Ver más\nTexto de la resolución\n\n \n\nExp: 16-003142-0007-CO\n\nRes. Nº 2016007539\n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cinco minutos del tres de junio de dos mil dieciseis .\n\n               \n\nRecurso de amparo presentado por Paola Andrea López Núñez, cédula de identidad 0303690814, contra la Municipalidad de Cartago y la Municipalidad de Oreamuno de Cartago.\n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de esta Sala a las once horas cincuenta y cuatro minutos del ocho de marzo del dos mil dieciséis la recurrente presenta recurso de amparo contra la Municipalidad de Cartago y la Municipalidad de Oreamuno de Cartago. Manifiesta que el 12 de noviembre de 2014 los vecinos del costado sur del Cementerio de San Rafael de Oreamuno solicitaron al Alcalde de Cartago y al Concejo Municipal de Oreamuno, audiencia para exponer algunos problemas comunales. Detallaron la presencia de insectos provenientes del cementerio y un desnivel del muro de contención del cementerio y que las cunetas que se ubican en la parte norte del cementerio no están bien construidas, dado que, no tienen un desnivel que facilite la evacuación del agua. Razón por la que el agua se estanca o sale a la calle, lo cual crea pozos que pueden ser criaderos de zancudos transmisores de graves enfermedades. De la misma manera, los lotes ubicados al costado sur del cementerio tienen poco mantenimiento y se encuentran llenos de pasto, lo que aumenta la posibilidad de criaderos de insectos, además, se utilizan como botaderos de basura. No obstante lo anterior, a la fecha de interposición de este recurso, no se les ha brindado una solución. Estima violentados sus derechos fundamentales y los de quienes habitan en dicho lugar. Solicita que se declare con lugar el recurso.\n\n2.- Por resolución de las ocho horas y cuarenta minutos de nueve de marzo de dos mil dieciséis se le dio curso al presente amparo y se le solicitó informe al Alcalde Municipal de Cartago y al Alcalde Municipal y Presidente del Concejo Municipal, ambos de la Municipalidad de Oreamuno (ver registro electrónico).\n\n3.- Por escrito presentado en la Secretaría de esta Sala a las 13:08 hrs. del 14 de marzo del 2016 el recurrente manifiesta que solicitó a las Municipalidades realizar los trabajos necesarios para pavimentar la calle y colocar el alcantarillados ya que existe una salida de agua del cementerio y que la Municipalidad de Oreamuno inició el trabajo nivelando con el back hoe y colocando una sub base pero no se ha concluido el trabajo y no se ha logrado que ambas Municipalidades se coordinen para realizar los trabajos. Además de los temas que se han comunicado a las Municipalidades tienen otros problemas de los cuales solicitan solución, como es la ubicación de las fosas cerca del muro de contención que no hay espacio para realizar una acera y colocar cunetas. La esquina de dicho cementerio no permite la visibilidad, lotes sin mantenimiento y el desnivel de las cunetas (los dos primeros puntos corresponden a la Municipalidad de Oreamuno y los últimos puntos son parte de la Municipalidad de Cartago). En el escrito de interposición del recurso no se refiere a cunetas, sino cordón de caño.\n\n4.- Informa bajo juramento Adrián Leandro Marín en su calidad de Alcalde a.i. y Diego Moya Gamboa en calidad de Presidente a.i. ambos de la Municipalidad de Cartago (ver registro electrónico) que: a) No han recibido documento o gestión a nombre de la recurrente; b) Tocante a que existen insectos en el cementerio y un  desnivel en el muro de contención de ese inmueble, así como cunetas en su parte norte que no presentan un desnivel que facilite la evacuación de aguas pluviales, lo que hace que las aguas se estanquen o se salgan a la calle, tales aseveraciones se refieren a un inmueble y a la infraestructura pública que es propiedad de la Municipalidad de Oreamuno; c) Atinente a lo afirmado en cuanto a que los lotes ubicados al costado sur del cementerio tienen poco mantenimiento y se encuentran enmontados, lo que hace que sean causa de criaderos de vectores y de depósitos ilegales de basuras, se aclara que es hasta ahora, con el amparo de marras, que la recurrente informa de ese problema y que en las mismas probanzas que adjunta al amparado, no se contiene referencia alguna al mismo, es decir, que es hasta la interposición del amparo que la Municipalidad de Cartago conoce de la situación; d) El Encargado de la Unidad Ambiental realizó una inspección al sitio el 15 de marzo del 2016 y verificó la situación descrita por la recurrente por lo que procedió de inmediato a iniciar las actividades preliminares  del procedimiento dispuesto en el numeral 75 del Código Municipal  con el objeto de ordenar a los titulares de los fundos involucrados para que procedan a ponerse a derecho, procedimiento que se estará iniciando a la mayor brevedad, se aclara que no existen depósitos de basura. Solicitan que se declare sin lugar el recurso.\n\n5.- Informa bajo juramento José Rafael Huertas Guillén en calidad de Alcalde de la Municipalidad de Oreamuno (ver registro electrónico) que: a) Sobre las cunetas que se ubican en la parte norte del cementerio se logró observar que en la actualidad no representa algún riesgo para los vecinos en la época lluviosa más fuerte, algunas aguas se salen a la calle, situación que se da casi en todas partes, pero por el nivel de las lluvias en algunas ocasiones, las cunetas se encuentran en buen estado, recientemente se cambió alguna tubería de acueducto que pasa por ese sector y se dejó la cuneta en buen estado nuevamente; b) Los lotes que se encuentran ubicados al costado sur del cementerio están bajo la jurisdicción de la Municipalidad de Cartago (la calle es limítrofe de  cantones de Oreamuno y Cartago, los mismos aunque están cerrados no presentan el mantenimiento debido, como se pueden observar en las fotografías que se adjuntan, por lo que considera que se le debe notificar por parte de Municipalidad de Cartago a los propietarios para que le den el mantenimiento debido; c) En el cementerio el pasto está recortado, los  jardines y las plantas están bien cuidadas y la zona en general se mantiene limpia e higiénica; d) En la calle (empero del lado norte del cementerio) sería adecuado realizar un trabajo de corte o desvío de aguas con tubería que tenga mayor capacidad que la existente para desviar las aguas que provienen de la calle oeste –norte también limítrofe con el cantón de Cartago, no obstante, sería parte de un proceso de mayo envergadura para control de aguas que provienen del norte por el desarrollo urbanístico; e) No se ha iniciado con el estudio en ningún presupuesto, pues las prioridades las determinan órganos municipales como Concejos de Distrito, Junta Vial Cantonal no lo han considerado; f) El síndico municipal recibió al recurrente a los vecinos del costado sur del Cementerio de San Rafael de Oreamuno   y se gestionó una limpieza de la zanja y mejoras en la calle; g) Por las flores de las tumbas es que se visualizan insectos, pero son de la época, no especies que atenten contra la salud de los vecinos; h) El 02 de marzo del 2016 una funcionaria del Ebais realizó una visita en el lugar y emitió una serie de recomendaciones, como evitar agua en los floreros  y mantener la limpieza de las canoas  y de las pilas y no se encontraron irregularidades, ni problemas con muros y tapias que representen un peligro para alguna persona; i) Actualmente se está aplicando un producto denominado “Malaquin 