De interés para la resolución; se tienen por acreditados los siguientes hechos: 1) Mediante los acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez, se acordó: \"(...) ACUERDO N°12: El Concejo Municipal de Puerto Jiménez acuerda acoger la recomendación CP-ZMT-2026-2401-01. Por mayoría simple QUEDA DEFINITIVAMENTE APROBADO; ACUERDO EN FIRME. ACUERDO N°13: el Concejo Municipal de Puerto Jiménez acuerda aprobar lo dictaminado en el oficio CP-ZMT-2026-2401-01. Por mayoría simple QUEDA DEFINITIVAMENTE APROBADO; ACUERDO EN FIRME.\". (Folios 983 a 986 del expediente principal); 2) El señor Alcalde presenta formal veto en contra de los acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez, donde se solicita entre otras cosas: \"(...) Petitoria: Primero: Que se tenga por interpuesto en tiempo y forma el presente veto por motivos de legalidad. Segundo: Que se dejen sin efecto los acuerdos números 12 y 13 de la sesión ordinaria número 77 del treinta y uno de enero del año dos mil veintiséis, así como el dictamen CP-ZMT-2026-2401-01 de la Comisión Permanente de Zona Marítimo Terrestres. Tercero: Que se ordene la realización de la audiencia prevista en el artículo 57 del Reglamento a la Ley 6043, para que ambos solicitantes (Norma Porras Quirós y Rolando Muñoz Contreras) puedan ejercer su derecho de defensa y presentar sus alegatos y pruebas. Cuarto: Que se designe un funcionario del Departamento Legal diferente a la licenciada Arelys Cascante Fernández para conocer de este asunto, a fin de garantizar la imparcialidad del procedimiento. Quinto: Que se mantenga suspendido todo proceso de desalojo y demolición contra el señor Rolando Muñoz Contreras hasta tanto no se resuelva conforme a derecho la situación de ambos expedientes. Sexto: Que se analice la posible responsabilidad administrativa de los funcionarios que incurrieron en la inacción administrativa respecto al expediente PU-7159-2014. (...).\". (Folios 991 a 1000 del expediente principal); 3) Por medio del Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026, se acordó: \"(...) En consecuencia, el Honorable Concejo Municipal de Puerto Jiménez rechaza el veto N° AM-PJ-VTO-001-2026 interpuesto por el señor alcalde Enrique Seginini Saballo.\". (Folios 1002 a 1003 del expediente principal); 4) El acta de la Sesión Ordinaria número 78-2026 fue ratificada y aprobada por unanimidad en la Sesión Ordinaria número 079-2026, Artículo III, inciso-59. (Folios 1009 del expediente principal); 5) En fecha 13 de febrero del año en curso, el señor Segnini Seballo se apersona a estrados judiciales a interponer \"(...) recurso de apelación en alzada conforme al artículo 167, párrafo tercero, del Código Municipal (Ley N° 7794), contra el acto de rechazo del veto AM-PJ-VTO-001-2026 adoptado por el Concejo Municipal de Puerto Jiménez, en relación con los acuerdos números 14 y 15 de la sesión ordinaria número 77 del 31 de enero de 2026, (...).\" y solicitud de medida cautelar. (Folios 2 a 10 del expediente principal); 6) Por resolución de las doce horas treinta y nueve minutos del trece de febrero de dos mil veintiséis, emitida por este despacho se previno: \"(...) A efectos de poder realizar el estudio de admisibilidad correspondiente y previo a conocer la medida cautelar solicitada, se le previene al señor Alcalde que en el plazo de 24 HORAS contados a partir de la notificación de esta resolución, aclare la naturaleza de la gestión que presenta, es decir, si lo que pretende es apersonarse a este despacho a efectos de que se conozca el veto que indica fue interpuesto contra los acuerdos Números 14 y 15, sesión ordinaria N° 77 del 31 de enero de 2026 y rechazado por el Concejo Municipal, o si lo que esta presentando como se indica en el encabezado del escrito aportado, es un recurso de apelación en contra del rechazo del veto AM-PJ-VTO-001-2026, en ambos casos deberá identificar el acuerdo del Concejo Municipal que conoció el veto interpuesto. (...).\". (Folios 19 del expediente principal); 7) La parte recurrente contesta la prevención que antecede y aclara que se apersona a efectos de que se conozca el veto rechazado por el Concejo Municipal. (Folios 19 a 30 del legajo de medida cautelar); 8) Mediante resolución de las trece horas cincuenta y tres minutos del dieciocho de marzo de dos mil veintiséis emitida por este despacho, se previno la presentación de antecedentes del Veto AM-PJVTO-001-2016. (Folio 966 a 968 del expediente principal); 9) El Concejo Municipal aporta un expediente al respecto. (Folios 972 a 1003 del expediente principal); 10) Por resolución de las nueve horas cuarenta minutos del quince de abril de dos mil veintiséis, el despacho previno a ambas partes aclarar debidamente los acuerdos vetados y también se previno al Concejo Municipal: \"(...), deberá el Concejo Municipal certificar cuando se aprobó definitivamente la sesión ordinaria número 78 e indicar si existe documentado el rechazo del veto o solo existe lo transcrito en el acuerdo de rechazo. (...).\". (Folio 1004 del expediente principal); 11) El Concejo Municipal aclara que los acuerdos vetados son los números 12 y 13 de la sesión ordinaria número 77 y certifica: \"(...) No existe documento alguno presentado por el Honorable Concejo Municipal de Puerto Jiménez en respuesta al Veto N°AM-PJ-VTO-001-2026. Únicamente consta lo transcrito en el Acta de la Sesión Ordinaria N°078-2026, artículo IX, Inciso-15), páginas 19 a 37, en el cual se registra la votación de rechazo al veto, (...).