"summary_en": "The Constitutional Chamber (Sala Constitucional) granted the amparo proceeding because the authorities had not definitively resolved the overflow and accumulation of stormwater, sewage, and wastewater in the El INVU neighborhood of Juan Viñas. Although the Municipalidad de Jiménez had authorized action on the problem in 2002 and later included drainage works in the Second Extraordinary Budget for 2026, it did not establish that the environmental and public-health conditions had actually been remedied. The Chamber also found that the Área Rectora de Salud de Turrialba, the local Ministry of Health authority, received a residents’ complaint in April 2024 and requested information from the municipality but failed to provide appropriate follow-up. It ordered the mayor to coordinate the measures required for a definitive solution within the twelve-month period previously established in judgment 2026028869, and ordered the health-area director to issue appropriate sanitary orders and monitor compliance continuously and permanently. It awarded costs and damages against the municipality and the State and denied the application in all other respects.",

Although it was established that, through that Health Area’s official letter No. MS-DRRSCE-DARST-1067-2024 of 20 August 2024, a report was requested from the Municipalidad de Jiménez regarding the measures adopted to correct the reported problem, there is no indication that the office provided appropriate follow-up concerning the reported environmental problem. The Chamber therefore finds that the alleged neglect occurred and that the application must be granted on this point.\n\nThe application is granted. Ana Isabel Azofeifa Pereira, in her capacity as mayor of Jiménez, or whoever holds that office, is ordered to undertake the necessary coordination and carry out all actions within the scope of the relevant powers so that, within the TWELVE-MONTH period established in judgment No. 2026028869 of 9:25 a.m. on 30 July 2026, the environmental problem reported by the amparo applicant is definitively resolved. In addition, Luis Fernando Mata Castro, in his capacity as director of the Área Rectora de Salud de Turrialba, or whoever holds that office, is ordered to issue such sanitary orders as may be appropriate so that the reported environmental problem is addressed within the same period and continuous and permanent monitoring of compliance with those sanitary orders is provided.",

San José, at 9:25 a.m. on 2 October 2026.\n\n \n\nAmparo proceeding brought by [Name 001], identity card [Value 001], against the MINISTERIO DE SALUD AND THE MUNICIPALIDAD DE JIMÉNEZ.\n\nBACKGROUND:\n\n1.- By a filing submitted at 10:21 a.m. on 5 August 2026, the amparo applicant brought an amparo proceeding against the Ministerio de Salud and the Municipalidad de Jiménez because, as she states, she is a resident of Cartago, Jiménez, Juan Viñas, house No. 21. She states that, for more than two years, residents of the community have been affected by the overflow and accumulation of rainwater, sewer water, and sewage that does not flow properly. She asserts that this situation arises because [Name 002] blocked the passage or outlet of that water within his property, relying on a complaint he filed against the Municipalidad de Jiménez to prevent the water from crossing his land. Although judicial proceedings have been pending since 2004 and an order was issued directing the Municipality to carry out works to solve the problem, that municipal corporation allegedly failed to comply with the order, allowing the harm to residents to persist. She adds that the affected persons have submitted numerous requests and complaints to the Municipalidad de Jiménez and the Área Rectora de Turrialba of the Ministerio de Salud, including complaints filed since April 2024. She states that, in official letter MS-DRRSCE-DARST-1067-2024 of 20 August 2024, the Ministerio de Salud indicated that the reported facts had been verified and that, when municipal officials were consulted, they stated that the project intended to solve the problem was being processed before the Contraloría General de la República. This situation has resulted in mosquitoes, foul odors, and risks to the population’s health and safety, particularly to older adults and minors. She also asserts that there is a drainage ditch more than fifty centimeters deep, which poses a danger to those living in the area. She requests the intervention of this Chamber.\n\n2.- By a decision issued at 7:40 a.m. on 14 August 2026, the amparo application was admitted for processing, and the mayor of Jiménez and the director of the Área Rectora de Salud de Turrialba of the Ministerio de Salud were ordered to submit reports concerning the alleged facts.\n\n3.