  "body_es_text": "Revisión del Documento\n\n\n\n \n\n \n\nVOTO 263-2026\n\nTRIBUNAL DE APELACIÓN DE SENTENCIA PENAL DE GUANACASTE, Santa Cruz, a las trece horas cincuenta minutos del doce de junio de dos mil veintiséis.\n\nRecurso de apelación interpuesto en la presente causa número 12-001557-412-PE, seguida contra [Nombre 001], cédula de identidad número [Valor 001], nacida el 15 de junio de 1954, hijo de [Nombre 002] y [Nombre 003], por el delito de INFRACCIÓN DE CONSERVACIÓN VIDA SILVESTRE en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión de los recursos, las personas juzgadoras Brisa Marina Campbell Argüello, Rodrigo Guillermo Obando Santamaría y Franklin Lara Fallas. Se apersonaron en esta sede la licenciada Milena Rodríguez Garro, en representación del Ministerio Público y la licenciada Jeannette Castrillo Vargas como Procuradora Penal.\n\nRESULTANDO\n\n1.- Mediante sentencia n.° 76-2025 de las 13:11 horas del 28 de marzo del dos mil veinticinco, el Tribunal Penal del Segundo Circuito Judicial de Guanacaste, sede Santa Cruz, resolvió: \"POR TANTO: Por las razones expuestas y con base en los artículos 27, 34, 36, 39, 41, 45, 46 y 50 de la Constitución Política; 1, 2, 3, 4, 5, 6, 7, 8, 9, 31, 34, 62, 63, 70, 71, 81, 82, 267, 363, 364, 365, 437, 439, 446, 452, 453, 454, 455 y 458 del Código Procesal Penal; 1, 4, 11, 14, 16, 18, 19, 20 y 227, inciso 1, del Código Penal, el artículo 58, de la Ley Forestal número 7575, y el artículo 13 de la Ley de Zona Marítimo Terrestre . EN BASE AL PRINCIPIO DE INDUBIO PRO REO SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD a la señora [Nombre 001], por los delitos de INFRACCIÓN A LA LEY DE CONSERVACIÓN DE LA VIDA SILVESTRE Y POR USURPACIÓN DE BIENES DE DOMINIO PÚBLICO, que se le ha venido atribuyendo en perjuicio de LOS RECURSOS NATURALES. Se RECHAZA la solicitud de expulsión de personas y derribo de estructuras, establecida por parte del Ministerio Público y de la Procuraduría General de la República, por considerar que existen terceras personas que no fueron llamadas al proceso, a quienes cobija su derecho constitucional de ejercer su defensa y alegatos al respecto, aceptar tal solicitud transgrede el debido proceso.- En base al artículo 267 del Código Procesal Penal, no se condena en costas al Querellante, por considerar que se ha venido litigando de buena fe y acorde a los parámetros del litigio. Son las costas y gastos del proceso a cargo del Estado. - Quedan las partes debidamente notificadas de la presente sentencia expuesta en forma oral y a disposición de estas en el registro de audio y video. Firme el fallo, archívese el expediente. - Fernando Alonso Barrantes Araya. Juez “(SIC).\n\nII. Contra el anterior pronunciamiento la licenciada Milena Rodríguez Garro, en representación del Ministerio Público y la licenciada Jeannette Castrillo Vargas, Procuradora Penal, interpusieron recurso de apelación.\n\nIII. Verificada la deliberación respectiva de conformidad con lo dispuesto en el Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en los recursos.\n\nIV. En los procedimientos se han observado las prescripciones legales pertinentes.\n\nRedacta el juez Obando Santamaría; y\n\nCONSIDERANDO\n\n I- De la admisibilidad: Revisadas las actuaciones que constan en autos, puntualmente la notificación de la sentencia y la fecha de interposición de los libelos de apelación se concluye que fueron presentados dentro del plazo legal y por sujetos procesales legitimados al efecto; además se expresan los agravios correspondientes contra un pronunciamiento de fondo. En consecuencia, corroborándose los requisitos que permiten conocer los motivos de inconformidad, al cumplir los criterios de taxatividad objetiva y subjetiva, desde la óptica formal se declaran admisibles para su correspondiente examen.