\". (Folios 1007 y 1011 del expediente principal); 12) La parte recurrente contesta la prevención indicada en el hecho 10) de esta resolución. (Folios 1012 a 1018 del expediente principal y folios 56 a 62 del legajo de medida cautelar); 13) Mediante resolución de las trece horas veintiocho minutos del veintitrés de abril de dos mil veintiséis, se solicitó por parte del despacho a la parte recurrente verificar y aclarar los acuerdos objeto de impugnación. (Folios 1019 del expediente principal); 14) La parte recurrente cumple la prevención que antecede e indica: \"(...) Es deber de esta representación rectificar de manera frontal, leal y transparente ante este Tribunal lo siguiente: efectivamente los acuerdos vetados corresponden a los números doce (12) y trece (13) de la sesión ordinaria N.° 77, celebrada el treinta y uno de enero de dos mil veintiséis, del Concejo Municipal de Puerto Jiménez, y no a los números catorce (14) y quince (15) como erróneamente se había venido indicando en escritos anteriores. (...).\". (Folios 1020 a 1052 del expediente principal y folios 63 a 95 del legajo de medida cautelar); 15) Por resolución de las dieciséis horas treinta y siete minutos del dos de junio de dos mil veintiséis emitida por el despacho, se previno: \"(...) Revisado que fue el expediente para su resolución de fondo, se observa q a folio 1010 se señala que, \"... Únicamente consta lo transcrito en el Acta de la Sesión Ordinaria N°78-2026, artículo IX, Inciso-15, páginas 19 a 37, en el cual se registra la votación del rechazo del veto...\"; sin embargo, las mismas no constan en autos, por lo anterior, se le previene al CONCEJO MUNICIPAL DE PUERTO JIMÉNEZ que en el plazo de TRES DÍAS HÁBILES, aporte la certificación correspondiente a las páginas indicadas.(...).\". (Folio 1058 del expediente principal); 16) El Concejo Municipal cumple con la prevención que antecede. (Folio 1062 a 1082 del expediente principal) \n\nII.-DEL VETO INTERPUESTO. A efectos de analizar la gestión que se conoce, es conveniente recordar, que conforme al enunciado del artículo 173 de la Constitución Política, desarrollado en los numerales 162, 165, 166, 167, 170 y 171 del Código Municipal y 189 y siguientes del Código Procesal Contencioso Administrativo, se define la competencia del Tribunal Contencioso Administrativo para actuar como contralor no jerárquico de legalidad del régimen municipal, lo cual, conforme al numeral 181 de la Ley General de la Administración Pública, se circunscribe a ejercer un control eminentemente de legalidad de la función formal de las corporaciones municipales, en tanto se limita a verificar un control de las decisiones administrativas de las Municipalidades, emanadas de sus autoridades, sea, del Concejo y del Alcalde, dentro del límite de las pretensiones y cuestiones de hecho planteadas por la parte recurrente. En el caso que nos ocupa, se conoce veto que recae en contra de los Acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026, mismos que indican: \"(...) ACUERDO N°12: El Concejo Municipal de Puerto Jiménez acuerda acoger la recomendación CP-ZMT-2026-2401-01. Por mayoría simple QUEDA DEFINITIVAMENTE APROBADO; ACUERDO EN FIRME. ACUERDO N°13: el Concejo Municipal de Puerto Jiménez acuerda aprobar lo dictaminado en el oficio CP-ZMT-2026-2401-01. Por mayoría simple QUEDA DEFINITIVAMENTE APROBADO; ACUERDO EN FIRME.\" (folios 983 a 986 del expediente principal); veto que fue conocido por medio del Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026, donde se acordó: \"(...) En consecuencia, el Honorable Concejo Municipal de Puerto Jiménez rechaza el veto N° AM-PJ-VTO-001-2026 interpuesto por el señor alcalde Enrique Seginini Saballo.\" (folios 1002 a 1003 del expediente principal); ambos actos emanados del Concejo Municipal. En dicho sentido y por la forma en como se resuelve es importante transcribir en lo de interés que establece la recomendación CP-ZMT-2026-2401-01, que se acuerda acoger por medio del acto vetado y al respecto en resumen indica: \"(...) RECOMENDACIÓN ACUERDO N°01 Por lo tanto, esta comisión recomienda al Concejo Municipal devolver ambos expedientes a la Administración Municipal, ya que con base en la documentación revisada se observa que es \"SITUACIÓN CONCLUIDA\" y se archive el expediente PU-7159-2014 , a nombre del señor Rolando Muñoz Contreras. Se somete a votación. Por votación de mayoría absoluta se aprueba la recomendación y se dispone este acuerdo en FIRME Y DEFINITIVAMENTE APROBADO. ACUERDO N°02 Por lo tanto, esta comisión recomienda al Concejo Municipal, que se le instruya al titular de la administración municipal que realice las actuaciones ejecutorias administrativas que correspondan conforme con la normativa aplicable y al principio de competencia administrativa. Consagrado en el numeral N°04 de la Ley General de la Administración Pública. Por votación de mayoría absoluta se aprueba la recomendación y se dispone este acuerdo en FIRME Y DEFINITIVAMENTE APROBADO. (...).\" (folios 983 a 986 del expediente principal). Teniendo claro lo anterior, se procede por parte de este órgano colegiado a enumerar las dos razones puntuales que permiten explicar la decisión adoptada. EN PRIMER ORDEN: es importante destacar propiamente y sobre el acuerdo del Concejo Municipal que conoce y rechaza el veto interpuesto por la Alcaldía Municipal, transcrito en el Acta de la Sesión Ordinaria N°78-2026, artículo IX, Inciso-15, páginas 19 a 37, en el cual se registra la votación del rechazo del veto (folio 1064 a 1082 del expediente principal), que el acta inicia con una transcripción literal del veto interpuesto, seguidamente se transcribe la intervención del regidor Yosar Flores, donde en resumen señala dicho regidor, que más que un veto parece que se presenta un recurso interpuesto por el señor Rolando, refiere que el tema ya fue resuelto por la Municipalidad de Golfito, y que si no estaban conformes debían accionar ante el Concejo Municipal de Golfito, porque era algo que ya se encontraba resuelto, señala que el Consejo lo que hace es ratificar lo que ya existía y que no es un acuerdo nuevo y que no pueden conocer el fondo porque ya se vencieron los plazos y los recursos. Posteriormente interviene el Presidente Municipal quien indica que el regidor deja clara la situación e indica que el funcionario de Zona Marítimo Terrestre \"revive al muerto\", porque el caso ya estaba cerrado. Aduce que, el veto tiene más características de un recurso de revisión y que quien debía interponerlos era el señor Contreras y reitera que lo que se hace es ratificar un acuerdo que tomo la Municipalidad de Golfito. Acto seguido se vota por el rechazo del veto (ver folios 1064 a 1082 de los autos). Ahora bien, analizado el contenido del Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026, donde se acordó: \"(...) En consecuencia, el Honorable Concejo Municipal de Puerto Jiménez rechaza el veto N° AM-PJ-VTO-001-2026 interpuesto por el señor alcalde Enrique Seginini Saballo.