60 ec” por recomendación e instrucciones de la empresa Agricultores Unidos S.A. y que debe aplicarse tres veces por semana para controlar un mosquito que es muy común en jardines y cementerios pues dice “sale de las mismas plantas” en la época todos los años principalmente en el verano, no obstante hace tres años se había fumigado pero no se ha repetido la fumigación; j) Las cunetas que se ubican en la parte norte del cementerio se observa que en la actualidad no representa ningún riesgo para los vecinos en la época lluviosa más fuerte, algunas aguas salen a la calle, situación que se da casi en todas partes, las cunetas se encuentran en buen estado, recientemente se cambió alguna tubería de acueducto que pasa por ese sector y se dejó la cuenta en buen estado nuevamente; k) Los lotes que se encuentran ubicados al costado sur del cementerio están bajo la jurisdicción de la Municipalidad de Cartago, los mismos aunque no están cerrados no presentan el mantenimiento debido, por lo que la  Municipalidad de Cartago debería notificar a los propietarios para que le den el mantenimiento correspondiente; l) En el cementerio el pasto está recortado, los jardines y plantas están cuidadas y la zona en general se mantiene limpia e higiénica, no es la causa de ningún problema para los vecinos cercanos, tanto de San Rafael de Oreamuno como de Cartago, esto último por cuanto la calle sur del Cementerio es limítrofe entre los cantones de Oreamuno y Cartago; m) En criterio personal considera que sería adecuado realizar un trabajo de corte o desvío de aguas con tubería  que tengan mayor limítrofe con el cantón de Cartago, no obstante sería parte de un proyecto de mayor envergadura para control de aguas que provienen del norte por el desarrollo urbanístico. Solicita que se declare sin lugar el recurso.\n\n6.- Por resolución de las quince horas y dos minutos de uno de abril de dos mil dieciséis el Magistrado Instructor como prueba para mejor resolver solicitó al Director  del Área Rectora de Salud de Cartago realizar  una inspección en el lugar y rendir un informe sobre la condición actual del cementerio (ver registro electrónico).\n\n7.- Informa bajo juramento Ericka Masis Cordero en calidad de Directora del Área Rectora de Salud de Cartago (ver registro electrónico) que el 25 de abril del 2016 la gestora ambiental del Área Rectora de Salud de Cartago, Licda. Nancy Fernández Fedullo, elaboró el Informe Técnico N°CE-ARSC-R-0379-2016, en el cual concluye textualmente “ … Debido a que el Cementerio de Oreamuno no localiza en jurisdicción del Área Rectora de Salud de Oreamuno, se recomienda hacer devolución del recurso de amparo para que se proceda a notificar al Dr. Oscar Rodríguez González, Director del Área Rectora de Salud de Oreamuno …”. Solicita se notifique al Área Rectora de Salud de Oreamuno. \n\n8.- Informa bajo juramento Oscar Rodríguez González en calidad de Director del Área Rectora de Salud de Oreamuno (ver registro electrónico) que el 06 de mayo del año 2016, al ser las diez horas con nueve minutos, en esta Área Rectora de Salud, se recibió vía fax el oficio DAJ-RM-1015-2016, suscrito por el Lic. Ronny Stanley Muñoz Salazar, Director de la Dirección de Asuntos Jurídicos, en el cual manifestó que con instrucciones del señor Ministro de Salud y por haberlo ordenado la Sala Constitucional como prueba para mejor resolver se ordenaba la realización de una inspección en los jardines del cementerio de la comunidad de Oreamuno de Cartago para determinar la presencia de moscos en esa zona. Con fecha 06 de mayo del año 2016, y en  cumplimiento de lo antes indicado, se le solicitó a la Dra. Fiorella Fait Wong, Coordinadora del Proceso de Regulación y Vigilancia de la Salud, realizar la respectiva inspección. El 06 de mayo del año 2016 se realizó la inspección solicitada. Lo encontrado en dicha inspección se detalla a continuación: EN LOS JARDINES: Se observa que a los jardines del cementerio se les ha brindado el mantenimiento adecuado (el césped está recortado, las plantas ornamentales tienen un tamaño adecuado, no se observan aguas estancadas en las zonas verdes, no hay residuos ni objetos que puedan ser potenciales criaderos de mosquitos en los jardines o zonas verdes en sí. SOBRE LAS LAPIDAS: Existen algunas maceteras sobre las lápidas que no tienen ningún medio para que fluya el agua de lluvia, observándose agua limpia, estancada, sin evidencia de huevos o larvas de mosquitos.  La mayoría de maceteras y floreros están debidamente rellenos con tierra, cemento o tapados con algún otro material, a otros se les ha colocado algún sistema de desagüe como agujeros o tubos para evitar que se estanque el agua.  No se observó presencia de mosquitos en los jardines, zonas verdes o alrededores del cementerio. Sin embargo, sí existen potenciales criaderos (maceteras y floreros con agua limpia estancada) para que se desarrolle el vector que transmite los virus del dengue, Chikungunya y Zika.\n\n9.-En los procedimientos seguidos se han observado las prescripciones legales.\n\nRedacta el Magistrado Cruz Castro; y,\n\nConsiderando:\n\nI.- OBJETO DEL RECURSO: La recurrente alega que en fecha 12 de noviembre de 2014 los vecinos del costado sur del Cementerio de San Rafael de Oreamuno solicitaron al Alcalde de Cartago y al Concejo Municipal de Oreamuno, audiencia para exponer algunos problemas comunales. Detallaron la presencia de insectos provenientes del cementerio y un desnivel del muro de contención del cementerio y que las cunetas que se ubican en la parte norte del cementerio no están bien construidas, dado que, no tienen un desnivel que facilite la evacuación del agua. Razón por la que el agua se estanca o sale a la calle, lo cual crea pozos que pueden ser criaderos de zancudos transmisores de graves enfermedades. De la misma manera, los lotes ubicados al costado sur del cementerio tienen poco mantenimiento y se encuentran llenos de pasto, lo que aumenta la posibilidad de criaderos de insectos, además, se utilizan como botaderos de basura. No obstante lo anterior, a la fecha de interposición de este recurso, no se les ha brindado una solución. Estima violentados sus derechos fundamentales y los de quienes habitan en dicho lugar. Solicita que se declare con lugar el recurso.\n\nII.- HECHOS PROBADOS: De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:\n\na.  En fecha 14 de noviembre del 2014 vecinos del costado sur del Cementerio de San Rafael de Oreamuno le solicitaron una audiencia al Alcalde Municipal y al Presidente del Concejo Municipal de San Rafael de Oreamuno de Cartago indicándole que “ …. Tenemos algunos problemas comunales, vivimos al costado sur del cementerio de San Rafael de Oreamuno, la calle no está pavimentada y tiene muchos huecos que con las lluvias se inundan, las aguas provenientes del cementerio caen sobre la calle, no hay alcantarillado y tenemos una gran cantidad de gusanos que se meten a nuestras casas, principalmente cuando hay presencia de fuertes lluvias; realmente estamos preocupados ya que nos da temor que de esta manera se propaguen enfermedades a causa de los desechos que provienen del cementerio, las calles se llenan de bastante barro y no hay lugar por donde se pueda pasar y además el muro que delimita al cementerio tiene un desnivel por la presión de la tierra, al cual se le debería de dar mantenimiento y aparte de eso el mas aspecto …” (ver registro electrónico).