\n\n II- Sobre la audiencia oral: Por solicitud de la parte recurrente se realizó audiencia a las 08:35 horas del 15 de julio de 2025, con la participación de todos los intervinientes, sea de manera presencial o mediante la plataforma virtual Teams. En tal oportunidad, el juez Obando Santamaría no integró el Tribunal, pero se ha impuesto del contenido de las actuaciones grabadas en formato audiovisual. La licenciada Rodríguez, fiscala del Ministerio Público, mantuvo los motivos expresados en el recurso interpuesto previamente, al igual que la procuradora Castillo Vargas. Por su parte, el defensor Araya Sibaja expuso sus argumentos para que sean rechazados ambos recursos. \n\n II- Contenido de la impugnación del Ministerio Público: La licenciada Rodríguez Garro, expone como único motivo de apelación la “errónea aplicación de los numerales 140, 142, 184 y 361 inciso d, del código procesal penal, falta de fundamentación”. En su escrito visible a partir de folio 625, reprocha que el tribunal enjuiciador rechazó la solicitud de derribo de las obras y expulsión de los poseedores, bajo la argumentación de que permanecía una tercera persona que no fue llamada al proceso y no la aquí imputada, por lo que se quebrantaría el derecho de defensa de ese tercero al no haber sido convocado al proceso, para ser escuchado en sus intereses jurídicos. No obstante, explica que ha sido la defensa técnica la que habría confundido en los diversos juicios realizados quien sería el poseedor, mencionando a distintos familiares de la acriminada; aun así, para el momento de los hechos, fue ella la que se presentó ante las autoridades administrativas a gestionar respecto de la construcción en dicho fundo. Después de hacer un amplio resumen de la normativa referida a que estas tierras pertenecen al Estado, ergo son de dominio público y no pueden ser apropiadas por los ciudadanos, expone que de conformidad con el numeral 62 de la Ley sobre la Zona Marítimo Terrestre, está absolutamente prohibida la construcción de obras en esos fundos, debiendo ser derribadas para proteger el ecosistema, en este caso el Refugio de Vida Silvestre Ostional, con independencia de quien sea el poseedor actual porque no cabría una ocupación legítima, ya que deviene imposible hacer un traspaso de dominio de un bien que pertenece al Estado y es inalienable. De allí que la tesis jurídica sostenida por el a quo resulta errónea y su decisión amerite la anulación, señalando dicho agravio pide que desde esta sede se ordene la medida de restablecimiento de las cosas a su estado anterior por ser lo procedente en derecho.\n\n III. Recurso de la Procuraduría General de la República. La licenciada Castrillo Vargas, actuando como Procuradora penal, interpone recurso contra la sentencia de marras alegando dos motivos. En el primero de ellos aduce inobservancia en la aplicación del artículo 142 del Código Procesal Penal. Estima que hay inobservancia de las reglas de la sana crítica en la valoración de prueba esencial, particularmente del testimonio del funcionario [Nombre 004], quien aseguró que la poseedora del fundo desde muchos años atrás era la imputada [Nombre 001] y no otras personas, aun así, el juzgador de instancia infravaloró dicha prueba y sustentó la absolutoria en que no detentaba el dominio y que correspondía a un tercero que no fue convocado al proceso. En su criterio, la decisión de absolver a la imputada fue errónea y ayuna de una debida fundamentación, por lo que pide la nulidad de lo resuelto. El segundo reclamo gira sobre la insuficiente fundamentación de la sentencia en cuanto a la solicitud de restitución de las cosas al estado anterior de los hechos. Reprocha la inaplicación de los numerales 103 inciso 1) del Código Penal de 1941; 140 y 142 del Código Procesal Penal. Explica que el formato o “machote” utilizado por el a quo hace referencia al rechazo de la acción civil resarcitoria, cuando lo cierto es que únicamente se formuló querella, lo que refleja una desatención grosera de la fundamentación jurisdiccional, que se vislumbra en contradicciones como asegurar que se trata de un bien inalienable porque pertenece al Estado pero que debe llamarse al tercero poseedor para atender sus intereses, lo cual es la base para rechazar la solicitud de restitución de las cosas a su estado anterior. Fustiga esa conclusión porque los bienes estatales no pueden ser adquiridos por ningún particular, así que la mera constatación de una construcción que está dentro del Refugio de Vida Silvestre Ostional es suficiente para disponer el derribo de cualquier obra, tal y como fue solicitado. Como agravio señala que el rechazo de dicha pretensión es ilegítimo y produce la nulidad del fallo lo que pide en el recurso, a