\" (folios 1002 a 1003 y 1064 a 1082 del expediente principal), es que este despacho determina que los argumentos de hecho y de derecho que fueron expuestos por el señor Alcalde en el veto que se conoce por esta alzada, no han sido conocidos ni analizados por el Concejo Municipal. Véase que el Acuerdo que rechazó el veto interpuesto, lo que hace es denegar la aprobación del veto interpuesto con base en argumentaciones subjetivas realizadas por un regidor y el Presidente del Concejo y remitirlo ante este despacho; lo anterior, sin ningún tipo de análisis técnico-jurídico del porque se adopta este acuerdo. Nótese que no se fundamenta de manera técnica ni razonada los vicios alegados en el veto como lo son: violación al principio de imparcialidad y conflicto de interés de la abogada municipal, violación de los artículos 230, 236, 113 de la Ley General de la Administración Pública, violación al artículo 3 de la Ley contra la Corrupción y el Enriquecimiento Ilícito, violación al artículo 44 de la Ley de Zona Marítimo Terrestre, violación al debido proceso constitucional por falta de audiencia al administrado, vicios en el procedimiento del permiso otorgado a la señora Porras Quirós, lo referente a las moratorias de desalojos, violación al principio de seguridad jurídica, violación al principio primero en tiempo primero en derecho, violación por inacción administrativa constitutiva de denegación de justicia, es decir, estos agravios ni siquiera son identificados en el acto administrativo que conoce del veto, menos aún fundamentan su rechazo. Es decir, el acuerdo del Concejo Municipal que conoce el veto que se remite ante este despacho, no analiza desde ninguna óptica los argumentos del veto planteado. En razón de la situación expuesta, es criterio de este colegio que el Concejo Municipal de Puerto Jiménez, debe proceder a conocer de la procedencia o no del veto planteado por la Alcaldía Municipal, es decir, debe conocer por el fondo de la procedencia o no de todos y cada uno de los agravios expuestos. En este línea de pensamiento, este Tribunal concluye que tal omisión, o bien tal falta de motivación, es lesiva al debido proceso por las siguientes razones: 1) Deriva de los artículos 8 de la Convención Americana de Derechos Humanos y 41 de la Constitución Política, en el contexto del voto 1739-1992 de la Sala Constitucional del Debido Proceso y Acceso a la Justicia, que los justiciables tienen derecho a una resolución motivada por el fondo y el acceso a una segunda instancia, en el contexto de las impugnaciones que presenten contra las resoluciones de los procedimientos judiciales y administrativos; en este caso del veto que se interpuso; 2) Acorde con lo anterior, la omisión de resolver los argumentos de hechos y derecho expuestos, lesiona el Principio de Resolución Expresa, contenido en el artículo 329 de la Ley General de la Administración Pública; norma que debe interpretarse y aplicarse en conjunto con el artículo 136.1.b) también de dicho cuerpo normativo, que exige que los actos que conocen recursos, sin ser la excepción el acto que conoce de un veto, deben ser motivados y fundamentados; mandato legal que no se verifica en autos, puesto que del acto contenido en el Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026, no se desprende ningún tipo de motivación fáctica-jurídica para su rechazo; 3) Igualmente en concordancia con los dos numerales que anteceden, la omisión de pronunciamiento sobre la procedencia o no del veto debidamente motivado, contraviene el contenido normativo de los artículos 173 de la Constitución Política, 167 del Código Municipal, 61.2 del Código Procesal Civil y 119 del Código Procesal Contencioso Administrativo que obligan a los operadores jurídicos, en ejercicio resolutivo judicial o administrativo, a resolver sobre todos los hechos, pruebas, fundamentos de derecho y pretensiones de las partes en sus acciones, recursos y vetos. Así las cosas, el Tribunal Contencioso al detectar la omisión absoluta del Concejo Municipal de resolver la procedencia o no del veto interpuesto de manera motivada; lesiona el debido proceso y coloca a quien veta en indefensión de forma tal, que sus alegatos sean conocido en única y última instancia por el Tribunal Contencioso Administrativo; y no así en primera instancia, por el Concejo Municipal, quien omite por completo referirse a todos los argumentos planteados, lo cual como se indicó, es contrario al Derecho Fundamental de la Segunda Instancia y consiste por sí misma en una falta de motivación y de servicio, precisamente por no motivar sus resoluciones y garantizar el Principio de Resolución Expresa, por el cual se resuelva sobre todos los vicios, hechos, pruebas, alegatos y pretensiones, expresados en el veto interpuesto. EN SEGUNDO TÉRMINO, y como fundamento de la decisión que se adopta por parte de esta alzada, se tiene que el acuerdo que se veta lo que hace es acoger la recomendación CP-ZMT-2026-2401-01, donde se acuerda devolver dos expedientes a la Administración Municipal, para que se archive el expediente PU-7159-2014 a nombre del señor Rolando