out, in order to assure all persons subject to the Administration that such activities cause no environmental harm of any kind. Nevertheless, for the reasons stated, certain activities, such as mining, require environmental-impact studies and analyses before they may be conducted. For this purpose, professionals in each field perform technical investigations to determine whether the proposed activity could cause harm of that kind, based on the various laws governing environmental matters, including water, forestry, and mining law, among others. Subsequently, once environmental-viability or feasibility permits have been obtained, the administrative authorities must heed and promptly address complaints filed by persons who consider themselves affected by any of the aforementioned activities, whether a concession or private or commercial work, in order to initiate investigations capable of determining the truth of the complaints made. This, once again, requires relevant technical opinions. In other words, for this Chamber to establish an infringement of environmental rights, whether generally or specifically, the affected person must have filed a complaint; the processing of that complaint must have established that harm was actually being caused to the environment; and, despite this, the respondent administrative authorities must have failed to take any measure in response, thereby infringing the constitutional right enshrined in Article 50 of the Constitution.’ (Emphasis not in the original).\n\nLikewise, this Court has repeatedly held that it must not replace the active Administration in the exercise of its powers and is not a forum for processing complaints. In that regard, judgment No. 2023019540 issued at 09:30 a.m. on 11 August 2023 ruled as follows:\n\n‘III.- Subject matter of the application. The applicants complain that approximately 25 years ago, the Municipalidad de Carrillo used heavy machinery to dig a drainage ditch across private properties for water flowing from Barrio Santa Luisa, through Barrio Bambú, and into a protected area owned by INDER. They assert that they have been affected by environmental contamination caused by the discharge of sewage and by standing water that creates breeding grounds for disease-carrying mosquitoes, thereby affecting health and the environment.\n\n(…)\n\n VI.- Specific case.\n\n(…)\n\n In this regard, a review of the record establishes that the applicants have not submitted a formal written request to the respondent authorities concerning the problem described in their application. From this standpoint, they must be advised that this Chamber must not replace the active Administration in the exercise of its powers and is not a forum for processing complaints. The petitioners should bear in mind that the foregoing is not the same as exhausting administrative remedies, but is simply an acknowledgment that this Court must not directly replace the will of the Administration or supplant public offices in managing matters within their competence. Accordingly, the applicants may, if they so wish, formally submit their objections or claims in writing to the respondent authorities or pursue them through the ordinary courts, forums in which they may fully litigate the merits and assert their claims. In light of the foregoing, this amparo application is declared inadmissible.\n\n On this subject, the Chamber has stated that complaints such as those raised by the applicants in this amparo must first be filed with the appropriate authorities. Judgment No. 2017-020375 issued at 11:00 a.m. on 19 December 2017 stated as follows:\n\n‘II.- THE SPECIFIC CASE. In the sub lite, the applicants have come directly before this Court to report a problem concerning pollution caused by sewage being channeled through their properties and discharged into a river. However, the applicants’ own statements show that they have not filed any complaint with the competent authorities, in this case the Municipalidad de Flores de Heredia. As has repeatedly been stated, this Court must not replace the active Administration in the exercise of its powers and is not a forum for processing complaints, as judgment 2016-001150 issued at 2:30 p.m. on 26 January 2016 explains. These considerations apply to the case under review, because this Court finds no reason to depart from the position stated in that judgment or any grounds for assessing the situation presented differently. Therefore, even if the applicants consider it unnecessary, in situations such as this they must formally present the stated complaint to the respondent authorities before filing an amparo application, so that those authorities may take the appropriate measures to resolve the reported problem or, failing that, they may pursue their claim through ordinary legal proceedings. This is without prejudice to the applicants’ right to seek constitutional relief after an unreasonable period has elapsed without effective action by the Administration, provided that a fundamental right is threatened or infringed.’ (Emphasis not in the original). (See, similarly, judgments No. 2023004954 issued at 09:30 a.m. on 03 March 2023, 2023004299 issued at 09:15 a.m. on 24 February 2023, and 2022026246 issued at 09:45 a.m. on 04 November 2022, among others).\n\nNevertheless, notwithstanding what has been stated thus far, the Constitutional Court has reviewed applications in which a violation of the right to a healthy and ecologically balanced environment was established without requiring a prior complaint to have been filed. It has done so in two exceptional circumstances, namely: 1) when the matter is of great magnitude; and 2) when the record shows that the competent authorities were aware of the reported situation, which was threatening or causing environmental harm, and failed to take any measure in response. In that regard, judgment No. 2008-04786 issued at 12:35 p.m. on 27 March 2008 ruled as follows:\n\n‘II.- SUBJECT MATTER OF THE APPLICATION.- The applicant alleges that he contacted the Ministerio de Salud, Defensoría de los Habitantes, and other administrative bodies to report a pig farm located next to his home that produces foul odors, but they did not address his requests (…)\n\nIV.- CONCERNING THE ACTIONS OF THE MUNICIPALIDAD DE ALAJUELA.- In the matter before us, the Código Municipal requires the municipalities of each canton to ensure that persons subject to the Administration are guaranteed the genuine and effective enjoyment of the rights to health and a healthy environment. The documents submitted in the case file, as well as the report given under oath by the respondent Mayor, indicate that, once municipal officials appeared at the location at issue in this amparo proceeding and established that the activity lacked a municipal permit, they gave the owner of the pig farm eight days to obtain the applicable business license. However, the Chamber considers that the role of the Municipality must not be limited to acting only when it receives complaints of alleged irregularities. Rather, its duty is to guarantee, defend, and preserve everyone’s right to enjoy a healthy and ecologically balanced environment through continuous oversight of all activities carried out in the community. In this Chamber’s view, in this case the Municipalidad de Alajuela has shown itself incapable of enforcing the applicable laws and fulfilling its duty to guarantee the residents of the area the enjoyment of a healthy and ecologically balanced environment, with the resulting consequences for their health. Thus, although the respondent Municipality was fully aware that, within its territorial jurisdiction, a citizen was conducting an activity without the legally required permits—an activity that is inherently sensitive because it involves the handling of animals and waste—it merely gave the reported person eight days to bring the activity into compliance, thereby evading its responsibility to remain constantly vigilant regarding the actions carried out by community residents. It is thus apparent that the respondent Municipality did not even attempt to determine whether the activity caused any kind of pollution or discharged contaminated water. Such a determination was necessary in order to impose the sanctions required by law after affording the persons concerned the due process and right of defense to which they are entitled. Consequently, the Municipalidad de Alajuela took no action to determine whether the problem existed or whether it might be connected to the alleged health hazard repeatedly reported by the applicant. The application against the Municipalidad de Alajuela must therefore be granted because of the constitutional violations of Articles 50 and 21 of the Constitution.