- Ana Isabel Azofeifa Pereira, in her capacity as mayor of Jiménez, reports under oath that it is true that, when the El INVU residential development in Juan Viñas was built between the 1970s and 1980s, and for reasons unknown to her, wastewater and rainwater were improperly managed because, at a certain point, they flowed through the property of [Name 002], and it is unknown whether this occurred with his express or implied consent. The serious problem involving this water, which went so far as to cause flooding on several properties, arose when the registered owner carried out works to prevent the water from flowing through his property. It is true that, as a result of the flooding, the applicant and other residents made oral and written submissions to this municipal corporation (the Concejo de Jiménez and its Mayor’s Office), reporting the problems and complaining about the Municipality’s inaction because its actions and interventions were not entirely effective, were partial or lasted only for a certain time, and the flooding returned in years when the rainy season was more severe in the region. Because the problem persisted despite the numerous municipal actions, and with the intention of safeguarding people’s lives, quality of life, and personal integrity, as well as their safety, property, and other fundamental rights, both original and derivative, it was agreed that a technical solution under professional supervision would be sought to bring the problem to a definitive end. Based on that agreement and in order to achieve a solution, an “Implementation Agenda” was designed and approved with a “Municipal Strategic Plan 2026-2030,” which sets out: Strategic Area. Objective. Course of Action. Performance Indicator. Project Description. Budget. And other details that the Court may verify in the document attached to this report. That project was included in the II Extraordinary Budget 2026. It will be implemented beginning in the first half of October of this year as part of SICOP procedure 2026LE-000001-0004500001, entitled PROCUREMENT ON AN ON-DEMAND BASIS OF MAINTENANCE WORKS FOR LOCAL ROADS. The work consists of improvements to the drainage systems in the block where the El INVU neighborhood Community Hall is located, the same block where both the applicant’s home and that of [Name 002] are located, and is intended to address the problem described by the applicant. Attached hereto are Purchase Order 0822026000900036, assigned to Constructora JSR SRL, for the aforementioned work to be performed in the block where the El INVU neighborhood Community Hall is located, and the corresponding budget certification. As the Chamber can see, the Municipality has at no time failed to fulfill its duty, because from the outset it acted in complete good faith and with evident responsibility, but without achieving the objective, because it was not until climate change began wreaking havoc that we had to seek a technical solution requiring a substantial commitment of municipal revenue. It is important to indicate that, in Case File 26-018032-0007-CO and the subsequent judgment No. 2026028869 of 30 July 2026, the application filed by [Name 003], which likewise concerned this work to be performed in the El INVU neighborhood, was granted in part, solely with respect to the delay in resolving the issue concerning the sewerage work still to be carried out. That decision ordered Ricardo Aguilar Solano and Evelio Camacho Ulloa, in their respective capacities as mayor and president of the Concejo Municipal, both of the Municipalidad de Jiménez, or whoever may hold those offices in their stead, to undertake the necessary coordination and perform all acts within the scope of their respective authority so that, within TWELVE MONTHS from notice of that ruling, the reported sewerage problem in the El INVU neighborhood would be resolved.\n\n4.- The director of the Área de Salud de Turrialba did not submit the report requested of him (certification appearing in the Event History of the Electronic Case File).\n\n5.- The legal requirements have been observed in the proceedings conducted.\n\nJustice Hess Herrera is the author of this decision; and,\n\nREASONS:\n\nI.- SUBJECT MATTER OF THE APPLICATION. The applicant states that the El INVU neighborhood in Juan Viñas is frequently affected by the overflow and accumulation of rainwater, wastewater, and sewage because one of her neighbors blocked the passage or outlet of that water within his property. She adds that this situation persists even though the respondent local government entity was ordered to carry out any works deemed necessary to solve the problem, which she considers contrary to her fundamental rights.\n\nII.