Muñoz Contreras y se ponga en disfrute del bien a la señora Norma Porras Quirós expediente PU-7302-2015 (folios 974 a 975 y 983 a 985 del expediente principal). De conformidad con lo anterior, si bien es cierto existe un veto elevado para ser conocido por este Tribunal, este Colegio ha detectado una eventual lesión al Principio del Debido Proceso, toda vez que no consta en autos, que los particulares quienes tramitaron expedientes administrativos que fueron abordados en el presente acuerdo: expediente PU-7159-2014 a nombre del señor Rolando Muñoz Contreras y expediente PU-7302-2015 a nombre de la señora Norma Porras Quirós, hayan sido considerados por el Concejo Municipal como parte procesal para la defensa de sus derechos en el procedimiento, al momento de resolver el veto interpuesto en contra el acto analizado, siendo que la integración como terceros ante esta instancia, no subsana tal omisión procedimental, toda vez que se conoce el veto de un acto administrativo que se relaciona con el otorgamiento de un permiso de uso de suelo en Zona Marítimo Terrestre y el archivo de un expediente relacionado con un trámite en esa misma línea. Acorde con lo anterior, es importante destacar lo que establece el artículo Artículo 182 de la Ley General de la Administración Pública, que señala: \"Artículo 182.-1. El Juez no podrá declarar de oficio la invalidez del acto, salvo que se trate de infracciones sustanciales relativas al sujeto, al procedimiento o a la forma, casos en los cuales deberá hacerlo. (...)\" (el resaltado no es del original), numeral que debe leerse en relación con el ordinal 223 de la misma ley, que refiere: \"Artículo 223.- 1. Sólo causará nulidad de lo actuado la omisión de formalidades sustanciales del procedimiento.2. Se entenderá como sustancial la formalidad cuya realización correcta hubiera impedido o cambiado la decisión final en aspectos importantes, o cuya omisión causare indefensión.\" (el resaltado no es del original); numerales que deben entenderse además, en armonía con el claro contenido del artículo 239 de la ley de cita, que dispone sobre el emplazamiento de todos los involucrados en el procedimiento administrativo: \"Artículo 239.-Todo acto de procedimiento que afecte derechos o intereses de las partes o de un tercero, deberá ser debidamente comunicado al afectado, de conformidad con esta Ley.\" (el resaltado no es del original). Es así como de conformidad con lo indicado y por método analógico, lo que es dable considerar en resguardo del Derecho al Debido Proceso regulado en los artículos 41 de la Constitución Política y 8 de la Convención Americana sobre Derechos Humanos, que el Concejo Municipal debió considerar previo a conocer del veto interpuesto, como parte procesal a todas las personas que devengaron algún derecho o interés legítimo por medio del acto administrativo vetado, para que se les diera audiencia y la oportunidad para la defensa de sus intereses y derechos, que eventualmente podían ser afectados por los agravios planteados en el veto. Así las cosas, la integración de terceros debe darse desde la sede municipal para que en el eventual supuesto de que se estime con lugar el veto planteado; quienes hayan devengado algún interés legítimo o derecho del acto cuestionado hayan tenido la posibilidad de manifestarse al respecto; todo ello con la finalidad de garantizarles el Derecho Fundamental a la Debido Proceso y como parte del mismo la garantía procesal de ser escuchados, tutelado por el artículo 41 de la Constitución Política así como el artículo 8 de la Convención Americana sobre Derechos Humanos. En dicho sentido, al ser un hecho fuera de toda controversia que los particulares: Rolando Muñoz Contreras y Norma Porras Quirós, no fueron considerados por el Concejo Municipal, como parte procesal para la defensa de sus intereses dentro del procedimiento al conocer del veto planteado contra el acuerdo cuestionado; se impone declarar por parte de este Tribunal de oficio la nulidad, con fundamento en los artículos 158, 182, 223 y 239 de la Ley General de la Administración Pública, lo anterior por la forma sin prejuzgar sobre su fondo, del acto administrativo dictado por el Concejo Municipal el contenido del Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026, por medio del cual se resolvió el veto interpuesto. En consecuencia y por la forma en como se resuelve, acorde con la nulidad declarada en esta resolución, deberá el Concejo Municipal garantizar como parte del procedimiento recursivo el Debido Proceso para lo cual, debe observar como mínimo lo siguiente: 1) Tener como parte procesal en la fase recursiva a las personas que tramitaron expedientes administrativos que fueron abordados en el acuerdo vetado: expediente PU-7159-2014 a nombre del señor Rolando Muñoz Contreras y expediente PU-7302-2015 a nombre de la señora Norma Porras Quirós; 2) Dar audiencia a las personas integradas del veto interpuesto contra los Acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez; 3) Garantizar el acceso al expediente a todas las partes procesales para el ejercicio de sus derechos; 4) Requerir medio para notificaciones a las nuevas partes procesales; 5) Dictar la resolución que conozca veto interpuesto por la Alcaldía Municipal, en el cual identifique, enumere y resuelva todos y cada uno de los agravios y pretensiones planteadas, así como todos los argumentos de descargo de todos los involucrados; 6) Notificar a todas las partes intervinientes la resolución del veto planteado. 7) Cumplidos los puntos aquí ordenado el Concejo Municipal deberá proseguir con el trámite que en Derecho corresponde para conocer a la brevedad del veto interpuesto por la Alcaldía Municipal. Por la forma en que se resuelve, se omite especial pronunciamiento sobre los agravios planteados en el veto interpuesto. En consecuencia, se anula el Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026 por el Concejo Municipal, donde se rechaza el veto interpuesto en contra de los acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez. Deberá el Concejo Municipal de Puerto Jiménez, listar y resolver uno por uno los agravios expresados en el veto presentado.