\n\nV.- CONCERNING THE ACTIONS OF THE MINISTERIO DE SALUD.- Although the State must respect individual rights, it must also safeguard the well-being of the community. Public Health and environmental protection are principles protected both at the constitutional level (Articles 21, 50, 73, and 89 of the Constitution) and under international law. In this case, the Ley General de Salud authorizes the Ministerio de Salud to adopt the corresponding health measures and impose sanctions. The Ministerio de Salud therefore has not only a duty to enforce the Ley General de Salud, but also a duty to protect public health, which is classified as a matter of public interest, because the rights to health and to a healthy environment free from pollution—at least above the levels tolerable for human beings—are fundamental, inalienable rights whose violation cannot legitimately be accepted. The respondent Minister states in the report submitted to this Chamber that there is no record of any complaint concerning these facts. Nevertheless, the head of the Ministerio de Salud must bear in mind that this body must not act solely at a party’s request, as she appears to understand, thereby disregarding the preventive function that is essential to the protection of human health and warrants its intervention, even on its own initiative, in inspecting and monitoring compliance with the provisions of the Ley General de Salud. As established in the record, the health authorities’ actions in the case under review were limited to inspecting the pig farm reported herein because this amparo application had been filed, and they established, among other facts, that the farm has a population of 150 pigs and is surrounded by homes. Although the health authority stated that it verified that there were no foul odors from decomposing food and that water used to wash the farm was not discharged onto public roads, its actions went no further. It declined to exercise its powers and responsibilities by failing to compel the appropriate persons to comply with the other requirements imposed by the legal system for operating this type of activity, including the necessary permits from the various administrative bodies with competence over this matter. It is therefore established that, apart from the inspection conducted as a result of this amparo proceeding, the case file discloses no other action by this authority aimed at ensuring that the pig farm complies with the statutory requirements and at monitoring the activity to ensure that it does not cause any kind of health-related or environmental contamination. The authorities therefore failed to fulfill their duty to protect the population’s right to health, and this omission consequently infringed the fundamental rights of all the area’s residents.’ (Emphasis not in the original).\n\nIn the sub examine, the appropriate disposition is to deny the application because the requirements stated supra for treating this as an exceptional case have not been met; that is, neither of the two circumstances that could justify the Constitutional Chamber’s review of this matter despite the absence of a complaint is present. As has been seen, there is no indication that, before filing the application, the applicant filed any formal complaint with the respondent authorities that was not addressed.” (Emphasis not in the original).\n\nConsistent with the judgments cited above, it must be stated that this Chamber has emphatically indicated the need to file a prior complaint before it will review matters involving alleged environmental problems, such as noise pollution. In this particular case, it is apparent that the applicant did not first file a complaint with any of the respondent authorities. Furthermore, it is important to note that neither of the two circumstances identified in the precedents is present here, namely: 1) a case of great magnitude; or 2) a case in which the record shows that the competent authorities were aware of the reported situation, which was threatening or causing environmental harm, and failed to take any measure in response.\n\nIt should be noted that what the amparo applicants allege in their filing is that turbine and engine tests conducted during the afternoon and nighttime generate extreme levels of noise, vibrations, and fuel odors that affect their health, safety, rest, and the structure of their home; however, the evidence submitted in the case file did not establish that the persons protected by the amparo reside in the vicinity of Aeropuerto Juan Santamaría. It should also be noted that, in connection with this amparo proceeding, Área Rectora de Salud Alajuela 1 conducted an on-site inspection at the address provided by the applicants and verified that they do not reside there. It stated that residents of the area reported that two of the applicants live in Dirección02, near the church and in barrio La Julieta, and that the third resides in downtown Alajuela.\n\nFinally, it is observed that none of these facts has been reported to the authorities, nor do they concern matters of major significance or matters that were known to the respondent authorities. It should also be noted that the persons protected by the amparo do not reside in the area identified in the complaint. It was likewise verified that the applicants’ actual claim in filing this amparo proceeding is to obtain the expropriation of their properties; however, it must be stated that this is not a matter for this Chamber to determine. Instead, the applicants must raise any allegation in that regard, should they deem it appropriate, through the applicable ordinary legal channels.\n\nAccordingly, in view of the absence of a formal complaint by the applicants, the determination that neither of the two exceptional circumstances heard by this Court is present, and the establishment that, in any event, the persons protected by the amparo do not reside there, the appropriate course is to deny the amparo application, as is hereby ordered.\n\nV.- Documentation submitted in the case file. The party is hereby advised that, if it submitted any paper document, as well as any objects or evidence contained on an additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, such items must be collected from the Court’s offices within a maximum period of 30 business days from notice of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”), approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12, held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is denied.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