efectos de que se disponga la medida de restablecimiento de las cosas a su estado anterior, o en su defecto que se ordene juicio de reenvío. \n\n IV- Posición de la contraparte. El abogado defensor, Edgardo Araya Sibaja, representando a la persona acusada [Nombre 001], de manera oral en la audiencia convocada, ha pedido el rechazo de las pretensiones de las recurrentes, considerando que lo resuelto está apegado a derecho. \n\n V- Ambos recursos se conocen de manera conjunta por estar intrínsecamente relacionados y se declaran parcialmente con lugar. Tras el respectivo escrutinio puntilloso del fallo bajo cuestionamiento, se detecta que en cuanto a uno de los puntos aquí recurridos la motivación no alcanza estándares de suficiencia intelectiva para cumplir con la garantía de una fundamentación legal. (A)- Como preámbulo, hay que tomar en cuenta que la sentencia traída en alzada proviene de un juicio de reenvío, según fuese dispuesto por el Tribunal de Apelación de Sentencia Penal de Guanacaste, en resolución número 041-2020 de las 10:30 horas del 31 de enero de 2020 (folio 362 y siguientes) dictada ante impugnación del Ministerio Público y la Procuraduría General de la República, por la sentencia absolutoria emitida por el Tribunal de Juicio de Santa Cruz número 044-2019 de las 16:10 horas del 08 de abril de 2019; de este contexto se deriva que dentro de esta causa el fallo que ahora se conoce sería la segunda absolutoria dictada en favor de la acusada [Nombre 001], lo que implica que ha operado la doble conformidad y entonces la impugnación respecto de la absolutoria penal no puede prosperar, pues la Sala Constitucional de la Corte Suprema de Justicia declaró inconstitucional la derogatoria del artículo 466 bis de la normativa procesal penal, considerando que la imposibilidad de someter a contradictorio a un sujeto a favor de quien se han dictado dos sentencias absolutorias, constituye una limitación que “está estrechamente relacionada con un ejercicio razonable y proporcional de la potestad represiva del Estado, pues el ejercicio de este poder, no puede mantenerse de forma indefinida, hasta lograr el dictado de una sentencia condenatoria”(voto 2014-013820 de la Sala Constitucional de la Corte Suprema de Justicia, de las 16:00 horas del 20 de agosto de 2014). Por lo expuesto, ha de rechazarse el primer motivo planteado por la representante de la Procuraduría General de la República. (B)- Sin menoscabo de lo antes dicho, debe hacerse notar que el instituto de la doble conformidad aplica únicamente en lo que atañe a la responsabilidad penal, excluyéndose de forma expresa lo relativo a las costas, extremos civiles y restitución: \n\n “Artículo 466 bis- Juicio de reenvío. El juicio de reenvío deberá ser celebrado por el mismo tribunal que dictó la sentencia, pero integrado por jueces distintos. El Ministerio Público, el querellante y el actor civil no podrán formular recurso de apelación contra la sentencia del Tribunal de Juicio que se produzca en juicio de reenvío que reitere la absolución de la persona imputada dispuesta en un juicio anterior. En el caso del párrafo anterior, sí se podrán interponer los recursos correspondientes en lo relativo a la acción civil resarcitoria, la restitución y las costas” (el subrayado es suplido).\n\n Lo citado produce como consecuencia que esta Cámara entre a resolver lo relativo a los reproches de ambas recurrentes que discurren sobre la denegatoria de la petición del restablecimiento de las cosas a su estado anterior y, consecuentemente, ordenar el derribo de las construcciones realizadas in situ. Sobre el punto, el juzgador de instancia utilizó como argumento central para declinar la petición que podía existir derecho de algún tercero poseedor de buena fe, según lo descrito por la defensa material durante el debate, por lo cual era necesario convocarlo a la causa para que gestionara conforme a sus intereses y así no quebrantar el debido proceso. Esta Cámara concluye que la motivación respecto de la petición de restitución es insuficiente e incorrecta, en primer término porque el a quo comete un yerro grosero al referirse a una acción civil resarcitoria que es inexistente, lo cual revela descuido en la redacción de su pronunciamiento, pero, además, es reflejo