\n\nb. Por oficio AM-OF-1451-2014 de fecha 21 de noviembre del 2014 el Alcalde Municipal de Oreamuno le informó  a Andrés Alejandro González Víquez y Otros que “… En atención al Oficio de fecha “12 de noviembre 2014”, Exp. 14077, en relación con problemas de calle costado sur del cementerio de San Rafael de Oreamuno, me permito remitir el Oficio N°CMO-OF-322-14, suscrito por el Ing. Andrés Fernández Solano, Coordinador del Departamento de Obras Municipales … ” (ver registro electrónico).\n\nc.  Mediante oficio AM-TCI-2475-2014 de fecha 19 de noviembre del 2014 el Ing. Andrés Fernández Solano, Coordinador del Departamento de Obras Municipales le informó al Alcalde Municipal de Cartago “… El día de hoy a partir de las 12:00 md hrs. ha procedido el suscrito a realizar la visita de mérito al sitio referido en compañía de nuestro Capataz Sr. Fernando Collado Ugalde, determinándose que según los registros municipales el mismo es camino público cantonal limítrofe entre Cartago y Oreamuno a partir de la LC eje central del camino por lo que del eje supraindicado hacia el norte corresponde al Municipio de Oreamuno y hacia el sector sur corresponde a la jurisdicción de nuestra Municipalidad de Cartago. Así las cosas la  intervención del camino deber ser conjunta entre ambos municipios acorde a la territorialidad correspondiente de cada uno, de igual forma los sistemas de alcantarillado pluvial requeridos deben ser proyectados bajo el mismo criterio. Así las cosas y en lo que respecta a las competencias institucionales de esta Dependencia estamos en la mayor disposición de brindar la colaboración requerida en lo que hace a los insumos para la construcción de los sistemas de alcantarillado pluvial de la margen sur del camino en mención en caso de que oportunamente la Unidad Técnica Vial así lo determine para la intervención de la calle de citas, ergo, decirlo el sistema frontal del sector norte es sumamente necesario por la cantidad de agua que tributa la propiedad del cementerio en jurisdicción de Oreamuno mismo que a su vez es administrado por ese Municipio. Gran parte de la sección de calle sur en nuestra jurisdicción cuenta con aceras y cordón de caño infraestructura que se presume fue oportunamente  avalada y alineada por la Dirección de Urbanismo. En lo tocante a mejoras en la superficie de ruedo solicitadas ello es correspondencia de la Unidad Técnica de Gestión Vial misma que oportunamente deberá referirse a dicha parte de la solicitud. Finalmente, en lo que respecta a la presunta presencia de contaminación proveniente del cementerio y problemas estructurales del muro de detención del mismo, ello es correspondencia del Municipio de Oreamuno, entidad ante la cual deberán los estimables recurrentes plantear la respectiva solicitud de valoración e intervención…” (ver registro electrónico).\n\nd. Por oficio 1257-SCM-2014  de fecha 25 de noviembre del 2014 el Concejo Municipal de Oreamuno le comunicó a la Junta Cantonal Vial, Vecinos costado sur del cementerio de San Rafael el acuerdo N°6394-2014 que indica “SE ACUERDA POR UNANIMIDAD, trasladar copia del documento a la Junta Cantonal para que sea analizada. Se le indica a los interesados que la audiencia solicitada se les estará brindando  para el día 29 de enero del 2015, al ser las 5:30 p.m. en el Salón de Sesiones de la Municipalidad de Oreamuno” (ver registro electrónico).\n\ne.  Por oficio 0082-SCM-2015 de fecha 03 de febrero del 2015 la Secretaria del Concejo Municipal de Oreamuno comunicó al Alcalde y a los Vecinos costado sur del cementerio de San Rafael el acuerdo N°3797-20156 que indica “SE ACUERDA POR UNANIMIDAD, solicitar a la Administración Municipal coordinar con el Concejo de Distrito, la Junta Vial Cantonal y la Unidad  Técnica de Gestión Vial, la planificación e intervención de la calle costado sur del cementerio en conjunto con la Municipalidad de Cartago” (ver registro electrónico).\n\nf.   En fecha 02 de marzo del 2016 una funcionaria del Ebais realizó una visita en el lugar y emitió una serie de recomendaciones, como evitar agua en los floreros  y mantener la limpieza de las canoas  y de las pilas y no se encontraron irregularidades, ni problemas con muros y tapias que representen un peligro para alguna persona (ver registro electrónico).\n\ng.  En fecha 17 de marzo del 2015 se realizó la reunión comunal (ver registro electrónico).\n\nh. En fecha 06 de mayo del año 2016 , funcionarios del Área Rectora de Salud de Oreamuno realizaron una inspección  en los jardines del cementerio de la comunidad de Oreamuno de Cartago para determinar la presencia de moscos en esa zona, en la inspección se anotó: “EN LOS JARDINES: Se observa que a los jardines del cementerio se les ha brindado el mantenimiento adecuado (el césped está recortado, las plantas ornamentales tienen un tamaño adecuado, no se observan aguas estancadas en las zonas verdes, no hay residuos ni objetos que puedan ser potenciales criaderos de mosquitos en los jardines o zonas verdes en sí. SOBRE LAS LAPIDAS: Existen algunas maceteras sobre las lápidas que no tienen ningún medio para que fluya el agua de lluvia, observándose agua limpia, estancada, sin evidencia de huevos o larvas de mosquitos.  La mayoría de maceteras y floreros están debidamente rellenos con tierra, cemento o tapados con algún otro material, a otros se les ha colocado algún sistema de desagüe como agujeros o tubos para evitar que se estanque el agua.  No se observó presencia de mosquitos en los jardines, zonas verdes o alrededores del cementerio. Sin embargo, sí existen potenciales criaderos (maceteras y floreros con agua limpia estancada) para que se desarrolle el vector que transmite los virus del dengue, Chikungunya y Zika” (ver registro electrónico).\n\ni.    Las cunetas que se ubican en la parte norte del cementerio se encuentran en buen estado - recientemente se cambió alguna tubería de acueducto que pasa por ese sector y se dejó la cuneta en buen estado nuevamente- (ver registro electrónico).\n\nj.   En época lluviosa fuerte la constante es que el agua de las cunetas se rebalse por el nivel del agua  (ver registro electrónico).\n\nk. Los lotes que se encuentran ubicados al costado sur del cementerio están bajo la jurisdicción de la Municipalidad de Cartago (la calle es limítrofe de  cantones de Oreamuno y Cartago, los mimos aunque están cerrados no presentan el mantenimiento debido (ver registro electrónico).\n\nl.    En la calle norte del cementerio se requiere realizar un trabajo de corte o desvío de aguas con tubería que tenga mayor capacidad que la existente para desviar las aguas que provienen de la calle oeste  (ver registro electrónico).\n\nm.  Actualmente en el cementerio se está aplicando tres veces por semana un producto denominado “Malaquin 60 ec” por recomendación e instrucciones de la empresa Agricultores Unidos S.A. para controlar un mosquito que es muy común en jardines y cementerios (ver registro electrónico).\n\nIII.