"summary_en": "The Constitutional Chamber (Sala Constitucional), by majority, denied the amparo application against the Instituto Costarricense de Acueductos y Alcantarillados (ICAA). The amparo applicant challenged the refusal to install a new potable-water meter on property that already had several services. The Chamber found that ICAA had notified a decision supported by a technical assessment: limited space along the public-road boundary, vehicle traffic, and the presence of other meters prevented it from safeguarding an additional installation; moreover, no sanitary-sewer network was available. According to the majority, the failure to provide the requested service was not arbitrary but resulted from a technical or formal impossibility and therefore did not violate fundamental rights. Justices Cruz Castro and Rueda Leal dissented. They would have granted the amparo and ordered concrete, reasonable, and progressive measures to secure effective access to potable water within a reasonable period.",

In this case, as ICAA reports, this is not a denial of access to potable-water service but an impossibility of providing it because of insufficient infrastructure. The case under review involves a formal impossibility, namely, the absence of a water-distribution network.\n\nIn other words, provided that the failure to supply potable-water service is not capricious, arbitrary, or unsupported, but is justified by a legal or material impossibility, there is no violation of fundamental rights. On that understanding, the Chamber considers the claim inadmissible on its substance.\n\nThe application is denied. Justices Cruz Castro and Rueda Leal dissent and would grant the application.",

San José, at 9:35 a.m. on 17 September 2026.\n\nAmparo proceeding filed under case number 26-027640-0007-CO by Nombre01, residence identification card CED02, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).\n\nBACKGROUND:\n\n1.- In a brief filed with the Chamber’s Clerk’s Office at 2:07 p.m. on 31 July 2026, the amparo applicant filed an amparo application against the ICAA. She states that on two occasions she requested that the Instituto Costarricense de Acueductos y Alcantarillados install a meter so that her property could receive drinking-water service. She asserts that on each occasion her request was denied on the ground that water service was unavailable in the area. She alleges that, despite her repeated requests, the respondent has not offered her an alternative solution, a timeframe for resolving the situation, or a response guaranteeing her future access to drinking-water service. She requests that the application be granted, with the consequences provided by law. \n\n2.- By a decision of the Presidency issued at 9:34 p.m. on 13 August 2026, the present proceeding was admitted for consideration and served upon the GENERAL MANAGER OF THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\n3.- In a brief added to the digital case file at 10:47 a.m. on 20 August 2026, José Darío Guzmán Álvarez, in his capacity as general manager of the ICAA, reports under oath that: “(…) On 13 July 2026, application 2026-00016031-1 was received. It concerns the property bearing Real Property Folio number PRN01 and cadastral plan PRN02, registered to Nombre01, residence identification card number CED02, located in the San Juan district, Tibás canton, San José province, for the purpose of Supplying an Existing Dwelling. On 23 July 2026, decision SIGDD-2026-00016031-1-1-NRT was signed and notice thereof was sent to the email address ...01. It should be noted that Eng. Yeilin Jimenez Venegas denied the service-availability application for drinking-water and sanitary-sewer service for the proposed project because, according to the technical study conducted in this case, the following was stated: ‘For the Drinking-Water system: Site conditions technically unsuitable for connection and/or metering of the service. For the Sanitary-Sewer system: service is unavailable in the area for new connections: There is no sanitary-sewer network.’ It was further stated: ‘For drinking water: installation of new services is not technically feasible (limited space along the boundary adjoining the public street, which is also used as an access route for motor vehicles, thereby jeopardizing the integrity of the water meters). For sanitary sewerage: The Sanitary-Sewer system is unavailable in the area for new connections: There is no sanitary-sewer network.’ The foregoing is based on Articles 7 (subsection 12), 8, 9, 14, 16, 36, and 74 of the Reglamento de Prestación de Servicios de AyA; Article 18 (subsection g) and Article 22 of ARESEP’s Reglamento Técnico para la Prestación de Servicios de Agua Potable, Alcantarillado Sanitario e Hidrantes; and Articles 11, 16, 239, 240, 245, 269.1, 291.1, 342, 343, 344.1, 346.1, 347, and 349 of the Ley General de la Administración Pública. In addition, it was certified that, as of the date decision SIGDD-2026- 00016031-1-1-NRT was issued, the property did have AyA services identified by NIS 3393284, 3378690, CED01 5315751. It is important to note that no motion for reconsideration (Recurso de Revocatoria) and/or subsidiary appeal (Apelación en Subsidio) was filed against decision SIGDD-2026-00016031-1-1-NRT. (See report N°UEN-SCMED-GAM-2026-01653) 2. A review of the file associated with the property bearing Real Property Folio number PRN01 and cadastral plan PRN02, located in the San Juan district, Tibás canton, San José province, registered to Nombre01, residence identification card number CED02, identified only one other availability application, number 2023- 000203995-1, filed on 16 October 2023. That application was denied for drinking-water and sanitary-sewer service for the proposed Individualization of Services for a dwelling, and notice thereof was provided on 6 November 2023, stating that: ‘it is not feasible to grant availability for the individualization of dwelling service; installation of future new services is not technically feasible (limited space along the boundary adjoining the public street for service installation, which is also used as an access route for motor vehicles, thereby jeopardizing the integrity of the water meter).’ The foregoing is in accordance with Articles (subsection 12), 8, 9, 14, 16, 36, and 74 of the Reglamento de Prestación de Servicios de AyA; Article 18 (subsection g) and Article 22 of ARESEP’s Reglamento Técnico para la Prestación de Servicios de Agua Potable, Alcantarillado Sanitario e Hidrantes; and Articles 11, 16, 239, 240, 245, 269.1, 291.1, 342, 343, 344.1, 346.1, 347, and 349 of the Ley General de la Administración Pública. That decision also certified that, as of the date the document was issued, the property had AyA services identified by NIS 3393284, 3378690, CED01 5315751. (See report N°UEN-SCMED-GAM-2026-01653) 3. With respect to the Drinking-Water Technical Assessment issued in support of the denial of service availability, the technical inspection of the property determined that there is no adequate physical space for installing new services because the space along the boundary adjoining the public street is limited and the street is also used as an access route for motor vehicles, thereby jeopardizing the integrity of the water meters. Furthermore, four services have already been installed, making it even more difficult to install a new service and ensure the integrity of all the water meters. The foregoing is in accordance with Articles 7 (subsection 12), 8, 9, 14, 16, 36, and 74 of the Reglamento de Prestación de los Servicios de AYA. (See report N°UEN-SCMED-GAM-2026-01653) 4. It is vitally important to clarify that a property held through undivided ownership interests, as in this case, is not exempt from the pre-established regulations and requirements. AyA provides drinking-water services to registered and physically established properties, not to individuals or specific ownership interests; moreover, it does not intervene in matters that are strictly internal among co-owners. It is clarified that the property at issue has AyA services identified by NIS PRN03, PRN04, CED01 5315751. Consequently, under the regulations in force and the technical conditions previously described, authorizing another drinking-water service for the same property is neither appropriate nor technically feasible because the integrity of all the water meters cannot be guaranteed. (See report N°UEN-SCMED-GAM-2026-01653) 5. It is important to state that this Institute must comply with the existing technical and legal rules. In this case, the Reglamento para la Prestación de los Servicios de AyA applies and establishes that the technical feasibility of granting services is based on a process verifying the actual, current existence of water, hydraulic, material, technical, legal, and environmental resources. It is also necessary to ensure the existence of Hydraulic Capacity, which entails verifying the existence of installed and operating infrastructure in the supply and sanitation systems capable of conveying the flows and enabling the effective provision of services. It is likewise essential to verify Water-Resource Capacity, consisting of the actual existence of a water resource that is technically capable of meeting the demand of current and future users. Regarding the Certificate of Service Availability, the regulation at issue defines it as the document certifying the actual, current existence of water-resource capacity, hydraulic capacity, and collection and treatment capacity, provided that the demand for existing services is not adversely affected. It is clear that we must observe the existing regulations. Although drinking-water supply is a public service, it is also clear that we must ensure compliance with the principle of legality governing the Public Administration and the Political Constitution, under which the Institution must comply with its own Regulations and may make no exception whatsoever. Accordingly, the right to water does not exempt anyone from complying with the requirements established in the Reglamento de Prestación de Servicios de AYA. (See report N°UEN-SCMED-GAM-2026-01653) (…) In this regard, it is important to conclude that the requests submitted by the person protected by the amparo have been duly addressed and that the institution has therefore not infringed Ms. Nombre01’s fundamental rights. The requests concerning the availability determinations at issue in this amparo proceeding have been addressed, and notice was duly provided through the means designated by the applicant for that purpose. Granting Drinking-Water Availability for the property at issue in this amparo proceeding is not feasible, in accordance with the analysis set forth in the preceding paragraphs and for the considerations and reasons stated therein. Decisions SIGDD-2026-00016031-1-1- NRT and SIGDD-2026-00016031-1-2-NN were duly issued and supported, and issuing a contrary administrative act would disregard the provisions of the legal framework governing us. Accordingly, none of this Institute’s actions have been capricious, arbitrary, or unfounded.” He requests that the Chamber deny the application.