de una desacertada motivación jurídica porque no hace ninguna referencia a si el fundo es o no inalienable, como lo requirió la acusación y la querella, por ser parte del Refugio de Vida Silvestre Ostional. El punto es medular, porque si el bien de marras es de dominio público, por pertenecer al Estado, no podría alegarse título de dominio sobre el mismo por parte de un particular, ni derecho de posesión que oponer en instancias judiciales; ergo tanto si fuese la encartada [Nombre 001] como cualquiera de sus familiares u otras personas sería lo mismo porque no tendrían derecho alguno sobre el inmueble (en caso de estar dentro del Refugio de Vida Silvestre Ostional, lo que aquí no se prejuzga). Entonces, llevan razón las impugnantes en que no explica el a quo cuál sería el fundamento legal para no entrar a conocer la petición de restitución de las cosas al estado anterior y debió manifestarse sobre ese punto con razones jurídicamente sostenibles, lo que implica que ha de acogerse parcialmente su pretensión y ordenarse el reenvío para que sea resuelto en un nuevo juicio con integración distinta a la que ya ha conocido. En cuanto a la absolutoria penal en favor de la acusada, se rechaza el primer motivo interpuesto por la representante de la Procuraduría General de la República y se mantiene lo resuelto.\n\n \n\n \n\nPOR TANTO\n\n Se declara parcialmente con lugar el recurso de apelación interpuesto por la licenciada Milena Rodríguez Garro en representación del Ministerio Público, así como el segundo motivo del recurso de la licenciada Jeannette Castrillo Vargas, actuando como Procuradora penal; en consecuencia, se ordena el juicio de reenvió únicamente para conocer sobre la solicitud de restablecimiento de las cosas a su estado anterior, el desalojo y derribo de las construcciones. En cuanto a la absolutoria penal en favor de la acusada [Nombre 001], se rechaza el primer motivo interpuesto por la representante de la Procuraduría General de la República y se mantiene lo resuelto.   "body_en_text": "VOTO 263-2026\n\nTRIBUNAL DE APELACIÓN DE SENTENCIA PENAL DE GUANACASTE, Santa Cruz, at thirteen hours fifty minutes on the twelfth of June, two thousand and twenty-six.\n\nAppeal filed in case number 12-001557-412-PE, brought against [Nombre 001], national identity card (cédula de identidad) number [Valor 001], born June 15, 1954, child of [Nombre 002] and [Nombre 003], for the offense of VIOLATION OF WILDLIFE CONSERVATION LAW to the detriment of NATURAL RESOURCES. The following judges participated in deciding the appeals: Brisa Marina Campbell Argüello, Rodrigo Guillermo Obando Santamaría, and Franklin Lara Fallas. Attorney Milena Rodríguez Garro appeared before this court on behalf of the Ministerio Público, and attorney Jeannette Castrillo Vargas appeared as Procuradora Penal.\n\nBACKGROUND\n\n1.- By judgment no. 76-2025 of 13:11 hours on March 28, two thousand and twenty-five, the Tribunal Penal del Segundo Circuito Judicial de Guanacaste, Santa Cruz division, ruled: \"Por tanto: For the reasons set forth and on the basis of Articles 27, 34, 36, 39, 41, 45, 46, and 50 of the Constitution; Articles 1, 2, 3, 4, 5, 6, 7, 8, 9, 31, 34, 62, 63, 70, 71, 81, 82, 267, 363, 364, 365, 437, 439, 446, 452, 453, 454, 455, and 458 of the Code of Criminal Procedure; Articles 1, 4, 11, 14, 16, 18, 19, 20, and 227, paragraph 1, of the Criminal Code; Art. 58 of the Ley Forestal number 7575; and Art. 13 of the Ley sobre la Zona Marítimo Terrestre. APPLYING THE PRINCIPLE OF IN DUBIO PRO REO, [Nombre 001] IS ACQUITTED OF ALL PENALTY AND LIABILITY for the offenses of VIOLATION OF THE LAW ON WILDLIFE CONSERVATION AND USURPATION OF PUBLIC DOMAIN PROPERTY, as those offenses have been attributed to her to the detriment of NATURAL RESOURCES. The request for the expulsion of persons and demolition of structures, submitted by the Ministerio Público and the Procuraduría General de la República, IS REJECTED, on the grounds that there are third parties who were not summoned to participate in the proceedings and who are protected by their constitutional right to exercise their defense and present their arguments in that regard; granting such a request would violate due process (debido proceso). Pursuant to Art. 267 of the Code of Criminal Procedure, no costs are awarded against the complainant (querellante), as the litigation has been conducted in good faith and in accordance with standard litigation parameters. Costs and expenses of the proceedings are to be borne by the State. The parties are duly notified of the present judgment as delivered orally, and the recording is available to them in the audio and video log. Once the judgment is final, the file shall be archived. — Fernando Alonso Barrantes Araya. Judge.