- SOBRE EL CASO CONCRETO: De los informes rendidos por las autoridades municipales y sanitarias, los cuales son rendidos bajo la solemnidad del juramento con las consecuencias legales que ello implica se desprende que desde el año dos mil catorce las autoridades municipales tienen conocimiento de los problemas que enfrentan los vecinos del costado sur del Cementerio de San Rafael de Oreamuno, problemas relacionados con el pavimento de la calle y la ausencia de alcantarillado. De igual forma se logró acreditar que ese mismo año, los gobiernos locales de Cartago y Oreamuno al concluir, que el camino público cantonal constituye el límite entre ambos cantones, acordaron realizar la intervención en forma conjunta. Posteriormente y mediante oficio 0082-SCM-2015 de fecha 03 de febrero del 2015 la Secretaria del Concejo Municipal de Oreamuno comunicó al Alcalde y a los Vecinos del costado sur del cementerio de San Rafael el acuerdo N°3797-20156 que indica “SE ACUERDA POR UNANIMIDAD, solicitar a la Administración Municipal coordinar con el Concejo de Distrito, la Junta Vial Cantonal y la Unidad  Técnica de Gestión Vial, la planificación e intervención de la calle costado sur del cementerio en conjunto con la Municipalidad de Cartago”. En ocasión a la interposición del presente recurso de amparo, las autoridades sanitarias realizaron una inspección en el lugar y concluyeron en resumen que: 1. A los jardines del cementerio  se les brinda un mantenimiento adecuado; 2. No existen aguas negras, ni residuos, ni objetos que puedan ser potenciales criaderos de mosquitos; 3. En las lápidas se observaron  potenciales criaderos (maceteras y floreros con agua limpia estancada) para que se desarrolle el vector que transmite los virus del dengue, Chikungunya y Zika”. De igual forma se logró acreditar que los lotes que se encuentran ubicados al costado sur del cementerio aunque están cerrados no presentan el mantenimiento debido y que en la calle norte del cementerio se requiere realizar un trabajo de corte o desvío de aguas con tubería que tenga mayor capacidad que la existente para desviar las aguas que provienen de la calle oeste. Ante ese panorama el amparo deviene procedente por las siguientes razones: 1. Tal y como se logró acreditar, recientemente las autoridades de la Municipalidad de Oreamuno, cambiaron alguna tubería del acueducto que pasa por la parte norte del cementerio, sin embargo, reconocen que en la calle norte del cementerio se requiere realizar un trabajo de corte o desvío de aguas con tubería que tenga mayor capacidad que la existente para desviar las aguas que provienen de la calle oeste –trabajo que a la fecha no se ha realizado-; 2. En la inspección realizada por las autoridades sanitarias se constató que sí existen potenciales criaderos (maceteras y floreros con agua limpia estancada) para que se desarrolle el vector que transmite los virus del dengue, Chikungunya y Zika”; 3. Los lotes a los que se refiere la recurrente si bien es cierto se encuentran cerrados, quedó acreditado que no se les brinda el debido mantenimiento.\n\nIV.- CONCLUSIÓN: En esa tesitura, se debe tener por cierto que  a la fecha de presentación del recurso de amparo, las autoridades municipales no han girado las órdenes pertinentes a efectos de que los  propietarios de los lotes realicen la limpieza de los mismos, el cambio de la tubería para desviar las aguas que provienen de la calle oeste se encuentra pendiente y a pesar de que se constató en los jardines del cementerio la presencia de criaderos del vector que transmite los virus del dengue, Chikungunya y Zika no se han tomado acciones al respecto. Evidentemente la inercia de las autoridades recurridas pone en riesgo tanto la seguridad de los peatones del lugar, como otros derechos fundamentales de igual trascendencia, como el derecho a un ambiente sano, reconocido en el numeral 50 de la Constitución.\n\nV.- NOTA DEL MAGISTRADO JINESTA LOBO. El suscrito Magistrado aclara, en primer término, que si bien los asuntos ambientales, cuando hay intervención administrativa de cualquier índole, los remite a la jurisdicción contencioso administrativa, lo cierto es que tratándose de denuncias donde se alega una presunta contaminación a raíz de aguas estancadas y la proliferación de criaderos de mosquitos que afecta, a su vez, a los ocupantes de varias casas de habitación -como sucede en el caso concreto-, no lo hará así. Esto, por cuanto, se encuentran en juego otros derechos de los vecinos de la fuente contaminante, tales como la salud y a gozar de un nivel digno de calidad de vida.  De otra parte, el suscrito Magistrado aclara que en aquellos asuntos relacionados con la reparación o construcción de diversas obras de infraestructura, salva igualmente el voto al estimar que la inactividad administrativa constituye una discusión propia de ser planteada ante la jurisdicción ordinaria. Lo anterior, excepto que exista de por medio la infracción a otros derechos fundamentales como la vida, la integridad física, la propiedad privada y la vivienda o bien, la tutela a grupos en desventaja. En el sub lite, al estar de por medio la protección a la integridad y a la propiedad de la tutelada y demás vecinos de la zona, se estima procedente conocer el fondo del amparo. Desde esa perspectiva, es una excepción a la regla en esta materia.\n\nVI.-  NOTA SEPARADA DE LA MAGISTRADA HERNANDEZ LÓPEZ: Como línea general sostengo que los reclamos por omisiones en relación con temas de infraestructura pueden y deben ser atendidos por los órganos administrativos competentes y de control así como por la jurisdicción ordinaria.- Pero también he dejado hecha la salvedad de que la puesta en peligro de derechos como la integridad física y la salud ameritan la intervención de este Tribunal. Ello sucede en este caso concreto tal y como se demuestra del elenco de hechos demostrados que permite concluir que existe un peligro inminente para la salud de las personas y que las autoridades que conocen del problema no han actuado con la diligencia necesaria para dar remedio a dicha urgencia. Por estas razones es que concurro con el voto de mayoría.\n\nVII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE . Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\n \n\nPor tanto:\n\nSe declara con lugar el recurso. Se ordena a Adrián Leandro Marín en su calidad de Alcalde a.i. y Diego Moya Gamboa en calidad de Presidente a.i. ambos de la Municipalidad de Cartago o a quienes ocupen los cargos, que dentro del plazo de QUINCE DÍAS contado a partir de la notificación de esta sentencia, se comuniquen con los propietarios de los lotes que se encuentran ubicados al costado sur del cementerio para que procedan a realizar la limpieza correspondiente, en caso de no concretar la notificación, deberá la Municipalidad proceder con la limpieza y proceder posteriormente a realizar el cobro respectivo. Asimismo, se le ordena a José Rafael Huertas Guillén en calidad de Alcalde de la Municipalidad de Oreamuno o a quien en su lugar ocupe el cargo, que dentro del plazo de SEIS MESES contados a partir de la notificación de esta sentencia, realice los trámites correspondientes para que se inicien las mejoras en la tubería de las cunetas que se ubican en la parte norte del cementerio. Deberá además coordinar con las autoridades sanitarias para que DE FORMA INMEDIATA se tomen las acciones correspondientes a fin de eliminar los potenciales criaderos del vector que transmite los virus del dengue, Chikungunya y Zika que se localizaron en los jardines del cementerio. Se hace la advertencia de que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Oreamuno y  a la Municipalidad de Cartago al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese la presente resolución a Adrián Leandro Marín en su calidad de Alcalde a.i. y Diego Moya Gamboa en calidad de Presidente a.i. ambos de la Municipalidad de Cartago y a José Rafael Huertas Guillén en calidad de Alcalde de la Municipalidad de Oreamuno o a quienes ocupen los cargos EN FORMA PERSONAL. San José, at nine hours and five minutes on June third, two thousand sixteen.