- PRELIMINARY MATTER. Before analyzing the merits of the matter, it must be clarified that, since Judgment No. 2008-02545 of 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa), with certain exceptions, matters involving disputes as to whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, for issuing a final administrative act resolving an administrative proceeding—initiated ex officio or at the request of a party—or for hearing the applicable administrative challenges. Specifically, the sub lite matter presents an exception because it concerns the failure to resolve an environmental complaint. Having clarified that point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.\n\nFurthermore, because the director of the Área Rectora de Salud de Turrialba failed to submit the report required of him in the order serving notice of the application, pursuant to Article 45 of the Ley de la Jurisdicción Constitucional, the alleged facts are deemed true as to that respondent, and their constitutionality will be analyzed on the basis of the applicant’s statements.\n\nIII.- PROVEN FACTS. The following facts relevant to the decision in this amparo proceeding are deemed established: 1) REGARDING THE RESPONDENT LOCAL GOVERNMENT ENTITY: 1) Between the 1970s and 1980s, when the Urbanización El INVU de Juan Viñas was built, wastewater and rainwater were improperly managed because, at a certain point, they flowed through the property of [Name 002] (report submitted under oath). 2) At ordinary session 484 of the Concejo de Jiménez, held on 24 April 2002, it was agreed to authorize the mayor of that canton to resolve the neighborhood’s sewage and wastewater problem so that the water would be properly disposed of (documentary evidence submitted in Case File No. 26-018032). 3) On an undetermined date, the Municipalidad de Jiménez created the project “Improvements to El INVU Drainage Systems, Phase I, 3-04-110,” whose objective is “To construct a concrete drainage channel to improve drainage conditions in the area and to protect the public road. Improvement of drainage systems to prevent water from accumulating near the Community Hall” (documentary evidence submitted in Case File No. 26-018032). 4) In subsection b) of Article V of ordinary session 107 of the Concejo de Jiménez, held on 20 May 2026, the inclusion of “El INVU JV Urban Streets (Phase I, Coffee Plantation and Community Hall) 110 (Ley 8114 Funds)” in Extraordinary Budget 2-2026 was approved (report submitted under oath in Case File 26-018032). 5) On an undetermined date, that budget was submitted to the Contraloría General de la República for approval (report submitted under oath in Case File 26-018032). 6) On undetermined dates, some residents reported the environmental problem and the respondent’s inaction to the respondent local government entity (report submitted under oath). 7) On an undetermined date, the respondent municipality agreed to seek a technical solution under professional supervision that would bring the problem to a definitive end (report submitted under oath). 8) On an undetermined date, pursuant to that agreement, it approved an “Implementation Agenda” with a “Municipal Strategic Plan 2026-2030,” which sets out: Strategic Area. Objective. Course of Action. Performance Indicator. Project Description. Budget (report submitted under oath). 9) On an undetermined date, that project was included in the II Extraordinary Budget 2026 and is to be implemented beginning in the first half of October of this year as part of SICOP procedure 2026LE-000001-0004500001, entitled PROCUREMENT ON AN ON-DEMAND BASIS OF MAINTENANCE WORKS FOR LOCAL ROADS (report submitted under oath). 10) On 28 August 2026, Purchase Order 0822026000900036 was issued and assigned to Constructora JSR SRL for that work (report submitted under oath). B) REGARDING THE ÁREA RECTORA DE SALUD DE TURRIALBA: 1) On 10 April 2024, some residents of the Urbanización El INVU, Juan Viñas, filed a complaint with that office concerning the safety and hygiene problems they experience as a result of the improper disposal of sewage and wastewater in their community (copies attached to the initial application). 2) By official letter No. MS-DRRSCE-DARST-1067-2024 of 20 August 2024, that Área Rectora de Salud requested a report from the Municipalidad de Jiménez concerning the measures ordered to correct the reported problem (copies attached to the initial application). 3) The Área Rectora de Salud has not appropriately followed up on the reported environmental problem (uncontested fact).\n\nIV.