\" (SIC).\n\nII. Against the foregoing ruling, attorney Milena Rodríguez Garro, on behalf of the Ministerio Público, and attorney Jeannette Castrillo Vargas, Procuradora Penal, filed appeals.\n\nIII. After the relevant deliberations were carried out in accordance with the provisions of the Code of Criminal Procedure, the Tribunal considered the issues raised in the appeals.\n\nIV. The applicable legal requirements have been observed in these proceedings.\n\nThe opinion is authored by Judge Obando Santamaría; and\n\nCONSIDERING\n\nI — On Admissibility: Upon reviewing the record of proceedings, specifically the notification of the judgment and the date of filing of the appeal briefs, it is concluded that they were submitted within the statutory time limit by procedurally authorized parties; moreover, the corresponding grievances are set forth against a substantive ruling. Accordingly, having verified the requirements for examining the grounds of disagreement, and finding that the criteria of objective and subjective specificity (taxatividad objetiva y subjetiva) are met, the appeals are declared formally admissible for review on their merits.\n\nII — On the Oral Hearing: At the request of the appealing party, a hearing was held at 08:35 hours on July 15, 2025, with the participation of all parties, either in person or through the Teams virtual platform. On that occasion, Judge Obando Santamaría did not sit on the panel, but has familiarized himself with the contents of the proceedings as recorded in audiovisual format. Attorney Rodríguez, prosecutor (fiscala) for the Ministerio Público, maintained the grounds set forth in the previously filed appeal, as did Procuradora Castrillo Vargas. Defense counsel Araya Sibaja presented his arguments in support of rejecting both appeals.\n\nII — Content of the Ministerio Público's Appeal: Attorney Rodríguez Garro presents as the sole ground for appeal the \"erroneous application of Articles 140, 142, 184, and 361 paragraph d of the Code of Criminal Procedure, and lack of adequate reasoning.\" In her brief, visible from folio 625, she criticizes the trial court for rejecting the request to demolish the structures and expel the occupants, on the basis that there remained a third party who had not been called to the proceedings — and not the defendant in this case — so that granting such a request would violate that third party's right to a defense, since that person had not been summoned to the proceedings to be heard regarding their legal interests. She argues, however, that it was defense counsel who, throughout the various trials held in this matter, confused the identity of the occupant, variously naming different family members of the accused; nonetheless, at the time of the events in question, it was the accused herself who appeared before the administrative authorities to handle matters relating to the construction on the property (fundo). After providing an extensive summary of the legal framework establishing that these lands belong to the State and therefore constitute public domain property that cannot be appropriated by private individuals, she submits that pursuant to Art. 62 of the Ley sobre la Zona Marítimo Terrestre, construction on such properties is absolutely prohibited and must be demolished to protect the ecosystem — in this case, the Refugio de Vida Silvestre Ostional — regardless of who the current occupant may be, since no legitimate occupation is possible, given that it is legally impossible to transfer title to property belonging to the State, which is inalienable. She therefore argues that the legal theory adopted by the court below (a quo) is erroneous and that its decision warrants annulment; citing this grievance, she requests that this court order the measure of restoration of things to their prior state (restablecimiento de las cosas a su estado anterior), as the legally appropriate remedy.