-\n\nIII.- Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del «Reglamento sobre Expediente Electrónico ante el Poder Judicial», aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.- \n\nPOR TANTO\n\nCon fundamento en los artículos 158, 182, 223 y 239 de la Ley General de la Administración Pública, de oficio SE ANULA la resolución contenida en el acto administrativo dictado por el Concejo Municipal de Puerto Jiménez, Artículo IX, Inciso -15) de la Sesión Ordinaria número 78-2026 celebrada el 7 de febrero del año 2026 por el Concejo Municipal, donde se rechaza el veto interpuesto en contra de los acuerdos números 12 y 13 adoptados en la Sesión Ordinaria número 77 del treinta y uno de enero del año 2026 por el Concejo Municipal de Puerto Jiménez. (Page 1009 of the main case file); 5) On February 13 of the current year, Mr. Segnini Saballo appeared before this Court to file \"(...) an appeal (recurso de apelación en alzada) pursuant to Article 167, paragraph three, of the Municipal Code (Ley N° 7794), against the act rejecting veto AM-PJ-VTO-001-2026 adopted by the Municipal Council of Puerto Jiménez, in connection with Resolutions numbers 14 and 15 of Ordinary Session number 77 of January 31, 2026, (...),\" and a request for a precautionary measure (medida cautelar). (Pages 2 to 10 of the main case file); 6) By resolution issued at twelve hours and thirty-nine minutes on February thirteenth, two thousand and twenty-six, this Court issued the following preliminary procedural notice (prevención): \"(...) (Pages 1007 and 1011 of the main case file); 12) The appealing party responded to the notice referenced in fact 10) of this resolution. (Pages 1012 to 1018 of the main case file and pages 56 to 62 of the precautionary-measure file); 13) By resolution issued at thirteen hours and twenty-eight minutes on April twenty-third, two thousand and twenty-six, this Court requested the appealing party to verify and clarify the resolutions under challenge. (Page 1019 of the main case file); 14) The appealing party complied with the foregoing notice and stated: \"(...) It is the duty of this representative to forthrightly, loyally, and transparently rectify the following before this Court: the vetoed resolutions do in fact correspond to numbers twelve (12) and thirteen (13) of Ordinary Session N.° 77, held on January thirty-first, two thousand and twenty-six, of the Municipal Council of Puerto Jiménez, and not to numbers fourteen (14) and fifteen (15) as had been erroneously indicated in prior filings. (...).\". (Pages 1020 to 1052 of the main case file and pages 63 to 95 of the precautionary-measure file); 15) By resolution issued at sixteen hours and thirty-seven minutes on June second, two thousand and twenty-six, this Court issued the following notice: \"(...) Upon reviewing the case file for a decision on the merits, it was observed that on page 1010 it is noted that, '... Only the text transcribed in the Minutes of Ordinary Session N°78-2026, Article IX, Sub-item-15, pages 19 to 37, appears on record, in which the vote to reject the veto is recorded...'; however, those pages are not included in the record. Accordingly, the MUNICIPAL COUNCIL OF PUERTO JIMÉNEZ is hereby given notice that within THREE BUSINESS DAYS, it must submit the certification corresponding to the indicated pages.(...).\". (Page 1058 of the main case file); 16) The Municipal Council complied with the foregoing notice. (Pages 1062 to 1082 of the main case file)\n\nII.— THE VETO FILED. For purposes of analyzing the matter before this Court, it is worth recalling that, pursuant to Article 173 of the Political Constitution (Constitución Política), as developed in Articles 162, 165, 166, 167, 170, and 171 of the Municipal Code and Articles 189 and following of the Administrative Contentious Procedural Code (Código Procesal Contencioso Administrativo), the jurisdiction of the Administrative Contentious Court to act as non-hierarchical legality supervisor over the municipal system is defined. This jurisdiction, pursuant to Article 181 of the General Law of Public Administration (Ley General de la Administración Pública), is limited to exercising a review that is purely one of legality over the formal functioning of municipal corporations (corporaciones municipales), and is confined to verifying control over the administrative decisions of the municipalities issued by their authorities — namely, the Council and the Mayor — within the limits of the claims and factual issues raised by the appealing party. In the case at hand, the Court is seized of a veto directed against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 on January thirty-first, two thousand and twenty-six, which read as follows: \"(...) RESOLUTION N°12: The Municipal Council of Puerto Jiménez agrees to accept recommendation CP-ZMT-2026-2401-01. By simple majority, THIS IS DEFINITIVELY APPROVED; RESOLUTION IN FULL FORCE. RESOLUTION N°13: The Municipal Council of Puerto Jiménez agrees to approve the opinion set forth in memorandum CP-ZMT-2026-2401-01. By simple majority, THIS IS DEFINITIVELY APPROVED; RESOLUTION IN FULL FORCE.\" (pages 983 to 986 of the main case file); a veto that was considered by means of Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, where it was agreed: \"(...) Consequently, the Honorable Municipal Council of Puerto Jiménez rejects veto N° AM-PJ-VTO-001-2026 filed by Mayor Enrique Seginini Saballo.