\n\nAmparo petition filed by Paola Andrea López Núñez, identity card 0303690814, against the Municipality of Cartago and the Municipality of Oreamuno de Cartago.\nResulting:\n\n1.- By a brief filed at the Secretariat of this Chamber at eleven hours and fifty-four minutes on March eighth, two thousand sixteen, the petitioner files an amparo petition against the Municipality of Cartago and the Municipality of Oreamuno de Cartago. She states that on November 12, 2014, the residents of the south side of the San Rafael de Oreamuno Cemetery requested the Mayor of Cartago and the Municipal Council of Oreamuno for a hearing to discuss some community problems. They detailed the presence of insects coming from the cemetery and an unevenness in the cemetery retaining wall, and that the gutters (cunetas) located on the north side of the cemetery are not well constructed, given that they lack a slope to facilitate water evacuation. This is the reason why water stagnates or flows into the street, creating puddles that can become breeding sites for mosquitoes transmitting serious diseases. Similarly, the lots located on the south side of the cemetery have little maintenance and are overgrown with grass, which increases the possibility of insect breeding sites; additionally, they are used as illegal waste dumps (botaderos de basura). Despite the foregoing, as of the date of filing this petition, no solution has been provided to them. She considers that her fundamental rights and those of the people living in that place have been violated. She requests that the petition be granted.\n\n2.- By a resolution at eight hours and forty minutes on March ninth, two thousand sixteen, this amparo was admitted and a report was requested from the Municipal Mayor of Cartago and from the Municipal Mayor and the President of the Municipal Council, both of the Municipality of Oreamuno (see electronic record).\n\n3.- By a brief filed at the Secretariat of this Chamber at 13:08 on March 14, 2016, the petitioner states that she requested the Municipalities to carry out the necessary work to pave the street and install the sewer system (alcantarillados) because there is a water outlet from the cemetery and that the Municipality of Oreamuno began the work by leveling with a backhoe and placing a sub-base, but the work has not been completed and it has not been possible for both Municipalities to coordinate to carry out the work. In addition to the issues that have been communicated to the Municipalities, they have other problems for which they request a solution, such as the location of the graves near the retaining wall, leaving no space to build a sidewalk and install gutters (cunetas). The corner of said cemetery does not allow visibility, lots without maintenance, and the unevenness of the gutters (cunetas) (the first two points correspond to the Municipality of Oreamuno and the last points are the responsibility of the Municipality of Cartago). In the brief filing the petition, she refers not to gutters (cunetas), but to a curb and gutter (cordón de caño).\n\n4.- Adrián Leandro Marín, in his capacity as Acting Mayor, and Diego Moya Gamboa, in his capacity as Acting President, both of the Municipality of Cartago, report under oath (see electronic record) that: a) They have not received any document or communication on behalf of the petitioner; b) Regarding the existence of insects in the cemetery and an unevenness in the retaining wall of that property, as well as gutters (cunetas) on its north side that lack a slope to facilitate stormwater evacuation, causing water to stagnate or flow into the street, such assertions refer to a property and public infrastructure owned by the Municipality of Oreamuno; c) Concerning the claim that the lots located on the south side of the cemetery have little maintenance and are overgrown (enmontados), making them a cause of vector breeding sites and illegal waste deposits (depósitos ilegales de basuras), it is clarified that it is only now, with this amparo in question, that the petitioner reports this problem and that the very evidence she attaches to the petition does not contain any reference to it, meaning that the Municipality of Cartago only became aware of the situation upon the filing of the amparo; d) The person in charge of the Environmental Unit conducted an on-site inspection on March 15, 2016, and verified the situation described by the petitioner, therefore, immediately proceeded to initiate the preliminary activities of the procedure set forth in Article 75 of the Municipal Code in order to order the holders of the involved properties to comply with the law, a procedure that will commence as soon as possible; it is clarified that there are no waste deposits. They request that the petition be dismissed.\n\n5.- José Rafael Huertas Guillén, in his capacity as Mayor of the Municipality of Oreamuno, reports under oath (see electronic record) that: a) Regarding the gutters (cunetas) located on the north side of the cemetery, it was observed that they currently do not represent any risk to the residents; during the heaviest rainy season, some water flows into the street, a situation that occurs almost everywhere, but due to the level of rainfall on some occasions, the gutters (cunetas) are in good condition; some aqueduct piping passing through that sector was recently replaced and the gutter (cuneta) was left in good condition again; b) The lots located on the south side of the cemetery are under the jurisdiction of the Municipality of Cartago (the street is the boundary between the cantons of Oreamuno and Cartago); although they are closed, they do not have proper maintenance, as can be seen in the attached photographs, and therefore he considers that the Municipality of Cartago should notify the owners to provide proper maintenance; c) In the cemetery, the grass is cut, the gardens and plants are well cared for, and the area in general is kept clean and hygienic; d) On the street (specifically on the north side of the cemetery), it would be advisable to carry out work to cut or divert water with piping of greater capacity than the existing one to divert water coming from the west–north street also bordering the canton of Cartago; however, this would be part of a larger-scale project for water control coming from the north due to urban development; e) No budget study has been initiated because priorities are determined by municipal bodies such as District Councils; the Cantonal Road Board (Junta Vial Cantonal) has not considered it; f) The municipal trustee received the petitioner and the residents of the south side of the San Rafael de Oreamuno Cemetery and arranged for cleaning of the ditch and improvements to the street; g) Insects are visible because of the flowers on the graves, but they are seasonal, not species that threaten the health of the residents; h) On March 2, 2016, an official from the Ebais conducted a site visit and issued a series of recommendations, such as avoiding water in flower vases (floreros) and keeping the gutters (canoas) and basins clean, and no irregularities were found, nor problems with walls (muros) and enclosure walls (tapias) representing a danger to any person; i) A product called “Malaquin 60 ec” is currently being applied, based on the recommendation and instructions of the company Agricultores Unidos S.A., and it must be applied three times a week to control a mosquito that is very common in gardens and