\n\nIII — Appeal by the Procuraduría General de la República: Attorney Castrillo Vargas, acting as Procuradora penal, appeals the judgment in question on two grounds. In the first ground, she alleges non-observance in the application of Art. 142 of the Code of Criminal Procedure. She submits that the rules of sound evidentiary reasoning (sana crítica) were disregarded in the assessment of essential evidence — specifically the testimony of official [Nombre 004], who stated that the occupant of the property for many years had been the defendant [Nombre 001] and not other persons; yet the trial judge underweighted this evidence and grounded the acquittal in the finding that the defendant did not hold title and that the property belonged to a third party who had not been called to the proceedings. In her view, the decision to acquit the defendant was erroneous and devoid of adequate reasoning, and she therefore requests that the judgment be annulled. The second ground concerns the insufficient reasoning of the judgment with respect to the request for restoration of things to their prior state. She criticizes the non-application of Art. 103, paragraph 1, of the 1941 Criminal Code, and Articles 140 and 142 of the Code of Criminal Procedure. She explains that the standard template (machote) used by the trial court refers to the rejection of a civil damages action (acción civil resarcitoria), when in fact only a criminal complaint (querella) had been filed, which reflects a gross disregard for proper judicial reasoning, evidenced in contradictions such as affirming that the property is inalienable because it belongs to the State, while at the same time holding that the third-party occupant must be called to assert their interests — which was the basis for rejecting the request for restoration of things to their prior state. She challenges that conclusion because State property cannot be acquired by any private individual, so the mere finding of a construction within the Refugio de Vida Silvestre Ostional is sufficient to order the demolition of any structure, as had been requested. As her grievance, she submits that the rejection of that claim is illegitimate and renders the judgment void, which she requests in the appeal, to the end that the measure of restoration of things to their prior state be ordered, or alternatively that a retrial (juicio de reenvío) be ordered.\n\nIV — Position of the Opposing Party: Defense attorney Edgardo Araya Sibaja, representing the accused [Nombre 001], orally at the scheduled hearing, requested rejection of the appellants' claims, submitting that the ruling is in accordance with the law.\n\nV — Both appeals are considered jointly as they are intrinsically related, and are declared partially well-founded. Following a meticulous examination of the challenged judgment, it is found that with respect to one of the points under appeal, the reasoning fails to meet the standards of intellectual sufficiency required to satisfy the guarantee of legal justification. (A) — As a preliminary matter, it must be noted that the judgment brought on appeal arises from a retrial, as ordered by the TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL DE GUANACASTE in ruling number 041-2020 of 10:30 hours on January 31, 2020 (folio 362 et seq.), issued upon appeals by the Ministerio Público and the Procuraduría General de la República from the acquittal rendered by the Tribunal de Juicio de Santa Cruz in judgment number 044-2019 of 16:10 hours on April 8, 2019; from this context, it follows that within these proceedings the judgment now under review would be the second acquittal handed down in favor of the accused [Nombre 001], which means that the double-acquittal rule (doble conformidad) has taken effect, and accordingly the challenge to the criminal acquittal cannot succeed, since the Sala Constitucional de la Corte Suprema de Justicia declared unconstitutional the repeal of Art. 466 bis of the Code of Criminal Procedure, finding that the impossibility of subjecting to further adversarial proceedings a person in whose favor two acquittals