"summary_en": "The Constitutional Chamber (Sala Constitucional) denied the amparo application against the El Cairo ASADA concerning its refusal to update a water-availability certificate needed for a housing project financed through a family housing subsidy. The majority recognized access to water as a fundamental right and held that the ASADA, although a private-law entity, provides a public service and may therefore be challenged through amparo. Nevertheless, the denial was not arbitrary: the certificate dated 27 September 2024 had expired, no timely extension or operator-approved transfer was proven, and technical evidence showed a water deficit and a risk to existing users. The new source known as Naciente Hugo was not yet operational. Disputes over the technical balance, property-registration discrepancies, and service requirements belonged before the competent administration or ordinary jurisdiction. The right of petition was not violated because the documented request received a written response. Two justices partially dissented and would have ordered concrete, progressive measures to secure access to potable water.",

"excerpt_en": "Those arguments are fully applicable to this case, in which the applicant was denied a potable-water availability letter for technical reasons. Nevertheless, satisfaction of a specific request must be reconciled with the actual conditions of the aqueduct and the continuity of supply for those already receiving the service; therefore, the Court cannot order issuance of a positive certificate that disregards a demonstrated technical impossibility.\n\nFollowing the same reasoning, the denial in this matter is not supported solely by a statement from the ASADA president. The record includes the aqueduct’s technical assessment and, in particular, an AyA communication from November 2025 documenting the increase in services, the negative water balance, and the risk of adding new demand. The report submitted in these proceedings confirms that constraint, while the documentation from October 2026 specifies that the new source is not yet operational. Accordingly, for purposes of constitutional review, there is objective support for ruling out that the denial resulted from a merely capricious decision.",

San José, at 9:25 a.m. on 15 October 2026.\n\n Amparo proceeding filed by [Nombre 001], identity card No. [Valor 001], on her own behalf and on behalf of [Nombre 002], a minor, identification No. [Valor 002], against the Asociación Administradora del Acueducto y Alcantarillado Sanitario Integrada del Distrito de El Cairo.\n\nBackground:\n\n 1.- In a written submission filed on 28 August 2026, the amparo applicant filed an amparo proceeding against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO INTEGRADA DEL DISTRITO DE EL CAIRO and stated that her household consists of three minor children, one of whom has level-two autism spectrum disorder, and that she is seeking a housing solution through the family housing subsidy (bono familiar de vivienda). She alleges that the refusal to update the confirmation of drinking-water availability prevents the project from proceeding, despite an earlier confirmation having been issued and the alleged assignment of another valid availability confirmation. She requests examination of the technical justification for the refusal, the existing alternatives, and the family’s vulnerable circumstances.\n\n2.- By a decision issued at 9:18 a.m. on 7 September 2026, the applicant was directed to provide proof of the legal representation of the respondent private entity. This direction was complied with through documentation added to the record on the following 21 September.\n\n3.- By a decision issued at 12:19 p.m. on 23 September 2026, the order was deemed satisfied and the amparo was admitted for processing, with notice to Alexis Calvo Francis, in his capacity as president of the respondent association, so that he could submit the corresponding report and provide a certified copy of the administrative case file.\n\n4.- In a written submission added to the record on 5 October 2026, ALEXIS CALVO FRANCIS, in his capacity as representative of the Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de El Cairo, responded to the hearing granted. He maintains that the amparo applicant is not listed as a user and that there is no record that she demonstrated compliance with the requirements for seeking an availability confirmation in her own name, whereas the land-use authorization (uso de suelo), the earlier confirmation, and the request for an explanation pertain to [Nombre 003]. He acknowledges that an availability confirmation was issued on 27 September 2024 with a twelve-month validity period, but states that it expired without a timely request for an extension. He explains that an availability confirmation issued for another property cannot be transferred automatically through an assignment between private parties. The same report states that the refusal is due to the water-supply insufficiency of the aqueduct, according to the March 2023 assessment and Instituto Costarricense de Acueductos y Alcantarillados official letter No. GSD-UEN-GAR-2025-04427 of 12 November 2025. He acknowledges the medical and socioeconomic documentation submitted but maintains that those circumstances do not permit the supply to existing users to be jeopardized. He reports on the efforts to incorporate Naciente Hugo, the contracting of construction work, and the partial installation of piping, although the source is not yet operational. He requests that the application be denied and separately submits a certified administrative case file in the name of [Nombre 003].