\n\n4.- The legal requirements have been observed in the proceedings followed. \n\nJustice Salazar Alvarado authors the decision; and,\n\nREASONS: \n\nI.- SUBJECT MATTER OF THE APPLICATION. The amparo applicant states that on two occasions she requested that the ICAA install a meter so that her property could receive drinking-water service. She asserts that on each occasion her request was denied on the ground that water service was unavailable in the area. She alleges that, despite her repeated requests, the respondent has not offered her an alternative solution, a timeframe for resolving the situation, or a response guaranteeing her future access to drinking-water service.\n\nII.- PROVEN FACTS. The following facts relevant to deciding this matter are deemed duly established, either because they were proven or because the respondent failed to address them as required by the initial order: \n\na) On 13 July 2026, application 2026-00016031-1 was received. It concerns the property bearing Real Property Folio number PRN01 and cadastral plan PRN02, registered to Nombre01, residence identification card number CED02, located in the San Juan district, Tibás canton, San José province, for the purpose of supplying an existing dwelling (see report submitted under oath and evidence provided).\n\nb) On 23 July 2026, decision SIGDD-2026-00016031-1-1-NRT was signed and notice thereof was sent to the email address ...01 (see report submitted under oath and evidence provided).\n\nc) The service-availability application for drinking-water and sanitary-sewer service was denied for the proposed project because, according to the technical study conducted in this case, the following was stated: “For the Drinking-Water system: Site conditions technically unsuitable for connection and/or metering of the service. For the Sanitary-Sewer system: service is unavailable in the area for new connections: There is no sanitary-sewer network” (see report submitted under oath and evidence provided).\n\nd) That technical study stated: “For drinking water: installation of new services is not technically feasible (limited space along the boundary adjoining the public street, which is also used as an access route for motor vehicles, thereby jeopardizing the integrity of the water meters). For sanitary sewerage: The Sanitary-Sewer system is unavailable in the area for new connections: There is no sanitary-sewer network” (see report submitted under oath and evidence provided).\n\ne) As of the date decision SIGDD-2026- 00016031-1-1-NRT was issued, the property did have AyA services identified by NIS 3393284, 3378690, CED01 5315751 (see report submitted under oath and evidence provided).\n\nIII.- TECHNICAL IMPEDIMENTS TO THE SUPPLY OF DRINKING WATER. In Judgment N° 2010-001516, issued at 6:36 p.m. on 26 January 2010, this Chamber addressed technical or legal impediments to providing drinking-water service. On that occasion, it held as follows: \n\n“IV.- Why a legal or formal impediment to providing drinking-water service does not violate fundamental rights.- This Chamber’s settled case law has stated that, under the Costa Rican legal system, the supply of drinking water is considered a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under conditions of equality, and with adaptation to technological changes (see, in this regard, judgment 2001-09676, issued at 11:25 a.m. on 26 September 2001, and judgment 2004-08161, issued at 10:53 a.m. on 23 July 2004). In this respect, it is clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the State entities charged with providing the public drinking-water service, is likewise required to provide that service continuously, adaptably, efficiently, and equally to all inhabitants. Nevertheless, despite all the foregoing, this Constitutional Court’s case law has also stated that, where there is a legal impediment (meaning failure to satisfy requirements established in the applicable regulations) or a formal impediment (meaning the absence of a Water-Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear the installation costs when no drinking-water distribution network exists and infrastructure must be constructed. Thus, in such cases it has been made clear that this is not a denial of access to drinking-water service but rather an impediment to providing it, or that the interested party must participate in overcoming a technical impediment, namely, the lack of infrastructure. Of course, AyA, as a State entity primarily responsible for providing drinking-water service, has an obligation to continue expanding its infrastructure so that more and more people have access to this precious resource. Until existing gaps are eliminated, however, cooperation by interested parties is essential (see decisions Nº 2006-014218, issued at 3:04 p.m. on 26 September 2006, and Nº 2007-11190, issued at 2:36 p.m. on 7 August 2007). In other words, provided that the failure to provide drinking-water service is not capricious, arbitrary, or unfounded but is instead justified by a legal or material impediment, there is no violation of fundamental rights.”\n\nIV.