have been rendered constitutes a limitation that \"is closely related to a reasonable and proportionate exercise of the State's punitive power, since the exercise of that power cannot be maintained indefinitely until a conviction is obtained\" (voto 2014-013820 of the Sala Constitucional de la Corte Suprema de Justicia, of 16:00 hours on August 20, 2014). For these reasons, the first ground raised by the representative of the Procuraduría General de la República must be rejected. (B) — Without prejudice to the foregoing, it must be noted that the double-acquittal rule applies solely with respect to criminal liability, and is expressly excluded in matters relating to costs, civil claims, and restitution:\n\n\"Article 466 bis — Retrial. The retrial shall be held before the same court that rendered the judgment, but composed of different judges. The Ministerio Público, the complainant, and the civil plaintiff may not file an appeal against a judgment of the Tribunal de Juicio issued in a retrial that reiterates the acquittal of the accused person ordered in a prior trial. In the case described in the preceding paragraph, the corresponding appeals may nonetheless be filed with respect to the civil damages action, restitution, and costs.\" (emphasis added).\n\nThe foregoing leads this Chamber to resolve the grievances raised by both appellants regarding the denial of the request for restoration of things to their prior state and, consequently, for an order to demolish the structures built in situ. On this point, the trial judge used as his central argument for declining the request the possibility that some third-party good-faith occupant might have rights, as described by the defense during the trial, and that it was therefore necessary to summon that person to the proceedings so that they could act in accordance with their interests, thereby avoiding a violation of due process. This Chamber concludes that the reasoning with respect to the restitution request is insufficient and incorrect: first, because the court below commits a gross error in referring to a civil damages action that does not exist in these proceedings, which reveals carelessness in the drafting of the judgment; but furthermore, it reflects flawed legal reasoning because no reference whatsoever is made to whether or not the property is inalienable — as required by the prosecution and the complainant — given that it allegedly forms part of the Refugio de Vida Silvestre Ostional. This point is central, because if the property in question is public domain property belonging to the State, no private individual could assert title over it, nor any right of possession cognizable before the courts; accordingly, whether it were the accused [Nombre 001] or any of her relatives or other persons, the result would be the same, since none of them would have any rights over the property (in the event it is within the Refugio de Vida Silvestre Ostional, which is not prejudged here). It follows that the appellants are correct in arguing that the court below failed to explain the legal basis for declining to rule on the request for restoration of things to their prior state, and that it was required to address that point with legally sustainable reasoning; this means that their claim must be partially upheld and a retrial must be ordered, to be resolved in new proceedings with a different judicial composition from those that have already heard the case. As to the criminal acquittal in favor of the accused, the first ground filed by the representative of the Procuraduría General de la República is rejected and the ruling is upheld.\n\nPOR TANTO\n\nThe appeal filed by attorney Milena Rodríguez Garro on behalf of the Ministerio Público is declared partially well-founded, as is the second ground of the appeal filed by attorney Jeannette Castrillo Vargas acting as Procuradora penal; consequently, a retrial is ordered solely for the purpose of resolving the request for restoration of things to their prior state, the eviction, and the demolition of the structures. As to the criminal acquittal in favor of the accused [Nombre 001], the first ground filed by the representative of the Procuraduría General de la República is rejected and the ruling is upheld.