\n\n 5.- The statutory requirements have been observed in the proceedings conducted.\n\n Justice Salazar Alvarado writes the opinion; and,\n\nReasons:\n\n I.- PRELIMINARY MATTER: Under Article 57 of the Ley de la Jurisdicción Constitucional, an amparo proceeding is admissible against the acts or omissions of private-law entities when they act, or are required to act, in the exercise of public functions or powers or when, as a matter of law or fact, they occupy a position of power in relation to which ordinary judicial remedies are clearly insufficient or untimely to protect the fundamental rights or freedoms referred to in Article 2(a) of that same Law. In this case, this Chamber considers the amparo proceeding admissible because the respondent ASADA, although a private-law entity, provides a public service.\n\nII.- Subject matter of the proceeding. The amparo applicant alleges that the respondent association denied the update to the confirmation of drinking-water availability needed to complete the housing solution she is pursuing through the family housing subsidy, even though a positive confirmation had been issued on 27 September 2024 and another valid availability confirmation had allegedly been assigned to the lot designated for the project. She contends that the extended duration of the housing process caused the earlier document to expire and that the response of 21 August 2026 did not include the cited technical study or Board of Directors’ resolution. She therefore requests verification of the basis for the refusal, the significance of the preceding circumstances, and the existence of alternatives, taking into consideration the poverty of the household, her three minor children, and [Nombre 002]’s disability.\n\nIII.- Proven facts. The following facts of significance to the decision in this matter are deemed duly established, either because they have been proven or because the respondent failed to address them as required by the initial order:\n\na) The amparo applicant, [Nombre 001], is part of a household with her three minor children and is listed as living in poverty in the SINIRUBE report consulted on 27 August 2026 (see attached evidence).\n\nb) The certified administrative case file contains registry documentation identifying property registration number 161447-000, survey plan L-1919805-2016, measuring 185 square meters, in the name of [Nombre 003]. Land-use authorization USM MS-416-2023 also identifies that person as the owner and applicant, with reference to the same registration number and survey plan (see attached evidence).\n\nc) On 9 September 2024, [Nombre 003] signed water-source and hydraulic capacity application No. 000411 for confirmation of availability for residential use concerning registration number 161447-000 and survey plan L-1919805-2016. Inspection No. 3681 was conducted, and positive certification No. 01-2709-24, dated 27 September 2024, was issued with an express validity period of twelve months. (See attached evidence.)\n\nd) The confirmation dated 27 September 2024 had expired when the request for an explanation was submitted in August 2026. The initial filing acknowledges that the document was valid for twelve months and subsequently expired (see attached evidence).\n\ne) On 14 August 2026, [Nombre 003] submitted a written request for an explanation regarding the failure to renew the availability confirmation, which was received that day at 11:20 a.m. She identified herself as the owner, specified survey plan L-1919805 and registration number 161446-00, and requested a written response to submit to the person interested in acquiring the property and to the institution processing her subsidy. An email address was provided for contact. (See attached evidence.)\n\nf) In a communication dated 21 August 2026 and addressed to [Nombre 003], the ASADA administration explained that the earlier availability confirmation had expired and that there was insufficient water capacity to renew it. It cited Board of Directors’ session No. 249 of 20 November 2025 and the aqueduct’s technical study. The certified copy contains a notation stating that it was delivered on 24 August 2026 at 2:26 p.m. The amparo applicant acknowledges in her initial filing that she learned of the response and that it was delivered to her. (See attached evidence.)\n\ng) In official letter No. GSD-UEN-GAR-2025-04427 of 12 November 2025, AyA informed the Municipalidad de Siquirres that the 2023 assessment had been conducted when there were 2447 service connections and that 2673 were subsequently recorded. A water deficit of 0,43 liters per second was reported for 2025, and it was stated that granting new service connections would place the existing supply at risk, such that capacity had to be increased through new sources (see attached evidence).