- THE SPECIFIC CASE. In the matter under review, the amparo applicant contends that on two occasions she requested that the ICAA install a meter so that her property could receive drinking-water service. She asserts that on each occasion her request was denied on the ground that water service was unavailable in the area. She alleges that, despite her repeated requests, the respondent has not offered her an alternative solution, a timeframe for resolving the situation, or a response guaranteeing her future access to drinking-water service. In this regard, the Chamber finds it established that on 13 July 2026, application 2026-00016031-1 was received. The service-availability application for drinking-water and sanitary-sewer service was denied for the proposed project because, according to the technical study conducted in this case, the following was stated: “For the Drinking-Water system: Site conditions technically unsuitable for connection and/or metering of the service. For the Sanitary-Sewer system: service is unavailable in the area for new connections: There is no sanitary-sewer network.” That technical study stated: “For drinking water: installation of new services is not technically feasible (limited space along the boundary adjoining the public street, which is also used as an access route for motor vehicles, thereby jeopardizing the integrity of the water meters). For sanitary sewerage: The Sanitary-Sewer system is unavailable in the area for new connections: There is no sanitary-sewer network.” As of the date decision SIGDD-2026- 00016031-1-1-NRT was issued, the property did have AyA services identified by NIS 3393284, 3378690, CED01 5315751. Given these circumstances, the Chamber finds that the amparo applicant’s claim must be rejected. As the ICAA reports, this is not a denial of access to drinking-water service but rather an impediment to providing it due to the lack of infrastructure. The case under review involves a formal impediment, namely, the absence of a water-distribution network. Specifically, it is stated that there is limited space along the boundary adjoining the public street and that the street is used as an access route for motor vehicles, thereby jeopardizing the integrity of the water meters. Consequently, as has been stated in other similar cases concerning technical or formal impediments, this is not a denial of access to drinking-water service but rather an impediment to providing it. In other words, provided that the failure to provide drinking-water service is not capricious, arbitrary, or unfounded but is instead justified by a legal or material impediment, there is no violation of fundamental rights. Under that reasoning, the Chamber finds the claim asserted to be unfounded. \n\nV.- DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, AUTHORED BY THE FORMER. For the reasons set forth below, we believe that the present application should be granted. The majority decision denies the amparo because, in its view, the challenged denial does not arise from arbitrary or discriminatory conduct but is instead based on technical criteria. It fails, however, to give adequate weight to the fact that access to drinking water is a fundamental right indispensable to life, health, and human dignity.\n\nArticle 21 of the Political Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution imposes upon the State the duty to guarantee the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—as interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to adopt positive measures for its full realization. In a social and democratic State governed by the rule of law, the State is subject to a heightened obligation; for that reason, supplying water is a priority obligation of public authorities.\n\nA public-service provider cannot limit itself to identifying deficiencies in the system; it has a legal duty to plan, anticipate, and carry out the actions necessary to guarantee progressive access to water service, particularly when the water is intended for human consumption.\n\nThis does not mean requiring the impossible, but rather requiring the adoption of reasonable, alternative, or progressive measures so that people are not left without protection.\n\nWater is not just another service; it is an essential human right. Accordingly, the respondent entity cannot disregard its duty to guarantee that right by invoking technical limitations without offering effective solutions.\n\nFor these reasons, we believe that the application should be granted, at least to order the adoption of concrete and progressive measures that would guarantee the person protected by the amparo effective access to drinking water within a reasonable period. Water is a good and a fundamental right whose effectiveness must be ensured; this is an unavoidable duty.\n\nVI.- DOCUMENTATION SUBMITTED TO THE CASE FILE. This Chamber must advise the parties that, if they have submitted any paper documents, objects, or evidence stored on any additional device or on electronic, computer, magnetic, optical, or telematic media, or produced using new technologies, such items must be retrieved from the Clerk’s Office within thirty business days after notice of this judgment is received. Otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session N°27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial N°19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N°43-12 held on 03 de mayo del 2012, Article LXXXI. \n\nTHEREFORE: \n\nThe application is denied.