\" (pages 1002 to 1003 of the main case file); both acts being issued by the Municipal Council. In that regard, and given the manner in which this matter is resolved, it is important to transcribe the relevant portions of recommendation CP-ZMT-2026-2401-01, which the vetoed act agreed to accept, and which in summary provides: \"(...) RECOMMENDATION RESOLUTION N°01: Therefore, this commission recommends to the Municipal Council that both case files be returned to the Municipal Administration, since, based on the documentation reviewed, it is observed that the matter is a 'CONCLUDED SITUATION' and that case file PU-7159-2014, in the name of Mr. Rolando Muñoz Contreras, be archived. Put to a vote. By absolute majority vote, the recommendation is approved and this resolution is ordered FINAL AND DEFINITIVELY APPROVED. RESOLUTION N°02: Therefore, this commission recommends to the Municipal Council that the head of the municipal administration be instructed to carry out the corresponding administrative enforcement actions in accordance with applicable regulations and the principle of administrative competence set forth in Article N°04 of the General Law of Public Administration. By absolute majority vote, the recommendation is approved and this resolution is ordered FINAL AND DEFINITIVELY APPROVED. (...).\" (pages 983 to 986 of the main case file). With the foregoing clearly established, this collegiate body proceeds to enumerate the two specific reasons that explain the decision adopted.\n\nIN THE FIRST PLACE: it is important to highlight — specifically with regard to the Municipal Council's resolution that considered and rejected the veto filed by the Municipal Mayor's Office, as transcribed in the Minutes of Ordinary Session N°78-2026, Article IX, Sub-item-15, pages 19 to 37, in which the vote to reject the veto is recorded (pages 1064 to 1082 of the main case file) — that the minutes begin with a verbatim transcription of the veto filed, followed by the transcription of the intervention by councilmember (regidor) Yosar Flores, who in summary stated that the filing looked more like an appeal filed by Mr. Rolando than a veto; that the matter had already been resolved by the Municipality of Golfito; that if they were dissatisfied, they should take action before the Municipal Council of Golfito, because the matter had already been settled; that what the Council does is ratify what already existed, that it is not a new resolution, and that they cannot address the merits because the deadlines and remedies had expired. The Municipal President then intervened, indicating that the councilmember had clarified the situation, and noted that the Maritime-Terrestrial Zone official \"brought the dead back to life,\" because the case had already been closed. He argued that the veto bore more of the characteristics of a petition for review (recurso de revisión) and that it was Mr. Contreras who should have filed it, reiterating that what was being done was merely ratifying a resolution adopted by the Municipality of Golfito. The vote on the rejection of the veto was then taken (see pages 1064 to 1082 of the record). Now, having analyzed the content of Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, where it was agreed: \"(...) Consequently, the Honorable Municipal Council of Puerto Jiménez rejects veto N° AM-PJ-VTO-001-2026 filed by Mayor Enrique Seginini Saballo.\" (pages 1002 to 1003 and 1064 to 1082 of the main case file), this Court determines that the factual and legal arguments set forth by the Mayor in the veto now before this appellate instance have not been considered or analyzed by the Municipal Council. Note that the resolution rejecting the veto does nothing more than deny approval of the veto based on subjective arguments made by one councilmember and the President of the Council, and refer it to this Court — all without any technical or legal analysis of the grounds for adopting this resolution. It is worth noting that the defects alleged in the veto are not technically or reasonably substantiated — such as: violation of the principle of impartiality and conflict of interest on the part of the municipal attorney, violation of Articles 230, 236, and 113 of the General Law of Public Administration, violation of Art. 3 of the Law Against Corruption and Illicit Enrichment (Ley contra la Corrupción y el Enriquecimiento Ilícito), violation of Art. 44 of the Maritime-Terrestrial Zone Law (Ley de Zona Marítimo Terrestre), violation of constitutional due process (debido proceso) for failure to provide a hearing to the regulated party (administrado), defects in the procedure for the permit granted to Ms. Porras Quirós, matters relating to eviction moratoria, violation of the principle of legal certainty (principio de seguridad jurídica), violation of the principle of first-in-time, first-in-right (principio primero en tiempo primero en derecho), and violation through administrative inaction constituting a denial of justice — none of these grievances are even identified in the administrative act (acto administrativo) that considers the veto, much less do they form the basis for its rejection. In other words, the Municipal Council's resolution considering the veto referred to this Court does not analyze — from any perspective — the arguments set forth in the veto. In light of this situation, it is the view of this collegiate body that the Municipal Council of Puerto Jiménez must proceed to consider whether the veto filed by the Municipal Mayor's Office should or should not be granted — that is, it must address, on the merits, each and every one of the grievances raised. Along these lines, this Court concludes that such omission — or, rather, such lack of reasoning — is injurious to due process for the following reasons: 1) It follows from Article 8 of the American Convention on Human Rights (Convención Americana de Derechos Humanos) and Art. 41 of the Political Constitution, in