\n\nh) In official letter No. Ad-OF-2026-10-001 of 2 October 2026, it was reported that the Naciente Hugo property had been acquired in 2019, that its registration had been pursued, and that a construction contract had been signed on 8 June 2026. The installation of 2602 meters of a planned 4200-meter conveyance line was reported, along with outstanding conveyance and intake work. The source had not yet been incorporated and was not operational. (See attached evidence.)\n\ni) In a communication dated 26 August 2026, Construcciones Técnicas Tres H del Caribe S. A. requested assistance in obtaining a valid availability confirmation for [Nombre 001]’s housing solution and stated that the subsidy process was experiencing delays. It clarified that the availability document was required for the construction permits, although installation of the meter was not yet needed (see attached evidence).\n\n IV.- Unproven facts. The following facts relevant to this decision are not deemed established:\n\na) It has not been established that the amparo applicant submitted her own availability application that was rejected through an individualized notice directing her to satisfy specific requirements, nor that she was specifically told which document she had failed to provide and the period within which to cure the omission.\n\nb) It has not been established that a request for an extension was submitted before the confirmation of 27 September 2024 expired.\n\nc) The identity of the assignor, the property of origin, the instrument of assignment, the corresponding flow rate, and the operator’s approval of the transfer of the availability alleged in the application have not been established through documentary evidence.\n\nd) It has not been established that, before the amparo proceeding was filed, the ASADA was asked for a copy of the technical study or the Board of Directors’ resolution and denied that request. Nor has it been established that the household is currently deprived of drinking water at its residence.\n\nV.- Admissibility of the amparo and assessment of the discrepancy in identities. Under Article 58 of the Law governing this jurisdiction, the fact that the amparo applicant is not listed as a registered user or as the owner of the property does not, by itself, prevent her from filing an amparo, particularly when she alleges an adverse effect on her housing project and on the rights of a minor. Standing to seek relief before this jurisdiction must therefore be distinguished from the requirements for obtaining an administrative confirmation. Notwithstanding the respondent authority’s arguments, the certified administrative case file belongs to [Nombre 003], not to the amparo applicant, [Nombre 001], or to the protected minor. The application form, land-use authorization, positive confirmation, and request for an explanation were issued or signed in the name of that person ([Nombre 003]). That documentation establishes who initiated the proceedings, but does not permit the conclusion, without other support, that the amparo applicant failed to meet particular requirements. Such a conclusion would require identification of the application attributable to her, the applicable requirement, and the specific omission, none of which can be inferred merely from the difference in names.\n\nNevertheless, a comprehensive analysis of the materials comprising the digital case file also shows that the documentation is not entirely unrelated to the dispute. An acquisition under the lot-purchase-and-construction arrangement is mentioned, while the construction company’s communication links the need for an availability confirmation to the amparo applicant’s project. Accordingly, this background may be examined as part of the asserted housing process without attributing registered ownership, authorship of the applications, or an availability confirmation issued personally in her favor to the amparo applicant.\n\nIt is essential to note an additional discrepancy: the registry documentation, land-use authorization, and positive confirmation identify registration number 161447-000, whereas the request for information, the response, and the report refer to registration number 161446-000. Although survey plan L-1919805-2016 is repeated, the source of that difference has not been established. Consequently, it is not appropriate to deem the two registration numbers to identify the same registered property based solely on those materials, or to establish a connection regarding either one. Nor may the application be denied on the assumption that the earlier document unequivocally relates to a property different from the project property.\n\nVI.- Merits. This Chamber has repeatedly held that, although the fundamental right to water and equal access to it are recognized because water is a service essential to life and health, this right does not entail unrestricted access to water, as the Administration may validly establish general conditions and requirements for access to this service. It is likewise valid for the public or private entities administering the service to reject applications for water service or for a water-availability letter when the interested party does not meet the requirements or when justified by technical or legal reasons. Thus, for example, in Judgment No. 2016-006027 issued at 9:05 a.m. on 6 May 2016, this Chamber held as follows:\n\n“This Constitutional Court, in judgment 2014-9134 issued at 2:05 p.m. on 19 June 2014, which addressed a matter very similar to the one raised in this application, ruled: ‘(...) In repeated judgments on the subject, this Chamber has stated that the supply of drinking water is considered a public service under the Costa Rican legal system and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under conditions of equality, and with adaptation to technological changes (see, in this regard, judgment 2001-09676 issued at 11:25 a.m. on 26 September 2001 and judgment 2004-08161 issued at 10:53 a.m. on 23 July 2004). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the State entities charged with providing the public drinking-water service, is also required to provide that service continuously, adaptably, efficiently, and equally to all inhabitants. Nevertheless, the case law of this Constitutional Court has also indicated that, where there is a legal impossibility (meaning failure to meet the requirements established in the applicable regulations) or a formal impossibility (meaning the absence of a Water Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear the installation costs when no drinking-water distribution network exists and infrastructure must be built. Thus, in these cases it has been clearly understood that this is not a denial of access to drinking-water service, but an inability to provide it or the necessary participation of the interested party in overcoming a technical impossibility, namely, the lack of infrastructure. In other words, provided that the failure to furnish drinking-water service is not capricious, arbitrary, or unfounded, but is justified by a legal or material impossibility, there is no violation of fundamental rights. In the specific case, the evidence submitted and the report provided under oath confirm that AyA did not arbitrarily reject the application submitted by the amparo applicant, but did so because not all the technical and legal requirements established by the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for approving new services had been met.’”\n\nThose arguments apply fully to this specific case, in which the amparo applicant was denied a drinking-water-availability letter for technical reasons. Nevertheless, satisfaction of a particular application must be reconciled with the aqueduct’s actual conditions and the continuity of supply to those receiving the service. It is therefore inappropriate to order the issuance of a positive certification that disregards an established technical impossibility.\n\nFollowing the same reasoning, the refusal in this matter is not supported solely by a statement from the ASADA president. The aqueduct’s technical assessment and, particularly, a November 2025 AyA official letter documenting the increase in service connections, the negative balance, and the risk posed by adding new demand have been submitted. The report provided in these proceedings confirms that limitation, and the October 2026 documentation specifies that the new source is not yet operational. Accordingly, for purposes of constitutional review, there is objective support for rejecting the contention that the denial resulted from a merely capricious decision.\n\nIt is also noted that the minutes submitted do not establish a uniform prohibition on every application: they approve planned connections (previstas), applications with valid availability confirmations, and infrastructure confirmations, and they resolve to inquire about a conditional certification. Water sufficiency is a prerequisite for issuing a positive confirmation. Disputes concerning the technical balance, registered-property identification, or a particular supply arrangement must therefore be raised before the competent administration or the ordinary courts, together with the corresponding evidence.\n\n VII.- Expiration of the confirmation and alleged assignment. It is established that the certification dated 27 September 2024 had an express twelve-month validity period and that its expiration is acknowledged in the initial filing. No request for an extension submitted during that period has been established. The validity and extension rule in Article 37 of the Reglamento para la Prestación de los Servicios de AyA requires a timely application and an examination of technical feasibility, while a new application must be assessed according to the system’s conditions once expiration has occurred. Consequently, the earlier confirmation does not, by itself, establish the continued existence of an enforceable reservation in August 2026.\n\nThe extended duration of the subsidy process and the parties’ good-faith conduct explain the context of the expiration, but do not establish that the association extended the confirmation, prevented the timely submission of an application, or caused the housing delay. Therefore, no constitutional violation arises merely from the refusal to maintain the conditions of a temporary availability confirmation indefinitely, without prejudice to any ordinary claims that may be available.