- SPECIFIC CASE. It was established that, since the construction of the Urbanización El INVU de Juan Viñas, the rainwater, wastewater, and sewage from that housing development have been improperly discharged through land owned by a third party. It was also established that, although at ordinary session 484 of the Concejo de Jiménez, held on 24 April 2002, it was agreed to authorize the mayor of that canton to resolve the reported environmental problem so that the water would be properly disposed of, it was not until a few months ago that the respondent municipality took the necessary measures for that purpose by including the project “Improvements to El INVU Drainage Systems, Phase I, 3-04-110” in the II Extraordinary Budget 2026; however, the problem has not been effectively addressed. In this regard, it is relevant to note that, although the applicant submitted printouts of photographs taken at the end of April of this year, the respondent authorities do not refute that the accumulation of rainwater, sewage, and wastewater has not been properly remedied. Accordingly, the Chamber finds that the alleged violation occurred because, as held in judgment No. 2026028869 of 9:25 a.m. on 30 July 2026:\n\n“… the Chamber finds that the fundamental rights of the protected party were violated because the Municipalidad de Jiménez failed to act diligently and promptly to address the reported problem concerning the sanitary sewerage system in the El INVU neighborhood. In this regard, it should be noted that, even though the respondent authorities maintain that the project ‘El INVU JV Urban Streets (Phase I, Coffee Plantation and Community Hall) 110 (Ley 8114 Funds) is included in Extraordinary Budget 2-2026,’ which is awaiting approval by the Contraloría General de la República, it is nonetheless true that there is no showing that the project will resolve the reported problem, nor is there any certainty as to whether it will be approved …”\n\nFurthermore, it was established that, in early April 2024, some residents of the Urbanización El INVU, Juan Viñas, filed a complaint with the Área Rectora de Salud de Turrialba concerning the reported safety and hygiene problems. Although it was established that, through official letter No. MS-DRRSCE-DARST-1067-2024 of 20 August 2024, that Área Rectora de Salud requested a report from the Municipalidad de Jiménez concerning the measures ordered to correct the reported problem, there is no indication that the office appropriately followed up on the reported environmental problem. The Chamber therefore finds that the alleged neglect occurred and that the application must be granted with respect to this issue.\n\nV.- NOTE BY JUSTICE CASTILLO VÍQUEZ CONCERNING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the Administrative-Litigation Courts rather than by this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, when petitioners consider that the Administration’s material conduct, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not mean that this Court must alter its line of precedent, because, under section 7 of its Law, it has exclusive authority to define its own jurisdiction. Therefore, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptions and that may indeed be heard in this jurisdiction through the constitutional protective proceeding of amparo, in all other cases, and for the reasons stated by this Court (Judgment No. 2008-02545 of 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.\n\nVI.- NOTE BY JUSTICE SALAZAR ALVARADO. In environmental matters, it is my view that, if the Public Administration has already intervened, the matter must be heard and decided by the administrative-litigation jurisdiction. Nevertheless, I do examine the merits when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free of pollution (Article 50 of the Constitución Política), as occurs in this case, in which the applicant states that the El INVU neighborhood in Juan Viñas is frequently affected by the overflow and accumulation of rainwater, wastewater, and sewage because one of her neighbors blocked the passage or outlet of that water within his property. She adds that this situation persists even though the respondent local government entity was ordered to carry out any works deemed necessary to solve the problem, which she considers contrary to her fundamental rights.\n\nVII.- DISSENTING OPINION OF JUSTICE GARRO VARGAS CONCERNING ENFORCEMENT OF THE JUDGMENT. I dissent with respect to enforcement of the judgment and would order that, pursuant to Art. 56 of the Ley de la Jurisdicción Constitucional (LJC), enforcement be assigned to the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda.\n\nEnforcement of the orders issued by the Constitutional Chamber must, in principle, be supervised by this same jurisdiction. However, that provision establishes exceptions in which this Court may order that enforcement of the judgment be assigned to the administrative-litigation jurisdiction:\n\n“Art. 56. Enforcement of judgments corresponds to the Constitutional Chamber, except as regards the calculation and payment of compensation and monetary liabilities, or other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through administrative-litigation proceedings under the judgment-enforcement procedure provided for by the law governing that jurisdiction.” (Emphasis not in the original).