cemeteries, as it is said to “come from the plants themselves” during the season each year, mainly in summer; however, fumigation was carried out three years ago but has not been repeated; j) The gutters (cunetas) located on the north side of the cemetery are observed to currently not represent any risk to the residents during the heaviest rainy season; some water flows into the street, a situation that occurs almost everywhere; the gutters (cunetas) are in good condition; some aqueduct piping passing through that sector was recently replaced and the gutter (cuneta) was left in good condition again; k) The lots located on the south side of the cemetery are under the jurisdiction of the Municipality of Cartago; although they are not closed, they do not have proper maintenance, so the Municipality of Cartago should notify the owners to provide the corresponding maintenance; l) In the cemetery, the grass is cut, the gardens and plants are cared for, and the area in general is kept clean and hygienic; it is not the cause of any problem for nearby residents of both San Rafael de Oreamuno and Cartago, the latter because the south street of the Cemetery is the boundary between the cantons of Oreamuno and Cartago; m) In his personal opinion, he considers it would be advisable to carry out work to cut or divert water with piping of greater capacity that is on the border with the canton of Cartago; however, this would be part of a larger-scale project for water control coming from the north due to urban development. He requests that the petition be dismissed.\n\n6.- By a resolution at fifteen hours and two minutes on April first, two thousand sixteen, the Investigating Magistrate, as evidence for better resolution, ordered the Director of the Cartago Health Governing Area (Área Rectora de Salud) to conduct an on-site inspection and render a report on the current condition of the cemetery (see electronic record).\n\n7.- Ericka Masis Cordero, in her capacity as Director of the Cartago Health Governing Area (Área Rectora de Salud), reports under oath (see electronic record) that on April 25, 2016, the environmental manager of the Cartago Health Governing Area, Licda. Nancy Fernández Fedullo, prepared Technical Report No. CE-ARSC-R-0379-2016, which concludes textually “… Because the Oreamuno Cemetery is not located in the jurisdiction of the Oreamuno Health Governing Area, it is recommended to return the amparo petition so that Dr. Oscar Rodríguez González, Director of the Oreamuno Health Governing Area, may be notified …”. She requests that the Oreamuno Health Governing Area be notified.\n\n8.- Oscar Rodríguez González, in his capacity as Director of the Oreamuno Health Governing Area (Área Rectora de Salud), reports under oath (see electronic record) that on May 6, 2016, at ten hours and nine minutes, this Health Governing Area received via fax official letter DAJ-RM-1015-2016, signed by Lic. Ronny Stanley Muñoz Salazar, Director of the Legal Affairs Directorate, stating that, with instructions from the Minister of Health and as ordered by the Constitutional Chamber as evidence for better resolution, an inspection of the gardens of the community cemetery of Oreamuno de Cartago was ordered to determine the presence of midges (moscos) in that area. On May 6, 2016, in compliance with the above, Dra. Fiorella Fait Wong, Coordinator of the Health Regulation and Surveillance Process, was requested to perform the respective inspection. The requested inspection was conducted on May 6, 2016. The findings of said inspection are detailed below: IN THE GARDENS: It is observed that the cemetery gardens have been provided with adequate maintenance (the lawn is cut, the ornamental plants are of an adequate size, no stagnant water is observed in the green areas, there are no waste or objects that could be potential mosquito breeding sites in the gardens or green areas themselves). ON THE HEADSTONES (LAPIDAS): There are some planters (maceteras) on the headstones that have no means for rainwater to drain, with clean, stagnant water observed, without evidence of mosquito eggs or larvae. Most planters (maceteras) and flower vases (floreros) are properly filled with soil, cement, or covered with some other material; others have had some drainage system installed, such as holes or tubes, to prevent water from stagnating. No presence of mosquitoes was observed in the gardens, green areas, or surroundings of the cemetery. However, there are indeed potential breeding sites (planters (maceteras) and flower vases (floreros) with clean stagnant water) for the development of the vector that transmits the dengue, Chikungunya and Zika viruses.\n\n9.- In the proceedings followed, the legal requirements have been observed.\n\nDrafted by Magistrate Cruz Castro; and,\n\nConsidering:\n\nI.- PURPOSE OF THE PETITION: The petitioner alleges that on November 12, 2014, the residents of the south side of the San Rafael de Oreamuno Cemetery requested the Mayor of Cartago and the Municipal Council of Oreamuno for a hearing to discuss some community problems. They detailed the presence of insects coming from the cemetery and an unevenness in the cemetery retaining wall, and that the gutters (cunetas) located on the north side of the cemetery are not well constructed, given that they lack a slope to facilitate water evacuation. This is the reason why water stagnates or flows into the street, creating puddles that can become breeding sites for mosquitoes transmitting serious diseases. Similarly, the lots located on the south side of the cemetery have little maintenance and are overgrown with grass, which increases the possibility of insect breeding sites; additionally, they are used as illegal waste dumps (botaderos de basura). Despite the foregoing, as of the date of filing this petition, no solution has been provided to them. She considers that her fundamental rights and those of the people living in that place have been violated. She requests that the petition be granted.\n\nII.- PROVEN FACTS: Of importance for the decision in this matter, the following facts are deemed duly proven, either because they have been accredited as such or because the respondent has failed to refer to them as provided in the initial order:\n\na. On November 14, 2014, residents of the south side of the San Rafael de Oreamuno Cemetery requested a hearing with the Municipal Mayor and the President of the Municipal Council of San Rafael de Oreamuno de Cartago, indicating that “…. We have some community problems; we live on the south side of the San Rafael de Oreamuno cemetery; the street is unpaved and has many potholes that flood with the rains; water coming from the cemetery falls onto the street; there is no sewer system (alcantarillado) and we have a large amount of worms that enter our homes, mainly when there are heavy rains; we are really worried because we fear that diseases may spread due to the waste coming from the cemetery; the streets become very muddy and there is no place to pass; and furthermore, the wall (muro) that borders the cemetery has an unevenness due to earth pressure, which should be maintained, and aside from that, the bad appearance …” (see electronic record).\n\nb. By official letter AM-OF-1451-2014 dated November 21, 2014, the Municipal Mayor of Oreamuno informed Andrés Alejandro González Víquez and Others that “… In response to the Official Letter dated ‘November 12, 2014’, File 14077, regarding problems with the street on the south side of the San Rafael de Oreamuno cemetery, I am forwarding Official Letter No. CMO-OF-322-14, signed by Eng. Andrés Fernández Solano, Coordinator of the Department of Municipal Works …” (see electronic record).