\n\nRegarding the assignment, the amparo applicant mentions the assistance of a person who held four availability confirmations but does not submit the instrument, the valid confirmation, or identification of the property of origin. Nor can it be deemed established, based solely on the respondent ASADA’s assertion, that this availability confirmation pertains to a particular different property. What is decisive is that there is no evidence of an act by the operator authorizing application of the assigned availability confirmation to the project lot. A private assignment does not replace verification of the capacity and conditions of the recipient property and therefore does not permit an order in these proceedings for its automatic recognition. Consequently, this Court considers that the respondent’s denial of water availability is supported by a material impossibility and thus does not constitute arbitrary conduct. It should be noted, however, that whether the water service at issue is appropriate, as well as the relevance or accuracy of the technical reasons supporting the respondent party’s decision and the propriety of the requirements imposed for providing the service, are not matters to be litigated in this jurisdiction because they concern a dispute of ordinary legality outside this Chamber’s jurisdiction.\n\nVIII.- RIGHT OF PETITION. In relation to Articles 27 and 30 of the Constitución Política, the request submitted on 14 August 2026 must be distinguished from a separate request for copies of the study and the resolution. The former was signed by [Nombre 003] and requested a written response concerning the expiration, the technical reason for the refusal, and the alternatives. The response of the following 21 August addressed those matters, and therefore no violation of the right of petition and access to information has been established.\n\nThe authorities have provided confirmation that the response was delivered on 24 August 2026, and the initial filing itself acknowledges that the response was delivered and reproduces its contents before the amparo proceeding was filed. Under those circumstances, there was no constitutionally injurious failure of communication. For purposes of this matter, although it has not been established that the amparo applicant personally submitted an information request to the ASADA, the established request received a written response, which came to the attention of the person who filed the amparo and who challenges its grounds and effects. However, she should be advised that the right of petition does not require that the requested relief be granted, but rather that the request be addressed in a responsive manner and that the decision be communicated. Disagreement with the technical refusal does not render that response nonexistent or establish administrative silence concerning a different request. For the reasons stated, the amparo is also inadmissible with respect to this issue.\n\n IX.- PARTIAL DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, WRITTEN BY THE FORMER. For the reasons stated below, we consider that this application should be granted insofar as the denial of water service is concerned. The majority opinion denies the amparo because, in its view, the challenged refusal does not result from arbitrary or discriminatory conduct but is based on technical criteria. However, it fails to give adequate weight to the fact that access to drinking water is a fundamental right essential to life, health, and human dignity. Article 21 of the Constitución Política protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution imposes on the State the duty to ensure the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—as interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to adopt positive measures for its full realization. The State has a heightened obligation in a social and democratic state governed by the rule of law; for that reason, supplying water is a priority obligation of public authorities. The public-service provider cannot confine itself to noting deficiencies in the system; it has a legal duty to plan, anticipate, and carry out the measures necessary to progressively guarantee access to water service, especially when it is intended for human consumption. This does not mean requiring the impossible, but rather requiring the adoption of reasonable, alternative, or progressive measures so that people are not left unprotected.\n\nWater is not merely another service; it is an essential human right. Accordingly, the respondent entity cannot disregard its duty to guarantee it by invoking technical limitations without offering effective solutions. For these reasons, we consider that the application should be granted, at least to order the adoption of concrete and progressive measures that would guarantee the protected party effective access to drinking water within a reasonable period. Water is a good and a fundamental right whose effective enjoyment must be ensured; this is an unavoidable duty.\n\nX.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, those items must be collected from the Court within a maximum period of thirty business days following notice of this judgment. Otherwise, any material not collected within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\n The application is denied. Justices Cruz Castro and Rueda Leal partially dissent and would grant the application insofar as the denial of water service is concerned.-\n\n \n\n \n\nFernando Castillo V.\n\nPresident\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.