the context of ruling 1739-1992 of the Constitutional Chamber (Sala Constitucional) on Due Process and Access to Justice, that litigants have the right to a reasoned decision on the merits and access to a second instance, in the context of challenges filed against decisions in judicial and administrative proceedings — in this case, the veto that was filed; 2) Accordingly, the failure to resolve the factual and legal arguments raised violates the Principle of Express Resolution (Principio de Resolución Expresa) contained in Article 329 of the General Law of Public Administration; a provision that must be interpreted and applied in conjunction with Article 136.1.b) of the same body of law, which requires that acts deciding appeals — and the act deciding a veto is no exception — be reasoned and substantiated; a legal mandate that is not evidenced in the record, since the act contained in Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, does not reflect any factual or legal reasoning for its rejection; 3) Equally, in harmony with the two foregoing provisions, the failure to issue a duly reasoned ruling on whether the veto should or should not be granted contravenes the normative content of Articles 173 of the Political Constitution, 167 of the Municipal Code, 61.2 of the Civil Procedural Code (Código Procesal Civil), and 119 of the Administrative Contentious Procedural Code, which require legal decision-makers — in the exercise of judicial or administrative resolution — to rule on all facts, evidence, legal grounds, and claims of the parties in their actions, appeals, and vetoes. In view of the foregoing, the Administrative Contentious Court, upon detecting the Municipal Council's complete failure to issue a reasoned ruling on whether the veto filed should or should not be granted, finds that such failure violates due process and places the vetoing party in a state of defenselessness (indefensión), such that its arguments would be considered solely and finally by the Administrative Contentious Court — rather than at first instance by the Municipal Council, which entirely failed to address any of the arguments raised. As noted, this is contrary to the Fundamental Right to a Second Instance and constitutes, in itself, a failure to provide reasoning and a failure of public service, precisely for failing to substantiate its resolutions and to guarantee the Principle of Express Resolution, by which all defects, facts, evidence, arguments, and claims expressed in the veto filed are to be resolved.\n\nIN THE SECOND PLACE, and as a further basis for the decision adopted by this appellate instance, the vetoed resolution is one that accepted recommendation CP-ZMT-2026-2401-01, whereby it was agreed to return two administrative case files to the Municipal Administration so that case file PU-7159-2014, in the name of Mr. Rolando Muñoz Contreras, be archived and so that Ms. Norma Porras Quirós be placed in enjoyment of the property subject to case file PU-7302-2015 (pages 974 to 975 and 983 to 985 of the main case file). In light of the foregoing, although a veto has been elevated for consideration by this Court, this collegiate body has detected a potential violation of the Principle of Due Process, given that there is no record in the file that the private individuals who processed administrative case files addressed in the resolution at issue — case file PU-7159-2014 in the name of Mr. Rolando Muñoz Contreras and case file PU-7302-2015 in the name of Ms. Norma Porras Quirós — were recognized by the Municipal Council as procedural parties for the defense of their rights in the proceeding when the veto against the analyzed act was resolved; and that their integration as third parties before this instance does not cure such procedural omission, since what is before the Court is a veto of an administrative act relating to the granting of a land-use permit (permiso de uso de suelo) in the Maritime-Terrestrial Zone and the archiving of a case file related to a proceeding in that same area. In accordance with the foregoing, it is important to highlight the provisions of Article 182 of the General Law of Public Administration, which states: \"Article 182.—1. The Judge may not declare the invalidity of the act ex officio, except where there are substantial violations relating to the subject, the procedure, or the form, in which cases the Judge shall be required to do so. (...)\" (emphasis not in the original); a provision that must be read in relation to Article 223 of the same law, which provides: \"Article 223.—1. Only the omission of substantial procedural formalities will cause the nullity (nulidad) of what has been done. 2. A formality shall be understood as substantial when its correct fulfillment would have prevented or changed the final decision in important respects, or when its omission caused defenselessness.\" (emphasis not in the original); provisions that must further be understood in harmony with the clear content of Article 239 of the same law, which addresses notice to all parties involved in the administrative proceeding: \"Article 239.—Every procedural act that affects the rights or interests of the parties or of a third party must be duly communicated to the affected party, in accordance with this Law.