\n\nc. By official letter AM-TCI-2475-2014 dated November 19, 2014, Eng. Andrés Fernández Solano, Coordinator of the Department of Municipal Works, informed the Municipal Mayor of Cartago “… Today, starting at 12:00 noon, the undersigned proceeded to conduct the on-site visit in question, accompanied by our Foreman Mr. Fernando Collado Ugalde, determining that, according to municipal records, the same is a cantonal public road on the boundary between Cartago and Oreamuno, starting from the boundary line (LC) at the central axis of the road; therefore, from the aforementioned axis northwards it corresponds to the Municipality of Oreamuno, and towards the south sector it corresponds to the jurisdiction of our Municipality of Cartago. Thus, the intervention of the road must be joint between both municipalities according to the corresponding territoriality of each; likewise, the required storm sewer (alcantarillado pluvial) systems must be designed under the same criteria. Therefore, and regarding the institutional competencies of this Department, we are fully willing to provide the required collaboration regarding the inputs for the construction of the storm sewer (alcantarillado pluvial) systems on the south side of the road in question should the Cantonal Road Management Unit determine the need for intervention of said street; ergo, it must be said that a frontal system on the north sector is extremely necessary due to the amount of water that drains from the cemetery property under the jurisdiction of Oreamuno, which is in turn administered by that Municipality. A large part of the south street section in our jurisdiction has sidewalks (aceras) and a curb and gutter (cordón de caño), infrastructure that is presumed to have been duly endorsed and aligned by the Urban Planning Directorate. Regarding requested improvements to the road surface, that is the responsibility of the Cantonal Road Management Technical Unit, which must duly address that part of the request. Finally, regarding the alleged presence of contamination from the cemetery and structural problems with the retaining wall (muro de detención) thereof, that is the responsibility of the Municipality of Oreamuno, an entity before which the esteemed petitioners must file the respective request for assessment and intervention…” (see electronic record).\n\nd. By official letter 1257-SCM-2014 dated November 25, 2014, the Municipal Council of Oreamuno communicated to the Cantonal Road Board (Junta Cantonal Vial) and the Residents on the south side of the San Rafael cemetery, Agreement No. 6394-2014, which states “IT IS UNANIMOUSLY AGREED, to forward a copy of the document to the Cantonal Board for analysis. The interested parties are informed that the requested hearing will be granted on January 29, 2015, at 5:30 p.m. in the Sessions Hall of the Municipality of Oreamuno” (see electronic record).\n\ne. By official letter 0082-SCM-2015 dated February 3, 2015, the Secretary of the Municipal Council of Oreamuno communicated to the Mayor and the Residents on the south side of the San Rafael cemetery, Agreement No. 3797-2015, which states “IT IS UNANIMOUSLY AGREED, to request the Municipal Administration to coordinate with the District Council, the Cantonal Road Board (Junta Vial Cantonal) and the Cantonal Road Management Technical Unit, the planning and intervention of the street on the south side of the cemetery jointly with the Municipality of Cartago” (see electronic record).\n\nf. On March 2, 2016, an official from the Ebais conducted a site visit and issued a series of recommendations, such as avoiding water in flower vases (floreros) and keeping the gutters (canoas) and basins clean, and no irregularities were found, nor problems with walls (muros) and enclosure walls (tapias) representing a danger to any person (see electronic record).\n\ng. On March 17, 2015, the community meeting was held (see electronic record).\n\nh. On May 6, 2016, officials from the Oreamuno Health Governing Area (Área Rectora de Salud) conducted an inspection of the gardens of the community cemetery of Oreamuno de Cartago to determine the presence of midges (moscos) in that area; the inspection noted: “IN THE GARDENS: It is observed that the cemetery gardens have been provided with adequate maintenance (the lawn is cut, the ornamental plants are of an adequate size, no stagnant water is observed in the green areas, there are no waste or objects that could be potential mosquito breeding sites in the gardens or green areas themselves). ON THE HEADSTONES (LAPIDAS): There are some planters (maceteras) on the headstones that have no means for rainwater to drain, with clean, stagnant water observed, without evidence of mosquito eggs or larvae. The gutters (cunetas) located on the north side of the cemetery are in good condition – some aqueduct piping passing through that sector was recently replaced and the gutter (cuneta) was left in good condition again – (see electronic record).\n\nj. During the heavy rainy season, it is common for the water from the gutters (cunetas) to overflow due to the water level (see electronic record).\n\nk. The lots located on the south side of the cemetery are under the jurisdiction of the Municipality of Cartago (the street is the boundary between the cantons of Oreamuno and Cartago); although they are closed, they do not have proper maintenance (see electronic record).\n\nl. On the north street of the cemetery, it is necessary to carry out work to cut or divert water with piping of greater capacity than the existing one to divert water coming from the west street (see electronic record).\n\nm. Currently, a product called “Malaquin 60 ec” is being applied three times a week at the cemetery, based on the recommendation and instructions of the company Agricultores Unidos S.A., to control a mosquito that is very common in gardens and cemeteries (see electronic record).\n\nIII.- ON THE SPECIFIC CASE: From the reports rendered by the municipal and health authorities, which are rendered under the solemnity of oath with the legal consequences that this entails, it is evident that since two thousand fourteen, the municipal authorities have been aware of the problems faced by the residents of the south side of the San Rafael de Oreamuno Cemetery, problems related to the pavement of the street and the absence of a sewer system (alcantarillado). Likewise, it was possible to accredit that that same year, the local governments of Cartago and Oreamuno, upon concluding that the cantonal public road constitutes the boundary between both cantons, agreed to carry out the intervention jointly. Subsequently, by official letter 0082-SCM-2015 dated February 3, 2015, the Secretary of the Municipal Council of Oreamuno communicated to the Mayor and the Residents of the south side of the San Rafael cemetery, Agreement No. 3797-2015, which states “IT IS UNANIMOUSLY AGREED, to request the Municipal Administration to coordinate with the District Council, the Cantonal Road Board (Junta Vial Cantonal) and the Cantonal Road Management Technical Unit, the planning and intervention of the street on the south side of the cemetery jointly with the Municipality of Cartago”. On the occasion of the filing