\n\nIt should be recalled that the bill concerning the LJC originally provided as follows:\n\n“Art. 56. Judgments favorable to the applicant shall be enforced through administrative-litigation proceedings under the judgment-enforcement procedure provided for by the law governing that Jurisdiction.” (Emphasis not in the original).\n\nHowever, the text was amended by motion so that the provision would be consistent with Art. 153 of the Constitución Política, and the following explanation was given:\n\n“THE SECRETARY:\n\nMotion No. 68 (32-19) by Deputy Chacón Jiménez:\n\n‘Article 57 (formerly 56): that the text read as follows: “Enforcement of judgments corresponds to the Constitutional Chamber, except as regards the calculation and payment of compensation or monetary liabilities, or other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through administrative-litigation proceedings under the judgment-enforcement procedure provided for by the law governing that jurisdiction.”’\n\nTHE PRESIDENT:\n\nIs the motion as read open for discussion?\n\nDoctor Piza Escalante:\n\nThere was a contradiction here with the general proposition that Courts enforce their own judgments, and it referred all enforcement to the Administrative-Litigation Jurisdiction; the other articles that allowed the Chamber to enforce them were therefore left unresolved.\n\nDeputy Corrales Bolaños:\n\nThis part says: ‘or other matters that the Chamber itself deems appropriate…’; what does that refer to?\n\nDoctor Piza Escalante:\n\nThe idea is that the Chamber, in judgment-enforcement proceedings, decides whatever it considers to be within its purview. It sends everything else to administrative-litigation proceedings.\n\nTHE SECRETARY:\n\nIs the motion considered to have been sufficiently discussed?\n\nTHE PRESIDENT:\n\nDiscussion concluded. Approved (unanimously, with five deputies present).” (sic). See the records approving the LJC. Emphasis not in the original).\n\nBased on the foregoing, it is clear that the LJC itself authorizes this Chamber to assess and decide whether all or some aspects related to enforcement of the judgment should be referred to the administrative-litigation jurisdiction.\n\nIn this specific case, given the nature of the orders being issued by this Court, I consider it appropriate to assign the enforcement stage of this matter to the administrative-litigation jurisdiction. This is because the legislation governing this constitutional jurisdiction does not provide suitable mechanisms for monitoring compliance with the orders set forth in this judgment, which involve highly complex technical matters.\n\nBy contrast, the provisions of the Código Procesal Contencioso-Administrativo concerning enforcement (Art. 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, establish liability, supervise stages of compliance, and so forth. Therefore, pursuant to Art. 56 of the LJC, I consider that the enforcement stage should take place before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.\n\nVIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, they must retrieve them from the Court within a maximum period of 30 business days from notice of this judgment. Otherwise, any material not retrieved within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12, held on 3 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe application is granted. Ana Isabel Azofeifa Pereira, in her capacity as mayor of Jiménez, or whoever may hold that office, is ordered to undertake the necessary coordination and perform all acts within the scope of her respective authority so that, within the TWELVE-MONTH period granted in judgment No. 2026028869 of 9:25 a.m. on 30 July 2026, the environmental problem reported by the applicant is definitively resolved. In addition, Luis Fernando Mata Castro, in his capacity as director of the Área Rectora de Salud de Turrialba, or whoever may hold that office, is ordered to issue any public-health orders deemed appropriate so that the reported environmental problem is addressed within that same period and continuous, ongoing monitoring of compliance with those public-health orders is provided. The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that the person must comply with or cause to be complied with, and who fails to comply with it or cause compliance with it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Jiménez and the State are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, the amount of which shall be determined in administrative-litigation judgment-enforcement proceedings. In all other respects, the application is denied. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note. Justice Garro Vargas dissents with respect to the forum for enforcement of the judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, would order that this stage be assigned to the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda. Notice shall be given.\n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresident\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.