\" (emphasis not in the original). Thus, in accordance with the foregoing and by analogy, what may properly be considered in safeguarding the Right to Due Process set forth in Art. 41 of the Political Constitution and Art. 8 of the American Convention on Human Rights is that the Municipal Council should have recognized — prior to considering the veto filed — as procedural parties all persons who had acquired any right or legitimate interest through the administrative act subject to the veto, so that they could be given a hearing and the opportunity to defend their interests and rights, which could potentially be affected by the grievances raised in the veto. Accordingly, the integration of third parties must occur at the municipal level so that, in the event the veto is ultimately upheld, those who had acquired any legitimate interest or right from the challenged act will have had the opportunity to be heard; all of this with the purpose of guaranteeing them the Fundamental Right to Due Process and, as part thereof, the procedural guarantee of being heard, protected by Art. 41 of the Political Constitution and Art. 8 of the American Convention on Human Rights. In that regard, since it is an uncontested fact that the private individuals Rolando Muñoz Contreras and Norma Porras Quirós were not recognized by the Municipal Council as procedural parties for the defense of their interests in the proceeding when it considered the veto filed against the challenged resolution, this Court is compelled to declare ex officio the nullity — on grounds of form and without prejudging the merits — of the administrative act issued by the Municipal Council contained in Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, by which the veto filed was resolved, on the basis of Articles 158, 182, 223, and 239 of the General Law of Public Administration. Consequently, and in light of the manner in which this matter is resolved, in accordance with the nullity declared in this ruling, the Municipal Council must guarantee, as part of the appeal proceeding, due process, for which it must observe at a minimum the following: 1) Recognize as procedural parties in the appellate phase the persons who processed administrative case files addressed in the vetoed resolution: case file PU-7159-2014 in the name of Mr. Rolando Muñoz Contreras and case file PU-7302-2015 in the name of Ms. Norma Porras Quirós; 2) Give a hearing to the parties joined to the veto filed against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 on January thirty-first, two thousand and twenty-six, by the Municipal Council of Puerto Jiménez; 3) Guarantee all procedural parties access to the case file for the exercise of their rights; 4) Obtain a means of notification from the new procedural parties; 5) Issue the ruling deciding the veto filed by the Municipal Mayor's Office, in which it identifies, enumerates, and resolves each and every one of the grievances and claims raised, as well as all counterarguments submitted by all parties involved; 6) Notify all participating parties of the decision on the veto filed. 7) Once the points ordered herein have been fulfilled, the Municipal Council must proceed with the steps required by law in order to consider the veto filed by the Municipal Mayor's Office as promptly as possible. In light of the manner in which this matter is resolved, no specific ruling is made on the grievances raised in the veto filed. Consequently, Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, by the Municipal Council — by which the veto filed against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 on January thirty-first, two thousand and twenty-six, by the Municipal Council of Puerto Jiménez is rejected — is annulled. The Municipal Council of Puerto Jiménez must list and resolve, one by one, the grievances expressed in the veto filed.\n\nIII.— Since these proceedings have been conducted before this Court in electronic form, the parties may obtain a complete copy containing both the administrative record submitted by the Municipal Corporation and all of the documents comprising the present appellate proceeding, for which they must provide an electronic storage device (USB drive or compact disc). Likewise, should any physical or electronic documentation (plans, photographs, reports, etc.) remain in the custody of this Court, the party who submitted it may retrieve it within a period of 30 business days, in accordance with Art. 12 of the «Regulations on Electronic Case Files before the Judiciary», approved by the Full Court (Corte Plena) at session n.° 27-11 of August 22, 2011, Article XXVI, and published in Judicial Gazette (Boletín Judicial) n.° 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) at session n.° 43-12, held on May 3, 2012, Article LXXXI.\n\nPor tanto\n\nOn the basis of Articles 158, 182, 223, and 239 of the General Law of Public Administration, the ruling contained in the administrative act issued by the Municipal Council of Puerto Jiménez, Article IX, Sub-item -15) of Ordinary Session number 78-2026, held on February 7, two thousand and twenty-six, by the Municipal Council — by which the veto filed against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 on January thirty-first, two thousand and twenty-six, by the Municipal Council of Puerto Jiménez is rejected — IS HEREBY ANNULLED ex officio. The Municipal Council is hereby ordered to take note of all that is set forth in Considerando II of this ruling. Once the following persons have been joined to the municipal proceeding: Mr. Rolando Muñoz Contreras (case file PU-7159-2014) and Ms. Norma Porras Quirós (case file PU-7302-2015), and once the time period granted in the hearing regarding the veto filed against Resolutions numbers 12 and 13 adopted at Ordinary Session number 77 on January thirty-first, two thousand and twenty-six, by the Municipal Council of Puerto Jiménez has elapsed, the Municipal Council must promptly resolve the veto filed, enumerating and resolving each and every one of the grievances and claims raised, as well as all counterarguments submitted by all parties involved. Once the points ordered herein have been fulfilled, the Municipal Council must proceed with the steps required by law. In light of the manner in which this matter is resolved, no specific ruling is made on the grievances raised in the veto filed. That is all. Notify the parties.