of this amparo petition, the health authorities conducted an on-site inspection and concluded, in summary, that: 1. The cemetery gardens are provided with adequate maintenance; 2. There are no black waters (aguas negras), nor waste, nor objects that could be potential mosquito breeding sites; 3. On the headstones (lápidas), potential breeding sites (planters (maceteras) and flower vases (floreros) with clean stagnant water) were observed for the development of the vector that transmits the dengue, Chikungunya and Zika viruses”. Likewise, it was possible to accredit that the lots located on the south side of the cemetery, although closed, do not have proper maintenance and that on the north street of the cemetery, it is necessary to carry out work to cut or divert water with piping of greater capacity than the existing one to divert water coming from the west street. Given this situation, the amparo is admissible for the following reasons: 1. As has been accredited, the authorities of the Municipality of Oreamuno recently replaced some aqueduct piping passing through the north part of the cemetery; however, they acknowledge that on the north street of the cemetery, it is necessary to carry out work to cut or divert water with piping of greater capacity than the existing one to divert water coming from the west street – work that to date has not been carried out; 2. In the inspection carried out by the health authorities, it was confirmed that there are indeed potential breeding sites (planters (maceteras) and flower vases (floreros) with clean stagnant water) for the development of the vector that transmits the dengue, Chikungunya and Zika viruses”; 3. The lots referred to by the petitioner, although they are indeed closed, it was accredited that they are not provided with proper maintenance.\n\nIV.- CONCLUSION: In this context, it must be taken as true that as of the date of filing the amparo petition, the municipal authorities have not issued the pertinent orders for the owners of the lots to clean them, the replacement of the piping to divert the water coming from the west street is pending, and despite the presence of breeding sites for the vector that transmits the dengue, Chikungunya and Zika viruses having been verified in the cemetery gardens, no actions have been taken in this regard. Evidently, the inertia of the respondent authorities endangers both the safety of pedestrians in the area and other fundamental rights of equal importance, such as the right to a healthy environment, recognized in Article 50 of the Constitution.\n\nV.- NOTE BY MAGISTRATE JINESTA LOBO. The undersigned Magistrate clarifies, first of all, that although he remits environmental matters, when there is administrative intervention of any kind, to the contentious-administrative jurisdiction, it is true that in the case of complaints alleging potential pollution from stagnant water and the proliferation of mosquito breeding sites that, in turn, affects the occupants of several homes—as is the case here—he will not do so. This is because other rights of the residents near the contaminating source are at stake, such as health and the enjoyment of a dignified quality of life.\n\nOn another note, the undersigned Magistrate clarifies that in those matters related to the repair or construction of various infrastructure works, he likewise dissents, considering that administrative inactivity constitutes a discussion properly to be raised before the ordinary jurisdiction. The foregoing applies unless there is an infringement of other fundamental rights such as life, physical integrity, private property, and housing, or the protection of disadvantaged groups. In the sub lite case, since the protection of the integrity and property of the petitioner and other residents of the area is at stake, it is deemed appropriate to hear the merits of the amparo. From that perspective, it is an exception to the rule in this matter.\n\nVI.- SEPARATE NOTE OF MAGISTRATE HERNANDEZ LÓPEZ: As a general line, I maintain that claims for omissions regarding infrastructure matters can and should be addressed by the competent administrative and oversight bodies as well as by the ordinary jurisdiction. But I have also made the exception that the endangerment of rights such as physical integrity and health warrant the intervention of this Court. This occurs in this specific case, as demonstrated by the list of proven facts that allows the conclusion that there is an imminent danger to people's health and that the authorities aware of the problem have not acted with the necessary diligence to remedy said urgency. For these reasons, I concur with the majority vote.\n\nVII.- DOCUMENTATION PROVIDED TO THE EXPEDIENTE. The parties are warned that if they have provided any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, any material not retrieved within this period will be destroyed, pursuant to the provisions of the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial,\" approved by the Corte Plena in session N° 27-11 of August 22, 2011, article XXVI and published in the Boletín Judicial number 19 of January 26, 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial, in session N° 43-12 held on May 3, 2012, article LXXXI.\n\nPor tanto:\n\nThe recurso is granted. It is ordered that Adrián Leandro Marín, in his capacity as Interim Mayor (Alcalde a.i.), and Diego Moya Gamboa, in his capacity as Interim President (Presidente a.i.), both of the Municipalidad de Cartago, or whoever holds their positions, within a period of FIFTEEN DAYS counted from the notification of this judgment, contact the owners of the lots located on the south side of the cemetery so that they proceed to perform the corresponding cleaning; should notification not be effected, the Municipalidad must proceed with the cleaning and subsequently proceed to make the respective charge. Likewise, it is ordered that José Rafael Huertas Guillén, in his capacity as Mayor of the Municipalidad de Oreamuno, or whoever holds the position in his stead, within a period of SIX MONTHS counted from the notification of this judgment, carry out the corresponding procedures to initiate improvements to the piping of the gutters (cunetas) located on the north side of the cemetery. He must also coordinate with the health authorities so that actions are IMMEDIATELY taken to eliminate the potential breeding sites of the vector that transmits the dengue, Chikungunya, and Zika viruses that were located in the cemetery gardens. It is hereby warned that, in accordance with article 71 of the Law of this Jurisdiction, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order that they must fulfill or enforce, issued in a recurso de amparo, and does not fulfill it or does not enforce it, provided that the offense is not more severely punished. The Municipalidad de Oreamuno and the Municipalidad de Cartago are ordered to pay the costs, damages, and losses caused by the acts serving as the basis for this declaration, which shall be liquidated in the enforcement of judgment phase of the contentious-administrative proceeding. Notify this resolution to Adrián Leandro Marín in his capacity as Interim Mayor (Alcalde a.i.) and Diego Moya Gamboa in his capacity as Interim President (Presidente a.i.), both of the Municipalidad de Cartago, and to José Rafael Huertas Guillén in his capacity as Mayor of the Municipalidad de Oreamuno, or to whoever holds their positions, PERSONALLY.
